            <p>		These Regulations are the <i>Autonomous Sanctions </i><i>Regulations 2</i><i>011</i>.</p>
          </content>

        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Definitions</heading>
          <content>
            <p>In these Regulations:</p>
            <p><term refersTo="#term-act">Act</term> means <def><ref href="">the Autonomous Sanctions Act 2011</ref>.</def></p>
            <p><term refersTo="#term-afp">AFP</term> means <def>the Australian Federal Police.</def></p>
            <p><term refersTo="#term-arms-or-related-mat-riel">arms or related matériel</term> includes <def>any of the following: weapons; ammunition; military vehicles and equipment; spare parts and accessories for the things mentioned in paragraphs (a) to (c); paramilitary equipment.</def></p>

              <p>weapons;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>ammunition;</p>

          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>military vehicles and equipment;</p>

              <p>spare parts and accessories for the things mentioned in paragraphs (a) to (c);</p>

              <p>paramilitary equipment.</p>
            </content>
            <content>
              <p><term refersTo="#term-authorised-commercial-activity">authorised commercial activity</term> means <def>a sanctioned commercial activity authorised by a permit granted under paragraph 18(1)(c).</def></p>
              <p><term refersTo="#term-authorised-import">authorised import</term> means <def>a sanctioned import authorised by a permit granted under paragraph 18(1)(b).</def></p>
              <p><term refersTo="#term-authorised-service">authorised service</term> means <def>a sanctioned service authorised by a permit granted under regulation 18.</def></p>
              <p><term refersTo="#term-authorised-supply">authorised supply</term> means <def>a sanctioned supply authorised by a permit granted under regulation 18.</def></p>
              <p><b><i>bribery</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>the promise, offering or giving, to a foreign public official, directly or indirectly, of an undue advantage, for the official or another person or entity, in order that the official act or refrain from acting in a particular way in the exercise of the official’s official duties; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>the solicitation or acceptance by a foreign public official, directly or indirectly, of an undue advantage, for the official or another person or entity, in order that the official act or refrain from acting in a particular way in the exercise of the official’s official duties.</p>
            </content>
            <content>
              <p><b><i>brokering services</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>the negotiation or arrangement of transactions for the purchase, sale or supply of goods and technology or of financial and technical services, including from a third country to any other third country; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>the selling or buying of goods and technology or of financial and technical services, including where they are located in third countries for their transfer to another third country.</p>
            </content>
            <content>
              <p><term refersTo="#term-commencement-day">commencement day</term> means <def>the day on which these Regulations commence.</def></p>
              <p><term refersTo="#term-controlled-asset">controlled asset</term> means <def>an asset owned or controlled by a designated person or entity.</def></p>
              <p><b><i>correspondent banking relationship</i></b> has the meaning given in section 5 of the <i>Anti</i><i>-</i><i>Money Laundering and Counter</i><i>-</i><i>Terrorism Financing Act 2006</i>.</p>
              <p><b><i>corruption</i></b> means:</p>

          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>bribery; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>misappropriation of property.</p>
            </content>
            <content>
              <p><term refersTo="#term-designated-asset">designated asset</term> means <def>a controlled asset to which a designation relates under regulation 7.</def></p>
              <p><term refersTo="#term-designated-person-or-entity">designated person or entity</term> means <def>a person or entity that has been designated under paragraph 6(a) or 6A(1)(a), (2)(a), (4)(a), (5)(a), (8)(a) or (9)(a).</def></p>
              <p><term refersTo="#term-dprk">DPRK</term> means <def>the Democratic People’s Republic of Korea.</def></p>
              <p><term refersTo="#term-dprk-person-or-entity">DPRK person or entity</term> means <def>any of the following: the government of the DPRK; the Workers’ Party of Korea; the Korean People’s Army; a public body, corporation or agency of the DPRK; an entity formed or incorporated in the DPRK; an official of an entity referred to in paragraph (a), (b), (c), (d) or (e); an individual who is in, or a resident of, the DPRK.</def></p>
            </content>

                <p>Note:	A person may also be declared under paragraph 6(b) or 6A(1)(b), (2)(b), (4)(b), (5)(b), (8)(b) or (9)(b) for the purpose of preventing the person from travelling to, entering or remaining in Australia.</p>

          </paragraph>

            <num>a</num>
            <content>
              <p>the government of the DPRK;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>the Workers’ Party of Korea;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>the Korean People’s Army;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-d">
            <num>d</num>
            <content>
              <p>a public body, corporation or agency of the DPRK;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-e">
            <num>e</num>
            <content>
              <p>an entity formed or incorporated in the DPRK;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-f">
            <num>f</num>
            <content>
              <p>an official of an entity referred to in paragraph (a), (b), (c), (d) or (e);</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-g">
            <num>g</num>
            <content>
              <p>an individual who is in, or a resident of, the DPRK.</p>
            </content>
            <content>
              <p><b><i>export sanctioned goods</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>the goods in the table in subregulation 4(2); and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>goods designated under subregulation 4(3).</p>
            </content>
            <content>
              <p><term refersTo="#term-extractive-or-related-industry">extractive or related industry</term> means <def>an industry engaged in any of the following: extracting raw materials from the earth; exploring or prospecting for raw materials to be extracted from the earth; refining or processing raw materials extracted from the earth.</def></p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-a">
            <num>a</num>
            <content>
              <p>extracting raw materials from the earth;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>exploring or prospecting for raw materials to be extracted from the earth;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>refining or processing raw materials extracted from the earth.</p>
            </content>
            <content>
              <p><term refersTo="#term-ffry">FFRY</term> means <def>the former Federal Republic of Yugoslavia.</def></p>
              <p><term refersTo="#term-financial-institution">financial institution</term> means <def>a natural or legal person that conducts, as a business, one or more of the following for, or on behalf of, a customer: the acceptance of deposits and other repayable funds from the public; the lending of money; financial leasing, other than the financial leasing of a consumer product; the transfer of money or value, other than the provision of message or other support for the purpose of transmitting money; the issue and management of means of payment; the giving of financial guarantees and commitments; trading in money market instruments; trading foreign exchange; trading in exchange instruments; trading in interest rate instruments; trading in interest index instruments; trading in transferable securities; trading in commodity futures; participation in the issue of securities and the provision of financial services in relation to the issue of securities; the management of individual or collective portfolios; the safekeeping and administration of cash or liquid securities; the investment, administration or management of funds or money; the underwriting and placement of life insurance and other insurance that is related to investments; money changing and other currency changing. 1	Credit and debit cards. 2	Cheques. 3	Travellers’ cheques. 4	Money orders. 5	Bankers’ drafts. 6	Electronic money. <b><i>financial service</i></b> includes: an investment service; and a service providing financial advice; and a brokering service; and insurance; and reinsurance; and financial derivatives.</def></p>

