              <p>	(1)	The main objects of this Act, when read together with <i>Competition and Consumer Act 2010</i>, are as follows:<ref href="#part-XI">Part XI</ref>C of the </p>

                <p>to provide a regulatory framework for NBN corporations that promotes the long-term interests of end-users of carriage services or of services provided by means of carriage services;</p>

                <p>to ensure that NBN Co remains in Commonwealth ownership.</p>

          <num>4</num>
          <heading>Simplified outline</heading>
          <content>
            <p>The following is a simplified outline of this Act:</p>
            <p>•	An NBN corporation must not supply an eligible service to another person unless the other person is:</p>
          </content>

            <num>a</num>
            <content>
              <p>a carrier; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">

              <p>•	An NBN corporation may be required to prepare, and comply with, a functional separation undertaking.</p>
              <p>•	The Communications Minister may give directions about the divestiture of assets of an NBN corporation.</p>
              <p>•	A condition of a carrier licence held by an NBN corporation may require the NBN corporation to supply a specified carriage service.</p>
              <p>•	A condition of a carrier licence held by an NBN corporation may prohibit the NBN corporation from supplying a specified carriage service.</p>
              <p>•	Under provisions called the Commonwealth ownership provisions, the Commonwealth must retain ownership of NBN Co.</p>

          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-accc">ACCC</term> means <def>the Australian Competition and Consumer Commission.</def></p>
            <p><b><i>Australia</i></b>, when used in a geographical sense, includes the external Territories.</p>
            <p><term refersTo="#term-authority">authority</term> includes <def>the following: a Department of the government of the Commonwealth; a Department of the government of a State; a Department of the government of a Territory.</def></p>

            <num>a</num>
            <content>
              <p>a Department of the government of the Commonwealth;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>

          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>a Department of the government of a Territory.</p>

            <content>
              <p><term refersTo="#term-bank">bank</term> has the same meaning as <def>in the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><term refersTo="#term-board">Board</term> means <def>the board of directors of NBN Co.</def></p>
              <p><term refersTo="#term-business-unit">business unit</term> means <def>a part of the NBN corporation.</def></p>
              <p><term refersTo="#term-carriage-service">carriage service</term> has the same meaning as <def>in <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-carrier">carrier</term> has the same meaning as <def>in <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-carrier-licence">carrier licence</term> has the same meaning as <def>in <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-carry">carry</term> has the same meaning as <def>in <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-charge">charge</term> has the same meaning as <def>in <ref href="">the Corporations Act 2001</ref>.</def></p>
              <p><term refersTo="#term-commonwealth-ownership-provisions">Commonwealth ownership provisions</term> means <def>sections 45 and 46.</def></p>
              <p><term refersTo="#term-communications">communications</term> has the same meaning as <def>in <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-communications-minister">Communications Minister</term> means <def>the Minister who administers this Act.</def></p>
              <p><b><i>constitution</i></b>, in relation to NBN Co, has the same meaning as in the <i>Corporations Act 2001</i>.</p>
              <p><term refersTo="#term-constitutional-corporation">constitutional corporation</term> means <def>a corporation to which paragraph 51(xx) of the Constitution applies.</def></p>
              <p><term refersTo="#term-content-service">content service</term> has the same meaning as <def>in <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-debenture">debenture</term> has the same meaning as <def>in <ref href="">the Corporations Act 2001</ref>.</def></p>
              <p><term refersTo="#term-declared-service">declared service</term> has the same meaning as <def>in <ref href="#part-XI">Part XI</ref>C of <ref href="">the Competition and Consumer Act 2010</ref>.</def></p>
              <p><term refersTo="#term-department-of-finance">Department of Finance</term> means <def>the Department administered by the Finance Minister.</def></p>
              <p><term refersTo="#term-draft-functional-separation-undertaking">draft functional separation undertaking</term> means <def>a draft functional separation undertaking under <ref href="#dvs-3">Division 3</ref> of <ref href="#part-2">Part 2</ref>.</def></p>
              <p><term refersTo="#term-electricity-supply-body">electricity supply body</term> means <def>an authority, or a body corporate, that carries on a business, or performs a function, of: generating, transmitting, distributing or supplying electricity; or managing the generation, transmission, distribution or supply of electricity.</def></p>

            <num>a</num>

              <p>generating, transmitting, distributing or supplying electricity; or</p>

              <p><term refersTo="#term-eligible-service">eligible service</term> has the same meaning as <def>in <ref href="#sec-152A">section 152A</ref>L of <ref href="">the Competition and Consumer Act 2010</ref>.</def></p>
              <p><b><i>engage in conduct</i></b> means:</p>

              <p>do an act; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">

              <p>omit to perform an act.</p>

            <content>
              <p><term refersTo="#term-federal-court">Federal Court</term> means <def>the Federal Court of Australia.</def></p>
              <p><term refersTo="#term-final-functional-separation-undertaking">final functional separation undertaking</term> means <def>a final functional separation undertaking under <ref href="#dvs-3">Division 3</ref> of <ref href="#part-2">Part 2</ref>.</def></p>
              <p><term refersTo="#term-finance-minister">Finance Minister</term> means <def>the Minister who administers the Public Governance, Performance and Accountability Act 2013.</def></p>
              <p><term refersTo="#term-functional">functional</term> includes <def>organisational.</def></p>
              <p><term refersTo="#term-functional-separation-principles">functional separation principles</term> has the meaning given by <def>subsection 24(1).</def></p>
              <p><term refersTo="#term-functional-separation-requirements-determination">functional separation requirements determination</term> means <def>a determination under subsection 25(1).</def></p>
              <p><term refersTo="#term-gas-supply-body">gas supply body</term> means <def>an authority, or a body corporate, that carries on a business, or performs a function, of: transmitting, distributing or supplying natural gas; or managing the transmission, distribution or supply of natural gas.</def></p>

            <content>
              <p><term refersTo="#term-listed-carriage-service">listed carriage service</term> has the same meaning as <def>in <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-national-broadband-network">national broadband network</term> means <def>a national telecommunications network for the high-speed carriage of communications, where an NBN corporation has been, is, or is to be, involved in the creation or development of the network. To avoid doubt, it is immaterial whether the creation or development of the network is, to any extent, attributable to: the acquisition of assets that were used, or for use, in connection with another telecommunications network; or the obtaining of access to assets that are also used, or for use, in connection with another telecommunications network.</def></p>

          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>the acquisition of assets that were used, or for use, in connection with another telecommunications network; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>the obtaining of access to assets that are also used, or for use, in connection with another telecommunications network.</p>
            </content>
            <content>
              <p><term refersTo="#term-nbn-co">NBN Co</term> means <def>NBN Co Limited (ACN 136 533 741), as the company exists from time to time (even if its name is later changed).</def></p>
              <p><term refersTo="#term-nbn-corporation">NBN corporation</term> has the meaning given by <def>clause 1 of Schedule 1.</def></p>
              <p><term refersTo="#term-nbn-tasmania">NBN Tasmania</term> means <def>NBN Tasmania Limited (ACN 138 338 271), as the company exists from time to time (even if its name is later changed).</def></p>
              <p><term refersTo="#term-non-communications-service">non-communications service</term> means <def>a service other than: an eligible service; or a content service; or a service that is ancillary or incidental to the supply by an NBN corporation of an eligible service; or an advisory or consulting service that relates to: the supply of an eligible service; or goods for use in connection with the supply of an eligible service; or 	(iii)	facilities (within the meaning of the <i>Telecommunications Act 1997</i>); or the provision, grant or conferral (whether by way of a licence or otherwise) of intellectual property rights that relate to: the supply of an eligible service; or goods for use in connection with the supply of an eligible service; or 	(iii)	facilities (within the meaning of the <i>Telecommunications Act 1997</i>).</def></p>

