          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>Gambling Measures </i><i>Act 201</i><i>2</i>.</p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act commences on the day this Act receives the Royal Assent.</p>
          </content>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Object of this Act</heading>
          <content>
            <p>The object of this Act is to recognise the Commonwealth’s commitment to the development and implementation of measures to encourage responsible gambling by all gamblers, including voluntary pre-commitment on gaming machines.</p>
          </content>

        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-australian-institute-of-family-studies">Australian Institute of Family Studies</term> means <def>the Australian Institute of Family Studies established by <ref href="#part-XIV">Part XIV</ref>A of <ref href="">the Family Law Act 1975</ref>.</def></p>
            <p><term refersTo="#term-director-of-the-australian-institute-of-family-studies">Director of the Australian Institute of Family Studies</term> means <def>the Director <ref href="#sec-114A">within the meaning of section 114A</ref> of <ref href="">the Family Law Act 1975</ref>.</def></p>
            <p><term refersTo="#term-gaming-machine">gaming machine</term> has the meaning given by <def><ref href="#sec-6">section 6</ref>.</def></p>

        </section>
        <section eId="part-1__sec-6">
          <num>6</num>
          <heading>Meaning of gaming machine</heading>
          <content>
            <p>		A <b><i>gaming machine</i></b> is a device (whether wholly or partly mechanically or electronically operated) that is designed so that:</p>
          </content>
          <paragraph eId="part-1__sec-6__para-a">
            <num>a</num>
            <content>
              <p>it may be used for the purposes of playing a game of chance, or a mixed game of chance and skill; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-6__para-b">
            <num>b</num>
            <content>
              <p>it may be operated wholly or partly by:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-6__para-i">
            <num>i</num>
            <content>
              <p>inserting a token, coin or banknote into the device; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-6__para-ii">
            <num>ii</num>
            <content>
              <p>electronically transferring credits or tokens to the device; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-6__para-iii">
            <num>iii</num>
            <content>
              <p>using credits or tokens in the device (whether those credits or tokens are held, stored or accredited by the device or elsewhere); and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-6__para-c">
            <num>c</num>
            <content>
              <p>because of making a bet on the device, winnings or other rewards may become payable.</p>
            </content>
          </paragraph>
        </section>
      </part>

        <num>2</num>
        <heading>Encouraging responsible gambling</heading>
        <section eId="part-2__sec-19">
          <num>19</num>
          <heading>Encouraging responsible gambling</heading>
          <subsection eId="part-2__sec-19__subsec-1">
            <num>1</num>
            <content>
              <p>The Commonwealth recognises the importance of meaningful measures to encourage responsible gambling.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-19__subsec-2">
            <num>2</num>
            <content>
              <p>The Commonwealth supports voluntary pre-commitment on gaming machines.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-19__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	Voluntary pre-commitment allows a player of a gaming machine to set a limit on the amount that the player is prepared to lose from playing gaming machines, and helps the player<i> </i>keep to the limit. The player chooses whether to set a limit.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-2__sec-20">
          <num>20</num>
          <heading>Developing and implementing voluntary pre-commitment measure</heading>
          <subsection eId="part-2__sec-20__subsec-1">
            <num>1</num>
            <content>
              <p>The Commonwealth will work with Governments of the States and Territories, the gaming industry, academics and the community sector:</p>
            </content>
            <paragraph eId="part-2__sec-20__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>to develop and implement a voluntary pre-commitment scheme on gaming machines; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-20__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>to develop a realistic timetable for implementing this measure.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-20__subsec-2">
            <num>2</num>
            <content>
              <p>The Commonwealth will work with Governments of the States and Territories and the gaming industry:</p>
            </content>
            <paragraph eId="part-2__sec-20__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>to ensure that all gaming machines are capable of supporting a venue-based voluntary pre-commitment scheme; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-20__subsec-2__para-aa">
              <num>aa</num>
              <content>
                <p>to ensure that a venue-based voluntary pre-commitment scheme operating in a State or Territory is capable of connecting to a State or Territory wide voluntary pre-commitment scheme that operates within the State or Territory; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-20__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>to develop a realistic timetable for implementing these capabilities.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-2__sec-21">
          <num>21</num>
          <heading>Administration of voluntary pre-commitment measure</heading>
          <content>
            <p>The Commonwealth will work with Governments of the States and Territories on the most appropriate way of administering the voluntary pre-commitment measure referred to in subsection 20(1).</p>
          </content>

