            <p>This Act commences on the day this Act receives the Royal Assent.</p>

            <p>This Act is about promoting the supply of low aromatic fuel and controlling the supply of other fuels in certain areas in order to reduce potential harm to the health of people, including Aboriginal persons and Torres Strait Islanders, living in those areas from sniffing fuel (see the object of this Act in <ref href="#sec-4">section 4</ref>).</p>

            <p><ref href="#dvs-1">Division 1</ref> of <ref href="#part-2">Part 2</ref> deals with requirements relating to regular unleaded petrol for low aromatic fuel areas, prohibiting the supply of regular unleaded petrol in a low aromatic fuel area.</p>

            <p>Low aromatic fuel areas and fuel control areas are designated by <role refersTo="#minister">the Minister</role> under Part 3.</p>
            <p><role refersTo="#minister">The Minister</role> may only designate an area as a low aromatic fuel area, following appropriate consultation, if satisfied that doing so is reasonably likely to help reduce potential harm from sniffing fuel in that area, and if certain other conditions are satisfied.</p>
            <p><role refersTo="#minister">The Minister</role> may only designate an area as a fuel control area, following appropriate consultation, if satisfied that doing so is reasonably likely to help reduce potential harm from sniffing fuel in that area or in a low aromatic fuel area, and if certain other conditions are satisfied.</p>

              <i>4—Exemptions from requirements of this Act</i>
            </p>
            <p>Under <role refersTo="#minister">the Minister</role> may exempt specified conduct from one or more of the requirements that would otherwise apply under Part 2 in relation to a low aromatic fuel area or a fuel control area.<ref href="#part-4">Part 4</ref>, </p>

            </p>
            <p><ref href="#part-5">Part 5</ref> deals with miscellaneous matters, including reviewing the operation of this Act and the power to make regulations.</p>

              <i>Other introductory matters</i>
            </p>
            <p><ref href="#part-1">Part 1</ref> contains the Dictionary. The Dictionary is a list of every term that is defined in this Act. A term will either be defined in the Dictionary itself, or in another provision of this Act. If another provision defines the term, the Dictionary will have a signpost to that definition.</p>
            <p>In addition, <ref href="#part-1">Part 1</ref> deals with the application of this Act to the Crown and the relationship between this Act and State and Territory laws.</p>

        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Object of this Act</heading>
          <content>
            <p>The object of this Act is to enable special measures to be taken to reduce the potential harm to the health of people, including Aboriginal persons and Torres Strait Islanders, living in certain areas from sniffing fuel.</p>
          </content>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Dictionary</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-aboriginal-person">Aboriginal person</term> means <def>a person of the Aboriginal race of Australia.</def></p>
            <p><term refersTo="#term-conduct">conduct</term> means <def>an act, an omission to perform an act or a state of affairs.</def></p>
            <p><term refersTo="#term-corporation">corporation</term> means <def>a corporation to which paragraph 51(xx) of the Constitution applies.</def></p>
            <p><b><i>emergency law</i></b> means:</p>
          </content>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>	(a)	the <i>Liquid Fuel Emergency Act 1984</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>a law prescribed by the regulations for the purposes of this definition.</p>
            </content>
            <content>
              <p><b><i>engage in conduct</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>do an act; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>omit to perform an act.</p>
            </content>
            <content>
              <p><b><i>fuel</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>petrol, or any substance that is used as a substitute for petrol; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>a substance of a kind prescribed by the regulations for the purposes of this definition.</p>
            </content>
            <content>
              <p><term refersTo="#term-fuel-control-area">fuel control area</term> means <def>an area designated by the Minister under <ref href="#sec-15">section 15</ref>.</def></p>
              <p><b><i>low aromatic fuel</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>unleaded petrol that has a research octane number of less than 95, and that has aromatic compounds of less than 5% to help discourage fuel sniffing; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>unleaded petrol of a kind prescribed by the regulations for the purposes of this definition.</p>
            </content>
            <content>
              <p><term refersTo="#term-low-aromatic-fuel-area">low aromatic fuel area</term> means <def>an area designated by the Minister under <ref href="#sec-14">section 14</ref>.</def></p>
              <p><term refersTo="#term-petrol">petrol</term> means <def>a petroleum based fuel (whether or not containing ethanol) for spark-ignition internal combustion engines.</def></p>
              <p><term refersTo="#term-regular-unleaded-petrol">regular unleaded petrol</term> means <def>unleaded petrol that has a research octane number of less than 95, but does not include low aromatic fuel.</def></p>
              <p><term refersTo="#term-supply">supply</term> includes <def>give, distribute, barter and exchange, whether or not for consideration, and whether or not the supply is a wholesale or retail supply.</def></p>
              <p><term refersTo="#term-torres-strait-islander">Torres Strait Islander</term> means <def>a descendant of an Indigenous inhabitant of the Torres Strait Islands.</def></p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-6">
          <num>6</num>
          <heading>Act binds Crown</heading>
          <subsection eId="part-1__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>This Act binds the Crown in each of its capacities.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>This Act does not make the Crown liable to be prosecuted for an offence.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-3">
            <num>3</num>
            <content>
              <p>The protection in subsection (2) does not apply to an authority of the Crown.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-7">
          <num>7</num>
          <heading>Relationship to State and Territory laws</heading>
          <content>
            <p>This Act is not intended to exclude the operation of any law of a State or Territory, to the extent that that law is capable of operating concurrently with this Act.</p>

