                <p>The investigating constable must invite the suspect to nominate an accredited laboratory to which a part of the material sufficient for analysis will be provided on behalf of the suspect.</p>

                <p>If the suspect nominates an accredited laboratory, the investigating constable must ensure that:</p>
              </content>

                <p>a part of the material sufficient for analysis is provided to that laboratory, on behalf of the suspect, within the period of 28 days beginning on the day of the nomination; and</p>

            <heading>Disclosing information to private sector bodies</heading>

                <p><role refersTo="#ceo">The CEO</role> may disclose ACC information to a body corporate that is prescribed, or is included in a class of bodies corporate that is prescribed, by the regulations for the purposes of this section if:</p>

                <p><role refersTo="#ceo">the CEO</role> considers it appropriate to do so; and</p>

                <p>	(b)	the CEO considers that<i> </i>disclosing the information to the body is necessary for a permissible purpose; and</p>
              </content>
            </paragraph>

              <content>
                <p>the body has undertaken, in writing, not to use or further disclose the information except:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-i">

                <p>as referred to in subsection (3); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-ii">
              <num>ii</num>

                <p>as required by a law of the Commonwealth, a State or a Territory; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-d">
              <num>d</num>
              <content>
                <p>the body has undertaken, in writing, to comply with any conditions <role refersTo="#ceo">the CEO</role> specifies under subsection (4) or (5); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-e">
              <num>e</num>
              <content>
                <p>disclosing the ACC information:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-i">
              <num>i</num>
              <content>
                <p>would not prejudice the safety of a person, or prejudice the fair trial of a person who has been charged with an offence; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-ii">
              <num>ii</num>
              <content>
                <p>would not be contrary to a law of the Commonwealth, a State or a Territory that would otherwise apply.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	This section is subject to any relevant direction given under subsection 25A(9) (see <ref href="#sec-59A">section 59A</ref>C).</p>
              <p>Limitations on disclosing information under subsection (1)</p>
              <p>Specifying purposes and conditions etc.</p>
              <p>Offence—disclosure etc. for unauthorised purposes</p>
              <p>Penalty:	<quantity refersTo="#penaltyUnit">50 penalty units</quantity>, or <quantity refersTo="#custodialSentence">imprisonment for 12 months</quantity>, or both.</p>

                <p><role refersTo="#ceo">The CEO</role> may disclose ACC information to a body corporate under subsection (1) only if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-59AB__para-a">
              <num>a</num>
              <content>
                <p>	(a)	for information that is personal information (within the meaning of the <i>Privacy Act 1988</i>)—the CEO considers that<i> </i>disclosing the information is necessary for the purposes of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-i">
              <num>i</num>
              <content>
                <p>preventing criminal offences or activities that might constitute criminal offences (including under a law of a foreign country); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-ii">
              <num>ii</num>
              <content>
                <p>detecting criminal offences or activities that might constitute criminal offences (including under a law of a foreign country); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-iii">
              <num>iii</num>
              <content>
                <p>facilitating the collection of criminal information and intelligence in relation to criminal offences or activities that might constitute criminal offences (including under a law of a foreign country); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-b">
              <num>b</num>
              <content>
                <p>in any case—the information is not confidential commercial information relating to another body or person.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-59AB__subclause-3">