              <p>an eligible service; or</p>

          <paragraph eId="part-1__sec-5__para-ii">
            <num>ii</num>
            <content>
              <p>goods for use in connection with the supply of an eligible service; or</p>

          </paragraph>
          <paragraph eId="part-1__sec-5__para-iii">
            <num>iii</num>
            <content>
              <p>	(iii)	facilities (within the meaning of the <i>Telecommunications Act 1997</i>); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-e">
            <num>e</num>
            <content>
              <p>the provision, grant or conferral (whether by way of a licence or otherwise) of intellectual property rights that relate to:</p>
            </content>
          </paragraph>

              <p>the supply of an eligible service; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-ii">
            <num>ii</num>

              <p>goods for use in connection with the supply of an eligible service; or</p>

          </paragraph>
          <paragraph eId="part-1__sec-5__para-iii">
            <num>iii</num>
            <content>
              <p>	(iii)	facilities (within the meaning of the <i>Telecommunications Act 1997</i>).</p>
            </content>
            <content>
              <p><term refersTo="#term-rail-corporation">rail corporation</term> means <def>a body corporate that manages or operates either or both of the following: rail transport services; rail transport infrastructure.</def></p>

              <p>rail transport services;</p>
            </content>
          </paragraph>

              <p><term refersTo="#term-retail-carriage-service-provider">retail carriage service provider</term> means <def>a carriage service provider who supplies a listed carriage service to another person who is neither: a carrier; nor a service provider. <b><i>securities</i></b> includes: shares; and debentures.</def></p>

              <p>a carrier; nor</p>

              <p><b><i>securities</i></b> includes:</p>

          </paragraph>

            <num>b</num>

              <p>debentures.</p>

              <p><term refersTo="#term-service-provider">service provider</term> has the same meaning as <def>in <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-sewerage-services-body">sewerage services body</term> means <def>an authority, or a body corporate, that carries on a business, or performs a function, of supplying sewerage services.</def></p>
              <p><term refersTo="#term-state-or-territory-road-authority">State or Territory road authority</term> means <def>an authority that has responsibility for the management, regulation or control of motor traffic in a State or Territory.</def></p>
              <p><term refersTo="#term-storm-water-drainage-services">storm water drainage services</term> means <def>services that consist of draining storm water.</def></p>
              <p><term refersTo="#term-storm-water-drainage-services-body">storm water drainage services body</term> means <def>an authority, or a body corporate, that carries on a business, or performs a function, of supplying storm water drainage services.</def></p>
              <p><term refersTo="#term-telecommunications-market">telecommunications market</term> has the same meaning as <def>in <ref href="#part-XI">Part XI</ref>B of <ref href="">the Competition and Consumer Act 2010</ref>.</def></p>
              <p><term refersTo="#term-telecommunications-network">telecommunications network</term> has the same meaning as <def>in <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-telecommunications-transmission-tower">telecommunications transmission tower</term> has the same meaning as <def>in <ref href="#part-5">Part 5</ref> of Schedule 1 to <ref href="">the Telecommunications Act 1997</ref>.</def></p>
              <p><term refersTo="#term-voting-share">voting share</term> has the same meaning as <def>in <ref href="">the Corporations Act 2001</ref>.</def></p>
              <p><term refersTo="#term-water-supply-body">water supply body</term> means <def>an authority, or a body corporate, that carries on a business, or performs a function, of supplying water.</def></p>

          <heading>Crown to be bound</heading>
          <subsection eId="part-1__sec-6__subsec-1">

              <p>This Act binds the Crown in each of its capacities.</p>

            <num>2</num>
            <content>
              <p>This Act does not make the Crown liable to a pecuniary penalty or to be prosecuted for an offence.</p>

          </subsection>

              <p>The protection in subsection (2) does not apply to an authority of the Crown.</p>

                  <p>bus or other road services of a kind provided by <role refersTo="#authority">the authority</role>;</p>

                  <p>tram services of a kind provided by <role refersTo="#authority">the authority</role>; or</p>

                  <p>the eligible service is a service that facilitates the supply of a carriage service covered by paragraph (a) of this subsection.</p>

                  <p>the eligible service is a service that facilitates the supply of a carriage service covered by paragraph (a) of this subsection.</p>

            <subsection eId="part-2__dvs-2__sec-10__subsec-4">

                <p>Paragraph (3)(a) does not apply to a carriage service supplied to a rail corporation unless the carriage service is supplied on the basis that the rail corporation must not re-supply the carriage service.</p>

            <heading>Exemption—electricity supply bodies</heading>

                  <p>the eligible service is a carriage service, and the sole use of the carriage service is use by an electricity supply body to carry communications necessary or desirable for:</p>

              <paragraph eId="part-2__dvs-2__sec-11__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>managing the generation, transmission, distribution or supply of electricity; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>charging for the supply of electricity; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the eligible service is a service that facilitates the supply of a carriage service covered by paragraph (a) of this section.</p>
                </content>
              </paragraph>
            </subsection>

                <p>Paragraph (1)(a) does not apply to a carriage service supplied to an electricity supply body unless the carriage service is supplied on the basis that the electricity supply body must not re-supply the carriage service.</p>

            <heading>Exemption—gas supply bodies</heading>

                  <p>managing the transmission or distribution of natural gas in a pipeline; or</p>
                </content>

                <num>ii</num>

                  <p>charging for the supply of natural gas transmitted or distributed in a pipeline; or</p>
                </content>
              </paragraph>

                  <p>the eligible service is a service that facilitates the supply of a carriage service covered by paragraph (a) of this section.</p>

                <p>Paragraph (1)(a) does not apply to a carriage service supplied to a gas supply body unless the carriage service is supplied on the basis that the gas supply body must not re-supply the carriage service.</p>

            <heading>Exemption—water supply bodies</heading>

                  <p>managing the distribution of water in a pipeline; or</p>
                </content>

                  <p>charging for the supply of water distributed in a pipeline; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-1__para-b">

                  <p>the eligible service is a service that facilitates the supply of a carriage service covered by paragraph (a) of this section.</p>
                </content>
              </paragraph>
            </subsection>

                <p>Paragraph (1)(a) does not apply to a carriage service supplied to a water supply body unless the carriage service is supplied on the basis that the water supply body must not re-supply the carriage service.</p>

            <heading>Exemption—sewerage services bodies</heading>

                  <p>charging for the supply of sewerage services; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-14__subsec-1__para-b">

                  <p>the eligible service is a service that facilitates the supply of a carriage service covered by paragraph (a) of this section.</p>

              </paragraph>
            </subsection>

                <p>Paragraph (1)(a) does not apply to a carriage service supplied to a sewerage services body unless the carriage service is supplied on the basis that the sewerage services body must not re-supply the carriage service.</p>

            <heading>Exemption—storm water drainage services bodies</heading>

                <content>
                  <p>managing the supply of storm water drainage services; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-15__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>charging for the supply of storm water drainage services; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-15__subsec-1__para-b">
                <num>b</num>

                  <p>the eligible service is a service that facilitates the supply of a carriage service covered by paragraph (a) of this section.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-15__subsec-2">

                <p>Paragraph (1)(a) does not apply to a carriage service supplied to a storm water drainage services body unless the carriage service is supplied on the basis that the storm water drainage services body must not re-supply the carriage service.</p>