            <num>a</num>
            <content>
              <p>the acceptance of deposits and other repayable funds from the public;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>the lending of money;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>financial leasing, other than the financial leasing of a consumer product;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-d">
            <num>d</num>
            <content>
              <p>the transfer of money or value, other than the provision of message or other support for the purpose of transmitting money;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-e">
            <num>e</num>
            <content>
              <p>the issue and management of means of payment;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-f">
            <num>f</num>
            <content>
              <p>the giving of financial guarantees and commitments;</p>

              <p><term refersTo="#term-money-market-instruments">money-market instruments</term> means <def>instruments, other than instruments of payment, that are normally dealt in on the money market, such as treasury bills, certificates of deposit and commercial papers.</def></p>
              <p><term refersTo="#term-paramilitary-equipment">paramilitary equipment</term> means <def>any of the following: batons, clubs, riot sticks and similar devices of a kind used for law enforcement purposes; body armour, including: bullet-resistant apparel; and bullet-resistant pads; and protective helmets; handcuffs, leg irons and other devices used for restraining prisoners; riot protection shields; whips; parts and accessories designed or adapted for use in, or with, equipment mentioned in paragraphs (a) to (e).</def></p>

              <p><term refersTo="#term-sanctioned-commercial-activity">sanctioned commercial activity</term> has the meaning given by <def>regulations 5A, 5B, 5C and 5CA, but does not include an activity specified in a legislative instrument under regulation 5D.</def></p>
              <p><term refersTo="#term-sanctioned-import">sanctioned import</term> has the meaning given by <def>regulation 4A, but does not include an activity specified in a legislative instrument under regulation 5D.</def></p>
              <p><term refersTo="#term-sanctioned-service">sanctioned service</term> has the meaning given by <def>regulation 5, but does not include an activity specified in a legislative instrument under regulation 5D.</def></p>
              <p><term refersTo="#term-sanctioned-supply">sanctioned supply</term> has the meaning given by <def>regulation 4, but does not include an activity specified in a legislative instrument under regulation 5D.</def></p>

              <p>	(1)	For these Regulations, a person makes a <b><i>sanctioned import</i></b> if:</p>

