          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Astronomical Functions Act 2010</i>.</p>
          </content>

          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act commences on <date date="2010-07-01">1 July 2010</date>.</p>
          </content>

          <heading>Simplified outline of this Act</heading>
          <content>
            <p>This Act provides that <role refersTo="#secretary">the Secretary</role> has various functions relating to optical astronomy.</p>
            <p>The Commonwealth may charge fees in connection with things done in the performance of <role refersTo="#secretary">the Secretary</role>’s functions.</p>
            <p><role refersTo="#secretary">The Secretary</role> may delegate functions and powers under this Act to APS employees in the Department.</p>

          <num>4</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-optical">optical</term> includes <def>radiation in the near-ultraviolet, visible and infrared portions of the electromagnetic spectrum.</def></p>
            <p><term refersTo="#term-optical-astronomy-facility">optical astronomy facility</term> means <def>a telescope, or other facility, for making optical astronomical observations, and includes any associated equipment, buildings or infrastructure.</def></p>
            <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>

          <num>5</num>
          <heading>Crown to be bound</heading>
          <content>
            <p>This Act binds the Crown in each of its capacities.</p>
          </content>
        </section>
        <section eId="part-1__sec-6">
          <num>6</num>
          <heading>Extension to external Territories</heading>
          <content>
            <p>This Act extends to every external Territory.</p>
          </content>
        </section>

          <heading>Extra-territorial application</heading>
          <content>
            <p>This Act applies both within and outside Australia.</p>

          <heading>Astronomical functions</heading>
          <subsection eId="part-3__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> has functions relating to optical astronomy.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>Those functions include the following:</p>
            </content>
            <paragraph eId="part-3__sec-11__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>to operate, construct, develop and maintain national optical astronomy facilities;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>to support optical astronomy facilities;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>to consult and co-operate with other persons, organisations and governments on matters relating to optical astronomy;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>to facilitate access to optical astronomy facilities;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>to develop, manufacture and provide instrumentation for optical astronomy facilities;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>to support the development, manufacture and provision of instrumentation for optical astronomy facilities;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-g">
              <num>g</num>
              <content>
                <p>to support, encourage, conduct and evaluate research about matters relating to optical astronomy;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-h">
              <num>h</num>
              <content>
                <p>to support, encourage, conduct and evaluate educational, promotional and community awareness programs that are relevant to optical astronomy;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>to publish (whether on the internet or otherwise) reports, papers and information relating to optical astronomy;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-j">
              <num>j</num>
              <content>
                <p>to advise <role refersTo="#minister">the Minister</role> about matters relating to optical astronomy;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-k">
              <num>k</num>
              <content>
                <p>to implement Australia’s international obligations in relation to optical astronomy;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-l">
              <num>l</num>
              <content>
                <p>such other functions (if any) as are specified in the regulations;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-2__para-m">
              <num>m</num>

                <p>to do anything incidental to or conducive to the performance of any of the above functions.</p>
              </content>
            </paragraph>
          </subsection>

              <p>Subsection (2) does not limit subsection (1).</p>

          <heading>Fees</heading>

            <p>The Commonwealth may charge fees for things done in the performance of the functions conferred by <ref href="#sec-11">section 11</ref>.</p>

          <heading>Delegation by the Secretary</heading>
          <subsection eId="part-5__sec-23__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, by writing, delegate all or any of <role refersTo="#secretary">the Secretary</role>’s functions or powers under this Act to an APS employee in the Department who has expertise appropriate to the function or power delegated.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-3">
            <num>3</num>
            <content>
              <p>In exercising functions or powers under a delegation, the delegate must comply with any directions of <role refersTo="#secretary">the Secretary</role>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-24">
          <num>24</num>
          <heading>Executive power of the Commonwealth</heading>
          <content>
            <p>This Act does not limit the executive power of the Commonwealth.</p>
          </content>
        </section>
        <section eId="part-5__sec-25">
          <num>25</num>
          <heading>Concurrent operation of State and Territory laws</heading>
          <content>
            <p>This Act is not intended to exclude or limit the operation of a law of a State or Territory that is capable of operating concurrently with this Act.</p>

          <num>26</num>
          <heading>Regulations</heading>
          <content>
            <p>The Governor-General may make regulations prescribing matters:</p>
          </content>
          <paragraph eId="part-5__sec-26__para-a">
            <num>a</num>
            <content>
              <p>required or permitted to be prescribed by this Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-5__sec-26__para-b">
            <num>b</num>
            <content>
              <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.</p>
              <p>If a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.</p>
