          <heading>Short title</heading>
          <content>
            <p>		This Act may be cited as the <i>National Radioactive Waste Management Act 201</i><i>2</i><i>.</i></p>
          </content>
        </section>
        <section eId="part-1__sec-2">
          <num>2</num>
          <heading>Commencement</heading>
          <content>
            <p>This Act commences on the day this Act receives the Royal Assent.</p>
          </content>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Object of Act</heading>
          <subsection eId="part-1__sec-3__subsec-1">
            <num>1</num>
            <content>
              <p>The object of this Act is to ensure that controlled material is safely and securely managed by providing for:</p>
            </content>
            <paragraph eId="part-1__sec-3__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the selection of a site for a radioactive waste management facility on land in Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-3__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the establishment and operation of such a facility on the selected site.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-3__subsec-2">
            <num>2</num>
            <content>
              <p>By ensuring that controlled material is safely and securely managed, this Act, among other things, gives effect to certain obligations that Australia has as a party to the Joint Convention, in particular, Australia’s obligations under Chapters 3 and 4 of the Joint Convention.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-aboriginal-land">Aboriginal land</term> means <def>Aboriginal land within the meaning of the Aboriginal Land Rights (Northern Territory) Act 1976.</def></p>
            <p><b><i>authority</i></b> means:</p>
          </content>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>in relation to a State:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-i">
            <num>i</num>
            <content>
              <p>a body corporate established for a public purpose by or under a law of the State; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-ii">
            <num>ii</num>
            <content>
              <p>an incorporated company in which the State, or a body corporate mentioned in subparagraph (a)(i), has a controlling interest; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>in relation to a Territory:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-i">
            <num>i</num>
            <content>
              <p>a body corporate established for a public purpose by or under a law of the Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-ii">
            <num>ii</num>
            <content>
              <p>an incorporated company in which the Territory, or a body corporate mentioned in subparagraph (b)(i), has a controlling interest.</p>
            </content>
            <content>
              <p><b><i>Commonwealth contractor </i></b>means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>a person who is a party to a contract with the Commonwealth or a Commonwealth entity; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>a person who is a subcontractor for a contract with the Commonwealth or a Commonwealth entity.</p>
            </content>
            <content>
              <p><b><i>Commonwealth entity </i></b>means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>a body corporate established for a public purpose by or under an Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>a company in which a controlling interest is held by any one of the following persons, or any 2 or more of the following persons together:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-i">
            <num>i</num>
            <content>
              <p>the Commonwealth;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-ii">
            <num>ii</num>
            <content>
              <p>a body covered by paragraph (a).</p>
            </content>
            <content>
              <p><b><i>controlled material</i></b>: see section 4A.</p>
              <p><term refersTo="#term-facility">facility</term> means <def>a facility for the management of controlled material.</def></p>
              <p><term refersTo="#term-general-nomination-start-time">general nomination start time</term> means <def>the time at which a declaration under <ref href="#sec-6">section 6</ref> takes effect.</def></p>
              <p><term refersTo="#term-high-level-radioactive-material">high level radioactive material</term> means <def>material which has a thermal energy output of at least 2 kilowatts per cubic metre.</def></p>
              <p><b><i>host community</i></b>, for a facility, means the community located in the local government area in which the facility is situated.</p>
              <p><term refersTo="#term-joint-convention">Joint Convention</term> means <def>the Joint Convention on the Safety of Spent Fuel Management and on the Safety of Radioactive Waste Management, done at Vienna on 5 September 1997, as amended and in force for Australia from time to time.</def></p>
              <p><term refersTo="#term-land-council">Land Council</term> means <def>a Land Council within the meaning of the Aboriginal Land Rights (Northern Territory) Act 1976.</def></p>
              <p><term refersTo="#term-land-trust">Land Trust</term> means <def>a Land Trust within the meaning of the Aboriginal Land Rights (Northern Territory) Act 1976.</def></p>
              <p><term refersTo="#term-local-government-area">local government area</term> means <def>an area that, at the time the Minister makes a declaration under subsection 14(2) in relation to a site, is an area for which a local government body is constituted by or under a law of the State or Territory in which the site is situated.</def></p>
              <p><term refersTo="#term-nominator-of-land">nominator of land</term> means <def>the following: a Land Council that nominated the land as a potential site under subsection 5(1); a person who nominated the land as a potential site under subsection 7(2) or (3). <b><i>NRWMF Community Fund entity</i></b>: see subsection 34AA(1).</def></p>

            <num>a</num>
            <content>
              <p>a Land Council that nominated the land as a potential site under subsection 5(1);</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>a person who nominated the land as a potential site under subsection 7(2) or (3).</p>
            </content>
            <content>
              <p><b><i>NRWMF Community Fund entity</i></b>: see subsection 34AA(1).</p>
              <p><term refersTo="#term-selected-site">selected site</term> means <def>the site, or the specified part of a site, in relation to which a declaration by the Minister under subsection 14(2) is in effect.</def></p>
              <p><term refersTo="#term-site">site</term> means <def>a site approved by the Minister under <ref href="#sec-9">section 9</ref>.</def></p>
              <p><term refersTo="#term-spent-nuclear-fuel">spent nuclear fuel</term> means <def>material that: is or was capable of producing energy by a self-sustaining chain process of nuclear fission; and has been irradiated in, and permanently removed from, a nuclear reactor (which is a structure containing material to which paragraph (a) applies in such an arrangement that a self-sustaining chain process of nuclear fission can occur in the structure without an additional source of neutrons). <b><i>statutory authority</i></b>, in relation to the Crown in right of the Commonwealth, a State or a Territory, means any authority or body (including a corporation sole) established by a law of the Commonwealth, the State or Territory other than a general law allowing incorporation as a company or body corporate. <b><i>subcontractor</i></b>, for a contract, means a person who is a party to: 	(a)	a contract with a Commonwealth contractor (within the meaning of paragraph (a) of the definition of <b><i>Commonwealth contractor</i></b>); or a contract with another subcontractor (under a previous application of this definition).</def></p>

