        <heading>Short title</heading>
        <content>
          <p>		This Act may be cited as the <i>Defence Legislation Amendment (Woomera Prohibited Area)</i> <i>Act 2014.</i></p>

        <heading>Commencement</heading>
        <content>
          <p>This Act commences on the day after this Act receives the Royal Assent.</p>
        </content>

        <heading>Schedule(s)</heading>
        <subsection eId="sec-3__subsec-1">
          <num>1</num>
          <content>
            <p>Each Act, and each set of regulations, that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>
          </content>
        </subsection>
        <subsection eId="sec-3__subsec-2">
          <num>2</num>
          <content>
            <p>The amendment of any regulation under subsection (1) does not prevent the regulation, as so amended, from being amended or repealed by the Governor-General.</p>

            <heading>Subsection 71A(1) (definition of defence premises)</heading>
            <content>
              <p>Repeal the definition, substitute:</p>
              <p><b><i>defence premises</i></b> means:</p>
            </content>
            <paragraph eId="schedule-1__clause-1__para-a">
              <num>a</num>
              <content>
                <p>any of the following that is in Australia, and is owned or occupied by the Commonwealth for use by the Defence Force or the Department:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-i">
              <num>i</num>
              <content>
                <p>an area of land or any other place (whether or not it is enclosed or built on);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-ii">
              <num>ii</num>
              <content>
                <p>a building or other structure;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-iii">
              <num>iii</num>
              <content>
                <p>a vehicle, vessel or aircraft, including any fixed or moveable ramp, stairs or other means of access to, or exit from, the vehicle, vessel or aircraft;</p>
              </content>
            </paragraph>

              <num>iv</num>
              <content>
                <p>	(iv)	a prohibited area, within the meaning of the <i>Defence (Special Undertakings) Act 1952</i>; or</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>the Woomera Prohibited Area.</p>
              </content>
            </paragraph>
          </hcontainer>

            <heading>Subsection 71A(1)</heading>
            <content>
              <p>Insert:</p>
              <p><b><i>Woomera Prohibited Area</i></b> means the area prescribed under subsection 72TA(1).</p>
            </content>

            <content>
              <p>Insert:</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-72T">
            <num>72T</num>
            <heading>Definitions</heading>
            <content>
              <p>In this Part:</p>
              <p><b><i>Aboriginal person </i></b>means a person of the Aboriginal race of Australia.</p>
              <p><b><i>acquisition of property</i></b> has the same meaning as in paragraph 51(xxxi) of the Constitution.</p>
              <p><b><i>Anangu Pitjantjatjara Yankunytjatjara lands</i></b> means the lands within the meaning of the <i>Anangu Pitjantjatjara Yankunytjatjara Land Rights Act 1981</i> (SA).</p>
              <p><b><i>Industry Minister </i></b>means the Minister administering the <i>Offshore Petroleum and Greenhouse Gas Storage Act 2006</i>.</p>
              <p><b><i>just terms</i></b> has the same meaning as in paragraph 51(xxxi) of the Constitution.</p>
              <p><b><i>Maralinga Tjarutja lands</i></b> means the lands within the meaning of the <i>Maralinga Tjarutja Land Rights Act 1984</i> (SA).</p>
              <p><b><i>Minister’s permission</i></b> means permission under section 72TF.</p>
              <p><b><i>pastoral lease</i></b> means a lease over land in the Woomera Prohibited Area held under the <i>Pastoral Land Management and Conservation Act 1989</i> (SA).</p>
              <p><b><i>permission</i></b> has the meaning given by subsection 72TC(3).</p>
              <p><b><i>permit</i></b> means a permit under the Rules.</p>
              <p><b><i>Rules</i></b> means the Woomera Prohibited Area Rules made under section 72TP.</p>
              <p><b><i>standing permission</i></b> means permission provided by the Rules under section 72TD.</p>
              <p><b><i>this Part</i></b> includes the Rules.</p>
              <p><b><i>traditional owner</i></b>:</p>
              <p><b><i>Woomera Prohibited Area</i></b> means the area prescribed under subsection 72TA(1).</p>

                <p>	(a)	in relation to the Maralinga Tjarutja lands, means a traditional owner within the meaning of the <i>Maralinga Tjarutja Land Rights Act 1984</i> (SA); and</p>

