          <heading>Short title</heading>

            <p>		This Act may be cited as the <i>Australian Organ and Tissue Donation and Transplantation Authority Act 2008</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act commences on <date date="2009-01-01">1 January 2009</date>.</p>
          </content>

          <num>3</num>
          <heading>Simplified outline</heading>
          <content>
            <p>The following is a simplified outline of this Act:</p>
            <p>This Act establishes the Australian Organ and Tissue Donation and Transplantation Authority. <role refersTo="#authority">The Authority</role> has a number of functions relating to organ or tissue donation and transplantation matters.</p>
            <p><role refersTo="#authority">The Authority</role> consists of the Chief Executive Officer and the staff of <role refersTo="#authority">the Authority</role>. The functions of <role refersTo="#ceo">the CEO</role> include:</p>

            <num>a</num>
            <content>
              <p>determining objectives, strategies and policies to be followed by <role refersTo="#authority">the Authority</role> in the performance of its functions; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>ensuring the proper, efficient and effective performance of <role refersTo="#authority">the Authority</role>’s functions; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>managing the administration of <role refersTo="#authority">the Authority</role>.</p>
            </content>
            <content>
              <p>The Australian Organ and Tissue Donation and Transplantation Advisory Board is also established by this Act. The Advisory Board’s main function is advising <role refersTo="#ceo">the CEO</role> about a number of matters including organ or tissue donation and transplantation matters.</p>
              <p>The Act also provides for <role refersTo="#ceo">the CEO</role> to establish expert advisory committees and for <role refersTo="#authority">the Authority</role> to make grants relating to organ or tissue donation and transplantation matters.</p>

