              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <heading>Object</heading>
          <content>
            <p>The object of this Act is:</p>
          </content>
          <paragraph eId="part-1__sec-2A__para-a">
            <num>a</num>
            <content>
              <p>to promote the disclosure of information about the energy efficiency of buildings; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-2A__para-b">
            <num>b</num>
            <content>
              <p>to contribute to the achievement of Australia’s greenhouse gas emissions reduction targets.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-accredited-assessor">accredited assessor</term> means <def>a person who is accredited as an assessor under <ref href="#dvs-1">Division 1</ref> of <ref href="#part-3">Part 3</ref>, but does not include a person whose accreditation has been suspended or revoked.</def></p>
            <p><b><i>auditing authority</i></b> means:</p>
          </content>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p><role refersTo="#secretary">the Secretary</role>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>a person or body appointed by <role refersTo="#secretary">the Secretary</role> under section 33.</p>
            </content>
            <content>
              <p><term refersTo="#term-auditor">auditor</term> means <def>a person appointed as an auditor under <ref href="#sec-34">section 34</ref>.</def></p>
              <p><b><i>Australia’s greenhouse gas emissions reduction targets</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>if:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-i">
            <num>i</num>
            <content>
              <p>Australia’s current nationally determined contribution was communicated in accordance with Article 4 of the Paris Agreement in June 2022; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-ii">
            <num>ii</num>
            <content>
              <p>that nationally determined contribution has not been adjusted in accordance with paragraph 11 of Article 4 of the Paris Agreement;</p>
            </content>
            <content>
              <p>		the greenhouse gas emissions reduction targets set out in paragraphs 10(1)(a) and (b) of the <i>Climate Change Act 2022</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>in any other case—the greenhouse gas emissions reduction targets included in:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-i">
            <num>i</num>
            <content>
              <p>Australia’s current nationally determined contribution communicated in accordance with Article 4 of the Paris Agreement; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-ii">
            <num>ii</num>
            <content>
              <p>if that nationally determined contribution has been adjusted in accordance with paragraph 11 of Article 4 of the Paris Agreement—that nationally determined contribution, as adjusted and in force from time to time.</p>
            </content>
            <content>
              <p><term refersTo="#term-building-energy-efficiency-certificate">building energy efficiency certificate</term> means <def>a certificate issued under <ref href="#sec-13A">section 13A</ref>.</def></p>
              <p><term refersTo="#term-civil-penalty-provision">civil penalty provision</term> has the same meaning as <def>in the Regulatory Powers Act.</def></p>
              <p><term refersTo="#term-constitutional-corporation">constitutional corporation</term> means <def>a corporation to which paragraph 51(xx) of the Constitution applies.</def></p>
              <p><b><i>Court</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>the Federal Court of Australia; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>).</p>
            </content>
            <content>
              <p><b><i>current</i></b>: a building energy efficiency certificate is <b><i>current</i></b> for the period set out in the certificate under paragraph 13A(2)(d).</p>
              <p><term refersTo="#term-current-energy-efficiency-rating">current energy efficiency rating</term> means <def>an energy efficiency rating set out in a current building energy efficiency certificate.</def></p>
              <p><term refersTo="#term-disclosure-affected-area-of-a-building">disclosure affected area of a building</term> means <def>an area of a building, other than an exempt area, that is: used or capable of being used as an office; and of a kind determined by <role refersTo="#minister">the Minister</role> under subsection 10(2) to be disclosure affected.</def></p>

          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>used or capable of being used as an office; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>of a kind determined by <role refersTo="#minister">the Minister</role> under subsection 10(2) to be disclosure affected.</p>
            </content>
            <content>
              <p><term refersTo="#term-disclosure-affected-building">disclosure affected building</term> means <def>a building, other than an exempt building, that is: used or capable of being used as an office; and of a kind determined by <role refersTo="#minister">the Minister</role> under subsection 10(1) to be disclosure affected.</def></p>

          </paragraph>

            <num>a</num>
            <content>
              <p>used or capable of being used as an office; and</p>
            </content>
          </paragraph>

              <p>of a kind determined by <role refersTo="#minister">the Minister</role> under subsection 10(1) to be disclosure affected.</p>

            <content>
              <p><term refersTo="#term-energy-efficiency-disclosure-obligation">energy efficiency disclosure obligation</term> means <def>an obligation under <ref href="#sec-11">section 11</ref>, subsection 12(6) or <ref href="#sec-15">section 15</ref>.</def></p>
              <p><term refersTo="#term-entity">entity</term> has the same meaning as <def>in <ref href="">the Income Tax Assessment Act 1997</ref>.</def></p>
              <p><b><i>exempt area</i></b>, of a building, means an area exempted under section 17 or 17A.</p>
              <p><term refersTo="#term-exempt-building">exempt building</term> means <def>a building exempted under <ref href="#sec-17">section 17</ref> or 17A.</def></p>
              <p><b><i>inviting an offer to lease</i></b>, in relation to a building or an area of a building, has a meaning affected by section 5.</p>
              <p><b><i>inviting an offer to </i></b><b><i>purchase</i></b>, in relation to a building, has a meaning affected by section 4.</p>
              <p><b><i>inviting an offer to sublease</i></b>, in relation to a building or an area of a building, has a meaning affected by section 5.</p>
              <p><b><i>issue day</i></b>: see section 13.</p>
              <p><b><i>issuing authority</i></b> means:</p>
            </content>
          </paragraph>

            <num>a</num>
            <content>
              <p><role refersTo="#secretary">the Secretary</role>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>a person or body approved by <role refersTo="#secretary">the Secretary</role> under section 71A.</p>
            </content>
            <content>
              <p><b><i>lighting energy efficiency assessment</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>in relation to a building—an assessment of the energy efficiency of the lighting for the building that might reasonably be expected to remain if the building is sold, let or sublet; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>in relation to an area of a building—an assessment of the energy efficiency of the lighting for the area that might reasonably be expected to remain if the area is let or sublet.</p>
            </content>
            <content>
              <p><term refersTo="#term-monitoring-powers">monitoring powers</term> has the meaning given by <def><ref href="#sec-37">section 37</ref>.</def></p>
              <p><b><i>monitoring warrant</i></b> is a warrant issued under section 47.</p>
              <p><b><i>non</i></b><b><i>-</i></b><b><i>assessable</i></b>, in relation to a building or an area of a building: see section 17.</p>

          <heading>Application to wholly-owned subsidiaries</heading>

            <p>This Act does not apply in relation to an offer to enter into a contract between:</p>
          </content>

              <p>an entity and a wholly-owned subsidiary of the entity; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5A__para-b">
            <num>b</num>

              <p>wholly-owned subsidiaries of an entity.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-6">
          <num>6</num>
          <heading>Further subleases</heading>
          <content>
            <p>		To avoid doubt, where a person has taken a sublease of a disclosure affected building or a disclosure affected area of a building (a <b><i>disclosure affected space</i></b>), the person is subject to the energy efficiency disclosure obligations:</p>
          </content>
          <paragraph eId="part-1__sec-6__para-a">
            <num>a</num>
            <content>
              <p>if the person offers or continues to offer to sublet the disclosure affected space—in the same way as a lessee would be subject to those obligations if the lessee offered or continued to offer to sublet the space; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-6__para-b">
            <num>b</num>
            <content>
              <p>if the person invites offers or continues to invite offers to sublease the disclosure affected space—in the same way as a lessee would be subject to those obligations if the lessee invited or continued to invite offers to sublease the space.</p>

          </paragraph>
        </section>
        <section eId="part-1__sec-7">
          <num>7</num>
          <heading>Relationship with State and Territory law</heading>
          <content>
            <p>This Act is not intended to displace or limit a law of a State or Territory imposing a disclosure obligation in relation to the sale, lease or sublease of a building or an area of a building, unless the law is directly inconsistent with this Act.</p>
          </content>
        </section>
        <section eId="part-1__sec-8">
          <num>8</num>
          <heading>Act binds the Crown</heading>
          <subsection eId="part-1__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>This Act binds the Crown in each of its capacities.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>This Act does not make the Crown liable to be prosecuted for an offence.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-8__subsec-3">
            <num>3</num>
            <content>
              <p>The protection in subsection (2) does not apply to an authority of the Crown.</p>
            </content>
          </subsection>
        </section>

          <heading>External Territories</heading>

            <p>This Act extends to all the external Territories.</p>

              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, determine that a specified kind of building is disclosure affected.</p>

          </subsection>

              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, determine that a specified kind of area of a building is disclosure affected.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-11">
          <num>11</num>
          <heading>No sale, lease or sublease without a building energy efficiency certificate</heading>
          <subsection eId="part-2__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p>If a constitutional corporation owns a disclosure affected building, the corporation must not do any of the following unless a current building energy efficiency certificate for the building is registered:</p>
            </content>

