          <num>4</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><b><i>account</i></b> includes:</p>
          </content>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>a free account; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>a pre-paid account; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">
            <num>c</num>
            <content>
              <p>anything that may reasonably be regarded as the equivalent of an account.</p>
            </content>
            <content>
              <p><term refersTo="#term-acma">ACMA</term> means <def>the Australian Communications and Media Authority.</def></p>
              <p><b><i>acquire</i></b>, when used in relation to goods or services, has the same meaning as in the <i>Competition and Consumer Act 2010</i>.</p>
              <p><b><i>agency</i></b> includes:</p>

            <num>a</num>
            <content>
              <p>an armed force; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>a police force.</p>

            <content>
              <p><term refersTo="#term-australia">Australia</term> means <def>the Commonwealth of Australia and, when used in a geographical sense, includes the eligible Territories, but does not include any other external Territory.</def></p>
              <p><term refersTo="#term-australian-number">Australian number</term> means <def>a number that is: specified in: 	(i)	the numbering scheme referred to in <i>Telecommunications Act 1997</i>; or<ref href="#sec-454A">section 454A</ref> of the  the numbering plan referred to in <ref href="#sec-455">section 455</ref> of that Act; and for use in connection with the supply of carriage services to the public in Australia, <ref href="#sec-456__subsec-2">within the meaning of subsection 456(2)</ref> of that Act. <b><i>authorise</i></b>: when used in relation to the making of a telemarketing call—has a meaning affected by clause 6 of Schedule 1; or when used in relation to the sending of a marketing fax—has a meaning affected by clause 6 of Schedule 1A.</def></p>

              <p>specified in:</p>

              <p>the numbering plan referred to in <ref href="#sec-455">section 455</ref> of that Act; and</p>

          </paragraph>

            <content>
              <p>for use in connection with the supply of carriage services to the public in Australia, <ref href="#sec-456__subsec-2">within the meaning of subsection 456(2)</ref> of that Act.</p>

            <content>
              <p><b><i>authorise</i></b>:</p>
            </content>
          </paragraph>

            <num>a</num>
            <content>
              <p>when used in relation to the making of a telemarketing call—has a meaning affected by clause 6 of Schedule 1; or</p>
            </content>
          </paragraph>

            <content>
              <p>when used in relation to the sending of a marketing fax—has a meaning affected by clause 6 of Schedule 1A.</p>
            </content>
            <content>
              <p><b><i>authorised officer</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>the Chair of the ACMA; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>a member of the staff of the ACMA appointed under clause 8 of Schedule 3.</p>
            </content>
            <content>
              <p><term refersTo="#term-business">business</term> includes <def>a venture or concern in trade or commerce, whether or not conducted on a regular, repetitive or continuous basis.</def></p>
              <p><term refersTo="#term-business-number">business number</term> means <def>an Australian number other than a number that is used, or maintained, exclusively or primarily for private or domestic purposes.</def></p>
              <p><term refersTo="#term-candidate">candidate</term> means <def>a person who has been nominated as a candidate under: 	(a)	the <i>Commonwealth Electoral Act 1918</i>; or a law of a State or Territory that deals with electoral matters.</def></p>

          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>	(a)	the <i>Commonwealth Electoral Act 1918</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>a law of a State or Territory that deals with electoral matters.</p>
            </content>
            <content>
              <p><term refersTo="#term-carriage-service">carriage service</term> has the same meaning as <def>in <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><b><i>cause</i></b>:</p>

              <p><term refersTo="#term-data-processing-device">data processing device</term> has the same meaning as <def>in <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><b><i>dealing with</i></b>:</p>

              <p><term refersTo="#term-designated-telemarketing-call">designated telemarketing call</term> has the meaning given by <def>Schedule 1.</def></p>
              <p><term refersTo="#term-director">director</term> includes <def>a member of the governing body of an organisation.</def></p>
              <p><term refersTo="#term-do-not-call-register">Do Not Call Register</term> means <def>the register kept under <ref href="#sec-13">section 13</ref>.</def></p>
              <p><b><i>educational institution</i></b> includes:</p>

              <p><b><i>eligible Territory</i></b> means:</p>

              <p><b><i>give effect to</i></b>, in relation to a contract, arrangement or understanding, includes do an act or thing:</p>

              <p><term refersTo="#term-marketing-fax">marketing fax</term> has the meaning given by <def><ref href="#sec-5B">section 5B</ref>.</def></p>
              <p><term refersTo="#term-mistake">mistake</term> means <def>reasonable mistake of fact.</def></p>
              <p><term refersTo="#term-nominee">nominee</term> has the meaning given by <def><ref href="#sec-39">section 39</ref>.</def></p>
              <p><b><i>organisation</i></b> includes:</p>

              <p>if a call covered by paragraph (a) or (b) is not practical for a particular recipient with a disability (for example, because the recipient has a hearing impairment)—a call that is equivalent to a call covered by either of those paragraphs;</p>

              <p>whether or not the recipient responds by way of pressing buttons on a telephone handset or similar thing.</p>

          </paragraph>

          <heading>Telemarketing calls</heading>
          <content>
            <p>Basic definition</p>
          </content>
          <subsection eId="part-1__sec-5__subsec-1">

