          <p>		This Act may be cited as the <i>Public Service Amendment </i><i>Act 201</i><i>3</i>.</p>
        </content>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

                <p>The roles of <role refersTo="#secretary">the Secretary</role> of a Department include, but are not limited to, the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-57__para-a">
              <num>a</num>
              <content>
                <p>principal official policy adviser to the Agency Minister;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57__para-b">
              <num>b</num>
              <content>
                <p>manager, ensuring delivery of government programs and collaboration to achieve outcomes within the Agency Minister’s portfolio and, with other Secretaries, across the whole of Government;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57__para-c">
              <num>c</num>
              <content>
                <p>leader, providing stewardship within the Department and, in partnership with the Secretaries Board, across the APS;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57__para-d">
              <num>d</num>
              <content>
                <p>any other role prescribed by the regulations.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-57__subclause-2">
              <num>2</num>
              <content>
                <p>The responsibilities of <role refersTo="#secretary">the Secretary</role> of a Department are as follows:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-57__para-a">
              <num>a</num>
              <content>
                <p>to manage the affairs of the Department efficiently, effectively, economically and ethically;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57__para-b">
              <num>b</num>
              <content>
                <p>to advise the Agency Minister about matters relating to the Department;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57__para-c">
              <num>c</num>
              <content>
                <p>to implement measures directed at ensuring that the Department complies with the law;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57__para-d">
              <num>d</num>
              <content>
                <p>to provide leadership, strategic direction and a focus on results for the Department;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57__para-e">
              <num>e</num>
              <content>
                <p>to maintain clear lines of communication within the Agency Minister’s portfolio, as negotiated between <role refersTo="#secretary">the Secretary</role> and the other Agency Heads in the portfolio;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57__para-f">
              <num>f</num>
              <content>
                <p>to engage with stakeholders, particularly in relation to the core activities of the Department;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57__para-g">
              <num>g</num>
              <content>
                <p>to manage the affairs of the Department in a way that is not inconsistent with the policies of the Commonwealth and the interests of the APS as a whole;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57__para-h">
              <num>h</num>
              <content>
                <p>to ensure that the Agency Minister’s portfolio has a strong strategic policy capability that can consider complex, whole-of-government issues;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57__para-i">
              <num>i</num>
              <content>
                <p>to assist the Agency Minister to fulfil the Agency Minister’s accountability obligations to the Parliament to provide factual information, as required by the Parliament, in relation to the operation and administration of the Department;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-57__para-j">
              <num>j</num>
              <content>
                <p>such other responsibilities as are prescribed by the regulations.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-57__subclause-3">
              <num>3</num>
              <content>
                <p>Subsection (2) does not affect a Secretary’s responsibilities under any other law.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-58">
            <num>58</num>
            <heading>Appointment</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-58__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> of a Department is to be appointed by the Governor-General, by written instrument, on the recommendation of the Prime Minister.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	The Secretary of a Department is eligible for reappointment as the Secretary of that Department (see <i>Acts Interpretation Act 1901</i>).<ref href="#sec-33A">section 33A</ref>A of the </p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-58__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> of a Department holds office for the period specified in the instrument of appointment.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-58__subclause-3">
              <num>3</num>
              <content>
                <p>The period of a person’s appointment as <role refersTo="#secretary">the Secretary</role> of a Department must be:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-58__para-a">
              <num>a</num>
              <content>
                <p>5 years; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-58__para-b">
              <num>b</num>
              <content>
                <p>if the person has requested a shorter period—that shorter period.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-58__subclause-4">
              <num>4</num>
              <content>
                <p>Subsection (3) does not apply in relation to a person who is reappointed as <role refersTo="#secretary">the Secretary</role> of a Department. In this case, the person’s appointment may be for any period not exceeding 5 years.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-58__subclause-5">
              <num>5</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role> of a Department holds office on a full-time basis.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-58__subclause-6">
              <num>6</num>
              <content>
                <p>Before recommending to the Governor-General that a person be appointed as <role refersTo="#secretary">the Secretary</role> of the Prime Minister’s Department, the Prime Minister must have received a report about the appointment prepared by <role refersTo="#commissioner">the Commissioner</role>.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-58__subclause-7">
              <num>7</num>
              <content>
                <p>Before recommending to the Governor-General that a person be appointed as <role refersTo="#secretary">the Secretary</role> of a Department other than the Prime Minister’s Department, the Prime Minister must have received a report about the appointment from <role refersTo="#secretary">the Secretary</role> of the Prime Minister’s Department.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-58__subclause-8">
              <num>8</num>
              <content>
                <p>The report from <role refersTo="#secretary">the Secretary</role> of the Prime Minister’s Department about the appointment of <role refersTo="#secretary">the Secretary</role> of another Department must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-58__para-a">
              <num>a</num>
              <content>
                <p>be prepared after consultation with:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-58__para-i">
              <num>i</num>
              <content>
                <p><role refersTo="#commissioner">the Commissioner</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-58__para-ii">
              <num>ii</num>
              <content>
                <p>the person who is expected to be the Agency Minister of the other Department at the time the appointment is made; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-58__para-b">
              <num>b</num>
              <content>
                <p>if <role refersTo="#secretary">the Secretary</role> of the Prime Minister’s Department and <role refersTo="#commissioner">the Commissioner</role> disagree in relation to the proposed appointment—explain the substance of the disagreement.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-59">
            <num>59</num>
            <heading>Termination of appointment</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-59__subclause-1">
              <num>1</num>
              <content>
                <p>The Governor-General may, on the recommendation of the Prime Minister and by notice in writing, terminate the appointment of a Secretary.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	In <i>Barratt v Howard</i> [1999] FCA 1132, the Federal Court of Australia described the basis on which requirements of procedural fairness applied to the termination of an appointment of Secretary under section 37 of the <i>Public Service Act 1922</i>.</p>
            </content>

