            <p>		This Act may be cited as the <i>Asbestos and Silica Safety and Eradication Agency Act 2013</i>.</p>

          <heading>Commencement</heading>
          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>

              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <num>2A</num>
          <heading>Object of this Act</heading>
          <content>
            <p>The object of this Act is to establish the Asbestos and Silica Safety and Eradication Agency to lead coordinated and national action to eliminate asbestos-related diseases and silica-related diseases in Australia by:</p>
          </content>
          <paragraph eId="part-1__sec-2A__para-a">
            <num>a</num>
            <content>
              <p>fostering collaboration between:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-2A__para-i">
            <num>i</num>
            <content>
              <p>persons and bodies involved in the regulation, management and control of asbestos safety and silica safety; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-2A__para-ii">
            <num>ii</num>
            <content>
              <p>persons and bodies involved in dealing with issues related to asbestos-related diseases and silica-related diseases; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-2A__para-b">
            <num>b</num>
            <content>
              <p>supporting and monitoring the implementation of the National Strategic Plans by the Commonwealth and State, Territory and local governments; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-2A__para-c">
            <num>c</num>
            <content>
              <p>promoting national consistency in relation to asbestos safety, asbestos-related diseases, silica safety and silica-related diseases; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-2A__para-d">
            <num>d</num>
            <content>
              <p>improving the state of knowledge and awareness of issues relating to asbestos safety, asbestos-related diseases, silica safety and silica-related diseases.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-3">
          <num>3</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-agency">Agency</term> means <def>the Asbestos and Silica Safety and Eradication Agency referred to in <ref href="#sec-6">section 6</ref>.</def></p>
            <p><term refersTo="#term-asbestos-and-silica-safety-and-eradication-agency">Asbestos and Silica Safety and Eradication Agency</term> means <def>the Agency referred to in <ref href="#sec-6">section 6</ref>.</def></p>
            <p><term refersTo="#term-asbestos-and-silica-safety-and-eradication-council">Asbestos and Silica Safety and Eradication Council</term> means <def>the Council referred to in <ref href="#sec-28">section 28</ref>.</def></p>
            <p><term refersTo="#term-asbestos-national-strategic-plan">Asbestos National Strategic Plan</term> has the meaning given by <def><ref href="#sec-5A">section 5A</ref>.</def></p>
            <p><b><i>asbestos safety</i></b> includes, but is not limited to, matters relating to asbestos awareness, education and information sharing, and the identification, management, removal, transportation, storage or disposal of asbestos in Australia or internationally.</p>
            <p><term refersTo="#term-ceo">CEO</term> means <def>the Chief Executive Officer of the Agency.</def></p>
            <p><term refersTo="#term-chair">Chair</term> means <def>the Chair of the Council.</def></p>
            <p><term refersTo="#term-council">Council</term> means <def>the Asbestos and Silica Safety and Eradication Council.</def></p>
            <p><term refersTo="#term-council-member">Council member</term> means <def>a member of the Council (and includes the Chair).</def></p>
            <p><term refersTo="#term-national-strategic-plans">National Strategic Plans</term> means <def>the Asbestos National Strategic Plan and the Silica National Strategic Plan.</def></p>
            <p><term refersTo="#term-paid-work">paid work</term> means <def>work for financial gain or reward (whether as an employee, a self-employed person or otherwise).</def></p>
            <p><term refersTo="#term-rules">rules</term> means <def>the rules made by the Minister under <ref href="#sec-48">section 48</ref>.</def></p>
            <p><term refersTo="#term-silica-national-strategic-plan">Silica National Strategic Plan</term> has the meaning given by <def><ref href="#sec-5B">section 5B</ref>.</def></p>
            <p><b><i>silica safety</i></b> includes, but is not limited to, matters relating to awareness, education and information sharing in relation to respirable crystalline silica and products that contain silica.</p>

        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Crown to be bound</heading>
          <content>
            <p>This Act binds the Crown in each of its capacities.</p>
          </content>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Extension to external Territories</heading>
          <content>
            <p>This Act extends to every external Territory.</p>
          </content>