              <p>	(1)	For the purposes of this Act, a <b><i>telemarketing call</i></b> is a voice call to an Australian number, where, having regard to:</p>

                <p>the content of the call; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-b">

                <p>the presentational aspects of the call; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the content that can be obtained using the numbers, URLs or contact information (if any) mentioned in the call; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>if the number from which the call is made is disclosed to the recipient (whether by calling line identification or otherwise)—the content (if any) that can be obtained by calling that number;</p>
              </content>

                <p>it would be concluded that the purpose, or one of the purposes, of the call is:</p>

              <p>For the purposes of paragraphs (1)(e) to (m), it is immaterial whether the goods, services, land, interest or opportunity exists.</p>

          </subsection>
          <subsection eId="part-1__sec-5__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of paragraphs (1)(e) to (m), it is immaterial whether it is lawful to acquire the goods, services, land or interest or take up the opportunity.</p>
            </content>
          </subsection>

            <content>
              <p>Either of the following:</p>
            </content>

              <p>Excluded calls—regulations</p>

            <p>		A reference in this Act to a <b><i>fax</i></b> is a reference to a fax, whether or not:</p>

              <p>the fax is a facsimile of a physical document; or</p>
            </content>
          </paragraph>

              <p>the sending of the fax involves the use of:</p>

                <p>the other person, or an employee or agent of the other person, gives effect to the contract, arrangement or understanding by making a telemarketing call;</p>

              <p>Paragraph (9)(a) applies to contracts or arrangements entered into, or understandings arrived at, before, at or after the commencement of this section.</p>

          <heading>Agreements for the making of telemarketing calls must require compliance with this Act</heading>
          <subsection eId="part-2__sec-12__subsec-1">

              <p>	(1)	A person (the <b><i>first person</i></b>) must not enter into a contract or arrangement, or arrive at an understanding, with another person, if:</p>
            </content>
            <paragraph eId="part-2__sec-12__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>there is a reasonable likelihood that the other person will give effect to the contract, arrangement or understanding by:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>making telemarketing calls; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>causing any or all of the employees or agents of the other person to make telemarketing calls; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>there is a reasonable likelihood that some or all of those calls will be made to Australian numbers that, under <ref href="#sec-14">section 14</ref>, are eligible to be entered on the Do Not Call Register; and</p>

            </paragraph>

              <num>c</num>
              <content>
                <p>the contract, arrangement or understanding does not contain an express provision to the effect that the other person will:</p>

                <p>in any case—comply with this Act; and</p>
              </content>
            </paragraph>

                <p>if subparagraph (a)(ii) applies—take all reasonable steps to ensure that the employees and agents of the other person comply with this Act;</p>

                <p>in relation to the making of telemarketing calls that are made in order to give effect to the contract, arrangement or understanding.</p>

              <p>For the purposes of this section, if:</p>
            </content>
            <paragraph eId="part-2A__sec-12B__subsec-10__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a person (the <b><i>first person</i></b>) enters into a contract or arrangement, or arrives at an understanding, with another person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-12B__subsec-10__para-c">
              <num>c</num>
              <content>
                <p>the other person, or an employee or agent of the other person, gives effect to the contract, arrangement or understanding by sending a marketing fax;</p>
              </content>
              <content>
                <p>the first person is taken to have <b><i>caused</i></b> the marketing fax to be sent.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2A__sec-12B__subsec-11">
            <num>11</num>
            <content>
              <p>Paragraph (10)(a) applies to contracts or arrangements entered into, or understandings arrived at, before, at or after the commencement of this section.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2A__sec-12C">
          <num>12C</num>
          <heading>Agreements for the sending of marketing faxes must require compliance with this Act</heading>
          <subsection eId="part-2A__sec-12C__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	A person (the <b><i>first person</i></b>) must not enter into a contract or arrangement, or arrive at an understanding, with another person, if:</p>
            </content>
            <paragraph eId="part-2A__sec-12C__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>there is a reasonable likelihood that the other person will give effect to the contract, arrangement or understanding by:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-12C__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>sending marketing faxes; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-12C__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>causing any or all of the employees or agents of the other person to send marketing faxes; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-12C__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>there is a reasonable likelihood that some or all of those faxes will be sent to Australian numbers that, under <ref href="#sec-14">section 14</ref>, are eligible to be entered on the Do Not Call Register; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-12C__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the contract, arrangement or understanding does not contain an express provision to the effect that the other person will:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-12C__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>in any case—comply with this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-12C__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>if subparagraph (a)(ii) applies—take all reasonable steps to ensure that the employees and agents of the other person comply with this Act;</p>
              </content>
              <content>
                <p>in relation to the sending of marketing faxes that are sent in order to give effect to the contract, arrangement or understanding.</p>
                <p>Ancillary contraventions</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2A__sec-12C__subsec-2">
            <num>2</num>
            <content>
              <p>A person must not:</p>
            </content>
            <paragraph eId="part-2A__sec-12C__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>aid, abet, counsel or procure a contravention of subsection (1); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-12C__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>induce, whether by threats or promises or otherwise, a contravention of subsection (1); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-12C__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>be in any way, directly or indirectly, knowingly concerned in, or party to, a contravention of subsection (1); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2A__sec-12C__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>conspire with others to effect a contravention of subsection (1).</p>
              </content>
              <content>
                <p>Civil penalty provisions</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2A__sec-12C__subsec-3">