            <heading>Exemption—State or Territory road authorities</heading>

                  <p>the eligible service is a service that facilitates the supply of a carriage service covered by paragraph (a) of this section.</p>

                <p>Paragraph (1)(a) does not apply to a carriage service supplied to a State or Territory road authority unless the carriage service is supplied on the basis that the State or Territory road authority must not re-supply the carriage service.</p>

                <p>Subdivision B—Supply of other goods and services</p>

            <heading>Content services not to be supplied</heading>

              <p>An NBN corporation must not supply a content service to another person.</p>
            </content>
          </section>

            <heading>Non-communications services not to be supplied</heading>
            <content>
              <p>An NBN corporation must not supply a non-communications service to another person.</p>
            </content>
          </section>
          <section eId="part-2__dvs-2__sec-19">
            <num>19</num>
            <heading>Non-communications goods not to be supplied</heading>
            <content>
              <p>An NBN corporation must not supply goods to another person unless:</p>
            </content>
            <paragraph eId="part-2__dvs-2__sec-19__para-a">
              <num>a</num>
              <content>
                <p>the goods are for use in connection with the supply, or prospective supply, of an eligible service by the NBN corporation; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-2__sec-19__para-b">
              <num>b</num>
              <content>
                <p>the NBN corporation did not obtain the goods for the purpose of supplying the goods; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-2__sec-19__para-c">
              <num>c</num>
              <content>
                <p>the NBN corporation:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-2__sec-19__para-i">
              <num>i</num>
              <content>
                <p>obtained the goods for the purpose of supplying the goods in connection with the supply, or prospective supply, of an eligible service by the NBN corporation; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-2__sec-19__para-ii">
              <num>ii</num>
              <content>
                <p>considers the goods to be excess to the NBN corporation’s requirements.</p>
              </content>
              <content>
                <p>Subdivision BA—Access to a telecommunications transmission tower owned or operated by an NBN corporation etc.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-2__dvs-2__sec-19A">
            <num>19A</num>
            <heading>Access to a telecommunications transmission tower</heading>
            <subsection eId="part-2__dvs-2__sec-19A__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	If a telecommunications transmission tower (the <b><i>first tower</i></b>) is owned or operated by an NBN corporation, the NBN corporation must, if requested to do so by an eligible person, give the eligible person access to the first tower if:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the access is for the sole purpose of enabling the eligible person to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>install particular equipment on the first tower; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>maintain, operate or remove particular equipment installed by the eligible person on the first tower; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>in a case where subparagraph (a)(i) applies—the NBN corporation is satisfied that the installation of the equipment is technically feasible; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>in a case where:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>subparagraph (a)(i) applies; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>there is another telecommunications transmission tower in the vicinity of the first tower that is not owned or operated by the NBN corporation;</p>
                </content>
                <content>
                  <p>the NBN corporation is reasonably satisfied that it would not be reasonable for the eligible person to install the equipment on the other tower.</p>
                  <p>Exemptions from sections 9, 18 and 19</p>

                  <p>the giving of access; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-2__para-b">

                  <p>the supply to the eligible person of goods that are incidental to the giving of access.</p>
                </content>
                <content>
                  <p>Limits on subsection (1) obligation</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-19A__subsec-3">
              <num>3</num>
              <content>
                <p>Subsection (1) does not impose an obligation to the extent (if any) to which the imposition of the obligation would have any of the following effects:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>preventing an NBN corporation from reserving sufficient space on the first tower to be able to meet the NBN corporation’s reasonably anticipated requirements in relation to the installation of equipment, measured at the time when the request was made;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>preventing a person (other than an NBN corporation) who has already installed equipment on the first tower from obtaining access to sufficient space on the first tower to be able to meet the person’s reasonably anticipated requirements in relation to the installation of equipment, measured at the time when the request was made;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>depriving any person of a protected contractual right.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-19A__subsec-4">
              <num>4</num>
              <content>
                <p>	(4)	For the purposes of paragraph (3)(c), <b><i>protected contractual right</i></b> means a right under a contract that was in force at the commencement of this section.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-19A__subsec-5">
              <num>5</num>
              <content>
                <p>Subsection (1) does not impose an obligation to give an eligible person access to the first tower if:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>the eligible person is included in a class of persons specified under paragraph 19H(2)(a); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>the imposition of the obligation would be inconsistent with a limitation or restriction that, under paragraph 19H(2)(b), is applicable to that class.</p>
                </content>
                <content>
                  <p>Exemption from compliance with subsection (1)—Ministerial determination</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-19A__subsec-6">
              <num>6</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, determine that subsection (1) does not impose an obligation if the conditions specified in the determination are satisfied.</p>
              </content>
              <content>
                <p>Technically feasible</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-19A__subsec-7">
              <num>7</num>
              <content>
                <p>For the purposes of this section, in determining whether it is technically feasible to install particular equipment on a telecommunications transmission tower, an NBN corporation must have regard to:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-7__para-a">
                <num>a</num>
                <content>
                  <p>whether the installation of the equipment is likely to result in significant difficulties of a technical or engineering nature; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-7__para-b">
                <num>b</num>
                <content>
                  <p>whether the installation of the equipment is likely to result in a significant threat to the health or safety of persons who operate, or work on, the tower; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-7__para-c">
                <num>c</num>
                <content>
                  <p>if the installation of the equipment is likely to have a result referred to in paragraph (a) or (b)—whether there are practicable means of avoiding such a result, including (but not limited to):</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-7__para-i">
                <num>i</num>
                <content>
                  <p>changing the configuration or operating parameters of a facility situated on the tower; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-7__para-ii">
                <num>ii</num>
                <content>
                  <p>making alterations to the tower; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19A__subsec-7__para-d">
                <num>d</num>
                <content>
                  <p>such other matters (if any) as are relevant.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-19A__subsec-8">

                <p>	(8)	For the purposes of subsection (7), <b><i>facility</i></b><i> </i>has the same meaning as in the <i>Telecommunications Act 1997</i>.</p>

            <heading>Access to the site of a telecommunications transmission tower</heading>
            <subsection eId="part-2__dvs-2__sec-19B__subsec-1">

              <paragraph eId="part-2__dvs-2__sec-19B__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a telecommunications transmission tower owned or operated by an NBN corporation is situated on a particular site, and:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19B__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>the site is owned, occupied or controlled by the NBN corporation; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19B__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>the NBN corporation has a right (whether conditional or unconditional) to use the site; and</p>

                  <p>the NBN corporation is or was required by subsection 19A(1) to give an eligible person access to the tower for the purpose of enabling the eligible person to:</p>

                <num>i</num>
                <content>
                  <p>install particular equipment on the tower; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19B__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>maintain, operate or remove particular equipment installed by the eligible person on the tower;</p>
                </content>
                <content>
                  <p>the NBN corporation must, if requested to do so by the eligible person:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19B__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>give the eligible person access to the site for the sole purpose of enabling the eligible person to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19B__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>install the equipment on the tower; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19B__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>maintain, operate or remove the equipment installed by the eligible person on the tower; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19B__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>give the eligible person access to the site for the sole purpose of enabling the eligible person to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19B__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>install particular equipment on the site, where that equipment is for use in connection with the equipment mentioned in paragraph (b); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19B__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>maintain, operate or remove the equipment first mentioned in subparagraph (i).</p>
                </content>

                  <p>the giving of access; or</p>
                </content>
              </paragraph>

