          <num>3</num>
          <heading>Simplified outline of this Act</heading>
          <content>
            <p>Generally, a registered training organisation must not issue a VET qualification or VET statement of attainment to an individual after 2014 unless the individual has a student identifier.</p>
            <p>Generally, a registered higher education provider must not confer a regulated higher education award on an individual after 2022 unless the individual has been assigned a student identifier.</p>
            <p>The Student Identifiers Registrar must assign a student identifier or a schools identifier to an individual on application. A schools identifier cannot be used as a student identifier until it is validated by <role refersTo="#registrar">the Registrar</role>.</p>
            <p>On request by an individual or by certain entities, <role refersTo="#registrar">the Registrar</role> may verify that an identifier is the individual’s student identifier or schools identifier, or give the individual’s student identifier or schools identifier.</p>
            <p><role refersTo="#registrar">The Registrar</role> may also, on request by certain entities, give information (called school identity management information) about a school student to the entity, or verify any such information held by the entity.</p>
            <p>Records of student identifiers, schools identifiers and school identity management information (together called protected information) must be protected from misuse. Collection, use and disclosure of an individual’s protected information without the individual’s consent is prohibited, unless it is authorised by this Act. The Information Commissioner may deal with a breach of these rules as an interference with privacy under the <i>Privacy Act 1988</i>.</p>
            <p>On request, <role refersTo="#registrar">the Registrar</role> may give all or part of an authenticated VET transcript of an individual who has a student identifier to the individual or a registered training organisation, VET-related body or other entity. However, access by such an organisation, body or entity is subject to access controls set by the individual.</p>
            <p>There are civil penalty provisions for certain conduct relating to:</p>

            <num>a</num>
            <content>
              <p>applying for student identifiers; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>altering an authenticated VET transcript or an extract from such a transcript; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>making a document purporting to be an authenticated VET transcript or an extract from such a transcript.</p>
            </content>
            <content>
              <p>Those civil penalty provisions are enforceable under the Regulatory Powers Act. Infringement notices may be given under that Act for contraventions of those civil penalty provisions.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Definitions</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><term refersTo="#term-access-controls">access controls</term> has the meaning given by <def>paragraph 32(1)(f).</def></p>
              <p><term refersTo="#term-account">Account</term> means <def>the Student Identifiers Special Account established by <ref href="#sec-48">section 48</ref>.</def></p>
              <p><term refersTo="#term-alternative-schooling-arrangement">alternative schooling arrangement</term> means <def>a schooling arrangement that is acceptable under a law of a State or Territory as an alternative to a requirement under that law to enrol at, or attend, a school.</def></p>
              <p><term refersTo="#term-approved-authority-for-a-school">approved authority for a school</term> has the same meaning as <def>in <ref href="">the Australian Education Act 2013</ref>.</def></p>

                <p><term refersTo="#term-commonwealth-minister">Commonwealth Minister</term> means <def>the Minister administering this Act.</def></p>
                <p><term refersTo="#term-corresponding-law-of-a-state-or-territory">corresponding law of a State or Territory</term> means <def>a law of a State or Territory that corresponds with <ref href="#dvs-5">Division 5</ref> of <ref href="#part-2">Part 2</ref> and the regulations made under <ref href="#sec-22">section 22</ref>.</def></p>
                <p><term refersTo="#term-education-department">Education Department</term> means <def>the Department administered by the Education Minister.</def></p>
                <p><term refersTo="#term-education-minister">Education Minister</term> means <def><ref class="unresolved">the Minister who administers the Tertiary Education Quality and Standards Agency Act 2011</ref>.</def></p>
                <p><b><i>Education Ministerial Council</i></b> means:</p>

            </paragraph>

              <num>a</num>

                <p>if there is a body (however described) that consists of <role refersTo="#minister">the Minister</role> of the Commonwealth, and <role refersTo="#minister">the Minister</role> of each State and Territory, who is responsible, or principally responsible, for matters relating to school education and higher education—that body; or</p>

                <p><term refersTo="#term-higher-education-tuition-protection-director">Higher Education Tuition Protection Director</term> has the same meaning as <def>in <ref href="">the Higher Education Support Act 2003</ref>.</def></p>
                <p><term refersTo="#term-identifier">identifier</term> means <def>a unique combination of any or all of the following: letters; numbers; symbols.</def></p>

                <p><b><i>Ministerial Council</i></b> means:</p>

                <p>if there is a body established by the Council of Australian Governments to deal with training and skills—that body; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">

                <p>otherwise—a body prescribed by the regulations.</p>
              </content>
              <content>
                <p><term refersTo="#term-misconduct">misconduct</term> includes <def>fraud, negligence, default, breach of trust, breach of duty, breach of discipline or any other misconduct in the course of duty.</def></p>
                <p><term refersTo="#term-personal-information">personal information</term> has the same meaning as <def>in <ref href="">the Privacy Act 1988</ref>.</def></p>
                <p><term refersTo="#term-prescribed-public-body-of-a-state-or-territory">prescribed public body of a State or Territory</term> means <def>a public body of a State or Territory prescribed by the regulations.</def></p>
                <p><b><i>protected information</i></b> of an individual means:</p>

            </paragraph>

              <num>a</num>
              <content>
                <p>a student identifier of the individual; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-b">

                <p>a schools identifier of the individual; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the individual’s school identity management information.</p>
              </content>
              <content>
                <p><b><i>public body </i></b>of a State or Territory means:</p>
              </content>
            </paragraph>

                <p>the Crown in right of the State or Territory; or</p>
              </content>
            </paragraph>

                <p>	(b)	a State or Territory authority (within the meaning of the <i>Privacy Act 1988</i>) of that State or Territory; or</p>

                <p><term refersTo="#term-registered-higher-education-provider">registered higher education provider</term> has the same meaning as <def>in <ref href="">the Tertiary Education Quality and Standards Agency Act 2011</ref>.</def></p>
                <p><term refersTo="#term-registered-training-organisation">registered training organisation</term> has the same meaning as <def>in <ref href="">the National Vocational Education and Training Regulator Act 2011</ref>.</def></p>
                <p><term refersTo="#term-registrar">Registrar</term> means <def>the Student Identifiers Registrar.</def></p>
                <p><term refersTo="#term-regulated-higher-education-award">regulated higher education award</term> has the same meaning as <def>in <ref href="">the Tertiary Education Quality and Standards Agency Act 2011</ref>.</def></p>
                <p><term refersTo="#term-regulatory-powers-act">Regulatory Powers Act</term> means <def>the Regulatory Powers (Standard Provisions) Act 2014.</def></p>
                <p><term refersTo="#term-school">school</term> means <def>a school, college or other educational institution that provides primary or secondary level education.</def></p>
                <p><b><i>school identity management information</i></b>, in relation to an individual, has the meaning prescribed by the regulations.</p>
                <p><term refersTo="#term-schools-identifier">schools identifier</term> means <def>an identifier assigned to an individual by the Registrar under <ref href="#sec-13B">section 13B</ref>.</def></p>
                <p><b><i>student identifier</i></b> means:</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an identifier assigned to an individual by <role refersTo="#registrar">the Registrar</role> under section 10 or paragraph 12(1)(b) or 13E(1)(c); or</p>

                <p><term refersTo="#term-teqsa-commissioner">TEQSA Commissioner</term> means <def>a Commissioner of the Tertiary Education Quality and Standards Agency.</def></p>
                <p><term refersTo="#term-tertiary-admission-centre">Tertiary Admission Centre</term> has the same meaning as <def>in <ref href="">the Tertiary Education Quality and Standards Agency Act 2011</ref>.</def></p>
                <p><term refersTo="#term-tps-director">TPS Director</term> means <def>the person holding office as <ref class="unresolved">the TPS Director under the Education Services for Overseas Students Act 2000</ref>.</def></p>
                <p><term refersTo="#term-tps-officer">TPS officer</term> has the same meaning as <def>in <ref href="">the Education Services for Overseas Students Act 2000</ref>.</def></p>
                <p><term refersTo="#term-vet">VET</term> means <def>vocational education and training.</def></p>
                <p><term refersTo="#term-vet-admission-body">VET admission body</term> means <def>an entity specified in an instrument under subsection (2).</def></p>
                <p><b><i>VET</i></b><b><i>-</i></b><b><i>related body</i></b> means:</p>

            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a Department of the Commonwealth, or a Department of a State or Territory, that deals with matters relating to VET (including the funding of VET); or</p>
              </content>

              <num>b</num>
              <content>
                <p>a body (whether incorporated or not) established by or under a law of the Commonwealth, a State or a Territory that performs functions relating to VET (including the funding of VET); or</p>

            </paragraph>
            <paragraph eId="part-1__sec-4__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>	(c)	a VET Regulator (within the meaning of the <i>National Vocational Education and Training Regulator Act 2011</i>); or</p>