            <content>
              <p>is or was capable of producing energy by a self-sustaining chain process of nuclear fission; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>has been irradiated in, and permanently removed from, a nuclear reactor (which is a structure containing material to which paragraph (a) applies in such an arrangement that a self-sustaining chain process of nuclear fission can occur in the structure without an additional source of neutrons).</p>

            <content>

              <p>a contract with another subcontractor (under a previous application of this definition).</p>
            </content>
            <content>
              <p><term refersTo="#term-traditional-aboriginal-owners">traditional Aboriginal owners</term> means <def>traditional Aboriginal owners within the meaning of the Aboriginal Land Rights (Northern Territory) Act 1976.</def></p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-4A">
          <num>4A</num>
          <heading>Meaning of controlled material</heading>
          <subsection eId="part-1__sec-4A__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	<b><i>Controlled material</i></b> means controlled material within the meaning of the <i>Australian Radiation Protection and Nuclear Safety Act 1998</i> that is controlled material to which subsections (2) and (3) apply.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4A__subsec-2">
            <num>2</num>
            <content>
              <p>This subsection applies to controlled material if:</p>
            </content>
            <paragraph eId="part-1__sec-4A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>	(a)	it has been used in Australia, generated by activities in Australia, or sent to Australia under contractual arrangements relating to the conditioning or reprocessing of ANSTO spent nuclear fuel (within the meaning of the<i> Australian Nuclear Science and Technology Organisation Act 1987</i>); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4A__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>it is not high level radioactive material or spent nuclear fuel.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-4A__subsec-3">
            <num>3</num>
            <content>
              <p>This subsection applies to controlled material if it is one or more of the following:</p>
            </content>
            <paragraph eId="part-1__sec-4A__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>controlled material that is radioactive waste (within the meaning of the Joint Convention);</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4A__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>controlled material that is generated as a result of activities that relate to the defence of Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4A__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>	(c)	controlled material that needs to be securely managed to prevent its use in the commission of a terrorist act (within the meaning of the <i>Crimes Act 1914</i>);</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4A__subsec-3__para-d">
              <num>d</num>
              <content>

                <p>A nomination must:</p>

                  <p>specify the land nominated by reference to portion number (if any), survey points (if available) and geographical coordinates; and</p>

                  <p>contain evidence of all interests in the land; and</p>
                </content>
              </paragraph>

                  <p>	(e)	if there is a sacred site within the meaning of the <i>Aboriginal Land Rights (Northern Territory) Act 1976</i> on or near the land—contain evidence that the persons for whom the site is sacred or is otherwise of significance are satisfied that there is no substantial risk of damage to or interference with the sacred site as a result of the nomination or subsequent action under this Act; and</p>

              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-5__subsec-2__para-f">
                <num>f</num>

                  <p>contain evidence that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-5__subsec-2__para-i">

                  <p>the Land Council has consulted with the traditional Aboriginal owners of the land; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-5__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>the traditional Aboriginal owners understand the nature and effect of the proposed nomination and the things that might be done on or in relation to the land under this Act if <role refersTo="#minister">the Minister</role> approves the nomination; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-5__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>	(iii)	the traditional Aboriginal owners as a group have consented to the proposed nomination being made (that consent as a group being determined in accordance with <i>Aboriginal Land Rights (Northern Territory) Act 1976</i>); and<ref href="#sec-77A">section 77A</ref> of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-5__subsec-2__para-iv">
                <num>iv</num>
                <content>
                  <p>any Aboriginal community or group that may be affected by the proposed nomination has been consulted and has had adequate opportunity to express its view to the Land Council.</p>

              </paragraph>
            </subsection>

              <num>3</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may request further information from the Land Council.</p>
              </content>
            </subsection>

                <p>Failure to comply with subsection (2) does not invalidate a nomination.</p>
              </content>
            </subsection>

            </subsection>

          <heading>General nominations</heading>

            <heading>Minister may declare that nominations can be made under section 7</heading>

                <p><role refersTo="#minister">The Minister</role> may make a declaration in writing that nominations of potential sites may be made under section 7.</p>

                  <p><role refersTo="#minister">the Minister</role> must not approve land nominated under section 5, or declare land so nominated to be the selected site for a facility (see subsections 9(2) and 14(3)).</p>

              <num>2</num>
              <content>
                <p>In deciding whether to make a declaration, <role refersTo="#minister">the Minister</role> must have regard to whether it is unlikely that a facility will be able to be constructed and operated on Aboriginal land that has been nominated as a potential site under section 5 (whether or not that land has been approved as a site under section 9).</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-6__subsec-3">
              <num>3</num>
              <content>
                <p>A declaration takes effect at the time specified in the declaration, which must not be earlier than the time the declaration is made.</p>
              </content>
            </subsection>

                <p>	(4)	A copy of a declaration must be published in the <i>Gazette</i> within 7 days of the declaration being made.</p>

