            <p>		This Act may be cited as the<i> AusCheck Act 2007</i>.</p>
          </content>

          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act commences on the day after it receives the Royal Assent.</p>
          </content>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Object of Act</heading>
          <content>
            <p>The object of this Act is to provide a regulatory framework for coordinating and conducting certain criminal, security and other background checking.</p>
          </content>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Definitions</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><term refersTo="#term-asic-short-for-aviation-security-identification-card">ASIC (short for aviation security identification card)</term> has the same meaning as <def>in the Aviation Transport Security Regulations 2005.</def></p>
              <p><term refersTo="#term-auscheck-database">AusCheck database</term> means <def>the database referred to in <ref href="#sec-14">section 14</ref>.</def></p>
              <p><term refersTo="#term-auscheck-scheme">AusCheck scheme</term> means <def>the scheme prescribed for the purposes of <ref href="#sec-8">section 8</ref>.</def></p>
              <p><term refersTo="#term-auscheck-scheme-personal-information">AusCheck scheme personal information</term> means <def>personal information: that is obtained under the AusCheck scheme; or that relates to the administration of the AusCheck scheme; or 	(c)	that is obtained before the commencement of Schedule 1 to the <i>AusCheck Amendment (Global Entry Program) Act 2025</i> by an agency (within the meaning of the <i>Privacy Act 1988</i>) for the purposes of conducting (whether before or after that commencement) a background check in connection with an individual’s participation in the Global Entry program.</def></p>

              <num>a</num>
              <content>
                <p>that is obtained under the AusCheck scheme; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>that relates to the administration of the AusCheck scheme; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>	(c)	that is obtained before the commencement of Schedule 1 to the <i>AusCheck Amendment (Global Entry Program) Act 2025</i> by an agency (within the meaning of the <i>Privacy Act 1988</i>) for the purposes of conducting (whether before or after that commencement) a background check in connection with an individual’s participation in the Global Entry program.</p>

              <content>
                <p><b><i>AusCheck staff member</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an APS employee who performs functions relating to, or for the purposes of, the AusCheck scheme; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a person engaged as a consultant or contractor to perform functions relating to, or for the purposes of, the AusCheck scheme.</p>
              </content>

              </authorialNote>
              <content>
                <p><term refersTo="#term-aviation-security-relevant-offence">aviation-security-relevant offence</term> has the same meaning as <def>in the Aviation Transport Security Regulations 2005.</def></p>
                <p><term refersTo="#term-ceo-of-acic">CEO of ACIC</term> means <def><ref class="unresolved">the Chief Executive Officer of the Australian Criminal Intelligence Commission established by the Australian Crime Commission Act 2002</ref>.</def></p>
                <p><b><i>charged</i></b>: an individual is <b><i>charged</i></b> with a serious offence if an information is laid against the individual for the offence, whether or not:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a summons to require the attendance of the individual to answer the information has been issued; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a warrant for the arrest of the individual has been issued.</p>
              </content>
              <content>
                <p><term refersTo="#term-commonwealth-authority">Commonwealth authority</term> means <def>a body (whether incorporated or not) established for a public purpose by or under a law of the Commonwealth.</def></p>
                <p><term refersTo="#term-critical-infrastructure-risk-management-program">critical infrastructure risk management program</term> has the same meaning as <def>in <ref href="">the Security of Critical Infrastructure Act 2018</ref>.</def></p>
                <p><term refersTo="#term-defence-force-magistrate">Defence Force magistrate</term> has the same meaning as <def>in <ref href="">the Defence Force Discipline Act 1982</ref>.</def></p>
                <p><term refersTo="#term-firearms-background-check">firearms background check</term> means <def>a background check conducted under regulations made for the purposes of paragraph 8(1)(f).</def></p>
                <p><term refersTo="#term-firearms-licensing-authority">firearms licensing authority</term> has the meaning given by <def>regulations made for the purposes of this definition.</def></p>
                <p><term refersTo="#term-global-entry-program">Global Entry program</term> means <def>the trusted traveller program of the Government of the United States of America, known as the Global Entry program, that enables expedited immigration and customs clearance for individuals entering the United States of America and that is open to Australian citizens.</def></p>
                <p><term refersTo="#term-identity-verification-information">identity verification information</term> means <def>personal information consisting of the individual’s fingerprints or other biometric data about the individual, but does not include a photograph of the individual.</def></p>
                <p><b><i>issuing body</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	an issuing body within the meaning of the <i>Aviation Transport Security Regulations</i><i> </i><i>2005</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	an issuing body within the meaning of the <i>Maritime Transport and Offshore Facilities Security</i><i> </i><i>Regulations</i><i> </i><i>2003</i>.</p>
              </content>
              <content>
                <p><term refersTo="#term-law-enforcement-agency">law enforcement agency</term> means <def>an authority of the Commonwealth, or an authority of a State or Territory, that has functions relating to law enforcement.</def></p>
                <p><term refersTo="#term-major-national-event">major national event</term> has the meaning given by <def><ref href="#sec-5A">section 5A</ref>.</def></p>
                <p><term refersTo="#term-maritime-security-relevant-offence">maritime-security-relevant offence</term> has the same meaning as <def>in the Maritime Transport and Offshore Facilities Security Regulations 2003.</def></p>
                <p><term refersTo="#term-msic-short-for-maritime-security-identification-card">MSIC (short for maritime security identification card)</term> has the same meaning as <def>in the Maritime Transport and Offshore Facilities Security Regulations 2003.</def></p>
                <p><b><i>national security agency</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the Australian Security Intelligence Organisation; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the Australian Criminal Intelligence Commission established by the <i>Australian Crime Commission Act 2002</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>	(c)	any other agency of the Commonwealth<i> </i>prescribed by the regulations.</p>
              </content>
              <content>
                <p><term refersTo="#term-national-security-background-check">national security background check</term> means <def>a background check conducted in relation to the individual under an Act or legislative instrument referred to in subparagraph 8(1)(b)(i) or (ii) for a purpose referred to in paragraph 8(2)(a), (b), (c), or (d).</def></p>
                <p><term refersTo="#term-permanent-resident">permanent resident</term> means <def>a person: who is not an Australian citizen; and whose normal place of residence is situated in Australia; and whose presence in Australia is not subject to any limitation as to time imposed by law; and who is not an unlawful non-citizen.</def></p>

