          <heading>Simplified outline</heading>
          <content>
            <p>The following is a simplified outline of this Act and some related material:</p>
            <p>In certain circumstances, the Commonwealth will pay to a person an amount that <role refersTo="#secretary">the Secretary</role> considers is equal to an accommodation payment balance, and interest, owed to the person by a registered provider or former registered provider (see sections 10, 12, 13 and 16).</p>
            <p>Any rights that a person who is paid such an amount had to recover the amount from a registered provider or former registered provider are transferred to the Commonwealth (see <ref href="#sec-15">section 15</ref>).</p>
            <p>The Commonwealth may recoup certain costs it incurs from other registered providers (see sections 18 and 19 and the <i>Aged Care (</i><i>Accommodation Payment</i><i> Security) Levy Act 200</i><i>6</i>).</p>

        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Application of this Act</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>This Act applies in all the States and Territories.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>However, this Act does not apply in any external Territory, except Norfolk Island, the Territory of Christmas Island and the Territory of Cocos (Keeling) Islands.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Binding the Crown</heading>
          <subsection eId="part-1__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>This Act binds the Crown in each of its capacities.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p>This Act does not make the Crown liable to be prosecuted for an offence.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-6">
          <num>6</num>
          <heading>Definitions</heading>
          <subsection eId="part-1__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><term refersTo="#term-accommodation-bond">accommodation bond</term> has the same meaning as <def>in <ref href="">the Aged Care Act 2024</ref>.</def></p>
              <p><term refersTo="#term-accommodation-bond-balance">accommodation bond balance</term> has the same meaning as <def>in <ref href="">the Aged Care Act 2024</ref>.</def></p>
              <p><b><i>accommodation payment balance</i></b> means:</p>
            </content>
            <paragraph eId="part-1__sec-6__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a refundable deposit balance; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an accommodation bond balance; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>an entry contribution balance; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>an unregulated lump sum balance.</p>
              </content>
              <content>
                <p><term refersTo="#term-administrative-costs">administrative costs</term> means <def>costs incurred by the Commonwealth in relation to, and as the result of, the making of the default event declaration and includes, but is not limited to, costs incurred by the Commonwealth as a result of: making any insolvency event declaration under <ref href="#sec-7">section 7</ref> that enabled the making of the default event declaration; and giving notice of such an insolvency event declaration under <ref href="#sec-8">section 8</ref>; and giving notice of the default event declaration under <ref href="#sec-11">section 11</ref>; and determining matters under <ref href="#sec-12">section 12</ref> that were required to be determined as a result of the making of the default event declaration; and making any refund declarations under <ref href="#sec-13">section 13</ref> that were required to be made as a result of the making of the default event declaration; and making any refund declarations under <ref href="#sec-13A">section 13A</ref> that were permitted to be made as a result of the making of the default event declaration; and giving notice of those refund declarations under <ref href="#sec-14">section 14</ref>; and attempting to recover amounts that the Commonwealth gained the right to recover under <ref href="#sec-15">section 15</ref> as a result of the making of those refund declarations; and making refund costs recoupment determinations under <ref href="#sec-18">section 18</ref> relating to those refund declarations; and 	(i)	recovering levy that the Commonwealth was enabled, as a result of the making of those refund costs recoupment determinations, to impose by regulations made under <i>Aged Care (</i><i>Accommodation Payment</i><i> Security) Levy Act 200</i><i>6</i>.<ref href="#sec-6">section 6</ref> of the </def></p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>making any insolvency event declaration under <ref href="#sec-7">section 7</ref> that enabled the making of the default event declaration; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>giving notice of such an insolvency event declaration under <ref href="#sec-8">section 8</ref>; and</p>
              </content>
            </paragraph>

                <p>giving notice of the default event declaration under <ref href="#sec-11">section 11</ref>; and</p>

                <p>determining matters under <ref href="#sec-12">section 12</ref> that were required to be determined as a result of the making of the default event declaration; and</p>

              <content>
                <p>making any refund declarations under <ref href="#sec-13">section 13</ref> that were required to be made as a result of the making of the default event declaration; and</p>
              </content>
            </paragraph>

