        <heading>Short title</heading>

          <p>		This Act may be cited as the <i>Australian Sports Anti</i><i>-</i><i>Doping Authority Amendment</i><i> Act 201</i><i>3</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

            <heading>Section 4</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>evidential burden</i></b>, in relation to a matter, means the burden of adducing or pointing to evidence that suggests a reasonable possibility that the matter exists or does not exist.</p>
            </content>

            <heading>Section 4</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>relevant court</i></b> means:</p>
            </content>

              <content>
                <p>the Federal Court of Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-b">
              <num>b</num>
              <content>
                <p>the Federal Circuit Court of Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-c">
              <num>c</num>
              <content>
                <p>a court of a State or Territory that has jurisdiction in relation to matters arising under this Act.</p>
              </content>
            </paragraph>

            <num>7</num>
            <heading>After paragraph 13(1)(e)</heading>
            <content>
              <p>Insert:</p>
              <p>if <role refersTo="#ceo">the CEO</role> reasonably believes that the person has information, documents or things that may be relevant to the administration of the NAD scheme; and</p>
            </content>

                <p>authorise <role refersTo="#ceo">the CEO</role> to request a specified person to do one or more of the following within a specified period:</p>
              </content>
            </paragraph>

                <p>attend an interview to answer questions;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-7__para-ii">

            </paragraph>
            <paragraph eId="schedule-1__clause-7__para-iii">
              <num>iii</num>
              <content>
                <p>produce documents or things of a specified kind;</p>
              </content>
            </paragraph>

            <heading>Paragraph 13(1)(g)</heading>
            <content>
              <p>Repeal the paragraph, substitute:</p>

                <p>authorise <role refersTo="#ceo">the CEO</role> to disclose information, documents or things obtained in relation to the administration of the NAD scheme (including information obtained during investigations of possible violations of the anti-doping rules) for the purposes of, or in connection with, that administration; and</p>