              <num>2</num>
              <content>
                <p>	(2)	Before recommending to the Governor-General that the appointment of the Secretary of the Prime Minister’s Department be terminated, the Prime Minister must have received a report about the<i> </i>proposed termination<i> </i>from the Commissioner.</p>

            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-59__subclause-3">
              <num>3</num>
              <content>
                <p>	(3)	Before recommending to the Governor-General that the appointment of the Secretary of a Department other than the Prime Minister’s Department be terminated, the Prime Minister must have received a report about the<i> </i>proposed termination<i> </i>from the Secretary of the Prime Minister’s Department.</p>

              </content>
            </paragraph>

                <p>such other persons as are nominated in writing by <role refersTo="#secretary">the Secretary</role> of the Prime Minister’s Department.</p>

              <content>
                <p>The Secretaries Board has the following functions:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-64__para-a">
              <num>a</num>
              <content>
                <p>to take responsibility for the stewardship of the APS and for developing and implementing strategies to improve the APS;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-64__para-b">
              <num>b</num>
              <content>
                <p>to identify strategic priorities for the APS and consider issues that affect the APS;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-64__para-c">
              <num>c</num>
              <content>
                <p>to set an annual work program, and direct subcommittees to develop strategies to address APS-wide issues and make recommendations to the Secretaries Board;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-64__para-d">
              <num>d</num>
              <content>
                <p>to draw together advice from senior leaders in government, business and the community;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-64__para-e">
              <num>e</num>
              <content>
                <p>to work collaboratively and model leadership behaviours.</p>
              </content>
            </paragraph>

              <num>4</num>
              <content>

                <p>The Prime Minister may make a request under paragraph (1)(a) in relation to an alleged breach of the Code of Conduct of which the Prime Minister has become aware as a result of, or in the course of, a systems review or a special review.</p>