              <num>ea</num>
              <content>
                <p>making any refund declarations under <ref href="#sec-13A">section 13A</ref> that were permitted to be made as a result of the making of the default event declaration; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>giving notice of those refund declarations under <ref href="#sec-14">section 14</ref>; and</p>
              </content>
            </paragraph>

              <content>
                <p>attempting to recover amounts that the Commonwealth gained the right to recover under <ref href="#sec-15">section 15</ref> as a result of the making of those refund declarations; and</p>

              <content>
                <p>making refund costs recoupment determinations under <ref href="#sec-18">section 18</ref> relating to those refund declarations; and</p>

              <num>i</num>
              <content>
                <p>	(i)	recovering levy that the Commonwealth was enabled, as a result of the making of those refund costs recoupment determinations, to impose by regulations made under <i>Aged Care (</i><i>Accommodation Payment</i><i> Security) Levy Act 200</i><i>6</i>.<ref href="#sec-6">section 6</ref> of the </p>
              </content>
              <content>
                <p><term refersTo="#term-administrative-costs-recoupment-determination">administrative costs recoupment determination</term> means <def>a determination made under <ref href="#sec-19">section 19</ref>.</def></p>
                <p><term refersTo="#term-aged-care-service">aged care service</term> has the meaning given by <def>the Dictionary in Schedule 1 to <ref class="unresolved">the Aged Care Act 1997</ref>.</def></p>
                <p><term refersTo="#term-approved-provider">approved provider</term> has the same meaning as <def>in <ref class="unresolved">the Aged Care Quality and Safety Commission Act 2018</ref>.</def></p>
                <p><term refersTo="#term-approved-residential-care-home">approved residential care home</term> has the same meaning as <def>in <ref href="">the Aged Care Act 2024</ref>.</def></p>
                <p><b><i>Australia</i></b>, when used in a geographical sense,<b><i> </i></b>includes Norfolk Island, the Territory of Cocos (Keeling) Islands and the Territory of Christmas Island.</p>
                <p><term refersTo="#term-corporation">corporation</term> means <def>a trading or financial corporation within the meaning of paragraph 51(xx) of the Constitution.</def></p>
                <p><term refersTo="#term-default-event-declaration">default event declaration</term> means <def>a declaration made under <ref href="#sec-10">section 10</ref>.</def></p>
                <p><b><i>entry</i></b>, in relation to a person and an aged care service, has the meaning given by the Dictionary in Schedule 1 to the <i>Aged Care Act 1997</i>.</p>
                <p><term refersTo="#term-entry-contribution">entry contribution</term> has the same meaning as <def>in <ref href="">the Aged Care Act 2024</ref>.</def></p>
                <p><term refersTo="#term-entry-contribution-balance">entry contribution balance</term> has the same meaning as <def>in <ref href="">the Aged Care Act 2024</ref>.</def></p>
                <p><term refersTo="#term-finance-minister">Finance Minister</term> means <def>the Minister who administers the Public Governance, Performance and Accountability Act 2013.</def></p>
                <p><term refersTo="#term-flexible-care">flexible care</term> has the meaning given by <def>the Dictionary in Schedule 1 to <ref class="unresolved">the Aged Care Act 1997</ref>.</def></p>
                <p><term refersTo="#term-flexible-care-service">flexible care service</term> has the meaning given by <def>the Dictionary in Schedule 1 to <ref class="unresolved">the Aged Care Act 1997</ref>.</def></p>
                <p><term refersTo="#term-formal-agreement">formal agreement</term> has the same meaning as <def>in the rules made under the Aged Care (Consequential and Transitional Provisions) Act 2024.</def></p>
                <p><term refersTo="#term-funded-aged-care-service">funded aged care service</term> has the same meaning as <def>in <ref href="">the Aged Care Act 2024</ref>.</def></p>
                <p><b><i>insolvency event</i></b>: each of the following events is an <b><i>insolvency event</i></b> that may occur in relation to a person who is or has been a registered provider (the <b><i>registered provider or former registered provider</i></b>):</p>

