          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Infrastructure Australia Act 2008</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act commences on the day after it receives the Royal Assent.</p>
          </content>
        </section>
        <section eId="part-1__sec-2A">
          <num>2A</num>
          <heading>Object</heading>
          <content>
            <p>The object of this Act is to establish Infrastructure Australia as the Commonwealth Government’s independent adviser on nationally significant infrastructure investment planning and project prioritisation.</p>
          </content>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><b><i>Australia’s greenhouse gas emissions reduction targets</i></b> means:</p>
          </content>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>if:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-i">
            <num>i</num>
            <content>
              <p>Australia’s current nationally determined contribution was communicated in accordance with Article 4 of the Paris Agreement in June 2022; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-ii">
            <num>ii</num>
            <content>
              <p>that nationally determined contribution has not been adjusted in accordance with paragraph 11 of Article 4 of the Paris Agreement;</p>
            </content>
            <content>
              <p>		the greenhouse gas emissions reduction targets set out in paragraphs 10(1)(a) and (b) of the <i>Climate Change Act 2022</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>in any other case—the greenhouse gas emissions reduction targets included in:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-i">
            <num>i</num>
            <content>
              <p>Australia’s current nationally determined contribution communicated in accordance with Article 4 of the Paris Agreement; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-ii">
            <num>ii</num>
            <content>
              <p>if that nationally determined contribution has been adjusted in accordance with paragraph 11 of Article 4 of the Paris Agreement—that nationally determined contribution, as adjusted and in force from time to time.</p>
            </content>
            <content>
              <p><term refersTo="#term-ceo">CEO</term> means <def>the Chief Executive Officer of Infrastructure Australia appointed under <ref href="#sec-29">section 29</ref>.</def></p>
              <p><term refersTo="#term-chief-commissioner">Chief Commissioner</term> means <def>the Chief Commissioner appointed under <ref href="#sec-8">section 8</ref>.</def></p>
              <p><term refersTo="#term-commissioner">Commissioner</term> means <def>a Commissioner appointed under <ref href="#sec-8">section 8</ref> and includes the Chief Commissioner.</def></p>
              <p><term refersTo="#term-finance-minister">Finance Minister</term> means <def>the Minister who administers the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><term refersTo="#term-full-time-commissioner">full-time Commissioner</term> means <def>a Commissioner appointed on a full-time basis.</def></p>
              <p><term refersTo="#term-infrastructure-australia">Infrastructure Australia</term> means <def>the body established by <ref href="#sec-4">section 4</ref>.</def></p>
              <p><b><i>nationally significant infrastructure</i></b> includes:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>transport infrastructure; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>energy infrastructure; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>communications infrastructure; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-d">
            <num>d</num>
            <content>
              <p>water infrastructure; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-e">
            <num>e</num>
            <content>
              <p>social infrastructure;</p>
            </content>
            <content>
              <p>in which investment or further investment will materially improve national productivity.</p>
              <p><term refersTo="#term-paris-agreement">Paris Agreement</term> means <def>the Paris Agreement, done at Paris on 12 December 2015, as amended and in force for Australia from time to time.</def></p>
              <p><term refersTo="#term-part-time-commissioner">part-time Commissioner</term> means <def>a Commissioner appointed on a part-time basis.</def></p>
              <p><term refersTo="#term-quarter">quarter</term> means <def>a period of 3 months beginning on 1 January, 1 April, 1 July or 1 October of a year.</def></p>
              <p><term refersTo="#term-social-infrastructure">social infrastructure</term> means <def>facilities, spaces, services or networks that support quality of life and wellbeing of communities.</def></p>

        <heading>Infrastructure Australia</heading>
        <section eId="part-2__sec-4">
          <num>4</num>
          <heading>Establishment</heading>
          <subsection eId="part-2__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>Infrastructure Australia is established by this section.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>Infrastructure Australia:</p>
            </content>
            <paragraph eId="part-2__sec-4__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>is a body corporate; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-4__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>must have a seal; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-4__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>may acquire, hold and dispose of real and personal property; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-4__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>may sue and be sued.</p>
              </content>