              <content>
                <p><role refersTo="#ceo">The CEO</role> must specify, in writing, any permissible purpose for which the ACC information may be used or further disclosed.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-59AB__subclause-4">
              <num>4</num>
              <content>
                <p>	(4)	If the CEO discloses ACC information that is personal information (within the meaning of the <i>Privacy Act 1988</i>) to a body corporate, the CEO must specify, in writing:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-59AB__para-a">
              <num>a</num>
              <content>
                <p>one or more conditions that the body corporate must meet in relation to monitoring and controlling any further disclosure of that information by an employee or officer of the body corporate; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-b">
              <num>b</num>
              <content>
                <p>a condition that the information is not to be disclosed to a person who is not an employee or officer of the body corporate, other than in any circumstances specified; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-c">
              <num>c</num>
              <content>
                <p>one or more conditions that the body corporate must meet in order to ensure that the information is not used or disclosed in a way that might prejudice the reputation of a person.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-59AB__subclause-5">
              <num>5</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may specify, in writing, any other conditions that <role refersTo="#ceo">the CEO</role> considers appropriate in relation to ACC information that is disclosed under, or in accordance with, this section (whether in relation to personal information or any other ACC information).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-59AB__subclause-6">
              <num>6</num>
              <content>
                <p>An instrument made under subsection (3), (4) or (5) is not a legislative instrument.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-59AB__subclause-7">
              <num>7</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-59AB__para-a">
              <num>a</num>
              <content>
                <p>ACC information is disclosed to the person under, or in accordance with, this section; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-b">
              <num>b</num>
              <content>
                <p>the person (directly or indirectly):</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-i">
              <num>i</num>
              <content>
                <p>makes a record of the information; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-ii">
              <num>ii</num>
              <content>
                <p>discloses the information to any other person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-c">
              <num>c</num>
              <content>
                <p>the record or disclosure referred to in paragraph (b) is not:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-i">
              <num>i</num>
              <content>
                <p>for a purpose specified under subsection (3) in relation to the information; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-ii">
              <num>ii</num>
              <content>
                <p>required by any other law.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-59AB__subclause-8">
              <num>8</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-59AB__para-a">
              <num>a</num>
              <content>
                <p>ACC information is disclosed to the person under, or in accordance with, this section; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#ceo">the CEO</role> specifies a condition under subsection (4) or (5) in relation to the information; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-c">
              <num>c</num>
              <content>
                <p>the person does an act or omits to do an act in relation to the information; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-d">
              <num>d</num>
              <content>
                <p>the act or omission breaches the condition.</p>
              </content>
            </paragraph>

                <p>Subsections (7) and (8) do not apply to a person in relation to ACC information if:</p>
              </content>
            </hcontainer>

                <p>the information is in the public domain before the person:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-i">
              <num>i</num>
              <content>
                <p>makes the record, or discloses the information (if subsection (7) applies); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-ii">
              <num>ii</num>
              <content>
                <p>does the act or omits to do the act in relation to the information (if subsection (8) applies); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-b">
              <num>b</num>
              <content>
                <p>the original disclosure of the information into the public domain (before the person does the thing referred to in subparagraph (a)(i) or (ii) of this subsection) was not:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-59AB__para-i">
              <num>i</num>
              <content>
                <p>in contravention of <ref href="#sec-51">section 51</ref> or subsection (7) or (8) of this section; or</p>
              </content>
            </paragraph>

                <p>in breach of an undertaking given under subsection (1) of this section.</p>

            <heading>Confidentiality in relation to examinations</heading>

              <p>Sections 59, 59AA and 59AB are subject to any relevant direction as in force under subsection 25A(9) (confidentiality in relation to examinations).</p>

                <p>A constable or Commonwealth officer, who is not a member of the staff of the ACC, may use a returnable item for all or any of the purposes referred to in subsection (1) if it is necessary to do so for that purpose.</p>

              <num>3</num>
              <content>
                <p>The head of the special ACC operation/investigation to which a returnable item relates may make the item available to another member of the staff of the ACC to use for the purpose of the performance of all or any of the functions referred to in <ref href="#sec-7A">section 7A</ref> or 7C.</p>

              <num>4</num>

                <p>A member of the staff of the ACC may use a returnable item for the purpose of the performance of all or any of the functions referred to in <ref href="#sec-7A">section 7A</ref> or 7C.</p>

              <num>5</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may make a returnable item available to a constable or Commonwealth officer to use for any purpose for which the making available of the item is required or authorised by a law of a State or Territory.</p>

