            <p>		This Act may be cited as the <i>Airspace Act 200</i><i>7</i>.</p>

              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <heading>Object of this Act</heading>
          <content>
            <p>The object of this Act is to ensure that Australian-administered airspace is administered and used safely, taking into account the following matters:</p>
          </content>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>protection of the environment;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>efficient use of that airspace;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>equitable access to that airspace for all users of that airspace;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-d">
            <num>d</num>
            <content>
              <p>national security.</p>
            </content>
          </paragraph>

        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-airservices-australia">Airservices Australia</term> means <def>the body established by subsection 7(1) of <ref href="">the Air Services Act 1995</ref>.</def></p>
            <p><term refersTo="#term-australian-administered-airspace">Australian-administered airspace</term> has the meaning given by <def>paragraphs (a) and (b) of the definition of Australian-administered airspace in subsection 3(1) of <ref href="">the Air Services Act 1995</ref>.</def></p>
            <p><term refersTo="#term-australian-airspace-policy-statement">Australian Airspace Policy Statement</term> means <def>the statement made under subsection 8(1).</def></p>
            <p><term refersTo="#term-casa">CASA</term> means <def><ref class="unresolved">the Civil Aviation Safety Authority established by the Civil Aviation Act 1988</ref>.</def></p>
            <p><term refersTo="#term-chicago-convention">Chicago Convention</term> has the same meaning as <def>in <ref href="">the Civil Aviation Act 1988</ref>.</def></p>

          <num>5</num>
          <heading>Act binds the Crown</heading>
          <content>
            <p>This Act binds the Crown in each of its capacities.</p>
          </content>
        </section>
        <section eId="part-1__sec-6">
          <num>6</num>
          <heading>External Territories</heading>
          <content>
            <p>This Act extends to all the external Territories.</p>
          </content>
        </section>
        <section eId="part-1__sec-7">
          <num>7</num>
          <heading>Extraterritorial application</heading>
          <content>
            <p>This Act extends to acts, omissions, matters and things outside Australia.</p>
          </content>

        <heading>Australian Airspace Policy Statement</heading>

          <num>8</num>
          <heading>Minister must make Australian Airspace Policy Statement</heading>
          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Minister must make a statement (the <b><i>Australian Airspace Policy Statement</i></b>).</p>
            </content>

              <p>The statement must:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>specify and describe the classifications to be used to administer Australian-administered airspace; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>specify and describe the designations to be used for the purposes of restricting access to, or warning about access to, particular volumes of Australian-administered airspace; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>describe the processes to be followed for changing the classifications or designations of particular volumes of Australian-administered airspace; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>outline the Commonwealth Government’s policy objectives for the administration and use of Australian-administered airspace; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>include a strategy for the administration and use of Australian-administered airspace in the future.</p>
              </content>
            </paragraph>
          </subsection>

              <p>The statement may also include any other matter <role refersTo="#minister">the Minister</role> thinks appropriate.</p>
            </content>
            <content>
              <p>Consistency with Chicago Convention</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-4">
            <num>4</num>
            <content>
              <p>The statement must be consistent with the Chicago Convention. However, if Australia has notified differences under Article 38 of that Convention, the statement must be consistent with those differences.</p>

              <p>	(5)	A statement made under subsection (1) is a legislative instrument, but <i>Legislation Act 2003</i> does not apply to the statement.<ref href="#sec-42">section 42</ref> (disallowance) of the </p>

          <heading>Consultation before making Statement</heading>
          <subsection eId="part-2__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p>Before making the Australian Airspace Policy Statement, <role refersTo="#minister">the Minister</role> must consult:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>CASA; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>Airservices Australia.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may also consult any other person or body <role refersTo="#minister">the Minister</role> thinks appropriate.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-10">
          <num>10</num>
          <heading>Statement must be reviewed every 3 years</heading>
          <content>
            <p><role refersTo="#minister">The Minister</role> must cause the Australian Airspace Policy Statement to be reviewed at least once in each of the following periods:</p>
          </content>
          <paragraph eId="part-2__sec-10__para-a">
            <num>a</num>
            <content>
              <p>the period of 3 years after it is made;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-10__para-b">
            <num>b</num>
            <content>
              <p>the period of 3 years after the completion of the last review.</p>
            </content>
          </paragraph>

