          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Parliamentary Joint Committee on Law Enforcement Act 2010.</i></p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act commences on the day after this Act receives the Royal Assent.</p>
          </content>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-afp">AFP</term> means <def>the Australian Federal Police.</def></p>
            <p><term refersTo="#term-afp-appointee">AFP appointee</term> has the same meaning as <def>in <ref href="">the Australian Federal Police Act 1979</ref>.</def></p>
            <p><term refersTo="#term-afp-conduct-or-practices-issue">AFP conduct or practices issue</term> has the same meaning as <def>in <ref href="">the Australian Federal Police Act 1979</ref>.</def></p>
            <p><b><i>law enforcement agency</i></b> means:</p>
          </content>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>the AFP; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>a Police Force of a State; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-d">
            <num>d</num>
            <content>
              <p>any other authority or person responsible for the enforcement of the laws of the Commonwealth or of the States.</p>
            </content>
            <content>
              <p><term refersTo="#term-member">member</term> means <def>a member of the Committee.</def></p>
              <p><term refersTo="#term-sensitive-information">sensitive information</term> means <def>information that, if disclosed: could prejudice: the security, defence or international relations of Australia; or relations between the Commonwealth Government and the Government of a State or between the Government of a State and the Government of another State; or would disclose: deliberations or decisions of the Cabinet, or of a Committee of the Cabinet, of the Commonwealth or of a State; or deliberations or decisions of the Australian Capital Territory Executive or of a committee of that Executive; or deliberations or advice of the Federal Executive Council or the Executive Council of a State or the Northern Territory; or could reveal, or enable a person to ascertain, the existence or identity of a confidential source of information in relation to: the enforcement of the criminal law of the Commonwealth, a State or Territory or a foreign country; or an investigation relating to misconduct or alleged misconduct by an AFP appointee; or an investigation into an AFP conduct or practices issue; or could endanger a person’s life or physical safety; or could prejudice the protection of public safety; or could prejudice the fair trial of a person or the impartial adjudication of a matter; or could prejudice the proper enforcement of the law or the operations of law enforcement agencies; or could prejudice a person’s reputation; or would disclose information the disclosure of which is prohibited (absolutely or subject to qualifications) by or under another law of the Commonwealth; or 	(j)	would unreasonably disclose personal information (within the meaning of the <i>Privacy Act 1988</i>); or would unreasonably disclose confidential commercial information.</def></p>

          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>could prejudice:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-i">
            <num>i</num>
            <content>
              <p>the security, defence or international relations of Australia; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-ii">
            <num>ii</num>
            <content>
              <p>relations between the Commonwealth Government and the Government of a State or between the Government of a State and the Government of another State; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>would disclose:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-i">
            <num>i</num>
            <content>
              <p>deliberations or decisions of the Cabinet, or of a Committee of the Cabinet, of the Commonwealth or of a State; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-ii">
            <num>ii</num>
            <content>
              <p>deliberations or decisions of the Australian Capital Territory Executive or of a committee of that Executive; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-iii">
            <num>iii</num>
            <content>
              <p>deliberations or advice of the Federal Executive Council or the Executive Council of a State or the Northern Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>could reveal, or enable a person to ascertain, the existence or identity of a confidential source of information in relation to:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-i">
            <num>i</num>
            <content>
              <p>the enforcement of the criminal law of the Commonwealth, a State or Territory or a foreign country; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-ii">
            <num>ii</num>
            <content>
              <p>an investigation relating to misconduct or alleged misconduct by an AFP appointee; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-iv">
            <num>iv</num>
            <content>
              <p>an investigation into an AFP conduct or practices issue; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-d">
            <num>d</num>
            <content>
              <p>could endanger a person’s life or physical safety; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-e">
            <num>e</num>
            <content>
              <p>could prejudice the protection of public safety; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-f">
            <num>f</num>
            <content>
              <p>could prejudice the fair trial of a person or the impartial adjudication of a matter; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-g">
            <num>g</num>
            <content>
              <p>could prejudice the proper enforcement of the law or the operations of law enforcement agencies; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-h">
            <num>h</num>
            <content>
              <p>could prejudice a person’s reputation; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-i">
            <num>i</num>
            <content>
              <p>would disclose information the disclosure of which is prohibited (absolutely or subject to qualifications) by or under another law of the Commonwealth; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-j">
            <num>j</num>
            <content>
              <p>	(j)	would unreasonably disclose personal information (within the meaning of the <i>Privacy Act 1988</i>); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-k">
            <num>k</num>
            <content>
              <p>would unreasonably disclose confidential commercial information.</p>
            </content>
            <content>
              <p><term refersTo="#term-state">State</term> includes <def>the Australian Capital Territory and the Northern Territory.</def></p>
              <p><term refersTo="#term-the-committee">the Committee</term> means <def>the Parliamentary Joint Committee on Law Enforcement for the time being constituted under this Act.</def></p>