          <heading>Sanctioned commercial activity—Russia</heading>
          <subsection eId="part-2__sec-5B__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	For these Regulations, <b><i>sanctioned commercial activity</i></b> also means the direct or indirect purchase or sale of, or any other dealing with, bonds, equity, transferable securities, money market instruments or other similar financial instruments, if the financial instrument:</p>
            </content>
            <paragraph eId="part-2__sec-5B__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>is issued, after the commencement of this subregulation, by an entity specified in subregulation (6); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>has a maturity period specified by <role refersTo="#minister">the Minister</role> in an instrument under this regulation for the financial instrument and the entity.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5B__subsec-2">
            <num>2</num>
            <content>
              <p>Subregulation (1) does not apply to an activity in relation to tradeable securities or other financial instruments that:</p>
            </content>
            <paragraph eId="part-2__sec-5B__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>is a derivative product the value of which is linked to an underlying asset of a type mentioned in subsection (1); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>does not involve the purchase or sale of, or any other dealing in relation to, the underlying asset.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5B__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	For these Regulations, <b><i>sanctioned commercial activity</i></b> also means directly or indirectly making, or being part of any arrangement to make, loans or credit if the loan or credit:</p>
            </content>
            <paragraph eId="part-2__sec-5B__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>is made, after the commencement of this subregulation, to an entity specified in subregulation (6); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>has a maturity period specified by <role refersTo="#minister">the Minister</role> in an instrument under this regulation for the financial instrument and the entity.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5B__subsec-4">
            <num>4</num>
            <content>
              <p>Subregulation (3) does not apply to loans or credit that have a specific and documented objective to provide:</p>
            </content>
            <paragraph eId="part-2__sec-5B__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>financing for non-prohibited imports or exports of goods and non-financial services between Australia and Russia; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>emergency funding to meet the solvency and liquidity criteria for legal persons:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>established in Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-4__para-ii">
              <num>ii</num>
              <content>
                <p>whose proprietary rights are owned for more than 50% by an entity specified by <role refersTo="#minister">the Minister</role> in an instrument under this regulation.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5B__subsec-5">
            <num>5</num>
            <content>
              <p>Subregulation (3) does not apply to drawdown or disbursements made under a contract concluded before the commencement of this subregulation if:</p>
            </content>
            <paragraph eId="part-2__sec-5B__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>all the terms and conditions of such drawdown or disbursements:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-5__para-i">
              <num>i</num>
              <content>
                <p>were agreed before the commencement of this subregulation; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-5__para-ii">
              <num>ii</num>
              <content>
                <p>have not been modified on or after the commencement of this subregulation; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>before the commencement of this subregulation, a contractual maturity date has been fixed for the repayment in full of all funds made available and for the cancellation of all the commitments, rights and obligations under the contract.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5B__subsec-6">
            <num>6</num>
            <content>
              <p>For paragraphs (1)(a) and (3)(a), the entities are the following:</p>
            </content>
            <paragraph eId="part-2__sec-5B__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>a major financial institution, or other major institution that:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-i">
              <num>i</num>
              <content>
                <p>is incorporated, or was established, in Russia and has an explicit mandate to promote competitiveness in the Russian economy, its diversification and the encouragement of investment; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-ii">
              <num>ii</num>
              <content>
                <p>at the commencement of this subregulation, was over 50% publicly owned or controlled; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-iii">
              <num>iii</num>
              <content>
                <p>is specified by <role refersTo="#minister">the Minister</role> in an instrument under this regulation;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>a body corporate or other entity that:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-i">
              <num>i</num>
              <content>
                <p>is incorporated, or was established, in Russia; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-ii">
              <num>ii</num>
              <content>
                <p>is predominantly engaged in major activities relating to the development, production, sale or export of military equipment or services; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-iii">
              <num>iii</num>
              <content>
                <p>is specified by <role refersTo="#minister">the Minister</role> in an instrument under this regulation;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-c">
              <num>c</num>
              <content>
                <p>a body corporate or other entity that:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-i">
              <num>i</num>
              <content>
                <p>is incorporated, or was established, in Russia; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-ii">
              <num>ii</num>
              <content>
                <p>is publicly controlled or over 50% publicly owned; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-iii">
              <num>iii</num>
              <content>
                <p>is involved in the sale or transportation of crude oil or petroleum products; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-iv">
              <num>iv</num>
              <content>
                <p>is specified by <role refersTo="#minister">the Minister</role> in an instrument under this regulation;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-d">
              <num>d</num>
              <content>
                <p>a body corporate or other entity that is incorporated, or was established, outside Australia and is over 50% owned by an institution, body corporate or entity referred to in paragraph (a), (b) or (c);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-6__para-e">
              <num>e</num>
              <content>
                <p>a body corporate or other entity acting on behalf of, or at the direction of, an institution, body corporate or entity referred to in paragraph (a), (b), (c) or (d).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5B__subsec-7">
            <num>7</num>
            <content>
              <p>In this regulation:</p>
            </content>
            <content>
              <p><b><i>terms and conditions</i></b> of drawdowns and disbursements include provisions relating to:</p>
            </content>
            <paragraph eId="part-2__sec-5B__subsec-7__para-a">
              <num>a</num>
              <content>
                <p>the length of the repayment period for the drawdown or disbursement; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-7__para-b">
              <num>b</num>
              <content>
                <p>the interest rate, or method of calculating the interest rate, for the drawdown or disbursement; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5B__subsec-7__para-c">
              <num>c</num>
              <content>
                <p>the maximum amount for the drawdown or disbursement.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-5C">
          <num>5C</num>
          <heading>Sanctioned commercial activity—specified Ukraine regions</heading>
          <subsection eId="part-2__sec-5C__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	For these Regulations, <b><i>sanctioned commercial activity</i></b> also means:</p>
            </content>
            <paragraph eId="part-2__sec-5C__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the granting by a person of any financial loan or credit; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5C__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the establishment by a person of a joint venture;</p>
              </content>
              <content>
                <p>relating to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5C__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the creation, acquisition or development of infrastructure in any of the following sectors in a specified Ukraine region:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5C__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>transport;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5C__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>telecommunications;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5C__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>energy; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5C__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>the exploitation of oil or gas, or of mineral resources specified by <role refersTo="#minister">the Minister</role> in an instrument under this regulation, in a specified Ukraine region.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5C__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	For these Regulations, <b><i>sanctioned commercial activity</i></b> also means the acquisition or extension by a person of an interest in an enterprise that was established in a specified Ukraine region and is engaged in an activity referred to in paragraph (1)(c) or (d).</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-5CA">
          <num>5CA</num>
          <heading>Sanctioned commercial activity—DPRK</heading>
          <subsection eId="part-2__sec-5CA__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	For the purposes of these Regulations, <b><i>sanctioned commercial activity</i></b> also means:</p>
            </content>
            <paragraph eId="part-2__sec-5CA__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the acquisition or extension of an interest in a person or entity mentioned in an item of the following table; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5CA__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the establishment of, or participation in, a joint venture, partnership or other business relationship with a person or entity mentioned in an item of the following table; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5CA__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the granting of a financial loan or credit to a person or entity mentioned in an item of the following table.</p>

                <p>the obtaining of any asset that is a tenement or permission (however described) in relation to the creation, construction, installation, development, maintenance or decommissioning of infrastructure associated with an extractive or related industry in the DPRK; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5CA__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>the use of, dealing with or making available of any asset for the purpose of obtaining any tenement or permission (however described) in relation to an extractive or related industry in the DPRK; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5CA__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>the use of, dealing with or making available of any asset for the purpose of obtaining any tenement or permission (however described) in relation to the creation, construction, installation, development, maintenance or decommissioning of infrastructure associated with an extractive or related industry in the DPRK.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-5CA__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	For the purposes of these Regulations, <b><i>sanctioned commercial activity</i></b> also means:</p>
            </content>
            <paragraph eId="part-2__sec-5CA__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>the obtaining, directly or indirectly, of any tenement or permission (however described) in relation to an extractive or related industry in the DPRK from a person or entity mentioned in an item of the table in subregulation (2); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5CA__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>the obtaining, directly or indirectly, of any tenement or permission (however described) in relation to the creation, construction, installation, development, maintenance or decommissioning of infrastructure associated with an extractive or related industry in the DPRK from a person or entity mentioned in an item of the table in subregulation (2).</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-5D">
          <num>5D</num>
          <heading>Suspension of sanctions for specified activities</heading>
          <content>
            <p>If <role refersTo="#minister">the Minister</role> is satisfied that it is in the national interest to do so, <role refersTo="#minister">the Minister</role> may, by legislative instrument, specify any of the following:</p>
          </content>
          <paragraph eId="part-2__sec-5D__para-a">
            <num>a</num>
            <content>
              <p>that an activity mentioned in regulation 4 is not a sanctioned supply;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-5D__para-b">
            <num>b</num>
            <content>
              <p>that an activity mentioned in regulation 4A is not a sanctioned import;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-5D__para-c">
            <num>c</num>
            <content>
              <p>that an activity mentioned in regulation 5 is not a sanctioned service;</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-5D__para-d">
            <num>d</num>
            <content>
              <p>that an activity mentioned in regulation 5A, 5B, 5C or 5CA is not a sanctioned commercial activity.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-2__sec-6">
          <num>6</num>
          <heading>Country-specific designation of persons or entities or declaration of persons</heading>
          <content>
            <p>For paragraph 10(1)(a) of the Act, <role refersTo="#minister">the Minister</role> may, by legislative instrument, do either or both of the following:</p>