              <num>a</num>
              <content>
                <p>offer, or continue to offer, to sell the building;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-1__para-b">

                <p>invite offers, or continue to invite offers, to purchase the building;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-1__para-c">

                <p>offer, or continue to offer, to let the building;</p>

            </paragraph>

                <p>offer, or continue to offer, to sublet the area;</p>
              </content>
            </paragraph>

                <p>invite offers, or continue to invite offers, to sublease the area.</p>

          <subsection eId="part-2__sec-11__subsec-5">

              <p>A constitutional corporation that contravenes a requirement of this section in relation to a continuing offer or a continuing invitation commits a separate contravention in respect of each day during which the person fails to comply with that requirement, including the day of the making of a relevant civil penalty order under the Regulatory Powers Act and any subsequent day.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-6">
            <num>6</num>
            <content>
              <p>Subsections (1) to (4) do not apply if:</p>
            </content>
            <paragraph eId="part-2__sec-11__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>an offer to let or sublet a building or an area of a building is made and, at the time the offer is made, a term of 12 months or less is proposed; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>at no time while the offer is continuing is a term of more than 12 months proposed.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-7">
            <num>7</num>
            <content>
              <p>Subsections (1) to (4) do not apply if:</p>
            </content>
            <paragraph eId="part-2__sec-11__subsec-7__para-a">
              <num>a</num>
              <content>
                <p>an invitation to make offers to lease or sublease a building or an area of a building is made and, at the time the invitation is made, a term of 12 months or less is proposed; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-7__para-b">
              <num>b</num>
              <content>
                <p>at no time while the invitation is continuing is a term of more than 12 months proposed.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-8">
            <num>8</num>
            <content>
              <p>In working out, for the purposes of subsections (6) and (7), whether the term proposed for a lease or sublease is a period of 12 months or less, include in the period any options to extend the lease or sublease.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-12">
          <num>12</num>
          <heading>Rights of a prospective purchaser, lessee or sublessee</heading>
          <subsection eId="part-2__sec-12__subsec-1">
            <num>1</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-2__sec-12__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a person (the <b><i>owner</i></b>) owns a disclosure affected building; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the owner offers to sell the building, or invites offers to purchase the building; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>	(c)	a constitutional corporation (the <b><i>prospective purchaser</i></b>) has an interest, in good faith, in accepting the offer or making an offer in response to the invitation;</p>
              </content>
              <content>
                <p>the prospective purchaser may give notice in writing to the owner at any time while the offer or invitation continues, requiring the owner to give the prospective purchaser a current building energy efficiency certificate for the building that has been registered.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-2">
            <num>2</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-2__sec-12__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a person (the <b><i>owner</i></b>) owns a disclosure affected building; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the owner offers to let the building, or invites offers to lease the building; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>	(c)	a constitutional corporation (the <b><i>prospective lessee</i></b>) has an interest, in good faith, in accepting the offer or making an offer in response to the invitation;</p>
              </content>
              <content>
                <p>the prospective lessee may give notice in writing to the owner at any time while the offer or invitation continues, requiring the owner to give the prospective lessee a copy of a current building energy efficiency certificate for the building that has been registered.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-3">
            <num>3</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-2__sec-12__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a person (the <b><i>lessee</i></b>) leases a disclosure affected building; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the lessee offers to sublet the building, or invites offers to sublease the building; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>	(c)	a constitutional corporation (the <b><i>prospective sublessee</i></b>) has an interest, in good faith, in accepting the offer or making an offer in response to the invitation;</p>
              </content>
              <content>
                <p>the prospective sublessee may give notice in writing to the lessee at any time while the offer or invitation continues, requiring the lessee to give the prospective sublessee a copy of a current building energy efficiency certificate for the building that has been registered.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-4">
            <num>4</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-2__sec-12__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a person (the <b><i>owner</i></b>) owns a building; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>the owner offers to let a disclosure affected area of the building, or invites offers to lease such an area; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>	(c)	a constitutional corporation (the <b><i>prospective lessee</i></b>) has an interest, in good faith, in accepting the offer or making an offer in response to the invitation;</p>
              </content>
              <content>
                <p>the prospective lessee may give notice in writing to the owner at any time while the offer or invitation continues, requiring the owner to give the prospective lessee a copy of a current building energy efficiency certificate for the area that has been registered.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-5">
            <num>5</num>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-2__sec-12__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a person (the <b><i>lessee</i></b>) leases a disclosure affected area of a building; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>the lessee offers to sublet the area, or invites offers to sublease the area; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-5__para-c">
              <num>c</num>
              <content>
                <p>	(c)	a constitutional corporation (the <b><i>prospective sublessee</i></b>) has an interest, in good faith, in accepting the offer or making an offer in response to the invitation;</p>
              </content>
              <content>
                <p>the prospective sublessee may give notice in writing to the lessee at any time while the offer or invitation continues, requiring the lessee to give the prospective sublessee a copy of a current building energy efficiency certificate for the area that has been registered.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-5A">
            <num>5A</num>
            <content>
              <p>Despite subsections (2) to (5), a person may not give notice in writing under any of those subsections if:</p>
            </content>
            <paragraph eId="part-2__sec-12__subsec-5A__para-a">
              <num>a</num>
              <content>
                <p>the term proposed for the lease or sublease at the time the offer or invitation is made is 12 months or less, including any options to extend the lease or sublease; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-12__subsec-5A__para-b">
              <num>b</num>
              <content>
                <p>at no time while the offer or invitation is continuing is a term of more than 12 months proposed.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-12__subsec-6">
            <num>6</num>
            <content>
              <p>If a person is, by notice given in accordance with this section, required to give another person a copy of a current building energy efficiency certificate for a building or an area of a building that has been registered, the person must do so as soon as is reasonably practicable.</p>
            </content>

          </subsection>
        </section>
        <section eId="part-2__sec-13">
          <num>13</num>
          <heading>Building energy efficiency certificates—applications</heading>
          <subsection eId="part-2__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><b><i>issue day</i></b>, in relation to a building energy efficiency certificate for a building or an area of a building, means the day on which the certificate is issued under subsection 13A(1).</p>
              <p><b><i>start day</i></b>, in relation to a building energy efficiency certificate for a building or an area of a building, means:</p>
            </content>
            <paragraph eId="part-2__sec-13__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the issue day for the certificate; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a later day specified in the certificate as the start day.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-13__subsec-2">
            <num>2</num>
            <content>
              <p>A person may apply to an issuing authority for a building energy efficiency certificate for a building or an area of a building.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-13__subsec-3">
            <num>3</num>
            <content>
              <p>The application must:</p>
            </content>
            <paragraph eId="part-2__sec-13__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>be in writing, in a form approved by <role refersTo="#secretary">the Secretary</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>include the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>an energy efficiency rating for the building (or the building in which the area is located);</p>
              </content>
            </paragraph>

                <p>meet any other requirements determined by <role refersTo="#secretary">the Secretary</role> under subsection (6).</p>

            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-13__subsec-4">
            <num>4</num>
            <content>
              <p>The energy efficiency rating must satisfy one of the following conditions:</p>
            </content>
            <paragraph eId="part-2__sec-13__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>the rating was worked out by an accredited assessor by applying the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>an auditing authority:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>provided or approved the rating; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-4__para-ii">
              <num>ii</num>
              <content>
                <p>is satisfied that the rating was worked out by applying the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-13__subsec-5">
            <num>5</num>
            <content>
              <p>The lighting energy efficiency assessment must satisfy one of the following conditions:</p>
            </content>
            <paragraph eId="part-2__sec-13__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>the assessment was performed by an accredited assessor by applying the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>an auditing authority:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-5__para-i">
              <num>i</num>
              <content>
                <p>provided or approved the assessment; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13__subsec-5__para-ii">
              <num>ii</num>
              <content>
                <p>is satisfied that the assessment was performed by applying the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>.</p>

            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-13__subsec-6">
            <num>6</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, by legislative instrument, make a determination for the purposes of paragraph (3)(c).</p>

