          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Independent National Security Legislation Monitor Act 2010</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act commences on the day after it receives the Royal Assent.</p>
          </content>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Object</heading>
          <content>
            <p>The object of this Act is to appoint an Independent National Security Legislation Monitor who will assist Ministers in ensuring that Australia’s counter-terrorism and national security legislation:</p>
          </content>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>is effective in deterring and preventing terrorism, terrorism-related activity and threats to Australia’s security; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>is effective in responding to terrorism, terrorism-related activity and threats to Australia’s security; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>is consistent with Australia’s international obligations, including:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-i">
            <num>i</num>
            <content>
              <p>human rights obligations; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-ii">
            <num>ii</num>
            <content>
              <p>counter-terrorism obligations; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-iii">
            <num>iii</num>
            <content>
              <p>international security obligations; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-d">
            <num>d</num>
            <content>
              <p>contains appropriate safeguards for protecting the rights of individuals.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-agency-within-the-national-intelligence-community">agency within the national intelligence community</term> has the same meaning as <def>in <ref href="">the Office of National Intelligence Act 2018</ref>.</def></p>
            <p><term refersTo="#term-committee-on-intelligence-and-security">Committee on Intelligence and Security</term> means <def><ref class="unresolved">the Parliamentary Joint Committee on Intelligence and Security established under the Intelligence Services Act 2001</ref>.</def></p>
            <p><term refersTo="#term-counter-terrorism-and-national-security-legislation">counter-terrorism and national security legislation</term> has the meaning given by <def><ref href="#sec-4A">section 4A</ref>.</def></p>
            <p><term refersTo="#term-defence-department">Defence Department</term> means <def>the Department of State that deals with defence and that is administered by the Minister administering <ref href="#sec-1">section 1</ref> of <ref href="">the Defence Act 1903</ref>.</def></p>
            <p><b><i>head</i></b> means:</p>
          </content>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>in relation to the Australian Federal Police—<role refersTo="#commissioner">the Commissioner</role> of Police; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>in relation to the Australian Crime Commission—the Chief Executive Officer of the Australian Crime Commission; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-d">
            <num>d</num>
            <content>
              <p>in relation to the Australian Security Intelligence Organisation—the Director-General of Security; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-e">
            <num>e</num>
            <content>
              <p>in relation to the Australian Secret Intelligence Service—the Director-General of the Australian Secret Intelligence Service; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-ea">
            <num>ea</num>
            <content>
              <p>in relation to the Australian Signals Directorate—the Director-General of the Australian Signals Directorate; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-f">
            <num>f</num>
            <content>
              <p>in relation to the part of the Defence Department known as the Australian Geospatial-Intelligence Organisation—the Director of that part of the Department; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-g">
            <num>g</num>
            <content>
              <p>in relation to the part of the Defence Department known as the Defence Intelligence Organisation—the Director of that part of the Department; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-i">
            <num>i</num>
            <content>
              <p>in relation to any other part of the Defence Department—the Chief of the Defence Force and <role refersTo="#secretary">the Secretary</role> of the Department; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-j">
            <num>j</num>
            <content>
              <p>in relation to the Office of National Intelligence—the Director-General of National Intelligence; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-k">
            <num>k</num>
            <content>
              <p>in relation to any other Commonwealth government agency:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-i">
            <num>i</num>
            <content>
              <p>in the case of a Department of the Commonwealth—<role refersTo="#secretary">the Secretary</role> of the Department; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-ii">
            <num>ii</num>
            <content>
              <p>in the case of a body established for a public purpose—the person holding, or performing the duties of, the principal office in respect of the body; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-l">
            <num>l</num>
            <content>
              <p>in relation to a State or Territory government agency—the person holding, or performing the duties of, the principal office in respect of the agency.</p>
            </content>
            <content>
              <p><term refersTo="#term-immigration-and-border-protection-department">Immigration and Border Protection Department</term> means <def><ref class="unresolved">the Department administered by the Minister administering the Australian Border Force Act 2015</ref>.</def></p>
              <p><term refersTo="#term-independent-national-security-legislation-monitor">Independent National Security Legislation Monitor</term> means <def>the person appointed in accordance with <ref href="#sec-11">section 11</ref>.</def></p>
              <p><term refersTo="#term-law-enforcement-or-security-agency">law enforcement or security agency</term> means <def>any of the following agencies: the Australian Federal Police; the Australian Crime Commission; the Immigration and Border Protection Department; the Australian Security Intelligence Organisation; the Australian Secret Intelligence Service; the Australian Signals Directorate; the Australian Defence Force; the part of the Defence Department known as the Australian Geospatial-Intelligence Organisation; the part of the Defence Department known as the Defence Intelligence Organisation; the Office of National Intelligence; the police force of a State or Territory; any other agency prescribed by the regulations for the purposes of this definition.</def></p>

            <num>a</num>
            <content>
              <p>the Australian Federal Police;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>the Australian Crime Commission;</p>