            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>who is not an Australian citizen; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>whose normal place of residence is situated in Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>whose presence in Australia is not subject to any limitation as to time imposed by law; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>who is not an unlawful non-citizen.</p>
              </content>
              <content>
                <p><term refersTo="#term-personal-information">personal information</term> has the same meaning as <def>in <ref href="">the Privacy Act 1988</ref>.</def></p>
                <p><b><i>resolved</i></b>: for when a charge for a serious offence is <b><i>resolved</i></b> in relation to an individual, see subsection (3).</p>
                <p><term refersTo="#term-schedule-1a-offence">Schedule 1A offence</term> has the same meaning as <def>in <ref href="">the Defence Force Discipline Act 1982</ref>.</def></p>
                <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>
                <p><b><i>serious offence</i></b>:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>in relation to an applicant for, or holder of, an ASIC—means an aviation-security-relevant offence of a kind specified in the regulations for the purposes of this paragraph; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>in relation to an applicant for, or holder of, an MSIC—means a maritime-security-relevant offence of a kind specified in the regulations for the purposes of this paragraph.</p>
              </content>
              <content>
                <p><term refersTo="#term-service-offence">service offence</term> has the same meaning as <def>in <ref href="">the Defence Force Discipline Act 1982</ref>.</def></p>
                <p><term refersTo="#term-state-or-territory-authority">State or Territory authority</term> means <def>a body (whether incorporated or not) established for a public purpose by or under a law of a State or Territory.</def></p>
                <p><term refersTo="#term-unlawful-non-citizen">unlawful non-citizen</term> has the same meaning as <def>in <ref href="">the Migration Act 1958</ref>.</def></p>
                <p>Meaning of <b>personal information</b></p>

            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-2">

            <content>
              <p>To avoid doubt:</p>
            </content>
            <content>
              <p><term refersTo="#term-personal-information">personal information</term> includes <def>the following: the number of an ASIC or MSIC issued to the individual; any other identifier assigned to the individual; a photograph of the individual. When a charge is <b>resolved</b></def></p>

