          <p>		This Act may be cited as the <i>National Vocational Education and Training Regulator (Transitional Provisions) Act 2011</i>.</p>
        </content>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

            <heading>Interpretation</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-1">
              <num>1</num>
              <content>
                <p>In this Schedule:</p>
              </content>
            </hcontainer>
            <content>
              <p><b><i>commencement</i></b><i> </i>means the day this item commences.</p>
              <p><b><i>new law</i></b> means the <i>National Vocational Education and Training Regulator Act 2011</i>.</p>
              <p><b><i>record</i></b>, in relation to a registered training organisation registered by a State VET Regulator, means a document, or an object, in any form (including any electronic form) that is, or has been, kept by the Regulator because of:</p>
              <p><b><i>relevant commencement day</i></b> means:</p>
              <p>comes into force; or</p>
              <p><b><i>show cause notice</i></b> means a written notice given to a registered training organisation that:</p>
              <p>The notice may also state the period within which the organisation must give the written response to the State VET Regulator.</p>
              <p><b><i>TVET Australia</i></b> means TVET Australia Limited (ABN 99 062 758 632).</p>
              <p>is to be read as a reference to a registered training organisation that:</p>
            </content>
            <paragraph eId="schedule-1__clause-1__para-a">
              <num>a</num>
              <content>
                <p>any information or matter that it contains or that can be obtained from it; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-b">
              <num>b</num>
              <content>
                <p>its connection with any event, person, circumstance or thing.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-a">
              <num>a</num>
              <content>
                <p>for a referring State covered by paragraph 5(1)(a) of the new law—the later of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-i">
              <num>i</num>
              <content>
                <p>the day that the legislation passed by the Parliament of the State referring the matters covered by subsections 5(3) and (5) of the new law to the Commonwealth Parliament receives the Royal Assent; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-ii">
              <num>ii</num>
              <content>
                <p>the day this item commences; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-b">
              <num>b</num>
              <content>
                <p>for a State covered by subsection 7(2) of the new law—the day that the legislation passed by the Parliament of the State:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-i">
              <num>i</num>
              <content>
                <p>adopting the relevant version of the new law and the relevant version of this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-ii">
              <num>ii</num>
              <content>
                <p>referring the matter covered by subsection 5(5) of the new law to the Commonwealth Parliament;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-c">
              <num>c</num>
              <content>
                <p>for a non-referring State in relation to a registered training organisation mentioned in subitem 26(2) or 27(4)—the day that the National VET Regulator registers the organisation; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-d">
              <num>d</num>
              <content>
                <p>for a Territory—the day this item commences.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-a">
              <num>a</num>
              <content>
                <p>sets out the grounds on which a State VET Regulator is giving the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-b">
              <num>b</num>
              <content>
                <p>invites the organisation to respond to the State VET Regulator, in writing, addressing the grounds on which the Regulator has given the notice.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-2">
              <num>2</num>
              <content>
                <p>An expression used in this Schedule that is also used in the new law has the same meaning in this Schedule as it has in the new law.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-3">
              <num>3</num>
              <content>
                <p>Unless the context otherwise requires, a reference in this Schedule to a State VET Regulator includes a reference to a VET Regulator of a Territory.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-4">
              <num>4</num>
              <content>
                <p>In relation to a State VET Regulator of a non-referring State, a reference in this Schedule to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-1__para-a">
              <num>a</num>
              <content>
                <p>a registered training organisation registered by the State VET Regulator of the non-referring State; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-b">
              <num>b</num>
              <content>
                <p>a registered training organisation registered in the non-referring State;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-c">
              <num>c</num>
              <content>
                <p>is a registered provider (other than a secondary school); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-d">
              <num>d</num>
              <content>
                <p>provides all or part of a VET course in the non-referring State and a referring State or a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-e">
              <num>e</num>
              <content>
                <p>provides all or part of a VET course in the non-referring State and offers all or part of a VET course in a referring State or a Territory to be provided in the referring State or Territory.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-5">
              <num>5</num>
              <content>
                <p>In addition to its effect apart from this subitem, subitem (4) also has the effect it would have if each reference to a registered training organisation were, by express provision, confined to a trading corporation.</p>