        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-advisory-board-member">Advisory Board member</term> means <def>a member of the Advisory Board (and includes the Chair and Deputy Chair).</def></p>
            <p><b><i>Australia</i></b>, when used in a geographical sense, includes Norfolk Island, the Territory of Cocos (Keeling) Islands and the Territory of Christmas Island.</p>
            <p><term refersTo="#term-authorised-family-member">authorised family member</term> has the meaning given by <def><ref href="#sec-5">section 5</ref>.</def></p>
            <p><term refersTo="#term-authority">Authority</term> means <def>the Australian Organ and Tissue Donation and Transplantation Authority.</def></p>
            <p><term refersTo="#term-board">Board</term> means <def>the Australian Organ and Tissue Donation and Transplantation Advisory Board.</def></p>
            <p><term refersTo="#term-ceo">CEO</term> means <def>the Chief Executive Officer of the Authority.</def></p>
            <p><term refersTo="#term-chair">Chair</term> means <def>the Chair of the Advisory Board.</def></p>
            <p><b><i>child</i></b> has a meaning affected by section 5B.</p>
            <p><term refersTo="#term-constitutional-corporation">constitutional corporation</term> means <def>a corporation to which paragraph 51(xx) of the Constitution applies.</def></p>
            <p><term refersTo="#term-de-facto-partner">de facto partner</term> has the meaning given by <def><ref href="">the Acts Interpretation Act 1901</ref>.</def></p>
            <p><term refersTo="#term-deputy-chair">Deputy Chair</term> means <def>the Deputy Chair of the Advisory Board.</def></p>
            <p><term refersTo="#term-donatelife-agency">DonateLife Agency</term> has the meaning given by <def><ref href="#sec-5F">section 5F</ref>.</def></p>
            <p><term refersTo="#term-expert-advisory-committee">expert advisory committee</term> means <def>a committee established under <ref href="#sec-44">section 44</ref>.</def></p>
            <p><term refersTo="#term-expert-advisory-committee-member">expert advisory committee member</term> means <def>a member of an expert advisory committee, and includes the Chair of an expert advisory committee.</def></p>
            <p><term refersTo="#term-improving">improving</term> includes <def>maintaining.</def></p>
            <p><term refersTo="#term-organ">organ</term> means <def>an organ of a human body (within the ordinary meaning of that expression).</def></p>
            <p><b><i>organ or tissue donation and transplantation</i></b> means:</p>
          </content>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>the removal of an organ and/or tissue from the body of an individual (whether living or deceased) for the purpose of its transplantation to the body of a living individual (other than the individual from which it was removed); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>the transplantation to the body of a living individual of an organ and/or tissue removed from the body of another individual (whether living or deceased);</p>
            </content>
            <content>
              <p>or both.</p>
              <p><term refersTo="#term-organ-or-tissue-donation-and-transplantation-matter">organ or tissue donation and transplantation matter</term> means <def>a matter relating to organ or tissue donation and transplantation, and includes the following matters: the provision of an organ or tissue donation and transplantation service; the identification of potential organ or tissue donors; the obtaining of organs or tissue for transplantation; waiting lists for potential organ or tissue recipients; the allocation of organs or tissue for transplantation; support services for organ or tissue donors and their partners and families; the skills and knowledge of people involved in providing organ or tissue donation and transplantation services; commemorative activities relating to organ or tissue donors or recipients; public knowledge about, and confidence in, organ or tissue donation and transplantation services.</def></p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>the provision of an organ or tissue donation and transplantation service;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>the identification of potential organ or tissue donors;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">
            <num>c</num>
            <content>
              <p>the obtaining of organs or tissue for transplantation;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-d">
            <num>d</num>
            <content>
              <p>waiting lists for potential organ or tissue recipients;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-e">
            <num>e</num>
            <content>
              <p>the allocation of organs or tissue for transplantation;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-f">
            <num>f</num>
            <content>
              <p>support services for organ or tissue donors and their partners and families;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-g">
            <num>g</num>
            <content>
              <p>the skills and knowledge of people involved in providing organ or tissue donation and transplantation services;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-ga">
            <num>ga</num>
            <content>
              <p>commemorative activities relating to organ or tissue donors or recipients;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-h">
            <num>h</num>
            <content>
              <p>public knowledge about, and confidence in, organ or tissue donation and transplantation services.</p>
            </content>
            <content>
              <p><b><i>organ or tissue donation and transplantation service</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>a service relating to organ or tissue donation and transplantation; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>a service that is ancillary or incidental to a service covered by paragraph (a).</p>
            </content>
            <content>
              <p><term refersTo="#term-paid-work">paid work</term> means <def>work for financial gain or reward (whether as an employee, a self-employed person or otherwise).</def></p>
              <p><b><i>parent</i></b> has a meaning affected by section 5B.</p>
              <p><term refersTo="#term-partner">partner</term> has the meaning given by <def><ref href="#sec-5A">section 5A</ref>.</def></p>
              <p><b><i>sibling</i></b> has a meaning affected by section 5D.</p>
              <p><b><i>stepchild </i></b>has a meaning affected by section 5E.</p>
              <p><b><i>tissue</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>a part of a human body (other than an organ); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>a part of an organ; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">
            <num>c</num>
            <content>
              <p>a substance extracted from, or from a part of:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-i">
            <num>i</num>
            <content>
              <p>an organ; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-ii">
            <num>ii</num>
            <content>
              <p>any other part of a human body;</p>
            </content>
            <content>
              <p>but does not include a substance or thing specified in the regulations.</p>
              <p><b><i>transplantation</i></b>, in relation to an organ or tissue, includes:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>the transplantation of a part of the organ or tissue; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>the transplantation of a substance obtained from the organ or tissue.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Meaning of authorised family member</heading>
          <content>
            <p>		In this Act, <b><i>authorised family member</i></b> of an organ or tissue donor or recipient who has died means any of the following persons:</p>
          </content>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>the partner of the organ or tissue donor or recipient;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>a parent or legal guardian of the organ or tissue donor or recipient;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>a child of the organ or tissue donor or recipient;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-d">
            <num>d</num>
            <content>
              <p>a sibling of the organ or tissue donor or recipient;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-e">
            <num>e</num>
            <content>
              <p>a grandparent of the organ or tissue donor or recipient;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-f">
            <num>f</num>
            <content>
              <p>a grandchild of the organ or tissue donor or recipient;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-g">
            <num>g</num>
            <content>
              <p>if the organ or tissue donor or recipient has traditional Aboriginal or Torres Strait Islander kinship ties—a person who is related to the organ or tissue donor or recipient under Aboriginal or Torres Strait Islander kinship rules;</p>