        <heading>National Strategic Plans</heading>
        <section eId="part-1A__sec-5A">
          <num>5A</num>
          <heading>Asbestos National Strategic Plan</heading>
          <subsection eId="part-1A__sec-5A__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The <b><i>Asbestos National Strategic Plan</i></b> is the plan with that name<i> </i>that:</p>
            </content>
            <paragraph eId="part-1A__sec-5A__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>aims:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1A__sec-5A__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>to eliminate asbestos-related diseases in Australia by preventing exposure to asbestos fibres; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1A__sec-5A__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>to support workers and others who are affected by asbestos-related diseases; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1A__sec-5A__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>represents a commitment to implement an agreed set of strategic actions and national targets focussing on:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1A__sec-5A__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>identifying asbestos and preventing exposure risks, including through prioritised safe removal and effective waste management; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1A__sec-5A__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>improving awareness of asbestos safety and asbestos-related diseases; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1A__sec-5A__subsec-1__para-iii">
              <num>iii</num>
              <content>
                <p>improving research and national data in relation to asbestos safety and asbestos-related diseases; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1A__sec-5A__subsec-1__para-iv">
              <num>iv</num>
              <content>
                <p>facilitating international collaboration in relation to asbestos safety and asbestos-related diseases; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1A__sec-5A__subsec-1__para-v">
              <num>v</num>
              <content>
                <p>any other relevant priorities.</p>
              </content>

            <content>
              <p>The plan referred to in subsection (1) represents a commitment to implement an agreed set of strategic actions and national targets focussing on the priorities referred to in subparagraphs (1)(b)(i) to (v) only if the plan has been agreed to by at least 6 of the governments of the Commonwealth and each State and Territory.</p>
            </content>
          </subsection>

          <num>5B</num>
          <heading>Silica National Strategic Plan</heading>
          <subsection eId="part-1A__sec-5B__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The <b><i>Silica National Strategic Plan</i></b> is the plan with that name that:</p>
            </content>
            <paragraph eId="part-1A__sec-5B__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>aims:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1A__sec-5B__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>to eliminate silica-related diseases in Australia by preventing exposure to respirable crystalline silica; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1A__sec-5B__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>to support workers and others who are affected by silica-related diseases; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-1A__sec-5B__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>represents a commitment to implement an agreed set of strategic actions and national targets focussing on:</p>

            <p>The body known immediately before the commencement of this section as the Asbestos Safety and Eradication Agency is continued in existence with the new name, Asbestos and Silica Safety and Eradication Agency.</p>

          <heading>Functions of the Agency</heading>

              <p>The Agency has the following functions:</p>

                <p>to encourage, coordinate, monitor and report on the implementation of the National Strategic Plans;</p>
              </content>
            </paragraph>

              <content>
                <p>to review, amend or replace, publish and promote the National Strategic Plans;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>to provide advice to <role refersTo="#minister">the Minister</role> about asbestos safety, asbestos-related diseases, silica safety and silica-related diseases;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-d">
              <num>d</num>
              <content>
                <p>to collaborate with Commonwealth, State, Territory, local and other governments, agencies or bodies (including international governments, agencies and bodies) about:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>the development, implementation, review and amendment of the National Strategic Plans; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-ii">
              <num>ii</num>
              <content>
                <p>asbestos safety, asbestos-related diseases, silica safety and silica-related diseases;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-e">

              <content>
                <p>to conduct, commission, monitor and promote research about asbestos safety, asbestos-related diseases, silica safety and silica-related diseases;</p>
              </content>
            </paragraph>

              <num>f</num>
              <content>
                <p>to raise awareness of asbestos safety, asbestos-related diseases, silica safety and silica-related diseases, including by developing and promoting materials on asbestos safety, asbestos-related diseases, silica safety and silica-related diseases;</p>

              <num>g</num>
              <content>
                <p>to collect and analyse data required for measuring progress on preventing exposure to asbestos fibres, or respirable crystalline silica, and for informing evidence-based policies and strategies;</p>

              <num>h</num>
              <content>
                <p>to promote consistent messages, policies and practices in relation to asbestos safety, asbestos-related diseases, silica safety and silica-related diseases;</p>