              </content>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>Registration of registered training organisations—referring States</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-1">
              <num>1</num>
              <content>
                <p>This item applies to a registered training organisation that is, immediately before the relevant commencement day, registered in a referring State.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-2">
              <num>2</num>
              <content>
                <p>Before the end of 90 days beginning on the relevant commencement day, the registered training organisation must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-2__para-a">
              <num>a</num>
              <content>
                <p>apply to the National VET Regulator for registration under the new law; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-b">
              <num>b</num>
              <content>
                <p>seek confirmation, in writing, from the relevant State VET Regulator that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-i">
              <num>i</num>
              <content>
                <p>the organisation’s registration has been transferred to the National VET Regulator; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-ii">
              <num>ii</num>
              <content>
                <p>a copy of records, of a kind specified in a determination made by the National VET Regulator, have been provided by the State VET Regulator to the National VET Regulator;</p>
              </content>
            </paragraph>
            <content>
              <p>and provide that confirmation to the National VET Regulator.</p>
              <p>Note 1:	An NVR registered training organisation is registered under <ref href="#sec-17">section 17</ref> of the new law.</p>
              <p>Note 2:	Subparagraph (5)(b)(i) may apply in the circumstances described in subitem (4).</p>
              <p>Note 3:	Records relating to a registered training organisation that applies for registration still need to be provided by the relevant State regulator, see item 27.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-3">
              <num>3</num>
              <content>
                <p>However, subitem (2) does not apply if the registered training organisation and the National VET Regulator are notified, before the end of 90 days beginning on the relevant commencement day, in writing, by the relevant State VET Regulator that the State VET Regulator has:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-2__para-a">
              <num>a</num>
              <content>
                <p>transferred the organisation’s registration to the National VET Regulator; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-b">
              <num>b</num>
              <content>
                <p>provided a copy of records, of a kind specified in a determination made by the National VET Regulator, for a period before the relevant commencement day.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-4">
              <num>4</num>
              <content>
                <p>If a registered training organisation gives the National VET Regulator written confirmation, as mentioned in paragraph (2)(b), but a copy of the records mentioned in subparagraph (2)(b)(ii) have not actually been provided by the State VET Regulator to the National VET Regulator:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-2__para-a">
              <num>a</num>
              <content>
                <p>the National VET Regulator must notify the organisation, in writing, of that fact; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-b">
              <num>b</num>
              <content>
                <p>the organisation must, <quantity refersTo="#deadline">within 90 days</quantity> of being so notified, apply to the National VET Regulator for registration under the new law.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-5">
              <num>5</num>
              <content>
                <p>The registered training organisation is taken to be an NVR registered training organisation for the period:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-2__para-a">
              <num>a</num>
              <content>
                <p>beginning on the relevant commencement day; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-b">
              <num>b</num>
              <content>
                <p>ending on the day on which:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-i">
              <num>i</num>
              <content>
                <p>the National VET Regulator notifies the organisation of its decision under the new law to grant or reject its application; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-2__para-ii">
              <num>ii</num>
              <content>
                <p>the National VET Regulator updates the National Register to record that the organisation is now registered by the National VET Regulator.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-3">
            <num>3</num>
            <heading>Registration of registered training organisations—non-referring States</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-3__subclause-1">
              <num>1</num>
              <content>
                <p>This item applies to a registered training organisation that is, immediately before commencement, registered in a non-referring State.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-3__subclause-2">
              <num>2</num>
              <content>
                <p>Before the end of 90 days beginning on commencement, the registered training organisation must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-3__para-a">
              <num>a</num>
              <content>
                <p>apply to the National VET Regulator for registration under the new law; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-b">
              <num>b</num>
              <content>
                <p>seek confirmation, in writing, from the relevant State VET Regulator that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-i">
              <num>i</num>
              <content>
                <p>the organisation’s registration has been transferred to the National VET Regulator; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-ii">
              <num>ii</num>

