          <p>		This Act may be cited as the <i>Migration Legislation Amendment </i><i>Act </i><i>(No.</i><i> </i><i>1) </i><i>201</i><i>4</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

              <p>Repeal the subsection, substitute:</p>
              <p>may, subject to the regulations, apply for a visa of a class prescribed for the purposes of this section or have an application for such a visa made on his or her behalf, but not for a visa of any other class.</p>

              <num>b</num>
              <content>
                <p>after last entering Australia:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-i">
              <num>i</num>
              <content>
                <p>was refused a visa, other than a refusal of a bridging visa or a refusal under <ref href="#sec-501">section 501</ref>, 501A or 501B, for which the non-citizen had applied (whether or not the application has been finally determined); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-ii">
              <num>ii</num>
              <content>
                <p>held a visa that was cancelled under <ref href="#sec-109">section 109</ref> (incorrect information), 116 (general power to cancel), 134 (business visas), 137J (student visas) or 137Q (regional sponsored employment visas);</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-1A">
              <num>1A</num>
              <content>
                <p>A non-citizen in the migration zone who:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-1__para-a">
              <num>a</num>
              <content>
                <p>does not hold a substantive visa; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-b">
              <num>b</num>
              <content>
                <p>after last entering Australia, was refused a visa (other than a refusal of a bridging visa or a refusal under <ref href="#sec-501">section 501</ref>, 501A or 501B) for which an application had been made on the non-citizen’s behalf, whether or not:</p>
              </content>
            </paragraph>

              <num>i</num>
              <content>
                <p>the application has been finally determined; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-ii">
              <num>ii</num>
              <content>
                <p>the non-citizen knew about, or understood the nature of, the application due to any mental impairment; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-iii">
              <num>iii</num>
              <content>
                <p>the non-citizen knew about, or understood the nature of, the application due to the fact that the non-citizen was, at the time the application was made, a minor;</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-2">
            <num>2</num>
            <heading>Subsection 48A(1)</heading>
            <content>
              <p>Omit all the words after paragraph (b), substitute:</p>
              <p>may not make a further application for a protection visa, or have a further application for a protection visa made on his or her behalf, while the non-citizen is in the migration zone.</p>

            <num>3</num>
            <heading>After subsection 48A(1)</heading>
            <content>
              <p>Insert:</p>
              <p>(1AA)	Subject to <ref href="#sec-48B">section 48B</ref>, if:</p>
              <p>the non-citizen may not make a further application for a protection visa, or have a further application for a protection visa made on his or her behalf, while the non-citizen is in the migration zone.</p>

              <num>a</num>
              <content>
                <p>an application for a protection visa is made on a non-citizen’s behalf while the non-citizen is in the migration zone; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-b">
              <num>b</num>
              <content>
                <p>the grant of the visa has been refused, whether or not:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-i">
              <num>i</num>
              <content>
                <p>the application has been finally determined; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-ii">
              <num>ii</num>
              <content>
                <p>the non-citizen knew about, or understood the nature of, the application due to any mental impairment; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-iii">
              <num>iii</num>
              <content>
                <p>the non-citizen knew about, or understood the nature of, the application due to the fact that the non-citizen was, at the time the application was made, a minor;</p>
              </content>
            </paragraph>

            <num>4</num>
            <heading>Subsection 501E(1)</heading>
            <content>
              <p>After “for a visa”, insert “, or have an application for a visa made on the person’s behalf,”.</p>
            </content>

              <p>Insert:</p>
            </content>

              <num>1A</num>
              <content>
                <p>In relation to <role refersTo="#minister">the Minister</role>’s decision to refuse to grant a visa to the person, as mentioned in paragraph (1)(a), it does not matter whether:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5__para-a">
              <num>a</num>
              <content>
                <p>the application for the visa was made on the person’s behalf; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-b">
              <num>b</num>
              <content>
                <p>the person knew about, or understood the nature of, the application for the visa due to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-i">
              <num>i</num>
              <content>
                <p>any mental impairment; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-ii">
              <num>ii</num>
              <content>
                <p>the fact that the person was, at the time the application was made, a minor.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-6">
            <num>6</num>
            <heading>Application</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-6__subclause-1">
              <num>1</num>
              <content>
                <p>The amendment made by item 1 of this Schedule applies to an application for a visa that is made by or on behalf of a non-citizen on or after the day this item commences, even if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-6__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the refusal of a visa, as mentioned in subparagraph 48(1)(b)(i) of the <i>Migration Act 1958</i>, occurs before that day; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the cancellation of a visa, as mentioned in subparagraph 48(1)(b)(ii) of the <i>Migration Act 1958</i>, occurs before that day; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-c">
              <num>c</num>
              <content>
                <p>	(c)	the refusal of a visa, as mentioned in paragraph 48(1A)(b) of the <i>Migration Act 1958</i>, occurs before that day.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-6__subclause-2">
              <num>2</num>
              <content>
                <p>The amendment made by item 2 of this Schedule applies in relation to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-6__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a decision to refuse to grant a protection visa to a non-citizen that is made before the day this item commences, if the further application for a protection visa mentioned in subsection 48A(1) of the <i>Migration Act 1958</i> is made by or on behalf of the non-citizen on or after that day; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-b">
              <num>b</num>
              <content>
                <p>a decision to refuse to grant a protection visa to a non-citizen that is made on or after the day this item commences, regardless of when the application for the visa to which the decision relates was made.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-6__subclause-3">
              <num>3</num>
              <content>
                <p>The amendment made by item 3 of this Schedule applies in relation to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-6__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a decision to refuse to grant a protection visa to a non-citizen that is made before the day this item commences, if the further application for a protection visa mentioned in subsection 48A(1AA) of the <i>Migration Act 1958</i> (as inserted by that item) is made by or on behalf of the non-citizen on or after that day; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-b">
              <num>b</num>
              <content>
                <p>a decision to refuse to grant a protection visa to a non-citizen that is made on or after the day this item commences, regardless of when the application for the visa to which the decision relates was made.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-6__subclause-4">
              <num>4</num>
              <content>
                <p>The amendments made by items 4 and 5 of this Schedule apply in relation to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-6__para-a">
              <num>a</num>
              <content>
                <p>	(a)	a decision to refuse to grant a visa to a person that is made before the day this item commences, if an application for a visa mentioned in subsection 501E(1) of the <i>Migration Act 1958</i> is made by or on behalf of the person on or after that day; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-b">
              <num>b</num>
              <content>
                <p>a decision to refuse to grant a visa to a person that is made on or after the day this item commences, regardless of when the application for the visa to which the decision relates was made.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-7">
            <num>7</num>
            <heading>Saving of regulations</heading>
            <content>
              <p>The amendment made by item 1 of this Schedule does not affect the validity of regulations in force for the purposes of <i>Migration Act 1958</i> immediately before the commencement of that item.<ref href="#sec-48">section 48</ref> of the </p>
            </content>