              <p>	(3)	For the purposes of this Act, a charge for a serious offence is <b><i>resolved</i></b> in relation to an individual if the charge is finally dealt with in any of the following ways:</p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the charge is withdrawn;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the charge is dismissed by a court;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>the individual is discharged by a court following a committal hearing;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>the individual is acquitted of the offence by a court;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-3__para-e">
              <num>e</num>
              <content>
                <p>the individual is found guilty of the offence and a court:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>sentences the person for the offence; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	makes an order relating to the offence under <i>Crimes Act 1914</i>, or a corresponding provision of a law of a State or Territory.<ref href="#sec-19B">section 19B</ref> of the </p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Definition of background check</heading>
          <content>
            <p>		A <b><i>background check</i></b>, in relation to an individual, is an assessment of information relating to one or more of the following:</p>
          </content>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>the individual’s criminal history;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-aa">
            <num>aa</num>
            <content>
              <p>if required or permitted under a regulation made under subsection 8(3):</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-i">
            <num>i</num>
            <content>
              <p>whether the individual has been charged with a serious offence; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-ii">
            <num>ii</num>
            <content>
              <p>whether a charge for a serious offence has been resolved in relation to the individual;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>	(b)	matters relevant to a security assessment (<i>Australian Security Intelligence Organisation Act 197</i><i>9</i>) of the individual;<ref href="#sec-35__subsec-1">as defined in subsection 35(1)</ref> of the </p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-ba">
            <num>ba</num>
            <content>
              <p>	(ba)	if the background check is conducted for the purposes of paragraph 8(1)(a) or (f)—matters relevant to a criminal intelligence assessment (within the meaning of <i>Australian Crime Commission Act 2002</i>) of the individual;<ref href="#part-II">Part II</ref>I of the </p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-bb">
            <num>bb</num>
            <content>
              <p>if the background check is conducted for the purposes of paragraph 8(1)(e)—whether a court martial or a Defence Force magistrate:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-i">
            <num>i</num>
            <content>
              <p>has convicted the individual of a service offence (other than a Schedule 1A offence); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-ii">
            <num>ii</num>
            <content>
              <p>has convicted the individual of a Schedule 1A offence and imposed a punishment of imprisonment on the individual;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>the individual’s citizenship status, residency status or the individual’s entitlement to work in Australia, including but not limited to, whether the person is an Australian citizen, a permanent resident or an unlawful non-citizen;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-d">
            <num>d</num>
            <content>
              <p>the identity of the individual.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-5A">
          <num>5A</num>
          <heading>Declaration of major national events</heading>
          <subsection eId="part-1__sec-5A__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Minister may, by legislative instrument, declare that a specified event is a <b><i>major national event</i></b> for the purposes of this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-5A__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must not make a declaration under subsection (1) in relation to an event unless <role refersTo="#minister">the Minister</role> is satisfied that it is in the national interest that the Commonwealth be involved in the conduct and coordination of background checks in connection with the accreditation of individuals in relation to the event.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-5A__subsec-3">
            <num>3</num>
            <content>
              <p>In considering whether to make a declaration under subsection (1) in relation to an event, <role refersTo="#minister">the Minister</role> may have regard to:</p>
            </content>
            <paragraph eId="part-1__sec-5A__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the significance of the event; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5A__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the need (if any) to coordinate security arrangements in relation to the event with one or more States or Territories or one or more foreign governments; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5A__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>any risk assessment relating to the event; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5A__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>the potential impact of any security incident relating to the event on Australia’s reputation; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5A__subsec-3__para-e">
              <num>e</num>
              <content>
                <p>the anticipated attendees at the event; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5A__subsec-3__para-f">
              <num>f</num>
              <content>
                <p>any other matter <role refersTo="#minister">the Minister</role> considers relevant.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-1__sec-6">
          <num>6</num>
          <heading>Crown to be bound</heading>
          <subsection eId="part-1__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>This Act binds the Crown in each of its capacities.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>This Act does not make the Crown liable to be prosecuted for an offence.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-7">
          <num>7</num>
          <heading>Extension to external Territories</heading>
          <content>
            <p>This Act extends to every external Territory.</p>
          </content>
        </section>
      </part>

        <heading>Establishment of AusCheck scheme</heading>
        <section eId="part-2__sec-8">
          <num>8</num>
          <heading>Establishment of AusCheck scheme</heading>
          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The regulations may provide for the establishment of a scheme (the <b><i>AusCheck scheme</i></b>) relating to the conduct and coordination of background checks of individuals if:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>any of the following laws requires or permits a background check to be conducted of an individual for specified purposes:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>	(i)	the <i>Aviation Transport Security Act 2004</i> or regulations under that Act;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	the <i>Maritime Transport and Offshore Facilities Security Act 2003</i> or regulations under that Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>any other Act (other than this Act) expressly:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>requires or permits a background check of an individual to be conducted under the AusCheck scheme for purposes specified in the Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>provides for the making of a legislative instrument requiring or permitting a background check of an individual to be conducted under the AusCheck scheme for purposes specified in the Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-ba">
              <num>ba</num>
              <content>
                <p>a critical infrastructure risk management program permits a background check of an individual to be conducted under the AusCheck scheme; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a regulation made under subsection (3) requires or permits a background check to be conducted of an individual; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>the check is of an individual in connection with the accreditation of the individual in relation to a major national event; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>the check is of an individual in connection with the individual’s participation in the Global Entry program; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>the check is of an individual in connection with any of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>a decision under a law of a State or Territory about whether to issue a firearms licence to the individual or otherwise relating to the issue of such a licence (including in relation to conditions);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>a decision about whether to renew, revoke, vary or suspend a licence mentioned in subparagraph (i);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>in relation to an individual who holds a firearms licence—an application by a law enforcement agency or a national security agency.</p>
              </content>
              <content>
                <p>National security background checks</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>If paragraph (1)(b) applies, the background check must be conducted for purposes related to:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>Australia’s national security; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the defence of Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>a national emergency; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>	(d)	the prevention of conduct to which <i>Criminal Code</i> (which deal with terrorism, foreign incursions and recruitment) applies.<ref href="#part-5">Part 5</ref>.3, 5.3A or 5.5 of Chapter 5 of the </p>
              </content>
              <content>
                <p>Background checks in connection with major national events</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2A">
            <num>2A</num>
            <content>
              <p>If paragraph (1)(d) applies, the background check must be conducted:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-2A__para-a">
              <num>a</num>
              <content>
                <p>for purposes related to matters that are peculiarly adapted to the government of a nation and that cannot otherwise be carried on for the benefit of the nation; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-b">
              <num>b</num>
              <content>
                <p>for purposes involving, or for purposes related to, the collection and transmission of information by a communication using a postal, telegraphic, telephonic or other like service; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-c">
              <num>c</num>
              <content>
                <p>in, or for purposes related to, a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-d">
              <num>d</num>
              <content>
                <p>	(d)	in or with respect to a Commonwealth place (within the meaning of the <i>Commonwealth Places (Application of Laws) Act 1970</i>); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-e">
              <num>e</num>
              <content>
                <p>in the course of, or for purposes related to, trade or commerce with other countries, and among the States; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-f">
              <num>f</num>
              <content>
                <p>in relation to a person who is an employee of, an office holder in, or otherwise connected with, a corporation to which paragraph 51(xx) of the Constitution applies, where the results of the check are relevant to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-i">
              <num>i</num>
              <content>
                <p>the relationship between the person and the corporation; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-ii">
              <num>ii</num>
              <content>
                <p>the protection of the corporation; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-iii">
              <num>iii</num>
              <content>
                <p>the activities of the corporation; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-g">
              <num>g</num>
              <content>
                <p>for purposes related to external affairs; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-h">
              <num>h</num>
              <content>
                <p>for purposes related to the background checking of, or the protection of, aliens; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-i">
              <num>i</num>
              <content>
                <p>for purposes related to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-i">
              <num>i</num>
              <content>
                <p>Australia’s national security; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-ii">
              <num>ii</num>
              <content>
                <p>the defence of Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-iii">
              <num>iii</num>
              <content>
                <p>a national emergency; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-iv">
              <num>iv</num>
              <content>
                <p>	(iv)	the prevention of conduct to which <i>Criminal Code</i> applies; or<ref href="#part-5">Part 5</ref>.3, 5.3A or 5.5 of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-j">
              <num>j</num>
              <content>
                <p>by way of the provision of a service, for a purpose of the Commonwealth, to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-i">
              <num>i</num>
              <content>
                <p>the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-ii">
              <num>ii</num>