              <num>6</num>
              <content>
                <p>A constable or Commonwealth officer may use a returnable item for any other use that is required or authorised by or under a law of a State or a Territory.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-3__clause-24AA__subclause-7">
              <num>7</num>
              <content>
                <p>To avoid doubt, this section does not limit any other law of the Commonwealth that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-24AA__para-a">
              <num>a</num>
              <content>
                <p>requires or authorises the use of a document or other thing; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AA__para-b">
              <num>b</num>
              <content>
                <p>requires or authorises the making available (however described) of a document or other thing.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-24AA__subclause-8">
              <num>8</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may make a returnable item available to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-24AA__para-a">
              <num>a</num>
              <content>
                <p>a State or Territory law enforcement agency; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AA__para-b">
              <num>b</num>
              <content>
                <p>an agency that has responsibility for:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AA__para-i">
              <num>i</num>
              <content>
                <p>law enforcement in a foreign country; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AA__para-ii">
              <num>ii</num>
              <content>
                <p>intelligence gathering for a foreign country; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AA__para-iii">
              <num>iii</num>
              <content>
                <p>the security of a foreign country;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AA__para-c">
              <num>c</num>
              <content>
                <p>preventing, investigating or prosecuting an offence against a law of a State or Territory;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AA__para-d">
              <num>d</num>
              <content>
                <p>	(d)	proceedings under a corresponding law (within the meaning of the <i>Proceeds of Crime Act 1987</i> or the <i>Proceeds of Crime Act 2002</i>);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AA__para-e">
              <num>e</num>
              <content>
                <p>proceedings for the forfeiture of the item under a law of a State or Territory;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AA__para-f">
              <num>f</num>
              <content>
                <p>	(f)	deciding whether to institute proceedings or to take any other action mentioned in any of paragraphs 3ZQU(1)(a) to (l) (inclusive) of the <i>Crimes Act 1914</i>, subsection (5) or (6) of this section, or paragraph (c), (d) or (e) of this subsection.</p>

            </paragraph>

              <num>9</num>
              <content>
                <p>This section does not prevent <role refersTo="#minister">the Minister</role> from making an arrangement with a Minister of a State or Territory for:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-24AA__para-a">
              <num>a</num>
              <content>
                <p>the making available to a State or Territory law enforcement agency of that State or Territory, for purposes mentioned in subsections (1), (6) and (8), of returnable items; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AA__para-b">
              <num>b</num>
              <content>
                <p>the disposal by the agency of such items when they are no longer of use to that agency for those purposes.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-3__clause-24AB">
            <num>24AB</num>
            <heading>When returnable items must be returned</heading>
            <hcontainer name="subclause" eId="schedule-3__clause-24AB__subclause-1">
              <num>1</num>
              <content>
                <p>If <role refersTo="#ceo">the CEO</role> is satisfied that a returnable item is not required (or is no longer required) for a purpose mentioned in section 24AA or for other judicial or administrative review proceedings, <role refersTo="#ceo">the CEO</role> must take reasonable steps to return the item to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-24AB__para-a">
              <num>a</num>
              <content>
                <p>the person from whom the item was seized, or the person who produced the item; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AB__para-b">
              <num>b</num>
              <content>
                <p>the owner, if the person mentioned in paragraph (a) is not entitled to possess it.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-24AB__subclause-2">
              <num>2</num>
              <content>
                <p>However, <role refersTo="#ceo">the CEO</role> does not have to take those steps if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-24AB__para-a">
              <num>a</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AB__para-i">
              <num>i</num>
              <content>
                <p>the returnable item may be retained because of an order under subsection 24AC(2), or any other order under that subsection has been made in relation to the item; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AB__para-ii">
              <num>ii</num>
              <content>
                <p><role refersTo="#ceo">the CEO</role> has applied for such an order and the application has not been determined; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AB__para-b">
              <num>b</num>
              <content>
                <p>the returnable item may otherwise be retained, destroyed or disposed of under a law, or an order of a court or tribunal, of the Commonwealth or of a State or a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AB__para-c">
              <num>c</num>
              <content>
                <p>the returnable item is forfeited or forfeitable to the Commonwealth or is the subject of a dispute as to ownership.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-24AB__subclause-3">
              <num>3</num>
              <content>
                <p>To avoid doubt, if the returnable item is a document, <role refersTo="#ceo">the CEO</role> is required to take reasonable steps to return the document only if the ACC took possession of that document.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-3__clause-24AC">
            <num>24AC</num>
            <heading>Issuing officer may permit a returnable item to be retained, forfeited etc.</heading>
            <hcontainer name="subclause" eId="schedule-3__clause-24AC__subclause-1">
              <num>1</num>
              <content>
                <p>An issuing officer may, on application by <role refersTo="#ceo">the CEO</role>, make an order under subsection (2) in relation to a returnable item.</p>
              </content>
            </hcontainer>

              <p>Preventing use in committing terrorist act, terrorism offence or serious offence</p>

                <p>The issuing officer may make any of the orders referred to in subsection (3) if the issuing officer is satisfied that there are reasonable grounds to suspect that, if the returnable item is returned to either of the following persons, the item is likely to be used by that person or another person in the commission of a terrorist act, a terrorism offence or a serious offence:</p>

