          <p>		This Act may be cited as the <i>Public Interest Disclosure (Consequential Amendments)</i><i> Act 201</i><i>3</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

                <p>If:</p>

              <num>a</num>
              <content>
                <p>	(a)	a disclosure of information has been, or is required to be, allocated under <i>Public Interest Disclosure Act 2013</i>; and<ref href="#sec-43">section 43</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-8A__para-b">
              <num>b</num>
              <content>
                <p>some or all of the disclosable conduct with which the information is concerned relates (within the meaning of that Act) to an intelligence agency;</p>
              </content>
            </paragraph>
            <content>
              <p>to the extent that the conduct so relates, it is taken, for the purposes of this Act, to be action that relates to the propriety of particular activities of the intelligence agency.</p>
              <p>Note:	The Inspector-General’s functions under <ref href="#sec-8">section 8</ref> include inquiring into the propriety of particular activities of intelligence agencies.</p>

                <p>However, in determining whether the Inspector-General is authorised to inquire into the matter under <ref href="#sec-8">section 8</ref>, disregard subsection 8(4).</p>

              <num>3</num>
              <content>
                <p>For the purposes of the application of this Act to the action:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-8A__para-a">
              <num>a</num>
              <content>
                <p>the conduct is to be treated as if it were action taken by the intelligence agency; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-8A__para-b">
              <num>b</num>
              <content>
                <p>	(b)	a public official who belongs (within the meaning of the <i>Public Interest Disclosure Act 2013</i>) to the intelligence agency is taken to be a member of the intelligence agency; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-8A__para-c">
              <num>c</num>
              <content>
                <p>the person who disclosed the information is taken, if the disclosure is allocated to the Inspector-General, to have made a complaint to the Inspector-General in respect of the action.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-8A__subclause-4">
              <num>4</num>
              <content>
                <p>However, paragraph (3)(c) does not apply if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-8A__para-a">
              <num>a</num>
              <content>
                <p>the person is not an Australian citizen or permanent resident, and the intelligence agency is ASIS, DIGO or DSD; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-8A__para-b">
              <num>b</num>
              <content>
                <p>the intelligence agency is DIO or ONA.</p>
              </content>
            </paragraph>

              <num>5</num>
              <content>
                <p>It is immaterial whether the disclosable conduct occurred before or after the commencement of this section.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-4">
            <num>4</num>
            <heading>Subsection 34(1)</heading>
            <content>
              <p>After “powers under this Act”, insert “or the <i>Public Interest Disclosure Act 201</i><i>3</i>”.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-5">
            <num>5</num>
            <heading>Paragraph 34(5)(c)</heading>
            <content>
              <p>Repeal the paragraph, substitute:</p>
              <p>Ombudsman Act 1976</p>
            </content>
            <paragraph eId="schedule-1__clause-5__para-c">
              <num>c</num>
              <content>
                <p>if the information is obtained by the person because the person is performing functions or duties or exercising powers under this Act:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-i">
              <num>i</num>
              <content>
                <p>unless subparagraph (ii) applies—for the purposes of this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	if the information is obtained for the purposes of an investigation by the Inspector-General under the <i>Public Interest Disclosure Act 201</i><i>3</i>—for the purposes of that Act; and</p>
              </content>
            </paragraph>
          </hcontainer>

            <num>6</num>
            <heading>Subsection 3(1)</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>A</i></b><b><i>gency Head</i></b> has the same meaning as in the <i>Public Service Act 1999</i>.</p>
              <p><b><i>APS Code of Conduct</i></b> means the rules in section 13 of the <i>Public Service Act 1999</i>.</p>
              <p><b><i>disclosable conduct</i></b> has the same meaning as in the <i>Public Interest Disclosure Act 2013</i>.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-7">
            <num>7</num>
            <heading>Subsection 3(1) (definition of Secretary)</heading>
            <content>
              <p>Repeal the definition, substitute:</p>
              <p><b><i>Secretary</i></b> means:</p>
            </content>
            <paragraph eId="schedule-1__clause-7__para-a">
              <num>a</num>
              <content>
                <p>	(a)	in relation to a Department—the person who is the Secretary of the Department for the purposes of the <i>Public Service Act 1999</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-7__para-b">
              <num>b</num>
              <content>
                <p>	(b)	in relation to a Parliamentary Department—the person who is the Secretary of the Parliamentary Department for the purposes of the <i>Parliamentary</i><i> Service Act 1999</i>.</p>
              </content>
            </paragraph>