              <p>Offence—supplying regular unleaded petrol in low aromatic fuel area</p>

              <num>1</num>
              <content>
                <p>A corporation must not supply regular unleaded petrol to a person if the person is in a low aromatic fuel area.</p>
              </content>

                <p>Offence—transporting regular unleaded petrol for supply in low aromatic fuel area</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-8__subsec-2">
              <num>2</num>
              <content>
                <p>A corporation must not transport regular unleaded petrol:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	intending to supply any of it to a person (the <b><i>recipient</i></b>); or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	knowing that, or reckless as to whether, another person intends to supply any of it to a third person (the <b><i>recipient</i></b>);</p>
                </content>
                <content>
                  <p>if the recipient is in a low aromatic fuel area.</p>
                  <p>Offence—possessing regular unleaded petrol for supply in low aromatic fuel area</p>
                </content>
                <hcontainer name="penalty">
                  <content>
                    <p>Penalty:	<quantity refersTo="#penaltyUnit">300 penalty units</quantity>.</p>

              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-8__subsec-3">
              <num>3</num>
              <content>
                <p>A corporation must not possess regular unleaded petrol intending to supply any of it to a person if the person is in a low aromatic fuel area.</p>
              </content>

                  <p>Penalty:	<quantity refersTo="#penaltyUnit">300 penalty units</quantity>.</p>

              <content>
                <p>Exceptions</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-1__sec-8__subsec-4">
              <num>4</num>
              <content>
                <p>A corporation does not commit an offence against subsection (1), (2) or (3) by engaging in particular conduct if:</p>
              </content>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>both:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-4__para-i">
                <num>i</num>
                <content>
                  <p>the conduct is exempt under <ref href="#sec-17">section 17</ref>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-4__para-ii">
                <num>ii</num>
                <content>
                  <p>the corporation complies with any conditions of the exemption in engaging in the conduct; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-1__sec-8__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>the corporation engages in the conduct in order to comply with a direction or order under an emergency law.</p>
                </content>

            <heading>Requirements relating to low aromatic fuel for low aromatic fuel areas and fuel control areas</heading>
            <content>
              <p>Minister may determine requirements</p>
            </content>
            <subsection eId="part-2__dvs-2__sec-9__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, determine requirements relating to the following:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-9__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>communicating information in connection with the supply of low aromatic fuel in, or in relation to, a low aromatic fuel area or fuel control area, including information promoting low aromatic fuel;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-9__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>making and keeping records relating to the supply, transport, possession or storage of low aromatic fuel in, or in relation to, a low aromatic fuel area or a fuel control area;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-9__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>giving <role refersTo="#minister">the Minister</role> specified information relating to the supply, transport, possession or storage of low aromatic fuel in, or in relation to, a low aromatic fuel area or a fuel control area.</p>