                <p><role refersTo="#commissioner">The Commissioner</role> must establish written procedures for inquiring into and determining whether an APS employee, or a former APS employee, in an Agency has breached the Code of Conduct (including by engaging in conduct referred to in subsection 15(2A)). The procedures:</p>

                <p>must comply with basic procedural requirements prescribed by the regulations; and</p>

                <p>must have due regard to procedural fairness.</p>
              </content>
            </paragraph>

                <p>In addition, and without affecting subsection (3), the procedures may be different for:</p>
              </content>

                <p>different categories of APS employees or former APS employees; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41B__para-b">

                <p>APS employees, or former APS employees, who:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41B__para-i">
              <num>i</num>
              <content>
                <p>have been convicted of an offence against a Commonwealth, State or Territory law in respect of conduct that is alleged to constitute a breach of the Code of Conduct; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41B__para-ii">
              <num>ii</num>
              <content>
                <p>have been found to have committed such an offence but no conviction is recorded.</p>
              </content>
            </paragraph>

                <p><role refersTo="#commissioner">The Commissioner</role> must ensure that the procedures established under subsection (3) are made publicly available.</p>

                <p>	(1)	The Prime Minister may direct the Commissioner to conduct a review (a <b><i>systems review</i></b>) of any matter relating to an Agency, including:</p>

                <p>the management and organisational systems, structures or processes in an Agency; and</p>
              </content>
            </paragraph>

            <heading>Protection of information—Merit Protection Commissioner’s functions etc.</heading>

              <p>Definitions</p>
              <p><b><i>entrusted person</i></b> means any of the following:</p>
              <p><b><i>prescribed entrusted person</i></b> means an entrusted person of a kind prescribed by regulations for the purposes of this definition.</p>
              <p><b><i>protected information</i></b> means information that was obtained by an entrusted person in connection with the performance of functions or duties, or the exercise of powers, under:</p>
              <p>Prohibition on disclosure or other use of protected information</p>
              <p>Note:	Section 70 of the <i>Crimes Act 1914</i> creates offences in relation to the disclosure of information by Commonwealth officers.</p>
              <p>Authorised disclosure or other use of protected information</p>
              <p>Authorised disclosure of protected information by the Merit Protection Commissioner</p>
              <p>Compellability of entrusted persons to give evidence</p>
              <p>to disclose protected information that was obtained in connection with the performance of functions or duties, or the exercise of powers, under:</p>

                <p>any other person prescribed by the regulations for the purposes of this paragraph.</p>

            </paragraph>

                <p>subsection 50(1) or (2); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72B__para-b">

              <content>
                <p>Except as authorised by this section or the regulations, a person who is, or was, an entrusted person must not, directly or indirectly, make a record of, disclose or otherwise use protected information.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-72B__subclause-3">
              <num>3</num>
              <content>
                <p>An entrusted person may make a record of, disclose or otherwise use protected information for the purposes of, or in connection with, the performance of functions or duties, or the exercise of powers, under this Act or the regulations.</p>
              </content>

            <hcontainer name="subclause" eId="schedule-1__clause-72B__subclause-4">
              <num>4</num>
              <content>
                <p>The Merit Protection Commissioner may disclose protected information in a report prepared for purposes connected with the performance of the functions, or the exercise of the powers, of the Merit Protection Commissioner under this Act or the regulations, if the Merit Protection Commissioner is satisfied that the disclosure is necessary for the purpose of setting out the grounds for the conclusions and recommendations contained in the report.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-72B__subclause-5">
              <num>5</num>
              <content>
                <p>Subject to subsection (6), the Merit Protection Commissioner may disclose protected information to a person, or to the public or a section of the public, if the Merit Protection Commissioner is satisfied that:</p>
              </content>

            <paragraph eId="schedule-1__clause-72B__para-a">
              <num>a</num>
              <content>
                <p>the disclosure:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72B__para-i">
              <num>i</num>