                <p>an authority of the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-2A__para-k">
              <num>k</num>
              <content>
                <p>for purposes related to matters incidental to the execution of any of the legislative powers of the Parliament or the executive power of the Commonwealth.</p>
              </content>
              <content>
                <p>Background checks required or permitted under the regulations—charges for serious offences</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-3">
            <num>3</num>
            <content>
              <p>The regulations may require or permit a background check covering a matter referred to in paragraph 5(a), (aa) or (d) to be conducted in relation to an individual if:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>one of the following applies:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the individual has applied to an issuing body for an ASIC or MSIC, and the issuing body has neither issued, nor refused to issue, the ASIC or MSIC;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	the individual or an issuing body has applied under regulations made under the <i>Aviation Transport Security Act 2004</i> or the <i>Maritime Transport and Offshore Facilities Security Act 2003</i> for approval to issue an ASIC or MSIC to the individual, and the application has not been determined;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-3__para-iii">
              <num>iii</num>
              <content>
                <p>the individual is the holder of an ASIC or MSIC;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-3__para-iv">
              <num>iv</num>
              <content>
                <p>the individual or an issuing body has applied under regulations made under either of those Acts to set aside the cancellation of an ASIC or MSIC issued to the individual;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-3__para-v">
              <num>v</num>
              <content>
                <p>the individual has applied to the Administrative Review Tribunal for review of a decision made under regulations made under either of those Acts, or a decision made under the AusCheck scheme, relating to the issue, suspension or cancellation of an ASIC or MSIC, and the application has not been determined; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-3__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> considers on reasonable grounds that:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the individual has been charged with a serious offence; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>a charge for a serious offence has been resolved in relation to the individual.</p>
              </content>

              <num>a</num>
              <content>
                <p>	(a)	the <i>Aviation Transport Security Act 2004</i> or regulations under that Act; or</p>
              </content>
            </paragraph>

                <p>	(b)	the <i>Maritime Transport and Offshore Facilities Security Act 2003</i> or regulations under that Act.</p>

                <p>Firearms background checks</p>

          </subsection>
          <subsection eId="part-2__sec-8__subsec-4A">
            <num>4A</num>
            <content>
              <p>If paragraph (1)(f) applies, a firearms background check of an individual may only take into account one or more of the following:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-4A__para-a">
              <num>a</num>
              <content>
                <p>	(a)	an assessment by the Australian Security Intelligence Organisation of the individual under the <i>Australian Security Intelligence Organisation Act 1979</i>;</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>	(b)	a criminal intelligence assessment (within the meaning of <i>Australian Crime Commission Act 2002</i>) of the individual under that Act;<ref href="#part-II">Part II</ref>I of the </p>

          <heading>Matters covered by AusCheck scheme—background checks required or permitted other than under regulations made under this Act</heading>
          <subsection eId="part-2__sec-9__subsec-1">

              <p>The AusCheck scheme may, for the purposes of paragraphs 8(1)(a) and (b), make provision for and in relation to the following:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the making of applications for a background check by the individual to whom the background check relates;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the making of applications for a background check by a person other than the individual to whom the background check relates, with the consent of the individual to whom the background check relates;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the information that is to be contained in an application for a background check;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>the criteria against which an application for a background check is to be assessed;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>the decision or decisions that may be made as a result of an application for a background check;</p>
              </content>
            </paragraph>

