            <p>		This Act may be cited as the <i>Civil Dispute Resolution Act 201</i><i>1</i><i>.</i></p>

              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <heading>Object of Act</heading>
          <content>
            <p>The object of this Act is to ensure that, as far as possible, people take genuine steps to resolve disputes before certain civil proceedings are instituted.</p>
          </content>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Genuine steps to resolve a dispute</heading>
          <subsection eId="part-1__sec-4__subsec-1A">
            <num>1A</num>
            <content>
              <p>	(1A)	For the purposes of this Act, a person takes<b><i> genuine steps to resolve a dispute</i></b> if the steps taken by the person in relation to the dispute constitute a sincere and genuine attempt to resolve the dispute, having regard to the person’s circumstances and the nature and circumstances of the dispute.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>Examples of steps that could be taken by a person as part of taking genuine steps to resolve a dispute with another person, include the following:</p>
            </content>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>notifying the other person of the issues that are, or may be, in dispute, and offering to discuss them, with a view to resolving the dispute;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>responding appropriately to any such notification;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>providing relevant information and documents to the other person to enable the other person to understand the issues involved and how the dispute might be resolved;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>considering whether the dispute could be resolved by a process facilitated by another person, including an alternative dispute resolution process;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>if such a process is agreed to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>agreeing on a particular person to facilitate the process; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>attending the process;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>if such a process is conducted but does not result in resolution of the dispute—considering a different process;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-g">
              <num>g</num>
              <content>
                <p>attempting to negotiate with the other person, with a view to resolving some or all the issues in dispute, or authorising a representative to do so.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>Subsection (1) does not limit the steps that may constitute taking genuine steps to resolve a dispute.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-applicant-in-proceedings">applicant in proceedings</term> means <def>a person who institutes the proceedings.</def></p>
            <p><term refersTo="#term-application">application</term> means <def>an application (however described) by which civil proceedings are instituted.</def></p>
            <p><term refersTo="#term-civil-penalty-provision">civil penalty provision</term> means <def>a civil penalty provision however described.</def></p>
            <p><term refersTo="#term-commonwealth-authority">Commonwealth authority</term> means <def>a body corporate established for a public purpose by or under a law of the Commonwealth.</def></p>
            <p><term refersTo="#term-eligible-court">eligible court</term> means <def>the following: the Federal Court of Australia; the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>).</def></p>

            <num>a</num>
            <content>
              <p>the Federal Court of Australia;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>).</p>
            </content>
            <content>
              <p><term refersTo="#term-excluded-proceedings">excluded proceedings</term> means <def>proceedings that are excluded proceedings under <ref href="#part-4">Part 4</ref>.</def></p>
              <p><b><i>genuine steps statement</i></b>:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>for an applicant—see <ref href="#sec-6">section 6</ref>;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>for a respondent—see <ref href="#sec-7">section 7</ref>.</p>
            </content>
            <content>
              <p><term refersTo="#term-lawyer">lawyer</term> has the same meaning as <def>in <ref href="">the Federal Court of Australia Act 1976</ref>.</def></p>
              <p><term refersTo="#term-respondent-in-proceedings">respondent in proceedings</term> means <def>a person against whom the proceedings are instituted.</def></p>

