          <p>		This Act may be cited as the <i>Customs and AusCheck</i><i> Legislation Amendment (Organised Crime and Other Measures) </i><i>Act 201</i><i>3</i>.</p>

              <p><b><i>cargo handler</i></b> means a person who is involved in any of the following activities at a cargo terminal:</p>
              <p><b><i>cargo terminal</i></b> means a place (other than a depot to which a depot licence relates or a warehouse to which a warehouse licence relates), within the limits of a port, airport or wharf, where:</p>
              <p><b><i>cargo terminal operator</i></b>, in relation to a cargo terminal, means a person who manages the cargo terminal.</p>
              <p><b><i>establishment identification</i></b>, in relation to a cargo handler and a port, airport or wharf, means the handler’s identification code provided by Customs for the port, airport or wharf.</p>
              <p><b><i>executive officer</i></b> of a body corporate means a person, by whatever name called and whether or not a director of the body, who is concerned in, or takes part in, the management of the body.</p>
              <p><b><i>place</i></b> includes an area, a building and a part of a building.</p>

                <p>the movement of goods subject to Customs control into, within or out of the terminal;</p>
              </content>
            </paragraph>

                <p>the loading, unloading or handling of goods subject to Customs control at the terminal;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102B__para-c">

                <p>the storage, packing or unpacking of goods subject to Customs control at the terminal.</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102B__para-a">
              <num>a</num>

                <p>goods are located immediately after being unloaded from a ship that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102B__para-i">
              <num>i</num>
              <content>
                <p>has taken the goods on board at a place outside Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102B__para-ii">
              <num>ii</num>
              <content>
                <p>carried the goods to a port or wharf in a State or Territory where some or all of the goods are unloaded; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102B__para-b">
              <num>b</num>
              <content>
                <p>goods are located immediately after being unloaded from an aircraft that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102B__para-i">

                <p>has taken the goods on board at a place outside Australia; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102B__para-ii">

                <p>carried the goods to an airport in a State or Territory where some or all of the goods are unloaded; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102B__para-c">
              <num>c</num>
              <content>
                <p>goods are located immediately before being loaded on a ship or aircraft in which they are to be exported.</p>
              </content>
            </paragraph>