          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">

              <p>the Immigration and Border Protection Department;</p>

              <p>the Australian Defence Force;</p>

              <p>the part of the Defence Department known as the Australian Geospatial-Intelligence Organisation;</p>

          </paragraph>
          <paragraph eId="part-1__sec-4__para-h">

              <p>the part of the Defence Department known as the Defence Intelligence Organisation;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-j">
            <num>j</num>
            <content>
              <p>the Office of National Intelligence;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-k">
            <num>k</num>
            <content>
              <p>the police force of a State or Territory;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-l">
            <num>l</num>
            <content>
              <p>any other agency prescribed by the regulations for the purposes of this definition.</p>
            </content>
            <content>
              <p><b><i>operationally sensitive information</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>information about information sources or operational activities or methods available to a law enforcement or security agency; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>information about particular operations that have been, are being or are proposed to be undertaken by a law enforcement or security agency, or about proceedings relating to those operations; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">
            <num>c</num>
            <content>
              <p>information provided by a foreign government, or by an agency of a foreign government, where that government does not consent to the public disclosure of the information.</p>
            </content>
            <content>
              <p><term refersTo="#term-responsible-minister">responsible Minister</term> means <def>the Minister (including a State or Territory Minister) responsible for the agency concerned in relation to the matter.</def></p>
              <p><b><i>secrecy provision</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>a provision of a law of the Commonwealth, of a State or of a Territory, being a provision that purports to prohibit; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>anything done, under a provision of a law of the Commonwealth, of a State or of a Territory, to prohibit;</p>
            </content>
            <content>
              <p>the communication, divulging or publication of information, the production of, or the publication of the contents of, a document, or the production of a thing.</p>
              <p><term refersTo="#term-special-report">special report</term> has the meaning given by <def>subsection 29A(1).</def></p>
              <p><term refersTo="#term-statutory-review-report">statutory review report</term> has the meaning given by <def>subsection 29B(2).</def></p>

          </paragraph>
        </section>
        <section eId="part-1__sec-4A">
          <num>4A</num>
          <heading>Meaning of counter-terrorism and national security legislation</heading>
          <subsection eId="part-1__sec-4A__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	<b><i>Counter</i></b><b><i>-</i></b><b><i>terrorism and national security legislation</i></b> means:</p>
            </content>
            <paragraph eId="part-1__sec-4A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>laws of the Commonwealth that relate to counter-terrorism or national security; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>laws of the Commonwealth to the extent that they relate to counter-terrorism or national security.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-4A__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	<b><i>Counter</i></b><b><i>-</i></b><b><i>terrorism and national security legislation</i></b> includes the following:</p>

              <num>a</num>
              <content>
                <p>	(a)	the <i>Intelligence Services Act 2001</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the <i>Australian Security Intelligence Organisation Act 1979</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4A__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>	(c)	the <i>Office of National Intelligence Act 2018</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4A__subsec-2__para-d">

              <p>There is to be an Independent National Security Legislation Monitor.</p>
            </content>
          </section>
          <section eId="part-2__dvs-1__sec-6">
            <num>6</num>
            <heading>Functions of the Independent National Security Legislation Monitor</heading>
            <subsection eId="part-2__dvs-1__sec-6__subsec-1">
              <num>1</num>
              <content>
                <p>The Independent National Security Legislation Monitor has the following functions:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>to review, on his or her own initiative, the operation, effectiveness and implications of:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>Australia’s counter-terrorism and national security legislation; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>any other law of the Commonwealth to the extent that it relates to Australia’s counter-terrorism and national security legislation;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>to consider, on his or her own initiative, whether any legislation mentioned in paragraph (a):</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>contains appropriate safeguards for protecting the rights of individuals; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>remains proportionate to any threat of terrorism or threat to national security, or both; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>remains necessary;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-1__para-c">
                <num>c</num>

                  <p>if a matter relating to counter-terrorism or national security is referred to the Monitor by a Minister under <ref href="#sec-7">section 7</ref>—to report on the reference;</p>
                </content>
              </paragraph>

                <num>d</num>
                <content>
                  <p>to assess whether Australia’s counter-terrorism or national security legislation is being used for matters unrelated to terrorism and national security;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-1__para-f">
                <num>f</num>
                <content>
                  <p>to report on matters relating to the performance of the Monitor’s functions, including reviews conducted by the Monitor (whether on the Monitor’s own initiative or as required by law).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-6__subsec-1A">
              <num>1A</num>
              <content>
                <p>If a matter is referred to the Independent National Security Legislation Monitor by the Committee on Intelligence and Security under <ref href="#sec-7A">section 7A</ref>, the Monitor may perform the function set out in paragraph (1)(a) or (b) in relation to the matter.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-6__subsec-1B">
              <num>1B</num>
              <content>
                <p>	(1B)	The Independent National Security Legislation Monitor must, as soon as practicable after the third anniversary of the day the <i>National Security Legislation Amendment (Espionage and Foreign Interference) Act 2018 </i>receives the Royal Assent, begin a review under paragraph (1)(a) of the following provisions of Chapter 5 of the <i>Criminal Code</i>:</p>