            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p>The matters referred to in subsection (1) may relate to:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>all background checks to be conducted for the purposes of paragraphs 8(1)(a) and (b); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>a specified class of background checks.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-3">
            <num>3</num>
            <content>
              <p>Without limiting the way in which a class of background checks may be described for the purposes of subsection (2), a class may be described by reference to a specified legislative or non-legislative scheme, a specified law of the Commonwealth, specified provisions of a law of the Commonwealth or specified purposes.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-4">
            <num>4</num>
            <content>
              <p>For the purposes of paragraph (1)(b), an individual is taken to have given consent to another person making an application for a background check in relation to the individual if:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>the individual has applied for:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>an ASIC or MSIC; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-4__para-iii">
              <num>iii</num>
              <content>
                <p>any other card, licence, permit or authorisation; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>before making the application referred to in paragraph (a), the individual was advised by the person to whom that application was made, in accordance with the requirements (if any) specified in the regulations, that a background check was a precondition to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>the issuing of the card, licence, permit or authorisation; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-4__para-ii">
              <num>ii</num>
              <content>
                <p>if the background check is required or permitted to be conducted as referred to in paragraph 8(1)(a) in a particular circumstance—the individual’s continuing eligibility to hold the card in that circumstance.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-10">
          <num>10</num>
          <heading>Matters covered by AusCheck scheme—background checks required or permitted under regulations made under this Act</heading>
          <subsection eId="part-2__sec-10__subsec-1">
            <num>1</num>
            <content>
              <p>The AusCheck scheme may, for the purposes of paragraph 8(1)(c), make provision for and in relation to the following:</p>
            </content>
            <paragraph eId="part-2__sec-10__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the giving to <role refersTo="#secretary">the Secretary</role> of information, relating to an individual in respect of whom a background check is conducted, that is directly necessary for the purpose of conducting the background check;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the criteria against which a background check is to be assessed;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the decision or decisions that may be made as a result of a background check;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>the form of advice to be given to an individual in respect of whom a background check is conducted;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>the form of advice to be given to other persons about the outcome of a background check.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-2">
            <num>2</num>
            <content>
              <p>The matters referred to in subsection (1) may relate to:</p>
            </content>
            <paragraph eId="part-2__sec-10__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>all background checks to be conducted for the purposes of paragraph 8(1)(c); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>a specified class of background checks.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-3">
            <num>3</num>
            <content>
              <p>The AusCheck scheme may, for the purposes of paragraph 8(1)(c), make provision for and in relation to an individual or an issuing body notifying <role refersTo="#secretary">the Secretary</role> of specified matters if:</p>
            </content>
            <paragraph eId="part-2__sec-10__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>one of the following applies:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the individual has applied to an issuing body for an ASIC or MSIC, and the issuing body has neither issued, nor refused to issue, the ASIC or MSIC;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	the individual or an issuing body has applied under regulations made under the <i>Aviation Transport Security Act 2004</i> or the <i>Maritime Transport and Offshore Facilities Security Act 2003</i> for approval to issue an ASIC or MSIC to the individual, and the application has not been determined;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-3__para-iii">
              <num>iii</num>
              <content>
                <p>the individual is the holder of an ASIC or MSIC;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-3__para-iv">
              <num>iv</num>
              <content>
                <p>the individual or an issuing body has applied under regulations made under either of those Acts to set aside the cancellation of an ASIC or MSIC issued to the individual;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-3__para-v">
              <num>v</num>
              <content>
                <p>the individual has applied to the Administrative Review Tribunal for review of a decision made under regulations made under either of those Acts, or a decision made under the AusCheck scheme, relating to the issue, suspension or cancellation of an ASIC or MSIC, and the application has not been determined; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the individual has been charged with a serious offence, or a charge for a serious offence has been resolved in relation to the individual; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>in the case of an issuing body:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the individual applied to the issuing body for the ASIC or MSIC; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>the issuing body issued the ASIC or MSIC to the individual.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-10AA">
          <num>10AA</num>
          <heading>Matters covered by the AusCheck scheme—background checks in connection with major national events</heading>
          <subsection eId="part-2__sec-10AA__subsec-1">
            <num>1</num>
            <content>
              <p>The AusCheck scheme may, for the purposes of paragraph 8(1)(d), make provision for and in relation to any of the following:</p>
            </content>
            <paragraph eId="part-2__sec-10AA__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the giving to <role refersTo="#secretary">the Secretary</role> of information, relating to an individual in respect of whom a background check is conducted, that is directly necessary for the purpose of conducting the background check;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AA__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the criteria against which a background check is to be assessed;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AA__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the decision or decisions that may be made as a result of a background check;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AA__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>the form of advice to be given to an individual in respect of whom a background check is conducted;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AA__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>the form of advice to be given to other persons about the outcome of a background check.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-10AA__subsec-2">
            <num>2</num>
            <content>
              <p>The matters referred to in subsection (1) may relate to:</p>
            </content>
            <paragraph eId="part-2__sec-10AA__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>all background checks to be conducted for the purposes of paragraph 8(1)(d); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AA__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>a specified class of background checks.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-10AB">
          <num>10AB</num>
          <heading>Matters covered by AusCheck Scheme—background checks in connection with the Global Entry program</heading>
          <subsection eId="part-2__sec-10AB__subsec-1">
            <num>1</num>
            <content>
              <p>The AusCheck scheme may, for the purposes of paragraph 8(1)(e), make provision for and in relation to any of the following:</p>
            </content>
            <paragraph eId="part-2__sec-10AB__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the making of applications for a background check by the individual to whom the background check relates;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AB__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>except for a background check in relation to an individual who has turned 18—either or both of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AB__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>consent by a parent or guardian of the individual to whom the background check relates to an application for a background check;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AB__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>the making of applications for a background check on behalf of the individual to whom the background check relates by a parent or guardian of the individual;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AB__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the making of applications for a background check by a person other than the individual to whom the background check relates, with the consent of any one or more of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AB__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the individual;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AB__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>a parent or guardian of the individual;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AB__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>the information that is to be contained in an application for a background check;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AB__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>the giving to <role refersTo="#secretary">the Secretary</role> of information, relating to an individual in respect of whom a background check is conducted, that is directly necessary for the purpose of conducting the background check;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AB__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>the criteria against which a background check is to be assessed;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AB__subsec-1__para-g">
              <num>g</num>
              <content>
                <p>the decision or decisions that may be made as a result of a background check;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AB__subsec-1__para-h">
              <num>h</num>
              <content>