            </hcontainer>
            <paragraph eId="schedule-3__clause-24AC__para-a">
              <num>a</num>
              <content>
                <p>the owner of the item;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AC__para-b">
              <num>b</num>
              <content>
                <p>the person from whom the item was seized, or the person who produced the item.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-24AC__subclause-3">
              <num>3</num>
              <content>
                <p>The orders are as follows:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-24AC__para-a">
              <num>a</num>
              <content>
                <p>an order that the item may be retained for the period specified in the order;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AC__para-b">
              <num>b</num>
              <content>
                <p>an order that the item is forfeited to the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AC__para-c">
              <num>c</num>
              <content>
                <p>if the item is not a document—an order that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AC__para-i">
              <num>i</num>
              <content>
                <p>the item be sold and the proceeds given to the owner of the item; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AC__para-ii">
              <num>ii</num>
              <content>
                <p>the item be sold in some other way;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AC__para-d">
              <num>d</num>
              <content>
                <p>an order that the item is to be destroyed or otherwise disposed of.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-24AC__subclause-4">
              <num>4</num>
              <content>
                <p>The issuing officer must order that the returnable item be returned to the following person if the issuing officer is not satisfied as mentioned in subsection (2):</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-24AC__para-a">
              <num>a</num>
              <content>
                <p>the person from whom the item was seized, or the person who produced the item;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AC__para-b">
              <num>b</num>
              <content>
                <p>if the person referred to in paragraph (a) is not entitled to possess the item—the owner of the item.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-3__clause-24AC__subclause-5">
              <num>5</num>
              <content>
                <p>Before making the application, <role refersTo="#ceo">the CEO</role> must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-3__clause-24AC__para-a">
              <num>a</num>
              <content>
                <p>take reasonable steps to discover who has an interest in the returnable item; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-24AC__para-b">
              <num>b</num>
              <content>
                <p>if it is practicable to do so, notify each person who <role refersTo="#ceo">the CEO</role> believes to have such an interest of the proposed application.</p>
              </content>
            </paragraph>

              <num>6</num>
              <content>
                <p>The issuing officer must allow a person who has an interest in the returnable item to appear and be heard in determining the application.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-3__clause-24AC__subclause-7">
              <num>7</num>
              <content>
                <p>A function of making an order under this section is conferred on an issuing officer in a personal capacity and not as a court or a member of a court.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-3__clause-24AC__subclause-8">
              <num>8</num>
              <content>
                <p>An issuing officer performing a function of, or connected with, making an order under this section has the same protection and immunity as if he or she were performing that function as, or as a member of, a court (being the court of which the issuing officer is a member).</p>

                <p>The Integrity Commissioner may include a notation in the notice to the effect that disclosure of information about:</p>
              </content>

                <p>the notice; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77A__para-b">
              <num>b</num>

                <p>any official matter connected with the notice;</p>

            </paragraph>

                <p>The Integrity Commissioner must include a notation in the notice if the Integrity Commissioner is satisfied that failure to do so would reasonably be expected to prejudice:</p>

              <num>a</num>
              <content>
                <p>a person’s safety or reputation; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77A__para-b">
              <num>b</num>
              <content>
                <p>the fair trial of a person who has been, or may be, charged with an offence; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77A__para-c">
              <num>c</num>

                <p>the investigation to which the notice relates or another corruption investigation; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77A__para-d">
              <num>d</num>

                <p>any action taken as a result of an investigation referred to in paragraph (c).</p>

            </paragraph>

                <p>The Integrity Commissioner may include a notation in the notice if the Integrity Commissioner is satisfied that:</p>

                <p>failure to do so might prejudice:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77A__para-i">

                <p>a person’s safety or reputation; or</p>

                <p>failure to do so might otherwise be contrary to the public interest.</p>
              </content>
            </paragraph>