                <p>Without limiting subsection (1), a determination under that subsection may determine requirements in relation to one or more specified areas or areas in a specified class.</p>

                <p>Before making a determination under subsection (1), <role refersTo="#minister">the Minister</role> must be satisfied that making the determination will further the object of this Act.</p>

              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, determine requirements relating to the supply, transport, possession or storage of a fuel in, or in relation to, a low aromatic fuel area or a fuel control area.</p>

                <p>Without limiting subsection (1), a determination under that subsection may do any or all of the following:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-11__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>prohibit (either absolutely or subject to conditions), limit, restrict or otherwise affect the supply, transport, possession or storage, of a fuel in, or in relation to, a low aromatic fuel area or a fuel control area;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-11__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>require a fuel in a low aromatic fuel area or a fuel control area to be stored or secured in accordance with the determination;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-11__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>require a fuel in a low aromatic fuel area or a fuel control area to be supplied in a specified kind of container;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-11__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>specify requirements in relation to communicating information, in accordance with the determination, in connection with a supply of a fuel in, or in relation to, a low aromatic fuel area or a fuel control area;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-11__subsec-2__para-e">
                <num>e</num>
                <content>
                  <p>specify requirements in relation to the information or documentation that a person must provide before a fuel is supplied to the person in a low aromatic fuel area or a fuel control area;</p>
                </content>

                <num>f</num>
                <content>
                  <p>require a person to make and keep records relating to the supply, transport, possession or storage of a fuel in, or in relation to, a low aromatic fuel area or a fuel control area in accordance with the determination;</p>

              <paragraph eId="part-2__dvs-3__sec-11__subsec-2__para-g">
                <num>g</num>
                <content>
                  <p>require a person to give <role refersTo="#minister">the Minister</role> specified information relating to the supply, transport, possession or storage of a fuel in, or in relation to, a low aromatic fuel area or a fuel control area, including information relating to a suspected offence against this Act.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-11__subsec-3">
              <num>3</num>
              <content>
                <p>The paragraphs of subsection (2) do not limit each other.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-11__subsec-4">
              <num>4</num>
              <content>
                <p>Without limiting subsection (1), a determination under that subsection may determine requirements in relation to one or more specified areas or areas in a specified class.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-11__subsec-5">
              <num>5</num>
              <content>
                <p>Before making a determination under subsection (1), <role refersTo="#minister">the Minister</role> must be satisfied that making the determination will further the object of this Act.</p>

            </subsection>

              <num>6</num>
              <content>
                <p>In making a determination under subsection (1), <role refersTo="#minister">the Minister</role> must have regard to:</p>
              </content>

                <num>a</num>
                <content>
                  <p>the wellbeing of people, including Aboriginal persons and Torres Strait Islanders, living in and near the area; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-11__subsec-6__para-b">
                <num>b</num>
                <content>
                  <p>any submissions of the kind referred to in paragraph 13(2)(b); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-11__subsec-6__para-c">
                <num>c</num>
                <content>
                  <p>any other matter that <role refersTo="#minister">the Minister</role> considers relevant.</p>
                </content>
              </paragraph>
            </subsection>

                  <p>the corporation engages in the conduct in order to comply with a direction or order under an emergency law.</p>

            <heading>Consultation before determining requirements relating to fuels generally</heading>
            <subsection eId="part-2__dvs-3__sec-13__subsec-1">
              <num>1</num>
              <content>
                <p>Before making a determination under <role refersTo="#minister">the Minister</role> must consult with such persons and bodies from among the following as <role refersTo="#minister">the Minister</role> considers appropriate:<ref href="#sec-11">section 11</ref>, </p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>community representatives and bodies;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-1__para-aa">
                <num>aa</num>
                <content>
                  <p>Aboriginal persons or Torres Strait Islanders (or representatives of Aboriginal persons or Torres Strait Islanders);</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>manufacturers and suppliers of fuel;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>persons with an interest in or knowledge of human health;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-1__para-d">
                <num>d</num>
                <content>
                  <p>any other person that <role refersTo="#minister">the Minister</role> considers appropriate.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-13__subsec-2">
              <num>2</num>
              <content>
                <p>Without limiting subsection (1), <role refersTo="#minister">the Minister</role> must ensure that:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>information setting out the following has been made available in the area or areas to which the determination relates:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>the proposed requirements;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>an explanation, in summary form, of the proposed requirements; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>people living in the area, and businesses and organisations operating in the area, have been given a reasonable opportunity to make submissions to <role refersTo="#minister">the Minister</role> about:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>the proposed requirements; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>the consequences of determining the proposed requirements; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-13__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>their circumstances, concerns and views, so far as they relate to the proposed requirements.</p>
                </content>
              </paragraph>
            </subsection>
          </section>