                <td>(a) A person who has been indicted for an offence by the ICTY (whether or not the person has been convicted of the offence).
(b) A person who has been indicted for an offence within the jurisdiction of the ICTY by a domestic court in Bosnia-Herzegovina, Croatia or Serbia (whether or not the person has been convicted of the offence).
(c) A person who is subject to an Interpol arrest warrant related to an offence within the jurisdiction of the ICTY.
(d) A person who the Minister is satisfied is a supporter of the former regime of Slobodan Milosevic.
(e) A person who is suspected of assisting a person who is:
(i) indicted by the ICTY; and
(ii) not currently detained by the ICTY.</td>

                <td>(a) A person or entity that the Minister is satisfied has contributed to, or is contributing to, Iran’s nuclear or missile programs.
(b) A person or entity that the Minister is satisfied has assisted, or is assisting, Iran to violate:
(i) Resolution 1737, 1747, 1803, 1929 or 2231 of the United Nations Security Council; or
(ii) a subsequent resolution relevant to a resolution mentioned in subparagraph (i).
(c) A person or entity that the Minister is satisfied is engaging in, is responsible for or is complicit in, or has engaged in, been responsible for or been complicit in, any of the following:
(i) the oppression of women and girls in Iran;
(ii) the general oppression of people in Iran;
(iii) undermining good governance or the rule of law in Iran.
(d) A person or entity that the Minister is satisfied is assisting, or has assisted, Iran to threaten or undermine the sovereignty or territorial integrity of another country.</td>

                <td>Libya</td>
                <td>(a) A person who the Minister is satisfied was a close associate of the former Qadhafi regime.
(b) An entity that the Minister is satisfied is under the control of one or more members of Muammar Qadhafi’s family.

(i) Resolution 1970 or 1973 of the United Nations Security Council; or

                <td>(a) A former member of the State Peace and Development Council (SPDC).

(d) A current or former military officer of the rank of Brigadier-General or higher.
(e) A senior official in any of Myanmar’s security or corrections agencies.
(f) A current or former senior officeholder of the Union Solidarity and Development Party (USDP) or the Union Solidarity and Development Association (USDA).
(g) A senior official or executive in a state-owned or a military-owned enterprise.
(ga) A current or former member of any of the following:
(i) the State Administration Council (SAC) or any successor of that body with similar functions;
(ii) the National Defence and Security Council (NDSC) or any successor of that body with similar functions;
(iii) any other body that the Minister is satisfied is a key governance body of a regime controlled by the Myanmar military;
(iv) a political party or association that the Minister is satisfied is part of, or is participating in the governance or administration of, a regime controlled by the Myanmar military.
(h) An immediate family member of a person mentioned in any of paragraphs (a) to (ga).
(i) An entity that the Minister is satisfied:
(i) is owned or controlled by, or provides support (including political support) to, a regime controlled by the Myanmar military; or
(ii) is owned or controlled by a person mentioned in any of paragraphs (a) to (ga) or by an immediate family member of such a person.</td>

            <content>
              <p>For the purposes of paragraph 10(1)(a) of the Act, <role refersTo="#minister">the Minister</role> may, by legislative instrument, do either or both of the following:</p>
            </content>
            <paragraph eId="part-2__sec-6A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>	(a)	designate a person or entity as a <b><i>designated person or entity </i></b>if the Minister is satisfied that the person or entity:</p>
              </content>

                <p>has caused, or attempted to cause, a significant cyber incident; or</p>
              </content>
            </paragraph>

              </content>
            </paragraph>

            </paragraph>

            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6A__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of this regulation, in deciding whether <role refersTo="#minister">the Minister</role> is satisfied that a cyber incident was, or would have been, significant, <role refersTo="#minister">the Minister</role> may have regard to the following matters:</p>
            </content>
            <paragraph eId="part-2__sec-6A__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>whether the conduct of the person or entity was malicious;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>in the case of a cyber incident that has occurred—whether the incident involved any of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>actions that destroyed, degraded or rendered unavailable an essential service or critical infrastructure;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>actions that resulted in the loss of a person’s life, or caused serious risk of loss of a person’s life;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-3__para-iii">
              <num>iii</num>
              <content>
                <p>theft of intellectual property, trade secrets or confidential business information for the purposes of gaining a competitive advantage for an entity or a commercial sector;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-3__para-iv">
              <num>iv</num>
              <content>
                <p>interference with a political or governmental process, the exercise of a political right or duty, or the functions or operations of a parliament;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>in the case of a cyber incident that has been attempted but has not occurred—whether <role refersTo="#minister">the Minister</role> is satisfied that, if the incident had occurred, the incident could reasonably be expected to have involved one or more of the matters mentioned in subparagraphs (b)(i) to (iv);</p>

            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>any other matters <role refersTo="#minister">the Minister</role> considers relevant.</p>
              </content>
              <content>
                <p>Serious violations or serious abuses of human rights</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6A__subsec-4">
            <num>4</num>
            <content>
              <p>For the purposes of paragraph 10(1)(a) of the Act, <role refersTo="#minister">the Minister</role> may, by legislative instrument, do either or both of the following:</p>
            </content>
            <paragraph eId="part-2__sec-6A__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>	(a)	designate a person or entity as a <b><i>designated person or entity</i></b> if the Minister is satisfied that the person or entity has engaged in, has been responsible for or has been complicit in an act that constitutes a serious violation or serious abuse of a person’s:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>right to life; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-4__para-ii">