          </paragraph>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Extension to external Territories</heading>
          <content>
            <p>This Act extends to every external Territory.</p>
          </content>
        </section>
      </part>
      <part eId="part-2">
        <num>2</num>
        <heading>Parliamentary Joint Committee on Law Enforcement</heading>
        <section eId="part-2__sec-5">
          <num>5</num>
          <heading>Parliamentary Joint Committee on Law Enforcement</heading>
          <subsection eId="part-2__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>As soon as practicable after the commencement of the first session of each Parliament, a joint committee of members of the Parliament, to be known as the Parliamentary Joint Committee on Law Enforcement, is to be appointed according to the practice of the Parliament.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p>The Committee is to consist of 10 members, namely, 5 members of the Senate appointed by the Senate, and 5 members of the House of Representatives appointed by that House.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5__subsec-3">
            <num>3</num>
            <content>
              <p>A member of the Parliament is not eligible for appointment as a member of the Committee if he or she is:</p>
            </content>
            <paragraph eId="part-2__sec-5__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>a Minister; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the President of the Senate; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>the Speaker of the House of Representatives.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5__subsec-4">
            <num>4</num>
            <content>
              <p>A member ceases to hold office:</p>
            </content>
            <paragraph eId="part-2__sec-5__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>when the House of Representatives expires by effluxion of time or is dissolved; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>if he or she becomes the holder of an office specified in any of the paragraphs of subsection (3); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>if he or she ceases to be a member of the House of the Parliament by which he or she was appointed; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-4__para-d">
              <num>d</num>
              <content>
                <p>if he or she resigns his or her office as provided by subsection (5) or (6).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5__subsec-5">
            <num>5</num>
            <content>
              <p>A member appointed by the Senate may resign his or her office by writing signed by him or her and delivered to the President of the Senate.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5__subsec-6">
            <num>6</num>
            <content>
              <p>A member appointed by the House of Representatives may resign his or her office by writing signed by him or her and delivered to the Speaker of that House.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5__subsec-7">
            <num>7</num>
            <content>
              <p>Either House of the Parliament may appoint one of its members to fill a vacancy amongst the members of the Committee appointed by that House.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-6">
          <num>6</num>
          <heading>Powers and proceedings of the Committee</heading>
          <content>
            <p>All matters relating to the powers and proceedings of the Committee are to be determined by resolution of both Houses of the Parliament.</p>
          </content>
        </section>
        <section eId="part-2__sec-7">
          <num>7</num>
          <heading>Functions of the Committee</heading>
          <subsection eId="part-2__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>The Committee has the following functions:</p>
            </content>
            <paragraph eId="part-2__sec-7__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>to monitor and to review the performance by the AFP of its functions;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>to report to both Houses of the Parliament, with such comments as it thinks fit, upon any matter appertaining to the AFP or connected with the performance of its functions to which, in the opinion of the Committee, the attention of the Parliament should be directed;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>to examine each annual report on the AFP and report to the Parliament on any matter appearing in, or arising out of, any such annual report;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-1__para-g">
              <num>g</num>
              <content>
                <p>to examine trends and changes in criminal activities, practices and methods and report to both Houses of the Parliament any change which the Committee thinks desirable to the functions, structure, powers and procedures of the AFP;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-1__para-h">
              <num>h</num>
              <content>
                <p>to inquire into any question in connection with its functions which is referred to it by either House of the Parliament, and to report to that House upon that question.</p>
              </content>

          </subsection>
          <subsection eId="part-2__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>The functions of the Committee do not include:</p>
            </content>
            <paragraph eId="part-2__sec-7__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>reviewing sensitive operational information or operational methods available to the AFP; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>reviewing particular operations or investigations that have been, are being or are proposed to be undertaken by the AFP; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>reviewing information provided by, or by an agency of, a foreign government where that government does not consent to the disclosure of the information; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>conducting inquiries into individual complaints about the activities of the AFP; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-2__para-g">
              <num>g</num>
              <content>
                <p>	(g)	monitoring, reviewing or reporting on the performance by the AFP of its functions under <i>Criminal Code</i>.<ref href="#part-5">Part 5</ref>.3 of the </p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-3">
            <num>3</num>
            <content>
              <p>To avoid doubt, the Committee may examine, and report to both Houses of the Parliament on, information given to it under <ref href="#sec-8">section 8</ref> or 9.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-9">
          <num>9</num>
          <heading>Disclosure to Committee by Commissioner of the AFP</heading>
          <subsection eId="part-2__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to subsection (2), <role refersTo="#commissioner">the Commissioner</role> of the AFP:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>must comply with a request by the Committee to give the Committee information in relation to an investigation that the AFP has conducted or is conducting; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>must when requested by the Committee, and may at such other times as <role refersTo="#commissioner">the Commissioner</role> thinks appropriate, inform the Committee concerning the general performance of the AFP’s functions.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#commissioner">The Commissioner</role> of the AFP may decide not to comply with the request if <role refersTo="#commissioner">the Commissioner</role> is satisfied that:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the information is sensitive information; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the public interest that would be served by giving the information to the Committee is outweighed by the prejudicial consequences that might result from giving the information to the Committee.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-3">
            <num>3</num>
            <content>
              <p>If <role refersTo="#commissioner">the Commissioner</role> of the AFP does not give information to the Committee because of subsection (2), the Committee may refer the request to <role refersTo="#minister">the Minister</role> responsible for the AFP.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-4">
            <num>4</num>
            <content>
              <p>If the Committee refers the request to <role refersTo="#minister">the Minister</role> responsible for the AFP, <role refersTo="#minister">the Minister</role> responsible for the AFP:</p>
            </content>
            <paragraph eId="part-2__sec-9__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>must determine in writing whether:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>the information is sensitive information; and</p>
              </content>

              <p>	(1)	At least once in each calendar year the Ombudsman must provide a briefing to the Committee about the involvement of the AFP in controlled operations under <i>Crimes Act 1914</i> during the preceding 12 months.<ref href="#part-IA">Part IA</ref>B of the </p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
              <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
