            <p>		This Act may be cited as the <i>Biosecurity Charges Imposition (General) Act 2015</i>.</p>
          </content>
        </section>

          <heading>Commencement</heading>
          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>
            <content>
              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <heading>Act binds the Crown</heading>
          <content>
            <p>This Act binds the Crown in each of its capacities.</p>
          </content>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Extension to external Territories</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>This Act extends to the Territory of Christmas Island and the Territory of Cocos (Keeling) Islands.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>A regulation may extend this Act or any provisions of this Act to any other external Territory that is prescribed by the regulation.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Extraterritorial application</heading>
          <content>
            <p>This Act extends to acts, omissions, matters and things outside:</p>
          </content>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>Australia and any external Territory to which a provision of this Act extends; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>the airspace over an area covered by paragraph (a); and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>	(c)	the coastal sea (<i>Acts Interpretation Act 1901</i>) of Australia and of any external Territory to which a provision of this Act extends.<ref href="#sec-15B__subsec-4">as defined in subsection 15B(4)</ref> of the </p>

              <p>a regulation may extend any or all provisions of this Act to one or more other external Territories.</p>

          <num>6</num>
          <heading>Act does not impose tax on property of a State</heading>
          <subsection eId="part-1__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>This Act does not impose a tax on property of any kind belonging to a State.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>property of any kind belonging to a State</i></b> has the same meaning as in section 114 of the Constitution.</p>
            </content>

        </section>

        <heading>Charges</heading>
        <section eId="part-2__sec-7">
          <num>7</num>
          <heading>Imposition of charges</heading>
          <subsection eId="part-2__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	A regulation may prescribe a charge in relation to a prescribed matter connected with the administration of the <i>Biosecurity Act 2015</i>.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>The charges prescribed under subsection (1) are imposed as taxes.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-3">
            <num>3</num>
            <content>
              <p>Two or more charges may be prescribed in relation to the same matter, and a single charge may be prescribed in relation to 2 or more matters.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-4">
            <num>4</num>
            <content>
              <p>This section imposes a charge only so far as that charge is neither a duty of customs nor a duty of excise <ref href="#sec-55">within the meaning of section 55</ref> of the Constitution.</p>

          <num>8</num>
          <heading>Matters relating to amount of charges</heading>
          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>A regulation may prescribe a charge under subsection 7(1):</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>by specifying an amount as the charge; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>by specifying a method for calculating the amount of the charge.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>Before the Governor-General makes a regulation under subsection 7(1) prescribing a charge in relation to a matter, <role refersTo="#minister">the Minister</role> must be satisfied that the amount of the charge is set at a level that is designed to recover no more than the Commonwealth’s likely costs in connection with the matter.</p>
            </content>
          </subsection>

          <heading>Exemptions from charges</heading>
          <content>
            <p>A regulation may provide for exemptions from a charge prescribed under subsection 7(1).</p>

          <heading>Regulations</heading>
          <content>
            <p>The Governor-General may make regulations prescribing matters:</p>
          </content>

            <num>a</num>
            <content>
              <p>required or permitted by this Act to be prescribed; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-12__para-b">
            <num>b</num>

              <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.</p>
              <p>If a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.</p>