            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a CGT event G3 (within the meaning of the <i>Income Tax Assessment Act 1997</i>) in respect of shares or financial instruments of the registered provider or former registered provider;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the making of an order:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>	(i)	under <i>Corporations Act</i><i> </i><i>2001</i>; or<ref href="#sec-459A">section 459A</ref> or 459B of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>under a provision of the law of a State, or Territory, which deals with the incorporation of associations;</p>
              </content>
              <content>
                <p>that the registered provider or former registered provider be wound up in insolvency;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the passing of a special resolution:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>	(i)	under <i>Corporations Act 2001</i>; or<ref href="#sec-491">section 491</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>under a provision of the law of a State, or Territory, which deals with the incorporation of associations;</p>
              </content>
              <content>
                <p>that the registered provider or former registered provider be wound up voluntarily;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>	(d)	the passing of a resolution under paragraph 439C(c) of the <i>Corporations Act 2001</i> by the creditors of the registered provider or former registered provider that the registered provider or former registered provider be wound up;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>the making of a sequestration order against the estate of the registered provider or former registered provider;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>	(f)	the acceptance of a debtor’s petition (within the meaning of the <i>Bankruptcy Act 1966</i>) against the registered provider or former registered provider by an Official Receiver (within the meaning of that Act);</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-g">
              <num>g</num>
              <content>
                <p>the making of an insolvency event declaration in relation to the registered provider or former registered provider (see <ref href="#sec-7">section 7</ref>);</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-h">
              <num>h</num>
              <content>
                <p>	(h)	the making of a debt agreement (within the meaning of the <i>Bankruptcy Act 1966</i>) to which the registered provider or former registered provider is a party in the capacity of a debtor;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>	(i)	the execution of a personal insolvency agreement (within the meaning of the <i>Bankruptcy Act 1966</i>) by the registered provider or former registered provider in the capacity of a debtor.</p>
              </content>
              <content>
                <p><term refersTo="#term-insolvency-event-declaration">insolvency event declaration</term> means <def>a declaration made under <ref href="#sec-7">section 7</ref>.</def></p>
                <p><term refersTo="#term-national-newspaper">national newspaper</term> means <def>a newspaper circulating generally throughout Australia.</def></p>
                <p><term refersTo="#term-outstanding-accommodation-payment-balance">outstanding accommodation payment balance</term> has the meaning given by <def>subsection (2).</def></p>
                <p><term refersTo="#term-refundable-deposit-balance">refundable deposit balance</term> has the same meaning as <def>in <ref href="">the Aged Care Act 2024</ref>.</def></p>
                <p><term refersTo="#term-refund-amount">refund amount</term> means <def>the amount that the refund declaration declares is to be paid by the Commonwealth.</def></p>
                <p><term refersTo="#term-refund-costs-recoupment-determination">refund costs recoupment determination</term> means <def>a determination made under <ref href="#sec-18">section 18</ref>.</def></p>
                <p><term refersTo="#term-refund-declaration">refund declaration</term> means <def>a declaration made under <ref href="#sec-13">section 13</ref> or 13A.</def></p>
                <p><term refersTo="#term-refund-recipient">refund recipient</term> means <def>the person that the refund declaration declares is to be paid an amount by the Commonwealth.</def></p>
                <p><term refersTo="#term-registered-provider">registered provider</term> has the same meaning as <def>in <ref href="">the Aged Care Act 2024</ref>.</def></p>
                <p><term refersTo="#term-residential-care">residential care</term> has the meaning given by <def>the Dictionary in Schedule 1 to <ref class="unresolved">the Aged Care Act 1997</ref>.</def></p>
                <p><term refersTo="#term-residential-care-service">residential care service</term> has the meaning given by <def>the Dictionary in Schedule 1 to <ref class="unresolved">the Aged Care Act 1997</ref>.</def></p>
                <p><term refersTo="#term-respite-care">respite care</term> has the meaning given by <def>the Dictionary in Schedule 1 to <ref class="unresolved">the Aged Care Act 1997</ref>.</def></p>
                <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>
                <p><term refersTo="#term-unregulated-lump-sum">unregulated lump sum</term> has the meaning given by <def>subsection (3).</def></p>
                <p><b><i>unregulated lump sum balance</i></b>, in relation to an unregulated lump sum is, at a particular time, an amount equal to the difference between:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the amount of the unregulated lump sum; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>any amounts that have been, or are permitted to be, deducted at that time under the agreement under which the unregulated lump sum was paid.</p>