            <heading>Public interest disclosure functions of Ombudsman</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-5A__subclause-1">
              <num>1</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5A__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a disclosure of information has been, or is required to be, allocated under <i>Public Interest Disclosure Act 2013</i>; and<ref href="#sec-43">section 43</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5A__para-b">
              <num>b</num>
              <content>
                <p>some or all of the disclosable conduct with which the information is concerned relates (within the meaning of that Act) to an agency (within the meaning of that Act); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5A__para-c">
              <num>c</num>
              <content>
                <p>the agency is neither an intelligence agency (within the meaning of that Act) nor the Inspector-General of Intelligence and Security;</p>
              </content>
            </paragraph>
            <content>
              <p>to the extent that the conduct so relates, it is taken, for the purposes of this Act, to be action that relates to a matter of administration.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-5A__subclause-2">
              <num>2</num>
              <content>
                <p>For the purposes of the application of this Act to the action:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5A__para-a">
              <num>a</num>
              <content>
                <p>the agency is taken to be a prescribed authority; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5A__para-b">
              <num>b</num>
              <content>
                <p>the action is to be treated as if it were action taken by the prescribed authority; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5A__para-c">
              <num>c</num>
              <content>
                <p>	(c)	a public official who belongs (within the meaning of the <i>Public Interest Disclosure Act 2013</i>) to the agency is taken to be an officer of the prescribed authority; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5A__para-d">
              <num>d</num>
              <content>
                <p>the person who disclosed the information is taken, if the disclosure is allocated to the Ombudsman, to have made a complaint to the Ombudsman in respect of the action.</p>
              </content>
            </paragraph>

              <num>3</num>
              <content>
                <p>It is immaterial whether the disclosable conduct occurred before or after the commencement of this section.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9">
            <num>9</num>
            <heading>After subsection 6(10)</heading>
            <content>
              <p>Insert:</p>
              <p>the Ombudsman may decide not to investigate the complaint, or not to investigate the complaint further, as the case may be, and to transfer the complaint to the Parliamentary Service Commissioner.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-9__subclause-11">
              <num>11</num>
              <content>
                <p>In considering whether to make a decision under subsection (9) relating to a complaint that includes an allegation of misconduct by an Agency Head, the Ombudsman must consult with the Australian Public Service Commissioner.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-9__subclause-11A">
              <num>11A</num>
              <content>
                <p>If the Ombudsman forms the opinion:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9__para-a">
              <num>a</num>
              <content>
                <p>	(a)	that a complaint could have been made under the <i>Parliamentary Service Act 1999</i>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9__para-b">
              <num>b</num>
              <content>
                <p>that the complaint could be more conveniently or effectively dealt with by the Parliamentary Service Commissioner;</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-9__subclause-11B">
              <num>11B</num>
              <content>
                <p>If the Ombudsman makes a decision under subsection (11A), the Ombudsman must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-9__para-a">
              <num>a</num>
              <content>
                <p>transfer the complaint to the Parliamentary Service Commissioner as soon as is reasonably practicable; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9__para-b">
              <num>b</num>
              <content>
                <p>give the Parliamentary Service Commissioner any information or documents relating to the complaint that are in the possession, or under the control, of the Ombudsman; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9__para-c">
              <num>c</num>
              <content>
                <p>as soon as is reasonably practicable, give the complainant written notice that the complaint has been transferred to the Parliamentary Service Commissioner.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-9__subclause-11C">
              <num>11C</num>
              <content>
                <p>In considering whether to make a decision under subsection (11A) relating to a complaint that includes an allegation of misconduct by <role refersTo="#secretary">the Secretary</role> of a Parliamentary Department, the Ombudsman must consult with the Parliamentary Service Commissioner.</p>

            <heading>Paragraphs 8(10)(c) and (d)</heading>

              <p>After “prescribed authority”, insert “(other than a Parliamentary Department)”.</p>

                <p>Without limiting subsection (10), if the Ombudsman forms the opinion, either before or after completing an investigation under this Act, that there is evidence that an Agency Head may have breached the APS Code of Conduct, the Ombudsman must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-16__para-a">
              <num>a</num>
              <content>
                <p>unless the Agency Head is the Australian Public Service Commissioner—bring the evidence to the notice of the Australian Public Service Commissioner; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-16__para-b">
              <num>b</num>
              <content>
                <p>if the Agency Head is the Australian Public Service Commissioner—bring the evidence to the notice of the Merit Protection Commissioner.</p>
              </content>
            </paragraph>

              <num>10B</num>
              <content>
                <p>	(10B)	Without limiting subsection (10), if the Ombudsman forms the opinion, either before or after completing an investigation under this Act, that there is evidence that the Secretary of a Parliamentary Department may have breached the Code of Conduct (within the meaning of the <i>Parliamentary Service Act 1999</i>), the Ombudsman must bring the evidence to the notice of the Parliamentary Service Commissioner.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-16__subclause-10C">
              <num>10C</num>
              <content>
                <p>	(10C)	Without limiting subsection (10), if the Ombudsman forms the opinion, either before or after completing an investigation under this Act, that there is evidence that the Parliamentary Service Commissioner may have breached the Code of Conduct (within the meaning of the <i>Parliamentary Service Act 1999</i>), the Ombudsman must bring the evidence to the notice of the Parliamentary Service Merit Protection Commissioner.</p>

            <heading>Subsection 35(4)</heading>