        <heading>Designating low aromatic fuel areas and fuel control areas</heading>
        <section eId="part-3__sec-14">
          <num>14</num>
          <heading>Minister may designate low aromatic fuel areas</heading>
          <subsection eId="part-3__sec-14__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Minister may, by legislative instrument, designate an area specified in the instrument as a <b><i>low aromatic fuel area</i></b>.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-14__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may only designate an area under subsection (1) if:</p>
            </content>
            <paragraph eId="part-3__sec-14__subsec-2__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that designating the area is reasonably likely to help reduce potential harm to the health of people, including Aboriginal persons and Torres Strait Islanders, living in the area from sniffing fuel; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-2__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that there are adequate facilities or arrangements for the supply of low aromatic fuel to and within the area being designated; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-2__para-c">
              <num>c</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> considers that the appropriate States and Territories have not enacted legislation consistent with this Act to reduce the harm of petrol sniffing, and it is unlikely that they will enact such legislation within a reasonable period.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-14__subsec-3">
            <num>3</num>
            <content>
              <p>In designating an area under subsection (1), <role refersTo="#minister">the Minister</role> must have regard to:</p>
            </content>
            <paragraph eId="part-3__sec-14__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the wellbeing of people, including Aboriginal persons and Torres Strait Islanders, living in the area; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>whether there is reason to believe that the health of people, including Aboriginal persons and Torres Strait Islanders, living in the area has been harmed by sniffing fuel; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>whether people, including Aboriginal persons and Torres Strait Islanders, living in the area have expressed their concerns about sniffing fuel; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>whether people, including Aboriginal persons and Torres Strait Islanders, living in the area have expressed the view that their wellbeing will be improved if the area is designated as a low aromatic fuel area; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-3__para-e">
              <num>e</num>
              <content>
                <p>any submissions of the kind referred to in paragraph 16(2)(b); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-3__para-f">
              <num>f</num>
              <content>
                <p>the availability of low aromatic fuel in relation to the area; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-14__subsec-3__para-g">
              <num>g</num>
              <content>
                <p>any other matter that <role refersTo="#minister">the Minister</role> considers relevant.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-3__sec-15">
          <num>15</num>
          <heading>Minister may designate fuel control areas</heading>
          <subsection eId="part-3__sec-15__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The Minister may, by legislative instrument, designate an area specified in the instrument as a <b><i>fuel control area</i></b>.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-15__subsec-2">
            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may only designate an area under subsection (1) if he or she is satisfied that:</p>
            </content>
            <paragraph eId="part-3__sec-15__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>designating the area is reasonably likely to help reduce potential harm to the health of people, including Aboriginal persons and Torres Strait Islanders, living in that area or in a low aromatic fuel area from sniffing fuel; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-15__subsec-2__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that there are adequate facilities or arrangements for the supply of low aromatic fuel to and within the area being designated; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-15__subsec-2__para-c">
              <num>c</num>
              <content>