              </content>
              <content>
                <p>Outstanding accommodation payment balance</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	For the purposes of this Act, an accommodation payment balance is an <b><i>outstanding accommodation payment balance</i></b> at a particular time of a person who is or has been a registered provider if:</p>
            </content>
            <paragraph eId="part-1__sec-6__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>at that time all, or part, of the accommodation payment balance has not been refunded; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-2__para-aa">
              <num>aa</num>
              <content>
                <p>	(aa)	in relation to a refundable deposit balance—that time is later than the time required for payment of the balance to be refunded by the person under <i>Aged Care Act 2024</i>; and<ref href="#sec-311">section 311</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>in relation to an accommodation bond balance or entry contribution balance—that time is later than the time required for the balance to be refunded by the person under:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>	(i)	for accommodation bond balances—the rules made under the <i>Aged Care Act 2024</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>for entry contribution balances—a formal agreement applying in respect of the balance; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>in relation to an unregulated lump sum—that time is later than the earlier of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>	(i)	the start of the first day on which the person (the <b><i>unregulated lump sum holder</i></b>) to whom the amount was paid is obliged, under the agreement under which it was paid, to refund the amount or part of the amount;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>the end of a period of 14 days beginning immediately after the day on which the individual in relation to whose entry to a residential care service or flexible care service the amount of the unregulated lump sum was paid ceased accessing relevant funded aged care services for the unregulated lump sum (see subsection 2A).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-2A">
            <num>2A</num>
            <content>
              <p>	(2A)	For the purposes of subparagraph 6(2)(c)(ii), <b><i>relevant funded aged care services</i></b> for an unregulated lump sum means funded aged care services:</p>
            </content>
            <paragraph eId="part-1__sec-6__subsec-2A__para-a">
              <num>a</num>
              <content>
                <p>delivered by the registered provider that holds the unregulated lump sum; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-2A__para-b">
              <num>b</num>
              <content>
                <p>	(b)	delivered in an approved residential care home, being the approved residential care home that was, immediately before the commencement of the <i>Aged Care Act 2024</i>, the place of the residential care service or flexible care service in relation to which the unregulated lump sum was paid.</p>
              </content>
              <content>
                <p>What is an unregulated lump sum?</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	An <b><i>unregulated lump sum </i></b>is an amount of money paid to a person (the <b><i>unregulated lump sum holder</i></b>) in the following circumstances:</p>
            </content>
            <paragraph eId="part-1__sec-6__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the amount is paid to the unregulated lump sum holder by a care recipient under a written agreement for the care recipient’s entry to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>a residential care service through which residential care other than respite care is, or is to be, provided by the unregulated lump sum holder; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>a flexible care service through which flexible care is, or is to be, provided by the unregulated lump sum holder;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the amount does not accrue daily;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>under the agreement, the amount, or part of the amount, must be refunded to the care recipient if the unregulated lump sum holder ceases to provide residential care or flexible care (as the case requires) to the care recipient;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>the unregulated lump sum holder was an approved provider immediately before <date date="2009-01-01">1 January 2009</date>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-3__para-e">
              <num>e</num>
              <content>
                <p>the amount was paid to the unregulated lump sum holder before <date date="2009-01-01">1 January 2009</date> and before the unregulated lump sum holder began to be an approved provider;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-3__para-f">
              <num>f</num>
              <content>
                <p>the amount is not an entry contribution;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-6__subsec-3__para-g">
              <num>g</num>
              <content>
                <p>the care recipient did not cease to be provided with residential care through the residential care service, or flexible care through the flexible care service (as the case requires), after the amount was paid but before the unregulated lump sum holder began to be an approved provider.</p>
              </content>