          <heading>Removal of unlawful non-citizens</heading>
          <content>
            <p>Migration Act 1958</p>
          </content>
          <hcontainer name="clause" eId="schedule-2__clause-1">
            <num>1</num>
            <heading>Paragraph 198(5)(b)</heading>
            <content>
              <p>Repeal the paragraph, substitute:</p>
              <p>regardless of whether the non-citizen has made a valid application for a bridging visa.</p>
            </content>
            <paragraph eId="schedule-2__clause-1__para-b">
              <num>b</num>
              <content>
                <p>neither applied for a substantive visa in accordance with subsection 195(1) nor applied under <ref href="#sec-137K">section 137K</ref> for revocation of the cancellation of a substantive visa;</p>

                <p>Despite subsection (5), an officer must not remove an unlawful non-citizen if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-2__para-a">
              <num>a</num>
              <content>
                <p>the non-citizen has made a valid application for a protection visa (even if the application was made outside the time allowed by subsection 195(1)); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-2__para-b">
              <num>b</num>
              <content>
                <p>either:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-2__para-i">
              <num>i</num>
              <content>
                <p>the grant of the visa has not been refused; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-2__para-ii">
              <num>ii</num>
              <content>
                <p>the application has not been finally determined.</p>
              </content>
            </paragraph>

            <heading>Application</heading>

              <p>The amendments made by this Schedule apply to the removal of a detainee on or after the day this item commences, even if the detainee was detained before that day.</p>

            <heading>Liability to the Commonwealth for the cost of keeping, maintaining and removing certain persons</heading>

            <heading>Paragraphs 262(1)(a) and (b)</heading>
            <content>
              <p>Repeal the paragraphs, substitute:</p>
            </content>

              <content>
                <p>is, or has been, detained under <ref href="#sec-189">section 189</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-2__para-b">
              <num>b</num>

                <p>was on board a vessel (not being an aircraft) when it was used in connection with the commission of an offence against this Act or against a prescribed law in force in the Commonwealth or in a State or Territory, being a law relating to the control of fishing; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-2__para-ba">
              <num>ba</num>
              <content>
                <p>is convicted of the offence;</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-3__clause-3">
            <num>3</num>
            <heading>At the end of section 262</heading>
            <content>
              <p>Add:</p>
            </content>
            <hcontainer name="subclause" eId="schedule-3__clause-3__subclause-4">
              <num>4</num>
              <content>
                <p>To avoid doubt, the liability to pay the Commonwealth an amount under subsection (1) may be enforced:</p>
              </content>
            </hcontainer>

                <p>at the time the person is convicted of an offence mentioned in paragraph (1)(b); or</p>
              </content>
            </paragraph>

                <p>after the person has served the whole or a part of any sentence imposed upon the person because of his or her conviction of an offence mentioned in paragraph (1)(b).</p>

            <heading>Application</heading>

                <p>(1)	The amendments made by this Schedule apply to a conviction for an offence against paragraph 262(1)(b) of the <i>Migration Act 1958</i>, as amended by this Schedule, that occurs on or after the day this item commences.</p>
              </content>

              <content>
                <p>The amendments made by this Schedule also apply to costs incurred before the day this item commences in relation to a conviction mentioned in subitem (1).</p>

            <heading>Saving of regulations</heading>
            <content>
              <p>The amendment made by item 2 of this Schedule does not affect the validity of regulations in force for the purposes of paragraph 262(1)(b) of the <i>Migration Act 1958</i> immediately before the commencement of that item.</p>