          <heading>Building energy efficiency certificates—issue</heading>
          <subsection eId="part-2__sec-13A__subsec-1">
            <num>1</num>
            <content>
              <p>An issuing authority may, on application under <ref href="#sec-13">section 13</ref>, issue a building energy efficiency certificate for a building or an area of a building if the issuing authority is satisfied that:</p>
            </content>
            <paragraph eId="part-2__sec-13A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the application meets the requirements of subsections 13(3), (4) and (5); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the energy efficiency rating is appropriate for the building (or the building in which the area is located), applying the methods and standards determined under <ref href="#sec-21">section 21</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13A__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the lighting energy efficiency assessment is appropriate for the building or the area, applying the methods and standards determined under <ref href="#sec-21">section 21</ref>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-13A__subsec-2">
            <num>2</num>
            <content>
              <p>The certificate must set out the following:</p>
            </content>
            <paragraph eId="part-2__sec-13A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the energy efficiency rating for the building (or the building in which the area is located);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the lighting energy efficiency assessment for the building or the area;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13A__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the start day for the certificate (which may be different from the start day sought by the applicant);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13A__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>the period for which the certificate is current;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-13A__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>any other information determined by <role refersTo="#secretary">the Secretary</role> under subsection (4).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-13A__subsec-3">
            <num>3</num>
            <content>
              <p>For paragraph (2)(d), the period set out in the certificate must be a period of no more than 12 months beginning on the start day set out in the certificate.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-13A__subsec-4">
            <num>4</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, by legislative instrument, make a determination for the purposes of paragraph (2)(e).</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-14">
          <num>14</num>
          <heading>Building Energy Efficiency Register</heading>
          <subsection eId="part-2__sec-14__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> is to maintain, or cause to be maintained, a register, to be known as the Building Energy Efficiency Register, in which <role refersTo="#secretary">the Secretary</role> includes particulars of building energy efficiency certificates.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-2">
            <num>2</num>
            <content>
              <p>The Register may include information about the following:</p>
            </content>
            <paragraph eId="part-2__sec-14__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>current building energy efficiency certificates and those that are no longer current;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>current exemptions under <ref href="#sec-17">section 17</ref> and those that are no longer current;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>variations and revocations of such exemptions.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> must delete, or cause to be deleted, the particulars of a building energy efficiency certificate from the Register if <role refersTo="#secretary">the Secretary</role> is notified in writing by an auditing authority that:</p>
            </content>
            <paragraph eId="part-2__sec-14__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>in the case of a building energy efficiency certificate for a building:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the energy efficiency rating specified in the certificate for the building is not that which, applying the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>, is appropriate for the building; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>the assessment of the energy efficiency of the lighting for the building that might reasonably be expected to remain if the building is sold, let or sublet is not that which, applying the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>, is appropriate for the building; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>in the case of a building energy efficiency certificate for an area of a building:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the energy efficiency rating specified in the certificate for the building in which the area is located is not that which, applying the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>, is appropriate for the building; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-14__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>the assessment of the energy efficiency of the lighting for the area that might reasonably be expected to remain if the area is let or sublet is not that which, applying the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>, is appropriate for the area.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-4">
            <num>4</num>
            <content>
              <p>If particulars of a building energy efficiency certificate for a building are deleted from the Register, <role refersTo="#secretary">the Secretary</role> may notify any person who <role refersTo="#secretary">the Secretary</role> reasonably believes is currently the owner of the building, or a lessee or sublessee of the building or an area of the building, of that fact.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-5">
            <num>5</num>
            <content>
              <p>If particulars of a building energy efficiency certificate for an area of a building are deleted from the Register, <role refersTo="#secretary">the Secretary</role> may notify any person who <role refersTo="#secretary">the Secretary</role> reasonably believes is currently the lessee or sublessee of the area of that fact.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-6">
            <num>6</num>
            <content>
              <p>The Register must be maintained by electronic means and be made available for inspection on the internet.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-14__subsec-7">
            <num>7</num>
            <content>
              <p>The Register is not a legislative instrument.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-15">
          <num>15</num>
          <heading>Advertisements to include energy efficiency ratings</heading>
          <subsection eId="part-2__sec-15__subsec-1">
            <num>1</num>
            <content>
              <p>If a constitutional corporation owns a disclosure affected building, the corporation must not advertise or continue to advertise the building for sale or lease unless:</p>
            </content>
            <paragraph eId="part-2__sec-15__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a current energy efficiency rating for the building is included in the advertisement; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-15__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the rating is expressed in the advertisement in a manner determined by <role refersTo="#secretary">the Secretary</role> by legislative instrument.</p>
              </content>
              <hcontainer name="penalty">
                <content>
                  <p>Civil penalty:	<quantity refersTo="#penaltyUnit">1,000 penalty units</quantity>.</p>
                </content>

            </paragraph>
          </subsection>

              <p>If a constitutional corporation leases a disclosure affected building, the corporation must not advertise or continue to advertise the building for sublease unless:</p>

                <p>a current energy efficiency rating for the building is included in the advertisement; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-15__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the rating is expressed in the advertisement in a manner determined by <role refersTo="#secretary">the Secretary</role> by legislative instrument.</p>
              </content>

              <p>If a constitutional corporation owns a building, the corporation must not advertise or continue to advertise a disclosure affected area of the building for lease unless:</p>
            </content>
            <paragraph eId="part-2__sec-15__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>a current energy efficiency rating for the building is included in the advertisement; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-15__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the rating is expressed in the advertisement in a manner determined by <role refersTo="#secretary">the Secretary</role> by legislative instrument.</p>
              </content>
              <hcontainer name="penalty">

          </subsection>

              <p>If a constitutional corporation leases a disclosure affected area of a building, the corporation must not advertise or continue to advertise the area for sublease unless:</p>
            </content>
            <paragraph eId="part-2__sec-15__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>a current energy efficiency rating for the building is included in the advertisement; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-15__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>the rating is expressed in the advertisement in a manner determined by <role refersTo="#secretary">the Secretary</role> by legislative instrument.</p>
              </content>
              <hcontainer name="penalty">
                <content>
                  <p>Civil penalty:	<quantity refersTo="#penaltyUnit">1,000 penalty units</quantity>.</p>
                </content>
              </hcontainer>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-15__subsec-5">
            <num>5</num>
            <content>
              <p>A constitutional corporation that contravenes a requirement of this section in relation to a continuing advertisement commits a separate contravention in respect of each day during which the person fails to comply with that requirement, including the day of the making of a relevant civil penalty order under the Regulatory Powers Act and any subsequent day.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-15__subsec-6">
            <num>6</num>
            <content>
              <p>Subsections (1) to (4) do not apply if:</p>
            </content>
            <paragraph eId="part-2__sec-15__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>a constitutional corporation advertises or continues to advertise a building or an area of a building for lease or sublease; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-15__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>the term proposed for the lease or sublease in the advertisement is 12 months or less, including any options to extend the lease or sublease; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-15__subsec-6__para-c">
              <num>c</num>
              <content>
                <p>at no time while the advertisement is continuing is a term of more than 12 months proposed.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-17">
          <num>17</num>
          <heading>Exemptions on application</heading>
          <content>
            <p>Application for an exemption</p>
          </content>
          <subsection eId="part-2__sec-17__subsec-1">
            <num>1</num>
            <content>
              <p>A person may apply to <role refersTo="#secretary">the Secretary</role> for a building or an area of a building to be exempt from the operation of section 11, 12 or 15.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-17__subsec-2">
            <num>2</num>
            <content>
              <p>The application must:</p>
            </content>
            <paragraph eId="part-2__sec-17__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>be in writing in a form approved by <role refersTo="#secretary">the Secretary</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-17__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>include information of a kind prescribed by regulation; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-17__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>be accompanied by the fee (if any) prescribed by regulation.</p>
              </content>
              <content>
                <p>Granting an exemption</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-17__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may grant the exemption:</p>
            </content>
            <paragraph eId="part-2__sec-17__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>if <role refersTo="#secretary">the Secretary</role> is satisfied that the building or the area is used for police or security operations; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-17__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>if <role refersTo="#secretary">the Secretary</role> is satisfied that the building or the area is non-assessable (see subsections (7) and (8)); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-17__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>in circumstances prescribed by regulation for the purposes of this paragraph.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-17__subsec-4">
            <num>4</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> must give the applicant written notice of <role refersTo="#secretary">the Secretary</role>’s decision under subsection (3).</p>
            </content>
            <content>
              <p>Varying or revoking an exemption</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-17__subsec-5">
            <num>5</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may vary or revoke an exemption by giving notice in writing to:</p>
            </content>
            <paragraph eId="part-2__sec-17__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>the applicant; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-17__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>any other person whose interest in the building or the area is registered with a land titles office (however described).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-17__subsec-6">
            <num>6</num>
            <content>
              <p>	(6)	Subsection (5) does not limit subsection 33(3) of the <i>Acts Interpretation Act 1901</i>.</p>
            </content>
            <content>
              <p>Meaning of <b>non</b><b>-</b><b>assessable</b></p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-17__subsec-7">
            <num>7</num>
            <content>
              <p>	(7)	A building is <b><i>non</i></b><b><i>-</i></b><b><i>assessable</i></b> if it is not possible to work out an energy efficiency rating for the building, or perform a lighting energy efficiency assessment for the building, because of the characteristics of the building.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-17__subsec-8">
            <num>8</num>
            <content>
              <p>	(8)	An area of a building is <b><i>non</i></b><b><i>-</i></b><b><i>assessable</i></b> if it is not possible to work out an energy efficiency rating for the building in which the area is located, or perform a lighting energy efficiency assessment for the area, because of the characteristics of the building or the area.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-17A">
          <num>17A</num>
          <heading>Automatic exemptions</heading>
          <content>
            <p>A building or an area of a building is exempt from the operation of <ref href="#sec-11">section 11</ref>, 12 or 15 if circumstances specified in a determination under paragraph 21(1)(d) apply to the building or the area.</p>
          </content>
        </section>
        <section eId="part-2__sec-18">
          <num>18</num>
          <heading>Information gathering</heading>
          <subsection eId="part-2__sec-18__subsec-1">
            <num>1</num>
            <content>
              <p>This section applies if:</p>
            </content>
            <paragraph eId="part-2__sec-18__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a person asks an accredited assessor to assess a building or an area of a building for the purposes of applying for a building energy efficiency certificate for the building or area; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-18__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the person does so in order to satisfy an energy efficiency disclosure obligation.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-18__subsec-2">
            <num>2</num>
            <content>
              <p>The accredited assessor may, by written notice, request <role refersTo="#secretary">the Secretary</role> to require an owner, lessee or sublessee of the building or area to give the assessor information that is:</p>
            </content>
            <paragraph eId="part-2__sec-18__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>necessary for the purposes of the assessment; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-18__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>of a kind specified in the notice;</p>
              </content>
              <content>
                <p>if the assessor reasonably believes that the person possesses the information.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-18__subsec-3">
            <num>3</num>
            <content>
              <p>At the written request of the accredited assessor, <role refersTo="#secretary">the Secretary</role> may, by written notice, require the owner, lessee or sublessee of the building or the area to give the information to the assessor within the period specified in the notice. The period must end at least 14 days after the day on which the notice is given.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-18__subsec-4">
            <num>4</num>
            <content>
              <p>At the written request of the accredited assessor, <role refersTo="#secretary">the Secretary</role> may, by written notice, require an owner, lessee or sublessee of the building or area of a building to give the assessor access to a place in or associated with the building or area if access to the place is necessary for the purposes of the assessment.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-18__subsec-5">
            <num>5</num>
            <content>
              <p>A notice given under subsection (4) to an owner, lessee or sublessee must specify the day and time on which access by the accredited assessor is required. However, the day and time on which access is required under the notice must be reasonable.</p>
            </content>
            <content>
              <p>Civil penalty provision</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-18__subsec-6">
            <num>6</num>
            <content>
              <p>An owner, lessee or sublessee to whom notice is given in accordance with this section must comply with the notice.</p>
            </content>
            <hcontainer name="penalty">