            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-i">
              <num>i</num>
              <content>
                <p>such other functions as are conferred on the Agency by or under this Act, the rules or any other law of the Commonwealth;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-j">
              <num>j</num>
              <content>
                <p>to do anything incidental or conducive to the performance of any of the above functions.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>The Agency has the power to do all things that are necessary or convenient to be done for or in connection with the performance of its functions.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-3">
            <num>3</num>
            <content>
              <p>In performing its functions, the Agency must act in accordance with the National Strategic Plans and any annual operational plan.</p>
            </content>
            <content>
              <p>Constitutional limits</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-4">
            <num>4</num>
            <content>
              <p>The Agency may perform its functions only:</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>for purposes relating to the collection of statistics; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>for purposes relating to a corporation to which paragraph 51(xx) of the Constitution applies; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>for purposes relating to trade and commerce:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-4__para-i">
              <num>i</num>

                <p>between Australia and places outside Australia; or</p>
              </content>
            </paragraph>

                <p>for purposes relating to a postal, telegraphic, telephonic or other like service within the meaning of paragraph 51(v) of the Constitution; or</p>

                <p>for purposes relating to a service to:</p>

        </section>

          <heading>Annual reports in relation to National Strategic Plans</heading>
          <content>
            <p>Annual report in relation to Asbestos National Strategic Plan</p>
          </content>
          <subsection eId="part-2__sec-8A__subsec-1">
            <num>1</num>
            <content>
              <p>The Agency must, before the end of 31 December in each financial year, prepare a written report relating to the progress made by the Commonwealth and State and Territory governments in implementing the Asbestos National Strategic Plan during the previous financial year. The report may also include information relating to any other matter the Agency considers relevant.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-8A__subsec-2">
            <num>2</num>
            <content>
              <p>As soon as practicable after the Agency has prepared a report under subsection (1), the Agency must give a copy of the report to the following:</p>
            </content>
            <paragraph eId="part-2__sec-8A__subsec-2__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> who administers this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8A__subsec-2__para-b">

                <p>	(b)	the Minister who administers the <i>National Health Act 1953</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8A__subsec-2__para-c">

                <p>	(c)	the Minister who administers the <i>Environment Protection and Biodiversity Conservation Act 1999</i>;</p>

                </content>
              </paragraph>

                  <p>to ensure the Agency performs its functions.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-11__subsec-2">

                <p><role refersTo="#ceo">The CEO</role> has power to do all things necessary or convenient to be done for or in connection with the performance of his or her functions.</p>

            </subsection>
          </section>

            <heading>Working with the Council</heading>
            <subsection eId="part-3__dvs-1__sec-12__subsec-1">
              <num>1</num>
              <content>
                <p>If the Council provides advice or makes recommendations to <role refersTo="#ceo">the CEO</role> under section 29, <role refersTo="#ceo">the CEO</role> must have regard to that advice or those recommendations in performing <role refersTo="#ceo">the CEO</role>’s functions.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-12__subsec-1A">
              <num>1A</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> must comply with any guidelines issued by the Council under section 29.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-12__subsec-1B">

                <p>Subsection (1A) does not apply to the extent that:</p>
              </content>

            <heading>CEO may obtain information</heading>
            <subsection eId="part-3__dvs-1__sec-14A__subsec-1">

              <content>
                <p>This section applies to a person if:</p>
              </content>
              <paragraph eId="part-3__dvs-1__sec-14A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p><role refersTo="#ceo">the CEO</role> believes on reasonable grounds that the person has information that is relevant to the performance of any of the functions of the Agency referred to in paragraphs 8(1)(a), (b) and (g); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-14A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#ceo">the CEO</role> is satisfied that the information:</p>
                </content>
              </paragraph>

                <num>i</num>
                <content>
                  <p>is necessary for the performance of that function; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-3__dvs-1__sec-14A__subsec-1__para-ii">

                  <p>is not otherwise available to <role refersTo="#ceo">the CEO</role>.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-14A__subsec-2">

              <content>
                <p><role refersTo="#ceo">The CEO</role> may, by written notice given to the person, request the person to give to <role refersTo="#ceo">the CEO</role>, within the period and in the manner and form specified in the notice, any such information.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-1__sec-14A__subsec-3">
              <num>3</num>
              <content>
                <p>A period specified under subsection (2) must not be shorter than 14 days after the notice is given.</p>
              </content>
            </subsection>