                <num>a</num>
                <content>
                  <p><ref href="#dvs-82">Division 82</ref> (sabotage);</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-1B__para-b">
                <num>b</num>
                <content>
                  <p><ref href="#part-5">Part 5</ref>.2 (espionage and related offences).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-6__subsec-1E">
              <num>1E</num>
              <content>
                <p>The Independent National Security Legislation Monitor must:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-1E__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	review the operation, effectiveness and implications of the amendments made by Schedules 1, 2 and 3 to the <i>Surveillance Legislation Amendment (Identify and Disrupt) Act 2021</i>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-1E__para-b">
                <num>b</num>
                <content>
                  <p>commence to do so before the end of the 3-year period beginning on the day that Act receives the Royal Assent.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-6__subsec-1F">
              <num>1F</num>
              <content>
                <p>The Independent National Security Legislation Monitor must:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-1F__para-a">
                <num>a</num>
                <content>
                  <p>review the operation, effectiveness and implications of:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-1F__para-i">
                <num>i</num>
                <content>
                  <p>	(i)	Subdivision C of <i>Australian Citizenship Act 2007 </i>(which deals with citizenship cessation), as amended by Schedule 1 to the <i>Australian Citizenship Amendment (Citizenship Repudiation) Act 2023</i>; and<ref href="#dvs-3">Division 3</ref> of Part 2 of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-1F__para-ii">
                <num>ii</num>
                <content>
                  <p>	(ii)	any other provision of the <i>Australian Citizenship Act 2007</i> so far as it relates to that Subdivision; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-1F__para-b">
                <num>b</num>
                <content>
                  <p>complete the review as soon as practicable after the end of the 3-year period beginning on the day the amendments of that Subdivision commence.</p>

                <p>To avoid doubt, the following are not functions of the Independent National Security Legislation Monitor:</p>

                <num>a</num>
                <content>
                  <p>to review the priorities of, and use of resources by, agencies that have functions relating to, or are involved in the implementation of, Australia’s counter-terrorism and national security legislation;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-6__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>to consider any individual complaints about the activities of Commonwealth agencies that have functions relating to, or are involved in the implementation of, Australia’s counter-terrorism and national security legislation.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-6__subsec-3">
              <num>3</num>
              <content>
                <p>The Independent National Security Legislation Monitor has the power to do all things necessary or convenient to be done for or in connection with the performance of the Monitor’s functions.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-1__sec-7">
            <num>7</num>
            <heading>References to the Independent National Security Legislation Monitor by the Prime Minister or the Attorney-General</heading>
            <subsection eId="part-2__dvs-1__sec-7__subsec-1">
              <num>1</num>
              <content>
                <p>The Prime Minister or the Attorney-General may refer a matter relating to counter-terrorism or national security to the Independent National Security Legislation Monitor, either at the Monitor’s suggestion or on his or her own initiative.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-7__subsec-2">
              <num>2</num>
              <content>
                <p>A Minister who refers a matter under subsection (1) may alter the terms of the reference.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-7__subsec-3">
              <num>3</num>
              <content>
                <p>The Prime Minister may give the Independent National Security Legislation Monitor directions about the order in which he or she is to deal with references.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-1__sec-7A">
            <num>7A</num>
            <heading>References to the Independent National Security Legislation Monitor by the Committee on Intelligence and Security</heading>
            <subsection eId="part-2__dvs-1__sec-7A__subsec-1">
              <num>1</num>
              <content>
                <p>The Committee on Intelligence and Security may refer to the Independent National Security Legislation Monitor a matter that the Committee:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-7A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	becomes aware of in the course of performing its functions under subsection 29(1) of the <i>Intelligence Services Act 2001</i>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-7A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>considers should be referred to the Monitor.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-7A__subsec-2">
              <num>2</num>
              <content>
                <p>It is a function of the Committee on Intelligence and Security to refer the matter to the Independent National Security Legislation Monitor.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-1__sec-8">
            <num>8</num>
            <heading>Regard to be had to international obligations and constitutional arrangements</heading>
            <content>
              <p>When performing the Independent National Security Legislation Monitor’s functions, the Monitor must have regard to:</p>
            </content>
            <paragraph eId="part-2__dvs-1__sec-8__para-a">
              <num>a</num>
              <content>
                <p>Australia’s obligations under international agreements (as in force from time to time), including:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-1__sec-8__para-i">
              <num>i</num>
              <content>
                <p>human rights obligations; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-1__sec-8__para-ii">
              <num>ii</num>
              <content>
                <p>counter-terrorism obligations; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-1__sec-8__para-iii">
              <num>iii</num>
              <content>
                <p>international security obligations; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-1__sec-8__para-b">
              <num>b</num>
              <content>
                <p>arrangements agreed from time to time between the Commonwealth, the States and the Territories to ensure a national approach to countering terrorism.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-2__dvs-1__sec-9">
            <num>9</num>
            <heading>Emphasis to be given to counter-terrorism and national security legislation that has been applied or considered recently</heading>
            <subsection eId="part-2__dvs-1__sec-9__subsec-1">
              <num>1</num>
              <content>
                <p>When performing functions relating to Australia’s counter-terrorism and national security legislation in a particular financial year, the Independent National Security Legislation Monitor must give particular emphasis to provisions of that legislation that have been applied, considered or purportedly applied by employees of agencies that have functions relating to, or are involved in the implementation of, that legislation during that financial year or the immediately preceding financial year.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-9__subsec-2">
              <num>2</num>
              <content>
                <p>Subsection (1) does not apply to the Independent National Security Legislation Monitor’s performance of his or her functions under sections 29A (special report) or 29B (statutory review report).</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-1__sec-10">
            <num>10</num>
            <heading>Consultation with agencies etc.</heading>
            <subsection eId="part-2__dvs-1__sec-10__subsec-1">
              <num>1</num>
              <content>
                <p>When performing functions relating to Australia’s counter-terrorism and national security legislation, the Independent National Security Legislation Monitor must have regard to:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-10__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the functions of agencies that have functions relating to, or are involved in the implementation of, that legislation; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-10__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>functions relating to that legislation that are conferred on a person who holds any office or appointment under a law of the Commonwealth or of a State or Territory.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-10__subsec-2">
              <num>2</num>
              <content>
                <p>When performing functions relating to Australia’s counter-terrorism and national security legislation, the Independent National Security Legislation Monitor may consult with:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-10__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the Ombudsman; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-10__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the Inspector-General of Intelligence and Security; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-10__subsec-2__para-ca">
                <num>ca</num>
                <content>
                  <p>the Human Rights Commissioner; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-10__subsec-2__para-cb">
                <num>cb</num>
                <content>
                  <p><role refersTo="#privacy-commissioner">the Privacy Commissioner</role>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-10__subsec-2__para-cc">