            <num>102BA</num>
            <heading>Meaning of fit and proper person</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-102BA__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	In deciding whether a natural person is a <b><i>fit and proper person</i></b> for the purposes of this Part, the decision-maker must have regard to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102BA__para-a">
              <num>a</num>
              <content>
                <p>any conviction of the person of an offence against this Act committed within the 10 years immediately before the decision; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102BA__para-b">
              <num>b</num>
              <content>
                <p>any conviction of the person of an offence punishable by <quantity refersTo="#custodialSentence">imprisonment for 1 year</quantity> or longer:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102BA__para-i">
              <num>i</num>
              <content>
                <p>against another law of the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102BA__para-ii">
              <num>ii</num>
              <content>
                <p>against a law of a State or Territory;</p>
              </content>
            </paragraph>
            <content>
              <p>if that offence was committed within the 10 years immediately before the decision; and</p>
              <p>committed:</p>
            </content>
            <paragraph eId="schedule-1__clause-102BA__para-c">
              <num>c</num>
              <content>
                <p>whether the person has been refused a transport security card, or has had such a card suspended or cancelled, within the 10 years immediately before the decision; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102BA__para-d">
              <num>d</num>
              <content>
                <p>if a request has been made of the person under subsection 102CF(2) and <role refersTo="#ceo">the CEO</role> is considering giving a direction to the person under Division 5—any misleading statement given by the person in response to the request.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-102BA__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	In deciding whether a company is a <b><i>fit and proper person</i></b> for the purposes of this Part, the decision-maker must have regard to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102BA__para-a">
              <num>a</num>
              <content>
                <p>any conviction of the company of an offence:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102BA__para-i">
              <num>i</num>
              <content>
                <p>against this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102BA__para-ii">
              <num>ii</num>
              <content>
                <p>if punishable by a fine of <quantity refersTo="#penaltyUnit">100 penalty units</quantity> or more—against another law of the Commonwealth, or a law of a State or of a Territory;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102BA__para-iii">
              <num>iii</num>
              <content>
                <p>within the 10 years immediately before the decision; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102BA__para-iv">
              <num>iv</num>
              <content>
                <p>at a time when any person who is presently a director, officer or shareholder of the company was such a director, officer or shareholder; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102BA__para-b">
              <num>b</num>
              <content>
                <p>whether a receiver of the property, or part of the property, of the company has been appointed; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102BA__para-c">
              <num>c</num>
              <content>
                <p>	(c)	whether the company is under administration within the meaning of the <i>Corporations Act 2001</i>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102BA__para-d">
              <num>d</num>
              <content>
                <p>whether the company has executed, under <ref href="#part-5">Part 5</ref>.3A of that Act, a deed of company arrangement that has not yet terminated.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-102C">
            <num>102C</num>
            <heading>Notifying Customs of cargo terminal</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-102C__subclause-1">
              <num>1</num>
              <content>
                <p>The cargo terminal operator of a cargo terminal must notify Customs of:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102C__para-a">
              <num>a</num>
              <content>
                <p>the terminal managed by the operator; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102C__para-b">
              <num>b</num>
              <content>
                <p>the terminal’s physical address.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-102C__subclause-2">
              <num>2</num>
              <content>
                <p>A notification must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102C__para-a">
              <num>a</num>
              <content>
                <p>be in a form approved, in writing, by Customs for the purposes of this section; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102C__para-b">
              <num>b</num>
              <content>
                <p>provide all the information, and be accompanied by any documents, required by the form.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-102CA">
            <num>102CA</num>
            <heading>Physical security of cargo terminal and goods</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-102CA__subclause-1">
              <num>1</num>
              <content>
                <p>The cargo terminal operator of a cargo terminal must ensure:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102CA__para-a">
              <num>a</num>
              <content>
                <p>adequate physical security of the terminal; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CA__para-b">
              <num>b</num>
              <content>
                <p>adequate security of goods at the terminal.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-102CA__subclause-2">
              <num>2</num>
              <content>
                <p>At a minimum, the following requirements must be met in relation to a cargo terminal:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102CA__para-a">
              <num>a</num>
              <content>
                <p>the terminal must be protected by:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CA__para-i">
              <num>i</num>
              <content>
                <p>adequate fencing; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CA__para-ii">
              <num>ii</num>
              <content>
                <p>a monitored alarm system;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CA__para-b">
              <num>b</num>
              <content>
                <p>entry or exit to the terminal must be controlled or limited;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CA__para-c">
              <num>c</num>
              <content>
                <p>appropriate procedures and methods for ensuring the security of goods at the terminal must be in place.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-102CA__subclause-3">
              <num>3</num>
              <content>
                <p>The cargo terminal operator of a cargo terminal must give Customs written notice of any substantial change that would affect:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102CA__para-a">
              <num>a</num>
              <content>
                <p>the physical security of the terminal; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CA__para-b">
              <num>b</num>
              <content>
                <p>the security of goods at the terminal.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-102CA__subclause-4">
              <num>4</num>
              <content>
                <p>A notice must be given at least 30 days before the change occurs, unless the change is required in response to an emergency or disaster, in which case a notice must be given as soon as practicable.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-102CA__subclause-5">
              <num>5</num>
              <content>
                <p><quantity refersTo="#deadline">Within 30 days</quantity> of being requested to do so by an authorised officer, the cargo terminal operator must provide documentation of the procedures and methods in place for ensuring the security of goods at the terminal.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-102CB">
            <num>102CB</num>
            <heading>Movement of signs at or near cargo terminal</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-102CB__subclause-1">
              <num>1</num>
              <content>
                <p>If Customs has placed a sign at or near a cargo terminal, the cargo terminal operator of the terminal must ensure that the sign is not concealed, moved or removed without the written approval of an authorised officer.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-102CB__subclause-2">
              <num>2</num>
              <content>
                <p>Subsection (1) does not apply if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102CB__para-a">
              <num>a</num>
              <content>
                <p>the sign is temporarily moved while maintenance or construction work is carried out; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CB__para-b">
              <num>b</num>
              <content>
                <p>the sign is moved for no more than 5 days.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-102CC">
            <num>102CC</num>
            <heading>Notification requirements relating to goods</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-102CC__subclause-1">
              <num>1</num>
              <content>
                <p>The cargo terminal operator of a cargo terminal must, within the time and in the manner mentioned in subsection (2), notify Customs of any of the following events:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102CC__para-a">
              <num>a</num>
              <content>
                <p>an unauthorised movement of goods subject to Customs control in or from the cargo terminal;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CC__para-b">
              <num>b</num>
              <content>
                <p>an unauthorised access to goods subject to Customs control:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CC__para-i">
              <num>i</num>
              <content>
                <p>in the cargo terminal; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CC__para-ii">
              <num>ii</num>
              <content>
                <p>on a ship or aircraft within, or adjacent to, the terminal;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CC__para-c">
              <num>c</num>
              <content>
                <p>an unauthorised access to an information system, whether electronic or paper based, relating to goods subject to Customs control;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CC__para-d">
              <num>d</num>
              <content>
                <p>an enquiry relating to goods subject to Customs control from a person who does not have a commercial connection with the goods;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CC__para-e">
              <num>e</num>
              <content>
                <p>a theft, loss or damage of goods subject to Customs control;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CC__para-f">
              <num>f</num>
              <content>
                <p>a break in and entry, or attempted break in, of the cargo terminal;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CC__para-g">
              <num>g</num>
              <content>
                <p>a change that may adversely affect the security of the terminal;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CC__para-h">
              <num>h</num>
              <content>
                <p>a suspected breach of a Customs-related law in the cargo terminal.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-102CC__subclause-2">
              <num>2</num>
              <content>
                <p>The notification of an event must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102CC__para-a">
              <num>a</num>
              <content>
                <p>be in writing; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CC__para-b">
              <num>b</num>
              <content>
                <p>be made as soon as practicable, but not later than 5 days after the cargo terminal operator becomes aware of the event.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-102CD">
            <num>102CD</num>
            <heading>Unclaimed goods</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-102CD__subclause-1">
              <num>1</num>
              <content>
                <p>The cargo terminal operator of a cargo terminal must notify Customs, within the time and in the manner mentioned in subsection (2), of goods not belonging to the operator that remain at the terminal for more than 30 days.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-102CD__subclause-2">
              <num>2</num>
              <content>
                <p>The notification must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102CD__para-a">
              <num>a</num>
              <content>
                <p>be in writing, including:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CD__para-i">
              <num>i</num>
              <content>
                <p>a description of the goods; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CD__para-ii">
              <num>ii</num>
              <content>
                <p>the date the goods were received; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CD__para-b">
              <num>b</num>
              <content>
                <p>be made no later than 35 days after the date the goods were received.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-102CE">
            <num>102CE</num>
            <heading>Record keeping requirements</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-102CE__subclause-1">
              <num>1</num>
              <content>
                <p>The cargo terminal operator of a cargo terminal must keep a record of each person who enters the terminal.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-102CE__subclause-2">
              <num>2</num>
              <content>
                <p>The record may be kept by electronic means.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-102CE__subclause-3">
              <num>3</num>
              <content>
                <p>The record must include such particulars for each person as are prescribed by the regulations.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-102CE__subclause-4">
              <num>4</num>
              <content>
                <p><quantity refersTo="#deadline">Within 30 days</quantity> of being requested to do so by an authorised officer, the cargo terminal operator must provide to the officer the records kept under this section for the period specified in the request.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-102CE__subclause-5">
              <num>5</num>
              <content>
                <p>	(5)	The disclosure of personal information in response to a request by an authorised officer is taken to be a disclosure that is authorised by this Act for the purposes of the <i>Privacy Act 1988</i>.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-102CE__subclause-6">
              <num>6</num>
              <content>
                <p>Subsection (1) does not apply in relation to a person who is:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102CE__para-a">
              <num>a</num>
              <content>
                <p>an employee of the cargo terminal operator; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CE__para-b">
              <num>b</num>
              <content>
                <p>an officer or employee of, or of an authority of, the Commonwealth, a State or a Territory.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-102CF">
            <num>102CF</num>
            <heading>Fit and proper person</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-102CF__subclause-1">
              <num>1</num>
              <content>
                <p>The cargo terminal operator of a cargo terminal must take all reasonable steps to ensure that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102CF__para-a">
              <num>a</num>
              <content>
                <p>the operator is a fit and proper person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CF__para-b">
              <num>b</num>
              <content>
                <p>if the operator is a body corporate—each executive officer of the body corporate is a fit and proper person.</p>