              <num>b</num>
              <content>
                <p>	(b)	in relation to the Anangu Pitjantjatjara Yankunytjatjara lands, means a traditional owner within the meaning of the <i>Anangu Pitjantjatjara Yankunytjatjara Land Rights Act 1981</i> (SA).</p>
              </content>

            <num>72TA</num>
            <heading>The Woomera Prohibited Area</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-72TA__subclause-1">
              <num>1</num>
              <content>
                <p>The Rules may prescribe an area as the Woomera Prohibited Area.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-72TA__subclause-2">
              <num>2</num>
              <content>
                <p>The area:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TA__para-a">
              <num>a</num>
              <content>
                <p>must be intended for use for the purposes of testing war materiel; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TA__para-b">
              <num>b</num>
              <content>
                <p>may be used for those purposes.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-72TA__subclause-3">
              <num>3</num>
              <content>
                <p>The Rules may, for the purposes of this Part:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TA__para-a">
              <num>a</num>
              <content>
                <p>prescribe zones within the Woomera Prohibited Area; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TA__para-b">
              <num>b</num>
              <content>
                <p>make provision for exclusion periods within those zones.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-72TB">
            <num>72TB</num>
            <heading>Application of this Part and Part VII of the Defence Force Regulations 1952</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-72TB__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	After the commencement of this Part, <i>Defence Force Regulations</i><i> </i><i>1952</i> applies only to the following:<ref href="#part-VI">Part VI</ref>I of the </p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TB__para-a">
              <num>a</num>
              <content>
                <p>	(a)	an Aboriginal person in the Woomera Prohibited Area exercising native title rights or rights under the <i>Native Title Act 1993</i>;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-b">
              <num>b</num>
              <content>
                <p>an Aboriginal person in the Woomera Prohibited Area:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-i">
              <num>i</num>
              <content>
                <p>	(i)	exercising rights under <i>Pastoral Land Management and Conservation Act 1989</i> (SA); or<ref href="#sec-47">section 47</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	exercising rights under the <i>Aboriginal Heritage Act 1988</i> (SA), or involved in the protection of sites, objects or remains protected under that Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-c">
              <num>c</num>
              <content>
                <p>a traditional owner in the Woomera Prohibited Area for purposes related to the Maralinga Tjarutja lands;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-d">
              <num>d</num>
              <content>
                <p>a traditional owner in the Woomera Prohibited Area for purposes related to the Anangu Pitjantjatjara Yankunytjatjara lands;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-e">
              <num>e</num>
              <content>
                <p>a person in the Woomera Prohibited Area who is employed or engaged by, or is acting for, or on behalf of, a person covered by paragraphs (a) to (d);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-f">
              <num>f</num>
              <content>
                <p>a person in the Woomera Prohibited Area who is accompanied by a person covered by paragraphs (a) to (e);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-g">
              <num>g</num>
              <content>
                <p>an Aboriginal person who:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-i">
              <num>i</num>
              <content>
                <p>has been invited onto the Maralinga Tjarutja lands or Anangu Pitjantjatjara Yankunytjatjara lands; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-ii">
              <num>ii</num>
              <content>
                <p>is in the Woomera Prohibited Area for purposes related to the invitation;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-h">
              <num>h</num>
              <content>
                <p>a person in the Woomera Prohibited Area who is acting for, or on behalf of, South Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-i">
              <num>i</num>
              <content>
                <p>a person in the Woomera Prohibited Area who is accompanied by a person covered by paragraph (h);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-j">
              <num>j</num>
              <content>
                <p>a person who:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-i">
              <num>i</num>
              <content>
                <p>holds a pastoral lease (whether the person’s interest in the lease was acquired before or after the commencement of this Part); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-ii">
              <num>ii</num>
              <content>
                <p>is in the Woomera Prohibited Area for purposes related to the lease;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-k">
              <num>k</num>
              <content>
                <p>a person who:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-i">
              <num>i</num>
              <content>
                <p>is employed or engaged by, or is acting for, or on behalf of, a person who holds a pastoral lease; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-ii">
              <num>ii</num>
              <content>
                <p>is in the Woomera Prohibited Area for purposes related to the lease;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-l">
              <num>l</num>
              <content>
                <p>a person in the Woomera Prohibited Area who is accompanied by a person covered by paragraph (j) or (k);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-m">
              <num>m</num>
              <content>
                <p>a person who:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-i">
              <num>i</num>
              <content>
                <p>is the owner or operator of the Tarcoola to Darwin railway; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-ii">
              <num>ii</num>
              <content>
                <p>is in the Woomera Prohibited Area for purposes related to the operation of the railway;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-n">
              <num>n</num>
              <content>
                <p>a person who:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-i">
              <num>i</num>
              <content>
                <p>is employed or engaged by, or is acting for, or on behalf of, a person who is the owner or operator of the Tarcoola to Darwin railway; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-ii">
              <num>ii</num>
              <content>
                <p>is in the Woomera Prohibited Area for purposes related to the operation of the railway;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-o">
              <num>o</num>
              <content>
                <p>a person in the Woomera Prohibited Area who is accompanied by a person covered by paragraph (m) or (n);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TB__para-p">
              <num>p</num>
              <content>
                <p>	(p)	a person who has authority for the purposes of <i>Defence Force Regulations</i><i> </i><i>1952</i> to be at a place in the Woomera Prohibited Area and the authority was given before the commencement of this Part.<ref href="#part-VI">Part VI</ref>I of the </p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-72TB__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	If <i>Defence Force Regulations</i><i> </i><i>1952</i> applies to the person, this Part does not apply to the person.<ref href="#part-VI">Part VI</ref>I of the </p>
              </content>
            </hcontainer>
            <content>
              <p>Effect of permit on existing authority</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-72TB__subclause-3">
              <num>3</num>
              <content>
                <p>Subsections (1) and (2) do not prevent a person from applying for a permit.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-72TB__subclause-4">
              <num>4</num>
              <content>
                <p>	(4)	Authority for the purposes of <i>Defence Force Regulations</i><i> </i><i>1952</i> for a person to be at a place in the Woomera Prohibited Area is revoked to the extent that a permit provides (or provided) permission for the person to be at the place.<ref href="#part-VI">Part VI</ref>I of the </p>

