                <p><role refersTo="#minister">the Minister</role> is satisfied that the person does not pass the character test because of the operation of:</p>
              </content>
            </paragraph>

              <num>i</num>
              <content>
                <p>paragraph (6)(a) (substantial criminal record), on the basis of paragraph (7)(a), (b) or (c); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-8__para-ii">
              <num>ii</num>
              <content>
                <p>paragraph (6)(e) (sexually based offences involving a child); and</p>
              </content>
            </paragraph>

                <p>the person is serving a sentence of imprisonment, on a full-time basis in a custodial institution, for an offence against a law of the Commonwealth, a State or a Territory.</p>

                <p>that the person has been or is a member of a group or organisation, or has had or has an association with a group, organisation or person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-ii">
              <num>ii</num>
              <content>
                <p>that the group, organisation or person has been or is involved in criminal conduct; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-ba">
              <num>ba</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> reasonably suspects that the person has been or is involved in conduct constituting one or more of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-i">
              <num>i</num>
              <content>
                <p>an offence under one or more of sections 233A to 234A (people smuggling);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-ii">
              <num>ii</num>
              <content>
                <p>an offence of trafficking in persons;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-iii">
              <num>iii</num>
              <content>
                <p>the crime of genocide, a crime against humanity, a war crime, a crime involving torture or slavery or a crime that is otherwise of serious international concern;</p>
              </content>
            </paragraph>
          </hcontainer>

            <heading>Paragraph 501(6)(d)</heading>

                <p>convicted the person of one or more sexually based offences involving a child; or</p>
              </content>

            <paragraph eId="schedule-1__clause-12__para-ii">

                <p>found the person guilty of such an offence, or found a charge against the person proved for such an offence, even if the person was discharged without a conviction; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-12__para-f">
              <num>f</num>
              <content>
                <p>the person has, in Australia or a foreign country, been charged with or indicted for one or more of the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-12__para-i">
              <num>i</num>
              <content>
                <p>the crime of genocide;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-12__para-ii">
              <num>ii</num>
              <content>
                <p>a crime against humanity;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-12__para-iii">
              <num>iii</num>
              <content>
                <p>a war crime;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-12__para-iv">
              <num>iv</num>
              <content>
                <p>a crime involving torture or slavery;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-12__para-v">
              <num>v</num>
              <content>
                <p>a crime that is otherwise of serious international concern; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-12__para-g">
              <num>g</num>
              <content>
                <p>	(g)	the person has been assessed by the Australian Security Intelligence Organisation to be directly or indirectly a risk to security (<i>Australian Security Intelligence Organisation Act 1979</i>); or<ref href="#sec-4">within the meaning of section 4</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-12__para-h">
              <num>h</num>
              <content>
                <p>an Interpol notice in relation to the person, from which it is reasonable to infer that the person would present a risk to the Australian community or a segment of that community, is in force.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-13">
            <num>13</num>
            <heading>Paragraph 501(7)(d)</heading>
            <content>
              <p>Omit “(whether on one or more occasions), where the total of those terms is 2 years”, substitute “, where the total of those terms is 12 months”.</p>

            <heading>At the end of subsection 501(7)</heading>

              <p>Add:</p>
              <p>; or (f)	the person has:</p>

                <p>been found by a court to not be fit to plead, in relation to an offence; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14__para-ii">

                <p>the court has nonetheless found that on the evidence available the person committed the offence; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-14__para-iii">
              <num>iii</num>
              <content>
                <p>as a result, the person has been detained in a facility or institution.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-15">
            <num>15</num>
            <heading>After subsection 501(7)</heading>
            <content>
              <p>Insert:</p>
              <p>Concurrent sentences</p>
              <p>Example:	A person is sentenced to 2 terms of <quantity refersTo="#custodialSentence">3 months imprisonment</quantity> for 2 offences, to be served concurrently. For the purposes of the character test, the total of those terms is 6 months.</p>

              <num>7A</num>
              <content>
                <p>For the purposes of the character test, if a person has been sentenced to 2 or more terms of imprisonment to be served concurrently (whether in whole or in part), the whole of each term is to be counted in working out the total of the terms.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-16">
            <num>16</num>
            <heading>Paragraph 501(10)(b)</heading>
            <content>
              <p>Repeal the paragraph, substitute:</p>
            </content>

              </content>
            </paragraph>

            </paragraph>

            <heading>Cancellation of visa—setting aside and substitution of non-adverse decision under section 501CA</heading>

