            <p>		This Act may be cited as the <i>Education Services for Overseas Students (TPS Lev</i><i>ies</i><i>)</i><i> Act 201</i><i>2</i>.</p>

              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <heading>Interpretation</heading>
          <content>
            <p>Definitions</p>
          </content>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><b><i>administrative fee component </i></b>for a registered provider for a year has the meaning given by section 6.</p>
              <p><term refersTo="#term-base-fee-component-for-a-registered-provider-for-a-year">base fee component for a registered provider for a year</term> has the meaning given by <def><ref href="#sec-7">section 7</ref>.</def></p>
              <p><b><i>index number</i></b>, for a quarter, means the All Groups Consumer Price Index number that is the weighted average of the 8 capital cities and is published by the Australian Statistician in relation to that quarter.</p>
              <p><b><i>overseas student tuition fee</i></b><b><i>s</i></b> for a registered provider<b> </b>for a year<b> </b>is the amount of tuition fees<i> </i>received by the provider during the year<i> </i>in respect of an overseas student or intending overseas student.</p>
              <p><b><i>risk rated premium component </i></b>for a registered provider for a year has the meaning given by section 9.</p>
              <p><term refersTo="#term-september-quarter">September quarter</term> means <def>a period of 3 months starting on 1 July.</def></p>
              <p><b><i>special tuition protection component </i></b>for a registered provider for a year has the meaning given by section 10.</p>
              <p><term refersTo="#term-total-enrolments-for-a-registered-provider-for-a-year">total enrolments for a registered provider for a year</term> has the meaning given by <def><ref href="#sec-4A">section 4A</ref>.</def></p>
              <p>Expressions used in <ref href="">the Education Services for Overseas Students Act 2000</ref></p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	An expression used in this Act that is also used in the <i>Education Services for Overseas Students Act 2000</i> has the same meaning as in that Act.</p>

          </subsection>
        </section>
        <section eId="part-1__sec-4A">
          <num>4A</num>
          <heading>Total enrolments</heading>
          <subsection eId="part-1__sec-4A__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	For the purposes of this Act, the <b><i>total enrolments</i></b> for a registered provider for a year are worked out by adding together the number of enrolments of overseas students for each course for which the provider is registered in the year.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4A__subsec-2">
            <num>2</num>
            <content>
              <p>When working out the enrolments for a course for a year:</p>
            </content>
            <paragraph eId="part-1__sec-4A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>for a course of at least 26 weeks duration—each student who is enrolled in, and is undertaking, the course at any time during the year counts as one enrolment; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>for a course of 13 or more weeks, but less than 26 weeks, duration—each student who is enrolled in, and is undertaking, the course at any time during the year counts as 0.5 of an enrolment; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4A__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>for a course of less than 13 weeks duration—each student who is enrolled in, and is undertaking, the course at any time during the year counts as 0.25 of an enrolment.</p>

                <p>Working out what constitutes a course</p>

            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-4A__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of this section, a course that spans 2 or more years is taken to be a separate course in each of those years.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4A__subsec-4">
            <num>4</num>
            <content>
              <p>For the purposes of this section, a course is taken to be a separate course at each location at which the provider is registered to provide the course.</p>
            </content>
          </subsection>
        </section>

        <num>2</num>
        <heading>The amount of the TPS levy</heading>

          <heading>TPS levy</heading>
          <content>
            <p>Registered providers</p>
          </content>
          <subsection eId="part-2__sec-5__subsec-1">
            <num>1</num>
            <content>
              <p>A provider who is registered on 1 January of a year is liable to pay a TPS levy for the year.</p>
            </content>

                <p>Note:	This section extends to a registered provider whose registration has been suspended.</p>

            </authorialNote>
          </subsection>
          <subsection eId="part-2__sec-5__subsec-2">
            <num>2</num>
            <content>
              <p>The amount of the TPS levy for a registered provider for a year is the sum of the following components:</p>
            </content>
            <paragraph eId="part-2__sec-5__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the provider’s administrative fee component for the year (see <ref href="#sec-6">section 6</ref>);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the provider’s base fee component for the year (see <ref href="#sec-7">section 7</ref>);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the provider’s risk rated premium component for the year (see <ref href="#sec-9">section 9</ref>);</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>the provider’s special tuition protection component for the year (see <ref href="#sec-10">section 10</ref>).</p>