              <content>
                <p>A manner specified in a notice under subsection (2) must involve the use of a service to which paragraph 51(v) of the Constitution applies.</p>

            </subsection>

                <p>A person may comply with a request under subsection (2).</p>
              </content>
            </subsection>

          <heading>Appointment of the CEO</heading>

                <p><role refersTo="#ceo">The CEO</role> is to be appointed by <role refersTo="#minister">the Minister</role> by written instrument, on a full-time basis.</p>

                <p><role refersTo="#ceo">The CEO</role> holds office for the period specified in the instrument of appointment. The period must not exceed 5 years.</p>

                <p>during a vacancy in the office of CEO, whether or not an appointment has previously been made to that office; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-2__sec-16__para-b">
              <num>b</num>
              <content>
                <p>during any period, or during all periods, when <role refersTo="#ceo">the CEO</role>:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-2__sec-16__para-i">
              <num>i</num>
              <content>
                <p>is absent from duty or from Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-2__sec-16__para-ii">

                <p>is, for any other reason, unable to perform the duties of the office.</p>

                <p><role refersTo="#ceo">The CEO</role> is to be paid the allowances that are prescribed by the rules.</p>

            <heading>Other terms and conditions</heading>

              <p><role refersTo="#ceo">The CEO</role> holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by <role refersTo="#minister">the Minister</role>.</p>

            <num>22</num>
            <heading>Resignation</heading>
            <subsection eId="part-3__dvs-3__sec-22__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#ceo">The CEO</role> may resign his or her appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>
              </content>
            </subsection>
            <subsection eId="part-3__dvs-3__sec-22__subsec-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day it is received by <role refersTo="#minister">the Minister</role> or, if a later day is specified in the resignation, on that later day.</p>

            </subsection>
          </section>

            <num>23</num>
            <heading>Termination of appointment</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> may terminate the appointment of <role refersTo="#ceo">the CEO</role>:</p>
            </content>

              <num>a</num>
              <content>
                <p>for misbehaviour; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-23__para-b">
              <num>b</num>
              <content>
                <p>if <role refersTo="#ceo">the CEO</role> is unable to perform the duties of his or her office because of physical or mental incapacity; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-23__para-c">
              <num>c</num>
              <content>
                <p>if <role refersTo="#ceo">the CEO</role>:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-23__para-i">
              <num>i</num>
              <content>
                <p>becomes bankrupt; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-23__para-ii">
              <num>ii</num>
              <content>
                <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-23__para-iii">
              <num>iii</num>
              <content>
                <p>compounds with his or her creditors; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__dvs-3__sec-23__para-iv">

                <p>makes an assignment of his or her remuneration for the benefit of his or her creditors; or</p>

            </paragraph>

                <p>if <role refersTo="#ceo">the CEO</role> is absent, except on leave of absence, for 14 consecutive days or for 28 days in any 12 months; or</p>

                <p>if <role refersTo="#ceo">the CEO</role> engages, except with <role refersTo="#minister">the Minister</role>’s approval, in paid work outside the duties of his or her office (see section 19); or</p>

            <heading>Delegation</heading>

                <p><role refersTo="#ceo">The CEO</role> may, in writing, delegate all or any of <role refersTo="#ceo">the CEO</role>’s functions or powers under this Act (other than section 14A which confers power on <role refersTo="#ceo">the CEO</role> to obtain information in certain circumstances) to a person who is a member of the staff of the Agency.</p>

            </subsection>

                <p>In exercising any powers or performing any functions under the delegation, the delegate must comply with any directions of <role refersTo="#ceo">the CEO</role>.</p>

                  <p><role refersTo="#ceo">the CEO</role> in the performance of his or her functions; or</p>
                </content>

                  <p>the Council in the performance of its functions.</p>
                </content>
              </paragraph>
            </subsection>

                <p>A committee is to consist of such persons as <role refersTo="#ceo">the CEO</role> determines.</p>