              <p>if the organ or tissue donor or recipient is a member of a community that accepts relationships other than those referred to in paragraphs (a) to (g) as kinship ties—a person who is accepted by the community to be related to the organ or tissue donor or recipient;</p>

              <p>a person who, under the regulations, is taken to be an authorised family member of the organ or tissue donor or recipient.</p>

          <heading>Meaning of partner</heading>
          <subsection eId="part-1__sec-5A__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	In this Act, <b><i>partner</i></b> of a person means:</p>
            </content>
            <paragraph eId="part-1__sec-5A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the person’s spouse; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the person’s de facto partner.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-5A__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	However, if more than one person would qualify as a <b><i>partner</i></b> of a person (the <b><i>first person</i></b>) under subsection (1), then only the last person to so qualify is the <b><i>partner</i></b> of the first person for the purposes of this Act.</p>

          <heading>Meaning of child</heading>
          <subsection eId="part-1__sec-5B__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	In this Act, <b><i>child</i></b> of a person includes:</p>

                <p>an adopted child, stepchild, exnuptial child or foster child of the person; and</p>
              </content>

                <p>	(b)	someone who is a child of the person within the meaning of the <i>Family Law Act 1975</i>.</p>

                <p>Tracing family relationships</p>

              <p>For the purposes of this Act, if one person is the child of another person because of subsection (1), relationships traced to or through that person are to be determined on the basis that the person is the child of the other person.</p>

          <heading>Meaning of parent</heading>
          <content>
            <p>Without limiting who is a <b><i>parent </i></b>of a person for the purposes of this Act, a person (the <b><i>first person</i></b>) is a <b><i>parent</i></b> of another person if the other person is the first person’s child.</p>

        <section eId="part-1__sec-5D">
          <num>5D</num>
          <heading>Meaning of sibling</heading>
          <content>
            <p>		In this Act, <b><i>sibling </i></b>of a person includes a half-brother, half-sister, adoptive brother, adoptive sister, step-brother, step-sister, foster-brother and foster-sister of the person.</p>

          <num>5E</num>
          <heading>Meaning of stepchild</heading>
          <content>
            <p>In this Act, without limiting who is a stepchild of a person, a person (the <b><i>first person</i></b>) is a <b><i>stepchild</i></b> of another person (the <b><i>second person</i></b>) if the first person would be the second person’s stepchild except that the second person is not legally married to the second person’s de facto partner.</p>

          <num>5F</num>
          <heading>Meaning of DonateLife Agency</heading>
          <subsection eId="part-1__sec-5F__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Minister may, by legislative instrument, declare that a specified agency is a <b><i>DonateLife Agency </i></b>for the purposes of this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-5F__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	The Minister must not declare under subsection (1) that an agency is a <b><i>DonateLife Agency </i></b>unless the Minister is satisfied that the agency has a role or function in relation to one or more organ or tissue donation and transplantation matters.</p>

                <p>to support, encourage, conduct and evaluate training programs that are directed towards improving the skills and knowledge of people involved in organ or tissue donation and transplantation services; and</p>

              <content>
                <p>to support, encourage, conduct and evaluate educational, promotional and community awareness programs that are relevant to organ or tissue donation and transplantation matters; and</p>

              <content>
                <p>to make, on behalf of the Commonwealth, grants of financial assistance in relation to organ or tissue donation and transplantation matters; and</p>

                <p>to consult and co-operate with other persons, organisations and governments on organ or tissue donation and transplantation matters; and</p>

                <p>such other functions as are conferred on <role refersTo="#authority">the Authority</role> by this Act or any other law; and</p>

              <p>improving the identification of potential organ or tissue donors;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-12__para-iv">
            <num>iv</num>
            <content>
              <p>minimising waiting times for potential organ or tissue recipients;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-12__para-v">

            <content>
              <p>improving the management of waiting lists for potential organ or tissue recipients;</p>
            </content>
          </paragraph>