              <p>	(3)	Subsections (1) and (2) are <b><i>civil penalty provisions</i></b>.</p>

        <heading>Do Not Call Register</heading>
        <section eId="part-3__sec-13">
          <num>13</num>
          <heading>Do Not Call Register</heading>
          <subsection eId="part-3__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p>The ACMA must:</p>
            </content>
            <paragraph eId="part-3__sec-13__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>keep; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-13__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	arrange for another person (the <b><i>contracted service provider</i></b>) to keep, on behalf of the ACMA;</p>
              </content>
              <content>
                <p>a register of Australian numbers for the purposes of this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-13__subsec-2">
            <num>2</num>
            <content>
              <p>The register is to be known as the Do Not Call Register.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-13__subsec-3">
            <num>3</num>
            <content>
              <p>The register is to be kept in electronic form.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-13__subsec-4">
            <num>4</num>
            <content>
              <p>The register is not a legislative instrument.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-13__subsec-5">
            <num>5</num>
            <content>
              <p>The ACMA must begin to comply with subsection (1) as soon as practicable after the commencement of this section.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-13__subsec-6">
            <num>6</num>
            <content>
              <p>For the purposes of <ref href="">the Privacy Act 1988</ref>, the primary purpose of the Do Not Call Register is to facilitate:</p>
            </content>
            <paragraph eId="part-3__sec-13__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>the prohibition, under <ref href="#sec-11">section 11</ref>, of unsolicited telemarketing calls (other than designated telemarketing calls); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-13__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>the prohibition, under <ref href="#sec-12B">section 12B</ref>, of unsolicited marketing faxes (other than designated marketing faxes).</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-3__sec-14">
          <num>14</num>
          <heading>Eligibility for registration</heading>
          <content>
            <p>An Australian number is eligible to be entered on the Do Not Call Register if:</p>
          </content>
          <paragraph eId="part-3__sec-14__para-a">
            <num>a</num>
            <content>
              <p>it is used or maintained primarily for private or domestic purposes; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-14__para-b">
            <num>b</num>
            <content>
              <p>it is used or maintained exclusively for transmitting and/or receiving faxes; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-14__para-c">
            <num>c</num>
            <content>
              <p>it is used or maintained exclusively for use by a government body; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-14__para-d">
            <num>d</num>
            <content>
              <p>it is an emergency service number.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-3__sec-15">
          <num>15</num>
          <heading>Applications for registration</heading>
          <content>
            <p>An application for an Australian number to be entered on the Do Not Call Register:</p>
          </content>
          <paragraph eId="part-3__sec-15__para-a">
            <num>a</num>
            <content>
              <p>may be made by:</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-15__para-i">
            <num>i</num>
            <content>
              <p>the relevant account-holder; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-15__para-ii">
            <num>ii</num>
            <content>
              <p>a nominee of the relevant account-holder; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-15__para-b">
            <num>b</num>
            <content>
              <p>is to be made to:</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-15__para-i">
            <num>i</num>
            <content>
              <p>if the Do Not Call Register is kept by the ACMA—the ACMA; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-15__para-ii">
            <num>ii</num>
            <content>
              <p>if the Do Not Call Register is kept by the contracted service provider—the contracted service provider on behalf of the ACMA; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-15__para-c">
            <num>c</num>
            <content>
              <p>is to be in the applicable form (if any) specified in a determination under subsection 18(1); and</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-15__para-d">
            <num>d</num>
            <content>
              <p>is to be made in the applicable manner (if any) specified in a determination under subsection 18(1).</p>
            </content>