                <p>the form of advice to be given to an applicant for a background check;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AB__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the form of advice to be given to an individual in respect of whom a background check is conducted;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AB__subsec-1__para-j">
              <num>j</num>
              <content>
                <p>the form of advice to be given to other persons about the outcome of a background check.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-10AB__subsec-2">
            <num>2</num>
            <content>
              <p>The matters referred to in subsection (1) may relate to:</p>
            </content>
            <paragraph eId="part-2__sec-10AB__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>all background checks to be conducted for the purposes of paragraph 8(1)(e); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10AB__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>a specified class of background checks.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-10A">
          <num>10A</num>
          <heading>Matters covered by AusCheck scheme—online verification service</heading>
          <content>
            <p>The AusCheck scheme may make provision for and in relation to matters relating to the establishment and provision of an online verification service that will enable verification:</p>
          </content>
          <paragraph eId="part-2__sec-10A__para-a">
            <num>a</num>
            <content>
              <p>that an ASIC or MSIC has been issued to a particular individual and is in effect at a particular time; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-10A__para-b">
            <num>b</num>
            <content>
              <p>that an individual who is in possession of an ASIC or MSIC is the person to whom the card was issued; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-10A__para-c">
            <num>c</num>
            <content>
              <p>that a national security background check has been conducted in relation to a particular individual; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-10A__para-d">
            <num>d</num>
            <content>
              <p>that an individual who is in possession of a card, licence, permit or other authorisation in relation to which a national security background check has been conducted is the individual to whom the card, licence, permit or authorisation was issued.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-10B">
          <num>10B</num>
          <heading>Matters covered by AusCheck scheme—firearms background checks</heading>
          <subsection eId="part-2__sec-10B__subsec-1">
            <num>1</num>
            <content>
              <p>The AusCheck scheme may, for the purposes of paragraph 8(1)(f), make provision for and in relation to any of the following:</p>
            </content>
            <paragraph eId="part-2__sec-10B__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the making of an application for a firearms background check by a firearms licensing authority, a law enforcement agency or a national security agency;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10B__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the information that is to be contained in an application for a firearms background check (including in relation to consent for the check);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10B__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the manner for conducting a firearms background check;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10B__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>the criteria against which an application for a firearms background check is to be assessed;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10B__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>the form of advice to be given to the applicant for a firearms background check;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10B__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>the form of advice to be given to other persons about the status or outcome of a firearms background check (including any conditions relating to the advice being provided to other persons);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10B__subsec-1__para-g">
              <num>g</num>
              <content>
                <p>any other matter relating to a firearms background check.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-10B__subsec-2">
            <num>2</num>
            <content>
              <p>The matters referred to in subsection (1) may relate to:</p>
            </content>
            <paragraph eId="part-2__sec-10B__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>all firearms background checks to be conducted for the purposes of paragraph 8(1)(f); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10B__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>a specified class or specified classes of such background checks.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-10B__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of paragraph (1)(b), without limiting that paragraph, an individual is taken to have given consent to another person making an application for a firearms background check of the individual if:</p>
            </content>
            <paragraph eId="part-2__sec-10B__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the individual has applied for a firearms licence (whether immediately before the firearms background check or at any previous time); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10B__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>before making the application for the firearms licence, the individual was advised by the person to whom that application was made, in accordance with the requirements (if any) specified in the regulations, that a firearms background check:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10B__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>was a precondition to the issuing of the licence; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-10B__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>may be conducted at any time that the licence is in force.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-11">
          <num>11</num>
          <heading>Secretary may give directions under AusCheck scheme</heading>
          <subsection eId="part-2__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p>The AusCheck scheme may empower <role refersTo="#secretary">the Secretary</role> to give directions to an applicant for a background check, or to a person who is required or permitted to take action relating to matters connected with a background check.</p>
            </content>
            <content>
              <p>Directions about advising whether licence etc. has been issued to individual</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting subsection (1), the AusCheck scheme may empower <role refersTo="#secretary">the Secretary</role> to direct a person to advise <role refersTo="#secretary">the Secretary</role> whether or not a licence, permit or other authorisation has been issued to an individual in respect of whom a background check has been conducted.</p>
            </content>
            <content>
              <p>Directions in connection with background checks required or permitted under the regulations—charges for serious offences</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-3">
            <num>3</num>
            <content>
              <p>Without limiting subsection (1), the AusCheck scheme may empower <role refersTo="#secretary">the Secretary</role> to give one or more of the following kinds of direction if <role refersTo="#secretary">the Secretary</role> considers on reasonable grounds that an individual has been charged with a serious offence:</p>
            </content>
            <paragraph eId="part-2__sec-11__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>a direction to an issuing body to delay considering an application for an ASIC or MSIC to be issued to the individual until further direction from <role refersTo="#secretary">the Secretary</role> in accordance with subsection (4);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>a direction to an issuing body to suspend an ASIC or MSIC issued by the issuing body to the individual until further direction from <role refersTo="#secretary">the Secretary</role> in accordance with subsection (4).</p>
              </content>
              <content>
                <p>Giving further directions referred to in subsection (3)</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-4">
            <num>4</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role>:</p>
            </content>
            <paragraph eId="part-2__sec-11__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>must give the further direction referred to in subsection (3) to the relevant person as soon as practicable after <role refersTo="#secretary">the Secretary</role> considers that:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>all charges for serious offences have been resolved in relation to the individual; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-4__para-ii">
              <num>ii</num>
              <content>
                <p>a background check has been conducted covering the matter referred to in paragraph 5(a) (criminal history) after subparagraph (i) is satisfied, whether or not the background check also covers other matters; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>may give the further direction at any time before paragraph (a) applies.</p>
              </content>
              <content>
                <p>Directions under subsection (3) to suspend ASICs or MSICs—other cards also taken to be suspended</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-5">
            <num>5</num>
            <content>
              <p>	(5)	If an ASIC or MSIC is suspended as referred to in paragraph (3)(c), then any other card issued to the individual under the <i>Aviation Transport Security Regulations</i><i> </i><i>2005</i> or the <i>Maritime Transport and Offshore Facilities Security Regulations</i><i> </i><i>2003</i> is taken also to be suspended.</p>
            </content>
            <content>
              <p>Other matters connected with giving directions under subsection (3)</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-6">
            <num>6</num>
            <content>
              <p>The AusCheck scheme may make provision for matters connected with the giving of a direction under subsection (3), including the following:</p>
            </content>
            <paragraph eId="part-2__sec-11__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>	(a)	preventing the individual from making any other application under the <i>Aviation Transport Security Regulations</i><i> </i><i>2005</i> or the <i>Maritime Transport and Offshore Facilities Security Regulations</i><i> </i><i>2003</i>, or entering any area or zone to which access is restricted under those regulations, until after the further direction referred to in subsection (3) has been given;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>preventing an issuing body or other person from issuing any card to the individual under those regulations until after the further direction referred to in subsection (3) has been given;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-6__para-c">
              <num>c</num>
              <content>