            <heading>Adequate training of staff</heading>
            <content>
              <p>The cargo terminal operator of a cargo terminal must take all reasonable steps to educate and train its employees or other persons involved in the operator’s business to ensure their awareness of the operator’s responsibilities and obligations in relation to goods subject to Customs control.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-102CH">
            <num>102CH</num>
            <heading>Complying with directions</heading>
            <content>
              <p>The cargo terminal operator of a cargo terminal must comply with a written direction given by an authorised officer under <ref href="#sec-102E">section 102E</ref>B.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-102CI">
            <num>102CI</num>
            <heading>Responsibility to provide facilities and assistance</heading>
            <content>
              <p>The cargo terminal operator of a cargo terminal must provide an authorised officer with all reasonable facilities and assistance for the effective exercise of their powers under a Customs-related law.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-102CJ">
            <num>102CJ</num>
            <heading>CEO may impose additional obligations</heading>
            <content>
              <p><role refersTo="#ceo">The CEO</role> may, by legislative instrument, impose additional obligations on cargo terminal operators generally if <role refersTo="#ceo">the CEO</role> considers the obligations to be necessary or desirable:</p>
            </content>
            <paragraph eId="schedule-1__clause-102CJ__para-a">
              <num>a</num>
              <content>
                <p>for the protection of the revenue; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102CJ__para-b">
              <num>b</num>