                  <p>the supply to the eligible person of goods that are incidental to the giving of access.</p>
                </content>
                <content>
                  <p>Exemption from compliance with subsection (1)—Ministerial determination</p>

                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, determine that subsection (1) does not impose an obligation if the conditions specified in the determination are satisfied.</p>

            <heading>Reasonableness—Ministerial determinations</heading>
            <subsection eId="part-2__dvs-2__sec-19C__subsec-1">
              <num>1</num>

                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-19C__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>determine that, if a condition specified in the determination is satisfied then, for the purposes of paragraph 19A(1)(c), it is taken to be reasonable for an eligible person to install equipment on a telecommunications transmission tower; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19C__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>determine that, if a condition specified in the determination is satisfied then, for the purposes of paragraph 19A(1)(c), it is taken not to be reasonable for an eligible person to install equipment on a telecommunications transmission tower.</p>

            <heading>Publication of access terms and conditions—towers</heading>

                <p>If a telecommunications transmission tower is owned or operated by an NBN corporation, the NBN corporation must publish on its website:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the terms and conditions relating to price or a method of ascertaining price; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>other terms and conditions;</p>
                </content>
                <content>
                  <p>on which the NBN corporation offers to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>give an eligible person access to the tower, in compliance with subsection 19A(1), for the purpose of enabling the eligible person to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>install particular equipment; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-1__para-ii">

                  <p>maintain, operate or remove particular equipment; and</p>
                </content>
              </paragraph>

                  <p>give the eligible person access to the tower; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-2__para-ii">

                  <p>supply to the eligible person goods that are incidental to giving the eligible person access to the tower; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-2__para-c">
                <num>c</num>

                  <p>as a result of the request, the NBN corporation has an obligation under subsection 19A(1) to give access to the tower or supply the goods, as the case requires; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>in accordance with subsection (1), the NBN corporation has published on its website:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>the terms and conditions relating to price or a method of ascertaining price; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>other terms and conditions;</p>
                </content>
                <content>
                  <p>on which the NBN corporation offers to give access to the tower or supply the goods, as the case requires; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-2__para-e">
                <num>e</num>
                <content>
                  <p>the eligible person requests the NBN corporation to enter into an agreement that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>relates to the access to the tower or the supply of the goods, as the case requires; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>sets out terms and conditions that are the same as the terms and conditions published as mentioned in paragraph (d);</p>
                </content>
                <content>
                  <p>the NBN corporation must comply with the request mentioned in paragraph (e).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-19D__subsec-3">
              <num>3</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>a telecommunications transmission tower is owned or operated by an NBN corporation; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>an eligible person requests the NBN corporation to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-3__para-i">
                <num>i</num>
                <content>
                  <p>give the eligible person access to the tower; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-3__para-ii">
                <num>ii</num>
                <content>
                  <p>supply to the eligible person goods that are incidental to giving the eligible person access to the tower; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>as a result of the request, the NBN corporation has an obligation under subsection 19A(1) to give access to the tower or supply the goods, as the case requires; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19D__subsec-3__para-d">
                <num>d</num>
                <content>
                  <p>the access to the tower, or the supply of the goods, is not covered by an agreement between the NBN corporation and the eligible person;</p>
                </content>
                <content>
                  <p>the terms and conditions on which the access is given, or the goods are supplied, as the case may be, are the terms and conditions that were published on the NBN corporation’s website, in accordance with subsection (1), at the time when the request was made.</p>
                </content>
              </paragraph>
            </subsection>
          </section>

            <num>19E</num>
            <heading>Publication of access terms and conditions—sites</heading>

                  <p>a telecommunications transmission tower owned or operated by an NBN corporation is situated on a particular site; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>either:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>the site is owned, occupied or controlled by the NBN corporation; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>the NBN corporation has a right (whether conditional or unconditional) to use the site;</p>
                </content>
                <content>
                  <p>the NBN corporation must cause to be published on its website:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the terms and conditions relating to price or a method of ascertaining price; and</p>
                </content>
              </paragraph>

                  <p>other terms and conditions;</p>
                </content>
                <content>
                  <p>on which it offers to:</p>
                </content>
              </paragraph>

                  <p>give an eligible person access to the site, in compliance with subsection 19B(1), for the purpose of enabling the eligible person to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>install particular equipment; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>maintain, operate or remove particular equipment; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-1__para-f">

                  <p>an eligible person requests the NBN corporation to:</p>

                  <p>give the eligible person access to the site; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-2__para-ii">

                  <p>supply to the eligible person goods that are incidental to giving the eligible person access to the site; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-2__para-d">

                  <p>as a result of the request, the NBN corporation has an obligation under subsection 19B(1) to give access to the site or supply the goods, as the case requires; and</p>

                <num>e</num>
                <content>
                  <p>in accordance with subsection (1), the NBN corporation has published on its website:</p>

                  <p>the terms and conditions relating to price or a method of ascertaining price; and</p>

                  <p>on which the NBN corporation offers to give access to the site or supply the goods, as the case requires; and</p>

                <num>f</num>
                <content>
                  <p>the eligible person requests the NBN corporation to enter into an agreement that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>relates to the access to the site or the supply of the goods, as the case requires; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>sets out terms and conditions that are the same as the terms and conditions published as mentioned in paragraph (e);</p>
                </content>
                <content>
                  <p>the NBN corporation must comply with the request mentioned in paragraph (f).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-19E__subsec-3">
              <num>3</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>a telecommunications transmission tower owned or operated by an NBN corporation is situated on a particular site; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>either:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-3__para-i">
                <num>i</num>
                <content>
                  <p>the site is owned, occupied or controlled by the NBN corporation; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-3__para-ii">
                <num>ii</num>
                <content>
                  <p>the NBN corporation has a right (whether conditional or unconditional) to use the site; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>an eligible person requests the NBN corporation to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-3__para-i">
                <num>i</num>
                <content>
                  <p>	(i)	give the eligible<b> </b>person access to the site; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-3__para-ii">
                <num>ii</num>
                <content>
                  <p>supply to the eligible person goods that are incidental to giving the eligible person access to the site; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-3__para-d">
                <num>d</num>
                <content>
                  <p>as a result of the request, the NBN corporation has an obligation under subsection 19B(1) to give access to the site or supply the goods, as the case requires; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19E__subsec-3__para-e">
                <num>e</num>
                <content>
                  <p>the access to the site, or the supply of the goods, is not covered by an agreement between the NBN corporation and the eligible person;</p>
                </content>
                <content>
                  <p>the terms and conditions on which the access is given, or the goods are supplied, as the case may be, are the terms and conditions that were published on the NBN corporation’s website, in accordance with subsection (1), at the time when the request was made.</p>
                </content>
              </paragraph>
            </subsection>

            <heading>Terms and conditions of access to be on a non-discriminatory basis</heading>
            <content>
              <p>Telecommunications transmission towers</p>
            </content>
            <subsection eId="part-2__dvs-2__sec-19F__subsec-1">
              <num>1</num>
              <content>
                <p>If a telecommunications transmission tower is owned or operated by an NBN corporation, the NBN corporation must not, in determining:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-19F__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the terms and conditions relating to price or a method of ascertaining price; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19F__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>other terms and conditions;</p>
                </content>
                <content>
                  <p>on which the NBN corporation:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19F__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>gives an eligible person access to the tower, in compliance with subsection 19A(1), for the purpose of enabling the eligible person to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19F__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>install particular equipment; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19F__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>maintain, operate or remove particular equipment; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19F__subsec-1__para-d">