                <p>right not to be subjected to torture or to cruel, inhuman or degrading treatment or punishment; or</p>

            </paragraph>

              <content>
                <p>	(a)	designate a person or entity as a <b><i>designated person or entity</i></b> if the Minister is satisfied that the person or entity has engaged in, has been responsible for or has been complicit in an act of corruption that is serious;</p>

            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>declare a person for the purpose of preventing the person from travelling to, entering or remaining in Australia if <role refersTo="#minister">the Minister</role> is satisfied that the person has engaged in, has been responsible for or has been complicit in an act of corruption that is serious.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6A__subsec-6">
            <num>6</num>
            <content>
              <p>For the purposes of this regulation, in deciding whether <role refersTo="#minister">the Minister</role> is satisfied that an act of corruption is serious, <role refersTo="#minister">the Minister</role> may have regard to the following matters:</p>
            </content>
            <paragraph eId="part-2__sec-6A__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>the status or position of the person or entity;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>the nature, extent and impact of the conduct of the person or entity;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-6__para-c">
              <num>c</num>
              <content>
                <p>the circumstances in which that conduct occurred;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-6__para-d">
              <num>d</num>
              <content>
                <p>any other matters <role refersTo="#minister">the Minister</role> considers relevant.</p>
              </content>
              <content>
                <p>Conduct in whole or in part outside Australia</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6A__subsec-7">
            <num>7</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must not make a designation or a declaration under subregulation (1), (2), (4) or (5) unless <role refersTo="#minister">the Minister</role> is satisfied that the conduct of the person or entity concerned occurred, in whole or in part, outside Australia.</p>
            </content>
            <content>
              <p>Immediate family members</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-6A__subsec-8">
            <num>8</num>
            <content>
              <p>For the purposes of paragraph 10(1)(a) of the Act, <role refersTo="#minister">the Minister</role> may, by legislative instrument, do either or both of the following:</p>
            </content>
            <paragraph eId="part-2__sec-6A__subsec-8__para-a">
              <num>a</num>
              <content>
                <p>	(a)	designate a person as a <b><i>designated person or entity</i></b> if the Minister is satisfied that the person is an immediate family member of a person who is covered by a designation under paragraph (4)(a) or (5)(a);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-8__para-b">
              <num>b</num>
              <content>
                <p>declare a person for the purpose of preventing the person from travelling to, entering or remaining in Australia if <role refersTo="#minister">the Minister</role> is satisfied that the person is an immediate family member of a person who is covered by a declaration under paragraph (4)(b) or (5)(b).</p>
              </content>
              <content>
                <p>Persons or entities obtaining financial or other benefits</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-6A__subsec-9">
            <num>9</num>
            <content>
              <p>For the purposes of paragraph 10(1)(a) of the Act, <role refersTo="#minister">the Minister</role> may, by legislative instrument, do either or both of the following:</p>
            </content>
            <paragraph eId="part-2__sec-6A__subsec-9__para-a">
              <num>a</num>
              <content>
                <p>	(a)	designate a person or entity as a <b><i>designated person or entity</i></b> if the Minister is satisfied that the person or entity has obtained a financial or other benefit as a result of the act of another person or entity who is covered by a designation under paragraph (4)(a) or (5)(a), being the act referred to in paragraph (4)(a) or (5)(a);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-6A__subsec-9__para-b">
              <num>b</num>
              <content>
                <p>declare a person for the purpose of preventing the person from travelling to, entering or remaining in Australia if <role refersTo="#minister">the Minister</role> is satisfied that the person has obtained a financial or other benefit as a result of the act of another person who is covered by a declaration under paragraph (4)(b) or (5)(b), being the act referred to in paragraph (4)(b) or (5)(b).</p>

            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-7">
          <num>7</num>
          <heading>Designating controlled assets</heading>
          <content>
            <p>		For paragraph 10(1)(b) of the Act, the Minister may, by legislative instrument, designate a controlled asset as a <b><i>designated asset</i></b>.</p>
          </content>
        </section>

          <num>8</num>
          <heading>Sanctioned vessels</heading>
          <content>
            <p>Designation of vessels</p>
          </content>
          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>For paragraph 10(1)(b) of the Act, <role refersTo="#minister">the Minister</role> may, by legislative instrument:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	designate a vessel as a <b><i>sanctioned vessel</i></b> for a country mentioned in the designation; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	designate each vessel in a class of vessels as a <b><i>sanctioned vessel</i></b> for a country mentioned in the designation.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>A vessel is not required to be owned, registered or flagged by the country mentioned in the designation.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-3">

              <p>A sanctioned vessel does not cease to be a sanctioned vessel solely because:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>its name is changed; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the flag under which it is operated changes; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>its registration is changed.</p>
              </content>
              <content>
                <p>Directions to sanctioned vessels</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-4">
            <num>4</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may direct a sanctioned vessel to:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>leave Australia, including by a particular route; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>not enter a particular port or place, or any port or place, in Australia.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-5">
            <num>5</num>
            <content>
              <p>Before giving the direction, <role refersTo="#minister">the Minister</role> must have regard to Australia’s obligations at international law.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-6">
            <num>6</num>
            <content>
              <p>A direction given under subregulation (4) in writing is not a legislative instrument.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-10">
          <num>10</num>
          <heading>Revocation of designation under regulation 6, 6A, 7 or 8 or declaration under regulation 6 or 6A</heading>
          <subsection eId="part-2__sec-10__subsec-1">

              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, revoke:</p>

              <p><role refersTo="#minister">The Minister</role> may also revoke:</p>

                <p>a designation made under paragraph 6(a) or 6A(1)(a), (2)(a), (4)(a), (5)(a), (8)(a) or (9)(a); or</p>

                <p>the owner of the sanctioned vessel to which the designation relates; or</p>
              </content>
            </paragraph>