              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-501BA__para-b">
              <num>b</num>
              <content>
                <p>the Administrative Appeals Tribunal;</p>
              </content>
            </paragraph>
            <content>
              <p>makes a decision under <b><i>original decision</i></b>) to revoke a decision under subsection 501(3A) to cancel a visa that has been granted to a person.<ref href="#sec-501C">section 501C</ref>A (the </p>
              <p>Action by Minister—natural justice does not apply</p>
              <p>Minister’s exercise of power</p>
              <p>Decision not reviewable under <ref href="#part-5">Part 5</ref> or 7</p>
              <p>Note:	For notification of decisions under subsection (2), see <ref href="#sec-501G">section 501G</ref>.</p>

              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may set aside the original decision and cancel a visa that has been granted to the person if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-501BA__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that the person does not pass the character test because of the operation of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-501BA__para-i">
              <num>i</num>
              <content>
                <p>paragraph 501(6)(a), on the basis of paragraph 501(7)(a), (b) or (c); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-501BA__para-ii">
              <num>ii</num>
              <content>
                <p>paragraph 501(6)(e); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-501BA__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied that the cancellation is in the national interest.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-501BA__subclause-3">
              <num>3</num>
              <content>
                <p>The rules of natural justice do not apply to a decision under subsection (2).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-501BA__subclause-4">
              <num>4</num>
              <content>
                <p>The power under subsection (2) may only be exercised by <role refersTo="#minister">the Minister</role> personally.</p>
              </content>
            </hcontainer>

              <num>5</num>
              <content>
                <p>A decision under subsection (2) is not reviewable under <ref href="#part-5">Part 5</ref> or 7.</p>

            <heading>After section 501C</heading>
            <content>
              <p>Insert:</p>

            <heading>Cancellation of visa—revocation of decision under subsection 501(3A) (person serving sentence of imprisonment)</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-501CA__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	This section applies if the Minister makes a decision (the <b><i>original decision</i></b>) under subsection 501(3A) (person serving sentence of imprisonment) to cancel a visa that has been granted to a person.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-501CA__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	For the purposes of this section, <b><i>relevant information</i></b> is information (other than non-disclosable information) that the Minister considers:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-501CA__para-a">
              <num>a</num>
              <content>
                <p>would be the reason, or a part of the reason, for making the original decision; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-501CA__para-b">
              <num>b</num>
              <content>
                <p>is specifically about the person or another person and is not just about a class of persons of which the person or other person is a member.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-501CA__subclause-3">
              <num>3</num>
              <content>
                <p>As soon as practicable after making the original decision, <role refersTo="#minister">the Minister</role> must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-501CA__para-a">
              <num>a</num>
              <content>
                <p>give the person, in the way that <role refersTo="#minister">the Minister</role> considers appropriate in the circumstances:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-501CA__para-i">
              <num>i</num>
              <content>
                <p>a written notice that sets out the original decision; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-501CA__para-ii">
              <num>ii</num>
              <content>
                <p>particulars of the relevant information; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-501CA__para-b">
              <num>b</num>
              <content>
                <p>invite the person to make representations to <role refersTo="#minister">the Minister</role>, within the period and in the manner ascertained in accordance with the regulations, about revocation of the original decision.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-501CA__subclause-4">
              <num>4</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may revoke the original decision if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-501CA__para-a">
              <num>a</num>
              <content>
                <p>the person makes representations in accordance with the invitation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-501CA__para-b">
              <num>b</num>
              <content>
                <p><role refersTo="#minister">the Minister</role> is satisfied:</p>
              </content>
            </paragraph>

                <p>Despite subsection (3), <role refersTo="#registrar">the registrar</role> (however described) of a court of a State or Territory is not required to comply with a notice under subsection (1) to the extent that the information specified in the notice, in relation to a person specified in the notice, is information that relates to proceedings that have not been finally determined by the court.</p>

                <p>The head of an agency of a State or Territory is not excused from complying with a notice under subsection (1) on the ground that disclosing the information specified in the notice would contravene a law of the Commonwealth, a State or a Territory that:</p>

              <num>a</num>
              <content>
                <p>primarily relates to the protection of the privacy of individuals; and</p>
              </content>
            </paragraph>