                <p>the National VET Regulator notifies the organisation of its decision under the new law to grant or reject its application; or</p>

            </paragraph>

              <num>ii</num>
              <content>
                <p>the National VET Regulator updates the National Register to record that the organisation is now registered by the National VET Regulator.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-4">
            <num>4</num>
            <heading>Registration of registered training organisations—Territories</heading>
            <content>
              <p>If a registered training organisation was, immediately before the relevant commencement day, registered under a Territory law, the organisation is taken to be an NVR registered training organisation for the period:</p>
              <p>whichever occurs first.</p>
              <p>Note:	An NVR registered training organisation is registered under <ref href="#sec-17">section 17</ref> of the new law.</p>
            </content>
            <paragraph eId="schedule-1__clause-4__para-a">
              <num>a</num>
              <content>
                <p>beginning on the relevant commencement day; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-4__para-b">
              <num>b</num>
              <content>
                <p>ending on the day on which:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-4__para-i">
              <num>i</num>
              <content>
                <p>the organisation’s registration would expire under the relevant Territory law but for this item; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-4__para-ii">
              <num>ii</num>
              <content>
                <p>the organisation’s registration is cancelled under subsection 39(1) of the new law; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-4__para-iii">
              <num>iii</num>
              <content>
                <p>the withdrawal of the organisation’s registration under <ref href="#sec-42">section 42</ref> of the new law takes effect;</p>
              </content>
            </paragraph>
          </hcontainer>

            <num>5</num>
            <heading>Conditions of registration etc.</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-1">
              <num>1</num>
              <content>
                <p>To avoid doubt, if a registered training organisation is taken to be an NVR registered training organisation under this Division:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5__para-a">
              <num>a</num>
              <content>
                <p>any condition imposed on the organisation or the organisation’s registration, before the relevant commencement day, requiring a fee, however described, to be paid to the relevant State, Territory or State VET Regulator continues in force as if it were a condition imposed under the new law; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-b">
              <num>b</num>
              <content>
                <p>a fee mentioned in paragraph (a) is, on and after the relevant commencement day, payable to the National VET Regulator, even if the State or Territory law that imposed the fee, or allowed such a fee to be imposed, is amended or repealed; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-c">
              <num>c</num>
              <content>
                <p>the National VET Regulator may, in accordance with the new law, impose conditions on the organisation’s registration, as if the organisation had applied for registration and the Regulator had decided to grant the application.</p>
              </content>
            </paragraph>

              <num>2</num>
              <content>
                <p>An inference that a registered training organisation complies with the VET Quality Framework is not to be made only because the organisation is taken to be an NVR registered training organisation under this Division.</p>

            <num>6</num>
            <heading>Suspension of registered training organisations</heading>
            <content>
              <p>If:</p>
              <p>the suspension continues until:</p>
              <p>Note:	A reference to a State VET Regulator includes a reference to a VET Regulator of a Territory, see subitem 1(3).</p>
            </content>
            <paragraph eId="schedule-1__clause-6__para-a">
              <num>a</num>
              <content>
                <p>a registered training organisation is taken to be an NVR registered training organisation under this Division; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-b">
              <num>b</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-i">
              <num>i</num>
              <content>
                <p>in the case of an organisation registered in a referring State or a Territory—all or part of the organisation’s scope of registration, immediately before the relevant commencement day, was suspended; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-ii">
              <num>ii</num>
              <content>
                <p>in the case of an organisation registered in a non-referring State—all or part of the organisation’s scope of registration, immediately before commencement, was suspended;</p>
              </content>
            </paragraph>

              <num>c</num>
              <content>
                <p>the National VET Regulator is satisfied that the organisation has done whatever is required for the suspension to be lifted (which may be something that was not required by the relevant State VET Regulator); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-d">
              <num>d</num>
              <content>
                <p>the National VET Regulator takes action in relation to the suspension under the new law.</p>
              </content>
            </paragraph>
          </hcontainer>