          <heading>References to the Aged Care Act 1997</heading>

              <p>	(1)	An expression used in a provision of this Act and in the <i>Aged Care Act 1997</i> has the same meaning in that provision as it had in that Act immediately before the commencement of the <i>Aged Care Act 2024</i>.</p>

              <p>Subsections (1) and (2) are subject to a contrary intention.</p>

              <p><role refersTo="#minister">The Minister</role> may make an insolvency event declaration in relation to a person who is or has been a registered provider if:</p>
            </content>
            <paragraph eId="part-2__sec-7__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the person is a Chapter 5 body corporate (within the meaning of the <i>Corporations Act 2001</i>); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>there is at least one outstanding accommodation payment balance of the person.</p>
              </content>

              <p>An insolvency event declaration is not a legislative instrument.</p>

          </subsection>

              <p><role refersTo="#secretary">The Secretary</role> must give a copy of an insolvency event declaration to the person to whom the insolvency event declaration relates.</p>

          </subsection>

            <content>
              <p>A failure to comply with subsection (1) does not affect the validity of any insolvency event declaration.</p>
            </content>
          </subsection>

        <heading>Requirement to notify Secretary of certain insolvency events</heading>

          <heading>Notice of certain insolvency events</heading>
          <subsection eId="part-3__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-3__sec-9__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a person is a registered provider; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-9__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	any of the events mentioned in paragraph (a), (b), (c), (d), (e), (f), (h) or (i) of the definition of <b><i>insolvency event </i></b>occur in relation to the person;</p>
              </content>
              <content>
                <p>the person must notify <role refersTo="#secretary">the Secretary</role> the first time that the event occurs.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-3__sec-9__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a person has been, but is no longer, a registered provider; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-9__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>	(b)	any of the events mentioned in paragraph (a), (b), (c), (d), (e), (f), (h) or (i) of the definition of <b><i>insolvency event </i></b>occur in relation to the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-9__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>there was at least one outstanding accommodation payment balance of the person at the time the event occurs;</p>
              </content>
              <content>
                <p>the person must notify <role refersTo="#secretary">the Secretary</role> the first time that the event occurs.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-9__subsec-3">
            <num>3</num>
            <content>
              <p>The notification under subsection (1) or (2) must be given in writing by the end of the first business day after the day on which the event occurs.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-9__subsec-4">
            <num>4</num>
            <content>
              <p>A person commits an offence if the person refuses or fails to comply with a requirement under this section.</p>
            </content>