              <p>an application is made for an Australian number to be entered on the Do Not Call Register; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-16__para-b">
            <num>b</num>
            <content>
              <p>the applicant satisfies:</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-16__para-i">
            <num>i</num>
            <content>
              <p>if the Do Not Call Register is kept by the ACMA—the ACMA; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-16__para-ii">
            <num>ii</num>
            <content>
              <p>if the Do Not Call Register is kept by the contracted service provider—the contracted service provider on behalf of the ACMA;</p>
            </content>
            <content>
              <p>that the number is eligible to be entered on the Do Not Call Register;</p>
              <p>then:</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-16__para-c">
            <num>c</num>
            <content>
              <p>if the Do Not Call Register is kept by the ACMA—the ACMA; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-16__para-d">
            <num>d</num>
            <content>
              <p>if the Do Not Call Register is kept by the contracted service provider—the contracted service provider on behalf of the ACMA;</p>
            </content>
            <content>
              <p>must enter the number on the Do Not Call Register.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-3__sec-17">
          <num>17</num>
          <heading>Duration of registration</heading>
          <subsection eId="part-3__sec-17__subsec-1">
            <num>1</num>
            <content>
              <p>The registration of an Australian number on the Do Not Call Register:</p>
            </content>
            <paragraph eId="part-3__sec-17__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>takes effect when it is entered on the Do Not Call Register; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>unless sooner removed from the Do Not Call Register in accordance with a determination under subsection 18(1), remains in force indefinitely.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-17__subsec-3">
            <num>3</num>
            <content>
              <p>If an Australian number is removed from the Do Not Call Register, this Act does not prevent the number from being re-registered on the Do Not Call Register.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-18">
          <num>18</num>
          <heading>Administration of the Do Not Call Register—determinations</heading>
          <subsection eId="part-3__sec-18__subsec-1">
            <num>1</num>
            <content>
              <p>The ACMA may make a determination that makes provision for and in relation to any or all of the following:</p>
            </content>
            <paragraph eId="part-3__sec-18__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the form of applications for Australian numbers to be entered on the Do Not Call Register;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-18__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the manner in which such applications are to be made;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-18__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the manner in which entries are to be made on the Do Not Call Register;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-18__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>the correction of entries in the Do Not Call Register;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-18__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>the removal of entries from the Do Not Call Register;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-18__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>any other matter relating to the administration or operation of the Do Not Call Register.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-18__subsec-2">
            <num>2</num>
            <content>
              <p>A determination under subsection (1) is a legislative instrument.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-18__subsec-3">

              <p>A determination under subsection (1) is to be an instrument of a legislative character.</p>

          </subsection>
        </section>
        <section eId="part-3__sec-19">
          <num>19</num>
          <heading>Access to the Do Not Call Register</heading>
          <subsection eId="part-3__sec-19__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	A person (the <b><i>access</i></b><b><i>-</i></b><b><i>seeker</i></b>) who wishes to access the Do Not Call Register may submit a list of Australian numbers to:</p>
            </content>
            <paragraph eId="part-3__sec-19__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>if the Do Not Call Register is kept by the ACMA—the ACMA; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-19__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>if the Do Not Call Register is kept by the contracted service provider—the contracted service provider on behalf of the ACMA.</p>
              </content>
              <content>
                <p>For this purpose, a list may consist of a single Australian number.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-19__subsec-2">
            <num>2</num>
            <content>
              <p>If the access-seeker has paid the applicable fee (if any) determined under subsection 21(1), then:</p>
            </content>
            <paragraph eId="part-3__sec-19__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>if the Do Not Call Register is kept by the ACMA—the ACMA; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-19__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>if the Do Not Call Register is kept by the contracted service provider—the contracted service provider on behalf of the ACMA;</p>
              </content>
              <content>
                <p>must:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-19__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>check the Australian numbers on the access-seeker’s list against the Australian numbers registered on the Do Not Call Register; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-19__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>if the access-seeker requests the ACMA or the contracted service provider, as the case may be, to do so—inform the access-seeker which numbers (if any) on the access-seeker’s list are registered on the Do Not Call Register; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-19__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>if the access-seeker requests the ACMA or the contracted service provider, as the case may be, to do so—inform the access-seeker which numbers (if any) on the access-seeker’s list are not registered on the Do Not Call Register; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-19__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>if the access-seeker requests the ACMA or the contracted service provider, as the case may be, to do so—return the access-seeker’s list, modified by the deletion of the numbers (if any) registered on the Do Not Call Register.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-19__subsec-4">
            <num>4</num>
            <content>
              <p>A submission under subsection (1) is to be made in the applicable manner (if any) specified in a determination under subsection 20(1).</p>
            </content>
          </subsection>
        </section>

          <heading>Access—determinations</heading>
          <subsection eId="part-3__sec-20__subsec-1">
            <num>1</num>
            <content>
              <p>The ACMA may make a determination that makes provision for and in relation to any or all of the following:</p>
            </content>
            <paragraph eId="part-3__sec-20__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the manner in which a submission under subsection 19(1) is to be made;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-20__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the manner in which information under paragraph 19(2)(d) or (e) is to be given;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-20__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the manner in which a list is to be returned under paragraph 19(2)(f);</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-20__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>any other matter relating to access to the Do Not Call Register.</p>
              </content>
              <content>
                <p>Determinations</p>

              <p>The ACMA may make a determination that makes provision for and in relation to either or both of the following:</p>

            <paragraph eId="part-3__sec-21__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>fees payable for services provided under subsection 19(2);</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-21__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>refunds of fees for those services.</p>
              </content>
              <content>
                <p>Exemptions</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-21__subsec-2">
            <num>2</num>
            <content>
              <p>The ACMA may make a determination that makes provision for and in relation to exemptions from fees for services provided under subsection 19(2).</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-21__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may make a determination that makes provision for and in relation to exemptions from fees for services provided under subsection 19(2).</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-21__subsec-4">
            <num>4</num>
            <content>
              <p>If one or more determinations are in force under subsection (3), a determination under subsection (2) has no effect except to the extent to which it makes provision for and in relation to exemptions that are in addition to exemptions dealt with by the determinations under subsection (3).</p>

              <p>Other matters</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-21__subsec-5">

              <p>A fee must not be such as to amount to taxation.</p>
            </content>
          </subsection>