            <heading>Nominations of potential sites</heading>

              <p>Nominations may be made</p>
            </content>
            <subsection eId="part-2__dvs-2__sec-7__subsec-1">
              <num>1</num>
              <content>
                <p>If a declaration under <ref href="#sec-6">section 6</ref> is in effect, a person or persons may, in accordance with this section, nominate land in a State, the Australian Capital Territory or the Northern Territory as a potential site.</p>
              </content>
              <content>
                <p>Nominations by holders of certain interests in land</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-7__subsec-2">
              <num>2</num>
              <content>
                <p>A person may nominate land under this subsection as a potential site if:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the person holds an interest in the land; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the interest is:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>an estate in fee simple; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>a lease of land granted by or on behalf of the Crown, a Minister of the Crown, a statutory authority or any other prescribed person, under a law of the Commonwealth, a State or a Territory; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>the person does not hold the interest as a joint tenant or a tenant in common.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-7__subsec-3">
              <num>3</num>
              <content>
                <p>The persons who, as joint tenants or tenants in common, hold one of the following interests in land may jointly nominate the land under this subsection as a potential site:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>an estate in fee simple;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>a lease of the land granted by or on behalf of the Crown, a Minister of the Crown, a statutory authority or any other prescribed person, under a law of the Commonwealth, a State or a Territory.</p>
                </content>
                <content>
                  <p>Nominations where native title exists</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-7__subsec-4">
              <num>4</num>
              <content>
                <p>A person may nominate land under this subsection as a potential site if:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>an approved determination of native title covers an area containing the land; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>the approved determination of native title determines that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-4__para-i">
                <num>i</num>
                <content>
                  <p>native title exists in relation to the land; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-4__para-ii">
                <num>ii</num>
                <content>
                  <p>the native title rights and interests confer possession, occupation, use and enjoyment of the land on the native title holders to the exclusion of all others; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-4__para-c">
                <num>c</num>
                <content>
                  <p>one of the following applies:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-4__para-i">
                <num>i</num>
                <content>
                  <p>in the case of an approved determination of native title by the Federal Court—the person is a prescribed body corporate that holds the native title rights and interests concerned on trust, or is an agent prescribed body corporate in relation to the native title rights and interests concerned;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-7__subsec-4__para-ii">
                <num>ii</num>
                <content>
                  <p>	(ii)	in the case of an approved determination of native title by a recognised State/Territory body—the person is a body corporate that holds the native title rights and interests concerned on trust, or that is determined in relation to the native title under a provision of a law of the State or Territory concerned that corresponds to <i>Native Title Act 1993</i>.<ref href="#sec-57">section 57</ref> of the </p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-7__subsec-5">
              <num>5</num>
              <content>
                <p>In this section:</p>
              </content>
              <content>
                <p><b><i>agent prescribed body corporate</i></b> has the same meaning as in the<i> Native Title Act 1993</i>.</p>
                <p><b><i>approved determination of native title</i></b> has the same meaning as in the<i> Native Title Act 1993</i>.</p>
                <p><b><i>prescribed body corporate</i></b> has the same meaning as in the<i> Native Title Act 1993</i>.</p>
                <p><b><i>recognised State/Territory body</i></b> has the same meaning as in the <i>Native Title Act 1993.</i></p>

            </subsection>

            <heading>Rules about nominations</heading>
            <subsection eId="part-2__dvs-2__sec-8__subsec-1">
              <num>1</num>
              <content>
                <p>A nomination made under <ref href="#sec-7">section 7</ref> must:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-8__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>be in writing; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-8__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>be made to <role refersTo="#minister">the Minister</role>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-8__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>specify the land nominated in accordance with subsection (2); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-8__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>in the case of a nomination under subsection 7(2) or (3)—contain evidence that the interest in the land held by the nominator or nominators of the land is an interest referred to in subparagraph 7(2)(b)(i) or (ii) or subsection 7(3); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-8__subsec-1__para-e">
                <num>e</num>
                <content>
                  <p>in the case of a nomination under subsection 7(4)—contain evidence of the matters specified in that subsection; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-8__subsec-1__para-f">
                <num>f</num>
                <content>
                  <p>contain such other evidence (if any) as is prescribed by the regulations, including, but not limited to, the following:</p>
                </content>
              </paragraph>

                <num>i</num>
                <content>
                  <p>evidence that one or more specified groups of persons have been consulted in relation to the nomination;</p>
                </content>
              </paragraph>

                <num>ii</num>

                  <p>evidence that one or more specified groups of persons are satisfied of specified matters in relation to the nomination;</p>
                </content>
              </paragraph>

                  <p>evidence that one or more specified groups of persons have consented to the making of the nomination.</p>
                </content>
              </paragraph>

                <p>gain access to and enter land and drive vehicles or fly aircraft to and from it;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-3__para-b">

                <p>in order to drive vehicles to and from land—use existing roads or construct roads on, or grade, land;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>construct or rehabilitate bores;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>operate drilling equipment;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-3__para-e">
              <num>e</num>
              <content>
                <p>extract water;</p>
              </content>
            </paragraph>

                <p>collect samples of flora and fauna;</p>
              </content>

                <p>place monitoring equipment (including meteorological and hydrological measuring equipment);</p>
              </content>
            </paragraph>

                <p>build structures to protect bores, monitoring equipment or other things;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-3__para-i">

                <p>move or extract sand, gravel, soil, mineral and rock samples;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-3__para-j">

                <p>conduct seismic or geological investigations;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-3__para-k">
              <num>k</num>

                <p>conduct archaeological or heritage investigations;</p>

              <p>A person doing a thing under this Part must:</p>
            </content>

                <p>take all reasonable steps to ensure that the doing of the thing causes as little detriment and inconvenience, and does as little damage, as is practicable to the land and to anything on, or growing or living on, the land; and</p>

              <num>b</num>
              <content>
                <p>remain on the land only for such period as is reasonably necessary; and</p>
              </content>
            </paragraph>

                <p>leave the land, as nearly as practicable, in the condition in which it was immediately before the thing was done.</p>
              </content>
            </paragraph>