      </part>

        <num>3</num>
        <heading>Airspace regulation</heading>
        <section eId="part-3__sec-11">
          <num>11</num>
          <heading>CASA to administer and regulate Australian-administered airspace</heading>
          <subsection eId="part-3__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p>The regulations may make provision for and in relation to conferring functions and powers on CASA that are in connection with the administration and regulation of Australian-administered airspace.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>Regulations made for the purposes of subsection (1) may make provision for and in relation to any one or more of the following:</p>
            </content>
            <paragraph eId="part-3__sec-11__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the classification of volumes of Australian-administered airspace;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the timing of reviews referred to in <ref href="#sec-13">section 13</ref> and the manner in which such reviews are to be conducted;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the determination of the services and facilities to be provided by the providers of air navigation services in relation to particular volumes of Australian-administered airspace;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>the designation of volumes of Australian-administered airspace for the purposes of restricting access to, or warning about access to, that airspace;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>the designation of air routes and airways in Australian-administered airspace and the conditions of use of a designated air route or airway;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>the giving of directions in connection with the use or operation of a designated air route or airway or of air route or airway facilities;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-g">
              <num>g</num>
              <content>
                <p>the determination of aerodromes as controlled aerodromes;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-h">
              <num>h</num>
              <content>
                <p>the determination of volumes of Australian-administered airspace as flight information areas or flight information regions;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>the determination of volumes of Australian-administered airspace as control areas or control zones;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-j">
              <num>j</num>
              <content>
                <p>the regulation of the provision of aeronautical information services;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-k">
              <num>k</num>
              <content>
                <p>the obtaining of information from the operators of aerodromes, the owners or operators of aircraft or the providers of air navigation services.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-3">
            <num>3</num>
            <content>
              <p>Subsection (2) does not limit subsection (1).</p>
            </content>
            <content>
              <p>Penalties</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-4">
            <num>4</num>
            <content>
              <p>Regulations made for the purposes of subsection (1) may prescribe penalties for offences against the regulations. A penalty must not be more than <quantity refersTo="#penaltyUnit">50 penalty units</quantity>.</p>

              <p>Charges</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-5">
            <num>5</num>
            <content>
              <p>Regulations made for the purposes of subsection (1) may make provision for and in relation to prescribing charges in respect of the performance of a function, or the exercise of a power, by CASA.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-6">
            <num>6</num>
            <content>
              <p>A charge may be set either by fixing the amount or by setting a method of calculation.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-7">
            <num>7</num>
            <content>
              <p>A charge must not be such as to amount to taxation.</p>
            </content>
            <content>
              <p>Sub-delegation</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-8">
            <num>8</num>
            <content>
              <p>Regulations made for the purposes of subsection (1) may make provision for and in relation to CASA delegating functions or powers to another person.</p>

              <p>Definitions</p>
            </content>
          </subsection>

            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>aerodrome</i></b> has the meaning prescribed by the regulations.</p>
              <p><b><i>aircraft </i></b>has the same meaning as in the <i>Civil Aviation Act 1988</i>.</p>
              <p><b><i>air route</i></b> has the meaning prescribed by the regulations.</p>
              <p><b><i>air route or airway facilities</i></b> has the meaning prescribed by the regulations.</p>
              <p><b><i>airway</i></b> has the meaning prescribed by the regulations.</p>

        </section>
        <section eId="part-3__sec-12">
          <num>12</num>
          <heading>Matters affecting CASA’s administration and regulation of Australian-administered airspace</heading>
          <subsection eId="part-3__sec-12__subsec-1">
            <num>1</num>
            <content>
              <p>In performing its functions and in exercising its powers conferred under the regulations, CASA must:</p>
            </content>
            <paragraph eId="part-3__sec-12__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>foster efficient use of Australian-administered airspace; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>foster equitable access to that airspace for all users of that airspace.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-2">
            <num>2</num>
            <content>
              <p>In performing its functions and in exercising its powers conferred under the regulations, CASA must take into account:</p>
            </content>
            <paragraph eId="part-3__sec-12__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the capacity of Australian-administered airspace to accommodate changes in its use; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>national security.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-3">
            <num>3</num>
            <content>
              <p>Subsection (2) does not limit the matters that may be taken into account.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	This section is subject to sections 9A to 11A of the <i>Civil Aviation Act 1988</i>.</p>

              <p>CASA has the function of conducting regular reviews of the existing classifications of volumes of Australian-administered airspace in order to determine whether those classifications are appropriate.</p>

              <p>CASA has the function of conducting regular reviews of the existing services and facilities provided by the providers of air navigation services in relation to particular volumes of Australian-administered airspace in order to determine whether those services and facilities are appropriate.</p>

              <p><role refersTo="#minister">The Minister</role> may, by written notice, request advice from CASA on a matter related to:</p>

              <num>a</num>
              <content>
                <p>the Australian Airspace Policy Statement; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-14__subsec-1__para-b">

                <p>CASA’s functions or powers under the regulations.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-14__subsec-2">
            <num>2</num>
            <content>
              <p>CASA must provide written advice to <role refersTo="#minister">the Minister</role> on that matter in accordance with the notice.</p>

              <p><role refersTo="#minister">The Minister</role> may, by writing, delegate <role refersTo="#minister">the Minister</role>’s power under subsection (1) to <role refersTo="#secretary">the Secretary</role> of the Department.</p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.</p>
              <p>If a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.</p>