                <p>is in the interests of an Agency or a person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72B__para-ii">
              <num>ii</num>
              <content>
                <p>is in the public interest; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72B__para-b">
              <num>b</num>
              <content>
                <p>the disclosure is not likely to interfere with a review or inquiry under this Act or the regulations.</p>
              </content>
            </paragraph>

              <num>6</num>
              <content>
                <p>The Merit Protection Commissioner must not disclose the name of an individual, or any other material that would enable an individual to be identified, in protected information that is disclosed under subsection (5), unless the Merit Protection Commissioner is satisfied that the disclosure is fair and reasonable in all the circumstances.</p>

                <p>a person reasonably believes that information or a document is relevant for purposes connected with the performance of functions or duties, or the exercise of powers, under a provision referred to in subsection (2); and</p>

              <num>b</num>
              <content>
                <p>the person obtained the information or document lawfully; and</p>
              </content>
            </paragraph>

                <p>If, by giving the information or producing the document to <role refersTo="#commissioner">the Commissioner</role>, the person:</p>

              <num>a</num>
              <content>
                <p>contravenes any other law; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72C__para-b">
              <num>b</num>
              <content>
                <p>might tend to incriminate the person or make the person liable to a penalty; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72C__para-c">
              <num>c</num>
              <content>
                <p>discloses legal advice given to a Minister or an Agency; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72C__para-d">
              <num>d</num>
              <content>
                <p>discloses a communication between a person performing functions or duties, or exercising powers, in an Agency and another person or body, being a communication protected against disclosure by legal professional privilege; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72C__para-e">
              <num>e</num>
              <content>
                <p>otherwise acts contrary to the public interest;</p>
              </content>
            </paragraph>

            <heading>Saving—right of return for election candidates</heading>
            <hcontainer name="subclause" eId="schedule-4__clause-45__subclause-1">
              <num>1</num>
              <content>
                <p>This item applies to a person (and <ref href="#sec-32">section 32</ref> of the new Public Service Act does not apply to the person) if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-4__clause-45__para-a">
              <num>a</num>
              <content>
                <p>before the commencement time, the person resigned as an APS employee in order to contest an election prescribed by regulations in force for the purposes of paragraph 32(1)(a) of the old Public Service Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-45__para-b">
              <num>b</num>
              <content>
                <p>the resignation took effect not earlier than 6 months before the closing date for nominations; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-4__clause-45__para-c">
              <num>c</num>
              <content>
                <p>the person was a candidate in the election but failed to be elected.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-4__clause-45__subclause-2">
              <num>2</num>
              <content>
                <p>The person is entitled to be again engaged as an APS employee, in accordance with regulations in force for the purposes of subsection 32(2) of the old Public Service Act and within the time limits prescribed by those regulations.</p>

          </hcontainer>
          <hcontainer name="clause" eId="schedule-4__clause-46">
            <num>46</num>
            <heading>Saving—Commissioner’s Directions on SES matters</heading>
            <content>
              <p>Despite the repeal of <i> </i>by item<i> </i>84 of Schedule 1 to this Act, Commissioner’s Directions in force for the purposes of that section continue in force at and after the commencement time as if they were Commissioner’s Directions about employment matters relating to SES employees issued for the purposes of paragraphs 11A(1)(a), (b), (c), (d) and (f) of the new Public Service Act.<ref href="#sec-36">section 36</ref> of the old Public Service Act</p>

          <hcontainer name="clause" eId="schedule-4__clause-47">
            <num>47</num>
            <heading>Reduction in classification of APS employee</heading>
            <content>
              <p>The amendment of subsection 23(5) of the <i>Public Service Act 1999</i> made by item 89 of Schedule 1 to this Act applies in relation to a reduction in the classification of an APS employee that occurs at or after the commencement time.</p>

            <heading>Determinations of terms and conditions of employment</heading>

                <p>(1)	The amendment of subsection 24(1) of the <i>Public Service Act 1999</i> made by item 91 of Schedule 1 to this Act does not affect the continuity of a determination that was in force under that subsection immediately before the commencement time.</p>