                <p>for the purpose of ensuring compliance with the Customs Acts, any other law of the Commonwealth prescribed by the regulations or a law of a State or Territory prescribed by the regulations; or</p>

            </paragraph>

              <num>c</num>
              <content>
                <p>for any other purpose.</p>
              </content>
            </paragraph>

            <heading>Offence—failure to comply with obligations or requirements</heading>

                <p>A person commits an offence if:</p>

                <p>the person is a cargo terminal operator; and</p>
              </content>

                <p>the person fails to comply with an obligation or requirement:</p>

            </paragraph>

                <p>set out in this Division; or</p>
              </content>

            </paragraph>

            <heading>Unpacking of goods in containers at cargo terminal</heading>
            <content>
              <p>If goods are in a container at a cargo terminal, a cargo handler must not allow the container to be unpacked without the written approval of an authorised officer.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-102DB">
            <num>102DB</num>
            <heading>Facilitating transhipment or export of goods</heading>
            <content>
              <p>If goods are imported into Australia and are subject to Customs control, a cargo handler must not facilitate the transhipment or export of the goods without the written approval of an authorised officer.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-102DC">
            <num>102DC</num>
            <heading>Using establishment identification when communicating with Customs</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-102DC__subclause-1">
              <num>1</num>
              <content>
                <p>When communicating electronically with Customs about activities undertaken at a port, airport or wharf, a cargo handler must use his, her or its correct establishment identification for the port, airport or wharf.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-102DC__subclause-2">
              <num>2</num>
              <content>
                <p>Subsection (1) does not apply in relation to a particular port, airport or wharf if a cargo handler has the written approval of an authorised officer for the handler to use a contingency code for the port, airport or wharf.</p>