        </section>

          <heading>Application of State and Territory laws</heading>
          <subsection eId="part-3__sec-12__subsec-1">
            <num>1</num>
            <content>
              <p>A law, or a provision of a law, of a State or Territory (whether written or unwritten), so far as it relates to:</p>
            </content>
            <paragraph eId="part-3__sec-12__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the use or proposed use of land or premises; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the environmental consequences of the use of land or premises; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the archaeological or heritage values of land, premises or objects (including the significance of land, premises or objects in the traditions of Indigenous people); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>controlled material, radioactive material or dangerous goods; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-1__para-e">
              <num>e</num>
              <content>
                <p>licensing (however described) in relation to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>employment; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>carrying on a particular kind of business or undertaking; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-12__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>conducting a particular kind of operation or activity;</p>
              </content>

                <p>has no effect to the extent that it would, apart from this section, regulate, hinder or prevent the doing of a thing authorised by <ref href="#sec-11">section 11</ref>.</p>

              <p>The regulations may prescribe a law, or a provision of a law, of a State or Territory for the purposes of this subsection. The prescribed law or provision has no effect to the extent that it would, apart from this subsection, regulate, hinder or prevent the doing of a thing authorised by <ref href="#sec-11">section 11</ref>.</p>

              <p>Regulations made for the purposes of subsection (2) may prescribe a law, or a provision of a law, whether or not it is a law or a provision of a kind described in subsection (1).</p>

              <p>The regulations may prescribe a law, or a provision of a law, of a State or Territory for the purposes of this subsection. The prescribed law or provision has effect despite anything else in this section.</p>

          </subsection>
        </section>
        <section eId="part-3__sec-13">
          <num>13</num>
          <heading>Application of Commonwealth laws</heading>
          <subsection eId="part-3__sec-13__subsec-1">
            <num>1</num>
            <content>
              <p>The following laws have no effect to the extent that they would, apart from this section, regulate, hinder or prevent the doing of a thing authorised by <ref href="#sec-11">section 11</ref>:</p>
            </content>
            <paragraph eId="part-3__sec-13__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the <i>Aboriginal and Torres Strait Islander Heritage Protection Act 1984</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-13__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the <i>Environment Protection and Biodiversity Conservation Act 1999</i>.</p>
              </content>
            </paragraph>
          </subsection>

              <p>The regulations may prescribe another law, or a provision of another law, of the Commonwealth for the purposes of this subsection.         <heading>Acquisition or extinguishment of rights and interests</heading>

          <heading>Minister may declare a site as the site for a facility</heading>
          <section eId="part-4__dvs-1__sec-14">
            <num>14</num>
            <heading>Minister’s declaration of land as selected site or required for road access</heading>
            <subsection eId="part-4__dvs-1__sec-14__subsec-1">
              <num>1</num>
              <content>
                <p>This section applies if:</p>
              </content>
              <paragraph eId="part-4__dvs-1__sec-14__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>land has been nominated as a site under <ref href="#sec-5">section 5</ref> or 7; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-14__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#minister">the Minister</role> has approved the nominated land, or a specified part of the nominated land, as a site under section 9.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-14__subsec-2">
              <num>2</num>
              <content>
                <p>Subject to <role refersTo="#minister">the Minister</role> may, in his or her absolute discretion, declare in writing that the site approved by <role refersTo="#minister">the Minister</role>, or a specified part of the site, is selected as the site for a facility. The declaration may specify all or some of the rights or interests in the selected site.<ref href="#sec-18">section 18</ref>, </p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-14__subsec-3">
              <num>3</num>
              <content>
                <p>Despite subsection (2), <role refersTo="#minister">the Minister</role> must not, after the general nomination start time, make such a declaration in relation to land nominated as a site under section 5.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-14__subsec-4">
              <num>4</num>
              <content>
                <p>Subject to <role refersTo="#minister">the Minister</role> may, in his or her absolute discretion, declare in writing that all or specified rights or interests in land in a State or Territory specified in the declaration are required for providing all-weather road access to the selected site.<ref href="#sec-18">section 18</ref>, </p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-14__subsec-5">
              <num>5</num>
              <content>
                <p>To avoid doubt, rights and interests specified in a declaration under subsection (2) or (4) may include the following:</p>
              </content>
              <paragraph eId="part-4__dvs-1__sec-14__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>rights to minerals (if any);</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-14__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>native title rights and interests (if any);</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-14__subsec-5__para-c">
                <num>c</num>
                <content>
                  <p>an interest in the land, being an interest that did not previously exist;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-14__subsec-5__para-d">
                <num>d</num>
                <content>
                  <p>an easement in gross (if any).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-14__subsec-6">

                <p>	(6)	To avoid doubt, this section has effect subject to <i>Racial Discrimination Act 1975</i>.<ref href="#sec-9">section 9</ref> of the </p>

            <heading>Formalities relating to Minister’s declarations</heading>

                <p>	(1)	A copy of a declaration under subsection 14(2) or (4) must be published in the <i>Gazette</i> within 7 days of the declaration being made.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-15__subsec-2">
              <num>2</num>
              <content>
                <p>Failure to comply with subsection (1) of this section, or subsection 5(2), 6(4), 8(1) or 9(5), does not invalidate a declaration.</p>

            <heading>When Minister’s declarations take effect etc.</heading>

                <p>A declaration under subsection 14(2) or (4) takes effect at the time specified in the declaration, which must not be earlier than the time the declaration is made.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-16__subsec-2">

              <content>
                <p><role refersTo="#minister">The Minister</role> may, subject to this section, make more than one declaration under subsection 14(2) or (4), but only one declaration under subsection 14(2) may be in effect at a particular time.</p>

            </subsection>
            <subsection eId="part-4__dvs-1__sec-16__subsec-3">
              <num>3</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-4__dvs-1__sec-16__subsec-3__para-a">

                  <p>	(a)	a declaration under subsection 14(2) (the <b><i>original declaration</i></b>) is in effect at a particular time; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-1__sec-16__subsec-3__para-b">