                <p>an entity specified in an instrument under subsection (3).</p>

          </subsection>

              <p>	(2)	The Registrar may, by legislative instrument, specify an entity for the purposes of the definition of <b><i>VET admission body</i></b> in subsection (1).</p>

              <p>The Student Identifiers Registrar must assign a student identifier to an individual on application by or on behalf of the individual if <role refersTo="#registrar">the Registrar</role> is satisfied of the individual’s identity and that the individual does not already have a student identifier or schools identifier.</p>
              <p>Generally, anyone who collects personal information about an individual to apply for a student identifier for the individual must destroy the information as soon as practicable after it is no longer needed for that purpose.</p>
              <p><role refersTo="#registrar">The Registrar</role> must assign a schools identifier to an individual, on application on behalf of the individual, if the individual does not already have a student identifier or schools identifier. A schools identifier cannot be used as a student identifier until it is validated by <role refersTo="#registrar">the Registrar</role>.</p>
              <p>An individual may apply to <role refersTo="#registrar">the Registrar</role> for a schools identifier to be validated. <role refersTo="#registrar">The Registrar</role> must validate the schools identifier if the individual’s identity has been verified, the identifier is the individual’s schools identifier, and the individual does not already have a student identifier.</p>
              <p>On request by an individual or by certain entities, including entities involved with vocational education and training, higher education or school education, <role refersTo="#registrar">the Registrar</role> may verify that an identifier is the individual’s student identifier or schools identifier, or give the individual’s student identifier or schools identifier.</p>
              <p><role refersTo="#registrar">The Registrar</role> may also, on request by certain entities including entities involved with school education in a State or Territory, give information (called school identity management information) about a school student in that State or Territory to the entity, or verify any such information held by the entity.</p>
              <p>Anyone (including <role refersTo="#registrar">the Registrar</role>) who keeps a record of student identifiers, schools identifiers or school identity management information (together called protected information) must protect it from misuse and unauthorised access and disclosure.</p>
              <p>Collection, use and disclosure of an individual’s protected information without the individual’s consent is prohibited, unless it is authorised. This Part authorises collection, use and disclosure by <role refersTo="#registrar">the Registrar</role> for certain purposes or by others to deal with unlawful acts or to help law enforcement.</p>
              <p>The Information Commissioner may deal with breaches of the rules about destroying personal information, protecting records of protected information and unauthorised collection, use and disclosure of protected information as interferences with privacy under the <i>Privacy Act 1988</i>.</p>

                <p>An individual may apply to <role refersTo="#registrar">the Registrar</role> for a student identifier to be assigned to the individual.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-9__subsec-2">
              <num>2</num>
              <content>
                <p>The following entities may apply to <role refersTo="#registrar">the Registrar</role> for a student identifier to be assigned to an individual if authorised by the individual to make an application under this section:</p>

                <content>
                  <p>a registered training organisation;</p>
                </content>
              </paragraph>

                <p>The application must:</p>

                <num>a</num>
                <content>
                  <p>be made in a manner and form approved by <role refersTo="#registrar">the Registrar</role>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-9__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>include any information required by <role refersTo="#registrar">the Registrar</role>.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-9__subsec-4">
              <num>4</num>
              <content>
                <p>If <role refersTo="#registrar">the Registrar</role> is satisfied that the individual has already been assigned a schools identifier, the application is taken to be an application under section 13C for the schools identifier to be validated.</p>

            </subsection>

            <heading>Assignment of a student identifier by the Registrar</heading>
            <subsection eId="part-2__dvs-2__sec-10__subsec-1">
              <num>1</num>

                <p>If an application is made under <role refersTo="#registrar">the Registrar</role> must assign a student identifier to the individual if <role refersTo="#registrar">the Registrar</role> is satisfied that:<ref href="#sec-9">section 9</ref> in relation to an individual, </p>
              </content>

                <num>a</num>
                <content>
                  <p>the identity of the individual has been appropriately verified; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-1__para-b">

                <content>
                  <p>the individual has not already been assigned a student identifier or schools identifier.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-10__subsec-2">

                <p><role refersTo="#registrar">The Registrar</role> must give written notice of <role refersTo="#registrar">the Registrar</role>’s decision on the application to:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the applicant; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if the applicant is not the individual—the individual.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-10__subsec-3">
              <num>3</num>
              <content>
                <p>If <role refersTo="#registrar">the Registrar</role> assigns a student identifier to the individual, the notice given under subsection (2) must:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>set out the identifier; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>if the notice is given to the individual—explain the purposes and uses of the identifier.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-10__subsec-4">
              <num>4</num>
              <content>
                <p>If <role refersTo="#registrar">the Registrar</role> refuses to assign a student identifier to the individual, the notice given under subsection (2) must set out the reasons for the refusal.</p>
              </content>
            </subsection>
          </section>

            <heading>Destruction of personal information collected for the purpose of making an application</heading>
            <subsection eId="part-2__dvs-2__sec-11__subsec-1">
              <num>1</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>an entity is authorised by an individual to make an application under <ref href="#sec-9">section 9</ref>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the entity collects personal information about the individual for the purpose of making the application; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-11__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>some or all of the personal information is collected solely for the purpose of making the application;</p>
                </content>
                <content>
                  <p>the entity must destroy the personal information collected solely for that purpose as soon as practicable after the application is made or it is no longer needed for that purpose.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-11__subsec-2">
              <num>2</num>
              <content>
                <p>Subsection (1) does not apply if the entity is required by or under any law to retain the information.</p>
              </content>

            <heading>Registrar to resolve problems in relation to the assignment of student identifiers</heading>
            <subsection eId="part-2__dvs-2__sec-12__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> may do any of the following in order to resolve a problem that has occurred in relation to the assignment of one or more student identifiers to one or more individuals:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>revoke one or more of those student identifiers;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>assign a new student identifier to one or more of those individuals;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>assign a schools identifier to one or more of those individuals.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-12__subsec-2">
              <num>2</num>
              <content>
                <p>If <role refersTo="#registrar">the Registrar</role> does a thing mentioned in subsection (1) in relation to an individual, <role refersTo="#registrar">the Registrar</role> must give written notice of <role refersTo="#registrar">the Registrar</role>’s decision to:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the individual; and</p>
                </content>
              </paragraph>

                  <p>a VET-related body of a kind referred to in paragraph (a) of the definition of that expression in subsection 4(1); and</p>

                  <p><role refersTo="#secretary">the Secretary</role> of, or an APS employee in, the Education Department; and</p>

                  <p>any entity that has made an application under <ref href="#sec-13A">section 13A</ref> for a schools identifier to be assigned to the individual; and</p>

                <content>
                  <p>any other entity that <role refersTo="#registrar">the Registrar</role> considers appropriate in the circumstances.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-12__subsec-2A">
              <num>2A</num>
              <content>
                <p>However, <role refersTo="#registrar">the Registrar</role> is not required to give the notice under subsection (2) to the individual if:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-2A__para-a">
                <num>a</num>
                <content>
                  <p><role refersTo="#registrar">the Registrar</role>’s decision is to:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-2A__para-i">
                <num>i</num>
                <content>
                  <p>revoke a student identifier of the individual; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-2A__para-ii">
                <num>ii</num>
                <content>
                  <p>assign a schools identifier to the individual; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-2A__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#registrar">the Registrar</role> is satisfied that an entity covered by paragraph (2)(bb) will notify the individual of:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-2A__para-i">
                <num>i</num>
                <content>
                  <p><role refersTo="#registrar">the Registrar</role>’s decision; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-2A__para-ii">
                <num>ii</num>
                <content>
                  <p>if the decision is to revoke a student identifier of the individual—the revoked identifier; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-2A__para-iii">
                <num>iii</num>
                <content>
                  <p>if the decision is to assign a schools identifier to the individual—the schools identifier.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2__sec-12__subsec-3">
              <num>3</num>
              <content>
                <p>The notice given under subsection (2) must set out:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>if a student identifier of the individual has been revoked—the revoked identifier; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>if a new student identifier or a schools identifier has been assigned to the individual—that identifier.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-2__sec-13">
            <num>13</num>
            <heading>Review by the Administrative Review Tribunal</heading>
            <subsection eId="part-2__dvs-2__sec-13__subsec-1">
              <num>1</num>
              <content>
                <p>Applications may be made to the Administrative Review Tribunal by an individual for review of the following decisions of <role refersTo="#registrar">the Registrar</role>:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>a refusal to assign a student identifier to the individual under <ref href="#sec-10">section 10</ref>;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-13__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a decision under <ref href="#sec-12">section 12</ref> to revoke a student identifier of the individual or to assign an identifier to the individual.</p>
                </content>
              </paragraph>
            </subsection>