            <num>102DD</num>

                <p>For the purpose of determining whether a provision of any Customs-related law has been, or is being, complied with, an authorised officer may enter a cargo terminal and exercise the following powers:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102E__para-a">
              <num>a</num>
              <content>
                <p>the power to inspect any document at the terminal;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102E__para-b">
              <num>b</num>
              <content>
                <p>the power to take extracts from, or make copies of, any such document;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102E__para-c">
              <num>c</num>
              <content>
                <p>the power to take into the terminal such equipment and materials as the authorised person requires for the purpose of exercising powers under a Customs-related law in relation to the terminal.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-102E__subclause-2">
              <num>2</num>
              <content>
                <p>While at a cargo terminal, an authorised officer may:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102E__para-a">
              <num>a</num>
              <content>
                <p>access electronic equipment at the terminal; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102E__para-b">
              <num>b</num>
              <content>
                <p>use a disk, tape or other storage device that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102E__para-i">
              <num>i</num>
              <content>
                <p>is at the terminal; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102E__para-ii">
              <num>ii</num>
              <content>
                <p>can be used with the equipment or is associated with it;</p>
              </content>
            </paragraph>
            <content>
              <p>if the authorised officer has reasonable grounds for suspecting that the electronic equipment, disk, tape or other storage device is or contains information relating to a matter mentioned in subsection (3).</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-102E__subclause-3">
              <num>3</num>
              <content>
                <p>For the purposes of subsection (2), the matters are:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102E__para-a">
              <num>a</num>
              <content>
                <p>the unloading of goods subject to Customs control from a ship or aircraft or their movement to a particular part of the cargo terminal; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102E__para-b">
              <num>b</num>
              <content>
                <p>the receipt of goods subject to Customs control at the cargo terminal; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102E__para-c">
              <num>c</num>
              <content>
                <p>access to goods subject to Customs control:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102E__para-i">
              <num>i</num>
              <content>
                <p>in the cargo terminal; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102E__para-ii">
              <num>ii</num>
              <content>
                <p>on a ship or aircraft within, or adjacent to, the terminal; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102E__para-d">
              <num>d</num>
              <content>
                <p>the security of goods subject to Customs control in the cargo terminal; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102E__para-e">
              <num>e</num>
              <content>
                <p>where goods subject to Customs control are stacked in the terminal; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102E__para-f">
              <num>f</num>
              <content>
                <p>ship bay plans relating to the terminal; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102E__para-g">
              <num>g</num>
              <content>
                <p>the rostering and attendance of staff at the terminal.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-102EA">
            <num>102EA</num>
            <heading>Power to make requests</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-102EA__subclause-1">
              <num>1</num>
              <content>
                <p>An authorised officer may request, in writing, that a cargo terminal operator of a cargo terminal:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102EA__para-a">
              <num>a</num>
              <content>
                <p>provide documentation to the officer of the procedures and methods in place for ensuring the security of goods at the terminal; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102EA__para-b">
              <num>b</num>
              <content>
                <p>provide to the officer the records relating to each person who enters the terminal for the period specified in the request.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-102EA__subclause-2">
              <num>2</num>
              <content>
                <p>An authorised officer may request, in writing, that a cargo terminal operator of a cargo terminal or a cargo handler:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102EA__para-a">
              <num>a</num>
              <content>
                <p>provide information to the officer that would support an assessment that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102EA__para-i">
              <num>i</num>
              <content>
                <p>the operator or handler is a fit and proper person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102EA__para-ii">
              <num>ii</num>
              <content>
                <p>if the operator or handler is a body corporate—each executive officer of the body corporate is a fit and proper person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102EA__para-b">
              <num>b</num>
              <content>
                <p>give the officer access to electronic equipment at the terminal for the purpose of obtaining information relating to a matter mentioned in subsection 102E(3).</p>

                <p>An authorised officer may give a written direction to a cargo terminal operator of a cargo terminal requiring the operator to:</p>
              </content>
            </hcontainer>

                <p>carry out remedial work at or near the terminal to address security concerns; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102EB__para-b">

                <p>install a closed-circuit television system for the terminal; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102EB__para-c">
              <num>c</num>
              <content>
                <p>keep all footage from a closed-circuit television system.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-102EB__subclause-2">

                <p>An authorised officer may give a written direction to:</p>
              </content>
            </hcontainer>

                <p>a cargo terminal operator of a cargo terminal; or</p>

                <p>a cargo handler in relation to a cargo terminal.</p>

            </paragraph>

                <p>A direction given under subsection (2) may relate to all or any of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-102EB__para-a">
              <num>a</num>
              <content>
                <p>the movement of goods subject to Customs control into, within or out of the terminal;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102EB__para-b">
              <num>b</num>
              <content>
                <p>the loading, unloading or handling of goods subject to Customs control at the terminal;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-102EB__para-c">
              <num>c</num>
              <content>
                <p>the storage, packing or unpacking of goods subject to Customs control at the terminal.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-102EB__subclause-4">

                <p>A direction given under subsection (1) or (2) is not a legislative instrument.</p>
              </content>
            </hcontainer>