                <p>Civil penalty:</p>

          </subsection>
          <subsection eId="part-2__sec-18__subsec-7">

            <content>
              <p>If a person contravenes subsection (6) by failing to give access at a day and time on which access is required under a notice, the person commits a separate contravention of that subsection in respect of each day after the day required under the notice, including a day of the making of the relevant civil penalty order and any subsequent day.</p>
            </content>

          <heading>Offences relating to information obtained or generated in applying for a certificate</heading>
          <subsection eId="part-2__sec-19__subsec-1">
            <num>1</num>
            <content>
              <p>A person commits an offence if:</p>
            </content>
            <paragraph eId="part-2__sec-19__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the person:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-19__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>is given information in response to a notice given or purportedly given under subsection 18(3); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-19__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>otherwise obtains or generates information for the purposes of obtaining a building energy efficiency certificate; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-19__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the person does any of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-19__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>copies, or makes a record of, the information;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-19__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>uses the information;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-19__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>discloses the information to any person.</p>
              </content>

            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-19__subsec-2">

              <p>Subsection (1) does not apply if:</p>
            </content>
            <paragraph eId="part-2__sec-19__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the information is copied, recorded, used or disclosed for the purposes of obtaining a building energy efficiency certificate; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-19__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the information is copied, recorded, used or disclosed in, or in connection with, an audit conducted under <ref href="#part-4">Part 4</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-19__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the information is copied, recorded, used or disclosed in circumstances in which the conduct is permitted, either expressly or by implication, under this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-19__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>	(d)	the information is copied, recorded, used or disclosed for the purposes of proceedings for an offence against <i>Criminal Code</i> (false or misleading information or documents) that relates to this Act; or<ref href="#sec-137">section 137</ref>.1 or 137.2 of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-19__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>	(e)	the information is copied, recorded, used or disclosed for the purposes of proceedings for an offence against <i>Criminal </i><i>C</i><i>ode</i> (obstruction of Commonwealth public officials) that relates to this Act; or<ref href="#sec-149">section 149</ref>.1 of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-19__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>the information is copied, recorded, used or disclosed with the consent of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-19__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>in the case of information given in response to a notice given or purportedly given under subsection 18(3)—the person who gave the information; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-19__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>in the case of information otherwise obtained for the purposes of obtaining a building energy efficiency certificate—the person from whom the information was obtained; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-19__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>in the case of information generated for the purposes of obtaining a building energy efficiency certificate—the person on whose behalf the accredited assessor made an application for the certificate; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-19__subsec-2__para-g">
              <num>g</num>
              <content>
                <p>the information is already publicly available.</p>
              </content>

        </section>
        <section eId="part-2__sec-20">
          <num>20</num>
          <heading>Damages for failure to properly carry out assessments</heading>
          <subsection eId="part-2__sec-20__subsec-1">
            <num>1</num>
            <content>
              <p>An accredited assessor who carries out an assessment of a disclosure affected building for the purposes of applying for a building energy efficiency certificate must, in doing so:</p>
            </content>
            <paragraph eId="part-2__sec-20__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>work out the proposed energy efficiency rating for the building by applying the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-20__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>perform a lighting energy efficiency assessment for the building by applying the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-20__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>comply with the assessor’s conditions of accreditation.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-20__subsec-2">
            <num>2</num>
            <content>
              <p>An accredited assessor who carries out an assessment of a disclosure affected area of a building for the purposes of applying for a building energy efficiency certificate must, in doing so:</p>
            </content>
            <paragraph eId="part-2__sec-20__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>work out the proposed energy efficiency rating for the building by applying the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-20__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>perform a lighting energy efficiency assessment for the area by applying the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-20__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>comply with the assessor’s conditions of accreditation.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-20__subsec-3">
            <num>3</num>
            <content>
              <p>If one of the following persons suffers damage as a result of a failure to comply with a duty under this section, the person may recover damages for any loss suffered as a result of that failure in a Court:</p>
            </content>
            <paragraph eId="part-2__sec-20__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>if the certificate is sought for a disclosure affected building:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-20__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the owner of the building; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-20__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>if all or part of the building is let—the lessor and lessee under the lease; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-20__subsec-3__para-iii">
              <num>iii</num>
              <content>
                <p>if all or part of the building is sublet—the sublessor and sublessee under the sublease;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-20__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>if the rating or certificate is sought for a disclosure affected area of a building:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-20__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the owner of the building; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-20__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>the lessor and lessee under a lease of the area; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-20__subsec-3__para-iii">
              <num>iii</num>
              <content>
                <p>if the area is sublet—the sublessor and sublessee under the sublease.</p>
              </content>

          <num>21</num>
          <heading>Methods and standards of assessment</heading>
          <subsection eId="part-2__sec-21__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, by legislative instrument, determine:</p>
            </content>
            <paragraph eId="part-2__sec-21__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the assessment methods and standards to be applied in working out the energy efficiency rating for a building; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-21__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the assessment methods and standards to be applied in performing a lighting energy efficiency assessment for the building; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-21__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the assessment methods and standards to be applied in performing a lighting energy efficiency assessment for the area; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-21__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>the circumstances in which a building or an area of a building is exempt for the purposes of <ref href="#sec-17A">section 17A</ref>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-21__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting subsection (1), <role refersTo="#secretary">the Secretary</role> may determine an assessment method or standard by applying, adopting or incorporating, with or without modification, any matter contained in any other instrument or writing as in force at a particular time or as in force from time to time.</p>
            </content>
          </subsection>