              <num>c</num>
              <content>
                <p>whether people, including Aboriginal persons and Torres Strait Islanders, living in the area or any relevant low aromatic fuel area have expressed their concerns about sniffing fuel; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-15__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>whether people, including Aboriginal persons and Torres Strait Islanders, living in the area or any relevant low aromatic fuel area have expressed the view that their wellbeing will be improved if the area is designated as a fuel control area; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-15__subsec-3__para-e">
              <num>e</num>
              <content>
                <p>any submissions of the kind referred to in paragraph 16(2)(b); and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-15__subsec-3__para-f">
              <num>f</num>
              <content>
                <p>the availability of fuel (including low aromatic fuel) in relation to the area; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-15__subsec-3__para-g">
              <num>g</num>
              <content>
                <p>any other matter that <role refersTo="#minister">the Minister</role> considers relevant.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-3__sec-16">
          <num>16</num>
          <heading>Consultation before designating low aromatic fuel areas and fuel control areas</heading>
          <subsection eId="part-3__sec-16__subsec-1">
            <num>1</num>
            <content>
              <p>Before designating an area under <role refersTo="#minister">the Minister</role> must consult with such persons and bodies from among the following as <role refersTo="#minister">the Minister</role> considers appropriate:<ref href="#sec-14">section 14</ref> or 15, </p>
            </content>
            <paragraph eId="part-3__sec-16__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>community representatives;</p>
              </content>
            </paragraph>

                <p>their circumstances, concerns and views, so far as they relate to the proposal.</p>

            </paragraph>
          </subsection>
        </section>
      </part>

        <num>4</num>
        <heading>Exemptions from requirements of this Act</heading>
        <section eId="part-4__sec-17">
          <num>17</num>
          <heading>Minister may exempt conduct in relation to low aromatic fuel areas and fuel control areas</heading>
          <subsection eId="part-4__sec-17__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by written instrument, exempt specified conduct in, or in relation to, a low aromatic fuel area or a fuel control area for the purposes of subsection 8(4), 10(2) or 12(2), but only if <role refersTo="#minister">the Minister</role> is satisfied that:</p>
            </content>
            <paragraph eId="part-4__sec-17__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>there are special circumstances justifying the exemption; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>if the exemption is for the purposes of subsection 8(4), 10(2) or 12(2)—it is unlikely that the wellbeing of people, including Aboriginal persons and Torres Strait Islanders, will be adversely affected by the exemption; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-17__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>if the exemption is for the purposes of subsection 8(4)—the exemption is necessary because of the unavailability, or likely unavailability, of low aromatic fuel.</p>
              </content>
            </paragraph>
          </subsection>

              <p>Without limiting subsection (1), <role refersTo="#minister">the Minister</role> may exempt conduct:</p>
            </content>

                <p>by one or more specified corporations or corporations in a specified class; and</p>
              </content>
            </paragraph>

                <p>in, or in relation to, one or more specified areas or areas in a specified class.</p>

              <p>An exemption under subsection (1) is subject to the conditions specified in the exemption.</p>

              <p>An exemption made under subsection (1) exempting conduct in relation to one or more specified corporations is not a legislative instrument.</p>

              <p>An exemption made under subsection (1) exempting the following conduct is a legislative instrument:</p>

        <heading>Miscellaneous</heading>

          <num>18</num>
          <heading>Reviewing the operation of this Act</heading>
          <subsection eId="part-5__sec-18__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause a review of the operation of this Act to be undertaken as soon as possible after:</p>
            </content>
            <paragraph eId="part-5__sec-18__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the fifth anniversary of the commencement of this section; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-18__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>each fifth anniversary after the day mentioned in paragraph (a).</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-18__subsec-2">
            <num>2</num>
            <content>
              <p>The persons who undertake the review must give <role refersTo="#minister">the Minister</role> a written report of the review within one year after the relevant anniversary mentioned in subsection (1).</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-18__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause a copy of the report of the review to be tabled in each House of the Parliament within 15 sitting days of the day on which the report is given to <role refersTo="#minister">the Minister</role>.</p>

          </subsection>

          <num>18A</num>
          <heading>Acquisition of property</heading>
          <content>
            <p>This Act, or any instrument made under this Act, does not apply to the extent that the operation of this Act or the instrument would result in an acquisition of property (within the meaning of paragraph 51(xxxi) of the Constitution) from a person otherwise than on just terms (within the meaning of that paragraph).</p>

          <heading>Regulations</heading>

            <p>The Governor-General may make regulations prescribing matters:</p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.</p>
              <p>If a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.</p>