            <num>7</num>
            <heading>Pending applications for registration—referring States and Territories</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-7__subclause-1">
              <num>1</num>

                <p>If:</p>

            <paragraph eId="schedule-1__clause-7__para-a">
              <num>a</num>
              <content>
                <p>an organisation has, before the relevant commencement day, applied to a State VET Regulator of a referring State or the VET Regulator of a Territory for registration; and</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-7__para-b">
              <num>b</num>
              <content>
                <p>the State VET Regulator has not decided the application before the relevant commencement day;</p>
              </content>
            </paragraph>

              <p>then:</p>

                <p>the State VET Regulator has not decided the application before the relevant commencement day;</p>
              </content>
            </paragraph>
            <content>
              <p>then:</p>

            <heading>Extension of time for considering applications</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-11__subclause-1">
              <num>1</num>
              <content>
                <p>If the National VET Regulator is satisfied that, for reasons beyond its control, a decision cannot be made within the 6 month period mentioned in paragraph 7(1)(c), 8(1)(c), 9(1)(c) or 10(1)(c), the Regulator may determine a longer period, of no more than 6 months, within which it must make a decision on an application.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-11__subclause-2">
              <num>2</num>
              <content>
                <p>If the National VET Regulator determines a longer period, it must do so not later than 6 weeks before the expiry of the 6 month period mentioned in paragraph 7(1)(c), 8(1)(c), 9(1)(c) or 10(1)(c), whichever applies.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-11__subclause-3">
              <num>3</num>
              <content>
                <p>If the National VET Regulator determines a longer period under subitem (1), the Regulator must, <quantity refersTo="#deadline">within 7 days</quantity> of making the determination:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-11__para-a">
              <num>a</num>
              <content>
                <p>notify the organisation concerned, in writing, of the determination; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-11__para-b">
              <num>b</num>
              <content>
                <p>give, in writing, the reasons for the determination.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-11__subclause-4">

                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-11__para-a">
              <num>a</num>

                <p>a decision is not made within the 6 month period mentioned in paragraph 7(1)(c), 8(1)(c), 9(1)(c) or 10(1)(c) and the National VET Regulator does not determine a longer period; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-11__para-b">
              <num>b</num>
              <content>
                <p>the Regulator determines a longer period but does not make a decision within that period;</p>
              </content>
            </paragraph>
            <content>
              <p>the Regulator is taken to have granted the application.</p>
            </content>

              <num>5</num>
              <content>
                <p>If the National VET Regulator is taken to have granted an application, as mentioned in subitem (4), the organisation to which the application relates is taken to have been registered (including by way of a renewal of registration), for 2 years beginning on the first day after the 6 month period.</p>

                <p>An inference that an organisation complies with the VET Quality Framework is not to be made only because the organisation is taken to have been registered as an NVR registered training organisation for the period mentioned in subitem (5).</p>

            <num>12</num>
            <heading>Pending applications for change of scope of registration—referring States and Territories</heading>

                <p>This item applies to a registered training organisation that is, immediately before the relevant commencement day, registered in a referring State or a Territory.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-12__subclause-2">
              <num>2</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-12__para-a">
              <num>a</num>
              <content>
                <p>a registered training organisation has, before the relevant commencement day, applied to a State VET Regulator to change its scope of registration to include a VET course or part of a VET course; and</p>

                <p>If, immediately before the relevant commencement day, a course was accredited by:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-16__para-a">
              <num>a</num>
              <content>
                <p>the State VET Regulator of a referring State; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-16__para-b">
              <num>b</num>
              <content>
                <p>the VET Regulator of a Territory;</p>
              </content>
            </paragraph>
            <content>
              <p>the course is taken to be a VET accredited course for the period:</p>
              <p>Note:	A course is accredited as a VET accredited course under <ref href="#sec-44">section 44</ref> of the new law.</p>
            </content>
            <paragraph eId="schedule-1__clause-16__para-c">
              <num>c</num>
              <content>
                <p>beginning on the relevant commencement day; and</p>