          </subsection>

            <num>3</num>
            <content>
              <p>	(3)	A provider who is not yet registered, but who is seeking to be registered under the <i>Education Services for Overseas Students Act 2000</i> in a year, is liable to pay a TPS levy for the year.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-5__subsec-4">
            <num>4</num>
            <content>
              <p>The amount of the TPS levy for such an unregistered provider for that year is the sum of the following components:</p>
            </content>
            <paragraph eId="part-2__sec-5__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>the amount under paragraph 6(a) for the year;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-5__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>the amount under paragraph 7(a) for the year.</p>

          <num>6</num>
          <heading>Administrative fee component</heading>
          <content>
            <p>		Subject to <b><i>administrative fee component</i></b> for a year is the sum of:<ref href="#sec-8">section 8</ref>, a registered provider’s </p>
          </content>
          <paragraph eId="part-2__sec-6__para-a">
            <num>a</num>
            <content>
              <p>	(a)	the amount (a <b><i>dollar amount</i></b>) determined in an instrument under section 7A for the purposes of this paragraph for that year; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-6__para-b">
            <num>b</num>
            <content>
              <p>	(b)	the amount (a <b><i>dollar amount</i></b>) determined in an instrument under section 7A for the purposes of this paragraph for that year, multiplied by the total enrolments for the provider for the previous year.</p>

          <heading>Base fee component</heading>
          <content>
            <p>		Subject to <b><i>base fee component</i></b> for a year is the sum of:<ref href="#sec-8">section 8</ref>, a registered provider’s </p>
          </content>
          <paragraph eId="part-2__sec-7__para-a">
            <num>a</num>
            <content>
              <p>	(a)	the amount (a <b><i>dollar amount</i></b>) determined in an instrument under section 7A for the purposes of this paragraph for that year; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-2__sec-7__para-b">
            <num>b</num>
            <content>
              <p>	(b)	the amount (a <b><i>dollar amount</i></b>) determined in an instrument under section 7A for the purposes of this paragraph for that year, multiplied by the total enrolments for the provider for the previous year.</p>

          <num>7A</num>
          <heading>Legislative instrument for purposes of section 6 or 7</heading>
          <content>
            <p>Calendar year beginning on <date date="2018-01-01">1 January 2018</date></p>
          </content>
          <subsection eId="part-2__sec-7A__subsec-1">
            <num>1</num>
            <content>
              <p>Before the calendar year beginning on <date date="2018-01-01">1 January 2018</date>, the Minister must, by legislative instrument, do all of the following:</p>
            </content>
            <paragraph eId="part-2__sec-7A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>determine an amount for the purposes of paragraph 6(a) for that year;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>determine an amount for the purposes of paragraph 6(b) for that year;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>determine an amount for the purposes of paragraph 7(a) for that year;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>determine an amount for the purposes of paragraph 7(b) for that year.</p>
              </content>
              <content>
                <p>Later calendar years</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-7A__subsec-2">
            <num>2</num>
            <content>
              <p>Before the calendar year beginning on <date date="2019-01-01">1 January 2019</date> or a later calendar year, the Minister may, by legislative instrument, do one or more of the following:</p>
            </content>
            <paragraph eId="part-2__sec-7A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>determine an amount for the purposes of paragraph 6(a) for that year;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>determine an amount for the purposes of paragraph 6(b) for that year;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>determine an amount for the purposes of paragraph 7(a) for that year;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>determine an amount for the purposes of paragraph 7(b) for that year.</p>
              </content>
              <content>
                <p>Upper limit</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-7A__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must not determine an amount in an instrument under this section for the purposes of paragraph 6(a) or (b) or 7(a) or (b) for a year that exceeds the following:</p>

              <num>a</num>
              <content>
                <p>for paragraph 6(a)—$107;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-3__para-b">

                <p>for paragraph 6(b)—$2.15;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-7A__subsec-3__para-c">