                  <p>Note:	The <i>Public Governance, Performance and Accountability Act 2013</i> applies to Infrastructure Australia. That Act deals with matters relating to corporate Commonwealth entities, including reporting and the use and management of public resources.</p>

          </subsection>
          <subsection eId="part-2__sec-4__subsec-3">
            <num>3</num>
            <content>
              <p>Infrastructure Australia’s seal is to be kept in such custody as the Commissioners direct and must not be used except as authorised by the Commissioners.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-4__subsec-4">
            <num>4</num>
            <content>
              <p>All courts, judges and persons acting judicially must:</p>
            </content>
            <paragraph eId="part-2__sec-4__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>take judicial notice of the imprint of the seal of Infrastructure Australia appearing on a document; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-4__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>presume that the document was duly sealed.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-5">
          <num>5</num>
          <heading>Functions—general</heading>
          <content>
            <p>Infrastructure Australia has the following functions:</p>
          </content>
          <paragraph eId="part-2__sec-5__para-a">
            <num>a</num>
            <content>
              <p>to conduct audits in accordance with <ref href="#sec-5A">section 5A</ref>;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-5__para-aa">
            <num>aa</num>
            <content>
              <p>to conduct or endorse evaluations in accordance with <ref href="#sec-5B">section 5B</ref>;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-5__para-b">
            <num>b</num>
            <content>
              <p>to develop lists (to be known as Infrastructure Priority Lists) and plans (to be known as Infrastructure Plans) in accordance with <ref href="#sec-5C">section 5C</ref>;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-5__para-c">
            <num>c</num>
            <content>
              <p>the functions mentioned in <ref href="#sec-5D">section 5D</ref> (providing advice on infrastructure matters);</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-5__para-d">
            <num>d</num>
            <content>
              <p>to assess, and report on, projects relating to nationally significant infrastructure in accordance with <ref href="#sec-5D">section 5D</ref>A;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-5__para-h">
            <num>h</num>
            <content>
              <p>to undertake or commission research relating to Infrastructure Australia’s other functions;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-5__para-i">
            <num>i</num>
            <content>
              <p>any other functions conferred on Infrastructure Australia by or under this Act or any other law.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-5A">
          <num>5A</num>
          <heading>Functions—conducting audits</heading>
          <subsection eId="part-2__sec-5A__subsec-1">
            <num>1</num>
            <content>
              <p>For the purposes of paragraph 5(a), Infrastructure Australia has the function of conducting audits to determine the adequacy, capacity and condition of nationally significant infrastructure, taking into account:</p>
            </content>
            <paragraph eId="part-2__sec-5A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>forecast economic and population growth; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>economic, social and environmental sustainability; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5A__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>Australia’s greenhouse gas emissions reduction targets.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5A__subsec-2">
            <num>2</num>
            <content>
              <p>An audit must be prepared under this section at such intervals as the Commissioners determine.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5A__subsec-3">
            <num>3</num>
            <content>
              <p>In performing this function, Infrastructure Australia may consider State, Territory or local government reports on the adequacy, capacity and condition of nationally significant infrastructure.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5A__subsec-4">
            <num>4</num>
            <content>
              <p>Infrastructure Australia must cause a copy of an audit prepared under this section to be tabled in each House of the Parliament within 10 sitting days of that House after the audit is finalised.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-5B">
          <num>5B</num>
          <heading>Functions—evaluating infrastructure proposals</heading>
          <content>
            <p>National planning and assessment framework</p>
          </content>
          <subsection eId="part-2__sec-5B__subsec-1">
            <num>1</num>
            <content>
              <p>Infrastructure Australia must develop a national planning and assessment framework to promote national consistency and coordination in infrastructure evaluations.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5B__subsec-2">
            <num>2</num>
            <content>
              <p>The framework is not a legislative instrument.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5B__subsec-3">
            <num>3</num>
            <content>
              <p>Infrastructure Australia must give the framework to <role refersTo="#minister">the Minister</role> and publish the framework on Infrastructure Australia’s website.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5B__subsec-4">
            <num>4</num>
            <content>
              <p>Infrastructure Australia must review the framework at least every 5 years.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5B__subsec-5">
            <num>5</num>
            <content>
              <p>In developing and reviewing the framework, Infrastructure Australia must consult with States and Territories.</p>
            </content>
            <content>
              <p>Evaluations</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5B__subsec-6">
            <num>6</num>
            <content>
              <p>For the purposes of paragraph 5(aa), Infrastructure Australia has the function of evaluating, or endorsing evaluations conducted by or for States or Territories of, proposals covered by subsection (7) that are submitted by any of the following:</p>

