          <p>		This Act may be cited as the <i>Counter</i><i>-</i><i>Terrorism Legislation Amendment </i><i>Act</i><i> (No.</i><i> </i><i>1) 2014</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

                <p>	(a)	a regulation that specifies an organisation for the purposes of paragraph (b) of the definition of <b><i>terrorist organisation</i></b> in section 102.1;</p>

              <num>b</num>
              <content>
                <p>an instrument made under <ref href="#sec-102">section 102</ref>.1AA.</p>
              </content>
            </paragraph>

                <p>The Parliamentary Joint Committee on Intelligence and Security may:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-1__para-a">
              <num>a</num>
              <content>
                <p>review the disallowable instrument as soon as possible after the making of the instrument; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-b">
              <num>b</num>
              <content>
                <p>report the Committee’s comments and recommendations to each House of the Parliament before the end of the applicable disallowance period for that House.</p>
              </content>
            </paragraph>
          </hcontainer>

            <num>2</num>
            <heading>Subsection 102.1A(3) (heading)</heading>

              <p>Repeal the heading, substitute:</p>

                <p>	(4)	The <b><i>applicable disallowance period</i></b> for a House of the Parliament means the period of 15 sitting days of that House after the disallowable instrument, or a copy of the disallowable instrument, was laid before that House in accordance with section 38 of the <i>Legislative Instruments Act 2003</i>.</p>

            <heading>Subdivision A of Division 104 of the Criminal Code</heading>
            <content>
              <p>Repeal the Subdivision, substitute:</p>
              <p>Subdivision A—Objects of this Division</p>
            </content>

              <num>104.1</num>
              <heading>Objects of this Division</heading>
              <content>
                <p>The objects of this Division are to allow obligations, prohibitions and restrictions to be imposed on a person by a control order for one or more of the following purposes:</p>
              </content>

                <num>a</num>
                <content>
                  <p>protecting the public from a terrorist act;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-6__subclause-104-1__para-b">
                <num>b</num>
                <content>
                  <p>preventing the provision of support for or the facilitation of a terrorist act;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-6__subclause-104-1__para-c">
                <num>c</num>
                <content>
                  <p>preventing the provision of support for or the facilitation of the engagement in a hostile activity in a foreign country.</p>
                </content>
              </paragraph>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-7">
            <num>7</num>
            <heading>At the end of subsection 104.2(2) of the Criminal Code</heading>
            <content>
              <p>Add:</p>
              <p>; or (c)	suspects on reasonable grounds that the order in the terms to be requested would substantially assist in preventing the provision of support for or the facilitation of a terrorist act; or</p>
            </content>
            <paragraph eId="schedule-1__clause-7__para-d">
              <num>d</num>
              <content>
                <p>suspects on reasonable grounds that the person has provided support for or otherwise facilitated the engagement in a hostile activity in a foreign country.</p>
              </content>
            </paragraph>

            <num>8</num>
            <heading>Subsections 104.2(3) to (4) of the Criminal Code</heading>
            <content>
              <p>Repeal the subsections, substitute:</p>
              <p>Note:	An interim control order cannot be requested in relation to a person who is under 16 years of age (see <ref href="#sec-104">section 104</ref>.28).</p>
            </content>