              <p>A fee is payable to the ACMA on behalf of the Commonwealth.</p>

              <p>	(1)	For the purposes of the <i>Privacy Act 1988</i>, if the Do Not Call Register is kept by the contracted service provider under a contract:</p>

              <num>a</num>
              <content>
                <p>the keeping of the Do Not Call Register by the contracted service provider; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the operation of the Do Not Call Register by the contracted service provider; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the performance of a function, or the exercise of a power, by the contracted service provider under:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>this Part; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>a determination under this Part;</p>

                <p>is taken to be the provision of a service to the ACMA under the contract.</p>

            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-22__subsec-2">

            <p>•	Proceedings for the recovery of penalties are to be instituted in the Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>).</p>

          <heading>Civil penalty orders</heading>
          <subsection eId="part-4__sec-24__subsec-1">
            <num>1</num>
            <content>
              <p>If the Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) is satisfied that a person has contravened a civil penalty provision, the court may, on the application of the ACMA, order the person to pay to the Commonwealth a pecuniary penalty.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-24__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	An order under subsection (1) is to be known as a <b><i>civil penalty order</i></b>.</p>
            </content>
            <content>
              <p>Determining pecuniary penalty</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-24__subsec-3">
            <num>3</num>
            <content>
              <p>In determining the pecuniary penalty, the court must have regard to all relevant matters, including:</p>
            </content>
            <paragraph eId="part-4__sec-24__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the nature and extent of the contravention; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the nature and extent of any loss or damage suffered as a result of the contravention; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>the circumstances in which the contravention took place; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>whether the person has previously been found by a court in proceedings under this Act to have engaged in any similar conduct; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-3__para-e">
              <num>e</num>
              <content>
                <p>if the court considers that it is appropriate to do so—whether the person has previously been found by a court in a foreign country to have engaged in any similar conduct.</p>
              </content>
              <content>
                <p>Civil enforcement of penalty</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-24__subsec-4">
            <num>4</num>
            <content>
              <p>The pecuniary penalty is a civil debt payable to the Commonwealth. The Commonwealth may enforce the civil penalty order as if it were an order made in civil proceedings against the person to recover a debt due by the person. The debt arising from the order is taken to be a judgment debt.</p>

          </subsection>
        </section>
        <section eId="part-4__sec-25">
          <num>25</num>
          <heading>Maximum penalties for contravention of civil penalty provisions</heading>
          <subsection eId="part-4__sec-25__subsec-1">
            <num>1</num>
            <content>
              <p>The maximum penalty payable under subsection 24(1) by a person in respect of a contravention of a civil penalty provision depends on:</p>
            </content>
            <paragraph eId="part-4__sec-25__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>whether the person has a prior record in relation to the civil penalty provision (see subsection (2)); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-25__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>whether the person is a body corporate; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-25__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>whether the civil penalty provision is subsection 11(1) or (7) or 12B(1) or (8).</p>
              </content>
              <content>
                <p>Prior record</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-25__subsec-2">
            <num>2</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-4__sec-25__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>	(a)	on a particular day (the <b><i>first day</i></b>), the Federal Court or the Federal Circuit and Family Court of Australia (Division 2) makes a civil penalty order against a person in respect of a contravention of a particular civil penalty provision; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-25__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>that is the first occasion on which a court makes a civil penalty order against the person in respect of a contravention of the civil penalty provision;</p>
              </content>
              <content>
                <p>then, for the purposes of determining the penalty payable under subsection 24(1) by the person in respect of a contravention of the civil penalty provision that occurs after the first day, the person has a <b><i>prior record</i></b> in relation to the civil penalty provision.</p>
                <p>Maximum penalty payable by body corporate—no prior record</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-25__subsec-3">
            <num>3</num>
            <content>
              <p>If a body corporate does not have a prior record in relation to a particular civil penalty provision:</p>
            </content>
            <paragraph eId="part-4__sec-25__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the penalty payable under subsection 24(1) by the body corporate in respect of a contravention of the civil penalty provision must not exceed:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-25__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>if the civil penalty provision is subsection 11(1) or (7) or 12B(1) or (8)—<quantity refersTo="#penaltyUnit">100 penalty units</quantity>; or</p>
              </content>
            </paragraph>

              <num>ii</num>
              <content>

              <p>If a person other than a body corporate does not have a prior record in relation to a particular civil penalty provision:</p>

                <p>the penalty payable under subsection 24(1) by the person in respect of a contravention of the civil penalty provision must not exceed:</p>

              <p>If a body corporate has a prior record in relation to a particular civil penalty provision:</p>

                <p>the penalty payable under subsection 24(1) by the body corporate in respect of a contravention of the civil penalty provision must not exceed:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-25__subsec-5__para-i">
              <num>i</num>
              <content>
                <p>if the civil penalty provision is subsection 11(1) or (7) or 12B(1) or (8)—<quantity refersTo="#penaltyUnit">500 penalty units</quantity>; or</p>

              <p>If a person other than a body corporate has a prior record in relation to a particular civil penalty provision:</p>