            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-72TC">
            <num>72TC</num>
            <heading>Offence—being in the Woomera Prohibited Area without permission</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-72TC__subclause-1">
              <num>1</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TC__para-a">
              <num>a</num>
              <content>
                <p>the person is not:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TC__para-i">
              <num>i</num>
              <content>
                <p>a member of the Defence Force; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TC__para-ii">
              <num>ii</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role>; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TC__para-iii">
              <num>iii</num>
              <content>
                <p>an APS employee in the Department; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TC__para-b">
              <num>b</num>
              <content>
                <p>the person is at a place in the Woomera Prohibited Area.</p>
              </content>
            </paragraph>
            <content>
              <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 2 years</quantity> or <quantity refersTo="#penaltyUnit">120 penalty units</quantity>, or both.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-72TC__subclause-2">
              <num>2</num>
              <content>
                <p>Subsection (1) does not apply if the person has permission to be at the place.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-72TC__subclause-3">
              <num>3</num>
              <content>
                <p>	(3)	The person has <b><i>permission</i></b> to be at the place if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TC__para-a">
              <num>a</num>
              <content>
                <p>a standing permission provides permission for the person to be at the place; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TC__para-b">
              <num>b</num>
              <content>
                <p>a permit provides permission for the person to be at the place; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TC__para-c">
              <num>c</num>
              <content>
                <p>the person has <role refersTo="#minister">the Minister</role>’s permission to be at the place.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-72TD">
            <num>72TD</num>
            <heading>Standing permission</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-72TD__subclause-1">
              <num>1</num>
              <content>
                <p>The Rules may provide permission for a person to be at a place in the Woomera Prohibited Area.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-72TD__subclause-2">
              <num>2</num>
              <content>
                <p>The permission may be subject to conditions set out in the Rules.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-72TD__subclause-3">
              <num>3</num>
              <content>
                <p>The Rules may make provision for, and in relation to, other matters in relation to standing permission.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-72TE">
            <num>72TE</num>
            <heading>Permits</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-72TE__subclause-1">
              <num>1</num>
              <content>
                <p>The Rules may make provision for, and in relation to, permits that provide permission for persons to be at places in the Woomera Prohibited Area.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-72TE__subclause-2">
              <num>2</num>
              <content>
                <p>The Rules may make provision in relation to the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TE__para-a">
              <num>a</num>
              <content>
                <p>the purposes for which permits may be issued;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TE__para-b">
              <num>b</num>
              <content>
                <p>applying for permits;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TE__para-c">
              <num>c</num>
              <content>
                <p>issuing and renewing permits;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TE__para-d">
              <num>d</num>
              <content>
                <p>suspending and cancelling permits;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TE__para-e">
              <num>e</num>
              <content>
                <p>conditions to which permits are subject.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-72TE__subclause-3">
              <num>3</num>
              <content>
                <p>Subsection (2) does not limit subsection (1).</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-72TF">
            <num>72TF</num>
            <heading>Minister’s permission</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-72TF__subclause-1">
              <num>1</num>