                  <p>supplies to an eligible person goods that are incidental to the giving of that access;</p>
                </content>

                  <p>discriminate between eligible persons who seek or obtain access in such circumstances.</p>

                  <p>the terms and conditions relating to price or a method of ascertaining price; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19F__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>other terms and conditions;</p>
                </content>
                <content>
                  <p>on which the NBN corporation:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19F__subsec-2__para-e">
                <num>e</num>
                <content>
                  <p>gives an eligible person access to the site, in compliance with subsection 19B(1), for the purpose of enabling the eligible person to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19F__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>install particular equipment; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19F__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>maintain, operate or remove particular equipment; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19F__subsec-2__para-f">
                <num>f</num>
                <content>
                  <p>supplies to an eligible person goods that are incidental to the giving of that access;</p>
                </content>
                <content>
                  <p>discriminate between eligible persons who seek or obtain access in such circumstances.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-19G">
            <num>19G</num>
            <heading>Equipment</heading>
            <subsection eId="part-2__dvs-2__sec-19G__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	For the purposes of this Subdivision, <b><i>equipment</i></b> means:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-19G__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	a facility (within the meaning of the <i>Telecommunications Act 1997</i>); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19G__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>an antenna; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19G__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>a measuring device; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19G__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>an apparatus; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19G__subsec-1__para-e">
                <num>e</num>
                <content>
                  <p>a thing that belongs to a class of things specified under subsection (2).</p>
                </content>
              </paragraph>
            </subsection>

                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, specify one or more classes of things for the purposes of paragraph (1)(e).</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-19H">
            <num>19H</num>
            <heading>Eligible person</heading>
            <subsection eId="part-2__dvs-2__sec-19H__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	For the purposes of this Subdivision, <b><i>eligible person</i></b> means:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-19H__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a police force or service; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19H__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a fire service; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19H__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>an ambulance service; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19H__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>a State or Territory emergency services organisation; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19H__subsec-1__para-e">
                <num>e</num>
                <content>
                  <p>a person who is included in a class of persons specified under paragraph (2)(a).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-19H__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, do any or all of the following:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-19H__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>specify one or more classes of persons for the purposes of paragraph (1)(e);</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-19H__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>for a class specified under paragraph (a)—declare that one or more specified limitations or restrictions are applicable to that class for the purposes of subsection 19A(5).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-19H__subsec-3">
              <num>3</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must not make a legislative instrument under subsection (2) unless <role refersTo="#minister">the Minister</role> is satisfied that it is in the public interest to do so.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-19H__subsec-4">
              <num>4</num>
              <content>
                <p>	(4)	Before making a legislative instrument under subsection (2), the Minister must consult the Minister who administers the <i>Australian Federal Police Act 1979</i>.</p>

            </subsection>

            <heading>Site</heading>
            <content>
              <p>		For the purposes of this Subdivision, <b><i>site</i></b> means:</p>
            </content>

              <num>a</num>

                <p>land; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-2__sec-19J__para-b">
              <num>b</num>
              <content>
                <p>a building on land; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-2__sec-19J__para-c">
              <num>c</num>
              <content>
                <p>a structure on land.</p>
              </content>
            </paragraph>

              <p>		For the purposes of this Subdivision, <b><i>goods</i></b> includes electricity.</p>
              <p>Subdivision C—Investment activities</p>
            </content>
          </section>

            <num>20</num>
            <heading>Restriction of investment activities</heading>
            <subsection eId="part-2__dvs-2__sec-20__subsec-1">
              <num>1</num>
              <content>
                <p>An NBN corporation must not invest money of the NBN corporation unless:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-20__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the investment is related to the supply, or prospective supply, of eligible services by the NBN corporation; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-20__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>both:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-20__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>the investment is related to the supply, or prospective supply, of goods; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-20__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>the goods are for use in connection with the supply, or prospective supply, of an eligible service by the NBN corporation; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-20__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>both:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-20__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>the investment is in shares in a company; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-20__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>the company carries on, proposes to carry on, or has the object of carrying on, a business that consists of or includes the supply of a carriage service; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-20__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>the investment is:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-20__subsec-1__para-i">

                  <p>an investment in securities of the Commonwealth or of a State or Territory; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-20__subsec-1__para-ii">

                  <p>an investment in securities guaranteed by the Commonwealth, a State or a Territory; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-20__subsec-1__para-iii">

                  <p>a deposit with a bank, including a deposit evidenced by a certificate of deposit; or</p>
                </content>
              </paragraph>

                  <p>	(iv)	any other form of investment prescribed by rules made for the purposes of subparagraph 58(8)(a)(iii) of the <i>Public Governance, Performance and Accountability Act 2013</i> (section 58 of that Act deals with investment by the Commonwealth).</p>

                  <p>	(b)	immediately before the start time, the company has an obligation (the <b><i>pre</i></b><b><i>-</i></b><b><i>existing obligation</i></b>) under a contract to:</p>

                <p>A draft or final functional separation undertaking given by an NBN corporation must:</p>

                  <p>comply with the functional separation principles that are applicable to the NBN corporation; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-23__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>comply with such requirements as are specified in a functional separation requirements determination that is applicable to the NBN corporation.</p>

            <heading>Functional separation principles</heading>

                <p>	(1)	The Communications Minister and the Finance Minister may, by writing, determine that specified principles are <b><i>functional separation principles</i></b> for the purposes of the application of this Act to a specified NBN corporation.</p>

                  <p>the principle that the NBN corporation should maintain arm’s length functional separation between the specified business units; and</p>

                  <p>	(c)	the principle that the NBN corporation should have<i> </i>systems, procedures and practices that relate to:</p>

                  <p>compliance with a final functional separation undertaking given by the NBN corporation; and</p>
                </content>
              </paragraph>

                  <p>monitoring of, and reporting on, compliance with the final functional separation undertaking; and</p>
                </content>
              </paragraph>

                  <p>the development of performance measures relating to compliance with the final functional separation undertaking; and</p>
                </content>
              </paragraph>

                  <p>independent audit, and other checks, of compliance with the final functional separation undertaking.</p>

                <p>	(1)	The Communications Minister and the Finance Minister may make a written determination (a <b><i>functional separation requirements determination</i></b>) specifying requirements to be complied with by a draft or final functional separation undertaking given by a specified NBN corporation.</p>

              <num>2</num>
              <content>
                <p>A functional separation requirements determination may deal with the manner in which the functional separation principles are to be implemented.</p>
              </content>
            </subsection>

                <p>Subsection (2) does not limit subsection (1).</p>
              </content>
            </subsection>

                <p>The Communications Minister and the Finance Minister must ensure that a functional separation requirements determination relating to an NBN corporation comes into force <quantity refersTo="#deadline">within 90 days</quantity> after the first or only determination is made under subsection 24(1) in relation to the NBN corporation.</p>

                <p>An NBN corporation must give the Communications Minister and the Finance Minister a draft functional separation undertaking:</p>
              </content>

                  <p><quantity refersTo="#deadline">within 90 days</quantity> after the first or only functional separation requirements determination in relation to the NBN corporation comes into force; or</p>
                </content>
              </paragraph>

                <num>b</num>
                <content>
                  <p>if a longer period is specified in an instrument under subsection (2)—within that longer period.</p>
                </content>
              </paragraph>

                <p>The Communications Minister and the Finance Minister may, by writing, specify a period for the purposes of paragraph (1)(b).</p>

                <p>The Communications Minister and the Finance Minister may, by writing, vary a subsection (2) instrument.</p>