              <content>
                <p>	(2)	Subsection (1) has effect despite subsection 17(1) of the <i>Administrative Review Tribunal Act 2024</i>.</p>

          <heading>Assignment and validation of schools identifiers etc.</heading>

            <p>Subdivision A—Assignment of schools identifiers</p>
          </content>
          <section eId="part-2__dvs-2A__sec-13A">
            <num>13A</num>
            <heading>Application for assignment of a schools identifier</heading>
            <subsection eId="part-2__dvs-2A__sec-13A__subsec-1">
              <num>1</num>
              <content>
                <p>If an individual is enrolled in a school, the following entities may apply to <role refersTo="#registrar">the Registrar</role> for a schools identifier to be assigned to the individual:</p>
              </content>
              <paragraph eId="part-2__dvs-2A__sec-13A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the approved authority for the school;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>a prescribed public body of the State or Territory in which the school is located;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13A__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>an entity prescribed by the regulations.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2A__sec-13A__subsec-2">
              <num>2</num>
              <content>
                <p>If an individual registers an alternative schooling arrangement under a law of a State or Territory that provides for the registration of such arrangements, the following entities may apply to <role refersTo="#registrar">the Registrar</role> for a schools identifier to be assigned to the individual:</p>
              </content>
              <paragraph eId="part-2__dvs-2A__sec-13A__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>that State or Territory;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13A__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>an entity prescribed by the regulations.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2A__sec-13A__subsec-3">
              <num>3</num>
              <content>
                <p>The application must:</p>
              </content>
              <paragraph eId="part-2__dvs-2A__sec-13A__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>be made in a manner and form approved by <role refersTo="#registrar">the Registrar</role>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13A__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>include the individual’s school identity management information.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-2A__sec-13B">
            <num>13B</num>
            <heading>Assignment of a schools identifier by the Registrar</heading>
            <subsection eId="part-2__dvs-2A__sec-13B__subsec-1">
              <num>1</num>
              <content>
                <p>If an application is made under <role refersTo="#registrar">the Registrar</role> must assign a schools identifier to the individual if the individual has not already been assigned a student identifier or schools identifier.<ref href="#sec-13A">section 13A</ref> in relation to an individual, </p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2A__sec-13B__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> must give written notice of <role refersTo="#registrar">the Registrar</role>’s decision on the application to:</p>
              </content>
              <paragraph eId="part-2__dvs-2A__sec-13B__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the applicant; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13B__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the individual.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2A__sec-13B__subsec-3">
              <num>3</num>
              <content>
                <p>However, <role refersTo="#registrar">the Registrar</role> is not required to give the notice under subsection (2) to the individual if <role refersTo="#registrar">the Registrar</role> is satisfied that the applicant will:</p>
              </content>
              <paragraph eId="part-2__dvs-2A__sec-13B__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>notify the individual of <role refersTo="#registrar">the Registrar</role>’s decision; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13B__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>explain to the individual the purposes and uses of the identifier; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13B__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>if the decision is to refuse to assign the identifier to the individual—explain to the individual the reasons for the refusal.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2A__sec-13B__subsec-4">
              <num>4</num>
              <content>
                <p>If <role refersTo="#registrar">the Registrar</role> assigns a schools identifier to the individual, the notice given under subsection (2) must:</p>
              </content>
              <paragraph eId="part-2__dvs-2A__sec-13B__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>set out the identifier; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13B__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>if the notice is given to the individual—explain the purposes and uses of the identifier.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2A__sec-13B__subsec-5">
              <num>5</num>
              <content>
                <p>If <role refersTo="#registrar">the Registrar</role> refuses to assign a schools identifier to the individual, the notice given under subsection (2) must set out the reasons for the refusal.</p>
              </content>
              <content>
                <p>Subdivision B—Validation of schools identifiers</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-2A__sec-13C">
            <num>13C</num>
            <heading>Application for validation of schools identifier</heading>
            <subsection eId="part-2__dvs-2A__sec-13C__subsec-1">
              <num>1</num>
              <content>
                <p>An individual may apply to <role refersTo="#registrar">the Registrar</role> for a schools identifier of the individual to be validated.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2A__sec-13C__subsec-2">
              <num>2</num>
              <content>
                <p>The following entities may apply to <role refersTo="#registrar">the Registrar</role> for a schools identifier of an individual to be validated if authorised by the individual to make an application under this section:</p>
              </content>
              <paragraph eId="part-2__dvs-2A__sec-13C__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>a registered training organisation;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13C__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>a VET admission body;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13C__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>a registered higher education provider;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13C__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>a Tertiary Admission Centre;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13C__subsec-2__para-e">
                <num>e</num>
                <content>
                  <p>if the individual is enrolled in a school:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13C__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>the approved authority for the school; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13C__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>a prescribed public body of the State or Territory in which the school is located;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13C__subsec-2__para-f">
                <num>f</num>
                <content>
                  <p>another entity.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2A__sec-13C__subsec-3">
              <num>3</num>
              <content>
                <p>The application must:</p>
              </content>
              <paragraph eId="part-2__dvs-2A__sec-13C__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>be made in a manner and form approved by <role refersTo="#registrar">the Registrar</role>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13C__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>include any information required by <role refersTo="#registrar">the Registrar</role>.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-2A__sec-13D">
            <num>13D</num>
            <heading>Validation of schools identifier by the Registrar</heading>
            <subsection eId="part-2__dvs-2A__sec-13D__subsec-1">
              <num>1</num>
              <content>
                <p>If an application is made under <role refersTo="#registrar">the Registrar</role> must validate the identifier if:<ref href="#sec-13C">section 13C</ref> in relation to a schools identifier of an individual, </p>
              </content>
              <paragraph eId="part-2__dvs-2A__sec-13D__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the identity of the individual has been verified; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13D__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>the identifier is the schools identifier of the individual; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13D__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>the individual has not already been assigned a student identifier.</p>
                </content>

              <num>2</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> must give written notice of <role refersTo="#registrar">the Registrar</role>’s decision on the application to:</p>
              </content>
              <paragraph eId="part-2__dvs-2A__sec-13D__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the applicant; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13D__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>if the applicant is not the individual—the individual.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2A__sec-13D__subsec-3">
              <num>3</num>
              <content>
                <p>However, <role refersTo="#registrar">the Registrar</role> is not required to give the notice under subsection (2) to the individual if the contact details of the individual are not known to <role refersTo="#registrar">the Registrar</role>.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-2A__sec-13D__subsec-4">
              <num>4</num>
              <content>
                <p>If <role refersTo="#registrar">the Registrar</role> validates the individual’s schools identifier, the notice given under subsection (2) must:</p>
              </content>
              <paragraph eId="part-2__dvs-2A__sec-13D__subsec-4__para-a">
                <num>a</num>
                <content>
                  <p>set out the validated identifier; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13D__subsec-4__para-b">
                <num>b</num>
                <content>
                  <p>if the notice is given to the individual—explain the purposes and uses of a student identifier.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2A__sec-13D__subsec-5">
              <num>5</num>
              <content>
                <p>If <role refersTo="#registrar">the Registrar</role> refuses to validate the individual’s schools identifier, the notice given under subsection (2) must set out the reasons for the refusal.</p>
              </content>
              <content>
                <p>Subdivision C—Other matters for schools identifiers</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-2A__sec-13E">
            <num>13E</num>
            <heading>Registrar to resolve problems in relation to the assignment of schools identifiers</heading>
            <subsection eId="part-2__dvs-2A__sec-13E__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> may do any of the following in order to resolve a problem that has occurred in relation to the assignment of one or more schools identifiers to one or more individuals:</p>
              </content>
              <paragraph eId="part-2__dvs-2A__sec-13E__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>revoke one or more of those schools identifiers;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13E__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>assign a new schools identifier to one or more of those individuals;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13E__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>assign a student identifier to one or more of those individuals.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2A__sec-13E__subsec-2">
              <num>2</num>
              <content>
                <p>If <role refersTo="#registrar">the Registrar</role> does a thing mentioned in subsection (1) in relation to an individual, <role refersTo="#registrar">the Registrar</role> must give written notice of <role refersTo="#registrar">the Registrar</role>’s decision to:</p>
              </content>
              <paragraph eId="part-2__dvs-2A__sec-13E__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the individual; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13E__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>any entity that has made an application under <ref href="#sec-13A">section 13A</ref> for a schools identifier to be assigned to the individual.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2A__sec-13E__subsec-3">
              <num>3</num>
              <content>
                <p>However, <role refersTo="#registrar">the Registrar</role> is not required to give the notice under subsection (2) to the individual if <role refersTo="#registrar">the Registrar</role> is satisfied that an entity covered by paragraph (2)(b) will notify the individual of:</p>
              </content>
              <paragraph eId="part-2__dvs-2A__sec-13E__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p><role refersTo="#registrar">the Registrar</role>’s decision; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13E__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>if the decision is to revoke a schools identifier of the individual—the revoked identifier; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2A__sec-13E__subsec-3__para-c">
                <num>c</num>
                <content>
                  <p>if the decision is to assign a new schools identifier or a student identifier to the individual—that identifier.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2A__sec-13E__subsec-4">
              <num>4</num>
              <content>
                <p>The notice given under subsection (2) must set out:</p>
              </content>