              <num>5</num>
              <content>
                <p>The Integrity Commissioner must not include a notation in the notice in any other case.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-4__clause-77A__subclause-6">
              <num>6</num>
              <content>
                <p>If a notation is included in the notice, it must be accompanied by a written statement setting out the rights and obligations conferred or imposed by <ref href="#sec-77B">section 77B</ref> on the person on whom the notice is served.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-4__clause-77A__subclause-7">
              <num>7</num>
              <content>
                <p>A notation included in the notice is cancelled by this subsection if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-77A__para-a">
              <num>a</num>
              <content>
                <p>the Integrity Commissioner concludes the investigation to which the notice relates; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77A__para-b">
              <num>b</num>
              <content>
                <p>any criminal proceedings or civil penalty proceedings resulting from the investigation are commenced.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-77A__subclause-8">
              <num>8</num>
              <content>
                <p>If a notation is cancelled by subsection (7), the Integrity Commissioner must advise the person who was served with the notated notice, in writing, of the cancellation.</p>
              </content>
            </hcontainer>

              <num>9</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-77A__para-a">
              <num>a</num>
              <content>
                <p>a notation has been included in the notice in relation to the disclosure of information about the notice or any official matter connected with the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77A__para-b">
              <num>b</num>
              <content>
                <p>the notation has not been cancelled; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77A__para-c">
              <num>c</num>
              <content>
                <p>	(c)	apart from this subsection, a credit reporting agency (<i>Privacy Act 1988</i>) would be required, under subsection 18K(5) of that Act, to make a note about the disclosure of the information;<ref href="#sec-11A">within the meaning of section 11A</ref> of the </p>

            <heading>Offences of disclosure</heading>

                <p>A person commits an offence if:</p>

                <p>the person is served with a notice under <ref href="#sec-75">section 75</ref>; and</p>

            </paragraph>

                <p>the notice includes a notation under <ref href="#sec-77A">section 77A</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77B__para-c">
              <num>c</num>
              <content>
                <p>the person discloses the existence of, or any information about:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77B__para-i">
              <num>i</num>
              <content>
                <p>the notice; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77B__para-ii">
              <num>ii</num>
              <content>
                <p>any official matter connected with the notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77B__para-d">
              <num>d</num>
              <content>
                <p>when the disclosure is made:</p>
              </content>
            </paragraph>

                <p>the notation has not been cancelled by subsection 77A(7); and</p>

                <p>the period of 5 years after the notice is served under <ref href="#sec-75">section 75</ref> has not ended.</p>

              </content>
            </paragraph>

                <p>to a legal practitioner for the purpose of obtaining legal advice or representation in relation to the notice; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77B__para-c">
              <num>c</num>
              <content>
                <p>to a legal aid officer for the purpose of seeking assistance under <ref href="#sec-221">section 221</ref> in relation to the notice; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77B__para-d">
              <num>d</num>
              <content>
                <p>if the person is a body corporate—to an officer or agent of the body corporate for the purpose of ensuring compliance with the notice; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77B__para-e">
              <num>e</num>
              <content>
                <p>if the person is a legal practitioner—for the purpose of obtaining the agreement of another person under subsection 79(3) to the legal practitioner answering a question or producing a document or thing.</p>
              </content>
            </paragraph>

                <p>A person commits an offence if:</p>
              </content>

            </paragraph>
            <paragraph eId="schedule-4__clause-77B__para-i">

                <p>a notice under <ref href="#sec-75">section 75</ref> that includes a notation under <ref href="#sec-77A">section 77A</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77B__para-ii">
              <num>ii</num>
              <content>
                <p>any official matter connected with a notice under <ref href="#sec-75">section 75</ref> that includes a notation under <ref href="#sec-77A">section 77A</ref>; and</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>the disclosure is permitted under subsection (2) or (4) because the person is a person of a particular kind; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77B__para-c">
              <num>c</num>
              <content>
                <p>while the person is a person of that kind, the person discloses the existence of, or any information about:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77B__para-i">
              <num>i</num>
              <content>
                <p>the notice; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-77B__para-ii">
              <num>ii</num>
              <content>
                <p>any official matter connected with the notice; and</p>
              </content>

                <p>when the disclosure by the person is made:</p>
              </content>
            </paragraph>

                <p>the notation has not been cancelled by subsection 77A(7); and</p>

                <p>to another officer or agent of the body corporate for the purpose of ensuring compliance with the notice; or</p>
              </content>
            </paragraph>

                <p>to a legal practitioner for the purpose of obtaining legal advice or representation in relation to the notice; or</p>
              </content>
            </paragraph>

                <p>to a legal aid officer for the purpose of seeking assistance under <ref href="#sec-221">section 221</ref> in relation to the notice; or</p>

                <p>creates a disturbance, or takes part in creating or continuing a disturbance, in or near a place that the person knows is being used to hold a hearing for the purpose of:</p>