              <num>a</num>
              <content>
                <p>the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-b">

                <p>	(b)	a Commonwealth entity (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-c">
              <num>c</num>
              <content>
                <p>a Commonwealth company (within the meaning of that Act);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-d">
              <num>d</num>
              <content>
                <p>a State;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-e">
              <num>e</num>
              <content>
                <p>a Territory.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5B__subsec-7">
            <num>7</num>
            <content>
              <p>For the purposes of subsection (6), this subsection covers proposals for investment in, or enhancements to, the following infrastructure:</p>
            </content>
            <paragraph eId="part-2__sec-5B__subsec-7__para-a">
              <num>a</num>
              <content>
                <p>nationally significant infrastructure;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-7__para-b">
              <num>b</num>
              <content>
                <p>other infrastructure determined by <role refersTo="#minister">the Minister</role>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5B__subsec-8">
            <num>8</num>
            <content>
              <p>A determination made by <role refersTo="#minister">the Minister</role> under paragraph (7)(b) is a legislative instrument.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5B__subsec-8A">
            <num>8A</num>
            <content>
              <p>In performing the function mentioned in subsection (6) in relation to a proposal, Infrastructure Australia must consider what impacts the proposal, if carried out, would have on:</p>
            </content>
            <paragraph eId="part-2__sec-5B__subsec-8A__para-a">
              <num>a</num>
              <content>
                <p>Australia’s net greenhouse gas emissions, as reported in national inventory reports in accordance with:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-8A__para-i">
              <num>i</num>
              <content>
                <p>the United Nations Framework Convention on Climate Change, done at New York on <date date="1992-05-09">9 May 1992</date>, as amended and in force for Australia from time to time; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-8A__para-ii">
              <num>ii</num>
              <content>
                <p>the Paris Agreement, done at Paris on <date date="2015-12-12">12 December 2015</date>, as amended and in force for Australia from time to time; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-8A__para-b">
              <num>b</num>
              <content>
                <p>the achievement of Australia’s greenhouse gas emissions reduction targets; and</p>
              </content>
            </paragraph>

              <content>
                <p>any policy issues arising from climate change that Infrastructure Australia considers relevant to the proposal.</p>
              </content>

              </content>
            </paragraph>

                <p>a summary of each proposal for which Infrastructure Australia endorsed an evaluation during the quarter.</p>
              </content>

                <p>Tabling requirement</p>

                <p>the national planning and assessment framework mentioned in subsection (1);</p>