        <num>2</num>
        <heading>Obligation to take genuine steps to resolve disputes before proceedings are instituted</heading>
        <section eId="part-2__sec-6">
          <num>6</num>
          <heading>Genuine steps statement to be filed by applicant</heading>
          <subsection eId="part-2__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>An applicant who institutes civil proceedings in an eligible court must file a genuine steps statement at the time of filing the application.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>A genuine steps statement filed under subsection (1) must specify:</p>
            </content>
            <paragraph eId="part-2__sec-6__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the steps that have been taken to try to resolve the issues in dispute between the applicant and the respondent in the proceedings; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the reasons why no such steps were taken, which may relate to, but are not limited to the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>the urgency of the proceedings;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>whether, and the extent to which, the safety or security of any person or property would have been compromised by taking such steps.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-3">
            <num>3</num>
            <content>
              <p>A genuine steps statement need not be filed under subsection (1) in relation to proceedings that are wholly excluded proceedings.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-6__subsec-4">
            <num>4</num>
            <content>
              <p>A genuine steps statement must be filed under subsection (1) in relation to proceedings that are in part excluded proceedings, but the statement need not relate to the parts of the proceedings that are excluded proceedings.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-7">
          <num>7</num>
          <heading>Genuine steps statement to be filed by respondent</heading>
          <subsection eId="part-2__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>A respondent in proceedings who is given a copy of a genuine steps statement filed by an applicant in the proceedings must file a genuine steps statement before the hearing date specified in the application.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>A genuine steps statement filed under subsection (1) must:</p>
            </content>
            <paragraph eId="part-2__sec-7__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>state that the respondent agrees with the genuine steps statement filed by the applicant; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>if the respondent disagrees in whole or part with the genuine steps statement filed by the applicant—specify the respect in which, and reasons why, the respondent disagrees.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-8">
          <num>8</num>
          <heading>Genuine steps statements must comply with Rules of Court</heading>
          <content>
            <p>A genuine steps statement must comply with any additional requirements specified in the Rules of Court of the eligible court (see <ref href="#sec-18">section 18</ref>) in which the statement is filed.</p>
          </content>
        </section>
        <section eId="part-2__sec-9">
          <num>9</num>
          <heading>Duty of lawyers to advise people of the requirements of this Act</heading>
          <content>
            <p>A lawyer acting for a person who is required to file a genuine steps statement must:</p>
          </content>
          <paragraph eId="part-2__sec-9__para-a">
            <num>a</num>
            <content>
              <p>advise the person of the requirement; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-9__para-b">
            <num>b</num>
            <content>
              <p>assist the person to comply with the requirement.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-10">
          <num>10</num>
          <heading>Effect of requirements of this Part</heading>
          <subsection eId="part-2__sec-10__subsec-1">
            <num>1</num>
            <content>
              <p>The requirements of this Part are in addition to, and not instead of, requirements imposed by any other Act.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-10__subsec-2">
            <num>2</num>
            <content>
              <p>A failure to file a genuine steps statement in proceedings does not invalidate the application instituting the proceedings, a response to such an application or the proceedings.</p>
            </content>
          </subsection>
        </section>
      </part>
      <part eId="part-3">
        <num>3</num>
        <heading>Powers of court</heading>
        <section eId="part-3__sec-11">
          <num>11</num>
          <heading>Court may have regard to genuine steps requirements in exercising powers and performing functions</heading>
          <content>
            <p>An eligible court may, in performing functions or exercising powers in relation to civil proceedings before it, take account of the following:</p>
          </content>
          <paragraph eId="part-3__sec-11__para-a">
            <num>a</num>
            <content>
              <p>whether a person who was required to file a genuine steps statement under <ref href="#part-2">Part 2</ref> in the proceedings filed such a statement;</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-11__para-b">
            <num>b</num>
            <content>
              <p>whether such a person took genuine steps to resolve the dispute.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-3__sec-12">
          <num>12</num>
          <heading>Exercising discretion to award costs</heading>
          <subsection eId="part-3__sec-12__subsec-1">
            <num>1</num>
            <content>
              <p>In exercising a discretion to award costs in a civil proceeding in an eligible court, the court, Judge or other person exercising the discretion may take account of:</p>
            </content>
            <paragraph eId="part-3__sec-12__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>whether a person who was required to file a genuine steps statement under <ref href="#part-2">Part 2</ref> in the proceedings filed such a statement; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>whether such a person took genuine steps to resolve the dispute.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-2">
            <num>2</num>
            <content>
              <p>In exercising a discretion to award costs in a civil proceeding in an eligible court, the court, Judge or other person exercising the discretion may take account of any failure by a lawyer to comply with the duty imposed by <ref href="#sec-9">section 9</ref>.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-12__subsec-3">
            <num>3</num>
            <content>
              <p>If a lawyer is ordered to bear costs personally because of a failure to comply with <ref href="#sec-9">section 9</ref>, the lawyer must not recover the costs from the lawyer’s client.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-13">
          <num>13</num>
          <heading>Powers are in addition to powers under other Acts</heading>
          <content>
            <p>The powers conferred on an eligible court under this Part are in addition to any other powers of the court, whether conferred by this Act or otherwise.</p>
          </content>
        </section>
      </part>
      <part eId="part-4">
        <num>4</num>
        <heading>Exclusions</heading>
        <section eId="part-4__sec-15">
          <num>15</num>
          <heading>Proceedings of certain kinds are excluded proceedings</heading>
          <content>
            <p>		Proceedings are <b><i>excluded proceedings</i></b> to the extent that they are any of the following:</p>
          </content>
          <paragraph eId="part-4__sec-15__para-a">
            <num>a</num>
            <content>
              <p>proceedings for an order imposing a pecuniary penalty for a contravention of a civil penalty provision;</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-15__para-b">
            <num>b</num>
            <content>
              <p>proceedings brought by or on behalf of the Commonwealth or a Commonwealth authority for an order connected with:</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-15__para-i">
            <num>i</num>
            <content>
              <p>a criminal offence or the possible commission of a criminal offence; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-15__para-ii">
            <num>ii</num>
            <content>
              <p>a contravention or possible contravention of a civil penalty provision;</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-15__para-c">
            <num>c</num>
            <content>
              <p>proceedings that relate to a decision of, or a decision that has been subject to review by:</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-15__para-i">
            <num>i</num>
            <content>
              <p>the Administrative Review Tribunal;</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-15__para-ii">
            <num>ii</num>
            <content>
              <p>the Australian Competition Tribunal;</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-15__para-iii">
            <num>iii</num>
            <content>
              <p>the Copyright Tribunal of Australia;</p>
            </content>