                  <p>the collection, use or disclosure is for the purposes of, or for purposes directly relating to, conducting a background check or advising on the status or outcome of a background check in respect of the individual under the AusCheck scheme; or</p>

                  <p>the collection, use or disclosure is for the purposes of updating information held by <role refersTo="#secretary">the Secretary</role> in respect of an individual in respect of whom a background check has been conducted under the AusCheck scheme; or</p>

                  <p>the collection, use or disclosure is for the purposes of providing an online verification service that will enable verification:</p>

                  <p>that an ASIC or MSIC has been issued to a particular individual and is in effect at a particular time; or</p>

                  <p>that an individual who is in possession of an ASIC or MSIC is the person to whom the card was issued; or</p>

                  <p>that a national security background check has been conducted under the AusCheck scheme in relation to a particular individual; or</p>

                  <p>that an individual who is in possession of a card, licence, permit or other authorisation in relation to which a national security background check has been conducted under the AusCheck scheme is the individual to whom the card, licence, permit or authorisation was issued.</p>

                  <p>Collection, use and disclosure of identity verification information</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-13__subsec-2">

              <content>
                <p>	(2)	The collection, use and disclosure of identity verification information about an individual is taken to be authorised by this Act for the purposes of the <i>Privacy Act 1988</i> if:</p>

                <num>a</num>
                <content>
                  <p>the collection, use or disclosure is directly necessary for the purpose of verifying the identity of an individual in respect of whom a background check is being or has been conducted under the AusCheck scheme; and</p>

                <num>b</num>

                  <p>for a use or disclosure—the information is only used or disclosed to the extent necessary for the purpose mentioned in paragraph (a).</p>

                  <p>Application of section in relation to firearms background checks</p>
                </content>

                <p>This section applies in relation to information (other than identity verification information) collected about an individual for the purposes of a firearms background check only if the individual is, or has been, the subject of the firearms background check.</p>

            <heading>Authorisation of retention and subsequent use and disclosure of information</heading>

                  <p>carrying out a subsequent background check in relation to the individual under the AusCheck scheme;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-14__subsec-2__para-ia">
                <num>ia</num>
                <content>
                  <p>	(ia)	monitoring and enforcing compliance with a requirement under the AusCheck scheme, the <i>Aviation Transport Security Regulations</i><i> </i><i>2005</i> or the <i>Maritime Transport and Offshore Facilities Security Regulations</i><i> </i><i>2003</i> to notify a Secretary of a Department of a specified matter;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-14__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>responding to an incident that poses a threat to national security;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-14__subsec-2__para-iii">