          </subsection>
        </section>

          <num>5C</num>
          <heading>Functions—developing Infrastructure Priority Lists and Infrastructure Plans</heading>
          <content>
            <p>Infrastructure Priority Lists</p>
          </content>
          <subsection eId="part-2__sec-5C__subsec-1">
            <num>1</num>
            <content>
              <p>For the purposes of paragraph 5(b), Infrastructure Australia has the function of developing targeted Infrastructure Priority Lists that:</p>
            </content>
            <paragraph eId="part-2__sec-5C__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>specify priorities for Commonwealth investment in nationally significant infrastructure across Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5C__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>take into account:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5C__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>audits mentioned in <ref href="#sec-5A">section 5A</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5C__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>evaluations conducted or endorsed by Infrastructure Australia in accordance with <ref href="#sec-5B">section 5B</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5C__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>consultations with Commonwealth, State and Territory governments; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5C__subsec-1__para-iv">
              <num>iv</num>
              <content>
                <p>any other matters Infrastructure Australia considers relevant.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5C__subsec-2">
            <num>2</num>
            <content>
              <p>Infrastructure Australia must develop Infrastructure Priority Lists at such intervals as the Commissioners determine. Infrastructure Australia must also develop an Infrastructure Priority List if <role refersTo="#minister">the Minister</role> requests.</p>
            </content>
            <content>
              <p>Infrastructure Plans</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5C__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of paragraph 5(b), Infrastructure Australia has the function of developing Infrastructure Plans specifying priorities for nationally significant infrastructure across Australia.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5C__subsec-4">
            <num>4</num>
            <content>
              <p>An Infrastructure Plan:</p>
            </content>
            <paragraph eId="part-2__sec-5C__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>must be developed at the request of <role refersTo="#minister">the Minister</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5C__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>may be developed on Infrastructure Australia’s own initiative after consultation with <role refersTo="#minister">the Minister</role>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5C__subsec-5">
            <num>5</num>
            <content>
              <p>An Infrastructure Plan must cover the period determined by the Commissioners after consultation with <role refersTo="#minister">the Minister</role>.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5C__subsec-6">
            <num>6</num>
            <content>
              <p>Infrastructure Australia must make an Infrastructure Plan available on Infrastructure Australia’s website <quantity refersTo="#deadline">within 14 days</quantity> after it is developed.</p>
            </content>
            <content>
              <p>Tabling requirement</p>