            <num>13A</num>
            <heading>Power to require information or documents to be given</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-13A__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	The NAD scheme must authorise the CEO to give a person a written notice (a <b><i>disclosure notice</i></b>) requiring the person to do one or more of the following within the period specified in the notice:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-13A__para-a">
              <num>a</num>
              <content>
                <p>attend an interview to answer questions;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13A__para-b">
              <num>b</num>
              <content>
                <p>give information of the kind specified in the notice;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13A__para-c">
              <num>c</num>
              <content>
                <p>produce documents or things of the kind specified in the notice.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-13A__subclause-1A">
              <num>1A</num>
              <content>
                <p>The NAD scheme must provide that <role refersTo="#ceo">the CEO</role> must not give a disclosure notice to a person unless:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-13A__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#ceo">the CEO</role> declares in writing that <role refersTo="#ceo">the CEO</role> reasonably believes that the person has information, documents or things that may be relevant to the administration of the NAD scheme; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13A__para-b">
              <num>b</num>
              <content>
                <p>if:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13A__para-i">
              <num>i</num>
              <content>
                <p>the person is a registered medical practitioner; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13A__para-ii">
              <num>ii</num>
              <content>
                <p>the notice is given to the person in his or her capacity as a registered medical practitioner;</p>
              </content>
            </paragraph>
            <content>
              <p><role refersTo="#ceo">the CEO</role> declares in writing that <role refersTo="#ceo">the CEO</role> reasonably believes that the person has been involved, in that capacity, in the commission, or attempted commission, of a possible violation of the anti-doping rules; and</p>
            </content>
            <paragraph eId="schedule-1__clause-13A__para-c">
              <num>c</num>
              <content>
                <p>3 ADRVP members agree in writing that the belief referred to in paragraph (a) (and, if applicable, paragraph (b)) is reasonable.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-13A__subclause-2">
              <num>2</num>
              <content>
                <p>The NAD scheme may make provision in relation to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-13A__para-a">
              <num>a</num>
              <content>
                <p>disclosure notices; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13A__para-b">
              <num>b</num>
              <content>
                <p>the form and conduct of interviews; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13A__para-c">
              <num>c</num>
              <content>
                <p>the form in which information, documents, things and answers to questions must or may be given.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-13A__subclause-3">
              <num>3</num>
              <content>
                <p>Without limiting subsection (2), the NAD scheme must provide that a person who is given a disclosure notice has the right to be notified in writing of the possible consequences of a failure to comply with the disclosure notice.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-13B">
            <num>13B</num>
            <heading>CEO may retain and copy documents etc.</heading>
            <content>
              <p>Inspecting and making copies of documents</p>
              <p>Retaining documents and things</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-13B__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-13B__para-a">
              <num>a</num>
              <content>
                <p>inspect a document produced in response to a disclosure notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13B__para-b">
              <num>b</num>
              <content>
                <p>make and retain copies of, or take and retain extracts from, such a document.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-13B__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may take, and retain for as long as is necessary, possession of a document or thing produced in response to a disclosure notice.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-13B__subclause-3">
              <num>3</num>
              <content>
                <p>While <role refersTo="#ceo">the CEO</role> retains the document or thing, he or she must allow a person who would otherwise be entitled to inspect the document or view the thing to do so at the times that the person would ordinarily be able to do so.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-13C">
            <num>13C</num>
            <heading>Failure to comply with disclosure notice</heading>
            <content>
              <p>Failure to give information or produce documents in time</p>
              <p>of a kind specified in the notice; and</p>
              <p>Civil penalty:	<quantity refersTo="#penaltyUnit">30 penalty units</quantity>.</p>
              <p>Note:	A person bears an evidential burden in relation to the matter in this subsection: see <ref href="#sec-73R">section 73R</ref>.</p>
              <p>Failure to attend interview</p>
              <p>Civil penalty:	<quantity refersTo="#penaltyUnit">30 penalty units</quantity>.</p>
              <p>Failure to answer questions</p>
              <p>Civil penalty:	<quantity refersTo="#penaltyUnit">30 penalty units</quantity>.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-13C__subclause-1">
              <num>1</num>
              <content>
                <p>A person contravenes this subsection if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-13C__para-a">
              <num>a</num>
              <content>
                <p>the person is given a disclosure notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13C__para-b">
              <num>b</num>
              <content>
                <p>the notice requires the person to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13C__para-i">
              <num>i</num>
              <content>
                <p>give information; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13C__para-ii">
              <num>ii</num>
              <content>
                <p>produce documents or things;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13C__para-c">
              <num>c</num>
              <content>
                <p>the person fails to comply with the notice within the period specified in the notice.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-13C__subclause-2">
              <num>2</num>
              <content>
                <p>Subsection (1) does not apply if the person gives <role refersTo="#ceo">the CEO</role> a statutory declaration stating that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-13C__para-a">
              <num>a</num>
              <content>
                <p>the person does not possess the information, document or thing; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13C__para-b">
              <num>b</num>
              <content>
                <p>the person has taken all reasonable steps available to the person to obtain the information, document or thing and has been unable to obtain it.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-13C__subclause-3">
              <num>3</num>
              <content>
                <p>A person contravenes this subsection if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-13C__para-a">
              <num>a</num>
              <content>
                <p>the person is given a disclosure notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13C__para-b">
              <num>b</num>
              <content>
                <p>the notice requires the person to attend an interview to answer questions; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13C__para-c">
              <num>c</num>
              <content>
                <p>the person fails to comply with the notice.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-13C__subclause-4">
              <num>4</num>
              <content>
                <p>A person contravenes this subsection if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-13C__para-a">
              <num>a</num>
              <content>
                <p>the person is given a disclosure notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13C__para-b">
              <num>b</num>
              <content>
                <p>the notice requires the person to attend an interview to answer questions; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13C__para-c">
              <num>c</num>
              <content>
                <p>the person refuses or fails to answer a question.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-13D">
            <num>13D</num>
            <heading>Self-incrimination</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-13D__subclause-1">
              <num>1</num>
              <content>
                <p>An individual is excused from complying with a requirement to answer a question or to give information if the answer to the question or the information might tend to incriminate the individual or expose the individual to a penalty.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-13D__subclause-1A">
              <num>1A</num>
              <content>
                <p>A person is not excused from producing a document or thing as required by a disclosure notice given to the person on the ground that the document or thing might tend to incriminate the person or expose the person to a penalty.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-13D__subclause-2">
              <num>2</num>
              <content>
                <p>However, in the case of an individual, none of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-13D__para-a">
              <num>a</num>
              <content>
                <p>the document or thing produced;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13D__para-b">
              <num>b</num>
              <content>
                <p>the producing of the document or thing;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13D__para-c">
              <num>c</num>
              <content>
                <p>any information, document or thing obtained as a direct or indirect consequence of producing the document or thing;</p>
              </content>
            </paragraph>
            <content>
              <p>is admissible in evidence against the individual in:</p>
            </content>
            <paragraph eId="schedule-1__clause-13D__para-e">
              <num>e</num>
              <content>
                <p>	(e)	criminal proceedings, other than proceedings for an offence against <i>Criminal Code</i> that relates to this Act; or<ref href="#sec-137">section 137</ref>.1 (false or misleading information) or 137.2 (false or misleading documents) of the </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13D__para-f">
              <num>f</num>
              <content>
                <p>any proceedings that would expose the individual to a penalty, other than proceedings in connection with this Act or the regulations.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-13D__subclause-3">
              <num>3</num>
              <content>
                <p>To avoid doubt, proceedings (however described) before a sporting administration body or the Court of Arbitration for Sport or other sporting tribunal that relate to sports doping and safety matters are proceedings in connection with this Act or the regulations.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-10">
            <num>10</num>
            <heading>After paragraph 14(2)(a)</heading>
            <content>
              <p>Insert:</p>
            </content>
            <paragraph eId="schedule-1__clause-10__para-aa">
              <num>aa</num>
              <content>
                <p>to attend an interview to answer questions; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-ab">