                <p>the National VET Regulator takes action in relation to the suspension under the new law.</p>

                <p>the State VET Regulator has not decided the application before the relevant commencement day;</p>

            <num>20</num>
            <heading>Extension of time for considering applications</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-20__subclause-1">
              <num>1</num>
              <content>
                <p>If the National VET Regulator is satisfied that, for reasons beyond its control, a decision cannot be made within the 6 month period mentioned in paragraph 18(1)(c) or 19(1)(c), the Regulator may determine a longer period, of no more than 6 months, within which it must make a decision on an application.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-20__subclause-2">
              <num>2</num>
              <content>
                <p>If the National VET Regulator determines a longer period, it must do so not later than 6 weeks before the expiry of the 6 month period mentioned in paragraph 18(1)(c) or 19(1)(c), whichever applies.</p>

                <p>If the National VET Regulator determines a longer period under subitem (1), the Regulator must, <quantity refersTo="#deadline">within 7 days</quantity> of making the determination:</p>

              <content>
                <p>notify the person or entity concerned, in writing, of the determination; and</p>
              </content>

            </paragraph>

                <p>If a thing was done by, or in relation to, the State VET Regulator of a referring State under a law of the State, then the thing is taken after the relevant commencement day, to have been done by, or in relation to, the National VET Regulator.</p>

                <p>This item applies to a registered training organisation that is, immediately before the relevant commencement day, registered in a referring State or a Territory.</p>
              </content>
            </hcontainer>

              <num>2</num>
              <content>
                <p>If, before the relevant commencement day, a State VET Regulator had given a registered training organisation a show cause notice, then, <quantity refersTo="#deadline">within 60 days</quantity> after the relevant commencement day, the National VET Regulator must:</p>

            <heading>Definitions</heading>
            <content>
              <p>In this Schedule:</p>
              <p><b><i>Amending Act</i></b> means the <i>National Vocational Education and Training Regulator Amendment (Governance and Other Matters) Act 2020</i>.</p>
              <p><b><i>Chief Commissioner</i></b> has the same meaning as in the Principal Act immediately before the later commencement time.</p>
              <p><b><i>Chief Executive Officer</i></b> has the same meaning as in the Principal Act immediately before the later commencement time.</p>
              <p><b><i>Commissioner</i></b> has the same meaning as in the Principal Act immediately before the later commencement time.</p>
              <p><b><i>early commencement time</i></b> means the start of the day on which Schedule 2 to the Amending Act commences.</p>
              <p><b><i>later commencement time</i></b> means the time at which Part 1 of Schedule 1 to the Amending Act commences.</p>
              <p><b><i>National VET Regulator</i></b> has the same meaning as in the Principal Act.</p>
              <p><b><i>Principal Act</i></b> means the <i>National Vocational Education and Training Regulator Act 2011</i>.</p>
              <p><b><i>VET information</i></b> has the same meaning as in the Principal Act.</p>

          <hcontainer name="clause" eId="schedule-5__clause-2">
            <num>2</num>
            <heading>Things done by, or in relation to, a Commissioner or the Chief Executive Officer</heading>
            <hcontainer name="subclause" eId="schedule-5__clause-2__subclause-1">
              <num>1</num>
              <content>
                <p>If a thing was done by, or in relation to, a Commissioner (including the Chief Commissioner) or the Chief Executive Officer under a law of the Commonwealth before the later commencement time, then the thing is taken, at and after that time, to have been done by, or in relation to, the National VET Regulator.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-2__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, determine that subitem (1) does not apply in relation to a specified thing done by, or in relation to, a Commissioner (including the Chief Commissioner) or the Chief Executive Officer.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-2__subclause-3">
              <num>3</num>
              <content>
                <p>To avoid doubt, doing a thing includes making an instrument.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-2__subclause-4">
              <num>4</num>
              <content>
                <p>Nothing in this item produces the result that the appointment of a person as a Commissioner (including the Chief Commissioner) before the later commencement time has effect, at or after that time, as if it were an appointment of the person as the National VET Regulator.</p>