          </subsection>
        </section>
        <section eId="part-2__sec-5D">
          <num>5D</num>
          <heading>Functions—providing advice on infrastructure matters</heading>
          <subsection eId="part-2__sec-5D__subsec-1">
            <num>1</num>
            <content>
              <p>For the purposes of paragraph 5(c), Infrastructure Australia has the following functions:</p>
            </content>
            <paragraph eId="part-2__sec-5D__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>to identify any impediments to investment in nationally significant infrastructure and identify strategies to remove any impediments identified;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to promote the timely and efficient delivery of nationally significant infrastructure projects, consistent with considerations of social and environmental sustainability;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>to identify and promote best practice in the planning and procurement of nationally significant infrastructure projects;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>to review and provide advice on proposals to facilitate the harmonisation of policies, and laws, relating to development of, and investment in, infrastructure;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>to review Commonwealth infrastructure funding programs and their alignment with Infrastructure Plans:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>at the request of <role refersTo="#minister">the Minister</role>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>after consultation with <role refersTo="#minister">the Minister</role>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>to inquire into and report on matters relating to nationally significant infrastructure:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>at the request of <role refersTo="#minister">the Minister</role>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>after consultation with <role refersTo="#minister">the Minister</role>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5D__subsec-2">
            <num>2</num>
            <content>
              <p>For the purposes of paragraph 5(c), Infrastructure Australia has the function of providing advice to <role refersTo="#minister">the Minister</role> and the Commonwealth on matters relating to infrastructure, including in relation to the following:</p>
            </content>
            <paragraph eId="part-2__sec-5D__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>Australia’s current and future needs and priorities relating to nationally significant infrastructure;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>policy, pricing and regulatory issues that may impact on the utilisation of infrastructure;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>policy issues arising from climate change, including the achievement of Australia’s greenhouse gas emissions reduction targets;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>impediments to the efficient utilisation of national infrastructure networks;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>options and reforms, including regulatory reforms, to make the utilisation of national infrastructure networks more efficient;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>the needs of users of infrastructure;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-2__para-g">
              <num>g</num>
              <content>
                <p>mechanisms for financing investment in infrastructure;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-2__para-h">
              <num>h</num>
              <content>
                <p>the delivery of infrastructure projects.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5D__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of paragraph (2)(h), Infrastructure Australia may evaluate the delivery of an infrastructure project, including evaluating:</p>
            </content>
            <paragraph eId="part-2__sec-5D__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the delivery against any targets set before or during delivery; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5D__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>any relevant assumptions made before or during delivery.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5D__subsec-4">
            <num>4</num>
            <content>
              <p>Infrastructure Australia also has the function of promoting public awareness of the matters mentioned in subsections (2) and (3), including by publishing information on its website.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-5DA">
          <num>5DA</num>
          <heading>Functions—assessments of certain nationally significant infrastructure projects without prior evaluation</heading>
          <subsection eId="part-2__sec-5DA__subsec-1">
            <num>1</num>
            <content>
              <p>For the purposes of paragraph 5(d), Infrastructure Australia has the function of assessing, and reporting on, projects covered by subsection (2).</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5DA__subsec-2">
            <num>2</num>
            <content>
              <p>A project is covered by this subsection if:</p>
            </content>
            <paragraph eId="part-2__sec-5DA__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>it is a project for investment in, or enhancements to, nationally significant infrastructure; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5DA__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the project involves expenditure by or on behalf of the Commonwealth; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5DA__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the Commonwealth Government’s total expenditure involved in the project is more than $250 million; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5DA__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>the Commonwealth Government has committed to the project without prior evaluation (or endorsement of evaluation) of a proposal for the project by Infrastructure Australia.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5DA__subsec-3">
            <num>3</num>
            <content>
              <p>Infrastructure Australia must ensure that assessments under this section are conducted at least once in each financial year beginning on or after the commencement of this section and prepare a report on the assessment.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5DA__subsec-4">
            <num>4</num>
            <content>
              <p>Infrastructure Australia must cause a copy of the report on the assessment under subsection (3) to be tabled in each House of the Parliament within 10 sitting days after it has been finalised.</p>
            </content>
            <content>
              <p>Other assessments</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5DA__subsec-5">
            <num>5</num>
            <content>
              <p>Infrastructure Australia may conduct other assessments under this section, and prepare reports on those assessments, on its own initiative.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5DA__subsec-6">
            <num>6</num>
            <content>
              <p>Infrastructure Australia must cause a copy of the report on the assessment mentioned in subsection (5) to be tabled in each House of the Parliament within 10 sitting days after it has been finalised.</p>
            </content>
            <content>
              <p>Conduct of assessments</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5DA__subsec-7">
            <num>7</num>
            <content>
              <p>The regulations may prescribe matters relating to the conduct of assessments under this section.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-5DB">
          <num>5DB</num>
          <heading>Functions—annual statements</heading>
          <subsection eId="part-2__sec-5DB__subsec-1">
            <num>1</num>
            <content>
              <p>Infrastructure Australia must, during each financial year, prepare and give to <role refersTo="#minister">the Minister</role> the following:</p>
            </content>
            <paragraph eId="part-2__sec-5DB__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an annual budget statement to inform the annual Commonwealth budget process on infrastructure investment; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5DB__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an annual performance statement on the performance outcomes being achieved by States, Territories and local government authorities in relation to the infrastructure investment program and existing project initiatives funded by the Commonwealth.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5DB__subsec-2">
            <num>2</num>
            <content>
              <p>Infrastructure Australia must cause each annual statement to be:</p>
            </content>
            <paragraph eId="part-2__sec-5DB__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>tabled in both Houses of the Parliament no later than 14 days prior to the scheduled public release of the annual Commonwealth budget each year; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5DB__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>published on Infrastructure Australia’s website as soon as practicable after the annual statement is tabled in the Parliament.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-5E">
          <num>5E</num>
          <heading>Infrastructure Australia must have regard to policies</heading>
          <content>
            <p>In performing its functions and exercising its powers, Infrastructure Australia must have regard to the policies of the Commonwealth Government in relation to infrastructure.</p>
          </content>
        </section>
        <section eId="part-2__sec-6">
          <num>6</num>
          <heading>Minister may give directions to Infrastructure Australia</heading>
          <subsection eId="part-2__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may give written directions to Infrastructure Australia about the performance of its functions.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>In giving directions under subsection (1), <role refersTo="#minister">the Minister</role> may have regard to any relevant decisions of a body (however described) that consists only of, or that includes, the following:</p>
            </content>
            <paragraph eId="part-2__sec-6__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the Prime Minister;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the Premiers of each State;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the Chief Ministers of the Australian Capital Territory and Northern Territory.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-3">
            <num>3</num>
            <content>
              <p>Directions given by <role refersTo="#minister">the Minister</role> under subsection (1) must be of a general nature only.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-4">
            <num>4</num>
            <content>
              <p>However, <role refersTo="#minister">the Minister</role> must not give directions about the content of any audit, list, evaluation, plan or advice to be provided by Infrastructure Australia.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-5">
            <num>5</num>
            <content>
              <p>Infrastructure Australia must comply with any direction given by <role refersTo="#minister">the Minister</role> under subsection (1).</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-6">
            <num>6</num>
            <content>
              <p>A direction given by <role refersTo="#minister">the Minister</role> under subsection (1) is not a legislative instrument.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-6A">
          <num>6A</num>
          <heading>Powers</heading>
          <subsection eId="part-2__sec-6A__subsec-1">
            <num>1</num>
            <content>
              <p>Infrastructure Australia has power to do all things necessary or convenient to be done for or in connection with the performance of its functions.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-6A__subsec-2">
            <num>2</num>
            <content>
              <p>Infrastructure Australia’s powers include, but are not limited to, the following powers:</p>
            </content>
            <paragraph eId="part-2__sec-6A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the power to enter into contracts and agreements;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the power to occupy, use and control any land or building owned or held under lease by the Commonwealth and made available for the purposes of Infrastructure Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the power to acquire, hold and dispose of real or personal property;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>the power to negotiate and cooperate with other Commonwealth bodies and with State, Territory and local government bodies;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>the power to do anything incidental to any of its powers.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-6B">
          <num>6B</num>
          <heading>Consultation</heading>
          <content>
            <p>Infrastructure Australia must, in performing its functions and exercising its powers, consult with such of the following as it considers appropriate:</p>
          </content>
          <paragraph eId="part-2__sec-6B__para-a">
            <num>a</num>
            <content>
              <p>government, commercial, industrial, consumer, academic, professional and other relevant bodies and organisations;</p>
            </content>
          </paragraph>