                <content>
                  <p>	(b)	at that time, the Minister makes another such declaration (the <b><i>later declaration</i></b>);</p>
                </content>

                  <p><role refersTo="#minister">the Minister</role> is taken, immediately before the time of effect specified in the later declaration, to have revoked the original declaration under section 17.</p>
                </content>
              </paragraph>
            </subsection>
          </section>

            <heading>Revocation of Minister’s declaration</heading>
            <subsection eId="part-4__dvs-1__sec-17__subsec-1">

                <p><role refersTo="#minister">The Minister</role> may, in his or her absolute discretion, revoke in writing a declaration made under subsection 14(2) or (4).</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-17__subsec-2">
              <num>2</num>
              <content>
                <p>A revocation takes effect at the time specified in the revocation, which must not be earlier than the time the revocation is made.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-1__sec-17__subsec-3">
              <num>3</num>
              <content>
                <p>To avoid doubt, if a declaration made under subsection 14(2) or (4) is revoked:</p>
              </content>
              <paragraph eId="part-4__dvs-1__sec-17__subsec-3__para-a">
                <num>a</num>

                  <p>the revocation does not affect the operation of <ref href="#sec-19">section 19</ref> in relation to the land that was the subject of the revoked declaration; and</p>
                </content>
              </paragraph>

                <num>b</num>
                <content>
                  <p>on and from the revocation, <ref href="#part-5">Part 5</ref> does not apply to that land.</p>

                <p>Section 18 does not apply to a revocation under this section.</p>
              </content>
            </subsection>

                <p>gathering or preparing information for a Commonwealth regulatory scheme that relates to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-i">

                <p>the construction or operation of a facility; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>anything done in preparation for the construction or operation of a facility;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>conducting activities that relate to gathering or preparing information for such a regulatory scheme;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>preparing the selected site for a facility;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-d">
              <num>d</num>

                <p>preparing to construct and operate a facility;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-e">
              <num>e</num>
              <content>
                <p>constructing a facility;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-f">
              <num>f</num>
              <content>
                <p>constructing roads on, or grading, land in a State or Territory;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-g">

                <p>erecting fences and other access controls on land specified in the declaration under subsection 14(4);</p>
              </content>
            </paragraph>

                <p>operating a facility;</p>

            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-2__para-i">

                <p>maintaining a facility;</p>

                <p>keeping a facility safe;</p>

                <p>decommissioning a facility.</p>

          </subsection>
          <subsection eId="part-5__sec-23__subsec-3">

              <p>Without limiting subsection (2), the person may, under that subsection, do a thing mentioned in subsection 11(3) in relation to the selected site.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-4">

              <p>Subsection (2) extends to doing things outside the selected site.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-23__subsec-5">

              <p>A person to whom this section applies may, in relation to the selected site:</p>
            </content>
            <paragraph eId="part-5__sec-23__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>transport (including through a State or Territory) people and materials (including controlled material) to or from a facility; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-23__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>use transport infrastructure for that transport.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-5__sec-24">

          <heading>Application of State and Territory laws</heading>
          <subsection eId="part-5__sec-24__subsec-1">
            <num>1</num>
            <content>
              <p>A law, or a provision of a law, of a State or Territory (whether written or unwritten), so far as it relates to:</p>
            </content>
            <paragraph eId="part-5__sec-24__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the use or proposed use of land or premises; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-24__subsec-1__para-b">
              <num>b</num>

                <p>the environmental consequences of the use of land or premises; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-24__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the archaeological or heritage values of land, premises or objects (including the significance of land, premises or objects in the traditions of Indigenous people); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-24__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>controlled material, radioactive material or dangerous goods; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-24__subsec-1__para-e">

                <p>licensing (however described) in relation to:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-24__subsec-1__para-i">
              <num>i</num>

                <p>carrying on a particular kind of business or undertaking; or</p>

                <p>	(a)	immediately before a declaration under subsection 14(2) took effect, land that was the subject of the declaration was Aboriginal land (the <b><i>relevant land</i></b>); and</p>

            </paragraph>

              <num>b</num>
              <content>
                <p>as a result of the declaration, the Commonwealth acquired, under <ref href="#sec-19">section 19</ref>, an estate in fee simple in the relevant land; and</p>

              <num>c</num>
              <content>
                <p>	(c)	a facility on the relevant land has been abandoned in accordance with the <i>Australian Radiation Protection and Nuclear Safety Act 1998</i>; and</p>

                <p>the Commonwealth holds an estate in fee simple in the relevant land.</p>

              <p>This Part also applies if:</p>

            <paragraph eId="part-6__sec-26__subsec-2__para-a">

                <p>	(a)	immediately before a declaration under subsection 14(4) took effect, all or part of the land that was the subject of the declaration was Aboriginal land (the whole, or that part, of the land being <b><i>relevant land</i></b>); and</p>

            </paragraph>

              <num>b</num>
              <content>
                <p>as a result of the declaration, the Commonwealth acquired, under <ref href="#sec-19">section 19</ref>, rights or interests in the relevant land; and</p>

              <content>
                <p>	(c)	the facility mentioned in paragraph (1)(c) has been abandoned in accordance with the <i>Australian Radiation Protection and Nuclear Safety Act 1998</i>; and</p>

                <p>the Commonwealth holds all or some of those rights or interests in the relevant land.</p>

              <p>However, this Part does not apply to a declaration referred to in subsection (1) or (2) if the declaration relates to land nominated under <ref href="#sec-7">section 7</ref>.</p>

          <heading>Declaration of intention to grant rights and interests in land to original owners</heading>
          <subsection eId="part-6__sec-27__subsec-1">
            <num>1</num>