                <p>A period specified in a subsection (2) instrument may be a period ascertained wholly or partly by reference to the occurrence of a specified event.</p>

                <p>The Communications Minister and the Finance Minister must cause a copy of an instrument under subsection (2) or (3) to be published on the Department’s website.</p>

            <heading>Approval of draft functional separation undertaking by the Communications Minister and the Finance Minister</heading>

              <num>1</num>

                <p>	(1)	This section applies if an NBN corporation gives the Communications Minister and the Finance Minister a draft functional separation undertaking (the <b><i>original undertaking</i></b>).</p>

              <num>2</num>
              <content>
                <p>The Communications Minister and the Finance Minister must, by writing:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-27__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>approve the original undertaking; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-27__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>both:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-27__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>vary the original undertaking; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-27__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>approve the original undertaking as varied; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-27__subsec-2__para-c">
                <num>c</num>

                  <p>both:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-27__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>	(i)	determine that the NBN corporation is taken to have given the Communications Minister and the Finance Minister another draft functional separation undertaking (the <b><i>replacement undertaking</i></b>) in the terms specified in the determination, instead of the original undertaking; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-27__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>approve the replacement undertaking.</p>
                </content>
                <content>
                  <p>Consultation</p>

            </subsection>

              <num>3</num>
              <content>
                <p>Before making a decision under subsection (2), the Communications Minister and the Finance Minister must:</p>
              </content>

                <num>a</num>
                <content>
                  <p>cause to be published on the Department’s website a notice:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-27__subsec-3__para-i">
                <num>i</num>
                <content>
                  <p>setting out the original undertaking; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-27__subsec-3__para-ii">
                <num>ii</num>

                  <p>inviting persons to make submissions to the Communications Minister and the Finance Minister about the original undertaking <quantity refersTo="#deadline">within 14 days</quantity> after the notice is published; and</p>
                </content>
              </paragraph>

                <num>b</num>
                <content>
                  <p>give the ACCC a copy of the notice; and</p>
                </content>
              </paragraph>

                  <p>cause to be published on the Department’s website a copy of each submission received within the 14-day period mentioned in paragraph (a); and</p>

                  <p>consider any submissions received within the 14-day period mentioned in paragraph (a); and</p>

                  <p>have regard to any advice given by the ACCC.</p>

                <p>Before making a decision under paragraph (2)(b) to approve the original undertaking as varied, the Communications Minister and the Finance Minister must:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-27__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>give the NBN corporation a notice:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-27__subsec-4__para-i">
                <num>i</num>
                <content>
                  <p>setting out the original undertaking as proposed to be varied; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-27__subsec-4__para-ii">
                <num>ii</num>
                <content>
                  <p>inviting the NBN corporation to make submissions to the Communications Minister and the Finance Minister, <quantity refersTo="#deadline">within 14 days</quantity> after the notice is given, about the original undertaking as proposed to be varied; and</p>

                  <p>consider any submissions received from the NBN corporation within the 14-day period mentioned in paragraph (a).</p>

                  <p>Consultation—replacement undertaking</p>

            </subsection>

              <num>5</num>
              <content>
                <p>Before making a decision under paragraph (2)(c) to approve the replacement undertaking, the Communications Minister and the Finance Minister must:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-27__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>give the NBN corporation a notice:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-27__subsec-5__para-i">
                <num>i</num>
                <content>
                  <p>setting out the proposed replacement undertaking; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-27__subsec-5__para-ii">
                <num>ii</num>
                <content>
                  <p>inviting the NBN corporation to make submissions to the Communications Minister and the Finance Minister about the proposed replacement undertaking <quantity refersTo="#deadline">within 14 days</quantity> after the notice is given; and</p>
                </content>
              </paragraph>

                <num>b</num>
                <content>
                  <p>consider any submissions received from the NBN corporation within the 14-day period mentioned in paragraph (a).</p>

                <p>Subsection (3) does not, by implication, prevent the Communications Minister and the Finance Minister from asking the ACCC to give the Communications Minister and the Finance Minister additional advice about a matter arising under this section.</p>

                <p>Notification of decision</p>

                <p>As soon as practicable after making a decision under subsection (2), the Communications Minister and the Finance Minister must notify the NBN corporation in writing of the decision.</p>

            <heading>Time limit for making an approval decision</heading>

                <p>	(1)	This section applies if an NBN corporation gives the Communications Minister and the Finance Minister a draft functional separation undertaking (the <b><i>original undertaking</i></b>).</p>

                <p>The Communications Minister and the Finance Minister must use their best endeavours to make a decision under subsection 27(2) in relation to the original undertaking <quantity refersTo="#deadline">within 6 months</quantity> after the original undertaking was given to the Communications Minister and the Finance Minister.</p>

            <heading>Effect of approval</heading>
            <subsection eId="part-2__dvs-3__sec-29__subsec-1">

                <p>If the Communications Minister and the Finance Minister approve a draft functional separation undertaking under subsection 27(2), the undertaking becomes a final functional separation undertaking.</p>
              </content>

                <p>A final functional separation undertaking given by an NBN corporation comes into force on the day after notice of the relevant decision is given to the NBN corporation in accordance with subsection 27(7).</p>

                <p>This section applies if a final functional separation undertaking given by an NBN corporation is in force.</p>

            </subsection>

                <p>The Communications Minister and the Finance Minister may, in writing, vary the final functional separation undertaking:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-30__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>at the request of the NBN corporation or another person; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-30__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>on the initiative of the Communications Minister and the Finance Minister.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-30__subsec-3">
              <num>3</num>
              <content>
                <p>The Communications Minister and the Finance Minister do not have a duty to consider whether to exercise the power to vary a final functional separation undertaking, whether they are requested to do so by the NBN corporation or by any other person, or in any other circumstances.</p>

              <num>4</num>
              <content>
                <p>Before varying a final functional separation undertaking, the Communications Minister and the Finance Minister must:</p>

              <paragraph eId="part-2__dvs-3__sec-30__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>cause to be published on the Department’s website a notice:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-30__subsec-4__para-i">
                <num>i</num>
                <content>
                  <p>setting out the proposed variation; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-30__subsec-4__para-ii">
                <num>ii</num>
                <content>
                  <p>inviting persons to make submissions to the Communications Minister and the Finance Minister about the proposed variation <quantity refersTo="#deadline">within 14 days</quantity> after the notice is published; and</p>

                  <p>is not made at the request of the NBN corporation;</p>

                  <p>then, before making the proposed variation, the Communications Minister and the Finance Minister must:</p>

                  <p>give the NBN corporation a notice:</p>
                </content>

              </paragraph>

                <p>As soon as practicable after a final functional separation undertaking given by an NBN corporation comes into force, the NBN corporation must make a copy of the undertaking available on the NBN corporation’s website.</p>

                <p>As soon as practicable after a variation of a final functional separation undertaking given by an NBN corporation comes into force, the NBN corporation must make a copy of the varied final functional separation undertaking available on the NBN corporation’s website.</p>