                <p><role refersTo="#minister">The Minister</role> may, on request, give written permission for a person to be at a place in the Woomera Prohibited Area.</p>

                <p>The permission must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TF__para-a">
              <num>a</num>
              <content>
                <p>specify the person by name; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TF__para-b">
              <num>b</num>
              <content>
                <p>be given in accordance with any requirements set out in the Rules.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-72TF__subclause-3">
              <num>3</num>
              <content>
                <p>The permission may be subject to one or more of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TF__para-a">
              <num>a</num>
              <content>
                <p>conditions imposed by <role refersTo="#minister">the Minister</role> and set out in the permission;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TF__para-b">
              <num>b</num>
              <content>
                <p>conditions set out in the Rules.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-72TF__subclause-4">
              <num>4</num>
              <content>
                <p>The Rules may make provision for, and in relation to, other matters in relation to Minister’s permission.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-72TG">
            <num>72TG</num>
            <heading>Offence—failing to comply with conditions</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-72TG__subclause-1">
              <num>1</num>
              <content>
                <p>A person commits an offence if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TG__para-a">
              <num>a</num>
              <content>
                <p>the person has permission to be at a place in the Woomera Prohibited Area; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TG__para-b">
              <num>b</num>
              <content>
                <p>the person does, or refuses or fails to do, an act or thing; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TG__para-c">
              <num>c</num>
              <content>
                <p>doing, or refusing or failing to do, the act or thing results in a failure to comply with a condition of the permission.</p>
              </content>
            </paragraph>
            <content>
              <p>Penalty:	<quantity refersTo="#penaltyUnit">60 penalty units</quantity>.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-72TG__subclause-2">
              <num>2</num>
              <content>
                <p>Subsection (1) is an offence of strict liability.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-72TH">
            <num>72TH</num>
            <heading>Minister may suspend permission</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-72TH__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may suspend a permission if <role refersTo="#minister">the Minister</role> considers it necessary for the purposes of the defence of Australia.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-72TH__subclause-2">
              <num>2</num>
              <content>
                <p>The suspension must be:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TH__para-a">
              <num>a</num>
              <content>
                <p>in writing; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TH__para-b">
              <num>b</num>
              <content>
                <p>in accordance with any requirements set out in the Rules.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-72TH__subclause-3">
              <num>3</num>
              <content>
                <p>A suspension under subsection (1) is not a legislative instrument.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-72TJ">
            <num>72TJ</num>
            <heading>Minister may give directions</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-72TJ__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may direct a person to do, or not to do, one or more specified acts or things in relation to the Woomera Prohibited Area if <role refersTo="#minister">the Minister</role> considers it necessary:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TJ__para-a">
              <num>a</num>
              <content>
                <p>for the purposes of the defence of Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TJ__para-b">
              <num>b</num>
              <content>
                <p>to protect human life.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-72TJ__subclause-2">
              <num>2</num>
              <content>
                <p>The direction may include one or more of the following:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TJ__para-a">
              <num>a</num>
              <content>
                <p>a direction to leave a place or an area;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TJ__para-b">
              <num>b</num>
              <content>
                <p>a direction to move, or remove, property or livestock;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TJ__para-c">
              <num>c</num>
              <content>
                <p>a direction to secure buildings.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-72TJ__subclause-3">
              <num>3</num>
              <content>
                <p>Subsection (2) does not limit subsection (1).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-72TJ__subclause-4">
              <num>4</num>
              <content>
                <p>A direction made in writing under subsection (1) is not a legislative instrument.</p>
              </content>
            </hcontainer>
            <content>
              <p>Offence—failing to comply with direction</p>
              <p>Penalty:	Imprisonment for 5 years or 300 penalty units, or both<i>.</i></p>
            </content>