                  <p>if a schools identifier of the individual has been revoked—the revoked identifier; and</p>

                  <p>a decision under <ref href="#sec-13E">section 13E</ref> to revoke a schools identifier of the individual or to assign an identifier to the individual.</p>

              <num>2</num>
              <content>

          <heading>Verification, giving and updating of identifiers and other information</heading>

            <heading>Request to verify or give an identifier</heading>
            <subsection eId="part-2__dvs-3__sec-14__subsec-1">
              <num>1</num>
              <content>
                <p>Any of the following entities may request <role refersTo="#registrar">the Registrar</role> to verify that an identifier is the student identifier or schools identifier of an individual, or to give the entity the student identifier or schools identifier of an individual:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-14__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the individual;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-14__subsec-1__para-b">

                  <p>a registered training organisation;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-14__subsec-1__para-c">

                  <p>a VET-related body;</p>

              <paragraph eId="part-2__dvs-3__sec-14__subsec-1__para-d">

                  <p>a VET admission body authorised by the individual to make a request under this section;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-14__subsec-1__para-e">
                <num>e</num>
                <content>
                  <p>a registered higher education provider;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-14__subsec-1__para-f">

              <paragraph eId="part-2__dvs-3__sec-14__subsec-1__para-r">

                  <p>if the individual is enrolled in a school:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-14__subsec-1__para-i">

                  <p>the approved authority for the school; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-14__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>a prescribed public body of the State or Territory in which the school is located;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-14__subsec-1__para-s">
                <num>s</num>
                <content>
                  <p>if the individual registers an alternative schooling arrangement under a law of a State or Territory that provides for the registration of such arrangements—that State or Territory;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-14__subsec-1__para-t">
                <num>t</num>
                <content>
                  <p>an entity prescribed by the regulations.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-14__subsec-2">
              <num>2</num>
              <content>
                <p>The request must:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-14__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>be made in a manner and form approved by <role refersTo="#registrar">the Registrar</role>; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-14__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>include any information required by <role refersTo="#registrar">the Registrar</role>.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-3__sec-15">
            <num>15</num>
            <heading>Verification or giving of an identifier</heading>
            <subsection eId="part-2__dvs-3__sec-15__subsec-1">
              <num>1</num>
              <content>
                <p>If a request is made under <role refersTo="#registrar">the Registrar</role> may, by written notice given to the entity that made the request, verify or give the student identifier or schools identifier (as the case requires) of the individual.<ref href="#sec-14">section 14</ref> in relation to an individual, </p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-3__sec-15__subsec-2">
              <num>2</num>
              <content>
                <p>If <role refersTo="#registrar">the Registrar</role> refuses to verify or give the student identifier or schools identifier (as the case requires), <role refersTo="#registrar">the Registrar</role> must give the entity that made the request written notice of the refusal and the reasons for the refusal.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-3__sec-15A">
            <num>15A</num>
            <heading>Request to verify or give certain information</heading>
            <subsection eId="part-2__dvs-3__sec-15A__subsec-1">
              <num>1</num>
              <content>
                <p>Any of the following entities may request <role refersTo="#registrar">the Registrar</role> to give the entity an individual’s school identity management information, or to verify any such information held by the entity:</p>
              </content>
              <paragraph eId="part-2__dvs-3__sec-15A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>if the individual is enrolled in a school:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-15A__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>the approved authority for the school; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-15A__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>a prescribed public body of the State or Territory in which the school is located;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-3__sec-15A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if the individual registers an alternative schooling arrangement under a law of a State or Territory that provides for the registration of such arrangements—that State or Territory;</p>

            <heading>Verification or giving of certain information</heading>
            <subsection eId="part-2__dvs-3__sec-15B__subsec-1">

                <p>If a request is made under <role refersTo="#registrar">the Registrar</role> may, by written notice given to the entity that made the request, verify or give the individual’s school identity management information.<ref href="#sec-15A">section 15A</ref> in relation to an individual, </p>

                <p>If <role refersTo="#registrar">the Registrar</role> refuses to verify or give the information, <role refersTo="#registrar">the Registrar</role> must give the entity that made the request written notice of the refusal and the reasons for the refusal.</p>

          <heading>Protection of records</heading>

            <heading>Records must be protected from misuse etc.</heading>
            <subsection eId="part-2__dvs-4__sec-16__subsec-1A">

                <p>This section applies in relation to a record of one or more of the following:</p>
              </content>
              <paragraph eId="part-2__dvs-4__sec-16__subsec-1A__para-a">
                <num>a</num>
                <content>
                  <p>student identifiers;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-16__subsec-1A__para-b">
                <num>b</num>
                <content>
                  <p>schools identifiers;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-16__subsec-1A__para-c">
                <num>c</num>
                <content>
                  <p>school identity management information.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-4__sec-16__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> must take reasonable steps to protect any such record kept by <role refersTo="#registrar">the Registrar</role>:</p>
              </content>
              <paragraph eId="part-2__dvs-4__sec-16__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>from misuse, interference and loss; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-16__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>from unauthorised access, modification or disclosure.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-4__sec-16__subsec-2">
              <num>2</num>
              <content>
                <p>If any other entity keeps such a record, the entity must take reasonable steps to protect the record:</p>
              </content>
              <paragraph eId="part-2__dvs-4__sec-16__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>from misuse, interference and loss; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-16__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>from unauthorised access, modification or disclosure.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-4__sec-16__subsec-3">

              <content>
                <p>Subsection (2) does not apply to an individual who keeps a record of the student identifier, schools identifier or school identity management information of the individual.</p>

              <p>An entity must not collect, use or disclose protected information of an individual if:</p>
            </content>

                <p>the entity is not the individual; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-5__sec-17__para-b">
              <num>b</num>

                <p>the collection, use or disclosure is not authorised under this Division.</p>

                <p><role refersTo="#registrar">The Registrar</role> is authorised to use or disclose a student identifier of an individual if the use or disclosure is for the purposes of research:</p>
              </content>
              <paragraph eId="part-2__dvs-5__sec-18__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>that relates (directly or indirectly) to VET, or that requires the use of student identifiers or information about VET; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-5__sec-18__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>that meets the requirements specified by the Ministerial Council.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-5__sec-18__subsec-3">
              <num>3</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> is authorised to use or disclose a student identifier of an individual if the use or disclosure is for the purposes of research:</p>
              </content>
              <paragraph eId="part-2__dvs-5__sec-18__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>that relates (directly or indirectly) to the provision of higher education; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-5__sec-18__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>that meets the requirements specified in an instrument under subsection (4).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-5__sec-18__subsec-4">
              <num>4</num>
              <content>
                <p>The Education Minister must, by legislative instrument, specify requirements for the purposes of paragraph (3)(b).</p>
              </content>
              <content>
                <p>Protected information and personal information</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-5__sec-18__subsec-5">
              <num>5</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> is authorised to use or disclose protected information of an individual if:</p>
              </content>
              <paragraph eId="part-2__dvs-5__sec-18__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>the use or disclosure is for the purposes of research:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-5__sec-18__subsec-5__para-i">
                <num>i</num>
                <content>
                  <p>that relates (directly or indirectly) to school education, or that requires the use of protected information or information about school education; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-5__sec-18__subsec-5__para-ii">
                <num>ii</num>
                <content>
                  <p>that meets the requirements specified by the Education Ministerial Council; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-5__sec-18__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>for a disclosure of information that is personal information—the disclosure meets the requirements specified in an instrument made under subsection (6).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-5__sec-18__subsec-6">
              <num>6</num>
              <content>
                <p>The Education Minister must, by legislative instrument and with the agreement of the Education Ministerial Council, specify requirements for the purposes of paragraph (5)(b).</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-5__sec-18__subsec-7">
              <num>7</num>
              <content>
                <p>	(7)	Despite subsection 14(2) of the <i>Legislation Act 2003</i>, an instrument made under subsection (6) of this section may make provision in relation to a matter by applying, adopting or incorporating, with or without modification, a matter contained in an instrument or other writing as in force or existing from time to time.</p>

            </subsection>
            <subsection eId="part-2__dvs-5__sec-18__subsec-8">

                <p>	(8)	Despite subsection 44(1) of the <i>Legislation Act 2003</i>, section 42 (disallowance) of that Act applies to an instrument made under subsection (6) of this section.</p>