                  <p>the performance of functions relating to law enforcement or national security by the Commonwealth or a Commonwealth authority;</p>
                </content>
              </paragraph>

                  <p>the performance of functions relating to law enforcement or national security by a State or Territory or a State or Territory authority;</p>
                </content>
              </paragraph>

                  <p>without limiting subparagraph (iii) or (iiia)—determining whether any individual referred to in paragraph 8(3)(a) has been charged with a serious offence, or whether a charge for a serious offence has been resolved in relation to any such individual.</p>

              <num>2A</num>
              <content>
                <p>AusCheck scheme personal information about an individual (other than identity verification information) may also be used or disclosed for the purpose of verifying:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-14__subsec-2A__para-a">
                <num>a</num>
                <content>
                  <p>that an ASIC or MSIC has been issued to a particular individual and is in effect at a particular time; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-14__subsec-2A__para-b">
                <num>b</num>
                <content>
                  <p>that an individual who is in possession of an ASIC or MSIC is the person to whom the card was issued; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-14__subsec-2A__para-c">
                <num>c</num>
                <content>
                  <p>that a national security background check has been conducted in relation to a particular individual; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-14__subsec-2A__para-d">

                  <p>that an individual who is in possession of a card, licence, permit or other authorisation in relation to which a national security background check has been conducted is the individual to whom the card, licence, permit or authorisation was issued.</p>

                  <p>Use and disclosure of AusCheck scheme personal information that is identity verification information</p>
                  <p>(2AB)	AusCheck scheme personal information about an individual that is identity verification information may be used or disclosed for the purpose of verifying the identity of the individual if a subsequent background check is being conducted in respect of the individual under the AusCheck scheme.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-14__subsec-2B">
              <num>2B</num>
              <content>
                <p>AusCheck scheme personal information used or disclosed for the purpose mentioned in subsection (2A) or (2AB) must be limited to personal information of a kind directly necessary for that purpose, and must only be used or disclosed to the extent necessary for that purpose.</p>

            </subsection>

                <p>AusCheck scheme personal information included in the AusCheck database may be used in such a way that de-identified information derived from the AusCheck scheme personal information can be used and disclosed for the following purposes:</p>

                <content>
                  <p>research;</p>
                </content>
              </paragraph>

                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-14__subsec-3__para-c">

                  <p>Application of section in relation to firearms background checks</p>
                </content>

                <p>This section applies in relation to information (other than identity verification information) collected about an individual for the purposes of a firearms background check only if the individual is, or has been, the subject of the firearms background check.</p>

            <heading>Special rule relating to collection, retention, use and disclosure of identity verification information by AusCheck staff members</heading>

              <p>Despite sections 13 and 14, those sections only authorise the collection, retention, use and disclosure by <role refersTo="#secretary">the Secretary</role> or an AusCheck staff member of identity verification information about an individual in relation to whom a background check is being or has been conducted, if the collection, retention, use or disclosure is directly necessary for the purpose of:</p>

                <p>providing the information to the individual.</p>

                  <p>for the purposes of a criminal proceeding for an offence against this Act or regulations under this Act (including a proceeding to determine whether a person should be tried for an offence).</p>

        <heading>Other matters</heading>
        <section eId="part-5__sec-17">
          <num>17</num>
          <heading>Use of the name AusCheck</heading>
          <subsection eId="part-5__sec-17__subsec-1">
            <num>1</num>
            <content>
              <p>The Commonwealth is entitled to use the name “AusCheck” for the purposes of the AusCheck scheme.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-17__subsec-2">
            <num>2</num>
            <content>
              <p>If the operation of this section would result in an acquisition of property from a person otherwise than on just terms, the Commonwealth is liable to pay a reasonable amount of compensation to the person.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-17__subsec-3">
            <num>3</num>
            <content>
              <p>If the Commonwealth and the person do not agree on the amount of the compensation, the person may institute proceedings in a court of competent jurisdiction for the recovery from the Commonwealth of such reasonable amount of compensation as the court determines.</p>

          <heading>Regulations</heading>
          <subsection eId="part-5__sec-18__subsec-1">
            <num>1</num>
            <content>
              <p>The Governor-General may make regulations prescribing matters:</p>
            </content>
            <paragraph eId="part-5__sec-18__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-18__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-18__subsec-2">
            <num>2</num>
            <content>
              <p>The regulations may provide for the following:</p>
            </content>

              <num>a</num>
              <content>
                <p>the charging and recovery of fees and other charges in respect of matters specified in the regulations, being matters in relation to which expenses are incurred by the Commonwealth under this Act or under the regulations, but not that would otherwise amount to taxation;</p>

            <paragraph eId="part-5__sec-18__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the review of decisions under the regulations;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-18__subsec-2__para-c">

              <content>
                <p>the imposition of penalties, not exceeding <quantity refersTo="#penaltyUnit">100 penalty units</quantity>, for a contravention of the regulations;</p>

              <num>d</num>
              <content>
                <p>the making of guidelines about matters relating to background checking;</p>

                  <b>Editorial changes</b>
                </p>
                <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
                <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>
                <p>
                  <b>Misdescribed amendments</b>
                </p>
                <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
                <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