          <heading>Proceedings under certain Acts are excluded proceedings</heading>

          <heading>Proceedings prescribed by the regulations are excluded proceedings</heading>

              <p>	(1)	Proceedings are <b><i>excluded proceedings</i></b> to the extent that they are proceedings prescribed by the regulations for the purposes of this subsection.</p>

          </subsection>
          <subsection eId="part-4__sec-17__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	Regulations made for the purposes of subsection (1)<b><i> </i></b>may specify proceedings in any way including, but not limited to, by reference to the following:</p>

              <num>a</num>
              <content>
                <p>the nature of the proceedings;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-2__para-b">

                <p>the subject matter of the proceedings;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the Act or regulations, or provision of an Act or regulations, under which the proceedings arise.</p>

            </paragraph>

        <heading>Other matters</heading>
        <section eId="part-5__sec-17A">
          <num>17A</num>
          <heading>Act does not exclude or limit law relating to disclosure of information, etc.</heading>

            <p>To avoid doubt, this Act does not exclude or limit the operation of a law of the Commonwealth, a law of a State or Territory, or the common law (including the rules of equity), relating to the use or disclosure of information, the production of documents or the admissibility of evidence.</p>

          <num>18</num>
          <heading>Rules of Court</heading>
          <content>
            <p>		Rules of Court made under the <i>Federal Court of Australia Act 1976</i> or Chapter 4 of the <i>Federal Circuit and Family Court of Australia Act 2021</i><i> </i>may make provision for or in relation to the following:</p>

              <p>the form of genuine steps statements;</p>
            </content>
          </paragraph>

          <paragraph eId="part-5__sec-18__para-c">
            <num>c</num>
            <content>
              <p>time limits relating to the provision of copies of genuine steps statements.</p>

          <heading>Regulations</heading>

            <p>The Governor-General may make regulations prescribing matters:</p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
              <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