            <num>11</num>
            <heading>Subsection 24N(1)</heading>

              <p>After “powers”, insert “(other than the power to give a disclosure notice)”.</p>

            <heading>Civil penalty provisions</heading>
            <content>
              <p>		A provision of this Act is a <b><i>civil penalty provision</i></b> if:</p>
            </content>
            <paragraph eId="schedule-1__clause-73A__para-a">
              <num>a</num>
              <content>

                <p>	(4)	An order under subsection (3) is a <b><i>civil penalty order</i></b>.</p>

                <p>The pecuniary penalty must not be more than:</p>
              </content>
            </hcontainer>

                <p>if the person is a body corporate—5 times the pecuniary penalty specified for the civil penalty provision; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73B__para-b">
              <num>b</num>

                <p>otherwise—the pecuniary penalty specified for the civil penalty provision.</p>
              </content>
            </paragraph>

                <p>In determining the pecuniary penalty, the court must take into account all relevant matters, including:</p>
              </content>

                <p>the nature and extent of the contravention; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73B__para-b">

                <p>the nature and extent of any loss or damage suffered because of the contravention; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73B__para-c">
              <num>c</num>
              <content>
                <p>the circumstances in which the contravention took place; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73B__para-d">
              <num>d</num>

                <p>whether the person has previously been found by a court (including a court in a foreign country) to have engaged in any similar conduct.</p>
              </content>
            </paragraph>

            <heading>Civil enforcement of penalty</heading>

                <p>A pecuniary penalty is a debt payable to the Commonwealth.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-73C__subclause-2">
              <num>2</num>
              <content>
                <p>The Commonwealth may enforce a civil penalty order as if it were an order made in civil proceedings against the person to recover a debt due by the person. The debt arising from the order is taken to be a judgement debt.</p>
              </content>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-73D">
            <num>73D</num>
            <heading>Conduct contravening more than one civil penalty provision</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-73D__subclause-1">
              <num>1</num>
              <content>
                <p>If conduct constitutes a contravention of 2 or more civil penalty provisions, proceedings may be instituted under this Part against a person in relation to the contravention of any one or more of those provisions.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-73D__subclause-2">
              <num>2</num>
              <content>
                <p>However, the person is not liable to more than one pecuniary penalty under this Part in relation to the same conduct.</p>
              </content>
            </hcontainer>

            <heading>Multiple contraventions</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-73E__subclause-1">
              <num>1</num>

                <p>A relevant court may make a single civil penalty order against a person for multiple contraventions of a civil penalty provision if proceedings for the contraventions are founded on the same facts, or if the contraventions form, or are part of, a series of contraventions of the same or a similar character.</p>
              </content>
            </hcontainer>

              <p>Note:	For continuing contraventions of civil penalty provisions, see <ref href="#sec-73N">section 73N</ref>.</p>