            <num>18A</num>
            <heading>Collection, use or disclosure for administration of VET student loans</heading>
            <content>
              <p>A VET-related body, the VSL Tuition Protection Director or <role refersTo="#commissioner-of-taxation">the Commissioner of Taxation</role> is authorised to collect, use or disclose a student identifier of an individual if the collection, use or disclosure is reasonably necessary for the purposes of performing functions or exercising powers in relation to:</p>

              <num>a</num>
              <content>
                <p>	(a)	the <i>VET Student Loans Act 2016</i>; or</p>
              </content>
            </paragraph>

                <p>	(b)	any Act or instrument to the extent that it is included in the definition of <b><i>this Act</i></b> in the <i>VET Student Loans Act 2016</i>.</p>

            <heading>Collection, use or disclosure for purposes of higher education</heading>

                <p>A person referred to in subsection (2) is authorised to collect, use or disclose a student identifier of an individual if the collection, use or disclosure is reasonably necessary for the purposes of performing functions or exercising powers in relation to:</p>

                <num>a</num>
                <content>
                  <p>	(a)	the <i>Higher Education Support Act 2003</i>; or</p>
                </content>

                <content>
                  <p>	(a)	the <i>Higher Education Support Act 2003 </i>or <i>Tertiary Education Quality and Standards Agency Act 2011</i>; or</p>

              <paragraph eId="part-2__dvs-5__sec-18B__subsec-5__para-b">
                <num>b</num>

                  <p>any instrument made under that Act.</p>

            <heading>Collection, use or disclosure for purposes of education services for overseas students</heading>
            <subsection eId="part-2__dvs-5__sec-18C__subsec-1">
              <num>1</num>
              <content>
                <p>An entity referred to in subsection (2) is authorised to collect, use or disclose a student identifier of an individual if the collection, use or disclosure is reasonably necessary for the purposes of performing functions or exercising powers in relation to:</p>
              </content>
              <paragraph eId="part-2__dvs-5__sec-18C__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	the <i>Education Services for Overseas Students Act 2000</i>; or</p>
                </content>
              </paragraph>

                <num>b</num>
                <content>
                  <p>the TPS Director;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-5__sec-18C__subsec-2__para-c">
                <num>c</num>
                <content>
                  <p>a TPS officer;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-5__sec-18C__subsec-2__para-d">
                <num>d</num>
                <content>
                  <p>an ESOS agency for a provider or registered provider;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-5__sec-18C__subsec-2__para-e">
                <num>e</num>
                <content>
                  <p>an authorised officer of the ESOS agency for a registered provider.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-5__sec-18C__subsec-3">
              <num>3</num>
              <content>
                <p>A registered higher education provider is authorised to collect, use or disclose a student identifier of an individual if the collection, use or disclosure is reasonably necessary in connection with the operation of:</p>
              </content>
              <paragraph eId="part-2__dvs-5__sec-18C__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	the <i>Education Services for Overseas Students Act 2000</i>; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-5__sec-18C__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>any instrument made under that Act.</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-5__sec-18D">
            <num>18D</num>
            <heading>Collection, use or disclosure for purposes of school education</heading>
            <content>
              <p>An entity prescribed by the regulations is authorised to collect, use or disclose protected information of an individual if the collection, use or disclosure is for a purpose, or in circumstances:</p>
            </content>
            <paragraph eId="part-2__dvs-5__sec-18D__para-a">
              <num>a</num>
              <content>
                <p>relating to school education; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-5__sec-18D__para-b">
              <num>b</num>
              <content>
                <p>prescribed by the regulations.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-2__dvs-5__sec-19">
            <num>19</num>
            <heading>Collection, use or disclosure with the individual’s consent</heading>
            <subsection eId="part-2__dvs-5__sec-19__subsec-1">
              <num>1</num>
              <content>
                <p>An entity is authorised to collect, use or disclose protected information of an individual if the individual consents (expressly or impliedly) to the collection, use or disclosure.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-5__sec-19__subsec-2">
              <num>2</num>
              <content>
                <p>However, the individual cannot consent to the entity using the individual’s student identifier or schools identifier as the entity’s own identifier of the individual.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-5__sec-20">
            <num>20</num>
            <heading>Collection, use or disclosure relating to unlawful activities etc.</heading>
            <content>
              <p>An entity is authorised to collect, use or disclose a student identifier of an individual if:</p>
            </content>
            <paragraph eId="part-2__dvs-5__sec-20__para-a">
              <num>a</num>
              <content>
                <p>the entity has reason to suspect that unlawful activity, or misconduct of a serious nature, that relates to the entity’s functions or activities has been, is being or may be engaged in; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-5__sec-20__para-b">
              <num>b</num>
              <content>
                <p>the entity reasonably believes that the collection, use or disclosure is necessary in order for the entity to take appropriate action in relation to the matter.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-2__dvs-5__sec-21">
            <num>21</num>
            <heading>Collection, use or disclosure for law enforcement purposes etc.</heading>
            <content>
              <p>		An entity is authorised to collect, use or disclose a student identifier of an individual if the entity reasonably believes that the collection, use or disclosure is reasonably necessary for one or more of following things done by, or on behalf of, an enforcement body (within the meaning of the <i>Privacy Act 1988</i>):</p>
            </content>
            <paragraph eId="part-2__dvs-5__sec-21__para-a">
              <num>a</num>
              <content>
                <p>the prevention, detection, investigation, prosecution or punishment of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-5__sec-21__para-i">
              <num>i</num>
              <content>
                <p>criminal offences; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-5__sec-21__para-ii">
              <num>ii</num>
              <content>
                <p>breaches of a law imposing a penalty or sanction;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-5__sec-21__para-b">
              <num>b</num>
              <content>
                <p>the conduct of surveillance activities, intelligence gathering activities or monitoring activities;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-5__sec-21__para-c">
              <num>c</num>
              <content>
                <p>the conduct of protective or custodial activities;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-5__sec-21__para-d">
              <num>d</num>
              <content>
                <p>the enforcement of laws relating to the confiscation of the proceeds of crime;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-5__sec-21__para-e">
              <num>e</num>
              <content>
                <p>the protection of the public revenue;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-5__sec-21__para-f">
              <num>f</num>
              <content>
                <p>the prevention, detection, investigation or remedying of misconduct of a serious nature, or other conduct prescribed by the regulations;</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-5__sec-21__para-g">
              <num>g</num>
              <content>
                <p>the preparation for, or conduct of, proceedings before any court or tribunal, or the implementation of the orders of a court or tribunal.</p>
              </content>
            </paragraph>
          </section>
          <section eId="part-2__dvs-5__sec-22">
            <num>22</num>
            <heading>Collection, use or disclosure authorised by regulations</heading>
            <content>
              <p>An entity is authorised to collect, use or disclose a student identifier of an individual if the collection, use or disclosure is authorised by the regulations.</p>
            </content>
          </section>
        </division>

          <num>6</num>
          <heading>Interaction with the Privacy Act 1988</heading>
          <section eId="part-2__dvs-6__sec-23">
            <num>23</num>
            <heading>Contraventions that are interferences with the privacy of an individual</heading>
            <subsection eId="part-2__dvs-6__sec-23__subsec-1">
              <num>1</num>
              <content>
                <p>An act or practice that contravenes:</p>
              </content>
              <paragraph eId="part-2__dvs-6__sec-23__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p><ref href="#sec-11">section 11</ref> in relation to personal information about an individual; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-6__sec-23__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p><ref href="#sec-16">section 16</ref> or 17 in relation to protected information of an individual;</p>
                </content>
                <content>
                  <p>is taken, for the purposes of the <i>Privacy Act 1988</i>, to be an interference with the privacy of the individual (within the meaning of that Act).</p>
                </content>