                <p>In performing their functions and exercising their powers, the Commissioners must have regard to the policies of the Commonwealth Government in relation to infrastructure.</p>

                <p>Commissioners (including the Chief Commissioner) are to be appointed by <role refersTo="#minister">the Minister</role> by written instrument.</p>

            </subsection>

                <p>A Commissioner may be appointed on a full-time or part-time basis.</p>
              </content>
            </subsection>
            <subsection eId="part-2A__dvs-2__sec-8__subsec-2A">

                <p>In appointing the Commissioners, <role refersTo="#minister">the Minister</role> must ensure that at least one of the Commissioners has a substantial connection to, or substantial experience in, a regional area through business, industry or community involvement.</p>

            <subsection eId="part-2A__dvs-2__sec-8__subsec-3">
              <num>3</num>
              <content>
                <p>A person must not be appointed as a Commissioner unless <role refersTo="#minister">the Minister</role> is satisfied that:</p>

                <num>a</num>
                <content>
                  <p>the person has appropriate qualifications, knowledge, skills or experience; and</p>
                </content>
              </paragraph>

                  <p>the selection of the person for the appointment is the result of a process that:</p>
                </content>
              </paragraph>

                  <p>was merit-based; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2A__dvs-2__sec-8__subsec-3__para-ii">

                  <p>included public advertising of the position.</p>

            </subsection>
            <subsection eId="part-2A__dvs-2__sec-8__subsec-4">

                <p>Paragraph (3)(b) does not prevent <role refersTo="#minister">the Minister</role>:</p>
              </content>
              <paragraph eId="part-2A__dvs-2__sec-8__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>taking affirmative action in relation to the appointment of women to positions; or</p>
                </content>
              </paragraph>

                  <p>taking into consideration appropriate representation among States, Territories and local government areas in relation to appointments to positions.</p>
                </content>
              </paragraph>
            </subsection>

                <p>Paragraph (3)(b) does not apply in relation to the reappointment of a person who, immediately before the start of the period of reappointment, holds office as a Commissioner under a previous appointment under subsection (1).</p>

            <heading>Term of appointment</heading>

              <p>A Commissioner holds office for the period specified in the instrument of appointment. The period must not exceed 5 years.</p>