                  <p>the head of an agency established by a law of the Commonwealth or of a State or Territory; or</p>
                </content>
              </paragraph>

          <heading>Appointment of Independent National Security Legislation Monitor</heading>
          <section eId="part-2__dvs-2__sec-11">
            <num>11</num>
            <heading>Appointment</heading>
            <subsection eId="part-2__dvs-2__sec-11__subsec-1">
              <num>1</num>
              <content>
                <p>The Independent National Security Legislation Monitor is to be appointed by the Governor-General by written instrument, on a part-time or full-time basis.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-11__subsec-2">
              <num>2</num>
              <content>
                <p>Before a recommendation is made to the Governor-General for the appointment of a person as the Independent National Security Legislation Monitor, the Prime Minister must consult with the Leader of the Opposition in the House of Representatives.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-11__subsec-3">
              <num>3</num>
              <content>
                <p>A person must not be appointed as the Independent National Security Legislation Monitor unless the person is, in the Governor-General’s opinion, suitable for appointment because of the person’s qualifications, training or experience.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-11__subsec-4">
              <num>4</num>
              <content>
                <p>A person’s appointment as the Independent National Security Legislation Monitor is not invalid because of a defect or irregularity in connection with the person’s appointment.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-11A">
            <num>11A</num>
            <heading>Obligation to fill vacancy as soon as practicable</heading>
            <content>
              <p>As soon as practicable after the office of Independent National Security Legislation Monitor becomes vacant, a Monitor or acting Monitor must be appointed under <ref href="#sec-11">section 11</ref> or 20.</p>
            </content>
          </section>
          <section eId="part-2__dvs-2__sec-12">
            <num>12</num>
            <heading>Term of appointment</heading>
            <subsection eId="part-2__dvs-2__sec-12__subsec-1">
              <num>1</num>
              <content>
                <p>The Independent National Security Legislation Monitor holds office for the period specified in the instrument of appointment. The period must not exceed 3 years.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-12__subsec-2">
              <num>2</num>
              <content>
                <p>The Independent National Security Legislation Monitor is eligible for reappointment once only.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-13">
            <num>13</num>
            <heading>Remuneration and allowances</heading>
            <subsection eId="part-2__dvs-2__sec-13__subsec-1">
              <num>1</num>
              <content>
                <p>The Independent National Security Legislation Monitor is to be paid such remuneration as is determined by the Remuneration Tribunal. If no determination of that remuneration is in operation, the Monitor is to be paid such remuneration as is prescribed by the regulations.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-13__subsec-2">
              <num>2</num>
              <content>
                <p>The Independent National Security Legislation Monitor is to be paid the allowances that are prescribed by the regulations.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-13__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	This section has effect subject to the <i>Remuneration Tribunal Act 1973</i>.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-14">
            <num>14</num>
            <heading>Leave of absence</heading>
            <subsection eId="part-2__dvs-2__sec-14__subsec-1">
              <num>1</num>
              <content>
                <p>A full-time Independent National Security Legislation Monitor has the recreation leave entitlements that are determined by the Remuneration Tribunal.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-14__subsec-2">
              <num>2</num>
              <content>
                <p>The Attorney-General may grant leave of absence, other than recreation leave, to a full-time Independent National Security Legislation Monitor on the terms and conditions as to remuneration or otherwise that the Attorney-General determines in writing.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-14__subsec-3">
              <num>3</num>
              <content>
                <p>The Attorney-General may grant leave of absence to a part-time Independent National Security Legislation Monitor on the terms and conditions that the Attorney-General determines in writing.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-15">
            <num>15</num>
            <heading>Outside employment</heading>
            <subsection eId="part-2__dvs-2__sec-15__subsec-1">
              <num>1</num>
              <content>
                <p>A full-time Independent National Security Legislation Monitor must not engage in paid employment outside the duties of his or her office without the Attorney-General’s written consent.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-15__subsec-2">
              <num>2</num>
              <content>
                <p>A part-time Independent National Security Legislation Monitor must not engage in any paid employment that conflicts or may conflict with the proper performance of his or her duties without the Attorney-General’s written consent.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-16">
            <num>16</num>
            <heading>Disclosure of interests to the Attorney-General</heading>
            <content>
              <p>The Independent National Security Legislation Monitor must give written notice to the Attorney-General of all interests, pecuniary or otherwise, that the Monitor has or acquires and that conflict or could conflict with the proper performance of his or her functions.</p>
            </content>
          </section>
          <section eId="part-2__dvs-2__sec-17">
            <num>17</num>
            <heading>Other terms and conditions</heading>
            <content>
              <p>The Independent National Security Legislation Monitor holds office on such terms and conditions (if any) in relation to matters not provided for by this Act as are determined, in writing, by the Governor-General.</p>