              <num>a</num>
              <content>
                <p>the penalty payable under subsection 24(1) by the person in respect of a contravention of the civil penalty provision must not exceed:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-25__subsec-6__para-i">
              <num>i</num>
              <content>
                <p>if the civil penalty provision is subsection 11(1) or (7) or 12B(1) or (8)—<quantity refersTo="#penaltyUnit">100 penalty units</quantity>; or</p>

              <num>ii</num>

        </section>
        <section eId="part-4__sec-26">
          <num>26</num>
          <heading>2 or more proceedings may be heard together</heading>
          <content>
            <p>The Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) may direct that 2 or more proceedings for civil penalty orders are to be heard together.</p>
          </content>
        </section>
        <section eId="part-4__sec-27">
          <num>27</num>
          <heading>Time limit for application for an order</heading>
          <content>
            <p>Proceedings for a civil penalty order may be started no later than 6 years after the contravention.</p>
          </content>
        </section>
        <section eId="part-4__sec-28">
          <num>28</num>
          <heading>Civil evidence and procedure rules for civil penalty orders</heading>
          <content>
            <p>The Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) must apply the rules of evidence and procedure for civil matters when hearing proceedings for a civil penalty order.</p>
          </content>
        </section>
        <section eId="part-4__sec-29">
          <num>29</num>
          <heading>Criminal proceedings not to be brought for contravention of civil penalty provisions</heading>
          <content>
            <p>Criminal proceedings do not lie against a person only because the person has contravened a civil penalty provision.</p>
          </content>
        </section>
        <section eId="part-4__sec-30">
          <num>30</num>
          <heading>Ancillary orders—compensation</heading>
          <subsection eId="part-4__sec-30__subsec-1">
            <num>1</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-4__sec-30__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	in one or more proceedings under <b><i>perpetrator</i></b>) has contravened one or more civil penalty provisions; and<ref href="#sec-24">section 24</ref>, the Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) finds that a person (the </p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the court is satisfied that another person (the <b><i>victim</i></b>) has suffered loss or damage as a result of any or all of those contraventions;</p>
              </content>
              <content>
                <p>the court may, on the application of the ACMA or the victim, make an order that the court considers appropriate directing the perpetrator to compensate the victim.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-30__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	In determining whether a person (the <b><i>victim</i></b>) has suffered loss or damage as a result of one or more contraventions by another person of section 11 in relation to the making of one or more telemarketing calls, and in assessing the amount of compensation payable, the court may have regard to the following:</p>
            </content>
            <paragraph eId="part-4__sec-30__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the extent to which any expenses incurred by the victim are attributable to dealing with the calls;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the effect of dealing with the calls on the victim’s ability to carry on business or other activities;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>any damage to the reputation of the victim’s business that is attributable to dealing with the calls;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>any loss of business opportunities suffered by the victim as a result of dealing with the calls;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>any other matters that the court considers relevant.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-30__subsec-2A">
            <num>2A</num>
            <content>
              <p>	(2A)	In determining whether a person (the <b><i>victim</i></b>) has suffered loss or damage as a result of one or more contraventions by another person of section 12B in relation to the sending of one or more marketing faxes, and in assessing the amount of compensation payable, the court may have regard to the following:</p>
            </content>
            <paragraph eId="part-4__sec-30__subsec-2A__para-a">
              <num>a</num>
              <content>
                <p>the extent to which any expenses incurred by the victim are attributable to dealing with the faxes;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-2A__para-b">
              <num>b</num>
              <content>
                <p>the effect of dealing with the faxes on the victim’s ability to carry on business or other activities;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-2A__para-c">
              <num>c</num>
              <content>
                <p>any damage to the reputation of the victim’s business that is attributable to dealing with the faxes;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-2A__para-d">
              <num>d</num>
              <content>
                <p>any loss of business opportunities suffered by the victim as a result of dealing with the faxes;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-30__subsec-2A__para-e">
              <num>e</num>
              <content>
                <p>any other matters that the court considers relevant.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-30__subsec-3">
            <num>3</num>
            <content>
              <p>The Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) may make an order under subsection (1), whether or not it makes a civil penalty order.</p>

                <p>the court is satisfied that the person has obtained (whether directly or indirectly) a financial benefit that is reasonably attributable to any or all of those contraventions;</p>

                <p>the court may, on the application of the ACMA, make an order directing the person to pay to the Commonwealth an amount up to the amount of the financial benefit.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-31__subsec-2">

              <p>The Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) may make an order under subsection (1), whether or not it makes a civil penalty order.</p>

                <p>restraining the person from engaging in the conduct; and</p>
              </content>
            </paragraph>

                <p>if, in the court’s opinion, it is desirable to do so—requiring the person to do something.</p>

                <p>Performance injunctions</p>

              <p>The power of the Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) under this Part to grant an injunction restraining a person from engaging in conduct of a particular kind may be exercised:</p>

          <heading>Nominees</heading>

            <p>Nomination by relevant account-holder</p>

              <p>For the purposes of the application of this Act to an Australian number, if:</p>
            </content>
            <paragraph eId="part-6__sec-39__subsec-1__para-a">

                <p>the relevant account-holder has nominated an individual in relation to the number; and</p>
              </content>
            </paragraph>

            <p>The ACMA may issue a formal warning if a person contravenes a civil penalty provision.</p>

