            <p>		This Act may be cited as the <i>Federation</i><i> Reform Fund Act 2008</i>.</p>

          <heading>Commencement</heading>
          <content>
            <p>This Act commences on <date date="2009-01-01">1 January 2009</date>.</p>

          <heading>Simplified outline</heading>

            <p>The following is a simplified outline of this Act:</p>
            <p>•	This Act establishes the Federation Reform Fund.</p>
            <p>•	The purpose of the Federation Reform Fund is the making of grants of financial assistance to the States and Territories.</p>
            <p>•	The terms and conditions on which financial assistance is granted are to be set out in a written agreement between the Commonwealth and the State or Territory.</p>

          <heading>Establishment of the Federation Reform Fund</heading>

              <p>The Federation Reform Fund is established by this section.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	The Federation Reform Fund is a special account for the purposes of the <i>Public Governance, Performance and Accountability Act 2013</i>.</p>

            <p>Scope</p>
          </content>

              <p>This section applies if:</p>
            </content>
            <paragraph eId="part-3__sec-7__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an amount is to be debited from the Federation Reform Fund for the purpose of making a grant of financial assistance to a State or Territory; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-7__subsec-1__para-ba">
              <num>ba</num>
              <content>
                <p>	(ba)	the grant is not covered by subsection 21(2) of the <i>DisabilityCare Australia Fund Act 2013</i>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-7__subsec-1__para-baa">
              <num>baa</num>
              <content>
                <p>	(baa)	the grant is not covered by subsection 21(1) of the <i>Medical Research Future Fund Act 2015</i>; and</p>
              </content>
            </paragraph>

              <num>bab</num>
              <content>
                <p>	(bab)	the grant is not covered by <i>Future Drought Fund Act 2019</i>; and<ref href="#sec-36A">section 36A</ref>B of the </p>

            <content>
              <p>The terms and conditions on which that financial assistance is granted are to be set out in a written agreement between the Commonwealth and the State or Territory.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-7__subsec-3">
            <num>3</num>
            <content>
              <p>An agreement under subsection (2) may be entered into by a Minister on behalf of the Commonwealth.</p>

          <heading>Delegation by a Minister</heading>

              <p>A Minister may, by writing, delegate any or all of his or her powers under <ref href="#sec-7">section 7</ref> to:</p>

              <num>a</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> of a Department; or</p>
              </content>
            </paragraph>

                <p>an SES employee, or acting SES employee, in a Department.</p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>

                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
              <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