                <p>If <role refersTo="#ceo">the CEO</role> establishes a committee under subsection (1), <role refersTo="#ceo">the CEO</role> must, in writing, determine:</p>

                  <p>the committee’s terms of reference; and</p>
                </content>

                  <p>the terms and conditions of appointment of the members of the committee; and</p>
                </content>
              </paragraph>

              <p>	(1)	The staff of the Agency must be persons engaged under the <i>Public Service Act 1999</i>.</p>

              <p>For the purposes of that Act:</p>
            </content>

                <p><role refersTo="#ceo">the CEO</role> and the staff of the Agency together constitute a Statutory Agency; and</p>

            </paragraph>

                <p><role refersTo="#ceo">the CEO</role> is the Head of that Statutory Agency.</p>

            </paragraph>

        </section>

          <heading>Consultants</heading>
          <subsection eId="part-4__sec-26__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#ceo">The CEO</role> may, on behalf of the Commonwealth, engage consultants to assist in the performance of the Agency’s functions.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-26__subsec-2">
            <num>2</num>
            <content>
              <p>The consultants are to be engaged on the terms and conditions that <role refersTo="#ceo">the CEO</role> determines in writing.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-27">
          <num>27</num>
          <heading>Persons assisting the Agency</heading>
          <content>
            <p>The Agency may be assisted:</p>
          </content>
          <paragraph eId="part-4__sec-27__para-a">
            <num>a</num>
            <content>
              <p>	(a)	by employees of Agencies (within the meaning of the <i>Public Service Act 1999</i>); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-27__para-b">
            <num>b</num>
            <content>
              <p>by officers or employees of a State or Territory; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-27__para-c">
            <num>c</num>
            <content>
              <p>by officers or employees of authorities of the Commonwealth, a State or a Territory;</p>
            </content>
            <content>
              <p>whose services are made available to the Agency in connection with the performance of the Agency’s functions.</p>

                  <p>to provide advice, and make recommendations, to <role refersTo="#ceo">the CEO</role> about the performance of the Agency’s functions, on its own initiative or at the request of <role refersTo="#ceo">the CEO</role>; and</p>

                <num>b</num>
                <content>
                  <p>to provide advice to <role refersTo="#minister">the Minister</role> about asbestos safety, asbestos-related diseases, silica safety and silica-related diseases; and</p>

                <num>c</num>

                  <p>to monitor the implementation of the National Strategic Plans by Commonwealth, State, Territory and local governments; and</p>

                  <p>to provide advice, and make recommendations, about the National Strategic Plans and annual operational plans.</p>

                <p>The Council may issue written guidelines to <role refersTo="#ceo">the CEO</role> about the performance of the Agency’s functions.</p>

            </subsection>

              <num>2A</num>
              <content>
                <p>The Council must not issue guidelines that are inconsistent with any directions given under <ref href="#sec-14">section 14</ref> (Minister’s directions to CEO).</p>

              <num>2B</num>
              <content>
                <p>Any guidelines that are inconsistent with a direction of the kind referred to in subsection (2A) have no effect to the extent of the inconsistency.</p>

                <p>The Council has power to do all things necessary or convenient to be done for or in connection with the performance of its functions.</p>

            <heading>Appointment of Council members</heading>

                <p>The Council members are to be appointed by <role refersTo="#minister">the Minister</role> by written instrument, on a part-time basis.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-2__sec-32__subsec-2">
              <num>2</num>
              <content>
                <p>The instrument of appointment of a Council member must specify whether the member is appointed as:</p>
              </content>
              <paragraph eId="part-5__dvs-2__sec-32__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the Chair; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-32__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the member representing the Commonwealth; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-32__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>a member representing State, Territory and local governments; or</p>

              </paragraph>

                  <p>the person has knowledge or experience in one or more of the following:</p>

                </content>
              </paragraph>

                  <p>public health issues relating to asbestos;</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-32__subsec-3__para-iii">
                <num>iii</num>
                <content>
                  <p>asbestos-related diseases;</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-32__subsec-3__para-iv">
                <num>iv</num>
                <content>
                  <p>the representation of, or the provision of support to, persons with asbestos-related diseases and their families;</p>
                </content>
              </paragraph>

