          <p>		This Act may be cited as the<i> </i><i>Stronger Futures in the Northern Territory (Consequential and Transitional Provisions)</i><i> Act 201</i><i>2</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

        <heading>Schedule(s)</heading>

          <p>Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

        <num>4</num>
        <heading>Definitions</heading>
        <subsection eId="sec-4__subsec-1">
          <num>1</num>
          <content>
            <p>In this Act:</p>
          </content>
          <content>
            <p><term refersTo="#term-commencement">commencement</term> means <def>the day Schedules 1 to 5 of this Act commence.</def></p>
            <p><term refersTo="#term-new-act">new Act</term> means <def><ref class="unresolved">the Stronger Futures in the Northern Territory Act 2012</ref>.</def></p>
            <p><term refersTo="#term-old-act">old Act</term> means <def><ref class="unresolved">the Northern Territory National Emergency Response Act 2007</ref> as in force immediately before commencement.</def></p>
            <p><b><i>relevant time</i></b> means:</p>
          </content>
          <paragraph eId="sec-4__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>if, under subsection (3), the Minister determines a day that is on or after commencement but before <date date="2012-08-17">17 August 2012</date>—the beginning of that day; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-4__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>otherwise—the end of <date date="2012-08-17">17 August 2012</date>.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-4__subsec-2">
          <num>2</num>
          <content>
            <p>In this Act, expressions that are defined in the new Act have the same meanings as they have in that Act.</p>
          </content>
        </subsection>
        <subsection eId="sec-4__subsec-3">
          <num>3</num>
          <content>
            <p>	(3)	The Minister may, by legislative instrument, determine a day for the purposes of the definition of <b><i>relevant time</i></b> in subsection (1).</p>

            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">

            <heading>Saving—if the old Act is repealed before 17 August 2012</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-1">
              <num>1</num>
              <content>
                <p>This item applies if this Act commences before <date date="2012-08-17">17 August 2012</date>.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-2__subclause-2">
              <num>2</num>
              <content>
                <p>Despite the repeal of <ref href="#sec-3">section 3</ref>, <ref href="#part-4">Part 4</ref>, <ref href="#part-8">Part 8</ref> and Schedule 1 to the old Act made by item 1 of this Schedule, those provisions (other than <ref href="#dvs-2">Division 2</ref> of <ref href="#part-4">Part 4</ref>) continue in force, in relation to leases granted under <ref href="#sec-31">section 31</ref> of the old Act before the repeal, until the relevant time.</p>
              </content>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-3">
            <num>3</num>
            <heading>Saving—Divisions 2 and 3 of Part 4 of the old Act and related provisions</heading>
            <content>
              <p>Despite the repeal of sections 3, 48, 49, 50, 51, 53, 54, 55, 56, 58, 59 and <ref href="#part-8">Part 8</ref> (acquisition of rights etc. in land) of the old Act made by item 1 of this Schedule:</p>
              <p>in relation to rights, titles and interests in land that:</p>
            </content>
            <paragraph eId="schedule-1__clause-3__para-a">
              <num>a</num>
              <content>
                <p>those provisions continue in force; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-b">
              <num>b</num>
              <content>
                <p>any instruments made under those provisions continue in force and may be dealt with under those provisions;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-c">
              <num>c</num>
              <content>
                <p>were vested in the Commonwealth under <ref href="#sec-47">section 47</ref> of the old Act before commencement; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-d">
              <num>d</num>
              <content>
                <p>were or are preserved under <ref href="#sec-48">section 48</ref> of the old Act before, on or after commencement.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-4">
            <num>4</num>
            <heading>Saving—sections 60, 61, 62 and 63 of the old Act</heading>
            <content>
              <p>Sections 60 and 61 (compensation for acquisition of property)</p>
              <p>Section 62 (payment of agreed amounts or rent)</p>
              <p>Section 63 (appropriation)</p>
            </content>

              <content>
                <p>Despite the repeal of sections 60 and 61 (compensation for acquisition of property) of the old Act made by item 1 of this Schedule, those sections continue in force in relation to acquisitions of property that occurred before the relevant time.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-4__subclause-2">
              <num>2</num>
              <content>
                <p>Despite the repeal of <ref href="#sec-62">section 62</ref> of the old Act made by item 1 of this Schedule, that section continues in force in relation to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-4__para-a">
              <num>a</num>
              <content>
                <p>agreements made under that section before the relevant time; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-4__para-b">
              <num>b</num>
              <content>
                <p>rent payable after the relevant time in relation to leases granted under <ref href="#sec-31">section 31</ref> of the old Act before the relevant time.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-4__subclause-3">
              <num>3</num>
              <content>
                <p>Despite the repeal of <ref href="#sec-63">section 63</ref> of the old Act made by item 1 of this Schedule, that section continues in force in relation to amounts payable before, on or after the relevant time.</p>
              </content>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-5">
            <num>5</num>
            <heading>Transitioning prescribed areas to alcohol protected areas</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-1">
              <num>1</num>
              <content>
                <p>If, immediately before commencement:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5__para-a">
              <num>a</num>
              <content>
                <p>an area in the Northern Territory was a prescribed area under <ref href="#sec-4">section 4</ref> of the old Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-b">
              <num>b</num>
              <content>
                <p>there was not a determination in force in relation to the area under paragraph 19(1)(b) of the old Act;</p>
              </content>
            </paragraph>
            <content>
              <p>then a rule prescribing the area as an alcohol protected area is taken to have been made, on commencement, for the purposes of subsection 27(1) of the new Act.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-2">
              <num>2</num>
              <content>
                <p>The rule referred to in subitem (1) may be revoked or varied, after commencement, by a rule made for the purposes of subsection 27(2) of the new Act.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-6">
            <num>6</num>
            <heading>Transitioning areas declared under section 12 of the old Act</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-6__subclause-1">
              <num>1</num>
              <content>
                <p>If a declaration under subsection 12(8) of the old Act (about when certain defences against alcohol offences are not available) was in force immediately before commencement, then that declaration continues in force (and may be dealt with), on and after commencement, as if the instrument had been made under subsection 75D(1) of the NT Liquor Act.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	Section 8 of the new Act includes subsection 75D(1) into the NT Liquor Act.</p>