            <heading>Proceedings may be heard together</heading>

              <p>A relevant court may direct that 2 or more proceedings for civil penalty orders are to be heard together.</p>

            <heading>Civil evidence and procedure rules for civil penalty orders</heading>
            <content>
              <p>A relevant court must apply the rules of evidence and procedure for civil matters when hearing proceedings for a civil penalty order.</p>
            </content>

            <heading>Civil proceedings after criminal proceedings</heading>
            <content>
              <p>A relevant court may not make a civil penalty order against a person for a contravention of a civil penalty provision if the person has been convicted of an offence constituted by conduct that is the same, or substantially the same, as the conduct constituting the contravention.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-73J">
            <num>73J</num>
            <heading>Criminal proceedings during civil proceedings</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-73J__subclause-1">
              <num>1</num>
              <content>
                <p>Proceedings for a civil penalty order against a person for a contravention of a civil penalty provision are stayed if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-73J__para-a">
              <num>a</num>
              <content>
                <p>criminal proceedings are commenced or have already been commenced against the person for an offence; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73J__para-b">
              <num>b</num>
              <content>
                <p>the offence is constituted by conduct that is the same, or substantially the same, as the conduct alleged to constitute the contravention.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-73J__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	The proceedings for the order (the <b><i>civil proceedings</i></b>) may be resumed if the person is not convicted of the offence. Otherwise:</p>
              </content>

              <content>
                <p>the civil proceedings are dismissed; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73J__para-b">

                <p><i>	</i>(b)	costs must not be awarded in relation to the civil proceedings.</p>
              </content>
            </paragraph>

            <heading>Criminal proceedings after civil proceedings</heading>

              <p>Criminal proceedings may be commenced against a person for conduct that is the same, or substantially the same, as conduct that would constitute a contravention of a civil penalty provision regardless of whether a civil penalty order has been made against the person in relation to the contravention.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-73L">
            <num>73L</num>
            <heading>Evidence given in civil proceedings not admissible in criminal proceedings</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-73L__subclause-1">
              <num>1</num>
              <content>
                <p>Evidence of information given, or evidence of production of documents, by an individual is not admissible in criminal proceedings against the individual if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-73L__para-a">
              <num>a</num>
              <content>
                <p>the individual previously gave the information or produced the documents in proceedings for a civil penalty order against the individual for an alleged contravention of a civil penalty provision (whether or not the order was made); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73L__para-b">
              <num>b</num>
              <content>
                <p>the conduct alleged to constitute the offence is the same, or substantially the same, as the conduct alleged to constitute the contravention.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-73L__subclause-2">
              <num>2</num>
              <content>
                <p>However, subsection (1) does not apply to criminal proceedings in relation to the falsity of the evidence given by the individual in the proceedings for the civil penalty order.</p>
              </content>
            </hcontainer>
          </hcontainer>