          <heading>Additional ACMA functions</heading>
          <content>
            <p>The ACMA has the following functions:</p>
          </content>

              <p>to conduct and/or co-ordinate community education programs about unsolicited telemarketing calls and unsolicited marketing faxes, in consultation with relevant industry and consumer groups and government agencies;</p>

          </paragraph>

            <num>b</num>
            <content>
              <p>to conduct and/or commission research into issues relating to unsolicited telemarketing calls and unsolicited marketing faxes;</p>
            </content>
          </paragraph>

            <content>
              <p>to liaise with regulatory and other relevant bodies overseas about co-operative arrangements for the prohibition or regulation of unsolicited telemarketing calls and unsolicited marketing faxes.</p>

          <heading>Operation of State and Territory laws</heading>
          <content>
            <p>This Act is not intended to exclude or limit the operation of a law of a State or Territory to the extent that the law is capable of operating concurrently with this Act.</p>
          </content>
        </section>
        <section eId="part-6__sec-43">
          <num>43</num>
          <heading>Implied freedom of political communication</heading>
          <content>
            <p>This Act does not apply to the extent (if any) that it would infringe any constitutional doctrine of implied freedom of political communication.</p>
          </content>
        </section>
        <section eId="part-6__sec-44">
          <num>44</num>
          <heading>Giving effect to international conventions</heading>
          <subsection eId="part-6__sec-44__subsec-1">
            <num>1</num>
            <content>
              <p>The regulations may make provision for and in relation to giving effect to an international convention that deals with telemarketing calls or marketing faxes.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-44__subsec-2">
            <num>2</num>
            <content>
              <p>Regulations made for the purposes of subsection (1) may:</p>
            </content>
            <paragraph eId="part-6__sec-44__subsec-2__para-a">

                <p>vest the Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) with jurisdiction in a matter or matters arising under the regulations; and</p>

              <num>b</num>

              <p>Attribution of authorisation to organisation</p>

              <p>the first-mentioned individual or organisation is taken to authorise the making of the call.</p>

                <p>the sending of the fax is authorised by either of the following bodies:</p>

            <paragraph eId="schedule-2__clause-2__para-ii">
              <num>ii</num>

                <p>a registered charity; and</p>

              <num>b</num>
              <content>
                <p>if the fax relates to goods or services—the body is the supplier, or prospective supplier, of the goods or services; and</p>

                <p>either or both of the following subparagraphs apply:</p>
              </content>
            </paragraph>

            <heading>Authorising the sending of marketing faxes</heading>

            <heading>Basic definition</heading>

              <p>		For the purposes of this Act, <b><i>consent</i></b> means:</p>

            <heading>Duration of express consent</heading>
            <content>
              <p>For the purposes of this Act, if:</p>
              <p>the consent is taken to have been withdrawn at the end of the period of 3 months beginning on the day on which the consent was given.</p>

                <p>The ACMA may, by legislative instrument, determine that, for the purposes of the application of this Act to a marketing fax sent to a business number, the consent of the relevant account-holder may not be inferred in the circumstances specified in the determination.</p>

            <hcontainer name="subclause" eId="schedule-3__clause-7__subclause-2">
              <num>2</num>
              <content>
                <p>The ACMA may, by legislative instrument, determine that, for the purposes of the application of this Act to a marketing fax sent to a business number, the consent of the relevant account-holder may be inferred in the circumstances specified in the determination.</p>

              <num>3</num>
              <content>
                <p>Before making a determination under subclause (1) or (2), the ACMA must consult <role refersTo="#minister">the Minister</role>.</p>

              <num>4</num>
              <content>
                <p>Before making a determination under subclause (1) or (2), the ACMA must:</p>

                <p>publish on its website a notice:</p>
              </content>
            </paragraph>

                <p>setting out a draft of the determination; and</p>

                <p>inviting persons to make submissions to the ACMA about the draft determination <quantity refersTo="#deadline">within 14 days</quantity> after the notice is published; and</p>

              <num>b</num>

                <p>consider any submissions received within the 14-day period.</p>

                <p>	(5)	Subsection 33(3) of the <i>Acts Interpretation Act 1901</i> applies to a power conferred on the ACMA by subclause (1) or (2). However, if a variation of a determination under subclause (1) or (2) is a variation of a minor nature, the ACMA is not required to comply with subclause (3) or (4) in relation to the variation.</p>

                <p>If a determination under subclause (1) or (2) of this clause is inconsistent with regulations made for the purposes of clause 5, the determination has no effect to the extent of the inconsistency.</p>

            <heading>Object</heading>
            <content>
              <p>The object of this Schedule is to set up a system of infringement notices for contraventions of civil penalty provisions as an alternative to the institution of proceedings in the Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>).</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-4__clause-2">
            <num>2</num>
            <heading>When an infringement notice can be given</heading>
            <hcontainer name="subclause" eId="schedule-4__clause-2__subclause-1">
              <num>1</num>
              <content>
                <p>If an authorised officer has reasonable grounds to believe that a person has, on a particular day, committed one or more contraventions of a particular civil penalty provision, the authorised officer may give to the person an infringement notice relating to those contraventions.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-4__clause-2__subclause-2">
              <num>2</num>
              <content>
                <p>An infringement notice must be given <quantity refersTo="#deadline">within 12 months</quantity> after the day on which the civil contraventions are alleged to have taken place.</p>