              <p><role refersTo="#minister">The Minister</role> may, in his or her absolute discretion, declare in writing that the land that was the subject of the declaration under subsection 14(2) is no longer required for the facility mentioned in paragraph 26(1)(c).</p>

          </subsection>
          <subsection eId="part-6__sec-27__subsec-2">
            <num>2</num>
            <content>
              <p>The declaration must:</p>
            </content>
            <paragraph eId="part-6__sec-27__subsec-2__para-a">
              <num>a</num>

                <p>specify all the relevant land; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-27__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>state that <role refersTo="#minister">the Minister</role> intends to make a declaration under section 28 granting the rights and interests specified in section 29 in specified land to a specified Land Trust.</p>

              <p>Land specified under paragraph (2)(b) may be all or part of the relevant land, but all of the specified land must, in total, be all of the relevant land.</p>

              <p>A Land Trust may be specified under paragraph (2)(b) in relation to specified land only if:</p>
            </content>
            <paragraph eId="part-6__sec-27__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>the Land Trust held title to the specified land immediately before the declaration under subsection 14(2) or (4) (as the case may be) took effect; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-27__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>the Land Trust has succeeded to the functions of a Land Trust mentioned in paragraph (a) of this subsection.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-27__subsec-5">
            <num>5</num>
            <content>
              <p><quantity refersTo="#deadline">Within 7 days</quantity> of the declaration being made, the Minister must:</p>
            </content>
            <paragraph eId="part-6__sec-27__subsec-5__para-a">
              <num>a</num>
              <content>
                <p>	(a)	publish a copy of the declaration in the <i>Gazette</i>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-27__subsec-5__para-b">
              <num>b</num>
              <content>
                <p>notify a specified Land Trust in writing that <role refersTo="#minister">the Minister</role> intends to make a declaration under section 28.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-27__subsec-6">
            <num>6</num>
            <content>
              <p>A declaration is not valid unless:</p>
            </content>
            <paragraph eId="part-6__sec-27__subsec-6__para-a">
              <num>a</num>
              <content>
                <p>it specifies and states the matters mentioned in subsection (2); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-27__subsec-6__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> complies with subsection (5).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-27__subsec-7">
            <num>7</num>
            <content>
              <p>A Land Trust specified in a declaration may consent in writing to the granting of the rights and interests specified in <ref href="#sec-29">section 29</ref> in the specified land.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-27__subsec-8">
            <num>8</num>
            <content>
              <p>A declaration is not a legislative instrument.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-6__sec-28">
          <num>28</num>
          <heading>Declaration granting rights and interests in land to original owners</heading>
          <subsection eId="part-6__sec-28__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must make a declaration in writing that an estate in fee simple is granted in specified land to a specified Land Trust if:</p>
            </content>
            <paragraph eId="part-6__sec-28__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the Commonwealth holds an estate in fee simple in the specified land; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-28__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the specified Land Trust has, under subsection 27(7), consented to the granting of an estate in fee simple in the specified land within:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-28__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>	(i)	12 months of the day on which the declaration under <i>Gazette</i>; or<ref href="#sec-27">section 27</ref> was published in the </p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-28__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>such longer period as is prescribed in the regulations.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-28__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must make a declaration in writing that the rights and interests specified in subsection 29(3) are granted in specified land to a specified Land Trust if:</p>
            </content>
            <paragraph eId="part-6__sec-28__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the Commonwealth holds rights or interests (other than an estate in fee simple) in the specified land; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-28__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the specified Land Trust has, under subsection 27(7), consented to the granting of the rights and interests specified in subsection 29(3) in the specified land within:</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-28__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>	(i)	12 months of the day on which the declaration under <i>Gazette</i>; or<ref href="#sec-27">section 27</ref> was published in the </p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-28__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>such longer period as is prescribed in the regulations.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-28__subsec-3">
            <num>3</num>
            <content>
              <p>A declaration takes effect at the time specified in the declaration, which must not be earlier than the time the declaration is made.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-28__subsec-4">
            <num>4</num>
            <content>
              <p>A declaration is not a legislative instrument.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-28__subsec-5">
            <num>5</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may include one or more declarations under subsections (1) and (2) in the same document.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-6__sec-29">
          <num>29</num>
          <heading>Grant of rights and interests in land to original owners</heading>
          <content>
            <p>Grant of estate in fee simple</p>
          </content>
          <subsection eId="part-6__sec-29__subsec-1">
            <num>1</num>
            <content>
              <p>If <role refersTo="#minister">the Minister</role> makes a declaration under subsection 28(1), then at the time the declaration takes effect:</p>
            </content>
            <paragraph eId="part-6__sec-29__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	an estate in fee simple is granted, by force of this subsection, in the specified land<i> </i>to the specified Land Trust; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-29__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the land is taken, for all purposes, to be Aboriginal land.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-29__subsec-2">
            <num>2</num>
            <content>
              <p>The estate in fee simple is subject to the reservations that:</p>
            </content>
            <paragraph eId="part-6__sec-29__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the right to any minerals existing in their natural condition, or in a deposit of waste material obtained from any underground or surface working, on or below the surface of the land, being minerals all interests in which are vested in the Commonwealth, remains with the Commonwealth; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-29__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>	(b)	rights to explore for minerals, and leases or licences to mine for minerals, on or below the surface of the land may be granted under <i>Lands Acquisition Act 1989</i>.<ref href="#sec-124">section 124</ref> of the </p>
              </content>
              <content>
                <p>Grant of other rights and interests</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-29__subsec-3">
            <num>3</num>
            <content>
              <p>If <role refersTo="#minister">the Minister</role> makes a declaration under subsection 28(2), then at the time the declaration takes effect, any rights and interests:</p>
            </content>
            <paragraph eId="part-6__sec-29__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>that are held by the Commonwealth in the specified land; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-29__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>that were acquired by the Commonwealth, under <ref href="#sec-19">section 19</ref>, in the specified land from the specified Land Trust or another Land Trust;</p>
              </content>
              <content>
                <p>are granted, by force of this subsection, in the specified land to the specified Land Trust.</p>
                <p>Validity of earlier rights, interests and actions</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6__sec-29__subsec-4">
            <num>4</num>
            <content>
              <p>The granting of rights and interests in land under subsection (1) or (3) does not affect:</p>
            </content>
            <paragraph eId="part-6__sec-29__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>the validity of any rights or interests acquired, created or granted (whether under this Act or otherwise) in relation to the land; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-29__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>the validity of the construction, operation, maintenance, decommissioning or abandoning of a facility on the land, or the doing of any other thing in relation to the land;</p>
              </content>
              <content>
                <p>before the declaration under <ref href="#sec-28">section 28</ref> takes effect.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-6__sec-30">
          <num>30</num>
          <heading>No earlier rights and interests granted</heading>
          <content>
            <p>To avoid doubt, the making of a declaration under <ref href="#sec-28">section 28</ref> does not create or grant any rights or interests in land before the declaration takes effect.</p>
          </content>
        </section>
        <section eId="part-6__sec-31">
          <num>31</num>
          <heading>Application of Commonwealth, State and Territory laws</heading>
          <content>
            <p>Section 29 has effect despite any other law of the Commonwealth, a State or a Territory (whether written or unwritten).</p>
          </content>
        </section>
        <section eId="part-6__sec-32">
          <num>32</num>
          <heading>Notice to Registrar-General</heading>
          <subsection eId="part-6__sec-32__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> of the Department may lodge with <role refersTo="#registrar">the Registrar</role>-General for the Northern Territory (or other appropriate officer) a copy of a Minister’s declaration under section 28, certified by writing signed by <role refersTo="#secretary">the Secretary</role>.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-32__subsec-2">
            <num>2</num>
            <content>
              <p>The officer with whom the copy is lodged may deal with and give effect to it as if it were a grant, conveyance, memorandum or instrument of transfer of relevant rights and interests done under the laws of the Northern Territory.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-6__sec-33">
          <num>33</num>
          <heading>Indemnity by Commonwealth</heading>
          <subsection eId="part-6__sec-33__subsec-1">
            <num>1</num>
            <content>
              <p>The Commonwealth must indemnify each Land Trust specified in a declaration under <ref href="#sec-28">section 28</ref>, and keep the Land Trust indemnified, against any action, claim or demand brought or made against the Land Trust in respect of any liability arising from, or damage caused by, ionising radiation from any act done or omitted to be done by or on behalf of the Commonwealth in relation to the transport of controlled material to or from, or the management of controlled material at, a facility on the land specified in the declaration.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-33__subsec-2">
            <num>2</num>
            <content>
              <p>The amount of the indemnity is reduced to the extent to which any fault on the part of the Land Trust, or its employees, agents or contractors, contributed to the liability or damage.</p>
            </content>
          </subsection>
          <subsection eId="part-6__sec-33__subsec-3">
            <num>3</num>
            <content>
              <p>Subsection (1) does not apply in relation to an action, claim or demand unless:</p>
            </content>
            <paragraph eId="part-6__sec-33__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the Land Trust notifies the Commonwealth, in writing, of the action, claim or demand as soon as practicable; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6__sec-33__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the Land Trust follows any directions of the Commonwealth in relation to the action, claim or demand.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-6__sec-34">
          <num>34</num>
          <heading>Regulations</heading>
          <content>
            <p>The regulations may prescribe any modifications of this Act that are necessary or convenient to deal with transitional matters arising from the making of a declaration under <ref href="#sec-27">section 27</ref> or 28.</p>
          </content>
        </section>
      </part>