                <p>the person who controls the sanctioned vessel to which the designation relates.</p>

              <p>The application must:</p>

              <p>A body corporate contravenes this regulation if:</p>
            </content>

                <p>the body corporate has effective control over the actions of another body corporate or entity, wherever incorporated or situated; and</p>
              </content>
            </paragraph>

                <p>the other body corporate or entity makes a sanctioned supply; and</p>

                <p>the person directly or indirectly makes an asset available to, or for the benefit of, a designated person or entity; and</p>

                <p>the making available of the asset is not authorised by a permit granted under regulation 18.</p>

                <p>allows the asset to be used or dealt with; or</p>

                <p>the person engages in conduct; and</p>
              </content>
            </paragraph>

                <p>the conduct causes the sanctioned vessel to contravene the direction.</p>

            </paragraph>
          </subsection>

        <heading>Authorisations</heading>

          <num>18</num>
          <heading>Minister may grant permits</heading>
          <subsection eId="part-4__sec-18__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may grant to a person a permit authorising:</p>
            </content>
            <paragraph eId="part-4__sec-18__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the making of a sanctioned supply; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the making of a sanctioned import; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>engaging in a sanctioned commercial activity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>the provision of a sanctioned service; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>the making available of an asset to a person or entity that would otherwise contravene regulation 14; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-1__para-f">
              <num>f</num>

                <p>a use of, or a dealing with, a controlled asset.</p>
              </content>

              <p><role refersTo="#minister">The Minister</role> may grant a permit:</p>
            </content>
            <paragraph eId="part-4__sec-18__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>on <role refersTo="#minister">the Minister</role>’s initiative; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>on application by a person.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-18__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must not grant a permit unless <role refersTo="#minister">the Minister</role> is satisfied:</p>
            </content>
            <paragraph eId="part-4__sec-18__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>that it would be in the national interest to grant the permit; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-18__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>about any circumstance or matter required by this Part to be considered for a particular kind of permit.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-18__subsec-4">
            <num>4</num>
            <content>
              <p>A permit may be granted subject to conditions specified in the permit.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-19">
          <num>19</num>
          <heading>Minister may waive operation of declaration under paragraph 6(b) or 6A(1)(b), (2)(b), (4)(b), (5)(b), (8)(b) or (9)(b)</heading>
          <subsection eId="part-4__sec-19__subsec-1">
            <num>1</num>
            <content>
              <p>This regulation applies if:</p>
            </content>
            <paragraph eId="part-4__sec-19__subsec-1__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> has declared a person under paragraph 6(b) or 6A(1)(b), (2)(b), (4)(b), (5)(b), (8)(b) or (9)(b) for the purpose of preventing the person from travelling to, entering or remaining in Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the person:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>	(i)	holds a visa under the <i>Migration Act 1958</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>had applied under that Act for the grant of a visa before the declaration, and the application had not been finally determined (within the meaning of that Act) before the declaration; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>applies under that Act for the grant of a visa after the declaration.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-19__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, in writing, waive the operation of the declaration to the extent that it would have the effect of preventing the person from travelling to, entering or remaining in Australia as would be permitted by the visa.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-19__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may waive the operation of the declaration only:</p>
            </content>
            <paragraph eId="part-4__sec-19__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>on the grounds that it would be in the national interest; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>on humanitarian grounds.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-19__subsec-4">
            <num>4</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may waive the operation of the declaration subject to conditions specified in the waiver.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-19__subsec-5">
            <num>5</num>
            <content>
              <p>A waiver has effect:</p>
            </content>
            <paragraph eId="part-4__sec-19__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>for the period (if any) specified by <role refersTo="#minister">the Minister</role> in the waiver; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>in the circumstances (if any) specified by <role refersTo="#minister">the Minister</role> in the waiver.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-19__subsec-6">
            <num>6</num>
            <content>
              <p>The waiver ceases to have effect if:</p>
            </content>
            <paragraph eId="part-4__sec-19__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>the person fails to comply with a condition to which it is subject; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-6__para-b">
              <num>b</num>
              <content>
                <p>the period (if any) for which it has effect ends; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-19__subsec-6__para-c">
              <num>c</num>
              <content>
                <p>the circumstances in which it has effect cease to exist.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-4__sec-20">
          <num>20</num>
          <heading>Permit for assets and controlled assets</heading>
          <subsection eId="part-4__sec-20__subsec-1">
            <num>1</num>
            <content>
              <p>An application for a permit authorising the making available of an asset to a person or entity that would otherwise contravene regulation 14 must be for:</p>
            </content>
            <paragraph eId="part-4__sec-20__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a basic expense dealing; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>a legally required dealing; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a contractual dealing.</p>
              </content>

            <paragraph eId="part-4__sec-20__subsec-3__para-ii">
              <num>ii</num>

                <p>rent or mortgage;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-3__para-iii">
              <num>iii</num>
              <content>
                <p>medicines or medical treatment;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-3__para-iv">

                <p>taxes;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-3__para-v">

                <p>reimbursement of expenses associated with the provision of legal services;</p>

                <p>fees or service charges that are in accordance with a law in force in Australia for the routine holding or maintenance of frozen assets.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-20__subsec-4">
            <num>4</num>
            <content>
              <p>A dealing is a legally required dealing if:</p>
            </content>
            <paragraph eId="part-4__sec-20__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>it is constituted by:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>a payment to a designated person or entity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-4__para-ii">
              <num>ii</num>
              <content>
                <p>a payment to a person or entity acting on behalf of, or at the direction of, a designated person or entity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-4__para-iii">
              <num>iii</num>
              <content>
                <p>a payment to an entity owned or controlled by a designated person or entity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-4__para-iv">

                <p>a use or dealing with a controlled asset; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-4__para-b">