                <p>If the Chief Commissioner is a full-time Commissioner, <role refersTo="#minister">the Minister</role> may grant the Chief Commissioner leave of absence, other than recreation leave, on the terms and conditions as to remuneration or otherwise that <role refersTo="#minister">the Minister</role> determines.</p>

            </subsection>

                <p>The Chief Commissioner may grant leave of absence to a part-time Commissioner (other than the Chief Commissioner) on the terms and conditions that the Chief Commissioner determines.</p>

            <heading>Outside employment</heading>
            <content>
              <p>A full-time Commissioner must not engage in paid employment outside the duties of <role refersTo="#commissioner">the Commissioner</role>’s office without <role refersTo="#minister">the Minister</role>’s approval.</p>

            <num>16</num>
            <heading>Other terms and conditions</heading>
            <content>
              <p>A Commissioner holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by <role refersTo="#minister">the Minister</role>.</p>

            <num>17</num>
            <heading>Resignation of Commissioners</heading>
            <subsection eId="part-2A__dvs-2__sec-17__subsec-1">
              <num>1</num>
              <content>
                <p>A Commissioner may resign <role refersTo="#commissioner">the Commissioner</role>’s appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>
              </content>
            </subsection>
            <subsection eId="part-2A__dvs-2__sec-17__subsec-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day it is received by <role refersTo="#minister">the Minister</role> or, if a later day is specified in the resignation, on that later day.</p>

            <heading>Termination of appointment</heading>

              <p>All Commissioners</p>
            </content>

                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of a Commissioner:</p>
              </content>

                  <p>for misbehaviour; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2A__dvs-2__sec-18__subsec-1__para-b">

                  <p>if <role refersTo="#commissioner">the Commissioner</role> is unable to perform the duties of <role refersTo="#commissioner">the Commissioner</role>’s office because of physical or mental incapacity.</p>

                <p><role refersTo="#minister">The Minister</role> may terminate the appointment of a Commissioner if <role refersTo="#commissioner">the Commissioner</role>:</p>

                  <p>becomes bankrupt; or</p>
                </content>
              </paragraph>

                  <p>takes steps to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
                </content>
              </paragraph>

                  <p>compounds with one or more of <role refersTo="#commissioner">the Commissioner</role>’s creditors; or</p>

                <p>The Chief Commissioner must preside at all meetings at which the Chief Commissioner is present.</p>

                <p>If the Chief Commissioner is not present at a meeting, the other Commissioners present must appoint one of themselves to preside.</p>

                  <p>	(a)	a Commissioner is required by rules made for the purposes of <i>Public Governance, Performance and Accountability Act 2013</i> not to be present during the deliberations, or to take part in any decision, of the Commissioners with respect to a particular matter; and<ref href="#sec-29">section 29</ref> of the </p>

                <p>A question arising at a meeting is to be determined by a majority of the votes of the Commissioners present and voting.</p>

                <p>The person presiding at a meeting has a deliberative vote and, in the event of an equality of votes, a casting vote.</p>

              <p>The Commissioners may regulate proceedings at their meetings as they consider appropriate.</p>

                  <p>without meeting, a majority of the Commissioners entitled to vote on the proposed decision indicate agreement with the decision; and</p>

                  <p>that agreement is indicated in accordance with the method determined by the Commissioners under subsection (2); and</p>

            <heading>Disclosure of interests</heading>

                <p>	(1)	A disclosure by the CEO under <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests) must be made to the Commissioners.<ref href="#sec-29">section 29</ref> of the </p>

                <p>Subsection (1) applies in addition to any rules made for the purposes of that section.</p>

              <p><role refersTo="#ceo">The CEO</role> must not engage in paid employment outside the duties of his or her office without the Chief Commissioner’s approval.</p>

            <heading>Other terms and conditions</heading>
            <content>
              <p><role refersTo="#ceo">The CEO</role> holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by the Commissioners.</p>

