                <p>the child satisfied paragraphs 23AA(2)(a), (b) and (c) or 23AB(3)(a), (b) and (c), as the case requires, at the time that application was made; and</p>

            </paragraph>
            <paragraph eId="schedule-3__clause-7__para-c">
              <num>c</num>
              <content>
                <p>the Minister had not decided the application immediately before <date>the commencement day</date>;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-7__subclause-6">
              <num>6</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-7__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a person had given the Minister a declaration (the <b><i>old declaration</i></b>) under section 23B of the old Act before the commencement day; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-7__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> had not registered the old declaration or refused to register the old declaration immediately before that day;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-7__subclause-7">
              <num>7</num>
              <content>
                <p>In assessing a new application under the new Act, a reference in the new Act to the time the person made the application is taken to be a reference to the time the old application or the old declaration, as the case requires, was made under the old Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-3__clause-7__subclause-8">
              <num>8</num>
              <content>
                <p>In applying <ref href="#sec-22">section 22</ref> of the new Act to a new application covered by subitem (2), subsections 22(1) to (2), (4A) and (5A) of the new Act do not apply and the following subsections of <ref href="#sec-22">section 22</ref> of the new Act apply instead:</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-3__clause-7__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	For the purposes of <b><i>residence requirement </i></b>if the person has been present in Australia as a permanent resident for:<ref href="#sec-21">section 21</ref>, a person satisfies the </p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-7__para-a">
              <num>a</num>
              <content>
                <p>a total period of at least 1 year in the period of 2 years before the day the person made the application; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-7__para-b">
              <num>b</num>
              <content>
                <p>a total period of at least 2 years in the period of 5 years before that day.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-7__subclause-2">
              <num>2</num>
              <content>
                <p>Paragraph (1)(b) does not apply if the person:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-7__para-a">
              <num>a</num>
              <content>
                <p>was born in Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-7__para-b">
              <num>b</num>
              <content>
                <p>was an Australian citizen at any time before the person made the application.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-7__subclause-3">
              <num>3</num>
              <content>
                <p>For the purposes of subsection (1), <role refersTo="#minister">the Minister</role> must not take into account any period during which the person has been:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-7__para-a">
              <num>a</num>
              <content>
                <p>confined in a prison; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-7__para-b">
              <num>b</num>
              <content>
                <p>confined in a psychiatric institution by order of a court made in connection with proceedings for an offence against an Australian law in relation to the person.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-7__subclause-4">
              <num>4</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may treat a period as one in which the person was present in Australia as a permanent resident if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-7__para-a">
              <num>a</num>
              <content>
                <p>the person was engaged in activities during that period that <role refersTo="#minister">the Minister</role> considers to be beneficial to Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-7__para-b">
              <num>b</num>
              <content>
                <p>the person was not present in Australia during that period but was a permanent resident during that period.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-7__subclause-9">
              <num>9</num>
              <content>
                <p>In applying <ref href="#sec-22">section 22</ref> of the new Act to a new application covered by subitem (2), subsections 22(5), (6) and (11) of the new Act have effect as if the reference in those subsections to “paragraph (1)(c)” were a reference to “subsection (1)” (as applied by subitem (8) of this item).</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-3__clause-8">
            <num>8</num>
            <heading>Person granted certificate of citizenship under the old Act but not an Australian citizen under the old Act</heading>
            <hcontainer name="subclause" eId="schedule-3__clause-8__subclause-1">
              <num>1</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-8__para-a">
              <num>a</num>
              <content>
                <p>a person has been granted a certificate of Australian citizenship under <date>the commencement day</date>; and<ref href="#sec-13">section 13</ref> of the old Act before </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-8__para-b">
              <num>b</num>
              <content>
                <p>the certificate is in force immediately before that day; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-8__para-c">
              <num>c</num>
              <content>
                <p>the person has not become an Australian citizen under <ref href="#sec-15">section 15</ref> of the old Act immediately before that day;</p>
              </content>
            </paragraph>
            <content>
              <p>the certificate is, on and from <date>the commencement day</date>, taken to be an approval given to the person under section 24 of the new Act.</p>
              <p>Cancellation of approval under the new Act</p>
              <p>Deferral of pledge of commitment under old Act</p>
            </content>
            <hcontainer name="subclause" eId="schedule-3__clause-8__subclause-2">
              <num>2</num>
              <content>
                <p>For the purposes of applying <ref href="#sec-25">section 25</ref> of the new Act to such an approval:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-8__para-a">
              <num>a</num>
              <content>
                <p>if the person was granted the certificate of Australian citizenship under subsection 13(1) of the old Act—paragraph 25(2)(a) of the new Act is taken to apply to the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-8__para-b">
              <num>b</num>
              <content>
                <p>the reference in paragraph 25(3)(a) of the new Act to the day on which the person received notice of the approval is taken to be a reference to the day on which the person was notified of <role refersTo="#minister">the Minister</role>’s decision under section 13 of the old Act to grant the certificate.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-8__subclause-3">
              <num>3</num>
              <content>
                <p>If a decision is in force under subsection 14C(1) of the old Act immediately before <date>the commencement day</date>, the decision is, on and from <date>the commencement day</date>, taken to be a determination made under subsection 26(3) of the new Act.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-3__clause-9">
            <num>9</num>
            <heading>Children of persons who lost or were deprived of citizenship under the old Act</heading>
            <hcontainer name="subclause" eId="schedule-3__clause-9__subclause-1">
              <num>1</num>
              <content>
                <p>If, immediately before <date>the commencement day</date>, paragraph 23(3)(c) of the old Act has prevented the application of subsection 23(1) or (2) of the old Act in relation to a child, then, on and from <date>the commencement day</date>, section 36 of the new Act is taken to apply in relation to the child.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-3__clause-9__subclause-2">
              <num>2</num>
              <content>
                <p>For this purpose, the reference to the cessation time in subsection 36(2) of the new Act is taken to be a reference to <date>the commencement day</date> and there is taken to be a responsible parent of the child who is an Australian citizen on that day.</p>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-3__clause-10">
            <num>10</num>
            <heading>Review of decisions made under the old Act</heading>
            <content>
              <p>Despite the repeal of the old Act made by item 42 of Schedule 1, <ref href="#sec-52A">section 52A</ref> of the old Act continues to apply in relation to a decision made under that Act, as if that repeal had not been made.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-3__clause-11">
            <num>11</num>
            <heading>Continuation of criminal proceedings under the old Act</heading>
            <content>
              <p>Despite the repeal of the old Act made by item 42 of Schedule 1, the old Act continues to apply on and after <date>the commencement day</date>, in relation to criminal proceedings that began before that day under the old Act, as if that repeal had not been made.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-3__clause-12">
            <num>12</num>
            <heading>Section 8 of the Acts Interpretation Act 1901</heading>
            <content>
              <p>This Part does not limit the operation of <i>Acts Interpretation Act 1901</i> in relation to the repeal of the old Act.<ref href="#sec-8">section 8</ref> of the </p>
            </content>

            <num>13</num>
            <heading>Transitional regulations</heading>
            <content>
              <p>The Governor-General may make regulations prescribing matters of a transitional nature (including prescribing any saving or application provisions) relating to:</p>

              <content>
                <p>the amendments or repeals made by this Act; or</p>
              </content>
            </paragraph>