            <num>73M</num>
            <heading>Ancillary contravention of civil penalty provisions</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-73M__subclause-1">
              <num>1</num>
              <content>
                <p>A person must not:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-73M__para-a">
              <num>a</num>
              <content>
                <p>attempt to contravene a civil penalty provision; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73M__para-b">
              <num>b</num>
              <content>
                <p>aid, abet, counsel or procure a contravention of a civil penalty provision; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73M__para-c">
              <num>c</num>
              <content>
                <p>induce (by threats, promises or otherwise) a contravention of a civil penalty provision; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73M__para-d">
              <num>d</num>
              <content>
                <p>be in any way, directly or indirectly, knowingly concerned in, or party to, a contravention of a civil penalty provision; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73M__para-e">
              <num>e</num>
              <content>
                <p>conspire with others to effect a contravention of a civil penalty provision.</p>
              </content>
            </paragraph>
            <content>
              <p>Civil penalty</p>
              <p>Note:	Section 73P (which provides that a person’s state of mind does not need to be proven in relation to a civil penalty provision) does not apply to the extent that proceedings relate to the contravention of subsection (1) of this section.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-73M__subclause-2">
              <num>2</num>
              <content>
                <p>A person who contravenes subsection (1) in relation to a civil penalty provision is taken to have contravened the provision.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-73N">
            <num>73N</num>
            <heading>Continuing contraventions of civil penalty provisions</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-73N__subclause-1">
              <num>1</num>
              <content>
                <p>If an act or thing is required under a civil penalty provision to be done:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-73N__para-a">
              <num>a</num>
              <content>
                <p>within a particular period; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73N__para-b">
              <num>b</num>
              <content>
                <p>before a particular time;</p>
              </content>
            </paragraph>
            <content>
              <p>then the obligation to do that act or thing continues until the act or thing is done (even if the period has expired or the time has passed).</p>
              <p>commits a separate contravention of that provision in respect of each day during which the contravention occurs (including the day the relevant civil penalty order is made or any later day).</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-73N__subclause-2">
              <num>2</num>
              <content>
                <p>A person who contravenes a civil penalty provision that requires an act or thing to be done:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-73N__para-a">
              <num>a</num>
              <content>
                <p>within a particular period; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73N__para-b">
              <num>b</num>
              <content>
                <p>before a particular time;</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-73P">
            <num>73P</num>
            <heading>State of mind</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-73P__subclause-1">
              <num>1</num>
              <content>
                <p>In proceedings for a civil penalty order against a person for a contravention of a civil penalty provision, it is not necessary to prove:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-73P__para-a">
              <num>a</num>
              <content>
                <p>the person’s intention; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73P__para-b">
              <num>b</num>
              <content>
                <p>the person’s knowledge; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73P__para-c">
              <num>c</num>
              <content>
                <p>the person’s recklessness; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73P__para-d">
              <num>d</num>
              <content>
                <p>the person’s negligence; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73P__para-e">
              <num>e</num>
              <content>
                <p>any other state of mind of the person.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-73P__subclause-2">
              <num>2</num>
              <content>
                <p>Subsection (1) does not apply to the extent that the proceedings relate to a contravention of subsection 73M(1) (ancillary contravention of civil penalty provisions).</p>

                <p>Subsection (1) does not affect the operation of <ref href="#sec-73Q">section 73Q</ref> (mistake of fact).</p>

            <heading>Mistake of fact</heading>

                <p>A person is not liable to have a civil penalty order made against the person for a contravention of a civil penalty provision if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-73Q__para-a">
              <num>a</num>
              <content>
                <p>at or before the time of the conduct constituting the contravention, the person:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73Q__para-i">
              <num>i</num>
              <content>
                <p>considered whether or not facts existed; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73Q__para-ii">
              <num>ii</num>
              <content>
                <p>was under a mistaken but reasonable belief about those facts; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73Q__para-b">
              <num>b</num>
              <content>
                <p>had those facts existed, the conduct would not have constituted a contravention of the civil penalty provision.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-73Q__subclause-2">
              <num>2</num>
              <content>
                <p>For the purposes of subsection (1), a person may be regarded as having considered whether or not facts existed if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-73Q__para-a">
              <num>a</num>
              <content>
                <p>the person had considered, on a previous occasion, whether those facts existed in the circumstances surrounding that occasion; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-73Q__para-b">
              <num>b</num>
              <content>
                <p>the person honestly and reasonably believed that the circumstances surrounding the present occasion were the same, or substantially the same, as those surrounding the previous occasion.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-73Q__subclause-3">
              <num>3</num>
              <content>
                <p>A person who wishes to rely on subsection (1) or (2) in proceedings for a civil penalty order bears an evidential burden in relation to that matter.</p>
              </content>

            <num>73R</num>
            <heading>Exceptions etc. to civil penalty provisions—burden of proof</heading>
            <content>
              <p>If, in proceedings for a civil penalty order against a person for a contravention of a civil penalty provision, the person wishes to rely on any exception, exemption, excuse, qualification or justification provided by the law creating the civil penalty provision, then the person bears an evidential burden in relation to that matter.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-73S">
            <num>73S</num>
            <heading>Civil penalty provisions contravened by employees, agents or officers</heading>
            <content>
              <p>If an element of a civil penalty provision is done by an employee, agent or officer of a body corporate acting within the actual or apparent scope of his or her employment, or within his or her actual or apparent authority, the element must also be attributed to the body corporate.</p>
            </content>

                <p>The Governor-General may make regulations prescribing matters of a transitional nature (including prescribing any saving or application provisions) in relation to matters arising from the amendments made by this Schedule.</p>