            <num>17A</num>
            <heading>Application of finance law</heading>
            <content>
              <p>		For the purposes of the finance law (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>), the Independent National Security Legislation Monitor is an official of the Department.</p>
            </content>
          </section>
          <section eId="part-2__dvs-2__sec-17B">
            <num>17B</num>
            <heading>Independence of Independent National Security Legislation Monitor</heading>
            <content>
              <p>Subject to this Act and any other Act, the Independent National Security Legislation Monitor:</p>
            </content>
            <paragraph eId="part-2__dvs-2__sec-17B__para-a">
              <num>a</num>
              <content>
                <p>has complete discretion in performing or exercising the Monitor’s functions or powers; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-2__sec-17B__para-b">
              <num>b</num>
              <content>
                <p>is not subject to direction from anyone when doing so.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-2__dvs-2__sec-18">
            <num>18</num>
            <heading>Resignation</heading>
            <subsection eId="part-2__dvs-2__sec-18__subsec-1">
              <num>1</num>
              <content>
                <p>The Independent National Security Legislation Monitor may resign by giving to the Governor-General a signed notice of resignation.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-18__subsec-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day on which it is received by the Governor-General or, if a later day is specified in the resignation, on that later day.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-19">
            <num>19</num>
            <heading>Termination of appointment</heading>
            <subsection eId="part-2__dvs-2__sec-19__subsec-1">
              <num>1</num>
              <content>
                <p>The Governor-General may terminate the appointment of the Independent National Security Legislation Monitor for misbehaviour or physical or mental incapacity.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-19__subsec-2">
              <num>2</num>
              <content>
                <p>The Governor-General must terminate the appointment of the Independent National Security Legislation Monitor:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-19__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>if the Monitor:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>becomes bankrupt; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>compounds with his or her creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19__subsec-2__para-iv">
                <num>iv</num>
                <content>
                  <p>makes an assignment of his or her remuneration for the benefit of his or her creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if the Monitor fails, without reasonable excuse, to comply with <ref href="#sec-16">section 16</ref>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19__subsec-2__para-ba">
                <num>ba</num>
                <content>
                  <p>if the Monitor is appointed on a full-time basis—the Monitor engages, except with the Attorney-General’s written consent, in paid employment outside the duties of his or her office;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>if the Monitor is appointed on a part-time basis—the Monitor engages, except with the Attorney-General’s written consent, in paid employment that conflicts or may conflict with the proper performance of the Monitor’s duties; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19__subsec-2__para-ca">
                <num>ca</num>
                <content>
                  <p>if the Monitor is appointed on a full-time basis—the Monitor is absent, except on leave of absence granted under subsection 14(2), for 14 consecutive days or for 28 days in any 12 months; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>if the Monitor is appointed on a part-time basis—the Monitor is absent, except on leave of absence granted under subsection 14(3), for 7 consecutive days or for 14 days in any 12 months.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-20">
            <num>20</num>
            <heading>Acting Independent National Security Legislation Monitor</heading>
            <content>
              <p>The Attorney-General may appoint a person to act as the Independent National Security Legislation Monitor:</p>
            </content>
            <paragraph eId="part-2__dvs-2__sec-20__para-a">
              <num>a</num>
              <content>
                <p>during a vacancy in the office of the Monitor (whether or not an appointment has previously been made to the office); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-2__sec-20__para-b">
              <num>b</num>
              <content>
                <p>during a period, or during all periods, when the Monitor:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-2__sec-20__para-i">
              <num>i</num>
              <content>
                <p>is absent from duty or from Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-2__sec-20__para-ii">
              <num>ii</num>
              <content>
                <p>is, for any reason, unable to perform the duties of the office;</p>
              </content>
              <content>
                <p>so long as the period, or the total of all periods, is not more than 12 months.</p>
              </content>

