          <p>		This Act may be cited as the <i>Higher Education Support Amendment (Further Streamlining and Other Measures)</i><i> Act 201</i><i>3</i>.</p>

        <num>2</num>
        <heading>Commencement</heading>
        <content>
          <p>This Act commences on the day after this Act receives the Royal Assent.</p>
        </content>
      </section>

        <heading>Schedule(s)</heading>
        <content>
          <p>Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

            <heading>Automatic revocation of approval if registration ceases</heading>

              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must revoke a body’s approval as a higher education provider if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-22-2__para-a">
              <num>a</num>
              <content>
                <p>the body is no longer a *registered higher education provider; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22-2__para-b">
              <num>b</num>
              <content>
                <p>in a case where *TEQSA has made either of the following decisions under the *TEQSA Act, the decision has not been set aside or quashed, and is no longer *subject to review:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22-2__para-i">
              <num>i</num>
              <content>
                <p>a decision under <ref href="#sec-36">section 36</ref> of that Act to refuse an application to renew the body’s registration under <ref href="#part-3">Part 3</ref> of that Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22-2__para-ii">
              <num>ii</num>
              <content>
                <p>a decision under <ref href="#sec-101">section 101</ref> of that Act to cancel the body’s registration under <ref href="#part-3">Part 3</ref> of that Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-22-2__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must notify the body in writing of the revocation. The notice must specify that the revocation takes effect on the day that the notice is registered in the *Federal Register of Legislative Instruments.</p>
              </content>

              <num>3</num>
              <content>

            <heading>Automatic revocation of approval if winding up order made</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-22-3__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must revoke a body’s approval as a higher education provider if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-22-3__para-a">
              <num>a</num>
              <content>
                <p>	(a)	an order is made by a court, or by the Australian Securities and Investments Commission under <i>Corporations Act 2001</i>, for the winding up of the body; and<ref href="#part-5">Part 5</ref>.4C of the </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-22-3__para-b">
              <num>b</num>
              <content>
                <p>the order has not been set aside or quashed, and is no longer *subject to review.</p>
              </content>
            </paragraph>

                <p><role refersTo="#minister">The Minister</role> must revoke a body’s approval as a *VET provider if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-29B__para-a">
              <num>a</num>
              <content>
                <p>the body ceases to be listed as a *registered training organisation on the *National Register; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29B__para-b">
              <num>b</num>
              <content>
                <p>in a case where the relevant *VET Regulator has made any of the following decisions, the decision has not been set aside or quashed, and is no longer *subject to review:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29B__para-i">
              <num>i</num>
              <content>
                <p>	(i)	a decision under <i>National Vocational Education and Training Regulator Act 2011</i> to refuse an application to renew the body’s registration as an NVR registered training organisation;<ref href="#sec-31">section 31</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29B__para-ii">
              <num>ii</num>
              <content>
                <p>a decision under <ref href="#sec-39">section 39</ref> of that Act to cancel the body’s registration as an NVR registered training organisation;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29B__para-iii">
              <num>iii</num>
              <content>
                <p>a decision under a law of a State that has a similar effect to a decision referred to in subparagraph (i) or (ii).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-29B__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must notify the body in writing of the revocation. The notice must specify that the revocation takes effect on the day that the notice is registered in the *Federal Register of Legislative Instruments.</p>

              <num>a</num>
              <content>
                <p>any applicable time limits for applying for a review (however described) or lodging an appeal (however described) of or in relation to the decision have expired; and</p>
              </content>
            </paragraph>

                <p>if there is such a review or appeal of or in relation to the decision—the review or appeal (and any later reviews or appeals) have been finally disposed of.</p>

            <content>
              <p>The amendments made by this Schedule apply in relation to a higher education provider or a VET provider approved before, on or after the commencement of this item.</p>

            <heading>Application of amendments—automatic revocation: registration ceases</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-9__subclause-1">
              <num>1</num>
              <content>
                <p>(1)	Section 22-2 of the <i>Higher Education Support Act 2003</i>, as in force on and after the commencement of this item, applies in relation to a higher education provider that ceases to be a registered higher education provider on or after that commencement.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-9__subclause-2">
              <num>2</num>
              <content>
                <p>(2)	Clause 29B of Schedule 1A to the <i>Higher Education Support Act 2003</i>, as in force on and after the commencement of this item, applies in relation to a VET provider that ceases to be listed as a registered training organisation on the National Register on or after that commencement.</p>

                <p>(1)	Section 182-1 of the <i>Higher Education Support Act 2003</i>, as in force on and after the commencement of this item, applies in relation to a higher education provider or a VET provider:</p>

              <p>To avoid doubt, a reference in the <i>Higher Education Support Act 2003</i> to the Australian Qualifications Framework Implementation Handbook is taken, from the day the Australian Qualifications Framework took effect, to have always included a reference to the Australian Qualifications Framework.</p>