            <num>4</num>
            <content>
              <p>In making a legislative instrument under this section, <role refersTo="#minister">the Minister</role> must have regard to the sustainability of the OSTF.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7A__subsec-5">
            <num>5</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may also have regard to any other matter he or she considers appropriate.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-8">
          <num>8</num>
          <heading>Indexation of administrative and base fee components</heading>
          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	This section applies for the purpose of working out a dollar amount under paragraph 6(a) or (b) or 7(a) or (b) for the calendar year (the <b><i>current year</i></b>) beginning on 1 January 2019 or a later calendar year (the <b><i>current year</i></b>) if in the previous year the Minister did not make an instrument under section 7A for the purposes of that paragraph for the current year.</p>

          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>

              <p><role refersTo="#minister">The Minister</role> must cause each amount worked out under subsection (2) to be made publicly available in any manner he or she considers appropriate.</p>

        </section>

          <num>9</num>
          <heading>Risk rated premium component</heading>
          <subsection eId="part-2__sec-9__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	A registered provider’s <b><i>risk rated premium component </i></b>for a year is the sum of the provider’s risk components for each risk factor for the year.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-9__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	A registered provider’s <b><i>risk</i></b><b> </b><b><i>component </i></b>for a risk factor for a year is worked out in accordance with the following formula:</p>

                <p>a percentage for that year;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-3__para-b">

                <p>one or more risk factors that reflect the risk of calls being made on the OSTF in respect of registered providers with that factor or those factors;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-9__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>for each risk factor, the factor by which the specified percentage for that year is multiplied.</p>

              <p>	(1)	A registered provider’s <b><i>special tuition protection component</i></b> for a year is worked out in accordance with the following formula:</p>

          <heading>Rules for making legislative instrument under section 9 or 10</heading>

            <num>1</num>
            <content>
              <p>The matters referred to in subsections 9(3) and 10(2) must be included in the same legislative instrument.</p>
            </content>
            <content>
              <p>Having regard to matters</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>In making a legislative instrument under those subsections, the TPS Director must have regard to:</p>
            </content>
            <paragraph eId="part-2__sec-11__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>any advice of the Board in relation to the matters referred to in those subsections; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-11__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the sustainability of the OSTF.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-3">
            <num>3</num>
            <content>
              <p>The Director may have regard to any other matter he or she considers appropriate.</p>
            </content>
            <content>
              <p>Approval of the Treasurer</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-11__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	Before the TPS Director makes (within the meaning of the <i>Legislation Act 2003</i>) a legislative instrument under subsections 9(3) and 10(2), the Treasurer must approve the legislative instrument in writing.</p>
            </content>
          </subsection>

            <num>5</num>

              <p>An approval given under subsection (4) is not a legislative instrument.</p>

          </subsection>

        <heading>Other matters</heading>

          <num>12</num>
          <heading>Exemptions</heading>
          <content>
            <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, prescribe one or more classes of registered providers who are exempt from the requirement to pay either or both of the following:</p>
          </content>
          <paragraph eId="part-3__sec-12__para-a">
            <num>a</num>
            <content>
              <p>the base fee component (or paragraph 7(a) of the base fee component);</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-12__para-b">
            <num>b</num>
            <content>
              <p>the risk rated premium component.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-3__sec-14">
          <num>14</num>
          <heading>Imposition of requirement to pay the TPS levy</heading>
          <content>
            <p>		The requirement to pay TPS levies under the <i>Education</i> <i>Services for Overseas Students Act 2000</i> is imposed by this section.</p>

          <num>15</num>
          <heading>Section 114 of the Constitution</heading>
          <subsection eId="part-3__sec-15__subsec-1">
            <num>1</num>
            <content>
              <p>If, apart from this section, this Act would purport to operate in a way that would be invalid because of <ref href="#sec-114">section 114</ref> of the Constitution, this Act does not have that operation.</p>

          </subsection>
          <subsection eId="part-3__sec-15__subsec-2">
            <num>2</num>
            <content>
              <p>For the purposes of this section, assume that, in <ref href="#sec-114">section 114</ref> of the Constitution, State includes the Australian Capital Territory and the Northern Territory.</p>

          <heading>Regulations</heading>

            <p>The Governor-General may make regulations prescribing matters:</p>