              <content>
                <p>If a declaration under subsection 12(8A) of the old Act (about when certain defences against alcohol offences are available) was in force immediately before commencement, then that declaration continues in force (and may be dealt with), on and after commencement, as if the instrument had been made under subsection 75D(2) of the NT Liquor Act.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-7">
            <num>7</num>
            <heading>Transitioning conditions etc. on NT liquor licences</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-7__subclause-1">
              <num>1</num>
              <content>
                <p>If a determination under subsection 13(4) of the old Act (about what is not authorised by a NT liquor licence) was in force immediately before commencement, then that determination continues in force (and may be dealt with), on and after commencement, as if the determination had been made under subsection 12(4) of the new Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-7__subclause-2">
              <num>2</num>
              <content>
                <p>If a determination under subsection 13(5) of the old Act (about the conditions on a NT liquor licence) was in force immediately before commencement, then that determination continues in force (and may be dealt with), on and after commencement, as if the determination had been made under subsection 12(5) of the new Act.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-8">
            <num>8</num>
            <heading>Transitioning conditions etc. on NT liquor permits</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-8__subclause-1">
              <num>1</num>
              <content>
                <p>If a determination under subsection 14(2) of the old Act (about what is not authorised by a NT liquor permit) was in force immediately before commencement, then that determination continues in force (and may be dealt with), on and after commencement, as if the determination had been made under subsection 13(2) of the new Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-8__subclause-2">
              <num>2</num>
              <content>
                <p>If a determination under subsection 14(3) of the old Act (about the conditions on a NT liquor permit) was in force immediately before commencement, then that determination continues in force (and may be dealt with), on and after commencement, as if the determination had been made under subsection 13(3) of the new Act.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9">
            <num>9</num>
            <heading>Transitioning community store licences</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-9__subclause-1">
              <num>1</num>
              <content>
                <p>(1)	This item applies to a community store licence (the <b><i>transitioned licence</i></b>) that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9__para-a">
              <num>a</num>
              <content>
                <p>was in force under Part 7 of the old Act immediately before commencement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9__para-b">
              <num>b</num>
              <content>
                <p>was held in relation to a community store whose premises are located in an area that, on commencement, is in the food security area.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-9__subclause-2">
              <num>2</num>
              <content>
                <p>The transitioned licence continues in force (and may be dealt with), on and after commencement, as if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9__para-a">
              <num>a</num>
              <content>
                <p>the licence had been granted under subsection 45(1) of the new Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9__para-b">
              <num>b</num>
              <content>
                <p>any conditions that were imposed on the licence under <ref href="#sec-103">section 103</ref> of the old Act had been imposed under subsection 52(1) of the new Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-9__subclause-3">
              <num>3</num>
              <content>
                <p>For the purposes of subsection 59(1) of the new Act (about revoking community store licences):</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9__para-a">
              <num>a</num>
              <content>
                <p>a breach of a condition of the transitioned licence that occurred before commencement is to be treated as if it were a breach of a condition of the licence after commencement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9__para-b">
              <num>b</num>
              <content>
                <p>an offence against the old Act that was committed by the owner, manager or person involved in the store before commencement is to be treated as if the offence had been committed against the new Act by that person after commencement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9__para-c">
              <num>c</num>
              <content>
                <p>if the transitioned licence was obtained improperly under the old Act, it is to be treated as if it had been obtained improperly under the new Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-9__subclause-4">
              <num>4</num>
              <content>
                <p>If a notice under subsection 108(2) of the old Act:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9__para-a">
              <num>a</num>
              <content>
                <p>related to a proposed decision to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9__para-i">
              <num>i</num>
              <content>
                <p>revoke the transitioned licence; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9__para-ii">
              <num>ii</num>
              <content>
                <p>refuse to vary the transitioned licence; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9__para-b">
              <num>b</num>
              <content>
                <p>was in force immediately before commencement;</p>
              </content>
            </paragraph>
            <content>
              <p>then the notice continues in force (and may be dealt with), on and after commencement, as if the notice had been given under subsection 60(1) of the new Act.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-10">
            <num>10</num>
            <heading>Transitioning appointments of authorised officers</heading>
            <content>
              <p>If an appointment under subsection 116(1) of the old Act was in force immediately before commencement in relation to an officer, the appointment continues in force (and may be dealt with), on and after commencement, as if it had been made under <ref href="#sec-69">section 69</ref> of the new Act in relation to the officer.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-11">
            <num>11</num>
            <heading>Transitioning identity cards</heading>
            <content>
              <p>If an identity card issued to an authorised officer under <ref href="#sec-117">section 117</ref> of the old Act was in force immediately before commencement, then the card continues in force (and may be dealt with) as if it had been issued to the officer under <ref href="#sec-70">section 70</ref> of the new Act.</p>