          <section eId="part-3__dvs-1__sec-37">
            <num>37</num>
            <heading>Resignation</heading>
            <subsection eId="part-3__dvs-1__sec-37__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may resign his or her appointment by giving the Chief Commissioner a written resignation.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-37__subsec-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day it is received by the Chief Commissioner or, if a later day is specified in the resignation, on that later day.</p>
              </content>
            </subsection>
          </section>

            <heading>Termination of appointment</heading>
            <content>
              <p>The Commissioners may terminate the appointment of <role refersTo="#ceo">the CEO</role> at any time, by instrument in writing.</p>

          <heading>Staff and consultants</heading>

            <heading>Staff of Infrastructure Australia</heading>

                <p>Infrastructure Australia may do either or both of the following:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-39__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	engage persons under the <i>Public Service Act 1999</i>;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-39__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>employ under written agreements such persons as Infrastructure Australia thinks necessary for the performance or exercise of any of its functions or powers.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-39__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	For the purposes of the <i>Public Service Act 1999</i>:</p>
              </content>

                  <p><role refersTo="#ceo">the CEO</role> and the APS employees referred to in paragraph (1)(a) together constitute a Statutory Agency; and</p>

                  <p><role refersTo="#ceo">the CEO</role> is the Head of that Statutory Agency.</p>

            <heading>Staff seconded to Infrastructure Australia</heading>

                <p>Infrastructure Australia may be assisted by:</p>

              <paragraph eId="part-3__dvs-2__sec-39A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	persons engaged under the <i>Public Service Act 1999</i>, and officers and employees of authorities of the Commonwealth, whose services are made available to Infrastructure Australia in connection with the performance of its functions or the exercise of its powers; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-39A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>persons whose services are so made available under arrangements made under subsection (2).</p>

                <p>Infrastructure Australia may make with the appropriate authority or officer of a State or Territory an arrangement under which the State or Territory may make officers or employees available to Infrastructure Australia to perform services in connection with the performance of its functions or the exercise of its powers.</p>

          <heading>Corporate plan</heading>

            <p>		In preparing or varying a corporate plan under <i>Public Governance, Performance and Accountability Act 2013</i>, the Commissioners must consult with:<ref href="#sec-35">section 35</ref> of the </p>

            <content>
              <p><role refersTo="#minister">the Minister</role>; and</p>
            </content>
          </paragraph>

          <heading>Annual report</heading>

            <p>		The annual report prepared by the Commissioners and given to the Minister under <i>Public Governance, Performance and Accountability Act 2013</i> for a period must also include details of any directions given to Infrastructure Australia by the Minister under subsection 6(1) of this Act during the period.<ref href="#sec-46">section 46</ref> of the </p>

        <heading>Finance</heading>

          <heading>Money payable to Infrastructure Australia</heading>

              <p>There is payable to Infrastructure Australia such money as is appropriated by the Parliament for the purposes of Infrastructure Australia.</p>
            </content>
          </subsection>
          <subsection eId="part-3B__sec-39D__subsec-2">

              <p>The Finance Minister may give directions about the amounts in which, and the times at which, money payable under subsection (1) is to be paid to Infrastructure Australia.</p>

              <p>If a direction under subsection (2) is given in writing, the direction is not a legislative instrument.</p>

                <p>in payment or discharge of the costs, expenses and other obligations incurred or undertaken by Infrastructure Australia in the performance of its functions and the exercise of its powers; and</p>

                <p>in payment of any remuneration or allowances payable under this Act.</p>

          <heading>Restrictions on financial transactions</heading>

                <p>acquire any property, right or privilege for a consideration exceeding in amount or value the amount prescribed by the regulations for the purposes of this paragraph; or</p>

                <p>dispose of any property, right or privilege if the amount or value of the consideration for the disposal, or the value of the property, right or privilege, exceeds the amount prescribed by the regulations for the purposes of this paragraph; or</p>

              <p>If Infrastructure Australia or the Commissioners delegate a power or function under subsection 40A(1) or 40B(1) to <role refersTo="#ceo">the CEO</role>, <role refersTo="#ceo">the CEO</role> may, in writing, subdelegate the power or function to a person mentioned in paragraph (1)(a), (b) or (c) of this section.</p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
              <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