        <num>6A</num>
        <heading>Community fund</heading>
        <section eId="part-6A__sec-34A">
          <num>34A</num>
          <heading>Application of Part</heading>
          <content>
            <p>This Part applies if:</p>
          </content>
          <paragraph eId="part-6A__sec-34A__para-a">
            <num>a</num>
            <content>
              <p><role refersTo="#minister">the Minister</role> has made a declaration under subsection 14(2) that a site is selected as the site for a facility; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-6A__sec-34A__para-b">
            <num>b</num>
            <content>
              <p>a facility has been constructed at the site; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-6A__sec-34A__para-c">
            <num>c</num>
            <content>
              <p>	(c)	a facility licence that authorises a person to operate the facility has been issued under the <i>Australian Radiation Protection and Nuclear Safety Act 1998</i>.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-6A__sec-34AA">
          <num>34AA</num>
          <heading>NRWMF Community Fund entity</heading>
          <subsection eId="part-6A__sec-34AA__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The <b><i>NRWMF Community Fund entity</i></b> is the entity prescribed by the regulations for the purposes of this subsection.</p>
            </content>
          </subsection>
          <subsection eId="part-6A__sec-34AA__subsec-2">
            <num>2</num>
            <content>
              <p>Before the Governor-General makes regulations for the purposes of subsection (1), <role refersTo="#minister">the Minister</role> must be satisfied that, before the entity was established, the following bodies were consulted on the type of entity to be established and associated governance arrangements:</p>
            </content>
            <paragraph eId="part-6A__sec-34AA__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the regional consultative committee mentioned in <ref href="#sec-22">section 22</ref>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6A__sec-34AA__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the local government body that serves the local government area in which the facility is situated;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6A__sec-34AA__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>the government of the State or Territory in which the facility is situated.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-6A__sec-34AB">
          <num>34AB</num>
          <heading>Payment to NRWMF Community Fund entity</heading>
          <subsection eId="part-6A__sec-34AB__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must, on behalf of the Commonwealth, make a payment to the NRWMF Community Fund entity for purposes associated with the economic and social sustainability of the host community for the facility, so as to support:</p>
            </content>
            <paragraph eId="part-6A__sec-34AB__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the establishment of the facility; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-6A__sec-34AB__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the operation of the facility in safely and securely managing controlled material.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6A__sec-34AB__subsec-2">
            <num>2</num>
            <content>
              <p>The payment must not be made to the NRWMF Community Fund entity unless the entity is party to an agreement with the Commonwealth under <ref href="#sec-34A">section 34A</ref>C.</p>
            </content>
          </subsection>
          <subsection eId="part-6A__sec-34AB__subsec-3">
            <num>3</num>
            <content>
              <p>The amount of the payment must be $20 million. The amount is to be paid as a single lump sum.</p>
            </content>
          </subsection>
          <subsection eId="part-6A__sec-34AB__subsec-4">
            <num>4</num>
            <content>
              <p>A payment under this section is to be made out of money appropriated by the Parliament by another Act.</p>
            </content>