              <p>As soon as practicable after <role refersTo="#secretary">the Secretary</role> first becomes aware that:</p>
            </content>
            <paragraph eId="part-4__sec-10__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	an insolvency event has occurred in relation to a person who is or has been a registered provider (the <b><i>registered provider or former registered provider</i></b>); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-10__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>there is at least one outstanding accommodation payment balance of the registered provider or former registered provider;</p>
              </content>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> must make a default event declaration.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-10__subsec-2">
            <num>2</num>
            <content>
              <p>The default event declaration must:</p>
            </content>
            <paragraph eId="part-4__sec-10__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>be in writing; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-10__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>state that an insolvency event has occurred in relation to the registered provider or former registered provider; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-10__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>state that <role refersTo="#secretary">the Secretary</role> considers that there is at least one outstanding accommodation payment balance of the registered provider or former registered provider.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-10__subsec-3">
            <num>3</num>
            <content>
              <p>A default event declaration is not a legislative instrument.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-11">
          <num>11</num>
          <heading>Notice of default event declaration</heading>
          <subsection eId="part-4__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> must give a copy of a default event declaration to:</p>
            </content>
            <paragraph eId="part-4__sec-11__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the registered provider or former registered provider in relation to which the declaration states an insolvency event has occurred; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-11__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>each person whom <role refersTo="#secretary">the Secretary</role> considers may be entitled to receive a refund of an outstanding accommodation payment balance of the registered provider or former registered provider.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> must publish a copy of a default event declaration in a national newspaper.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-11__subsec-3">
            <num>3</num>
            <content>
              <p>A failure to comply with subsection (1) or (2) does not affect the validity of any default event declaration.</p>
            </content>
          </subsection>
        </section>
      </part>
      <part eId="part-5">
        <num>5</num>
        <heading>Refund declaration</heading>
        <section eId="part-5__sec-12">
          <num>12</num>
          <heading>Secretary to determine certain matters</heading>
          <subsection eId="part-5__sec-12__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	If the Secretary has made a default event declaration stating that an insolvency event has occurred in relation to a person who is or has been a registered provider (the <b><i>registered provider or former registered provider</i></b>), the Secretary must identify each accommodation payment balance that:</p>
            </content>
            <paragraph eId="part-5__sec-12__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>was an outstanding accommodation payment balance of the registered provider or former registered provider at the time that the default event declaration was made; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-12__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>later becomes an outstanding accommodation payment balance of the registered provider or former registered provider.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-12__subsec-2">
            <num>2</num>
            <content>
              <p>In respect of each accommodation payment balance identified by <role refersTo="#secretary">the Secretary</role> under subsection (1), <role refersTo="#secretary">the Secretary</role> must determine:</p>
            </content>
            <paragraph eId="part-5__sec-12__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the date on which the accommodation payment balance became an outstanding accommodation payment balance; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-12__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the amount that <role refersTo="#secretary">the Secretary</role> considers is equal to the amount of the accommodation payment balance that had not been refunded at the time <role refersTo="#secretary">the Secretary</role> makes the determination; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-12__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>	(c)	the amount that the Secretary considers is equal to the amount representing interest on the amount determined under paragraph (b), worked out in accordance with the rules made for the purposes of <i>Aged Care Act 2024</i> under section 602 of that Act, that has accrued at the time that the Secretary determines the amount under paragraph (b); and<ref href="#sec-313">section 313</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-12__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>the person to whom <role refersTo="#secretary">the Secretary</role> considers the registered provider or former registered provider was required to refund the accommodation payment balance at the time that it became an outstanding accommodation payment balance; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-12__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>the method that <role refersTo="#secretary">the Secretary</role> considers would be most appropriate for the Commonwealth to use to pay a refund amount to the person mentioned in paragraph (d).</p>
              </content>
              <content>
                <p>Where all or part of a refund is clawed back as a result of insolvency or bankruptcy</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-12__subsec-3">
            <num>3</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-5__sec-12__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>before the determination is made, part of an accommodation payment balance is refunded; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-12__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>in a case where the registered provider or former registered provider is a corporation:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-12__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>	(i)	a transaction under which the refund took place is a voidable transaction under subsection 588FE(2), (2A), (2B) or (6B) of the <i>Corporations Act 2001</i>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-12__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>the liquidator takes action, including but not limited to the making of an application under <ref href="#sec-588F">section 588F</ref>F of that Act or a request under subsection 588FGAA(2) of that Act, as a result of which the person to whom the refund was made does not retain the value of the refund, or part of the value of the refund; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-12__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>in a case where the registered provider or former registered provider is not a corporation:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-12__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>	(i)	a transfer of any property for the purposes of giving the refund is void under <i>Bankruptcy Act</i><i> </i><i>1966</i>; and<ref href="#sec-122">section 122</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-12__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p><role refersTo="#trustee">the trustee</role> in bankruptcy takes action as a result of which the person to whom the refund was made does not retain the value of the refund, or part of the value of the refund;</p>
              </content>
              <content>
                <p>then, for the purposes of paragraph (2)(b), to the extent that the person to whom the refund was made does not retain the value of the refund, the refund is taken not to have been made.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-5__sec-13">
          <num>13</num>
          <heading>Making of refund declaration</heading>
          <subsection eId="part-5__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	As soon as practicable after the Secretary has determined the matters mentioned in subsection 12(2) in respect of an outstanding accommodation payment balance of a person who is or has been a registered provider (the <b><i>registered provider or former registered provider</i></b>), the Secretary must make a refund declaration relating to the outstanding accommodation payment balance.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-13__subsec-2">
            <num>2</num>
            <content>
              <p>The refund declaration must:</p>
            </content>
            <paragraph eId="part-5__sec-13__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>be in writing; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-13__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>specify the registered provider or former registered provider that has not refunded all, or part, of the relevant outstanding accommodation payment balance; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-13__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>declare that the Commonwealth is to pay an amount equal to the sum of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-13__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>the amount determined under paragraph 12(2)(b); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-13__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>the amount determined under paragraph 12(2)(c);</p>
              </content>
              <content>
                <p>to the person determined under paragraph 12(2)(d).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-13__subsec-3">
            <num>3</num>
            <content>
              <p>A refund declaration is not a legislative instrument.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-13A">
          <num>13A</num>
          <heading>Additional refund declaration where refund by registered provider or former registered provider void or voidable</heading>
          <subsection eId="part-5__sec-13A__subsec-1">
            <num>1</num>
            <content>
              <p>This section applies if:</p>
            </content>
            <paragraph eId="part-5__sec-13A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a person who is or has been a registered provider (the <b><i>registered provider or former registered provider</i></b>) refunds part of an accommodation payment balance (the <b><i>initial refund</i></b>); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-13A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>after the initial refund, <role refersTo="#secretary">the Secretary</role>, under paragraph 12(2)(b), determines the amount that <role refersTo="#secretary">the Secretary</role> considers is equal to the amount of the accommodation payment balance that has not been refunded at the time <role refersTo="#secretary">the Secretary</role> makes the determination; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-13A__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a refund declaration is made under <ref href="#sec-13">section 13</ref> in reliance on that determination; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-13A__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>in a case where the registered provider or former registered provider is a corporation:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-13A__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>	(i)	a transaction under which the initial refund took place is a voidable transaction under subsection 588FE(2), (2A), (2B) or (6B) of the <i>Corporations Act 2001</i>; and</p>
              </content>
            </paragraph>