              <content>
                <p>In seeking the Attorney-General’s consent, the member must give the Attorney-General:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-8__para-a">
              <num>a</num>
              <content>
                <p>a draft of the interim control order to be requested; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-8__para-aa">
              <num>aa</num>
              <content>
                <p>the following:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-8__para-i">
              <num>i</num>
              <content>
                <p>a statement of the facts relating to why the order should be made;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-8__para-ii">
              <num>ii</num>
              <content>
                <p>if the member is aware of any facts relating to why the order should not be made—a statement of those facts; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-8__para-b">
              <num>b</num>
              <content>
                <p>information (if any) that the member has about the person’s age; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-8__para-c">
              <num>c</num>
              <content>
                <p>a summary of the grounds on which the order should be made.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-8__subclause-3A">
              <num>3A</num>
              <content>
                <p>	(3A)	To avoid doubt, paragraph (3)(c) does not require any information to be included in the summary if disclosure of that information is likely to prejudice national security (within the meaning of the <i>National Security Information (Criminal and Civil Proceedings) Act 2004</i>).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-8__subclause-4">
              <num>4</num>
              <content>
                <p>The Attorney-General’s consent may be made subject to the member making changes required by the Attorney-General to the draft of the interim control order to be requested.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-8A">
            <num>8A</num>
            <heading>Subsection 104.2(6) of the Criminal Code</heading>
            <content>
              <p>Omit “paragraphs (2)(a) and (b)”, substitute “subsection (2)”.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9">
            <num>9</num>
            <heading>Section 104.3 of the Criminal Code</heading>
            <content>
              <p>Repeal the section, substitute:</p>
              <p>Note:	The member might commit an offence if the draft request is false or misleading (see sections 137.1 and 137.2).</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-9__subclause-104-3">
              <num>104.3</num>
              <heading>Requesting the court to make an interim control order</heading>
              <content>
                <p>If the Attorney-General consents to the request under <ref href="#sec-104">section 104</ref>.2, the senior AFP member may request an interim control order by giving an issuing court the following:</p>
              </content>
              <paragraph eId="schedule-1__clause-9__subclause-104-3__para-a">
                <num>a</num>
                <content>
                  <p>a request the information in which is sworn or affirmed by the member;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-9__subclause-104-3__para-b">
                <num>b</num>
                <content>
                  <p>all that is required under subsection 104.2(3) (incorporating any change made to the draft of the interim control order under subsection 104.2(4));</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-9__subclause-104-3__para-d">
                <num>d</num>
                <content>
                  <p>the following:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-9__subclause-104-3__para-i">
                <num>i</num>
                <content>
                  <p>an explanation as to why each of the proposed obligations, prohibitions or restrictions should be imposed on the person;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-9__subclause-104-3__para-ii">
                <num>ii</num>
                <content>
                  <p>if the member is aware of any facts relating to why any of those obligations, prohibitions or restrictions should not be imposed on the person—a statement of those facts;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-9__subclause-104-3__para-e">
                <num>e</num>
                <content>
                  <p>the following:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-9__subclause-104-3__para-i">
                <num>i</num>
                <content>
                  <p>the outcomes and particulars of all previous requests for interim control orders (including the outcomes of the hearings to confirm the orders) in relation to the person;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-9__subclause-104-3__para-ii">
                <num>ii</num>
                <content>
                  <p>the outcomes and particulars of all previous applications for variations of control orders made in relation to the person;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-9__subclause-104-3__para-iii">
                <num>iii</num>
                <content>
                  <p>the outcomes and particulars of all previous applications for revocations of control orders made in relation to the person;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-9__subclause-104-3__para-iv">
                <num>iv</num>
                <content>
                  <p>the outcomes and particulars of all previous applications for preventative detention orders in relation to the person;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-9__subclause-104-3__para-v">
                <num>v</num>
                <content>
                  <p>information (if any) that the member has about any periods for which the person has been detained under an order made under a corresponding State preventative detention law;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-9__subclause-104-3__para-f">
                <num>f</num>
                <content>
                  <p>a copy of the Attorney-General’s consent.</p>
                </content>
              </paragraph>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-10">
            <num>10</num>
            <heading>Subparagraph 104.4(1)(c)(v) of the Criminal Code</heading>
            <content>
              <p>Omit “; and”, substitute “; or”.</p>

              <p>Repeal the paragraph, substitute:</p>

                <p>the court is satisfied on the balance of probabilities that each of the obligations, prohibitions and restrictions to be imposed on the person by the order is reasonably necessary, and reasonably appropriate and adapted, for the purpose of:</p>

              <num>i</num>
              <content>
                <p>protecting the public from a terrorist act; or</p>
              </content>
            </paragraph>