        <heading>Accreditation of assessors</heading>

          <heading>Accreditation</heading>

            <heading>Application for accreditation</heading>
            <subsection eId="part-3__dvs-1__sec-24__subsec-1">
              <num>1</num>
              <content>
                <p>A person may apply to <role refersTo="#secretary">the Secretary</role> to become an accredited assessor.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-24__subsec-2">
              <num>2</num>
              <content>
                <p>The application must:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-24__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>be in writing in a form approved by <role refersTo="#secretary">the Secretary</role>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-24__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>include information of the prescribed kind; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-24__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>be accompanied by the prescribed fee.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-3__dvs-1__sec-25">
            <num>25</num>
            <heading>Accreditation of assessors</heading>
            <subsection eId="part-3__dvs-1__sec-25__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> must refuse to accredit a person as an assessor if:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	the person has been convicted of an offence against <i>Criminal Code</i> for the provision of false or misleading information or documents in, or in connection with, an application for a building energy efficiency certificate; or<ref href="#dvs-13">Division 13</ref>7 of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	the person has been convicted of an offence against <i>Criminal Code</i> for the provision of false or misleading information in, or in connection with, an audit conducted under Part 4; or<ref href="#dvs-13">Division 13</ref>7 of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p><role refersTo="#secretary">the Secretary</role> is satisfied that the person has otherwise provided false or misleading information in, or in connection with, a rating of the energy efficiency of a building on which another person might rely for any purpose; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>	(d)	the person has been convicted of an offence against <i>Criminal Code</i> for the provision of false or misleading information in, or in connection with, an application for accreditation or renewal of accreditation; or<ref href="#dvs-13">Division 13</ref>7 of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-1__para-e">
                <num>e</num>
                <content>
                  <p>the person has not successfully completed the prescribed training.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-25__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may refuse to accredit a person as an assessor if:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>in a case where the person has previously been accredited as an assessor:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>the person has been found in proceedings for damages brought under <ref href="#sec-20">section 20</ref> not to have properly applied the assessment methods and standards determined under <ref href="#sec-21">section 21</ref> for the purposes of working out a proposed energy efficiency rating or performing a lighting energy efficiency assessment for a building or an area of a building; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p><role refersTo="#secretary">the Secretary</role> is otherwise reasonably satisfied that the person has not properly applied the assessment methods and standards determined under section 21 for the purposes of working out a proposed energy efficiency rating or performing a lighting energy efficiency assessment for a building or an area of a building; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>the person has failed to comply with a condition of accreditation; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>in any case:</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p><role refersTo="#secretary">the Secretary</role> is satisfied that the person needs to undertake further training before the person can properly apply the assessment methods and standards determined under section 21 and the person has not successfully completed that training; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p><role refersTo="#secretary">the Secretary</role> is satisfied that the person does not have the qualifications or experience necessary to properly apply the assessment methods and standards determined under section 21; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-25__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p><role refersTo="#secretary">the Secretary</role> is satisfied that the person will not be able to satisfy a condition of accreditation prescribed under subsection 27(1) that is relevant to the person.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-25__subsec-3">
              <num>3</num>
              <content>
                <p>Otherwise, <role refersTo="#secretary">the Secretary</role> must accredit the person.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-25__subsec-4">
              <num>4</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> must notify the person in writing of <role refersTo="#secretary">the Secretary</role>’s decision on the application.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-1__sec-26">
            <num>26</num>
            <heading>Period of accreditation</heading>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may accredit a person as an assessor for a period of no less than 12 months and no more than 3 years.</p>
            </content>
          </section>
          <section eId="part-3__dvs-1__sec-27">
            <num>27</num>
            <heading>Conditions of accreditation</heading>
            <subsection eId="part-3__dvs-1__sec-27__subsec-1">
              <num>1</num>
              <content>
                <p>The regulations may prescribe conditions to be imposed on the accreditation of all or a specified class of assessors.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-27__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may impose additional conditions on the accreditation of an assessor.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-27__subsec-3">
              <num>3</num>
              <content>
                <p>Without limiting subsection (2), those conditions may include:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-27__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>a condition that the assessor may work out energy efficiency ratings or perform lighting energy efficiency assessments only under the supervision of an auditor; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-27__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>a condition that the assessor is to undertake specified further training while accredited.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-27__subsec-4">
              <num>4</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may, at any time, vary or revoke a condition imposed under subsection (2).</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-27__subsec-5">
              <num>5</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> must notify a person in writing of any condition imposed under subsection (2) on the person’s accreditation as an assessor, and the variation or revocation of such a condition.</p>
              </content>
            </subsection>

              <num>6</num>
              <content>
                <p>A notice given under subsection (5) is not a legislative instrument.</p>
              </content>
            </subsection>

          <heading>Suspension and revocation of accreditation</heading>

            <heading>Suspension of accreditation</heading>

              <num>1</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may suspend the accreditation of a person as an assessor if:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-28__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the person has been found in proceedings for damages brought under <ref href="#sec-20">section 20</ref> not to have properly applied the assessment methods and standards determined under <ref href="#sec-21">section 21</ref> for the purposes of working out a proposed energy efficiency rating or performing a lighting energy efficiency assessment for a building or an area of a building; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-28__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#secretary">the Secretary</role> is otherwise reasonably satisfied that the person has not properly applied the assessment methods and standards determined under section 21 for the purposes of working out a proposed energy efficiency rating or performing a lighting energy efficiency assessment for a building or an area of a building; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-28__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the person has failed to comply with a condition of accreditation.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-28__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> must notify a person in writing of a decision to suspend the person’s accreditation</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-2__sec-29">
            <num>29</num>
            <heading>Lift of suspension</heading>
            <subsection eId="part-3__dvs-2__sec-29__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may lift the suspension of the accreditation of a person if <role refersTo="#secretary">the Secretary</role> is satisfied that:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-29__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the issues that resulted in accreditation being suspended have been addressed; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-29__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>any other action necessary to ensure the person will properly apply the assessment methods and standards determined under <ref href="#sec-21">section 21</ref> and comply with the conditions of accreditation has been or will be taken.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-29__subsec-2">
              <num>2</num>
              <content>
                <p>If the accreditation of a person expires before a suspension of that accreditation is lifted, <role refersTo="#secretary">the Secretary</role> may waive all or a specified part of:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-29__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the requirement under paragraph 24(2)(b) to produce information on the application by the person for accreditation; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-29__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the requirement under paragraph 24(2)(c) to pay a fee on the application by the person for accreditation.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-29__subsec-3">
              <num>3</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> must notify a person in writing of:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-29__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>a decision to lift the suspension of the person’s accreditation; and</p>
                </content>
              </paragraph>

                <p><role refersTo="#secretary">The Secretary</role> must revoke the accreditation of a person as an assessor if:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-30__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	the person has been convicted of an offence against <i>Criminal Code</i> for the provision of false or misleading information or documents in, or in connection with, an application for a building energy efficiency certificate; or<ref href="#dvs-13">Division 13</ref>7 of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-30__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	the person has been convicted of an offence against <i>Criminal Code</i> for the provision of false or misleading information in, or in connection with, an audit conducted under Part 4; or<ref href="#dvs-13">Division 13</ref>7 of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-30__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p><role refersTo="#secretary">the Secretary</role> is satisfied that the person has otherwise provided false or misleading information in, or in connection with, a rating of the energy efficiency of a building on which another person might rely for any purpose; or</p>

              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-30__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>	(d)	the person has been convicted of an offence against <i>Criminal Code</i> for the provision of false or misleading information in, or in connection with, an application for accreditation or renewal of accreditation.<ref href="#dvs-13">Division 13</ref>7 of the </p>

              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-30__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may revoke the accreditation of a person as an assessor in the following circumstances:</p>
              </content>
              <paragraph eId="part-3__dvs-2__sec-30__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the person has been found in proceedings for damages brought under <ref href="#sec-20">section 20</ref> not to have properly applied the assessment methods and standards determined under <ref href="#sec-21">section 21</ref> for the purposes of working out an energy efficiency rating or performing a lighting energy efficiency assessment for a building or an area of a building;</p>

              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-30__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#secretary">the Secretary</role> is otherwise reasonably satisfied that the person has not properly applied the assessment methods and standards determined under section 21 for the purposes of working out an energy efficiency rating or performing a lighting energy efficiency assessment for a building or an area of a building;</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-2__sec-30__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the person has failed to comply with a condition of the person’s accreditation.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-2__sec-30__subsec-3">
              <num>3</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> must notify a person in writing of a decision to revoke the person’s accreditation.</p>
              </content>
            </subsection>

          <heading>General provisions relating to accreditation</heading>
          <section eId="part-3__dvs-3__sec-31">
            <num>31</num>
            <heading>Register of Accredited Assessors</heading>
            <subsection eId="part-3__dvs-3__sec-31__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> must maintain, or cause to be maintained, a register, to be known as the Register of Accredited Assessors.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-31__subsec-2">
              <num>2</num>
              <content>
                <p>The Register is to contain:</p>
              </content>
              <paragraph eId="part-3__dvs-3__sec-31__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the name of each accredited assessor; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-31__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the registration number for each accredited assessor; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-3__sec-31__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>any other information that <role refersTo="#secretary">the Secretary</role> considers relevant in assisting a person in engaging an accredited assessor to work out an energy efficiency rating or perform a lighting energy efficiency assessment for the purposes of applying for a building energy efficiency certificate.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-31__subsec-3">
              <num>3</num>
              <content>
                <p>The Register must be maintained by electronic means and be available for inspection on the internet.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-31__subsec-4">
              <num>4</num>
              <content>
                <p>The Register is not a legislative instrument.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-3__dvs-3__sec-32">
            <num>32</num>
            <heading>Offence—holding out to be an accredited assessor</heading>
            <content>
              <p>A person commits an offence if:</p>
            </content>
            <paragraph eId="part-3__dvs-3__sec-32__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the person (the <b><i>defendant</i></b>) makes a statement (whether orally, in a document or in any other way); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-32__para-b">
              <num>b</num>
              <content>
                <p>the statement might reasonably lead another person to believe that, at a particular time, the defendant is or was an accredited assessor; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-32__para-c">
              <num>c</num>
              <content>
                <p>at that time, the defendant is not or was not an accredited assessor.</p>
              </content>