                <p>	(i)	a transfer of any property for the purposes of giving the initial refund is void under <i>Bankruptcy Act 1966</i>; and<ref href="#sec-122">section 122</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-13A__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p><role refersTo="#trustee">the trustee</role> in bankruptcy takes action as a result of which the person to whom the initial refund was made does not retain the value of the initial refund, or part of the value of the initial refund.</p>

            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-13A__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may:</p>
            </content>
            <paragraph eId="part-5__sec-13A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>determine the amount that <role refersTo="#secretary">the Secretary</role> considers is equal to the amount of the value of the initial refund that has not been retained by the person to whom it was made; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-13A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>as soon as practicable after <role refersTo="#secretary">the Secretary</role> has determined that matter, make another refund declaration relating to the outstanding accommodation payment balance.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-13A__subsec-3">
            <num>3</num>
            <content>
              <p>The refund declaration must:</p>
            </content>
            <paragraph eId="part-5__sec-13A__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>be in writing; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-13A__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>specify the registered provider or former registered provider who has not refunded all, or part, of the relevant outstanding accommodation payment balance; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-13A__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>declare that the Commonwealth is to pay an amount equal to the amount determined under paragraph (2)(a).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-13A__subsec-4">
            <num>4</num>
            <content>
              <p>The refund declaration is not a legislative instrument.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-14">
          <num>14</num>
          <heading>Notice of refund declaration</heading>
          <subsection eId="part-5__sec-14__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> must give a copy of a refund declaration to:</p>
            </content>
            <paragraph eId="part-5__sec-14__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the refund recipient; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-14__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the registered provider or former registered provider specified in the refund declaration.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-14__subsec-2">
            <num>2</num>
            <content>
              <p>A failure to comply with subsection (1) does not affect the validity of any refund declaration.</p>
            </content>
          </subsection>
        </section>
      </part>

        <heading>Transfer of rights and payments of refund amounts</heading>
        <section eId="part-6__sec-15">
          <num>15</num>
          <heading>Transfer of recovery rights to Commonwealth</heading>
          <content>
            <p>Immediately after <role refersTo="#secretary">the Secretary</role> makes a refund declaration, any rights that the refund recipient had when the refund declaration was made to recover an amount equal to the refund amount from the registered provider or former registered provider specified in the refund declaration are, by force of this section, transferred to the Commonwealth.</p>
          </content>

              <p>Note:	Any rights that the refund recipient has to receive from the registered provider or former registered provider any additional amounts are not transferred to the Commonwealth by force of this section.</p>

          <heading>Payments by Commonwealth</heading>
          <content>
            <p><quantity refersTo="#deadline">Within 14 days</quantity> after the Secretary makes a refund declaration, the Commonwealth must pay the refund amount to the refund recipient.</p>
          </content>
        </section>

          <num>17</num>
          <heading>Appropriation</heading>
          <content>
            <p>The amounts payable under <ref href="#sec-16">section 16</ref> are to be paid out of the Consolidated Revenue Fund, which is appropriated accordingly.</p>
          </content>
        </section>