                  <p>silica safety;</p>
                </content>
              </paragraph>

                </content>
              </paragraph>

                  <p>has, or has had, an asbestos-related disease; or</p>

              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-32__subsec-3__para-ii">
                <num>ii</num>
                <content>
                  <p>has lived experience as a family member, carer or advocate in providing support to a person who has, or has had, an asbestos-related disease; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-32__subsec-3__para-iii">
                <num>iii</num>
                <content>
                  <p>has, or has had, a silica-related disease; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-32__subsec-3__para-iv">
                <num>iv</num>
                <content>
                  <p>has lived experience as a family member, carer or advocate in providing support to a person who has, or has had, a silica-related disease.</p>

                  <p>during a vacancy in the office of Chair, whether or not an appointment has previously been made to that office; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-34__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>during any period, or during all periods, when the Chair:</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-2__sec-34__subsec-1__para-i">

                  <p>is absent from duty or from Australia; or</p>
                </content>
              </paragraph>

          <heading>Terms and conditions of appointment</heading>

            <heading>Remuneration and allowances</heading>

                <p>A Council member is to be paid the remuneration that is determined by the Remuneration Tribunal. If no determination of that remuneration by the Tribunal is in operation, the member is to be paid the remuneration that is prescribed by the rules.</p>

            </subsection>
            <subsection eId="part-5__dvs-3__sec-35__subsec-2">
              <num>2</num>
              <content>
                <p>However, a Council member is not entitled to be paid remuneration if he or she holds an office or appointment, or is otherwise employed, on a full-time basis in the service or employment of:</p>

                <num>a</num>
                <content>
                  <p>a State; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-35__subsec-2__para-b">

                  <p>	(b)	a corporation (a <b><i>public statutory corporation</i></b>) that:</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-35__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>is established for a public purpose by a law of a State; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-35__subsec-2__para-ii">

                <content>
                  <p>is not a tertiary education institution; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-35__subsec-2__para-c">

                  <p>a company limited by guarantee, where the interests and rights of the members in or in relation to the company are beneficially owned by a State; or</p>
                </content>
              </paragraph>

                  <p>a company in which all the stock or shares are beneficially owned by a State or by a public statutory corporation.</p>

                <p><role refersTo="#minister">The Minister</role> may grant leave of absence to the Chair on the terms and conditions that <role refersTo="#minister">the Minister</role> determines.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-36__subsec-2">
              <num>2</num>
              <content>
                <p>The Chair may grant leave of absence to another Council member on the terms and conditions that the Chair determines.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-36__subsec-3">

              <content>
                <p>The Chair must notify <role refersTo="#minister">the Minister</role> if the Chair grants another Council member leave of absence for a period that exceeds 3 months.</p>
              </content>
            </subsection>

            <heading>Recording disclosures of interests</heading>
            <subsection eId="part-5__dvs-3__sec-37__subsec-1">
              <num>1</num>

                <p>	(1)	A disclosure by a Council member under <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests) to each other member of the Council must be recorded:<ref href="#sec-29">section 29</ref> of the </p>
              </content>
              <paragraph eId="part-5__dvs-3__sec-37__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>in any advice provided, or recommendations made, to <role refersTo="#ceo">the CEO</role> by the Council; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-3__sec-37__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>in any guidelines issued to <role refersTo="#ceo">the CEO</role> by the Council.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-37__subsec-2">
              <num>2</num>
              <content>
                <p>Subsection (1) applies in addition to any rules made for the purposes of that section.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-37__subsec-3">

                <p>	(3)	For the purposes of this Act and the <i>Public Governance, Performance and Accountability Act 2013</i>, the member is taken not to have complied with section 29 of that Act if the disclosure is not recorded as required by subsection (1) of this section.</p>

            <num>38</num>
            <heading>Other terms and conditions</heading>
            <content>
              <p>A Council member holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by <role refersTo="#minister">the Minister</role>.</p>
            </content>