            <subsection eId="part-2__dvs-6__sec-23__subsec-2">
              <num>2</num>
              <content>
                <p>If:</p>
              </content>
              <paragraph eId="part-2__dvs-6__sec-23__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	an act or practice of an entity that contravenes <i>Privacy Act 1988</i>; and<ref href="#sec-11">section 11</ref>, 16 or 17 is the subject of a complaint to, or an investigation by, the Information Commissioner under Part V of the </p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-6__sec-23__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>the entity is not an agency (within the meaning of that Act) or organisation (within the meaning of that Act);</p>
                </content>
                <content>
                  <p>the entity is taken, for the purposes of that Part and any other provision of that Act that relates to that Part, to be an organisation (within the meaning of that Act).</p>
                </content>
              </paragraph>
            </subsection>
          </section>
          <section eId="part-2__dvs-6__sec-24">
            <num>24</num>
            <heading>Additional functions of the Information Commissioner</heading>
            <subsection eId="part-2__dvs-6__sec-24__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	In addition to the Information Commissioner’s functions under the <i>Privacy Act 1988</i>, the Information Commissioner has the following functions:</p>
              </content>
              <paragraph eId="part-2__dvs-6__sec-24__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>to investigate an act or practice that may be an interference with the privacy of an individual under subsection 23(1) and, if <role refersTo="#information-commissioner">the Information Commissioner</role> considers it appropriate to do so, to attempt by conciliation to effect a settlement of the matters that gave rise to the investigation;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-6__sec-24__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>to conduct an assessment of whether <role refersTo="#registrar">the Registrar</role> is maintaining or handling protected information in accordance with the requirements of this Act;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-6__sec-24__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>to do anything incidental or conducive to the performance of those functions.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-6__sec-24__subsec-2">
              <num>2</num>
              <content>
                <p><role refersTo="#information-commissioner">The Information Commissioner</role> has power to do all things that are necessary or convenient to be done for or in connection with the performance of his or her functions under subsection (1).</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-6__sec-24__subsec-3">
              <num>3</num>
              <content>
                <p><role refersTo="#information-commissioner">The Information Commissioner</role> may conduct an assessment under paragraph (1)(b) in such manner as <role refersTo="#commissioner">the Commissioner</role> considers fit.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-6__sec-24__subsec-4">
              <num>4</num>
              <content>
                <p>	(4)	Section 56 (rather than <i>Privacy Act 1988</i>) applies in relation to the matters referred to in paragraph (1)(a) or (b) of this section in the same way as it applies to this Act.<ref href="#sec-12B">section 12B</ref> of the </p>
              </content>
            </subsection>
          </section>

            <num>25</num>
            <heading>Use or disclosure of personal information authorised for the purposes of the Privacy Act 1988</heading>
            <content>
              <p>Registrar’s functions or powers</p>
            </content>
            <subsection eId="part-2__dvs-6__sec-25__subsec-1">
              <num>1</num>
              <content>
                <p>	(1)	The use or disclosure by an entity of personal information about an individual is taken, for the purposes of the <i>Privacy Act 1988</i>, to be authorised by this Act if the use or disclosure is for the purposes of the Registrar performing his or her functions or exercising his or her powers.</p>
              </content>
              <content>
                <p>Research relating to vocational or higher education</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-6__sec-25__subsec-2">
              <num>2</num>
              <content>
                <p>	(2)	The use or disclosure by the Registrar of personal information about an individual is taken, for the purposes of the <i>Privacy Act 1988</i>, to be authorised by this Act if the use or disclosure is for the purposes of research:</p>
              </content>
              <paragraph eId="part-2__dvs-6__sec-25__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>that relates (directly or indirectly) to VET, or that requires the use of student identifiers or information about VET; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-6__sec-25__subsec-2__para-b">
                <num>b</num>
                <content>
                  <p>that meets the requirements specified by the Ministerial Council.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-6__sec-25__subsec-3">
              <num>3</num>
              <content>
                <p>	(3)	The use or disclosure by the Registrar of personal information about an individual is taken, for the purposes of the <i>Privacy Act 1988</i>, to be authorised by this Act if the use or disclosure is for the purposes of research:</p>
              </content>
              <paragraph eId="part-2__dvs-6__sec-25__subsec-3__para-a">
                <num>a</num>
                <content>
                  <p>that relates (directly or indirectly) to the provision of higher education; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-6__sec-25__subsec-3__para-b">
                <num>b</num>
                <content>
                  <p>that meets the requirements specified in an instrument under subsection (4).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-6__sec-25__subsec-4">
              <num>4</num>
              <content>
                <p>The Education Minister must, by legislative instrument, specify requirements for the purposes of paragraph (3)(b).</p>
              </content>
              <content>
                <p>Research relating to school education</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-6__sec-25__subsec-5">
              <num>5</num>
              <content>
                <p>	(5)	The use or disclosure by the Registrar of personal information about an individual is taken, for the purposes of the <i>Privacy Act 1988</i>, to be authorised by this Act if:</p>
              </content>
              <paragraph eId="part-2__dvs-6__sec-25__subsec-5__para-a">
                <num>a</num>
                <content>
                  <p>the use or disclosure is for the purposes of research:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-6__sec-25__subsec-5__para-i">
                <num>i</num>
                <content>
                  <p>that relates (directly or indirectly) to school education, or that requires the use of schools identifiers, school identity management information or information about school education; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-6__sec-25__subsec-5__para-ii">
                <num>ii</num>
                <content>
                  <p>that meets the requirements specified by the Education Ministerial Council; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-6__sec-25__subsec-5__para-b">
                <num>b</num>
                <content>
                  <p>for a disclosure of information that is personal information—the disclosure meets the requirements specified in an instrument made under subsection (6).</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-6__sec-25__subsec-6">
              <num>6</num>
              <content>
                <p>The Education Minister must, by legislative instrument and with the agreement of the Education Ministerial Council, specify requirements for the purposes of paragraph (5)(b).</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-6__sec-25__subsec-7">
              <num>7</num>
              <content>
                <p>	(7)	Despite subsection 14(2) of the <i>Legislation Act 2003</i>, an instrument made under subsection (6) of this section may make provision in relation to a matter by applying, adopting or incorporating, with or without modification, a matter contained in an instrument or other writing as in force or existing from time to time.</p>
              </content>
            </subsection>
            <subsection eId="part-2__dvs-6__sec-25__subsec-8">
              <num>8</num>
              <content>
                <p>	(8)	Despite subsection 44(1) of the <i>Legislation Act 2003</i>, section 42 (disallowance) of that Act applies to an instrument made under subsection (6) of this section.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-2__dvs-6__sec-25A">
            <num>25A</num>
            <heading>Registrar may refuse access to personal information</heading>
            <subsection eId="part-2__dvs-6__sec-25A__subsec-1">
              <num>1</num>
              <content>
                <p>If an individual makes a request for access to personal information about the individual held by <role refersTo="#registrar">the Registrar</role>, <role refersTo="#registrar">the Registrar</role> may refuse to give the individual access to the information if:</p>
              </content>
              <paragraph eId="part-2__dvs-6__sec-25A__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>the information is also held by any of the following entities:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-6__sec-25A__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>a school;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-6__sec-25A__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>an approved authority for a school;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-6__sec-25A__subsec-1__para-iii">
                <num>iii</num>
                <content>
                  <p>an entity prescribed by the regulations; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-6__sec-25A__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p><role refersTo="#registrar">the Registrar</role> considers that it is more appropriate for the request to be made to the entity.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-6__sec-25A__subsec-2">
              <num>2</num>
              <content>
                <p>The refusal is taken, for the purposes of paragraph 12.2(b) of Australian Privacy Principle 12, to be authorised by this Act.</p>
              </content>
            </subsection>

        <heading>Authenticated VET transcripts</heading>
        <section eId="part-3__sec-26">
          <num>26</num>
          <heading>Simplified outline of this Part</heading>
          <content>
            <p>An individual’s authenticated VET transcript is a document prepared by the Student Identifiers Registrar that sets out information that relates to vocational education and training undertaken by the individual and is prescribed by the regulations.</p>
            <p>On request, <role refersTo="#registrar">the Registrar</role> may give access to all or part of an authenticated VET transcript of an individual who has a student identifier to the individual or a registered training organisation, VET-related body or other entity. However, access by such an organisation, body or entity is subject to access controls set by the individual.</p>
          </content>
        </section>
        <section eId="part-3__sec-27">
          <num>27</num>
          <heading>Individual may be given access to an authenticated VET transcript etc.</heading>
          <subsection eId="part-3__sec-27__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#registrar">The Registrar</role> may, on request, give an individual who has been assigned a student identifier access to:</p>
            </content>
            <paragraph eId="part-3__sec-27__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an authenticated VET transcript of the individual; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-27__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an extract from an authenticated VET transcript of the individual.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-27__subsec-2">
            <num>2</num>
            <content>
              <p>The request must:</p>
            </content>
            <paragraph eId="part-3__sec-27__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>be made in a manner and form approved by <role refersTo="#registrar">the Registrar</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-27__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>include any information required by <role refersTo="#registrar">the Registrar</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-27__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>if the request is for an extract—specify the information to be excluded from the extract.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-27__subsec-3">
            <num>3</num>
            <content>
              <p>If <role refersTo="#registrar">the Registrar</role> refuses to give access under subsection (1), <role refersTo="#registrar">the Registrar</role> must give the individual written notice of the decision and the reasons for the decision.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-28">
          <num>28</num>
          <heading>Entities that may be given access to an authenticated VET transcript etc.</heading>
          <subsection eId="part-3__sec-28__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#registrar">The Registrar</role> may, on request, give a registered training organisation, VET-related body or other entity access to:</p>
            </content>
            <paragraph eId="part-3__sec-28__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>an authenticated VET transcript of an individual who has been assigned a student identifier; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-28__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>an extract from an authenticated VET transcript of an individual who has been assigned a student identifier;</p>
              </content>
              <content>
                <p>in accordance with the access controls set by the individual.</p>
              </content>