        <heading>Information gathering powers</heading>

          <heading>Independent National Security Legislation Monitor may hold hearings</heading>
          <subsection eId="part-3__sec-21__subsec-1">
            <num>1</num>
            <content>
              <p>The Independent National Security Legislation Monitor may hold a hearing for the purposes of performing his or her functions under this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-21__subsec-2">
            <num>2</num>
            <content>
              <p>A hearing, or a part of a hearing:</p>
            </content>
            <paragraph eId="part-3__sec-21__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>may be held in private if the Independent National Security Legislation Monitor so directs; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-21__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>must be held in private for any time during which a person is giving evidence that discloses operationally sensitive information.</p>
              </content>
              <content>
                <p>Otherwise, a hearing must be held in public.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-21__subsec-3">
            <num>3</num>
            <content>
              <p>A hearing may otherwise be conducted in such a manner as the Independent National Security Legislation Monitor thinks fit.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-21__subsec-4">
            <num>4</num>
            <content>
              <p>The Independent National Security Legislation Monitor must ensure that a record of a hearing is made.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-21__subsec-5">
            <num>5</num>
            <content>
              <p>A direction given under paragraph (2)(a) is not a legislative instrument.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-22">
          <num>22</num>
          <heading>Independent National Security Legislation Monitor may summon person</heading>
          <subsection eId="part-3__sec-22__subsec-1">
            <num>1</num>
            <content>
              <p>The Independent National Security Legislation Monitor may, by notice in writing, summon a person to attend a hearing at a time and place specified in the notice:</p>
            </content>
            <paragraph eId="part-3__sec-22__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>to give evidence; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to produce documents or things specified in the notice.</p>
              </content>

              <p>The notice must:</p>

              <num>a</num>
              <content>
                <p>be in writing and be signed by the Independent National Security Legislation Monitor; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>be served on the person required to attend a hearing.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-22__subsec-3">
            <num>3</num>
            <content>
              <p>A time specified in a notice must be at least 14 days after the day on which the notice is given.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-22__subsec-4">
            <num>4</num>
            <content>
              <p>A person summoned to appear as a witness at a hearing is entitled to be paid by the Commonwealth any allowances for travelling and other expenses that are prescribed by the regulations.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-23">
          <num>23</num>
          <heading>Evidence on oath or by affirmation</heading>
          <subsection eId="part-3__sec-23__subsec-1">
            <num>1</num>
            <content>
              <p>At a hearing, the Independent National Security Legislation Monitor may:</p>
            </content>
            <paragraph eId="part-3__sec-23__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>require a witness to either take an oath or make an affirmation; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-23__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>administer an oath or affirmation to the witness.</p>
              </content>

              <p>The oath or affirmation is an oath or affirmation that the evidence the person will give will be true.</p>

              <p>The Independent National Security Legislation Monitor may allow a person attending a hearing who has been sworn, or who has made an affirmation, to give evidence by tendering a written statement and verifying it by oath or affirmation.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-24">
          <num>24</num>
          <heading>Independent National Security Legislation Monitor may request production of a document or thing</heading>
          <subsection eId="part-3__sec-24__subsec-1">
            <num>1</num>
            <content>
              <p>For the purposes of performing his or her functions under this Act, the Independent National Security Legislation Monitor may request, by written notice, a person:</p>
            </content>
            <paragraph eId="part-3__sec-24__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>to give the Monitor the information referred to in the notice; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-24__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to produce to the Monitor the documents or things referred to in the notice.</p>
              </content>

              <p>The period specified in a notice must end at least 14 days after the day on which the notice is given.</p>

          </subsection>
        </section>

          <heading>Offences</heading>

            <p>Failure to attend hearing</p>
          </content>

              <p>A person commits an offence if:</p>
            </content>
            <paragraph eId="part-3__sec-25__subsec-1__para-a">

              <content>
                <p>the person is served with a notice to attend a hearing; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-25__subsec-1__para-b">