                <p>prohibits or regulates the use or disclosure of personal information.</p>
              </content>
            </paragraph>
            <content>
              <p>Immunity from suit</p>
              <p>merely because the person gives information to <role refersTo="#minister">the Minister</role> for the purposes of ensuring that the head of an agency of a State or Territory complies with a notice under subsection (1).</p>
              <p><b><i>agency</i></b> of a State or Territory includes the following:</p>
              <p><b><i>head</i></b> of an agency means:</p>
            </content>

                <p>A person is not liable to:</p>
              </content>

                <p>a company in which a controlling interest is held by any one of the following persons, or by 2 or more of the following persons together:</p>

              </content>
            </paragraph>

                <p><role refersTo="#minister">the Minister</role> is satisfied that it would be in the public interest to cancel the visa.</p>

                <p>The rules of natural justice, and the procedure set out in Subdivision C, do not apply to a decision under subsection (3).</p>

                <p>the visa holder was given a notice under <ref href="#sec-107">section 107</ref> in relation to the ground for cancelling the visa; or</p>

                <p>the visa holder responded to any such notice; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-133A__para-c">

                <p>the Migration Review Tribunal, the Refugee Review Tribunal, the Administrative Appeals Tribunal or a delegate of <role refersTo="#minister">the Minister</role>:</p>

            </paragraph>

                <p>decided that the ground did not exist; or</p>
              </content>
            </paragraph>

            </paragraph>

                <p>If a decision was made as mentioned in paragraph (5)(c), the power under subsection (3) to cancel a visa is a power to set aside that decision and cancel the visa.</p>

            <heading>Other provisions relating to the exercise of powers in section 133A</heading>

                <p>Subject to subsection (2), the possible non-compliances that can constitute a ground for the cancellation of a visa under subsection 133A(1) or (3) include non-compliances that occurred at any time (whether before or after the commencement of this section), including non-compliances in respect of any previous visa held by the person.</p>

                <p>a delegate of <role refersTo="#minister">the Minister</role> decided to revoke, under subsection 131(1), a cancellation of the visa in accordance with section 128 in relation to the ground.</p>

              <p>The regulations may provide that, in determining for the purposes of subsection 133A(1) or 133C(1) whether:</p>
              <p>satisfies <role refersTo="#minister">the Minister</role> that a ground for cancelling the person’s visa does not exist, any information or material submitted by or on behalf of the person must not be considered by <role refersTo="#minister">the Minister</role> unless the information or material is submitted within the period, and in the manner, ascertained in accordance with the regulations.</p>

                <p>sets out the reasons (other than non-disclosable information) for the decision.</p>

                <p>The notice is to be given in the prescribed manner.</p>

            <heading>Cancellation under subsection 133A(3) or 133C(3)—Minister may revoke cancellation in certain circumstances</heading>

                <p>	(1)	This section applies if the Minister makes a decision (the <b><i>original decision</i></b>) under subsection 133A(3) or 133C(3) to cancel a visa that has been granted to a person.</p>

              <num>2</num>
              <content>
                <p>	(2)	For the purposes of this section, <b><i>relevant information</i></b> is information (other than non-disclosable information) that the Minister considers:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-133F__para-a">
              <num>a</num>
              <content>
                <p>would be the reason, or a part of the reason, for making the original decision; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-133F__para-b">
              <num>b</num>
              <content>
                <p>is specifically about the person or another person and is not just about a class of persons of which the person or other person is a member.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-133F__subclause-3">

              <content>
                <p>As soon as practicable after making the original decision, <role refersTo="#minister">the Minister</role> must:</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>
                <p>give the person, in the way that <role refersTo="#minister">the Minister</role> considers appropriate in the circumstances:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-133F__para-i">
              <num>i</num>
              <content>
                <p>a written notice that sets out the original decision; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-133F__para-ii">
              <num>ii</num>
              <content>
                <p>particulars of the relevant information; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-133F__para-b">
              <num>b</num>
              <content>
                <p>invite the person to make representations to <role refersTo="#minister">the Minister</role>, within the period and in the manner ascertained in accordance with the regulations, about revocation of the original decision.</p>
              </content>
            </paragraph>

              <num>4</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may revoke the original decision if:</p>
              </content>
            </hcontainer>

              <content>
                <p>the person makes representations in accordance with the invitation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-133F__para-b">
              <num>b</num>
              <content>
                <p>the person satisfies <role refersTo="#minister">the Minister</role> that the ground for cancelling the visa referred to in subsection 133A(3) or 133C(3) (as the case requires) does not exist.</p>

                <p>The power in subsection (4) may only be exercised by <role refersTo="#minister">the Minister</role> personally.</p>