                <p>An authorised officer may, for the purpose of:</p>

                <p>preventing interference with goods subject to Customs control at a cargo terminal; or</p>
              </content>
            </paragraph>

                <p>preventing interference with the exercise of the powers or the performance of the functions of the authorised person or another authorised person in respect of a cargo terminal or of goods subject to Customs control at the terminal;</p>

              <p>that the person may not be involved, either indefinitely or for a specified period, in any way in the loading, unloading, handling or storage of goods subject to Customs control in a cargo terminal specified in the direction.</p>

                <p><role refersTo="#ceo">The CEO</role> may give a written direction to:</p>

              <num>b</num>
              <content>
                <p>the criteria against which a background check is to be assessed;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10__para-c">

                <p>the decision or decisions that may be made as a result of a background check;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10__para-d">
              <num>d</num>
              <content>
                <p>the form of advice to be given to an individual in respect of whom a background check is conducted;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10__para-e">
              <num>e</num>
              <content>
                <p>the form of advice to be given to other persons about the outcome of a background check.</p>
              </content>
            </paragraph>

                <p>The matters referred to in subsection (1) may relate to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-10__para-a">

                <p>all background checks to be conducted for the purposes of paragraph 8(1)(c); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10__para-b">
              <num>b</num>
              <content>
                <p>a specified class of background checks.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-10__subclause-3">
              <num>3</num>
              <content>
                <p>The AusCheck scheme may, for the purposes of paragraph 8(1)(c), make provision for and in relation to an individual or an issuing body notifying <role refersTo="#secretary">the Secretary</role> or the Transport Secretary of specified matters if:</p>
              </content>

              <num>a</num>
              <content>
                <p>one of the following applies:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10__para-i">
              <num>i</num>

                <p>the individual has applied to an issuing body for an ASIC or MSIC, and the issuing body has neither issued, nor refused to issue, the ASIC or MSIC;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10__para-ii">
              <num>ii</num>
              <content>
                <p>the individual or an issuing body has applied to the Transport Secretary for approval to issue an ASIC or MSIC to the individual, and the application has not been determined;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10__para-iii">
              <num>iii</num>
              <content>
                <p>the individual is the holder of an ASIC or MSIC;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10__para-iv">
              <num>iv</num>
              <content>
                <p>the individual or an issuing body has applied to the Transport Secretary to set aside the cancellation of an ASIC or MSIC issued to the individual;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10__para-v">
              <num>v</num>
              <content>
                <p>the individual has applied to the Administrative Appeals Tribunal for review of a decision by an issuing body, <role refersTo="#secretary">the Secretary</role> or the Transport Secretary relating to the issue, suspension or cancellation of an ASIC or MSIC, and the application has not been determined; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10__para-b">
              <num>b</num>
              <content>
                <p>the individual has been charged with a serious offence, or a charge for a serious offence has been resolved in relation to the individual; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10__para-c">
              <num>c</num>
              <content>
                <p>in the case of an issuing body:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10__para-i">
              <num>i</num>
              <content>
                <p>the individual applied to the issuing body for the ASIC or MSIC; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10__para-ii">
              <num>ii</num>
              <content>
                <p>the issuing body issued the ASIC or MSIC to the individual.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-10A">
            <num>10A</num>
            <heading>Matters covered by AusCheck scheme—online verification service</heading>
            <content>
              <p>The AusCheck scheme may make provision for and in relation to matters relating to the establishment and provision of an online verification service that will enable verification:</p>
            </content>
            <paragraph eId="schedule-2__clause-10A__para-a">
              <num>a</num>
              <content>
                <p>that an ASIC or MSIC has been issued to a particular individual and is in effect at a particular time; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10A__para-b">
              <num>b</num>
              <content>
                <p>that an individual who is in possession of an ASIC or MSIC is the person to whom the card was issued; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10A__para-c">
              <num>c</num>
              <content>
                <p>that a national security background check has been conducted in relation to a particular individual; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-10A__para-d">
              <num>d</num>
              <content>
                <p>that an individual who is in possession of a card, licence, permit or other authorisation in relation to which a national security background check has been conducted is the individual to whom the card, licence, permit or authorisation was issued.</p>
              </content>
            </paragraph>
          </hcontainer>

