        <heading>Short title</heading>
        <content>
          <p>		This Act may be cited as the <i>Private Health Insurance (National Joint Replacement Register Levy)</i> <i>Act 2009</i>.</p>
        </content>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

        <heading>Crown to be bound</heading>
        <content>
          <p>This Act binds the Crown in each of its capacities.</p>
        </content>

        <heading>Extension of Act to external Territories</heading>
        <content>
          <p>This Act extends to the Territory of Cocos (Keeling) Islands and to the Territory of Christmas Island.</p>

        <num>5</num>
        <heading>Definitions</heading>
        <subsection eId="sec-5__subsec-1">
          <num>1</num>
          <content>
            <p>In this Act:</p>
          </content>
          <content>
            <p><term refersTo="#term-joint-replacement-device">joint replacement device</term> means <def>a medical device (within the meaning of <ref href="">the Private Health Insurance Act 2007</ref>) that: is listed in the Private Health Insurance (Medical Devices and Human Tissue Products) Rules; and is used in joint replacement.</def></p>
          </content>
          <paragraph eId="sec-5__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>is listed in the Private Health Insurance (Medical Devices and Human Tissue Products) Rules; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-5__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>is used in joint replacement.</p>
            </content>
            <content>
              <p><term refersTo="#term-national-joint-replacement-register-levy">national joint replacement register levy</term> means <def>the national joint replacement register levy imposed under <ref href="#sec-6">section 6</ref>.</def></p>
              <p><term refersTo="#term-national-joint-replacement-register-levy-day">national joint replacement register levy day</term> means <def>a national joint replacement register levy day specified in the Private Health Insurance (National Joint Replacement Register Levy) Rules made for the purposes of <ref href="#sec-6">section 6</ref>.</def></p>
              <p><term refersTo="#term-private-health-insurance-medical-devices-and-human-tissue-products-rules">Private Health Insurance (Medical Devices and Human Tissue Products) Rules</term> means <def>the Private Health Insurance (Medical Devices and Human Tissue Products) Rules made for the purposes of item 4 of the table in subsection 333-20(1) of <ref href="">the Private Health Insurance Act 2007</ref>.</def></p>
              <p><term refersTo="#term-private-health-insurance-national-joint-replacement-register-levy-rules">Private Health Insurance (National Joint Replacement Register Levy) Rules</term> means <def>the Private Health Insurance (National Joint Replacement Register Levy) Rules made under <ref href="#sec-8">section 8</ref>.</def></p>
              <p><term refersTo="#term-register">register</term> means <def>the register known as the Australian Orthopaedic Association National Joint Replacement Registry.</def></p>
              <p><term refersTo="#term-supplementary-national-joint-replacement-register-levy-day">supplementary national joint replacement register levy day</term> means <def>a supplementary national joint replacement register levy day specified in a determination by the Minister under <ref href="#sec-8A">section 8A</ref>.</def></p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-5__subsec-3">
          <num>3</num>
          <content>
            <p>	(3)	The Private Health Insurance (National Joint Replacement Register Levy) Rules may provide that one or more classes of medical devices (within the meaning of the <i>Private Health Insurance Act 2007</i>) are taken, or are taken not, to be joint replacement devices for the purposes of the definition of <b><i>joint replacement device</i></b> in subsection (1).</p>

        </subsection>
      </section>
      <section eId="sec-6">
        <num>6</num>
        <heading>Imposition of national joint replacement register levy</heading>
        <subsection eId="sec-6__subsec-1">
          <num>1</num>
          <content>
            <p>National joint replacement register levy is imposed on the recording on the register of the provision of a joint replacement device:</p>
          </content>
          <paragraph eId="sec-6__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>on each day specified in the Private Health Insurance (National Joint Replacement Register Levy) Rules as a national joint replacement register levy day for a financial year; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-6__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>on each day (if any) specified in a determination under <ref href="#sec-8A">section 8A</ref> as a supplementary national joint replacement register levy day for a financial year.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-6__subsec-2">
          <num>2</num>
          <content>
            <p>The Private Health Insurance (National Joint Replacement Register Levy) Rules must not specify more than 4 levy days for a financial year.</p>
          </content>
        </subsection>
        <subsection eId="sec-6__subsec-3">
          <num>3</num>
          <content>
            <p>	(3)	The determination under <i>.</i><ref href="#sec-8A">section 8A</ref> must not specify more than 2 supplementary levy days for a financial year</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>Rate of national joint replacement register levy</heading>
        <subsection eId="sec-7__subsec-1">
          <num>1</num>
          <content>
            <p>The rate of national joint replacement register levy imposed on a particular day is worked out using the following table:</p>

        </subsection>
        <subsection eId="sec-7__subsec-2">
          <num>2</num>
          <content>
            <p>The Private Health Insurance (National Joint Replacement Register Levy) Rules, and a determination under <ref href="#sec-8A">section 8A</ref>, may:</p>
          </content>
          <paragraph eId="sec-7__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>specify different rates of levy, or different methods for calculating the rate of levy, in relation to different classes of joint replacement devices; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>specify a rate of levy of zero in relation to one or more classes of joint replacement devices; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-7__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>	(c)	specify a rate of levy, or a method for calculating the rate of levy, that takes into account the number of times recordings were made on the register of the provision of<i> </i>a joint replacement device during a particular period.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-7__subsec-3">
          <num>3</num>
          <content>
            <p>Despite subsection (2), the total amount of levy for a financial year for recordings on the register of the provision of a joint replacement device must not exceed $5,000.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-7A">
        <num>7A</num>
        <heading>Who must pay the national joint replacement register levy?</heading>
        <content>
          <p>National joint replacement register levy imposed in relation to a joint replacement device is payable by the person specified by the Private Health Insurance (National Joint Replacement Register Levy) Rules for the joint replacement device.</p>
        </content>
      </section>
      <section eId="sec-8">
        <num>8</num>
        <heading>Private Health Insurance (National Joint Replacement Register Levy) Rules</heading>
        <content>
          <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make Private Health Insurance (National Joint Replacement Register Levy) Rules providing for matters:</p>
        </content>
        <paragraph eId="sec-8__para-a">
          <num>a</num>
          <content>
            <p>required or permitted by this Act to be provided; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-8__para-b">
          <num>b</num>
          <content>
            <p>necessary or convenient to be provided in order to carry out or give effect to this Act.</p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-8A">
        <num>8A</num>
        <heading>Ministerial determination</heading>
        <content>
          <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make a determination:</p>
        </content>
        <paragraph eId="sec-8A__para-a">
          <num>a</num>
          <content>
            <p>specifying a supplementary national joint replacement register levy day for a financial year (see <ref href="#sec-6">section 6</ref>); and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-8A__para-b">
          <num>b</num>
          <content>
            <p>specifying, or specifying a method for calculating, a rate of national joint replacement register levy (see <ref href="#sec-7">section 7</ref>).</p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-9">
        <num>9</num>
        <heading>Regulations</heading>
        <content>
          <p>The Governor-General may make regulations prescribing matters:</p>
        </content>
        <paragraph eId="sec-9__para-a">
          <num>a</num>
          <content>
            <p>required or permitted by this Act to be prescribed; or</p>
          </content>
        </paragraph>
        <paragraph eId="sec-9__para-b">
          <num>b</num>
          <content>
            <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>

            </p>
            <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>

              <b>Misdescribed amendments</b>
            </p>
            <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
            <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