                <p>the dealing is necessary to satisfy a judicial, administrative or arbitral lien or judgement that was made prior to the date on which the person or entity became a designated person or entity; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>the dealing is not for the benefit of a designated person or entity.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-20__subsec-5">
            <num>5</num>
            <content>
              <p>	(5)	A dealing is a <b><i>contractual dealing</i></b> if:</p>
            </content>
            <paragraph eId="part-4__sec-20__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>it is constituted by:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-5__para-i">
              <num>i</num>
              <content>
                <p>a payment to a designated person or entity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-5__para-ii">
              <num>ii</num>
              <content>
                <p>a payment to a person or entity acting on behalf of, or at the direction of, a designated person or entity; or</p>

                <p>to apply interest or other earnings due on accounts holding controlled assets; or</p>

            </paragraph>
            <paragraph eId="part-4__sec-20__subsec-5__para-ii">
              <num>ii</num>
              <content>
                <p>required under contracts, agreements or obligations made before the date on which those accounts became accounts holding controlled assets.</p>

        <heading>Dealing with assets</heading>

          <heading>Advance notice of listing of persons, entities and assets</heading>
          <subsection eId="part-5__sec-21__subsec-1">
            <num>1</num>
            <content>
              <p>The Department may give notice of a designation made under paragraph 6(a) or 6A(1)(a), (2)(a), (4)(a), (5)(a), (8)(a) or (9)(a) or regulation 7 to any person who is engaged in the business of holding, dealing in, or facilitating dealing in, assets.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-21__subsec-2">
            <num>2</num>
            <content>
              <p>The Department may give the notice before the designation is published.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-22">
          <num>22</num>
          <heading>Consolidated list of entities, persons and assets</heading>
          <subsection eId="part-5__sec-22__subsec-1">
            <num>1</num>
            <content>
              <p>The Department must maintain a document that sets out:</p>
            </content>
            <paragraph eId="part-5__sec-22__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>all persons and entities that are currently designated persons or entities; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-22__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>all assets or classes of assets currently designated under regulation 8.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-22__subsec-2">
            <num>2</num>
            <content>
              <p>The document must contain the following information about a designated person or entity:</p>
            </content>
            <paragraph eId="part-5__sec-22__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the name of the person, including any alias for the person known to the Department;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-22__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the name of the entity, and any registration or incorporation number or name that will facilitate the identification of the entity;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-22__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the date on which the person or entity was designated.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-22__subsec-3">
            <num>3</num>
            <content>
              <p>The document must contain the following information about a designated asset:</p>
            </content>
            <paragraph eId="part-5__sec-22__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>a description of the asset or class of assets;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-22__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the name of the designated person or entity that, owns or controls the asset;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-22__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>the date on which the asset was designated under regulation 7.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-22__subsec-4">
            <num>4</num>
            <content>
              <p>The document must be made available to the public on the Department’s website.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-22__subsec-5">
            <num>5</num>
            <content>
              <p>	(5)	The document may be consolidated with the document mentioned in regulation 40 of the <i>Charter of the United Nations (Dealing with Assets) </i><i>Regulations 2</i><i>008</i>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-23">
          <num>23</num>
          <heading>Request to AFP for help</heading>
          <subsection eId="part-5__sec-23__subsec-1">
            <num>1</num>
            <content>
              <p>A person who holds an asset that the person suspects is, or may be, a controlled asset may request the AFP to help the person determine whether or not the asset is owned or controlled by a designated person or entity.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-2">
            <num>2</num>
            <content>
              <p>The request must be accompanied by:</p>
            </content>
            <paragraph eId="part-5__sec-23__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>details of the asset; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>as much information about the asset (including information about the owner or controller of the asset) as is known to the person making the request.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-3">
            <num>3</num>
            <content>
              <p>The AFP must use its best endeavours to help a person who has made a request under subregulation (1).</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-4">
            <num>4</num>
            <content>
              <p>As soon as practicable after receiving a request under subregulation (1), the AFP must respond in writing.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-5">
            <num>5</num>
            <content>
              <p>The response must state whether the AFP considers that:</p>
            </content>
            <paragraph eId="part-5__sec-23__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>it is likely that the asset is owned or controlled by a designated person or entity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>it is unlikely that the asset is owned or controlled by a designated person or entity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-5__para-c">
              <num>c</num>
              <content>
                <p>it is unknown whether the asset is owned or controlled by a designated person or entity.</p>
              </content>

          <heading>Informing AFP of opinion about asset</heading>
          <subsection eId="part-5__sec-24__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	This regulation sets out what a person who is holding an asset must do if the person forms an opinion (a <b><i>notifiable opinion</i></b>) that:</p>
            </content>