            <heading>Directions about disposal of assets</heading>

              <num>1</num>
              <content>
                <p>The Communications Minister and the Finance Minister may, by written notice given to an NBN corporation:</p>
              </content>
              <paragraph eId="part-2__dvs-4__sec-33__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>direct the NBN corporation:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-33__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>to dispose of one or more specified assets of the NBN corporation (otherwise than by transferring the asset to another NBN corporation); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-33__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>to do so within the period specified in the notice; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-33__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>give such other directions to the NBN corporation as the Communications Minister and the Finance Minister consider necessary for the purposes of securing the disposal.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-4__sec-33__subsec-2">
              <num>2</num>
              <content>
                <p>In deciding whether to give a direction under subsection (1), the Communications Minister and the Finance Minister must have regard to the following:</p>
              </content>
              <paragraph eId="part-2__dvs-4__sec-33__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>whether the direction will promote the long-term interests of end-users of carriage services or of services provided by means of carriage services;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-33__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if the Communications Minister and the Finance Minister have required the ACCC under <ref href="#sec-35">section 35</ref> to give advice about the giving of the direction—the advice given in compliance with the requirement;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-33__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>such other matters (if any) as the Communications Minister and the Finance Minister consider relevant.</p>

                <p>An NBN corporation must comply with a direction under subsection (1) that is applicable to the NBN corporation.</p>

                <p>A direction under subsection (1) is not a legislative instrument.</p>

            </subsection>

            <heading>Directions about transfer of assets to another NBN corporation</heading>
            <subsection eId="part-2__dvs-4__sec-34__subsec-1">
              <num>1</num>
              <content>
                <p>The Communications Minister and the Finance Minister may:</p>
              </content>
              <paragraph eId="part-2__dvs-4__sec-34__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	by written notice given to an NBN corporation (the <b><i>transferor</i></b>), direct the transferor:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-34__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>	(i)	to transfer one or more specified assets of the transferor to another NBN corporation specified in the notice (the <b><i>transferee</i></b>); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-34__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>to do so within the period specified in the notice; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-34__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>by written notice given to the transferor or the transferee, give such other directions to the transferor or transferee as the Communications Minister and the Finance Minister consider necessary for the purposes of securing the transfer.</p>

          <heading>Promotion of the long-term interests of end-users of carriage services and of services supplied by means of carriage services</heading>

            <p>		For the purposes of this Act, the question whether a particular thing promotes the long-term interests of end-users of carriage services or of services supplied by means of carriage services is to be determined in the same manner as it is determined for the purposes of <i>Competition and Consumer Act 2010</i>.<ref href="#part-XI">Part XI</ref>C of the </p>
          </content>
        </section>
        <section eId="part-7__sec-95">
          <num>95</num>
          <heading>NBN Co is not a public authority</heading>
          <content>
            <p>NBN Co is taken for the purposes of the laws of the Commonwealth, of a State or of a Territory:</p>
          </content>
          <paragraph eId="part-7__sec-95__para-a">
            <num>a</num>
            <content>
              <p>not to have been incorporated or established for a public purpose or for a purpose of the Commonwealth; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-95__para-b">
            <num>b</num>
            <content>
              <p>not to be a public authority or an instrumentality or agency of the Crown (however described); and</p>
            </content>
          </paragraph>
          <paragraph eId="part-7__sec-95__para-c">
            <num>c</num>
            <content>
              <p>not to be entitled to any immunity or privilege of the Commonwealth;</p>
            </content>
            <content>
              <p>except so far as express provision is made by this Act or any other law of the Commonwealth, or by a law of a State or of a Territory, as the case may be.</p>

          <heading>Public Works Committee Act</heading>
          <content>
            <p>		The <i>Public Works Committee Act 1969</i> does not apply to an NBN corporation.</p>

          <num>97</num>
          <heading>Winding-up of NBN corporation not prevented by this Act</heading>
          <content>
            <p>		This Act does not, by implication, prevent an NBN corporation being wound up in accordance with the <i>Corporations Act 2001</i>.</p>

        </section>
        <section eId="part-7__sec-98">
          <num>98</num>
          <heading>Rights of NBN corporation’s shareholders, debenture holders and creditors to be subject to this Act</heading>
          <content>
            <p>The rights of an NBN corporation’s shareholders, debenture holders and creditors are subject to this Act.</p>
          </content>
        </section>
        <section eId="part-7__sec-98A">
          <num>98A</num>
          <heading>Exemption from stamp duty—matters related to the creation, development or operation of the national broadband network</heading>
          <subsection eId="part-7__sec-98A__subsec-1">
            <num>1</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>category A designated matter</i></b> means any of the following matters:</p>
            </content>
            <paragraph eId="part-7__sec-98A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an action taken by Telstra to cease to supply fixed-line carriage services to customers using a telecommunications network over which Telstra is in a position to exercise control, where:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98A__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>	(i)	under <i>Telecommunications Act 1997</i>, the action is authorised for the purposes of subsection 51(1) of the <i>Competition and Consumer Act 2010</i>; and<ref href="#sec-577B">section 577B</ref>A of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98A__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>the cessation relates to the creation, development or operation of the national broadband network;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	an action taken by Telstra to commence to supply fixed-line carriage services to customers using the national broadband network, where, under <i>Telecommunications Act 1997</i>, the action is authorised for the purposes of subsection 51(1) of the <i>Competition and Consumer Act 2010</i>;<ref href="#sec-577B">section 577B</ref>A of the </p>

            </paragraph>

              <num>c</num>

                <p>the receipt of money by a person in respect of a matter covered by paragraph (a) or (b);</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98A__subsec-1__para-d">

                <p>an agreement that:</p>

            </paragraph>

                <p>		where, at the time when the agreement is entered into, an undertaking is in force under <i>Telecommunications Act 1997</i>;<ref href="#sec-577A">section 577A</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98A__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>an agreement that:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98A__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>is between Telstra and an NBN corporation; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98A__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>relates to a matter covered by paragraph (a) or (b);</p>
              </content>
              <content>
                <p>		where the operative provisions of the agreement are subject to a condition precedent, namely, the coming into force of an undertaking under <i>Telecommunications Act 1997</i>.<ref href="#sec-577A">section 577A</ref> of the </p>
                <p><b><i>category B designated matter</i></b> means any of the following matters:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the transfer, from Telstra to an NBN corporation, of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98A__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>a conduit, wire or cable; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98A__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>any equipment, apparatus or other thing used, or for use, in or in connection with a conduit, wire or cable;</p>
              </content>
              <content>
                <p>where:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98A__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>	(iii)	under <i>Telecommunications Act 1997</i>, the transfer is authorised for the purposes of subsection 51(1) of the <i>Competition and Consumer Act 2010</i>; and<ref href="#sec-577B">section 577B</ref>A of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98A__subsec-1__para-iv">
              <num>iv</num>
              <content>
                <p>the transfer relates to the creation, development or operation of the national broadband network;</p>

            </paragraph>

                <p>the giving to an NBN corporation, by Telstra, of access to a facility owned or operated by Telstra, where:</p>

            </paragraph>

              <num>i</num>
              <content>
                <p>	(i)	under <i>Telecommunications Act 1997</i>, the giving of the access is authorised for the purposes of subsection 51(1) of the <i>Competition and Consumer Act 2010</i>; and<ref href="#sec-577B">section 577B</ref>A of the </p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98A__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>the access relates to the creation, development or operation of the national broadband network;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98A__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the giving to an NBN corporation, by Telstra, of access to a site:</p>
              </content>
            </paragraph>

                <p>owned, occupied or controlled by Telstra; and</p>
              </content>
            </paragraph>

                <p>on which there is, or is proposed to be, situated a facility;</p>

                <p>where:</p>
              </content>
            </paragraph>

              <num>ii</num>

              <num>e</num>
              <content>
                <p>the receipt of money by a person in respect of a matter covered by paragraph (a), (b), (c) or (d);</p>

            </paragraph>

                <p>the boundaries and identification code for the national broadband network serving area module;</p>
              </content>