        <heading>Costs recoupment determinations</heading>
        <section eId="part-7__sec-18">
          <num>18</num>
          <heading>Making of refund costs recoupment determination</heading>
          <subsection eId="part-7__sec-18__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, at a particular time, make a refund costs recoupment determination relating to one or more refund declarations if:</p>
            </content>
            <paragraph eId="part-7__sec-18__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>before that time, <role refersTo="#minister">the Minister</role> has informed the Treasurer and the Finance Minister that <role refersTo="#minister">the Minister</role> intends to make a refund costs recoupment determination relating to those refund declarations; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-18__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>at that time, the Commonwealth has not recovered all of each refund amount in relation to those refund declarations; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-18__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>at that time, the Commonwealth has not previously made a refund costs recoupment determination relating to each of those refund declarations.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-18__subsec-2">
            <num>2</num>
            <content>
              <p>A refund costs recoupment determination must:</p>
            </content>
            <paragraph eId="part-7__sec-18__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>be in writing; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-18__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>specify the refund declarations to which the determination relates; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-18__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>specify the costs recoupment amount (see subsection (3)); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-18__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>specify the default event declaration to which the determination relates (see subsection (4)).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-18__subsec-3">
            <num>3</num>
            <content>
              <p>The costs recoupment amount specified in a refund costs recoupment determination is the amount equal to the sum of each refund amount that:</p>
            </content>
            <paragraph eId="part-7__sec-18__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>is specified in a refund declaration specified in the determination; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-18__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>has not been recovered by the Commonwealth at the time the determination is made.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-18__subsec-4">
            <num>4</num>
            <content>
              <p>A default event declaration is a default event declaration to which a refund costs recoupment determination relates if the making of the default event declaration was a precondition of the making of the refund declarations specified in the refund costs recoupment determination.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-18__subsec-5">
            <num>5</num>
            <content>
              <p>A refund costs recoupment determination is not a legislative instrument.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-7__sec-19">
          <num>19</num>
          <heading>Making of administrative costs recoupment determination</heading>
          <subsection eId="part-7__sec-19__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, at a particular time, make an administrative costs recoupment determination relating to a default event declaration if:</p>

            <paragraph eId="part-7__sec-19__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>before that time, <role refersTo="#minister">the Minister</role> has informed the Treasurer and the Finance Minister that <role refersTo="#minister">the Minister</role> intends to make an administrative costs recoupment determination relating to that default event declaration; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-19__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>at that time, <role refersTo="#minister">the Minister</role> considers, on reasonable grounds, that the Commonwealth has not recouped all of the administrative costs relating to the default event determination.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-19__subsec-2">
            <num>2</num>
            <content>
              <p>An administrative costs recoupment determination must:</p>
            </content>
            <paragraph eId="part-7__sec-19__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>be in writing; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-19__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>specify the default event declaration to which it relates; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-19__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>specify the costs recoupment amount (see subsection (3)).</p>
              </content>
            </paragraph>
          </subsection>

              <p>The costs recoupment amount specified in an administrative costs recoupment determination must not exceed the sum of:</p>

                <p>the amount that <role refersTo="#minister">the Minister</role> considers, on reasonable grounds, is equal to the amount of the administrative costs relating to the default event declaration specified in the determination that the Commonwealth has not recouped at the time that the determination is made; and</p>

              <num>b</num>

                <p>	(b)	the amount that the Minister considers, on reasonable grounds, is likely to cover the costs of recovering levy that the Commonwealth will be enabled to impose by regulations made under <i>Aged Care (</i><i>Accommodation Payment</i><i> Security) Levy Act 200</i><i>6</i> as a result of the making of the determination.<ref href="#sec-6">section 6</ref> of the </p>

                <p>Amending laws are annotated in the legislation history and amendment history.</p>
                <p>The legislation history in endnote 3 provides information about each law that has amended (or will amend) the compiled law. The information includes commencement details for amending laws and details of any application, saving or transitional provisions that are not included in this compilation.</p>
                <p>The amendment history in endnote 4 provides information about amendments at the provision (generally section or equivalent) level. It also includes information about any provision of the compiled law that has been repealed in accordance with a provision of the law.</p>

                  <b>Editorial changes</b>
                </p>
                <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
                <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>
                <p>
                  <b>Misdescribed amendments</b>
                </p>
                <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
                <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