            <heading>Auditing authority</heading>
            <subsection eId="part-4__dvs-1__sec-33__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may, by written instrument, appoint a person or body as an auditing authority.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-33__subsec-2">
              <num>2</num>
              <content>
                <p>An auditing authority has the following functions:</p>
              </content>
              <paragraph eId="part-4__dvs-1__sec-33__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>to direct auditors in performing their work to ensure that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-33__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>accredited assessors properly apply the assessment methods and standards determined under <ref href="#sec-21">section 21</ref> in working out ratings and performing assessments for the purposes of applying for building energy efficiency certificates; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-33__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>the ratings and assessments are not influenced by any conflict of interest;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-33__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>to provide or approve ratings and assessments for building energy efficiency certificates;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-33__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>such other functions as are conferred by this Act or the regulations.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-33__subsec-3">
              <num>3</num>
              <content>
                <p>An auditing authority must perform its functions in accordance with any policies notified to the auditing authority in writing by <role refersTo="#secretary">the Secretary</role>.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-33__subsec-4">
              <num>4</num>
              <content>
                <p>An auditing authority must notify <role refersTo="#secretary">the Secretary</role> in writing as soon as is reasonably practicable if it becomes apparent as a result of an audit of an assessment carried out by an accredited assessor that:</p>
              </content>
              <paragraph eId="part-4__dvs-1__sec-33__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>in relation to a building for which a building energy efficiency certificate is current:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-33__subsec-4__para-i">
                <num>i</num>
                <content>
                  <p>the energy efficiency rating specified in the certificate for the building is not that which, applying the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>, is appropriate for the building; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-33__subsec-4__para-ii">
                <num>ii</num>
                <content>
                  <p>the lighting energy efficiency assessment for the building is not that which, applying the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>, is appropriate for the building; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-33__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>in relation to an area of a building for which a building energy efficiency certificate is current:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-33__subsec-4__para-i">
                <num>i</num>
                <content>
                  <p>the energy efficiency rating specified in the certificate for the building in which the area is located is not that which, applying the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>, is appropriate for the building; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-33__subsec-4__para-ii">
                <num>ii</num>
                <content>
                  <p>the lighting energy efficiency assessment for the area is not that which, applying the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>, is appropriate for the area.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-33__subsec-5">
              <num>5</num>
              <content>
                <p>A policy made under subsection (3) is not a legislative instrument.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-4__dvs-1__sec-34">
            <num>34</num>
            <heading>Auditors</heading>
            <subsection eId="part-4__dvs-1__sec-34__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may, by written instrument, appoint any of the following persons as an auditor:</p>
              </content>
              <paragraph eId="part-4__dvs-1__sec-34__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>an APS employee;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-34__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a member of the civil or public service of a State or Territory;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-34__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>a person engaged by the Commonwealth as an auditor under contract or otherwise.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-34__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> may only appoint a person as an auditor if <role refersTo="#secretary">the Secretary</role> is satisfied that the person has the skills and experience necessary to perform the functions described in subsection (3).</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-34__subsec-3">
              <num>3</num>
              <content>
                <p>The functions of an auditor are to:</p>
              </content>
              <paragraph eId="part-4__dvs-1__sec-34__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>conduct audits of:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-34__subsec-3__para-i">
                <num>i</num>
                <content>
                  <p>energy efficiency ratings and lighting energy efficiency assessments worked out or performed by accredited assessors for the purposes of applying for building energy efficiency certificates; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-34__subsec-3__para-ii">
                <num>ii</num>
                <content>
                  <p>such ratings and assessments provided or approved by auditing authorities; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-34__subsec-3__para-iii">
                <num>iii</num>
                <content>
                  <p>applications for exemptions under <ref href="#sec-17">section 17</ref>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-34__subsec-3__para-iv">
                <num>iv</num>
                <content>
                  <p>the documentation and record keeping of accredited assessors and other persons in relation to such ratings, assessments and applications; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-34__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>supervise ratings and assessments by accredited assessors to ensure that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-34__subsec-3__para-i">
                <num>i</num>
                <content>
                  <p>the assessment methods and standards determined under <ref href="#sec-21">section 21</ref> are properly applied; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-34__subsec-3__para-ii">
                <num>ii</num>
                <content>
                  <p>the ratings and assessments are properly documented; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-34__subsec-3__para-iii">
                <num>iii</num>
                <content>
                  <p>the records of ratings and assessments are properly kept.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-34__subsec-3A">
              <num>3A</num>
              <content>
                <p>Without limiting subsection (3), an auditor may conduct an audit of a rating, assessment or application by doing no more than reviewing documents relating to the assessment, rating or application.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-34__subsec-4">
              <num>4</num>
              <content>
                <p>An auditor must perform his or her functions in accordance with any directions given by an auditing authority.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-34__subsec-5">
              <num>5</num>
              <content>
                <p>If a direction is given in writing, the direction is not a legislative instrument.</p>
              </content>
            </subsection>
          </section>

            <heading>Identity cards</heading>

                <p><role refersTo="#secretary">The Secretary</role> must issue an identity card to an auditor.</p>

                <p>The identity card must:</p>
              </content>

                  <p>satisfy the requirements prescribed by the regulations; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-35__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>contain a recent photograph of the auditor.</p>
                </content>
                <content>
                  <p>Offence</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-35__subsec-3">

                <p>A person commits an offence if:</p>
              </content>
              <paragraph eId="part-4__dvs-1__sec-35__subsec-3__para-a">

                  <p>the person has been issued with an identity card; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-35__subsec-3__para-b">

                  <p>the person ceases to be an auditor; and</p>
                </content>
              </paragraph>

                  <p>the person does not, as soon as practicable after so ceasing, return the identity card to <role refersTo="#secretary">the Secretary</role>.</p>

            <heading>Auditor may enter a building, an area of a building or an associated place by consent or under warrant</heading>

                <p>An auditor may exercise the powers under this section for the purpose of determining whether an accredited assessor has properly applied the assessment methods and standards determined under <ref href="#sec-21">section 21</ref> for the purposes of working out a proposed energy efficiency rating or performing a lighting energy efficiency assessment for a building or an area of a building.</p>

              <num>2</num>
              <content>
                <p>The auditor may:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-36__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	enter the building or area, and any place associated with the building or area (an <b><i>associated place</i></b>); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-36__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>exercise the monitoring powers set out in <ref href="#sec-37">section 37</ref>.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-36__subsec-3">
              <num>3</num>
              <content>
                <p>However, an auditor is not authorised to enter a building, an area or an associated place unless:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-36__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>the occupier of the building, area or associated place has consented to the entry and the auditor has shown his or her identity card if required by the occupier; or</p>
                </content>
              </paragraph>

                <num>b</num>
                <content>
                  <p>the entry is made under a monitoring warrant.</p>
                </content>

                <p>	(1)	The following are the <b><i>monitoring powers</i></b> that an auditor may exercise in relation to a building, an area or an associated place under section 36:</p>

                  <p>the power to observe any activity conducted in the building, area or associated place;</p>
                </content>
              </paragraph>

                  <p>the power to inspect, or take measurements of, any thing in the building, area or associated place;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-37__subsec-1__para-c">

                  <p>the power to make any still or moving image or any recording of the building, area or associated place or any thing in the building, area or associated place;</p>

                  <p>the power to inspect any document in the building, area or associated place;</p>
                </content>
              </paragraph>

                  <p>the power to take extracts from, or make copies of, any such document;</p>
                </content>
              </paragraph>

                  <p>the power to take into the building, area or associated place such equipment and materials as the auditor requires for the purpose of exercising powers in relation to the building, area or associated place;</p>

                <p>	(2)	The <b><i>monitoring powers</i></b> include the power to operate electronic equipment in the building, area or associated place to see whether:</p>

                  <p>the equipment; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-37__subsec-2__para-b">

                  <p>a disk, tape or other storage device that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-37__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>is in the building, area or associated place; and</p>
                </content>
              </paragraph>

                <p>	(3)	The <b><i>monitoring powers</i></b> include the following powers in relation to information described in subsection (2) found in the exercise of the power under that subsection:</p>

                  <p>the power to operate electronic equipment in the building, area or associated place to put the information in documentary form and remove the documents so produced from the building, area or associated place;</p>

                <num>b</num>
                <content>
                  <p>the power to operate electronic equipment in the building, area or associated place to transfer the information to a disk, tape or other storage device that:</p>