              <p>improving the management of the allocation of donated organs or tissue;</p>
            </content>
          </paragraph>

              <p>improving public knowledge about, and public confidence in, organ or tissue donation and transplantation services; and</p>

          </paragraph>
          <paragraph eId="part-2__sec-12__para-c">

              <p>effectiveness; and</p>

                <content>
                  <p>to ensure the proper, efficient and effective performance of <role refersTo="#authority">the Authority</role>’s functions; and</p>

                <content>
                  <p>to manage the administration of <role refersTo="#authority">the Authority</role>; and</p>

            <heading>Appointment of the CEO</heading>

                <p><role refersTo="#ceo">The CEO</role> is to be appointed by <role refersTo="#minister">the Minister</role> by written instrument.</p>
              </content>
            </subsection>

              <content>
                <p><role refersTo="#ceo">The CEO</role> holds office on a full-time basis.</p>
              </content>
            </subsection>
          </section>

            <heading>Period of appointment for the CEO</heading>
            <content>
              <p><role refersTo="#ceo">The CEO</role> holds office for the period specified in the instrument of appointment. The period must not exceed 5 years.</p>

                <p>during a vacancy in the office of CEO (whether or not an appointment has previously been made to the office); or</p>

                <p>during any period, or during all periods, when <role refersTo="#ceo">the CEO</role>:</p>
              </content>
            </paragraph>

                <p>is absent from duty or from Australia; or</p>
              </content>
            </paragraph>

                <p><role refersTo="#ceo">The CEO</role> is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, <role refersTo="#ceo">the CEO</role> is to be paid the remuneration that is prescribed by the regulations.</p>

            </subsection>

                <p><role refersTo="#ceo">The CEO</role> is to be paid the allowances that are prescribed by the regulations.</p>

                <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>

            <heading>Leave of absence</heading>

                <p><role refersTo="#ceo">The CEO</role> has the recreation leave entitlements that are determined by the Remuneration Tribunal.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-18__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may grant <role refersTo="#ceo">the CEO</role> leave of absence, other than recreation leave, on the terms and conditions as to remuneration or otherwise that <role refersTo="#minister">the Minister</role> determines.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-19">
            <num>19</num>
            <heading>Resignation</heading>
            <subsection eId="part-3__dvs-3__sec-19__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may resign his or her appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-19__subsec-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day it is received by <role refersTo="#minister">the Minister</role> or, if a later day is specified in the resignation, on that later day.</p>

            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-20">
            <num>20</num>
            <heading>Outside employment</heading>
            <content>
              <p><role refersTo="#ceo">The CEO</role> must not engage in paid employment outside the duties of his or her office without <role refersTo="#minister">the Minister</role>’s approval.</p>

            <num>22</num>
            <heading>Termination of appointment</heading>
            <subsection eId="part-3__dvs-3__sec-22__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of <role refersTo="#ceo">the CEO</role>:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-22__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>for misbehaviour; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-22__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if <role refersTo="#ceo">the CEO</role> is unable to perform the duties of <role refersTo="#ceo">the CEO</role>’s office because of physical or mental incapacity.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-22__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of <role refersTo="#ceo">the CEO</role> if:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-22__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p><role refersTo="#ceo">the CEO</role>:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-22__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>becomes bankrupt; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-22__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-22__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>compounds with his or her creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-22__subsec-2__para-iv">
                <num>iv</num>
                <content>
                  <p>makes an assignment of his or her remuneration for the benefit of his or her creditors; or</p>
                </content>
              </paragraph>

                  <p><role refersTo="#ceo">the CEO</role> is absent, except on leave of absence, for 14 consecutive days or for 28 days in any 12 months; or</p>

                <p>	(1)	The staff of the Authority are to be persons engaged under the <i>Public Service Act 1999</i>.</p>

                <p>	(2)	For the purposes of the <i>Public Service Act 1999</i>:</p>

                <p><role refersTo="#ceo">The CEO</role> may, on behalf of the Commonwealth, engage persons having suitable qualifications and experience as consultants to assist in the performance of <role refersTo="#authority">the Authority</role>’s functions.</p>