                <p>A person commits an offence if:</p>
              </content>

                <p>the person is given a direction under subsection (1); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TJ__para-b">
              <num>b</num>
              <content>
                <p>the person refuses or fails to comply with the direction.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-72TK">
            <num>72TK</num>
            <heading>Compensation for acquisition of property</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-72TK__subclause-1">
              <num>1</num>
              <content>
                <p>If the operation of this Part would result in an acquisition of property from a person otherwise than on just terms, the Commonwealth is liable to pay a reasonable amount of compensation to the person.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-72TK__subclause-2">
              <num>2</num>
              <content>
                <p>If the Commonwealth and the person do not agree on the amount of the compensation, the person may institute proceedings in a court of competent jurisdiction for the recovery from the Commonwealth of such reasonable amount of compensation as the court determines.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-72TL">
            <num>72TL</num>
            <heading>Compensation for loss or damage</heading>
            <content>
              <p>The Rules may limit amounts payable by the Commonwealth in respect of loss or damage in the Woomera Prohibited Area arising from a breach of a common law or statutory duty of care in relation to the use of the Woomera Prohibited Area for the purposes of testing war materiel.</p>
            </content>
          </hcontainer>

            <num>72TM</num>
            <heading>Review of decisions</heading>
            <content>
              <p>Internal review</p>
              <p>AAT review</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-72TM__subclause-1">
              <num>1</num>
              <content>
                <p>A person whose interests are affected by any of the following decisions may, by writing, apply to <role refersTo="#minister">the Minister</role> for a review of the decision:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TM__para-a">
              <num>a</num>
              <content>
                <p>a decision under <ref href="#sec-72T">section 72T</ref>F to give, or not to give, written permission for a person to be at a place in the Woomera Prohibited Area;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TM__para-b">
              <num>b</num>
              <content>
                <p>a decision to suspend a permission under <ref href="#sec-72T">section 72T</ref>H;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TM__para-c">
              <num>c</num>
              <content>
                <p>a decision to give a direction under <ref href="#sec-72T">section 72T</ref>J.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-72TM__subclause-2">
              <num>2</num>
              <content>
                <p>On application for review of the decision, <role refersTo="#minister">the Minister</role> must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TM__para-a">
              <num>a</num>
              <content>
                <p>review the decision; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TM__para-b">
              <num>b</num>
              <content>
                <p>confirm, vary or revoke the decision.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-72TM__subclause-3">
              <num>3</num>
              <content>
                <p>Within 20 business days after receiving the application, <role refersTo="#minister">the Minister</role> must give the person written notice of the decision on the review.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-72TM__subclause-4">
              <num>4</num>
              <content>
                <p>Applications may be made to the Administrative Appeals Tribunal for review of decisions of <role refersTo="#minister">the Minister</role> on the review of a decision under section 72TF to give, or not to give, written permission for a person to be at a place in the Woomera Prohibited Area.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-72TM__subclause-5">
              <num>5</num>
              <content>
                <p>To avoid doubt, a decision under <role refersTo="#minister">the Minister</role>.<ref href="#sec-72T">section 72T</ref>F to give written permission for a person to be at a place in the Woomera Prohibited Area includes a decision to give such permission subject to conditions imposed by </p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-72TN">
            <num>72TN</num>
            <heading>Delegation</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-72TN__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role>, by writing, may delegate his or her power under section 72TF (Minister’s permission) to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TN__para-a">
              <num>a</num>
              <content>
                <p>an APS employee who holds or performs the duties of an APS 6 position, or an equivalent or higher position, in the Department; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TN__para-b">
              <num>b</num>
              <content>
                <p>an officer of the Navy who holds the rank of Commander or a higher rank; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TN__para-c">
              <num>c</num>
              <content>
                <p>an officer of the Army who holds the rank of Lieutenant- Colonel or a higher rank; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TN__para-d">
              <num>d</num>
              <content>
                <p>an officer of the Air Force who holds the rank of Wing Commander or a higher rank.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-72TN__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role>, by writing, may delegate his or her power under paragraph 72TJ(1)(b) (direction to protect human life) to:</p>
              </content>