                <p>Subclause (2) does not apply to a contravention of subsection 12(1) or (2) or 12C(1) or (2).</p>

                <p>This clause does not authorise the giving of 2 or more infringement notices to a person in relation to contraventions of a particular civil penalty provision that allegedly occurred on the same day.</p>

            <num>3</num>
            <heading>Matters to be included in an infringement notice</heading>
            <hcontainer name="subclause" eId="schedule-4__clause-3__subclause-1">
              <num>1</num>

                <p>An infringement notice must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-3__para-a">
              <num>a</num>
              <content>
                <p>set out the name of the person to whom the notice is given; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-3__para-b">
              <num>b</num>

                <p>set out the name of the authorised officer who gave the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-3__para-c">
              <num>c</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-3__para-i">
              <num>i</num>
              <content>
                <p>set out brief details of each of the alleged civil contraventions; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-3__para-ii">
              <num>ii</num>
              <content>
                <p>be accompanied by one or more data processing devices that contain, in electronic form, brief details of each of the alleged civil contraventions; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-3__para-d">
              <num>d</num>
              <content>
                <p>contain a statement to the effect that the matter or matters will not be dealt with by the Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) if the penalty specified in the notice is paid to the ACMA, on behalf of the Commonwealth, within:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-3__para-i">
              <num>i</num>
              <content>
                <p>28 days after the notice is given; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-3__para-ii">
              <num>ii</num>
              <content>
                <p>if the ACMA allows a longer period—that longer period; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-3__para-e">
              <num>e</num>
              <content>
                <p>give an explanation of how payment of the penalty is to be made; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-3__para-f">
              <num>f</num>
              <content>
                <p>set out such other matters (if any) as are specified by the regulations.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	For the amount of penalty, see clause 4.</p>
            </content>

                <p>For the purposes of paragraph (1)(c), the brief details must include the following information in relation to each alleged civil contravention:</p>

              <num>a</num>
              <content>
                <p>the date of the alleged contravention;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-3__para-b">
              <num>b</num>

                <p>the civil penalty provision that was allegedly contravened.</p>
              </content>
            </paragraph>

                <p>Subparagraph (1)(c)(ii) does not authorise the inclusion of information in a data processing device unless, at the time the infringement notice was given, it was reasonable to expect that the information would be readily accessible so as to be useable for subsequent reference.</p>

                <p>	(4)	This clause does not limit the operation of the <i>Electronic Transactions Act 1999</i>.</p>

            <heading>Withdrawal of an infringement notice</heading>

                <p>This clause applies if an infringement notice is given to a person.</p>

            </hcontainer>
            <hcontainer name="subclause" eId="schedule-4__clause-5__subclause-2">

                <p>	(2)	An authorised officer may, by written notice (the <b><i>withdrawal notice</i></b>) given to the person, withdraw the infringement notice.</p>

            </hcontainer>

              <num>3</num>
              <content>
                <p>To be effective, the withdrawal notice must be given to the person <quantity refersTo="#deadline">within 28 days</quantity> after the infringement notice was given.</p>

              <p>Refund of penalty if infringement notice withdrawn</p>
              <p>the Commonwealth is liable to refund the penalty.</p>

            <heading>What happens if the penalty is paid</heading>

                <p>the penalty is paid in accordance with the infringement notice; and</p>

            </paragraph>

                <p>Any liability of the person for the alleged civil contraventions is discharged.</p>

                <p>Proceedings under <ref href="#part-4">Part 4</ref> may not be brought against the person for the alleged civil contraventions.</p>

            <num>7</num>
            <heading>Effect of this Schedule on civil proceedings</heading>
            <content>
              <p>This Schedule does not:</p>
            </content>
            <paragraph eId="schedule-4__clause-7__para-a">
              <num>a</num>
              <content>
                <p>require an infringement notice to be given in relation to an alleged civil contravention; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-7__para-b">
              <num>b</num>
              <content>
                <p>affect the liability of a person to have proceedings under <ref href="#part-4">Part 4</ref> brought against the person for an alleged civil contravention if:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-7__para-i">
              <num>i</num>
              <content>
                <p>the person does not comply with an infringement notice relating to the contravention; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-7__para-ii">
              <num>ii</num>
              <content>
                <p>an infringement notice relating to the contravention is not given to the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-7__para-iii">
              <num>iii</num>
              <content>
                <p>an infringement notice relating to the contravention is given to the person and subsequently withdrawn; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-7__para-c">
              <num>c</num>
              <content>
                <p>limit the discretion of the Federal Court or the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>) to determine the amount of a penalty to be imposed on a person who is found in proceedings under <ref href="#part-4">Part 4</ref> to have committed a civil contravention.</p>

            <heading>Appointment of authorised officer</heading>

              <p>The ACMA may, by writing, appoint a member of the staff of the ACMA as an authorised officer for the purposes of this Schedule.</p>