            </subsection>
            <subsection eId="part-3__dvs-5__sec-26__subsec-2">
              <num>2</num>
              <content>
                <p>The consultants are to be engaged on the terms and conditions that <role refersTo="#ceo">the CEO</role> determines in writing.</p>

            </subsection>
          </section>

            <heading>Persons assisting the Authority</heading>
            <content>
              <p><role refersTo="#authority">The Authority</role> may also be assisted:</p>

                <p>	(a)	by officers and employees of Agencies (within the meaning of the <i>Public Service Act 1999</i>); or</p>
              </content>
            </paragraph>

                <p>by officers and employees of authorities of the Commonwealth; or</p>
              </content>

                <p>Subject to this section, the Advisory Board members are to be appointed by <role refersTo="#minister">the Minister</role> by written instrument, on a part-time basis.</p>

                <p>A person is not eligible for appointment as an Advisory Board member unless <role refersTo="#minister">the Minister</role> is satisfied that the person has experience in, or knowledge of, at least one of the following fields:</p>

                <num>a</num>
                <content>
                  <p>public or health leadership or administration;</p>
                </content>
              </paragraph>

                  <p>clinical expertise in organ or tissue donation and transplantation;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-31__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>business management;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-31__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>community leadership and engagement in relation to organ or tissue donation and transplantation matters;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-31__subsec-2__para-e">
                <num>e</num>
                <content>
                  <p>promotion of organ or tissue donation and transplantation matters;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-31__subsec-2__para-f">
                <num>f</num>

                  <p>health consumer advocacy;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-31__subsec-2__para-g">

                  <p>any other field that <role refersTo="#minister">the Minister</role> considers appropriate.</p>
                </content>
                <content>
                  <p>Mix of Advisory Board members</p>
                </content>
              </paragraph>
            </subsection>

              <num>3</num>
              <content>
                <p>In appointing the Advisory Board members, <role refersTo="#minister">the Minister</role> must ensure, to the extent practicable, that those Advisory Board members are an appropriate mix of persons meeting the requirements of subsection (2).</p>

                <p>Consultation</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-31__subsec-4">
              <num>4</num>
              <content>
                <p>Before <role refersTo="#minister">the Minister</role> appoints a person as an Advisory Board member (other than the Chair), <role refersTo="#minister">the Minister</role> must consult:</p>
              </content>

                <num>a</num>
                <content>
                  <p><role refersTo="#minister">the Minister</role> of each State who is responsible, or principally responsible, for the administration of matters relating to health in the State; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-31__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#minister">the Minister</role> of the Northern Territory who is responsible, or principally responsible, for the administration of matters relating to health in that Territory; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-31__subsec-4__para-c">
                <num>c</num>
                <content>
                  <p><role refersTo="#minister">the Minister</role> of the Australian Capital Territory who is responsible, or principally responsible, for the administration of matters relating to health in that Territory; and</p>
                </content>
              </paragraph>

                <num>d</num>
                <content>
                  <p>such other persons (if any) as <role refersTo="#minister">the Minister</role> considers appropriate.</p>

          </section>
          <section eId="part-4__dvs-2__sec-32">
            <num>32</num>
            <heading>Term of appointment</heading>
            <content>
              <p>An Advisory Board member holds office for the period specified in the instrument of appointment. The period must not exceed 4 years.</p>
            </content>
          </section>
          <section eId="part-4__dvs-2__sec-33">
            <num>33</num>
            <heading>Acting appointment</heading>
            <content>
              <p>Acting as the Chair</p>
            </content>
            <subsection eId="part-4__dvs-2__sec-33__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by written instrument, appoint an Advisory Board member to act as the Chair:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-33__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>during a vacancy in the office of Chair, whether or not an appointment has previously been made to the office; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-33__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>during any period, or during all periods, when the Chair:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-33__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>is absent from duty or from Australia; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-33__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>is, for any reason, unable to perform the duties of the office.</p>
                </content>