                <p>the dominant technology type of connections to the national broadband network within the national broadband network serving area module;</p>
              </content>
            </paragraph>

                <p>the date on which the majority of premises within the national broadband network serving area module were declared ready for service by NBN Co; and</p>
              </content>
            </paragraph>

              <p><role refersTo="#secretary">The Secretary</role> may, by written notice given to NBN Co, direct NBN Co to:</p>

                <p>provide to <role refersTo="#secretary">the Secretary</role> the following mapping data about relevant premises connected, or due to be connected, to the national broadband network:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>the geographical location of the relevant premises;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>the address of the relevant premises;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>the technology type of the connection to the national broadband network of the relevant premises; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>do so <quantity refersTo="#deadline">within 30 days</quantity> after the Secretary gives the direction to NBN Co.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-98B__subsec-2A">
            <num>2A</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, by written notice given to NBN Co, direct NBN Co to:</p>
            </content>
            <paragraph eId="part-7__sec-98B__subsec-2A__para-a">
              <num>a</num>
              <content>
                <p>provide to <role refersTo="#secretary">the Secretary</role> the following mapping data about each national broadband network serving area module:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-2A__para-i">
              <num>i</num>
              <content>
                <p>the boundaries and identification code for the national broadband network serving area module;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-2A__para-ii">
              <num>ii</num>
              <content>
                <p>the dominant technology type of connections to the national broadband network within the national broadband network serving area module;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-2A__para-iii">
              <num>iii</num>
              <content>
                <p>the date on which the majority of premises within the national broadband network serving area module were declared ready for service by NBN Co; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-2A__para-b">
              <num>b</num>
              <content>
                <p>do so <quantity refersTo="#deadline">within 90 days</quantity> after the Secretary gives the direction to NBN Co.</p>
              </content>

                <p>Form of mapping data etc.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-98B__subsec-3">
            <num>3</num>
            <content>
              <p>Mapping data provided under subsection (1), (1A), (2) or (2A) must be in a form that allows separate maps to be produced for each technology type of connection to the national broadband network.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-98B__subsec-4">
            <num>4</num>
            <content>
              <p><quantity refersTo="#deadline">Within 14 days</quantity> after the commencement of this section, the Secretary must, by written notice given to NBN Co, direct NBN Co to ensure that mapping data provided by NBN Co under subsection (1) or (1A) complies with specified requirements in relation to any or all of the following matters:</p>

              <num>a</num>
              <content>
                <p>file format or formats;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-4__para-b">

                <p>mapping specifications;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>any other matter that relates to the form of the mapping data.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-98B__subsec-5">
            <num>5</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, by written notice given to NBN Co, direct NBN Co to ensure that mapping data provided by NBN Co under subsection (2) or (2A) complies with specified requirements in relation to any or all of the following matters:</p>
            </content>

              <num>a</num>
              <content>
                <p>file format or formats;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-5__para-b">
              <num>b</num>

                <p>mapping specifications;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-5__para-c">
              <num>c</num>
              <content>
                <p>any other matter that relates to the form of the mapping data.</p>

                <p>Compliance with directions</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-98B__subsec-6">
            <num>6</num>
            <content>
              <p>NBN Co must comply with a direction given by <role refersTo="#secretary">the Secretary</role> under subsection (2), (2A), (4) or (5).</p>
            </content>
            <content>
              <p>Publication of mapping data</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-98B__subsec-7">
            <num>7</num>
            <content>
              <p>Before the end of the 60-day period beginning when this section commences, <role refersTo="#secretary">the Secretary</role> must arrange for mapping data provided under subsection (1) to be published electronically in colour-coded format.</p>

              <p>In this section:</p>

              <p><b><i>national broadband network serving area module</i></b> means a geographical region within NBN Co’s fixed-line footprint which includes premises that are:</p>
            </content>
            <paragraph eId="part-7__sec-98B__subsec-8__para-a">
              <num>a</num>
              <content>
                <p>connected to the national broadband network; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-8__para-b">
              <num>b</num>
              <content>
                <p>served by any of the following technology types of connection to the national broadband network:</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-8__para-i">
              <num>i</num>
              <content>
                <p>fibre to the building;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-8__para-ii">
              <num>ii</num>
              <content>
                <p>fibre to the premises;</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-8__para-iii">
              <num>iii</num>
              <content>
                <p>fibre to the node;</p>
              </content>
            </paragraph>

                <p>fibre to the curb;</p>

                <p><b><i>relevant premises</i></b> means:</p>

                <p><b><i>Secretary</i></b> means the Secretary of the Department.</p>

                <p>fibre to the premises; or</p>

            <paragraph eId="part-7__sec-98B__subsec-8__para-d">
              <num>d</num>
              <content>
                <p>HFC; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-8__para-e">
              <num>e</num>
              <content>
                <p>fixed wireless; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-98B__subsec-8__para-f">
              <num>f</num>

                <p>satellite; or</p>

          <heading>Delegation</heading>

              <p>The Communications Minister may, by writing, delegate to:</p>
            </content>
            <paragraph eId="part-7__sec-99__subsec-1__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> of the Department; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-99__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an SES employee, or acting SES employee, in the Department;</p>
              </content>
              <content>
                <p>all or any of the Communications Minister’s powers and functions under this Act.</p>
              </content>
            </paragraph>
          </subsection>

            <num>2</num>
            <content>
              <p>The Finance Minister may, by writing, delegate to:</p>
            </content>
            <paragraph eId="part-7__sec-99__subsec-2__para-a">
              <num>a</num>

                <p><role refersTo="#secretary">the Secretary</role> of the Department of Finance; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-99__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>an SES employee, or acting SES employee, in the Department of Finance;</p>
              </content>
              <content>
                <p>all or any of the Finance Minister’s powers and functions under this Act.</p>

            </paragraph>
          </subsection>
        </section>

          <num>100</num>
          <heading>Compensation for acquisition of property</heading>
          <content>
            <p>General</p>
          </content>
          <subsection eId="part-7__sec-100__subsec-1">
            <num>1</num>
            <content>
              <p>If the operation of this Act (other than <ref href="#sec-34">section 34</ref>) or the regulations would result in an acquisition of property from a person otherwise than on just terms, the Commonwealth is liable to pay a reasonable amount of compensation to the person.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-100__subsec-2">
            <num>2</num>
            <content>
              <p>If the Commonwealth and the person do not agree on the amount of the compensation, the person may institute proceedings in the Federal Court for the recovery from the Commonwealth of such reasonable amount of compensation as the Court determines.</p>
            </content>
            <content>
              <p>Direction to transfer asset</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-100__subsec-3">
            <num>3</num>
            <content>
              <p>If the operation of <ref href="#sec-34">section 34</ref> in relation to the transfer of an asset to the transferee mentioned in that section would result in an acquisition of property from a person otherwise than on just terms, the transferee is liable to pay a reasonable amount of compensation to the person.</p>

            <num>4</num>

          <heading>Regulations</heading>

            <p>The Governor-General may make regulations prescribing matters:</p>

              <p>required or permitted by this Act to be prescribed; or</p>
            </content>
          </paragraph>

                <p>if any other conditions are specified in the regulations—those conditions are satisfied;</p>

            </paragraph>

              <p>the company is taken not to be an NBN corporation during the period:</p>

            <heading>Control of a company</heading>

                <p>	(1)	For the purposes of this Schedule, the question of whether a person is in a position to exercise control of a company is to be determined under Schedule 1 to the <i>Broadcasting Services Act 1992</i>.</p>