              <p>The request must:</p>
            </content>
            <paragraph eId="part-3__sec-28__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>be made in a manner and form approved by <role refersTo="#registrar">the Registrar</role>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-28__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>include any information required by <role refersTo="#registrar">the Registrar</role>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-28__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#registrar">The Registrar</role> must not give access under subsection (1) unless access controls have been set by the individual.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-28__subsec-4">
            <num>4</num>
            <content>
              <p>If <role refersTo="#registrar">the Registrar</role> refuses to give access under subsection (1), <role refersTo="#registrar">the Registrar</role> must give the registered training organisation, VET-related body or other entity written notice of the decision and the reasons for the decision.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-29">
          <num>29</num>
          <heading>Requirement relating to extracts from authenticated VET transcripts</heading>
          <subsection eId="part-3__sec-29__subsec-1">
            <num>1</num>
            <content>
              <p>If <role refersTo="#registrar">the Registrar</role> gives access to an extract from an authenticated VET transcript of an individual, the extract must include a statement that it is an extract.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-29__subsec-2">
            <num>2</num>
            <content>
              <p>Subsection (1) does not apply if:</p>
            </content>
            <paragraph eId="part-3__sec-29__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the only information not included in the extract is information of a kind prescribed by the regulations; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-29__subsec-2__para-b">
              <num>b</num>
              <content>

          <heading>Civil penalties—applications for student identifiers</heading>

                  <p>an individual has been assigned more than one identifier; or</p>

                  <p>during a vacancy in the office of Registrar (whether or not an appointment has previously been made to that office); or</p>

              </paragraph>

                  <p>during any period, or during all periods, when <role refersTo="#registrar">the Registrar</role>:</p>

                  <p>is absent from duty or from Australia; or</p>
                </content>

If no determination of that remuneration by the Tribunal is in operation, <role refersTo="#registrar">the Registrar</role> is to be paid the remuneration that is prescribed by the regulations.</p>

                <p>The Commonwealth Minister may grant to <role refersTo="#registrar">the Registrar</role> leave of absence, other than recreation leave, on the terms and conditions as to remuneration or otherwise that <role refersTo="#minister">the Minister</role> determines.</p>

            </subsection>
          </section>

            <heading>Outside employment</heading>
            <content>
              <p><role refersTo="#registrar">The Registrar</role> must not engage in paid employment outside the duties of his or her office without the Commonwealth Minister’s approval.</p>

            <num>40</num>
            <heading>Disclosure of interests</heading>
            <content>
              <p><role refersTo="#registrar">The Registrar</role> must give written notice to the Commonwealth Minister of all interests, pecuniary or otherwise, that <role refersTo="#registrar">the Registrar</role> has or acquires and that conflict or could conflict with the proper performance of <role refersTo="#registrar">the Registrar</role>’s functions.</p>
            </content>
          </section>
          <section eId="part-4__dvs-2__sec-41">
            <num>41</num>
            <heading>Other terms and conditions</heading>
            <content>
              <p><role refersTo="#registrar">The Registrar</role> holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by the Commonwealth Minister.</p>
            </content>
          </section>
          <section eId="part-4__dvs-2__sec-42">
            <num>42</num>
            <heading>Resignation</heading>
            <subsection eId="part-4__dvs-2__sec-42__subsec-1">
              <num>1</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> may resign his or her appointment by giving the Commonwealth Minister a written resignation.</p>
              </content>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-42__subsec-2">
              <num>2</num>
              <content>
                <p>The resignation takes effect on the day it is received by the Commonwealth Minister or, if a later day is specified in the resignation, on that later day.</p>
              </content>
            </subsection>
          </section>
          <section eId="part-4__dvs-2__sec-43">
            <num>43</num>
            <heading>Termination of appointment</heading>
            <subsection eId="part-4__dvs-2__sec-43__subsec-1">
              <num>1</num>
              <content>
                <p>The Commonwealth Minister may terminate the appointment of <role refersTo="#registrar">the Registrar</role>:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-43__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>for misbehaviour; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-43__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>if <role refersTo="#registrar">the Registrar</role> is unable to perform the duties of his or her office because of physical or mental incapacity.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-2__sec-43__subsec-2">
              <num>2</num>
              <content>
                <p>The Commonwealth Minister may terminate the appointment of <role refersTo="#registrar">the Registrar</role> if:</p>
              </content>
              <paragraph eId="part-4__dvs-2__sec-43__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p><role refersTo="#registrar">the Registrar</role>:</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-43__subsec-2__para-i">
                <num>i</num>
                <content>
                  <p>becomes bankrupt; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-43__subsec-2__para-ii">
                <num>ii</num>
                <content>
                  <p>takes steps to take the benefit of any law for the relief of bankrupt or insolvent debtors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-43__subsec-2__para-iii">
                <num>iii</num>
                <content>
                  <p>compounds with one or more of his or her creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-43__subsec-2__para-iv">
                <num>iv</num>
                <content>
                  <p>makes an assignment of his or her remuneration for the benefit of one or more of his or her creditors; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-2__sec-43__subsec-2__para-b">

                  <p><role refersTo="#registrar">the Registrar</role> is absent, except on leave of absence, for 14 consecutive days or for 28 days in any 12 months; or</p>

                  <p><role refersTo="#registrar">the Registrar</role> engages, except with <role refersTo="#minister">the Minister</role>’s approval, in paid employment outside the duties of his or her office (see section 39); or</p>

                <num>d</num>

                  <p><role refersTo="#registrar">the Registrar</role> fails, without reasonable excuse, to comply with section 40.</p>

                <p>If the Commonwealth Minister terminates the appointment of <role refersTo="#registrar">the Registrar</role>, <role refersTo="#minister">the Minister</role> must notify the Ministerial Council of the termination.</p>

                  <p>a person to whom an arrangement under <ref href="#sec-46">section 46</ref> relates.</p>

                <p><role refersTo="#registrar">The Registrar</role> may arrange with the appropriate authority of a State or Territory for the services of officers or employees of the following to be made available to assist <role refersTo="#registrar">the Registrar</role> in the performance of <role refersTo="#registrar">the Registrar</role>’s functions:</p>
              </content>
              <paragraph eId="part-4__dvs-3__sec-46__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>the Public Service of the State or Territory;</p>
                </content>
              </paragraph>
              <paragraph eId="part-4__dvs-3__sec-46__subsec-2__para-b">

                  <p>a body, whether incorporated or not, established by or under a law of the State or Territory.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-4__dvs-3__sec-46__subsec-3">

                <p>An arrangement under subsection (2) may provide for the Commonwealth to reimburse the appropriate authority of a State or Territory with respect to the services of a person to whom the arrangement relates.</p>

                <p>In assisting <role refersTo="#registrar">the Registrar</role> in the performance of <role refersTo="#registrar">the Registrar</role>’s functions, a person to whom an arrangement under subsection (1) or (2) relates is subject to the directions of <role refersTo="#registrar">the Registrar</role>.</p>

            </subsection>

            <heading>Consultants</heading>

                <p><role refersTo="#registrar">The Registrar</role> may, on behalf of the Commonwealth, engage consultants to assist in the performance of <role refersTo="#registrar">the Registrar</role>’s functions.</p>

              <num>2</num>
              <content>
                <p>The consultants are to be engaged on the terms and conditions that <role refersTo="#registrar">the Registrar</role> determines in writing.</p>
              </content>
            </subsection>

          <heading>Special Account</heading>

                <p>The Student Identifiers Special Account is established by this section.</p>

                <p>	(2)	The Account is a special account for the purposes of the <i>Public Governance, Performance and Accountability Act 2013</i>.</p>

              <p>There must be credited to the Account amounts equal to the following:</p>

                <p>amounts received by the Commonwealth in connection with the performance of <role refersTo="#registrar">the Registrar</role>’s functions;</p>

                <p>interest received by the Commonwealth from the investment of amounts debited from the Account;</p>

            </paragraph>

                <p>amounts of any gifts given or bequests made for the purposes of the Account.</p>
              </content>

                <p>reimbursing an appropriate authority of a State or Territory as mentioned in subsection 46(3);</p>

        <heading>Other matters</heading>

          <heading>Simplified outline of this Part</heading>
          <content>
            <p>Generally, a registered training organisation must not issue a VET qualification or VET statement of attainment to an individual after 2014 unless the individual has been assigned a student identifier. The Commonwealth Minister and <role refersTo="#registrar">the Registrar</role> can give exemptions.</p>
            <p>Generally, a registered higher education provider must not confer a regulated higher education award on an individual after 2022 unless the individual has been assigned a student identifier. The Education Minister and <role refersTo="#registrar">the Registrar</role> can give exemptions.</p>
            <p>The Commonwealth Minister may exempt a public body of a State or Territory from rules in this Act prohibiting unauthorised collection, use and disclosure of an individual’s protected information without the individual’s consent if:</p>