                <p>the person fails to attend as required by the notice.</p>

              <p>It is a reasonable excuse for a person to fail to:</p>

                <p>answer a question; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-25__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>produce a document or thing; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-25__subsec-6__para-c">
              <num>c</num>
              <content>
                <p>provide information;</p>
              </content>
              <content>
                <p>on the ground that to do so might tend to incriminate the person or expose the person to a penalty.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-3__sec-26">
          <num>26</num>
          <heading>No criminal or civil liability under secrecy provisions</heading>
          <content>
            <p>A person who is served with a notice under <ref href="#sec-22">section 22</ref> or 24 does not commit an offence, and is not liable to any penalty, under a secrecy provision because the person:</p>
          </content>
          <paragraph eId="part-3__sec-26__para-a">
            <num>a</num>
            <content>
              <p>answers a question at a hearing that the Independent National Security Legislation Monitor requires the person to answer; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-26__para-b">
            <num>b</num>
            <content>
              <p>provides information that the person is required to provide in accordance with the notice; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-26__para-c">
            <num>c</num>
            <content>
              <p>produces a document or thing that the person is required to produce in accordance with the notice.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-3__sec-27">
          <num>27</num>
          <heading>Independent National Security Legislation Monitor may retain documents or things</heading>
          <subsection eId="part-3__sec-27__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to <ref href="#sec-28">section 28</ref>, if a document or thing is produced to the Independent National Security Legislation Monitor in accordance with <ref href="#sec-22">section 22</ref> or 24, the Monitor:</p>
            </content>
            <paragraph eId="part-3__sec-27__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>may take possession of, and make copies of, the document or thing, or take extracts from the document; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-27__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>may retain possession of the document or thing for such period as is necessary for the performance of the Monitor’s functions under this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-27__subsec-2">
            <num>2</num>
            <content>
              <p>While the Independent National Security Legislation Monitor retains the document or thing, the Monitor must allow a person who would otherwise be entitled to possession of the document or thing, or a person authorised by that person:</p>
            </content>
            <paragraph eId="part-3__sec-27__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>reasonable access to the document for the purposes of inspecting and making copies of, or taking extracts from, it; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-27__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>reasonable access to the thing.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-3__sec-28">
          <num>28</num>
          <heading>Protection of information and documents</heading>
          <subsection eId="part-3__sec-28__subsec-1">
            <num>1</num>
            <content>
              <p>This section applies if documents having a national security classification or containing operationally sensitive information are provided by an agency to the Independent National Security Legislation Monitor.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-28__subsec-2">
            <num>2</num>
            <content>
              <p>The Independent National Security Legislation Monitor must:</p>
            </content>
            <paragraph eId="part-3__sec-28__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>make arrangements with the head of the agency for the protection of those documents while they remain in the Monitor’s possession; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-28__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>ensure that the documents are returned to the agency as soon as possible after the Monitor has examined them.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
      </part>

        <num>4</num>
        <heading>Reporting requirements</heading>
        <section eId="part-4__sec-29">
          <num>29</num>
          <heading>Annual report</heading>
          <subsection eId="part-4__sec-29__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Independent National Security Legislation Monitor must prepare and give to the Attorney-General a report (an <b><i>annual report</i></b>):</p>
            </content>
            <paragraph eId="part-4__sec-29__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>relating to the performance of the Monitor’s functions as set out in paragraphs 6(1)(a) and (b), including information relating to the performance of the Monitor’s functions as set out in subsection 6(1A); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-29__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>containing such details relating to the performance of the Monitor’s function as set out in paragraph 6(1)(c) as the Monitor considers appropriate.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-29__subsec-1A">
            <num>1A</num>
            <content>
              <p>Despite paragraph (1)(a), the annual report need not include information described in that paragraph if such information is already included in a report prepared under <ref href="#sec-29A">section 29A</ref>.</p>

          </subsection>
          <subsection eId="part-4__sec-29__subsec-2">
            <num>2</num>
            <content>
              <p>The annual report must be given to the Attorney-General as soon as practicable after 30 June in each financial year and, in any event, by the following 31 December.</p>

          <subsection eId="part-4__sec-29__subsec-2A">
            <num>2A</num>
            <content>
              <p>	(2A)	If the Independent National Security Legislation Monitor considers that the annual report contains information of the kind referred to in subsection (3), the Monitor must also prepare and give to the Attorney-General, at the same time as the annual report, a version of the report which does not contain that information (a <b><i>declassified annual report</i></b>).</p>

            <num>3</num>
            <content>
              <p>The information specified by this subsection is information of the following kind:</p>
            </content>
            <paragraph eId="part-4__sec-29__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>any operationally sensitive information; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-29__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>any information that would or might prejudice:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-29__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>Australia’s national security or the conduct of Australia’s foreign relations; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-29__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>the performance by a law enforcement or security agency of its functions; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-29__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>any information that, if included in the report, would or might endanger a person’s safety; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-29__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>any information obtained from a document prepared for the purposes of a meeting of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-29__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the Cabinet, or of a Committee of the Cabinet, of the Commonwealth or of a State; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-29__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>the Australian Capital Territory Executive or of a committee of that Executive; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-29__subsec-3__para-iii">
              <num>iii</num>
              <content>
                <p>the Executive Council of the Northern Territory or of a committee of that Executive Council; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-29__subsec-3__para-e">