                <p>A person is not eligible for appointment under subsection (2) unless <role refersTo="#minister">the Minister</role> is satisfied that the person meets the requirements of subsection 31(2).</p>

          </section>

            <num>34</num>
            <heading>Remuneration</heading>
            <subsection eId="part-4__dvs-2__sec-34__subsec-1">
              <num>1</num>
              <content>
                <p>An Advisory Board member is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, the Advisory Board member is to be paid the remuneration that is prescribed by the regulations.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-34__subsec-2">
              <num>2</num>
              <content>
                <p>An Advisory Board member is to be paid the allowances that are prescribed by the regulations.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-34__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-4__dvs-2__sec-35">
            <num>35</num>
            <heading>Leave of absence</heading>
            <subsection eId="part-4__dvs-2__sec-35__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may grant leave of absence to the Chair on the terms and conditions that <role refersTo="#minister">the Minister</role> determines.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-35__subsec-2">
              <num>2</num>
              <content>
                <p>The Chair may grant leave of absence to any other Advisory Board member on the terms and conditions that the Chair determines.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-35__subsec-3">
              <num>3</num>
              <content>
                <p>The Chair must notify <role refersTo="#minister">the Minister</role> if the Chair grants an Advisory Board member leave of absence for a period that exceeds 3 months.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-4__dvs-2__sec-36">
            <num>36</num>
            <heading>Other terms and conditions</heading>
            <content>
              <p>An Advisory Board member holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </section>
          <section eId="part-4__dvs-2__sec-37">
            <num>37</num>
            <heading>Resignation</heading>
            <subsection eId="part-4__dvs-2__sec-37__subsec-1">
              <num>1</num>
              <content>
                <p>An Advisory Board member may resign the member’s appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-37__subsec-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day it is received by <role refersTo="#minister">the Minister</role> or, if a later day is specified in the resignation, on that later day.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-4__dvs-2__sec-38">
            <num>38</num>
            <heading>Termination of appointment</heading>
            <subsection eId="part-4__dvs-2__sec-38__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of an Advisory Board member:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-38__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>for misbehaviour; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-38__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if the Advisory Board member is unable to perform the duties of that member’s office because of physical or mental incapacity.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-38__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of an Advisory Board member if:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-38__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the Advisory Board member:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-38__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>becomes bankrupt; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-38__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-38__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>compounds with that member’s creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-38__subsec-2__para-iv">
                <num>iv</num>
                <content>
                  <p>makes an assignment of that member’s remuneration for the benefit of that member’s creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-38__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the Advisory Board member is absent, except on leave of absence, from 3 consecutive meetings of the Advisory Board; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-38__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>	(c)	the Advisory Board member fails, without reasonable excuse, to comply with <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests) or rules made for the purposes of that section.<ref href="#sec-29">section 29</ref> of the </p>
                </content>
              </paragraph>
            </subsection>
          </section>
        </division>

          <heading>Meetings of the Advisory Board</heading>

            <heading>Convening meetings</heading>
            <subsection eId="part-4__dvs-3__sec-39__subsec-1">

              <content>
                <p>The Advisory Board must hold such meetings as are necessary for the efficient performance of its functions.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-39__subsec-2">
              <num>2</num>
              <content>
                <p>The Chair must convene at least 4 meetings of the Advisory Board each financial year.</p>
              </content>
            </subsection>
          </section>

            <heading>Presiding at meetings</heading>
            <subsection eId="part-4__dvs-3__sec-40__subsec-1">
              <num>1</num>
              <content>
                <p>The Chair must preside at all meetings of the Advisory Board at which the Chair is present.</p>

            <subsection eId="part-4__dvs-3__sec-40__subsec-2">
              <num>2</num>
              <content>
                <p>If the Chair is not present at a meeting of the Advisory Board:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-40__subsec-2__para-a">

                  <p>the Deputy Chair is to preside; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-40__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if the Deputy Chair is not present—the other Advisory Board members present must appoint one of themselves to preside.</p>
                </content>
              </paragraph>
            </subsection>

            <heading>Conduct of meetings</heading>

              <p>The Advisory Board may, subject to this Division, regulate proceedings at its meetings as it considers appropriate.</p>