              <p>The terms and conditions on which that payment is made are to be set out in a written agreement between the Commonwealth and the entity.</p>

          </subsection>
          <subsection eId="part-6A__sec-34AC__subsec-3">
            <num>3</num>
            <content>
              <p>An agreement under subsection (2) may be entered into by <role refersTo="#minister">the Minister</role> on behalf of the Commonwealth.</p>
            </content>
          </subsection>
          <subsection eId="part-6A__sec-34AC__subsec-4">
            <num>4</num>
            <content>
              <p>The entity must comply with the terms and conditions set out in the agreement.</p>
            </content>
            <content>
              <p>Core condition</p>

              <p><i>	</i>(5)	The agreement must include a condition to the effect that the entity will use the payment for purposes associated with the economic and social sustainability of the host community for the facility, so as to support:</p>

                <p>the establishment of the facility; and</p>

                <p>Other terms and conditions</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6A__sec-34AC__subsec-6">
            <num>6</num>
            <content>
              <p>The terms and conditions set out in the agreement must provide for the circumstances in which the entity must repay amounts to the Commonwealth.</p>
            </content>

              <p>An entity wishing to use the facility mentioned in <ref href="#sec-34A">section 34A</ref>, other than the following entities:</p>
            </content>
            <paragraph eId="part-6B__sec-34B__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6B__sec-34B__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the State or Territory in which the facility is situated;</p>
              </content>
            </paragraph>
            <paragraph eId="part-6B__sec-34B__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>a Commonwealth entity or an authority of the State or Territory in which the facility is situated;</p>
              </content>
              <content>
                <p>must pay such fee (the <b><i>Capital Contribution Fee</i></b>) as is prescribed by the regulations as a capital contribution towards the cost of the facility before being eligible to have <b>controlled material</b> accepted by the facility for storage, management or any other purpose.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-6B__sec-34B__subsec-2">
            <num>2</num>
            <content>
              <p>The Capital Contribution Fee is to be determined in the manner prescribed by the regulations.</p>
            </content>
          </subsection>
          <subsection eId="part-6B__sec-34B__subsec-2A">

              <p>The fee is payable to the Commonwealth.</p>
            </content>
          </subsection>
        </section>

          <heading>Commonwealth acceptance of controlled material destined for facility</heading>

            <p>The Commonwealth must not accept controlled material from any entity in a manner that avoids the payment of the Capital Contribution Fee mentioned in <ref href="#sec-34B">section 34B</ref>.</p>

        <heading>Miscellaneous</heading>
        <section eId="part-7__sec-35">

          <heading>Compensation</heading>
          <subsection eId="part-7__sec-35__subsec-1">

              <p>If rights or interests are acquired, extinguished or otherwise affected under <ref href="#sec-19">section 19</ref>, the Commonwealth is liable to pay a reasonable amount of compensation to a person whose right or interest has been acquired, extinguished or otherwise affected.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-35__subsec-2">
            <num>2</num>
            <content>
              <p>If the Commonwealth and the person do not agree on the amount of the compensation, the person may institute proceedings in the Federal Court of Australia for the recovery from the Commonwealth of such reasonable amount of compensation as the court determines.</p>

              <p>If the Commonwealth and the person do not agree on the amount of the compensation, the person may institute proceedings in the Federal Court of Australia for the recovery from the Commonwealth of such reasonable amount of compensation as the court determines.</p>

              <p>The Commonwealth must indemnify the Northern Territory, and keep the Northern Territory indemnified, against any action, claim or demand brought or made against the Northern Territory in respect of any liability arising from, or damage caused by, ionising radiation from any act done or omitted to be done by or on behalf of the Commonwealth in relation to the transport of controlled material to or from, or the management of controlled material at, a facility on the selected site.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-37__subsec-3">
            <num>3</num>
            <content>
              <p>The amount of the indemnity is reduced to the extent to which any fault on the part of the Northern Territory, or its employees, agents or contractors, contributed to the liability or damage.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-37__subsec-4">
            <num>4</num>
            <content>
              <p>Subsection (2) does not apply in relation to an action, claim or demand unless:</p>
            </content>
            <paragraph eId="part-7__sec-37__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>the Northern Territory notifies the Commonwealth, in writing, of the action, claim or demand as soon as practicable; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-37__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>the Northern Territory follows any directions of the Commonwealth in relation to the action, claim or demand.</p>

                <p>Management of Northern Territory controlled material</p>

            </paragraph>

              <p>If controlled material that is generated by activities in the Northern Territory is managed at a facility on the selected site, the Commonwealth must not charge the Northern Territory for the management.</p>

          <heading>Regulations</heading>

            <p>The Governor-General may make regulations prescribing matters:</p>