            <num>39</num>
            <heading>Resignation</heading>
            <subsection eId="part-5__dvs-3__sec-39__subsec-1">
              <num>1</num>
              <content>
                <p>A Council member may resign his or her appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-3__sec-39__subsec-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day it is received by <role refersTo="#minister">the Minister</role> or, if a later day is specified in the resignation, on that later day.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-5__dvs-3__sec-40">
            <num>40</num>
            <heading>Termination of appointment</heading>
            <content>
              <p><role refersTo="#minister">The Minister</role> may terminate the appointment of a Council member:</p>
            </content>
            <paragraph eId="part-5__dvs-3__sec-40__para-a">
              <num>a</num>
              <content>
                <p>for misbehaviour; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__dvs-3__sec-40__para-b">
              <num>b</num>
              <content>
                <p>if the member is incapable of performing the duties of his or her office; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__dvs-3__sec-40__para-c">
              <num>c</num>
              <content>
                <p>if the member:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__dvs-3__sec-40__para-i">
              <num>i</num>
              <content>
                <p>becomes bankrupt; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__dvs-3__sec-40__para-ii">
              <num>ii</num>
              <content>
                <p>applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__dvs-3__sec-40__para-iii">
              <num>iii</num>
              <content>
                <p>compounds with his or her creditors; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__dvs-3__sec-40__para-iv">
              <num>iv</num>
              <content>
                <p>makes an assignment of his or her remuneration for the benefit of his or her creditors; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__dvs-3__sec-40__para-d">

                <p>if the member is absent, except on leave of absence, from 3 consecutive meetings of the Council; or</p>
              </content>
            </paragraph>

                <p>	(e)	if the member fails, without reasonable excuse, to comply with <i>Public Governance, Performance and Accountability Act 2013</i> (which deals with the duty to disclose interests) or rules made for the purposes of that section.<ref href="#sec-29">section 29</ref> of the </p>

          <heading>Procedures of the Council</heading>

                <p>The Chair must hold such meetings as are necessary for the efficient performance of the Council’s functions.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-4__sec-41__subsec-2">

              <content>
                <p>The Chair must preside at all meetings at which he or she is present.</p>
              </content>
            </subsection>
            <subsection eId="part-5__dvs-4__sec-41__subsec-3">

                <p>If the Chair is not present at a meeting, the other Council members must appoint one of themselves to preside.</p>
              </content>
            </subsection>
          </section>

                <p>At a meeting of the Council, a quorum is constituted by:</p>

                  <p>2 members appointed under paragraph 31(c) (members representing State, Territory and local governments); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-4__sec-41A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>any 6 other Council members.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-4__sec-41A__subsec-2">

                <p>However, if:</p>
              </content>
              <paragraph eId="part-5__dvs-4__sec-41A__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	a member is required by rules made for the purposes of <i>Public Governance, Performance and Accountability Act 2013</i> not to be present during the deliberations or to take part in any decision of the Council with respect to a particular matter; and<ref href="#sec-29">section 29</ref> of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-4__sec-41A__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>when the member leaves the meeting concerned, there is no longer a quorum present;</p>

                  <p>the remaining Council members at the meeting constitute a quorum for the purposes of any deliberation or decision at that meeting with respect to that matter.</p>

            </subsection>

            <heading>Voting at meetings</heading>

                <p>A question arising at a meeting of the Council is to be determined by a majority of the votes of the Council members present and voting.</p>

            </subsection>
            <subsection eId="part-5__dvs-4__sec-41B__subsec-2">

              <content>
                <p>The person presiding at a meeting has:</p>
              </content>
              <paragraph eId="part-5__dvs-4__sec-41B__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>a deliberative vote; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-4__sec-41B__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if necessary, also a casting vote.</p>
                </content>
              </paragraph>
            </subsection>
          </section>

              <p>The Council must keep minutes of its meetings.</p>

              <p>The Council may regulate proceedings at its meetings as it considers appropriate.</p>

                <p>The Council is taken to have made a decision at a meeting if:</p>
              </content>
              <paragraph eId="part-5__dvs-4__sec-41E__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>without meeting, a majority of the Council members entitled to vote on the proposed decision indicate agreement with the decision; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-4__sec-41E__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>that agreement is indicated in accordance with the method determined by the Council under subsection (2); and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-4__sec-41E__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>all the Council members were informed of the proposed decision, or reasonable efforts were made to inform all the members of the proposed decision.</p>
                </content>
              </paragraph>