            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-5__clause-3">
            <num>3</num>
            <heading>Effect of things done by the National VET Regulator before the commencement of the Amending Act</heading>
            <content>
              <p>A thing done by, or in relation to, the National VET Regulator under a law of the Commonwealth before the later commencement time is not affected by the amendments made by Schedule 1 to the Amending Act.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-5__clause-4">
            <num>4</num>
            <heading>Consultants</heading>
            <content>
              <p>A consultant engaged under <ref href="#sec-184">section 184</ref> of the Principal Act immediately before the later commencement time is, at and after that time, taken to be engaged under <ref href="#sec-172">section 172</ref> of that Act.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-5__clause-5">
            <num>5</num>
            <heading>Unauthorised disclosure of VET information</heading>
            <content>
              <p>Despite the amendment of <ref href="#sec-204">section 204</ref> of the Principal Act by Schedule 1 to the Amending Act, that section, as in force immediately before the later commencement time, continues to apply at and after that time in relation to a person who was any of the following at any time before the later commencement time:</p>

              <num>a</num>
              <content>
                <p>a Commissioner;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-5__para-b">
              <num>b</num>
              <content>
                <p>the Chief Executive Officer;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-5__para-c">
              <num>c</num>
              <content>
                <p>a consultant engaged under <ref href="#sec-184">section 184</ref> of the Principal Act.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-5__clause-6">
            <num>6</num>
            <heading>Protections from civil actions</heading>
            <content>
              <p>Despite the amendment of <ref href="#sec-233">section 233</ref> of the Principal Act by Schedule 1 to the Amending Act, that section, as in force immediately before the later commencement time, continues to apply at and after that time in relation to a person who was a Commissioner at any time before the later commencement time.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-5__clause-7">
            <num>7</num>
            <heading>Party to pending proceedings</heading>
            <hcontainer name="subclause" eId="schedule-5__clause-7__subclause-1">
              <num>1</num>
              <content>
                <p>If, immediately before the later commencement time:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-7__para-a">
              <num>a</num>
              <content>
                <p>the National VET Regulator was a party to proceedings under the name “Australian Skills Quality Authority”; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-7__para-b">
              <num>b</num>
              <content>
                <p>the proceedings were pending in any court or tribunal;</p>
              </content>
            </paragraph>
            <content>
              <p>then, at and after the later commencement time, the National VET Regulator is taken to continue as a party to the proceedings under the name “National Vocational Education and Training Regulator”.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-5__clause-7__subclause-2">
              <num>2</num>
              <content>
                <p>However, if <role refersTo="#minister">the Minister</role> determines a different name under which the National VET Regulator is to continue as a party to the proceedings, then the Regulator is taken to continue as a party to the proceedings under that name.</p>

            </hcontainer>
            <hcontainer name="subclause" eId="schedule-5__clause-7__subclause-3">
              <num>3</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must notify the court or tribunal in writing of a determination under subitem (2).</p>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-5__clause-8">
            <num>8</num>
            <heading>Disclosure of information</heading>
            <content>
              <p>Section 210A (as inserted by Schedule 2 to the Amending Act) applies to a disclosure of information by the National Centre for Vocational Education Research at or after the early commencement time, even if the information was collected by the Centre before that time.</p>

            <heading>Application of amendments</heading>

              <p>The amendments to sections 210A and 210B of the Principal Act made by Schedule 1 to the Amending Act apply to the use, disclosure or release of information on or after the commencement time, regardless of whether the information was collected before, on or after the commencement time.</p>

            <heading>Saving of Data Provision Requirements</heading>

              <p>Requirements made under subsection 187(1) of the Principal Act that were in force immediately before the commencement time continue in force (and may be dealt with) as if they had been made under that subsection as amended by the Amending Act.</p>