              <paragraph eId="part-4__dvs-2__sec-37__subsec-3__para-i">
                <num>i</num>
                <content>
                  <p>is brought to the building, area or associated place for the exercise of the power; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-37__subsec-3__para-ii">
                <num>ii</num>
                <content>
                  <p>is in the building, area or associated place and the use of which for that purpose has been agreed in writing by the occupier of the building, area or associated place;</p>
                </content>
                <content>
                  <p>and remove the disk, tape or other storage device from the building, area or associated place.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-37__subsec-4">
              <num>4</num>
              <content>
                <p>An auditor may operate electronic equipment as mentioned in subsection (2) or (3) only if he or she believes on reasonable grounds that the operation of the equipment can be carried out without damage to the equipment.</p>

            <heading>Persons assisting auditors</heading>
            <content>
              <p>Auditors may be assisted by other persons</p>
            </content>
            <subsection eId="part-4__dvs-2__sec-38__subsec-1">

              <content>
                <p>	(1)	An auditor may, in entering a building, an area or an associated place under <b><i>person assisting</i></b> the auditor.<ref href="#sec-36">section 36</ref> and in exercising monitoring powers in relation to the building, area or associated place, be assisted by other persons if that assistance is necessary and reasonable. A person giving such assistance is a </p>

                <p>A person assisting the auditor may:</p>

                <num>a</num>

                  <p>enter the building, area or associated place; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-38__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>exercise monitoring powers in relation to the building, area or associated place, but only in accordance with a direction given to the person by the auditor.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-38__subsec-3">
              <num>3</num>
              <content>
                <p>A power exercised by a person assisting the auditor as mentioned in subsection (2) is taken for all purposes to have been exercised by the auditor.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-38__subsec-4">
              <num>4</num>
              <content>
                <p>If a direction is given under paragraph (2)(b) in writing, the direction is not a legislative instrument.</p>
              </content>
            </subsection>

            <heading>Auditor may ask questions and seek production of documents</heading>

              <p>Entry with consent</p>
            </content>
            <subsection eId="part-4__dvs-2__sec-39__subsec-1">

                <p>If an auditor is authorised to enter a building, an area or an associated place because the occupier has consented to the entry, the auditor may ask the occupier to:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-39__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>answer any questions that are put by the auditor and that relate to determining whether an accredited assessor has properly applied the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>; and</p>

              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-39__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>produce any document that is requested by the auditor and that relates to whether an accredited assessor has properly applied the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>.</p>

                  <p>Entry under a monitoring warrant</p>
                </content>
              </paragraph>
            </subsection>

                <p>If an auditor is authorised to enter a building, an area or an associated place by a monitoring warrant, the auditor may require any person in the building, area or associated place to:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-39__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>answer any questions that are put by the auditor and that relate to determining whether an accredited assessor has properly applied the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>; and</p>

              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-39__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>produce any document that is requested by the auditor and that relates to whether an accredited assessor has properly applied the assessment methods and standards determined under <ref href="#sec-21">section 21</ref>.</p>

                  <p>Offence</p>

                <p>A person commits an offence if:</p>

                  <p>the person is subject to a requirement under subsection (2); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-39__subsec-3__para-b">

                  <p>the person fails to comply with the requirement.</p>

                <p>An individual is not required to answer a question or produce a document if the answer or document might tend to incriminate the individual or expose the individual to a penalty.</p>

                <p>Subsection (3) does not apply to the extent that the person is not capable of complying with the requirement.</p>

            <heading>Consent</heading>
            <subsection eId="part-4__dvs-3__sec-40__subsec-1">
              <num>1</num>
              <content>
                <p>An auditor must, before obtaining the consent of an occupier of a building, an area or an associated place for the purposes of paragraph 36(3)(a), inform the occupier that the occupier may refuse consent.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-40__subsec-2">
              <num>2</num>
              <content>
                <p>A consent has no effect unless the consent is voluntary.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-40__subsec-3">
              <num>3</num>
              <content>
                <p>A consent may be expressed to be limited to entry during a particular period. If so, the consent has effect for that period unless the consent is withdrawn before the end of that period.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-40__subsec-4">
              <num>4</num>
              <content>
                <p>A consent that is not limited as mentioned in subsection (3) has effect until the consent is withdrawn.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-40__subsec-5">

                <p>If an auditor entered a building, an area or an associated place because of the consent of the occupier, the auditor and any person assisting the auditor must leave the building, area or associated place if the consent ceases to have effect.</p>

            </subsection>

            <num>41</num>
            <heading>Announcement before entry under warrant</heading>
            <subsection eId="part-4__dvs-3__sec-41__subsec-1">
              <num>1</num>
              <content>
                <p>An auditor must, before entering a building, an area or an associated place under a monitoring warrant:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-41__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>announce that he or she is authorised to enter the building, area or associated place; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-41__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>show his or her identity card to the occupier of the building, area or associated place, or to another person who apparently represents the occupier, if the occupier or other person is present in the building, area or associated place; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-41__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>give any person in the building, area or associated place an opportunity to allow entry to the building, area or associated place.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-41__subsec-2">
              <num>2</num>
              <content>
                <p>However, an auditor is not required to comply with subsection (1) if he or she believes on reasonable grounds that immediate entry to the building, area or associated place is required to ensure that the effective execution of the warrant is not frustrated.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-41__subsec-3">
              <num>3</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-41__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>an auditor does not comply with subsection (1) because of subsection (2); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-41__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>the occupier of the building, area or associated place, or another person who apparently represents the occupier, is present in the building, area or associated place;</p>
                </content>
                <content>
                  <p>the auditor must, as soon as practicable after entering the building, area or associated place, show his or her identity card to the occupier or other person.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-4__dvs-3__sec-42">
            <num>42</num>
            <heading>Auditor to be in possession of warrant</heading>
            <content>
              <p>If a monitoring warrant is being executed in relation to the building, area or associated place, an auditor executing the warrant must be in possession of the warrant or a copy of the warrant.</p>
            </content>
          </section>
          <section eId="part-4__dvs-3__sec-43">
            <num>43</num>
            <heading>Details of warrant etc. to be given to occupier</heading>
            <content>
              <p>If:</p>
            </content>
            <paragraph eId="part-4__dvs-3__sec-43__para-a">
              <num>a</num>
              <content>
                <p>a monitoring warrant is being executed in relation to a building, an area or an associated place; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-43__para-b">
              <num>b</num>
              <content>
                <p>the occupier of the building, area or associated place, or another person who apparently represents the occupier, is present in the building, area or associated place;</p>
              </content>
              <content>
                <p>an auditor executing the warrant must, as soon as practicable:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-43__para-c">
              <num>c</num>
              <content>
                <p>make a copy of the warrant available to the occupier or other person (which need not include the signature of the magistrate who issued it); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__dvs-3__sec-43__para-d">
              <num>d</num>
              <content>
                <p>inform the occupier or other person of the rights and responsibilities of the occupier or other person under <ref href="#dvs-4">Division 4</ref>.</p>
              </content>
            </paragraph>
          </section>

            <num>44</num>
            <heading>Compensation for damage to electronic equipment</heading>
            <subsection eId="part-4__dvs-3__sec-44__subsec-1">
              <num>1</num>
              <content>
                <p>This section applies if:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-44__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>as a result of electronic equipment being operated as mentioned in this Part:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-44__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>damage is caused to the equipment; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-44__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>the data recorded on the equipment is damaged; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-44__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>programs associated with the use of the equipment, or with the use of the data, are damaged or corrupted; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-44__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the damage or corruption occurs because:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-44__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>insufficient care was exercised in selecting the person who was to operate the equipment; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-44__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>insufficient care was exercised by the person operating the equipment.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-44__subsec-2">
              <num>2</num>
              <content>
                <p>The Commonwealth must pay the owner of the equipment, or the user of the data or programs, such reasonable compensation for the damage or corruption as the Commonwealth and the owner or user agree on.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-44__subsec-3">
              <num>3</num>
              <content>
                <p>However, if the owner or user and the Commonwealth fail to agree, the owner or user may institute proceedings in the Federal Court of Australia for such reasonable amount of compensation as the Court determines.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-44__subsec-4">
              <num>4</num>
              <content>
                <p>In determining the amount of compensation payable, regard is to be had to whether the occupier of the building, area or associated place, or the occupier’s employees or agents, if they were available at the time, provided any appropriate warning or guidance on the operation of the equipment.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-44__subsec-5">
              <num>5</num>
              <content>
                <p>Compensation is payable out of money appropriated by the Parliament.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-44__subsec-6">

                <p>In this section:</p>

                <p><b><i>damage</i></b>, in relation to data, includes damage by erasure of data or addition of other data.</p>

                  <p>the occupier of the building, area or associated place, or another person who apparently represents the occupier, is present in the building, area or associated place;</p>

                  <p>the occupier or other person is entitled to observe the execution of the warrant.</p>

                <p>The right to observe the execution of the warrant ceases if the occupier or other person impedes that execution.</p>

