          <p>		This Act may be cited as the <i>Offshore Petroleum and Greenhouse Gas Storage Amendment </i><i>(Compliance Measures No.</i><i> </i><i>2) </i><i>Act </i><i>2</i><i>013</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p>Note:	Part 5 of the Regulatory Powers Act creates a framework for using infringement notices in relation to provisions.</p>

                <p>the Chief Executive Officer of NOPSEMA, if the notice may be issued by the Chief Executive Officer of NOPSEMA;</p>
              </content>

              <num>b</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role>, if the notice may be issued by the Titles Administrator;</p>
              </content>
            </paragraph>

                <p>if the notice may be issued by either the Chief Executive Officer of NOPSEMA or the Titles Administrator—either of them.</p>
              </content>
            </paragraph>

                <p>If <role refersTo="#secretary">the Secretary</role> is the relevant chief executive, he or she may, in writing, delegate to an SES employee, or acting SES employee, in the Department the power to extend the period referred to in paragraph 108(1)(j) of the Regulatory Powers Act.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-611E__subclause-5">
              <num>5</num>
              <content>
                <p>A person exercising power under a delegation under subsection (4) must comply with any written directions of the relevant chief executive.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-611E__subclause-6">
              <num>6</num>
              <content>
                <p>Despite subsection 107(3) of the Regulatory Powers Act, a single infringement notice may be given to a person in respect of:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-611E__para-a">
              <num>a</num>
              <content>
                <p>2 or more alleged contraventions of a provision mentioned in subsection (1); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-611E__para-b">
              <num>b</num>
              <content>
                <p>alleged contraventions of 2 or more provisions mentioned in subsection (1).</p>
              </content>
            </paragraph>

              <num>7</num>
              <content>
                <p>A regulation made under this Act may set out any other matters that are to be included in an infringement notice given in relation to a contravention of a provision mentioned in subsection (1).</p>

              <num>8</num>
              <content>
                <p>Part 5 of the Regulatory Powers Act, as it applies in relation to the provisions mentioned in subsection (1), extends to each offshore area.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-611F">
            <num>611F</num>
            <heading>Infringement notice—multiple contraventions</heading>
            <content>
              <p>In addition to the circumstances set out in subsection 107(4) of the Regulatory Powers Act, and despite subsection 107(3) of that Act, an infringement officer may also give a person a single infringement notice relating to multiple contraventions of a single provision if, under this Act or a regulation, the person:</p>
            </content>
            <paragraph eId="schedule-1__clause-611F__para-a">
              <num>a</num>
              <content>
                <p>commits a separate offence in respect of each day during which the offence continues; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-611F__para-b">
              <num>b</num>
              <content>
                <p>is separately liable for a civil penalty in respect of each day during which the liability continues.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-611G">
            <num>611G</num>
            <heading>Evidentiary matters</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-611G__subclause-1">
              <num>1</num>
              <content>
                <p>The relevant chief executive may issue a certificate signed by him or her stating:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-611G__para-a">
              <num>a</num>
              <content>
                <p>that the relevant chief executive did not allow further time under <ref href="#sec-109">section 109</ref> of the Regulatory Powers Act to pay the penalty for an offence, or a civil penalty, under this Act or a regulation, stated in an infringement notice; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-611G__para-b">
              <num>b</num>
              <content>
                <p>that the penalty has not been paid in accordance with the notice <quantity refersTo="#deadline">within 28 days</quantity> after the day the infringement notice is given.</p>
              </content>
            </paragraph>

            </paragraph>

                <p>	(c)	complying (or failing to comply) with a<b> </b>requirement under this Act, or a legislative instrument under this Act, in relation to the petroleum activity.</p>

            </paragraph>

                <p>complying with the titleholder’s duty under <ref href="#sec-572C">section 572C</ref> (which relates to the escape of petroleum);</p>

                <p>The following may be provided for by regulation:</p>

                <p>compliance with subsection (2) in relation to a petroleum activity to be demonstrated as a prior condition of acceptance of an environment plan for the activity;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-571__para-b">
              <num>b</num>
              <content>
                <p>such compliance to be in a form acceptable to NOPSEMA;</p>
              </content>
            </paragraph>

                <p>a failure to maintain such compliance, in a form acceptable to NOPSEMA, to be grounds for the withdrawal of acceptance of an environment plan for the activity.</p>

                <p>The forms of financial assurance for a title that may be maintained for the purposes of this section include (without limitation) any of the following, or any combination of the following:</p>

              </content>
            </paragraph>

                <p>	(a)	an authorised deposit-taking institution within the meaning of the <i>Banking Act 1959</i>; and</p>

                <p>a financial institution of a foreign country.</p>
              </content>
            </paragraph>

            <heading>Insurance—greenhouse gas titles</heading>

              <p>Greenhouse gas titles</p>
              <p>may include a condition that the registered holder maintain, as directed by the responsible Commonwealth Minister from time to time, insurance against:</p>
              <p>arising in connection with, or as a result of:</p>
              <p>including insurance against expenses of complying with directions relating to the clean-up or other remediation of the effects of the escape of a greenhouse gas substance.</p>