        <num>3</num>
        <heading>Research and other provisions</heading>
        <section eId="part-3__sec-196">
          <num>196</num>
          <heading>Research into gambling</heading>
          <subsection eId="part-3__sec-196__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	In addition to the functions under subsection 114B(2) of the <i>Family Law Act 1975</i>, the functions of the Director of the Australian Institute of Family Studies include:</p>
            </content>
            <paragraph eId="part-3__sec-196__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>undertaking or commissioning research into, or producing data and statistics about, the following:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-196__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the harm caused by gambling to problem gamblers, the families and communities of problem gamblers, and those at risk of experiencing that harm;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-196__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>measures that may be undertaken to reduce that harm;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-196__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>recreational gambling; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-196__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>increasing the capability and capacity of researchers to conduct the research and produce the data and statistics referred to in paragraph (a).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-196__subsec-3">
            <num>3</num>
            <content>
              <p>The Director, when performing a function under subsection (1), and the Australian Institute of Family Studies, when assisting the Director in the performance of that function, are to be known as the Australian Gambling Research Centre.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-196__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	For the purposes of <i>Family Law Act 1975</i>, the functions of the Director referred to in subsection (1) of this section are taken to be functions under Part XIVA of that Act.<ref href="#sec-114L">section 114L</ref>D (delegation) of the </p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-197">
          <num>197</num>
          <heading>Expert Advisory Group on Gambling</heading>
          <subsection eId="part-3__sec-197__subsec-1">
            <num>1</num>
            <content>
              <p>The Expert Advisory Group on Gambling is established by this section.</p>
            </content>
            <content>
              <p>Functions of Group</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-197__subsec-2">
            <num>2</num>
            <content>
              <p>The functions of the Group are to provide advice to the Director of the Australian Institute of Family Studies, in his or her capacity as the Director of the Australian Gambling Research Centre, in relation to the following:</p>
            </content>
            <paragraph eId="part-3__sec-197__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>strategic directions, and research plans and programs, for undertaking or commissioning research into, or producing data and statistics about, gambling;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-197__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>strategies for increasing the capability and capacity of researchers to conduct research into, or produce data and statistics about, gambling.</p>
              </content>

              </authorialNote>
              <content>
                <p>Membership of Group</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-197__subsec-3">
            <num>3</num>
            <content>
              <p>The Group consists of:</p>
            </content>
            <paragraph eId="part-3__sec-197__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the Director; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-197__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>at least 7, but no more than 11, other members.</p>
              </content>
              <content>
                <p>Appointments</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-197__subsec-4">
            <num>4</num>
            <content>
              <p>A member of the Group (other than the Director) is to be appointed by the Director by written instrument.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-197__subsec-5">
            <num>5</num>
            <content>
              <p>The Director must not appoint a person as a member of the Group unless the Director is satisfied that the person has relevant expertise.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-197__subsec-6">
            <num>6</num>
            <content>
              <p>The Director may revoke a person’s appointment to the Group.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-197__subsec-7">
            <num>7</num>
            <content>
              <p>The Director must determine, in writing, the terms and conditions of appointment of the members of the Group.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-197__subsec-8">
            <num>8</num>
            <content>
              <p>	(8)	The office of a member of the Group is not a public office within the meaning of the <i>Remuneration Tribunal Act 1973</i>.</p>
            </content>
            <content>
              <p>Directions by Director</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-197__subsec-9">
            <num>9</num>
            <content>
              <p>The Director may give the Group written directions as to:</p>
            </content>
            <paragraph eId="part-3__sec-197__subsec-9__para-a">
              <num>a</num>
              <content>
                <p>the way in which the Group is to carry out its functions; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-197__subsec-9__para-b">
              <num>b</num>
              <content>
                <p>procedures to be followed in relation to meetings.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-197__subsec-10">
            <num>10</num>
            <content>
              <p>A direction given under subsection (9) is not a legislative instrument.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-198">
          <num>198</num>
          <heading>Act does not create legally enforceable obligations etc.</heading>
          <content>
            <p>This Act (other than sections 196 and 197) does not create rights or duties that are legally enforceable in judicial or other proceedings.</p>

        </section>

          <num>201</num>
          <heading>Regulations</heading>
          <content>
            <p>The Governor-General may make regulations prescribing matters:</p>
          </content>

              <p>required or permitted by this Act to be prescribed; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-201__para-b">
            <num>b</num>

              <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