                <p>any information that would disclose the deliberations or decisions of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-29__subsec-3__para-i">

              <p>In determining whether an annual report contains information of the kind referred to in subsection (3), the Independent National Security Legislation Monitor may consult the responsible Minister or responsible Ministers concerned.</p>

              <p>The Attorney-General must cause a copy of:</p>
            </content>
            <paragraph eId="part-4__sec-29__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>each annual report; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-29__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>if an annual report contains information of the kind referred to in subsection (3)—the corresponding declassified annual report;</p>
              </content>
              <content>
                <p>to be presented to each House of the Parliament within the earlier of:</p>
              </content>
            </paragraph>

              <num>c</num>
              <content>
                <p>15 sitting days of that House after the day on which he or she receives the report; or</p>

        </section>

          <heading>Special report</heading>
          <subsection eId="part-4__sec-29A__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Independent National Security Legislation Monitor may, from time to time, prepare and give to the Attorney-General a report (a <b><i>special report</i></b>) relating to the performance of the Monitor’s functions as set out in paragraphs 6(1)(a) or (b).</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-29A__subsec-2">
            <num>2</num>
            <content>
              <p>Before preparing the special report, the Independent National Security Legislation Monitor must give to the Attorney-General and Prime Minister a notice in writing:</p>
            </content>
            <paragraph eId="part-4__sec-29A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>of his or her intention to prepare the special report; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-29A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>providing reasons why, in the opinion of the Monitor, the special report is required.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-4__sec-29B">
          <num>29B</num>
          <heading>Statutory review report</heading>
          <subsection eId="part-4__sec-29B__subsec-1">
            <num>1</num>
            <content>
              <p>This section applies if the Independent National Security Legislation Monitor completes a review of legislation the Monitor was required to conduct by law.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-29B__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	The Independent National Security Legislation Monitor must prepare and give to the Attorney-General a report relating to the performance of the review (a<b><i> statutory review report</i></b>).</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-29B__subsec-3">

            <content>
              <p>To avoid doubt, this section does not apply in relation to a review conducted on a referral under <ref href="#sec-7">section 7</ref> (references by the Prime Minister or the Attorney-General).</p>

              <p>The referring Minister may, before the Independent National Security Legislation Monitor gives his or her report on a reference, direct the Monitor to give an interim report to the referring Minister on the Monitor’s work on the reference.</p>

              <p>Giving copies of reports to non-referring Minister</p>
            </content>
          </subsection>

              <p>The Independent National Security Legislation Monitor may, if he or she considers it appropriate to do so, give a copy of a report under subsection (1), (2) or (3) to <role refersTo="#minister">the Minister</role> mentioned in section 7 who did not make the reference.</p>

              <p>Declassified reports</p>

                <p>in the performance, or purported performance, of his or her functions; or</p>

            <p>The Governor-General may make regulations prescribing matters:</p>

          <heading>Staff of the Independent National Security Legislation Monitor</heading>

              <p>The Independent National Security Legislation Monitor may be assisted by the following persons, whose services are made available to the Monitor in connection with the performance of any of the Monitor’s functions, or the exercise of the Monitor’s powers:</p>

                <p>APS employees in the Department whose services are made available to the Monitor by <role refersTo="#secretary">the Secretary</role> of the Department;</p>

                <p>	(b)	employees of Agencies (within the meaning of the <i>Public Service Act 1999</i>);</p>

              <p>A person referred to in subsection (1) may only assist the Independent National Security Legislation Monitor with the written consent of the Monitor, and the Monitor may, in writing, withdraw such consent at any time.</p>

          <num>34</num>
          <heading>Contractors engaged by the Independent National Security Legislation Monitor</heading>
          <subsection eId="part-5__sec-34__subsec-1">
            <num>1</num>
            <content>
              <p>The Independent National Security Legislation Monitor may, on behalf of the Commonwealth, engage persons to assist in the performance of any of the Monitor’s functions, or the exercise of the Monitor’s powers.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-34__subsec-2">
            <num>2</num>
            <content>
              <p>The persons are to be engaged on the terms and conditions that the Independent National Security Legislation Monitor determines in writing.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-34__subsec-3">
            <num>3</num>
            <content>
              <p>When performing services for the Independent National Security Legislation Monitor, a person engaged under subsection (1) is subject to the directions of the Monitor.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-34__subsec-4">
            <num>4</num>
            <content>
              <p>The Independent National Security Legislation Monitor may, in writing, delegate the Monitor’s power under subsection (1) to a member of the staff of the Monitor who is:</p>

            <paragraph eId="part-5__sec-34__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>classified as an Executive Level 2 or equivalent or higher; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-34__subsec-4__para-b">

              <content>
                <p>acting in a position usually occupied by a person with a classification level of the kind mentioned in paragraph (a).</p>

            </paragraph>

              <p>In exercising the power delegated under subsection (4), the delegate is subject to the directions of the Independent National Security Legislation Monitor.</p>