            <subsection eId="part-5__dvs-4__sec-41E__subsec-2">

              <content>
                <p>Subsection (1) applies only if the Council:</p>
              </content>
              <paragraph eId="part-5__dvs-4__sec-41E__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>has determined that it may make decisions of that kind without meeting; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-5__dvs-4__sec-41E__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>has determined the method by which Council members are to indicate agreement with proposed decisions.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-5__dvs-4__sec-41E__subsec-3">

                <p>For the purposes of paragraph (1)(a), a Council member is not entitled to vote on a proposed decision if the member would not have been entitled to vote on that proposal if the matter had been considered at a meeting of the Council.</p>

          <heading>Annual operational plan</heading>

              <p><role refersTo="#ceo">The CEO</role> must, before the start of the 12-month period that starts on 1 July in a year, give <role refersTo="#minister">the Minister</role> for approval an annual operational plan relating to that period.</p>

              <p>The annual operational plan must set out:</p>

                <p>performance indicators for the assessment of the Agency’s performance of its functions during that period.</p>

              <p>The annual operational plan must not be inconsistent with either of the National Strategic Plans.</p>

          <heading>Approval of annual operational plan</heading>

              <p><role refersTo="#minister">The Minister</role> may, by written notice given to <role refersTo="#ceo">the CEO</role>:</p>

              <content>
                <p>approve an annual operational plan given to <role refersTo="#minister">the Minister</role> under section 42; or</p>
              </content>
            </paragraph>

              <content>
                <p>request <role refersTo="#ceo">the CEO</role> to amend an annual operational plan given to <role refersTo="#minister">the Minister</role> under section 42 and to resubmit it for approval.</p>

              <p>An annual operational plan comes into force on the later of the following days:</p>

                <p>the day it is approved by <role refersTo="#minister">the Minister</role>;</p>
              </content>
            </paragraph>

          <heading>Variation of annual operational plan</heading>

            <num>1</num>

              <p><role refersTo="#ceo">The CEO</role> may, on his or her own initiative or at the request of <role refersTo="#minister">the Minister</role>, vary an annual operational plan and give the variation to <role refersTo="#minister">the Minister</role> for approval.</p>

            <num>2</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by written notice given to <role refersTo="#ceo">the CEO</role>, approve the variation of the annual operational plan.</p>

            <num>5</num>
            <content>
              <p>The variation of the annual operational plan takes effect on the day it is approved by <role refersTo="#minister">the Minister</role>.</p>

        <heading>Miscellaneous</heading>

          <heading>Delegation</heading>
          <subsection eId="part-7__sec-46__subsec-1">

              <p>The Agency may, in writing, delegate all or any of its functions or powers under this Act to:</p>
            </content>

              <num>a</num>

                <p><role refersTo="#ceo">the CEO</role>; or</p>
              </content>
            </paragraph>

                <p>an SES employee, or acting SES employee, who is a member of the staff of the Agency.</p>

              <p>In exercising any powers or performing any functions under the delegation, the delegate must comply with any directions of the Agency.</p>

          <heading>Review of the Agency’s role and functions</heading>
          <subsection eId="part-7__sec-47__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause a review of the Asbestos and Silica Safety and Eradication Agency’s ongoing role and functions to be conducted.</p>
            </content>
          </subsection>
          <subsection eId="part-7__sec-47__subsec-2">
            <num>2</num>
            <content>
              <p>The review must:</p>
            </content>
            <paragraph eId="part-7__sec-47__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>start 5 years after the commencement of this section; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-7__sec-47__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>be completed <quantity refersTo="#deadline">within 6 months</quantity>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-7__sec-47__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> must cause a written report about the review to be prepared.</p>

          </subsection>

            <content>
              <p><role refersTo="#minister">The Minister</role> must cause a copy of the report to be laid before each House of Parliament within 15 sitting days after the completion of the report.</p>

          <heading>Rules</heading>
          <content>
            <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>

              <p>required or permitted by this Act to be prescribed by the rules; or</p>
            </content>

                <b>Editorial changes</b>

              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration.                 <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