              <p><b><i>first commencement time </i></b>means the time at which this Schedule commences.</p>
              <p><b><i>Principal Act</i></b> means the <i>National Vocational Education and Training Regulator Act 2011</i>.</p>
              <p><b><i>second commencement time</i></b> means the time at which Part 1 of the Amending Schedule commences.</p>

            <num>3</num>
            <heading>Application—lapse of registration</heading>
            <content>
              <p>General</p>
              <p>Lapse due before the second commencement time</p>
              <p>the organisation’s registration lapses at the second commencement time instead of the end of the measurement period (subject to <ref href="#sec-40B">section 40B</ref> of the Principal Act, as inserted by Part 1 of the Amending Schedule).</p>
              <p>Applications for extensions before the second commencement time</p>
              <p>an application by the organisation under subsection 40B(1) of the Principal Act, as inserted by Part 1 of the Amending Schedule, may be made during the period:</p>

                <p>Despite subsection 40A(2) of the Principal Act, as inserted by Part 1 of the Amending Schedule, if:</p>

              <num>a</num>
              <content>
                <p><ref href="#sec-40A">section 40A</ref> of the Principal Act, as inserted by Part 1 of the Amending Schedule, applies in relation to an NVR registered training organisation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-3__para-b">
              <num>b</num>
              <content>
                <p>the measurement period in relation to the organisation ends before the second commencement time;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-7__clause-3__subclause-3">
              <num>3</num>
              <content>
                <p>An NVR registered training organisation may, before the second commencement time, make an application for the purposes of subsection 40B(1) of the Principal Act, as inserted by Part 1 of the Amending Schedule, as if that subsection had commenced.</p>

            </hcontainer>
            <hcontainer name="subclause" eId="schedule-7__clause-3__subclause-4">
              <num>4</num>
              <content>
                <p>Subsection 40B(3) of the Principal Act, as inserted by Part 1 of the Amending Schedule, applies in relation to any application made after the second commencement time for the purposes of subsection 40B(1) of the Principal Act, as inserted by Part 1 of the Amending Schedule.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-7__clause-3__subclause-5">
              <num>5</num>
              <content>
                <p>Despite subsection 40B(2) of the Principal Act, as inserted by Part 1 of the Amending Schedule, if:</p>

              <num>a</num>
              <content>
                <p><ref href="#sec-40A">section 40A</ref> of the Principal Act, as inserted by Part 1 of the Amending Schedule, would apply in relation to an NVR registered training organisation; and</p>

            </paragraph>

              <num>6</num>
              <content>
                <p>Despite subsection 40B(2) of the Principal Act, as inserted by Part 1 of the Amending Schedule, if:</p>

            </hcontainer>
            <paragraph eId="schedule-7__clause-3__para-a">
              <num>a</num>
              <content>
                <p><ref href="#sec-40A">section 40A</ref> of the Principal Act, as inserted by Part 1 of the Amending Schedule, would apply in relation to an NVR registered training organisation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-3__para-b">
              <num>b</num>
              <content>
                <p>the measurement period in relation to the organisation would end <quantity refersTo="#deadline">within 30 days</quantity> after the second commencement time;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-3__para-c">
              <num>c</num>
              <content>
                <p>beginning at the first commencement time; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-3__para-d">
              <num>d</num>
              <content>
                <p>ending 60 days before the end of the measurement period.</p>
              </content>
            </paragraph>

                <p>For the purposes of subitems (5) and (6):</p>

                <p>The amendments of <ref href="#sec-211">section 211</ref> of the Principal Act made by Part 1 of the Amending Schedule apply in relation to any registration that ends (within the meaning given by subsection 211(2AA) of the Principal Act, as inserted by Part 1 of the Amending Schedule) at or after the second commencement time, whether the records were created before or after the second commencement time.</p>

                <b>Misdescribed amendments</b>

              <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
              <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