              <p>The Advisory Board must keep minutes of its meetings.</p>

                <p>the way in which the committee is to carry out its function; and</p>

            </paragraph>

                <p>procedures to be followed in relation to meetings.</p>
              </content>

              <p>However, an expert advisory committee member is not entitled to be paid remuneration if he or she holds an office or appointment, or is otherwise employed, on a full-time basis in the service or employment of:</p>

              <content>
                <p>a State; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-48__subsec-2__para-b">

                <p>	(b)	a corporation (a <b><i>public statutory corporation</i></b>) that:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-48__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>is established for a public purpose by a law of a State; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-48__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>is not a tertiary education institution; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-48__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>a company limited by guarantee, where the interests and rights of the members in or in relation to the company are beneficially owned by a State; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-48__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>a company in which all the stock or shares are beneficially owned by a State or by a public statutory corporation.</p>
              </content>

              <p>	(1)	A disclosure by an expert advisory committee member under <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests) must be made to the CEO.<ref href="#sec-29">section 29</ref> of the </p>

              <p>Subsection (1) applies in addition to any rules made for the purposes of that section.</p>

          <heading>Protection of patient confidentiality—Authority and CEO</heading>

              <p>In the performance of <role refersTo="#authority">the Authority</role>’s functions, <role refersTo="#authority">the Authority</role> must not publish or disseminate information that is likely to enable the identification of a particular organ or tissue donor or recipient.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-58__subsec-1">
            <num>1</num>
            <content>
              <p>In the performance of <role refersTo="#ceo">the CEO</role>’s functions, <role refersTo="#ceo">the CEO</role> must not publish or disseminate information that is likely to enable the identification of a particular organ or tissue donor or recipient.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-58__subsec-2">
            <num>2</num>
            <content>
              <p>Subsections (1A) and (1) do not apply if the publication or dissemination of the information takes place with the consent of:</p>
            </content>
            <paragraph eId="part-7__sec-58__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>if the organ or tissue donor or recipient is aged at least 18 years—the organ or tissue donor or recipient; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58__subsec-2__para-ab">
              <num>ab</num>
              <content>
                <p>if the organ or tissue donor or recipient is under 16 years of age—a parent or legal guardian of the organ or tissue donor or recipient; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58__subsec-2__para-ac">
              <num>ac</num>
              <content>
                <p>if the organ or tissue donor or recipient:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58__subsec-2__para-i">

                <p>is 16 or 17 years of age; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58__subsec-2__para-ii">

                <p>has legal capacity to consent to the publication or dissemination of the information;</p>

                <p>the organ or tissue donor or recipient; or</p>
              </content>
            </paragraph>

              <content>
                <p>if the organ or tissue donor or recipient:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58__subsec-2__para-i">

                <p>is 16 or 17 years of age; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58__subsec-2__para-ii">
              <num>ii</num>

                <p>does not have legal capacity to consent to the publication or dissemination of the information;</p>
              </content>
              <content>
                <p>a parent or legal guardian of the organ or tissue donor or recipient; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>if the organ or tissue donor or recipient has died but is survived by one or more authorised family members—any of those authorised family members; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>in any other case—an individual who, under the regulations, is authorised to give consent to the publication or dissemination of the information.</p>
              </content>
            </paragraph>
          </subsection>

            <content>
              <p>Subsection (2) does not permit the publication or dissemination by <role refersTo="#authority">the Authority</role> or <role refersTo="#ceo">the CEO</role> of information that reveals that an organ and/or tissue was:</p>
            </content>
            <paragraph eId="part-7__sec-58__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>removed from the body of a particular organ or tissue donor; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>transplanted to the body of a particular organ or tissue recipient.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-58__subsec-4">
            <num>4</num>
            <content>
              <p>To avoid doubt, if the publication or dissemination by <role refersTo="#authority">the Authority</role> or <role refersTo="#ceo">the CEO</role> of particular information is permitted by subsection (2), a law of a State or Territory does not prevent the publication or dissemination by <role refersTo="#authority">the Authority</role> or <role refersTo="#ceo">the CEO</role> of the information.</p>

