          <p>		This Act may be cited as the <i>Aviation Transport Security Amendment (</i><i>Inbound</i><i> Cargo</i><i> Security Enhancement</i><i>)</i><i> Act 201</i><i>3</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

            <heading>Simplified overview of Division</heading>
            <content>
              <p>This Division allows <role refersTo="#minister">the Minister</role> to make a legislative instrument prohibiting the entry of specified kinds of cargo into Australian territory.</p>
              <p>Failing to comply with such an instrument is an offence.</p>

            <heading>Minister may prohibit entry of certain kinds of cargo into Australian territory</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-65B__subclause-1">
              <num>1</num>
              <content>
                <p>For the purposes of safeguarding against unlawful interference with aviation, <role refersTo="#minister">the Minister</role> may, by legislative instrument, prohibit the entry of specified kinds of cargo into Australian territory.</p>
              </content>
            </hcontainer>

                <p>Without limiting subsection (1), an instrument under that subsection may relate to all or any of the following:</p>
              </content>

              <num>a</num>
              <content>
                <p>some or all of a class of persons to whom this Act applies;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-65B__para-b">
              <num>b</num>
              <content>
                <p>cargo originating from a particular country;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-65B__para-c">
              <num>c</num>
              <content>
                <p>cargo transiting through a particular country;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-65B__para-d">
              <num>d</num>
              <content>
                <p>cargo packaged in a particular way;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-65B__para-e">
              <num>e</num>
              <content>
                <p>cargo that meets, or is more or less than, a specified weight;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-65B__para-f">
              <num>f</num>

                <p>cargo that comes within a specified weight range.</p>

            </paragraph>

                <p><role refersTo="#minister">The Minister</role> must, before making an instrument, consult the Foreign Affairs Minister and the Trade Minister.</p>

            <heading>Failure to comply with prohibition</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-65C__subclause-1">
              <num>1</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-65C__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> has made an instrument under section 65B; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-65C__para-b">
              <num>b</num>
              <content>
                <p>the instrument applies to the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-65C__para-c">
              <num>c</num>
              <content>
                <p>the person fails to comply with the instrument.</p>
              </content>
            </paragraph>
            <content>
              <p>Penalty:	For an aircraft operator—<quantity refersTo="#penaltyUnit">200 penalty units</quantity>.</p>
              <p>For any other aviation industry participant—<quantity refersTo="#penaltyUnit">100 penalty units</quantity>.</p>