                <p>This section does not prevent the execution of the warrant in 2 or more areas at the same time.</p>

            </subsection>

                <p>The occupier of a building, an area or an associated place to which a monitoring warrant relates, or another person who apparently represents the occupier, must provide:</p>
              </content>
              <paragraph eId="part-4__dvs-4__sec-46__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>an auditor executing the warrant; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-4__sec-46__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>any person assisting the auditor;</p>
                </content>
                <content>
                  <p>with all reasonable facilities and assistance for the effective exercise of their powers.</p>
                </content>
              </paragraph>
            </subsection>

                <p>	(1)	An auditor may apply to a magistrate for a warrant under this section in relation to a building, an area of a building or any place associated with a building or an area of a building (an <b><i>associated place</i></b>).</p>

                <p>The magistrate may issue the warrant if the magistrate is satisfied, by information on oath or affirmation, that it is reasonably necessary that one or more auditors should have access to the building, area or associated place for the purpose of determining whether an accredited assessor has properly applied the assessment methods and standards determined under <ref href="#sec-21">section 21</ref> for the purposes of working out a proposed energy efficiency rating for the building or performing a lighting energy efficiency assessment for the building or an area of the building.</p>

            </subsection>
            <subsection eId="part-4__dvs-5__sec-47__subsec-3">
              <num>3</num>
              <content>
                <p>However, the magistrate must not issue the warrant unless the auditor or some other person has given to the magistrate, either orally or by affidavit, such further information (if any) as the magistrate requires concerning the grounds on which the issue of the warrant is being sought.</p>

                <p>Content of warrant</p>

            </subsection>

                <p>The warrant must:</p>

                  <p>describe the building, area or associated place to which the warrant relates; and</p>

                <p>Despite subsection 103(3) of the Regulatory Powers Act, an infringement officer may give a person a single infringement notice relating to multiple contraventions of subsection 18(6) that are alleged to have occurred because the person failed to give access to a place at a particular day and time specified in a notice under subsection 18(4) and continued to fail to do so after that day and time.</p>

                <p>Amount payable under an infringement notice</p>

                <p>Despite subsections 104(2) and (3) of the Regulatory Powers Act, the amount to be stated in an infringement notice for the purposes of paragraph 104(1)(f) of that Act in relation to a civil penalty provision of this Act must not exceed an amount equal to:</p>

                <p><role refersTo="#secretary">The Secretary</role> is to maintain, or cause to be maintained, a register, to be known as the Energy Efficiency Non-disclosure Register.</p>

                <p><role refersTo="#secretary">The Secretary</role> must remove, or cause to be removed, an instance of non-disclosure by a person from the Register if:</p>

                  <p>the instance was included on the Register because the person was given an infringement notice and the notice is subsequently withdrawn; or</p>

                  <p>the instance was included on the Register because a Court made a civil penalty order against the person and that order is overturned on appeal.</p>

                  <p>the energy efficiency rating for the building or area that was specified in the certificate; and</p>

          <heading>Internal review of certain decisions</heading>

              <p>A person may apply in writing to <role refersTo="#secretary">the Secretary</role> for review of a reviewable decision if:</p>

                <p>the decision was made by:</p>
              </content>
            </paragraph>

              <p>An application for review of a decision must be made within:</p>
            </content>
            <paragraph eId="part-6__sec-68__subsec-2__para-a">

                <p>28 days after the person is notified of the decision; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-68__subsec-2__para-b">
              <num>b</num>

                <p>such longer period as <role refersTo="#secretary">the Secretary</role> allows.</p>
              </content>
            </paragraph>
          </subsection>

              <p>An application for review of a decision must:</p>

                <p>set out the reasons for making the application; and</p>
              </content>

                <p>be in a form approved by <role refersTo="#secretary">the Secretary</role>.</p>

            </paragraph>
          </subsection>

              <p>After receiving an application for review of a decision, <role refersTo="#secretary">the Secretary</role> must review the decision and:</p>
            </content>
            <paragraph eId="part-6__sec-68__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>affirm the decision under review; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-68__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>vary the decision under review; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-68__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>set aside the decision under review and make a decision in substitution for it.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-68__subsec-5">
            <num>5</num>
            <content>
              <p>A decision of <role refersTo="#secretary">the Secretary</role> under subsection (4) takes effect:</p>

                <p>on a day, provided in the decision, that is after the decision was made; or</p>
              </content>

          <heading>Administrative review of certain decisions</heading>
          <content>
            <p>An application may be made to the Administrative Review Tribunal for review of the following decisions:</p>
          </content>
          <paragraph eId="part-6__sec-69__para-a">
            <num>a</num>
            <content>
              <p>a reviewable decision made by <role refersTo="#secretary">the Secretary</role> personally;</p>
            </content>
          </paragraph>
          <paragraph eId="part-6__sec-69__para-b">
            <num>b</num>
            <content>
              <p>a decision of <role refersTo="#secretary">the Secretary</role> under subsection 68(4).</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-6__sec-70">
          <num>70</num>
          <heading>Protection of information obtained or generated by issuing authorities, auditors etc.</heading>
          <subsection eId="part-6__sec-70__subsec-1">
            <num>1</num>
            <content>
              <p>A person commits an offence if:</p>
            </content>
            <paragraph eId="part-6__sec-70__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the person:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>obtains or generates information in the course of making a decision whether to issue a building energy efficiency certificate; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>obtains or generates information in, or in connection with, an audit conducted under <ref href="#part-4">Part 4</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>obtains or generates information in the course of exercising powers or performing functions under this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-1__para-iv">
              <num>iv</num>
              <content>
                <p>obtains or generates information in the course of exercising powers or performing function under the Regulatory Powers Act, as it applies in relation to this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the person does any of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>copies, or makes a record of, the information;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>uses the information;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>discloses the information to any person.</p>
              </content>

              <p>Subsection (1) does not apply if:</p>
            </content>

                <p>the information is copied, recorded, used or disclosed for the purposes of issuing a building energy efficiency certificate; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the information is copied, recorded, used or disclosed in, or in connection with, an audit conducted under <ref href="#part-4">Part 4</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the information is copied, recorded, used or disclosed for the purposes of ensuring compliance with this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>the information is copied, recorded, used or disclosed in circumstances in which the conduct is permitted, either expressly or by implication, under this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>	(e)	the information is copied, recorded, used or disclosed for the purposes of proceedings for an offence against <i>Criminal Code</i> (false or misleading information or documents) that relates to this Act; or<ref href="#sec-137">section 137</ref>.1 or 137.2 of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>	(f)	the information is copied, recorded, used or disclosed for the purposes of proceedings for an offence against <i>Criminal Code</i> (obstruction of Commonwealth public officials) that relates to this Act; or<ref href="#sec-149">section 149</ref>.1 of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-70__subsec-2__para-g">
              <num>g</num>
              <content>
                <p>the information is copied, recorded, used or disclosed for the purposes of producing de-identified information for the purposes of research or planning; or</p>
              </content>

              <num>h</num>
              <content>
                <p>the information is already publicly available.</p>
              </content>

              <p><role refersTo="#secretary">The Secretary</role> may, in writing, delegate to an APS employee who holds or performs the duties of an Executive Level 2 position, or an equivalent position, in the Department, any or all of <role refersTo="#secretary">the Secretary</role>’s powers or functions under the following:</p>

          <subsection eId="part-6__sec-71__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, in writing, delegate to an SES employee, or acting SES employee, in the Department any or all of <role refersTo="#secretary">the Secretary</role>’s powers or functions under this Act, other than the following:</p>

              <num>a</num>
              <content>
                <p>this power of delegation;</p>
              </content>

              <p><role refersTo="#secretary">The Secretary</role> may, in writing, delegate to an issuing authority approved under section 71A:</p>

              <p>In exercising powers or performing functions delegated under subsection (1) or (2), the delegate must comply with any directions of <role refersTo="#secretary">the Secretary</role>.</p>

          <num>71A</num>
          <heading>Issuing authorities</heading>
          <subsection eId="part-6__sec-71A__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, by written instrument, approve a person or body as an issuing authority.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-71A__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> must not approve a person or body as an issuing authority unless <role refersTo="#secretary">the Secretary</role> is satisfied that:</p>

              <num>a</num>
              <content>
                <p>the person or body has the competencies necessary to apply the assessment methods and standards determined under <ref href="#sec-21">section 21</ref> to decide whether energy efficiency ratings or lighting energy efficiency assessments are appropriate; and</p>

            <paragraph eId="part-6__sec-71A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the person or body has systems in place to ensure that building energy efficiency certificates are issued in good faith.</p>
              </content>
            </paragraph>

          <subsection eId="part-6__sec-71A__subsec-3">
            <num>3</num>
            <content>
              <p>An instrument under subsection (1) is not a legislative instrument.</p>
            </content>
          </subsection>

            <p>The Governor-General may make regulations prescribing matters:</p>