          <heading>Publication, dissemination or disclosure of patient information—DonateLife Agencies, grant recipients and authorised family members</heading>

              <p>This section applies if:</p>
            </content>
            <paragraph eId="part-7__sec-58A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an organ or tissue donation and transplantation has occurred; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the organ or tissue donor or recipient has died.</p>
              </content>
              <content>
                <p>Publication, dissemination or disclosure by a DonateLife Agency or grant recipient</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-58A__subsec-2">
            <num>2</num>
            <content>
              <p>Either of the following:</p>
            </content>
            <paragraph eId="part-7__sec-58A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a DonateLife Agency;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>a person who is a party to an agreement that:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58A__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>is in force; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58A__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>provides for the making of one or more grants under paragraph 11(1)(g) to the person;</p>
              </content>
              <content>
                <p>may publish, disseminate or disclose information that is likely to enable the identification of the deceased organ or tissue donor or the deceased organ or tissue recipient (as the case requires) if:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58A__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the publication, dissemination or disclosure is for the purposes of any of the following activities:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58A__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>an educational activity that is relevant to an organ or tissue donation and transplantation matter;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58A__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>a commemorative activity that is an organ or tissue donation and transplantation matter;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58A__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>a promotional activity that is relevant to an organ or tissue donation and transplantation matter;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58A__subsec-2__para-iv">
              <num>iv</num>
              <content>
                <p>a community awareness activity that is relevant to an organ or tissue donation and transplantation matter; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58A__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>	(d)	the publication, dissemination or disclosure is made with the consent of an authorised family member<i> </i>of the deceased organ or tissue donor or recipient; and</p>
              </content>
            </paragraph>

                <p>the publication, dissemination or disclosure is made:</p>
              </content>
            </paragraph>

                <p>using a service to which paragraph 51(v) of the Constitution applies; or</p>
              </content>
            </paragraph>

                <p>	(ii)	using an electronic service (within the meaning of the <i>Online Safety Act 2021</i>); or</p>
              </content>
            </paragraph>

                <p>in a Territory; or</p>
              </content>
            </paragraph>

              <p>An authorised family member of the deceased organ or tissue donor or recipient may publish, disseminate or disclose information that is likely to enable the identification of the deceased organ or tissue donor or the deceased organ or tissue recipient (as the case requires) if:</p>

                <p>the publication, dissemination or disclosure is for the purposes of any of the following activities of <role refersTo="#authority">the Authority</role> or a DonateLife Agency:</p>

              <num>i</num>
              <content>
                <p>an educational activity that is relevant to an organ or tissue donation and transplantation matter;</p>
              </content>
            </paragraph>

              <content>
                <p>a commemorative activity that is an organ or tissue donation and transplantation matter;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58A__subsec-3__para-iii">

                <p>a promotional activity that is relevant to an organ or tissue donation and transplantation matter;</p>

            </paragraph>

              <p>If information has been the subject of a publication, dissemination or disclosure under subsection (2) or (3), a person may publish, disseminate or disclose that information if:</p>

                <p>the publication, dissemination or disclosure is for the purposes of reporting on any of the following activities:</p>
              </content>
            </paragraph>

              <content>
                <p>an educational activity that is relevant to an organ or tissue donation and transplantation matter;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58A__subsec-5__para-ii">
              <num>ii</num>
              <content>
                <p>a commemorative activity that is an organ or tissue donation and transplantation matter;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-58A__subsec-5__para-iii">

              <content>
                <p>a promotional activity that is relevant to an organ or tissue donation and transplantation matter;</p>
              </content>
            </paragraph>

              <p>This Act is not intended to exclude or limit the operation of a law of a State or Territory that is capable of operating concurrently with this Act.</p>

              <p>This Act does not affect the operation of:</p>

                <p>to the extent that the law or rule requires the giving of consent to the removal of an organ or tissue from the body of an individual (whether living or deceased).</p>

            <p>The Governor-General may make regulations prescribing matters:</p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
              <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