                <p>investigating a corruption issue; or</p>
              </content>
            </paragraph>

                <p>interrupts a hearing that is being held for the purpose of:</p>
              </content>
            </paragraph>

            <paragraph eId="schedule-4__clause-96A__para-ii">

                <p>threatens a person present at a hearing that is being held for the purpose of:</p>

            </paragraph>
            <paragraph eId="schedule-4__clause-96A__para-ii">

                <p>conducting a public inquiry.</p>

            </paragraph>

                <p>Subparagraph (1)(a)(iv) does not apply in the case of a legal practitioner who refuses or fails to answer a question at a hearing on the ground that the answer to the question would disclose a privileged communication made by or to the legal practitioner in his or her capacity as a legal practitioner.</p>

            <heading>Federal Court or Supreme Court to deal with contempt</heading>
            <content>
              <p>Application</p>
              <p>How court may deal with application</p>
              <p>the court to which the application was made finds that the person was in contempt of ACLEI, the court may deal with the person as if the acts or omissions involved constituted a contempt of that court.</p>
            </content>

              <content>
                <p>If, in respect of a hearing, the Integrity Commissioner is of the opinion that a person is in contempt of ACLEI, the Integrity Commissioner may apply to either of the following courts for the person to be dealt with in relation to the contempt:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-96B__para-a">
              <num>a</num>
              <content>
                <p>the Federal Court;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-96B__para-b">
              <num>b</num>
              <content>
                <p>the Supreme Court of the State or Territory in which the hearing is held.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-96B__subclause-2">
              <num>2</num>
              <content>
                <p>Before making the application, the Integrity Commissioner must inform the person that the Integrity Commissioner proposes to make the application.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-4__clause-96B__subclause-3">
              <num>3</num>
              <content>
                <p>The application must be accompanied by a certificate that states:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-96B__para-a">
              <num>a</num>
              <content>
                <p>the grounds for making the application; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-96B__para-b">
              <num>b</num>
              <content>
                <p>evidence in support of the application.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-96B__subclause-4">

              <content>
                <p>A copy of the certificate must be given to the person before, or at the same time as, the application is made.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-4__clause-96B__subclause-5">

              <content>
                <p>To avoid doubt, if the Integrity Commissioner makes an application under this section, the Integrity Commissioner need not give the evidence to the relevant person or authority under <ref href="#sec-142">section 142</ref>.</p>
              </content>

            <hcontainer name="subclause" eId="schedule-4__clause-96B__subclause-6">

                <p>If, after:</p>

                <p>hearing or receiving any evidence or statements by or in support of ACLEI; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-96B__para-c">
              <num>c</num>
              <content>
                <p>hearing or receiving any evidence or statements by or in support of the person;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-96B__subclause-7">

                <p>	(7)	For the purposes of determining whether a person is in contempt of ACLEI under subsection (1), Chapter 2 of the <i>Criminal Code</i> applies as if:</p>

              <content>
                <p>being in contempt of ACLEI were an offence; and</p>
              </content>
            </paragraph>

                <p>references to a person being criminally responsible for an offence were references to a person being responsible for being in contempt of ACLEI.</p>
              </content>
            </paragraph>
          </hcontainer>