            <paragraph eId="schedule-1__clause-72TN__para-a">
              <num>a</num>
              <content>
                <p>an APS employee who holds or performs the duties of an Executive Level 2 position, or an equivalent or higher position, in the Department; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TN__para-b">
              <num>b</num>
              <content>
                <p>an officer of the Navy who holds the rank of Captain or a higher rank; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TN__para-c">
              <num>c</num>
              <content>
                <p>an officer of the Army who holds the rank of Colonel or a higher rank; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TN__para-d">

                <p>an officer of the Air Force who holds the rank of Group Captain or a higher rank.</p>

            </paragraph>

                <p><role refersTo="#minister">The Minister</role>, by writing, may delegate his or her power under section 72TM to review the following decisions to an APS employee who holds or performs the duties of an SES Band 2 position, or an equivalent or higher position, in the Department:</p>

              <num>a</num>
              <content>
                <p>a decision under <ref href="#sec-72T">section 72T</ref>F to give, or not to give, written permission for a person to be at a place in the Woomera Prohibited Area;</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-72TN__para-b">
              <num>b</num>
              <content>
                <p>a decision to give a direction under paragraph 72TJ(1)(b) (direction to protect human life).</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-72TP">
            <num>72TP</num>
            <heading>The Woomera Prohibited Area Rules</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-72TP__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument and with the agreement of the Industry Minister, make Woomera Prohibited Area Rules prescribing matters:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TP__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Part to be prescribed by the Rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TP__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Part.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-72TP__subclause-2">
              <num>2</num>
              <content>
                <p>Without limiting subsection (1), the Rules may:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-72TP__para-a">
              <num>a</num>
              <content>
                <p>prescribe fees for doing any act or providing any service for the purposes of this Part and prescribe the circumstances and ways in which fees can be refunded, waived or reduced; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-72TP__para-b">
              <num>b</num>
              <content>
                <p>make provision for, and in relation to, the review of decisions made under this Part or the Rules.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-72TP__subclause-3">
              <num>3</num>
              <content>
                <p>A fee prescribed under paragraph (2)(a) must not be such as to amount to taxation.</p>
              </content>
            </hcontainer>

                <p>The Rules may provide for a person who is alleged to have committed an offence against subsection 72TG(1) to pay a penalty to the Commonwealth as an alternative to prosecution.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-72TP__subclause-5">
              <num>5</num>
              <content>
                <p>The penalty must not exceed one-fifth of the maximum fine that a court could impose on the person as a penalty for that offence.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-72TP__subclause-6">
              <num>6</num>
              <content>
                <p>The Rules may establish a demerit points system under which a permit may be suspended or cancelled if the holder of the permit accrues a prescribed number of demerit points.</p>
              </content>
            </hcontainer>
          </hcontainer>

            <num>4</num>

            <heading>Validation of declaration and past acts in relation to the Woomera Prohibited Area</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-121A__subclause-1">
              <num>1</num>
              <content>
                <p>This section applies in relation to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-121A__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the declaration of the Woomera Prohibited Area under regulation 35 of the <i>Defence Force Regulations</i><i> </i><i>1952 </i>by notice published in the Gazette on 12 July 1989; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-121A__para-b">
              <num>b</num>
              <content>
                <p>	(b)	things done (the <b><i>past acts</i></b>) by the Commonwealth under regulation 35 of the <i>Defence Force Regulations</i><i> </i><i>1952</i> as a result of the declaration.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-121A__subclause-2">
              <num>2</num>
              <content>
                <p>The declaration and past acts are taken always to have been valid.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-121A__subclause-3">
              <num>3</num>
              <content>
                <p>	(3)	To the extent that<b>, </b>apart from subsection (2) and this subsection, the declaration and past acts would be invalid because they would result in an acquisition of property (within the meaning of paragraph 51(xxxi) of the Constitution) from a person otherwise than on just terms (within the meaning of that paragraph), the Commonwealth is liable to pay a reasonable amount of compensation to the person.</p>

              <num>4</num>