              <p><role refersTo="#minister">the Minister</role> is satisfied that equivalent State or Territory rules apply to the body; and</p>

              <p>a Minister of the State or Territory has asked for the exemption; and</p>
            </content>
          </paragraph>

              <p>if the body is a VET-related body—the Ministerial Council agrees to the exemption.</p>
            </content>
            <content>
              <p>This Act does not limit rights under other laws and does not limit State and Territory laws that can operate concurrently with this Act.</p>
              <p>This Part also contains other rules about the constitutional scope of this Act and about making regulations.</p>

          <heading>Issue of VET qualifications etc.</heading>

              <p>A registered training organisation must not issue either of the following to an individual unless the individual has been assigned a student identifier:</p>

              <content>
                <p>	(a)	a VET qualification (within the meaning of the <i>National Vocational Education and Training Regulator Act 2011</i>);</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>a VET statement of attainment (within the meaning of that Act).</p>
              </content>
              <content>
                <p>Exemptions given by Commonwealth Minister</p>

              <p>Subsection (1) does not apply to an issue specified under subsection (3).</p>

              <p>The Commonwealth Minister may, by legislative instrument, specify an issue to which subsection (1) does not apply, by reference to one or more of the following:</p>

                <p>the registered training organisation doing the issuing;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-53__subsec-3__para-b">

                <p>the VET qualification, or VET statement of attainment, being issued;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-53__subsec-3__para-c">

                <p>the individual to whom the VET qualification, or VET statement of attainment, is being issued.</p>

              <p>An individual may request <role refersTo="#registrar">the Registrar</role> to make a determination that subsection (1) does not apply in relation to the individual. The request must:</p>

                <p>be made in a manner and form approved by <role refersTo="#registrar">the Registrar</role>; and</p>
              </content>
            </paragraph>

              <content>
                <p>include any information required by <role refersTo="#registrar">the Registrar</role>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-53__subsec-6">

            <content>
              <p>If an individual makes a request under subsection (5), <role refersTo="#registrar">the Registrar</role> must, by writing, make, or refuse to make, the determination requested.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-53__subsec-7">
            <num>7</num>
            <content>
              <p><role refersTo="#registrar">The Registrar</role> must, in making a decision on the request, have regard to the matters (if any) determined in an instrument under subsection (9).</p>

          </subsection>

            <content>
              <p><role refersTo="#registrar">The Registrar</role> must give the individual notice of <role refersTo="#registrar">the Registrar</role>’s decision on the request. If <role refersTo="#registrar">the Registrar</role> refuses to make the determination requested, the notice must include reasons for the refusal.</p>

              <p>The Commonwealth Minister may, by legislative instrument, determine matters for the purposes of subsection (7).</p>

              <p>A registered higher education provider must not confer a regulated higher education award on an individual unless the individual has been assigned a student identifier.</p>

              <p>Subsection (1) does not apply to a conferral specified in an instrument under subsection (3).</p>

              <p>The Education Minister may, by legislative instrument, specify a conferral to which subsection (1) does not apply, by reference to one or more of the following:</p>

                <p>the registered higher education provider doing the conferring;</p>
              </content>
            </paragraph>

              </content>
            </paragraph>
            <paragraph eId="part-5__sec-53A__subsec-3__para-c">

                <p>the individual on whom the regulated higher education award is being conferred.</p>

              <p>An individual may request <role refersTo="#registrar">the Registrar</role> to make a determination that subsection (1) does not apply in relation to the individual. The request must:</p>

                <p>be made in a manner and form approved by <role refersTo="#registrar">the Registrar</role>; and</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>include any information required by <role refersTo="#registrar">the Registrar</role>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-53A__subsec-6">
            <num>6</num>
            <content>
              <p>If an individual makes a request under subsection (5), <role refersTo="#registrar">the Registrar</role> must, by writing, make, or refuse to make, the determination requested.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-53A__subsec-7">
            <num>7</num>
            <content>
              <p><role refersTo="#registrar">The Registrar</role> must, in making a decision on the request, have regard to the matters (if any) determined in an instrument under subsection (9).</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-53A__subsec-8">
            <num>8</num>
            <content>
              <p><role refersTo="#registrar">The Registrar</role> must give the person notice of <role refersTo="#registrar">the Registrar</role>’s decision on the request. If <role refersTo="#registrar">the Registrar</role> refuses to make the determination requested, the notice must include reasons for the refusal.</p>
            </content>
          </subsection>

            <num>9</num>
            <content>
              <p>The Education Minister may, by legislative instrument, determine matters for the purposes of subsection (7).</p>
            </content>
          </subsection>

              <p>An instrument under subsection (6) is not a legislative instrument.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-53A__subsec-11">

              <num>a</num>

                <p><role refersTo="#registrar">the Registrar</role>:</p>

                <p>assigns a student identifier to an individual; or</p>
              </content>
            </paragraph>

                <p>validates the schools identifier of an individual under <ref href="#sec-13D">section 13D</ref>; and</p>

          <heading>Saving of other laws and remedies</heading>
          <subsection eId="part-5__sec-54__subsec-1">
            <num>1</num>
            <content>
              <p>This Act is not intended to exclude or limit the operation of a law of a State or Territory that is capable of operating concurrently with this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-54__subsec-2">
            <num>2</num>
            <content>
              <p>Nothing in this Act limits, restricts or otherwise affects any right or remedy that a person would have had if this Act had not been enacted.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-55">
          <num>55</num>
          <heading>Disapplication of Division 5 of Part 2</heading>
          <subsection eId="part-5__sec-55__subsec-1">
            <num>1</num>
            <content>
              <p><ref href="#dvs-5">Division 5</ref> of <ref href="#part-2">Part 2</ref>, other than <ref href="#sec-17">section 17</ref> to the extent that it applies to schools identifiers and school identity management information, does not apply to a public body of a State or Territory if a declaration made under subsection (2) is in force in relation to the body.</p>
            </content>
          </subsection>
          <subsection eId="part-5__sec-55__subsec-2">
            <num>2</num>
            <content>
              <p>The Commonwealth Minister may, in writing, make a declaration under this subsection in relation to a public body of a State or Territory if:</p>
            </content>
            <paragraph eId="part-5__sec-55__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>a Minister of the State or Territory requests, by written notice, the Commonwealth Minister to make the declaration; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-55__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the Commonwealth Minister is satisfied that a corresponding law of a State or Territory is in force in the State or Territory and the law applies to the body; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-55__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>if the body is a VET-related body—the Ministerial Council agrees to the making of the declaration.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-55__subsec-3">
            <num>3</num>
            <content>
              <p>The Commonwealth Minister may, in writing, revoke a declaration made under subsection (2) in relation to a public body of a State or Territory if:</p>
            </content>

                <p>a Minister of the State or Territory requests, by written notice, the Commonwealth Minister to do so; or</p>
              </content>
            </paragraph>

                <p>both of the following apply:</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-55__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the Commonwealth Minister is satisfied that a corresponding law of a State or Territory is no longer in force in the State or Territory or no longer applies to the body;</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-55__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>if the body is a VET-related body—the Ministerial Council agrees to the revocation of the declaration.</p>
              </content>
            </paragraph>
          </subsection>

              <p>A declaration under subsection (2), and a revocation of a declaration under subsection (3), are legislative instruments.</p>

              <p>The Education Minister may, in writing, make a declaration under this subsection in relation to a public body of a State or Territory if the responsible Minister of the State or Territory requests, by written notice, the Education Minister to make the declaration.</p>

          </subsection>
          <subsection eId="part-5__sec-55A__subsec-3">
            <num>3</num>
            <content>
              <p>The Education Minister may, in writing, revoke a declaration made under subsection (2) in relation to a public body of a State or Territory if the responsible Minister of the State or Territory requests, by written notice, the Education Minister to do so.</p>

              <p>Without limiting its effect apart from each of the following subsections of this section, this Act also has effect as provided by that subsection.</p>

          </subsection>
          <subsection eId="part-5__sec-56__subsec-2">
            <num>2</num>
            <content>
              <p>This Act also has the effect it would have if its operation were expressly confined to matters:</p>
            </content>
            <paragraph eId="part-5__sec-56__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>in relation to which the Commonwealth is under an obligation under an international agreement, including Article 17 of the International Covenant on Civil and Political Rights, done at New York on <date date="1966-12-16">16 December 1966</date>; or</p>

              <num>b</num>

              <p>The Governor-General may make regulations prescribing matters:</p>

                <p>required or permitted by this Act to be prescribed; or</p>