                <p>preventing the provision of support for or the facilitation of a terrorist act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-12__para-iii">
              <num>iii</num>
              <content>
                <p>preventing the provision of support for or the facilitation of the engagement in a hostile activity in a foreign country.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-14">

            <heading>After subsection 104.5(1A) of the Criminal Code</heading>
            <content>
              <p>Insert:</p>
            </content>

                <p>In specifying a day for the purposes of paragraph (1)(e), the issuing court must take into account:</p>
              </content>
            </hcontainer>

                <p>that the persons mentioned in subsection 104.14(1) may need to prepare in order to adduce evidence or make submissions to the court in relation to the confirmation of the order; and</p>

                <p>any other matter the court considers relevant.</p>

                <p>An authorisation given under this section:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-9B__para-a">
              <num>a</num>

                <p>may be given in relation to the same matters as an authorisation may be given under subsection 9(2); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9B__para-b">
              <num>b</num>
              <content>
                <p>is subject to the requirements of subsections 9(3) and (4A).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-9B__subclause-4">
              <num>4</num>
              <content>
                <p>An authorisation given under this section for an activity or series of activities ceases to have effect at the earliest of the following times:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-9B__para-a">
              <num>a</num>
              <content>
                <p>when an authorisation for the activity or series of activities is given under <ref href="#sec-9">section 9</ref> or 9A;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9B__para-b">
              <num>b</num>
              <content>
                <p>when the authorisation given under this section is cancelled by the relevant responsible Minister under subsection (8) of this section;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9B__para-c">
              <num>c</num>
              <content>
                <p>48 hours from the time the authorisation was given under this section.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-9B__subclause-4A">
              <num>4A</num>
              <content>
                <p>An agency head who gives an authorisation under this section for an activity or series of activities must notify the relevant responsible Minister of the authorisation within 8 hours after giving the authorisation.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-9B__subclause-5">
              <num>5</num>
              <content>
                <p>The agency head must also give the following documents to the relevant responsible Minister and the Inspector-General of Intelligence and Security:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-9B__para-a">
              <num>a</num>
              <content>
                <p>a copy of the authorisation;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9B__para-b">
              <num>b</num>
              <content>
                <p>a summary of the facts of the case that the agency head was satisfied justified giving the authorisation;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9B__para-c">
              <num>c</num>
              <content>
                <p>an explanation of <role refersTo="#minister">the Minister</role>’s obligation under subsection (7).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-9B__subclause-6">
              <num>6</num>
              <content>
                <p>The documents must be given to the responsible Minister and the Inspector-General of Intelligence and Security as soon as practicable, but no later than the following time:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-9B__para-a">
              <num>a</num>
              <content>
                <p>for documents given to the responsible Minister—48 hours after giving the authorisation;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9B__para-b">
              <num>b</num>
              <content>
                <p>for documents given to the Inspector-General of Intelligence and Security—3 days after giving the authorisation.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-9B__subclause-7">
              <num>7</num>
              <content>
                <p>As soon as practicable after the responsible Minister is given the documents, the responsible Minister must consider whether to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-9B__para-a">
              <num>a</num>
              <content>
                <p>cancel the authorisation under subsection (8); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9B__para-b">
              <num>b</num>
              <content>
                <p>give a new authorisation for the activity or series of activities under <ref href="#sec-9">section 9</ref> or 9A.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-9B__subclause-8">
              <num>8</num>
              <content>
                <p>For the purposes of paragraph (4)(b), the relevant responsible Minister may, in writing, cancel an authorisation given under this section.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-9B__subclause-8A">
              <num>8A</num>
              <content>
                <p><quantity refersTo="#deadline">Within 30 days</quantity> after the Inspector-General of Intelligence and Security is given the documents, the Inspector-General must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-9B__para-a">