          </subsection>
          <subsection eId="part-5__sec-24__subsec-2">
            <num>2</num>
            <content>
              <p>Paragraph (1)(b) does not apply if:</p>
            </content>
            <paragraph eId="part-5__sec-24__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the asset has been removed from the document mentioned in regulation 22; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-24__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>all designated persons and entities associated with the asset have been removed from the document.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-24__subsec-3">
            <num>3</num>
            <content>
              <p>As soon as practicable after a person forms a notifiable opinion, the person must inform the AFP of:</p>
            </content>
            <paragraph eId="part-5__sec-24__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the asset about which the opinion was formed; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-24__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>as much information about the asset (including information about the owner or controller of the asset) as is known to the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-24__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>the reasons for the opinion.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-5__sec-25">
          <num>25</num>
          <heading>Protection of information</heading>
          <subsection eId="part-5__sec-25__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	This regulation applies to a person who, at the time that something is done under the Act or these Regulations (a <b><i>relevant action</i></b>), is:</p>
            </content>
            <paragraph eId="part-5__sec-25__subsec-1__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-25__subsec-1__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> of the Department; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-25__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>an APS employee; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-25__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>	(d)	an AFP employee, or a member of the Australian Federal Police, within the meaning of the <i>Australian Federal Police Act 1979</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-25__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>a person who holds a controlled asset or an asset that the person suspects may be a controlled asset; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-25__subsec-1__para-f">
              <num>f</num>
              <content>
                <p>a person employed by a person mentioned in paragraph (e).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-25__subsec-2">
            <num>2</num>
            <content>
              <p>A person to whom this regulation applies is not required:</p>
            </content>
            <paragraph eId="part-5__sec-25__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>to produce in a court any document that has come into the custody or control of the person in the course of, or because of, the relevant action; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-25__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>to divulge or communicate to a court any matter or thing that has come to the notice of the person in the course of, or because of, the relevant action;</p>
              </content>
              <content>
                <p>unless it is necessary to do so to comply with the Act or these Regulations.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
      </part>
      <part eId="part-6">
        <num>6</num>
        <heading>Miscellaneous</heading>
        <section eId="part-6__sec-25A">
          <num>25A</num>
          <heading>Review of operation of the autonomous sanctions legislative framework</heading>
          <subsection eId="part-6__sec-25A__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause a review of the operation of the autonomous sanctions legislative framework to be undertaken every 5 years, starting 5 years from the commencement of this regulation.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-25A__subsec-2">
            <num>2</num>
            <content>
              <p>Without limiting subregulation (1), each review must consider:</p>
            </content>
            <paragraph eId="part-6__sec-25A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the effectiveness of the autonomous sanctions legislative framework for achieving Australia’s foreign policy objectives; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-25A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>whether the Act and these Regulations are appropriate for achieving the objects of the Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-25A__subsec-3">
            <num>3</num>
            <content>
              <p>The persons who undertake a review must give the Minister a written report on the review <quantity refersTo="#deadline">within 12 months</quantity> of the commencement of the review.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-25A__subsec-4">
            <num>4</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause a copy of the report to be tabled in each House of the Parliament within 15 sitting days of that House after <role refersTo="#minister">the Minister</role> receives the report.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-6__sec-26">
          <num>26</num>
          <heading>Delegations by Minister</heading>
          <subsection eId="part-6__sec-26__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may delegate <role refersTo="#minister">the Minister</role>’s powers and functions under these Regulations (other than this power of delegation) to:</p>
            </content>
            <paragraph eId="part-6__sec-26__subsec-1__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role> of the Department; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-26__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an SES employee, or acting SES employee, in the Department.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-26__subsec-2">
            <num>2</num>
            <content>
              <p>The delegation must be in writing.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-26__subsec-3">
            <num>3</num>
            <content>
              <p>The delegate must comply with any directions of <role refersTo="#minister">the Minister</role> in exercising powers or functions under the delegation.</p>
            </content>
          </subsection>
        </section>

        <num>7</num>
        <heading>Application, saving and transitional provisions</heading>
        <section eId="part-7__sec-27">
          <num>27</num>
          <heading>Amendments made by the Autonomous Sanctions Amendment (Magnitsky-style and Other Thematic Sanctions) Regulations 2021</heading>
          <subsection eId="part-7__sec-27__subsec-1">
            <num>1</num>
            <content>
              <p>An instrument in force under subregulation 6(1) immediately before the commencement of this regulation continues in force on and after that commencement as if it were an instrument in force under regulation 6.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-27__subsec-2">
            <num>2</num>
            <content>
              <p>A designation made under paragraph 6(1)(a) before the commencement of this regulation and in force immediately before that commencement has effect on and after that commencement as if it were a designation made under paragraph 6(a).</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-27__subsec-3">
            <num>3</num>
            <content>
              <p>A declaration made under paragraph 6(1)(b) before the commencement of this regulation and in force immediately before that commencement has effect on and after that commencement as if it were a declaration made under paragraph 6(b).</p>

            <num>4</num>
            <content>
              <p>An instrument in force under subregulation 6(2) immediately before the commencement of this regulation continues in force on and after that commencement as if it were an instrument in force under subregulation 6A(1).</p>

            <num>5</num>
            <content>
              <p>A designation made under paragraph 6(2)(a) before the commencement of this regulation and in force immediately before that commencement has effect on and after that commencement as if it were a designation made under paragraph 6A(1)(a).</p>

            <num>6</num>
            <content>
              <p>A declaration made under paragraph 6(2)(b) before the commencement of this regulation and in force immediately before that commencement has effect on and after that commencement as if it were a declaration made under paragraph 6A(1)(b).</p>

          </subsection>
          <subsection eId="part-7__sec-27__subsec-7">
            <num>7</num>
            <content>
              <p>An instrument made under subregulation 9(3) before the commencement of this regulation, in relation to a designation or declaration, and in force immediately before that commencement, has effect on and after that commencement as if it were an instrument made under that subregulation in relation to that designation or declaration as affected by the operation of subregulation (2), (3), (5) or (6) of this regulation.</p>

          </subsection>

            <num>8</num>

              <p>This regulation does not affect the day on which a designation or declaration took effect.</p>

          <heading>Amendments made by the Autonomous Sanctions Amendment (Ukraine Regions) Regulations 2022</heading>
          <subsection eId="part-7__sec-28__subsec-1">

              <p>	(1)	Subsection 3(2) of the <i>Autonomous Sanctions (Russia, Crimea and Sevastopol) Specification 2015</i> (the <b><i>Specification</i></b>) has effect on and after the commencement of this regulation as if the reference in that subsection to “Crimea and Sevastopol” were instead a reference to “each specified Ukraine region”.</p>

          </subsection>
          <subsection eId="part-7__sec-28__subsec-2">
            <num>2</num>
            <content>

              <p>	(1)	The repeal of regulation 9 made by the <i>Autonomous Sanctions Amendment (Periodic Legislative Review) </i><i>Regulations 2</i><i>024 </i>applies in relation to a designation or declaration made under these Regulations, whether it was made before, on or after the commencement of the <i>Autonomous Sanctions Amendment (Periodic Legislative Review) </i><i>Regulations 2</i><i>024</i>.</p>

          </subsection>
          <subsection eId="part-7__sec-29__subsec-2">
            <num>2</num>
            <content>
              <p>To avoid doubt, the repeal of regulation 9 does not affect the previous operation of a declaration made under subregulation (3) of that regulation.</p>