            <heading>Conduct of contempt proceedings</heading>
            <hcontainer name="subclause" eId="schedule-4__clause-96C__subclause-1">
              <num>1</num>
              <content>
                <p>This section applies if an application is made to the Federal Court or to the Supreme Court of a State or Territory under <ref href="#sec-96B">section 96B</ref>.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-4__clause-96C__subclause-2">
              <num>2</num>
              <content>
                <p>Proceedings in relation to the application are, subject to this Act, to be instituted, carried on, heard and determined in accordance with the laws (including any Rules of Court) that apply in relation to the punishment of a contempt of the court to which the application was made.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-4__clause-96C__subclause-3">
              <num>3</num>
              <content>
                <p>In proceedings relating to the application, a certificate under subsection 96B(3) is prima facie evidence of the matters specified in the certificate.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-4__clause-96D">
            <num>96D</num>
            <heading>Person in contempt may be detained</heading>
            <hcontainer name="subclause" eId="schedule-4__clause-96D__subclause-1">
              <num>1</num>
              <content>
                <p>If the Integrity Commissioner proposes to make an application under subsection 96B(1) in respect of a person, the Integrity Commissioner may, during the hearing concerned, direct a constable or an authorised officer to detain the person for the purpose of bringing the person before the relevant court for the hearing of the application.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-4__clause-96D__subclause-2">
              <num>2</num>
              <content>
                <p>If the person is so detained:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-96D__para-a">
              <num>a</num>
              <content>
                <p>the Integrity Commissioner must apply to the court as soon as practicable under subsection 96B(1) in respect of the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-96D__para-b">
              <num>b</num>
              <content>
                <p>the person must, subject to subsection (3) of this section, be brought before the court as soon as practicable.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-96D__subclause-3">
              <num>3</num>
              <content>
                <p>The court may:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-96D__para-a">
              <num>a</num>
              <content>
                <p>direct that the person be released from detention on condition that he or she will appear before the court in relation to the application; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-96D__para-b">
              <num>b</num>
              <content>
                <p>order that the person continue to be detained until the application is determined.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-96D__subclause-4">
              <num>4</num>
              <content>
                <p>The court may also impose any other condition on the release, for example:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-96D__para-a">
              <num>a</num>
              <content>
                <p>that the person surrender his or her passport; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-96D__para-b">
              <num>b</num>

                <p>that the person give an undertaking as to his or her living arrangements; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-96D__para-c">
              <num>c</num>
              <content>
                <p>that the person report as required to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-96D__para-i">
              <num>i</num>
              <content>
                <p>the AFP; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-96D__para-ii">
              <num>ii</num>
              <content>
                <p>a police force or police service of a State; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-96D__para-iii">
              <num>iii</num>
              <content>
                <p>any other authority or person responsible for the enforcement of the laws of the Commonwealth or of the States.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-96D__subclause-5">
              <num>5</num>
              <content>
                <p>The court may at any time vary or revoke a condition imposed under subsection (4).</p>
              </content>
            </hcontainer>
          </hcontainer>

            <heading>Integrity Commissioner may withdraw contempt application</heading>
            <hcontainer name="subclause" eId="schedule-4__clause-96E__subclause-1">
              <num>1</num>

                <p>The Integrity Commissioner may, at any time, withdraw an application under subsection 96B(1).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-4__clause-96E__subclause-2">
              <num>2</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-96E__para-a">
              <num>a</num>
              <content>
                <p>the Integrity Commissioner does so; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-96E__para-b">
              <num>b</num>
              <content>
                <p>the person to whom the application relates is in detention under <ref href="#sec-96D">section 96D</ref>;</p>
              </content>
            </paragraph>
            <content>
              <p>the person must be released from detention immediately.</p>
            </content>
          </hcontainer>

            <heading>Double jeopardy</heading>

                <p>If an act or omission by a person is an offence against this Act and is also an offence against a law of a State, the person may be prosecuted and convicted under this Act or under that law of that State in respect of the act or omission, but nothing in this Act renders a person liable to be punished twice in respect of the same act or omission.</p>

                <p>If the Attorney-General refuses to make a parole order for a person under subsection (1) or paragraph (b) of this subsection, the Attorney-General must:</p>

                <p>give the person a written notice, <quantity refersTo="#deadline">within 14 days</quantity> after the refusal, that:</p>

              </content>

                <p>reconsider the making of a parole order for the person and either make, or refuse to make, such an order, <quantity refersTo="#deadline">within 12 months</quantity> after the refusal.</p>

                <p>if it is proposed that the supervision period for a person released on parole subject to supervision should end before the end of the person’s parole period—specify the day on which the supervision period ends.</p>
              </content>
            </paragraph>

                <p>Despite subsection (1), if the person will be serving a State or Territory sentence on the day after the end of the non-parole period, the requirement under that subsection to make, or refuse to make, a parole order does not apply:</p>

                <p>for a federal sentence, or federal sentences, that include a life sentence—until the release of the person from prison for the State or Territory offence (but a decision may be made under that subsection at any time during the 3 month period before the person’s expected release); and</p>

                <p>in any case—if the State or Territory sentence is a life sentence for which a non-parole period has not been fixed.</p>

            <heading>Release on parole—when is a person released</heading>
            <hcontainer name="subclause" eId="schedule-7__clause-19AM__subclause-1">
              <num>1</num>