              <num>a</num>
              <content>
                <p>consider whether the agency head complied with the requirements of this section in giving the authorisation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9B__para-b">
              <num>b</num>
              <content>
                <p>provide the responsible Minister with a report on the Inspector-General’s views of the extent of the agency head’s compliance with the requirements of this section in giving the authorisation; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9B__para-c">
              <num>c</num>
              <content>
                <p>provide to the Committee a copy of the conclusions in the report.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-9B__subclause-9">
              <num>9</num>
              <content>
                <p>An authorisation, report and a cancellation under this section are not legislative instruments.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-9C">
            <num>9C</num>
            <heading>Authorisations in an emergency—Minister responsible for administering the Australian Security Intelligence Organisation Act 1979 unavailable</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-9C__subclause-1">
              <num>1</num>
              <content>
                <p>This section applies if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-9C__para-a">
              <num>a</num>
              <content>
                <p>an agency head considers it necessary or desirable to undertake an activity or a series of activities; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9C__para-b">
              <num>b</num>
              <content>
                <p>an authorisation is sought under <ref href="#sec-9A">section 9A</ref> or 9B; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9C__para-c">
              <num>c</num>
              <content>
                <p>all of the following apply:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9C__para-i">
              <num>i</num>
              <content>
                <p>	(i)	the agreement of the Minister responsible for administering the <i>Australian Security Intelligence Organisation Act 1979</i> (the <b><i>ASIO Minister</i></b>) is required to be obtained under paragraph 9(1A)(b);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9C__para-ii">
              <num>ii</num>
              <content>
                <p>the agreement has not been obtained;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9C__para-iii">
              <num>iii</num>
              <content>
                <p>the agency head is satisfied that the ASIO Minister is not readily available or contactable.</p>
              </content>
            </paragraph>
            <content>
              <p>Giving authorisation</p>
              <p>Obtaining the agreement of the Director-General of Security</p>
              <p>Notifying the ASIO Minister</p>
              <p>Oversight by Inspector-General of Intelligence and Security</p>
            </content>
            <hcontainer name="subclause" eId="schedule-2__clause-9C__subclause-2">
              <num>2</num>
              <content>
                <p>Despite paragraph 9(1A)(b), the authorisation may (subject to subsection (3)) be given without obtaining the agreement of the ASIO Minister.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-9C__subclause-3">
              <num>3</num>
              <content>
                <p>Before an authorisation is given under <ref href="#sec-9A">section 9A</ref> or 9B, unless the agency head is satisfied that the Director-General of Security is not readily available or contactable, the agency head must obtain the agreement of the Director-General to the authorisation being given without the agreement of the ASIO Minister.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-9C__subclause-4">
              <num>4</num>
              <content>
                <p>The relevant agency head must notify the ASIO Minister and the Inspector-General of Intelligence and Security that an authorisation was given under <ref href="#sec-9A">section 9A</ref> or 9B (as the case requires) in accordance with this section. The notification must state whether the agreement of the Director-General of Security was obtained.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-9C__subclause-5">
              <num>5</num>
              <content>
                <p>The notification must be given:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-9C__para-a">
              <num>a</num>
              <content>
                <p>for a notification given to the ASIO Minister—before the end of 8 hours after the authorisation is given under <ref href="#sec-9A">section 9A</ref> or 9B; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-9C__para-b">
              <num>b</num>
              <content>
                <p>for a notification given to the Inspector-General of Intelligence and Security—as soon as practicable, but no later than 3 days after the authorisation is given under <ref href="#sec-9A">section 9A</ref> or 9B.</p>
              </content>
            </paragraph>

              <num>6</num>
              <content>
                <p><quantity refersTo="#deadline">Within 30 days</quantity> after the Inspector-General of Intelligence and Security is given the notification, the Inspector-General must:</p>

                <p>consider whether the agency head complied with the requirements of this section in giving the authorisation under <ref href="#sec-9A">section 9A</ref> or 9B; and</p>

                <p>provide the responsible Minister with a report on the Inspector-General’s views of the extent of the agency head’s compliance with the requirements of this section in giving the authorisation under that section; and</p>