                <p>a direction to an issuing body to delay considering an application for an ASIC or MSIC to be issued to the individual until further direction from <role refersTo="#secretary">the Secretary</role> in accordance with subsection (4);</p>

            </paragraph>
            <paragraph eId="schedule-2__clause-23__para-b">
              <num>b</num>
              <content>
                <p>a direction to the Transport Secretary to delay considering an application for approval to issue an ASIC or MSIC to the individual until further direction from <role refersTo="#secretary">the Secretary</role> in accordance with subsection (4);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-23__para-c">
              <num>c</num>
              <content>
                <p>a direction to an issuing body to suspend an ASIC or MSIC issued by the issuing body to the individual until further direction from <role refersTo="#secretary">the Secretary</role> in accordance with subsection (4);</p>

            </paragraph>
            <paragraph eId="schedule-2__clause-23__para-d">
              <num>d</num>
              <content>
                <p>a direction to the Transport Secretary to delay considering an application to set aside the cancellation of an ASIC or MSIC issued to the individual until further direction from <role refersTo="#secretary">the Secretary</role> in accordance with subsection (4).</p>

            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-23__subclause-4">
              <num>4</num>
              <content>
                <p><role refersTo="#secretary">The Secretary</role>:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-23__para-a">
              <num>a</num>
              <content>
                <p>must give the further direction referred to in subsection (3) to the relevant person as soon as practicable after <role refersTo="#secretary">the Secretary</role> considers that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-23__para-i">
              <num>i</num>
              <content>
                <p>all charges for serious offences have been resolved in relation to the individual; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-23__para-ii">
              <num>ii</num>
              <content>
                <p>a background check has been conducted covering the matter referred to in paragraph 5(a) (criminal history) after subparagraph (i) is satisfied, whether or not the background check also covers other matters; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-23__para-b">
              <num>b</num>
              <content>
                <p>may give the further direction at any time before paragraph (a) applies.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-23__subclause-5">
              <num>5</num>
              <content>
                <p>	(5)	If an ASIC or MSIC is suspended as referred to in paragraph (3)(c), then any other card issued to the individual under the <i>Aviation Transport Security Regulations</i><i> </i><i>2005</i> or the <i>Maritime Transport and Offshore Facilities Security Regulations</i><i> </i><i>2003</i> is taken also to be suspended.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-23__subclause-6">
              <num>6</num>
              <content>
                <p>The AusCheck scheme may make provision for matters connected with the giving of a direction under subsection (3), including the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-23__para-a">
              <num>a</num>
              <content>
                <p>	(a)	preventing the individual from making any other application under the <i>Aviation Transport Security Regulations</i><i> </i><i>2005</i> or the <i>Maritime Transport and Offshore Facilities Security Regulations</i><i> </i><i>2003</i>, or entering any area or zone to which access is restricted under those regulations, until after the further direction referred to in subsection (3) has been given;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-23__para-b">
              <num>b</num>
              <content>
                <p>preventing an issuing body or other person from issuing any card to the individual under those regulations until after the further direction referred to in subsection (3) has been given;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-23__para-c">
              <num>c</num>
              <content>
                <p>preventing a person from escorting the individual in any area or zone to which access is restricted under those regulations until after the further direction referred to in subsection (3) has been given;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-23__para-d">
              <num>d</num>
              <content>
                <p>returning a suspended card issued to the individual under those regulations to a specified person;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-23__para-e">
              <num>e</num>
              <content>
                <p>updating registers of cards and other records kept by an issuing body;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-23__para-f">
              <num>f</num>
              <content>
                <p>an issuing body or <role refersTo="#secretary">the Secretary</role> notifying other persons of matters in connection with the giving of the direction, for the purpose of preventing:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-23__para-i">
              <num>i</num>
              <content>
                <p>	(i)	an unlawful interference with aviation (within the meaning of the <i>Aviation Transport Security Act 2004</i>); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-23__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	an unlawful interference with maritime transport or offshore facilities (within the meaning of the <i>Maritime Transport and Offshore Facilities Security Act 2003</i>); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-23__para-iii">
              <num>iii</num>
              <content>
                <p>the commission of an offence against a law of the Commonwealth or a State or Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-23__para-iv">
              <num>iv</num>
              <content>
                <p>an incident that poses a threat to national security.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-24">