                <p>A person must be released from prison on parole in accordance with a parole order on whichever of the following days is applicable (subject to subsections (2) and (3) and 19AZD(2)):</p>

                <p>for a parole order made before the end of the non-parole period—the earlier of the following days:</p>

                <p>an earlier day (if any) specified in the parole order for the purposes of this subparagraph (not being earlier than 30 days before the end of the non-parole period);</p>

            </paragraph>
            <paragraph eId="schedule-7__clause-19AM__para-b">
              <num>b</num>
              <content>
                <p>for a parole order made after the end of the non-parole period—the later of the following days:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-19AM__para-i">
              <num>i</num>
              <content>
                <p>the day after the parole order is made;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-19AM__para-ii">
              <num>ii</num>
              <content>
                <p>a later day (if any) specified in the parole order for the purposes of this subparagraph (not being later than 30 days after the order is made).</p>
              </content>
            </paragraph>
            <content>
              <p>Note 1:	Subsection (2) of this section provides a different release day if the person is imprisoned for a State or Territory offence on the release day that would otherwise apply under this subsection.</p>
              <p>Note 2:	Subsection (3) requires the person to certify his or her acceptance of the parole order conditions before he or she may be released.</p>
              <p>Note 3:	Subsection 19AZD(2) may allow a person to be released slightly earlier than the day that would otherwise apply under this subsection (for example if the release day would otherwise fall on a weekend or public holiday).</p>
              <p>Note:	A person released on parole must comply with any conditions of the parole order during the parole period (see sections 19AN and 19AU).</p>
            </content>

              <num>2</num>

                <p>However, if the person is imprisoned for a State or Territory offence on the day he or she would otherwise be eligible for release under subsection (1), the person must be released from prison on parole in accordance with the parole order on the same day he or she is released from prison (including on parole) for the State or Territory offence.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-7__clause-19AM__subclause-3">
              <num>3</num>
              <content>
                <p>Despite subsections (1) and (2), the person must not be released from prison on parole in accordance with the parole order unless, before, on or after the release day provided by subsection (1) or (2), the person certifies on the parole order (or a copy of the order) that he or she accepts the conditions to which the order is subject.</p>

            <num>19AMA</num>
            <heading>Release on parole—parole period</heading>
            <hcontainer name="subclause" eId="schedule-7__clause-19AMA__subclause-1">
              <num>1</num>

                <p>	(1)	For the purposes of this Part, the <b><i>parole period</i></b> for a person for whom a parole order has been made is the period starting in accordance with subsection (2) and ending in accordance with subsection (3).</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	A person released on parole must comply with any conditions of the parole order during the parole period (see sections 19AN and 19AU).</p>
            </content>

                <p>The person’s parole period starts at the earlier of the following times:</p>
              </content>
            </hcontainer>

                <p>when the person is released from prison on parole;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-19AMA__para-b">

                <p>if the person is serving a State or Territory sentence at the time the parole order is made—when the person certifies on the parole order (or a copy of the order) that he or she accepts the conditions to which the order is subject.</p>

                <p>The person’s parole period ends:</p>
              </content>
            </hcontainer>

                <p>at the end of the last day of any federal sentence that is, on the day of the release, being served or to be served (after deducting any remission or reduction that is applicable); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-19AMA__para-b">
              <num>b</num>
              <content>
                <p>if the person has been given a federal life sentence—at the later of the following times:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-19AMA__para-i">
              <num>i</num>
              <content>
                <p>5 years after the person is released from prison on parole in accordance with <ref href="#sec-19A">section 19A</ref>M;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-7__clause-19AMA__para-ii">
              <num>ii</num>
              <content>
                <p>the end of a later day (if any) specified in the parole order for the purposes of this subparagraph (not being a day earlier than 5 years after the person’s expected release from prison in accordance with the order).</p>

            <heading>Paragraph 19AN(1)(b)</heading>

              </p>
              <p>Amending laws are annotated in the legislation history and amendment history.</p>
              <p>The legislation history in endnote 3 provides information about each law that has amended (or will amend) the compiled law. The information includes commencement details for amending laws and details of any application, saving or transitional provisions that are not included in this compilation.</p>
              <p>The amendment history in endnote 4 provides information about amendments at the provision (generally section or equivalent) level. It also includes information about any provision of the compiled law that has been repealed in accordance with a provision of the law.</p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
              <p>If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.</p>
