          <p>		This Act may be cited as the <i>Crimes Legislation Amendment (Psychoactive Substances and Other Measures)</i><i> Act 201</i><i>5</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

            <heading>After Part 9.1 of the Criminal Code</heading>
            <content>
              <p>Insert:</p>
              <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 5 years</quantity>, or <quantity refersTo="#penaltyUnit">300 penalty units</quantity>, or both.</p>
              <p>Note:	A defendant bears an evidential burden in relation to the matters in this subsection (see subsection 13.3(3)).</p>
              <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 2 years</quantity>, or <quantity refersTo="#penaltyUnit">120 penalty units</quantity>, or both.</p>
              <p>Note:	A defendant bears an evidential burden in relation to the matters in this subsection (see subsection 13.3(3)).</p>

              <heading>Definitions</heading>
              <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-320-1__subclause-1">
                <num>1</num>
                <content>
                  <p>In this Part:</p>
                </content>
              </hcontainer>
              <content>
                <p><b><i>consume</i></b>, in relation to a substance, includes:</p>
                <p><b><i>psychoactive effect</i></b>, in relation to a person, means:</p>
                <p><b><i>psychoactive substance</i></b> means any substance that, when a person consumes it, has the capacity to induce a psychoactive effect.</p>
                <p><b><i>serious drug alternative</i></b> means a substance that:</p>
              </content>
              <paragraph eId="schedule-1__clause-1__subclause-320-1__para-a">
                <num>a</num>
                <content>
                  <p>ingest the substance; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-1__para-b">
                <num>b</num>
                <content>
                  <p>inject the substance; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-1__para-c">
                <num>c</num>
                <content>
                  <p>inhale the substance; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-1__para-d">
                <num>d</num>
                <content>
                  <p>smoke the substance, or inhale fumes caused by heating or burning the substance; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-1__para-e">
                <num>e</num>
                <content>
                  <p>apply the substance externally to the body of a person; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-1__para-f">
                <num>f</num>
                <content>
                  <p>by any other means introduce the substance into any part of the body of a person.</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-1__para-a">
                <num>a</num>
                <content>
                  <p>stimulation or depression of the person’s central nervous system, resulting in hallucinations or in a significant disturbance in, or significant change to, motor function, thinking, behaviour, perception, awareness or mood; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-1__para-b">
                <num>b</num>
                <content>
                  <p>causing a state of dependence, including physical or psychological addiction.</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-1__para-a">
                <num>a</num>
                <content>
                  <p>has a psychoactive effect that is the same as, or is substantially similar to, the psychoactive effect of a serious drug; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-1__para-b">
                <num>b</num>
                <content>
                  <p>is a lawful alternative to a serious drug.</p>
                </content>
              </paragraph>

                <num>2</num>
                <content>
                  <p>Expressions used in this Part that are defined for the purposes of <ref href="#part-9">Part 9</ref>.1 have the same meaning as in that Part.</p>
                </content>
              </hcontainer>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-320-2">
              <num>320.2</num>
              <heading>Importing psychoactive substances</heading>
              <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-320-2__subclause-1">
                <num>1</num>
                <content>
                  <p>A person commits an offence if:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-a">
                <num>a</num>
                <content>
                  <p>the person imports a substance; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-b">
                <num>b</num>
                <content>
                  <p>the substance is a psychoactive substance.</p>
                </content>
              </paragraph>
              <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-320-2__subclause-2">
                <num>2</num>
                <content>
                  <p>Subject to subsection (3), this section does not apply to a substance if it is:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	food (within the meaning of the <i>Food Standards Australia New Zealand Act 1991</i>) for which:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-i">
                <num>i</num>
                <content>
                  <p>there is a standard (within the meaning of that Act); or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-ii">
                <num>ii</num>
                <content>
                  <p>in the form in which the substance is presented, there is a tradition in Australia and New Zealand of using the substance as food for humans; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-b">
                <num>b</num>
                <content>
                  <p>	(b)	a tobacco product (<i>Tobacco Advertising Prohibition Act 1992</i>); or<ref href="#sec-8">within the meaning of section 8</ref> of the </p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-c">
                <num>c</num>
                <content>
                  <p>	(c)	goods that are listed goods, or registered goods, within the meaning of the <i>Therapeutic Goods Act 1989</i>; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-d">
                <num>d</num>
                <content>
                  <p>goods that are represented in any way to be:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-i">
                <num>i</num>
                <content>
                  <p>for therapeutic use (within the meaning of that Act); or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-ii">
                <num>ii</num>
                <content>
                  <p>for use as an ingredient or component in the manufacture of therapeutic goods (within the meaning of that Act);</p>
                </content>
              </paragraph>
              <content>
                <p>other than goods that are represented as a serious drug alternative; or</p>
              </content>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-e">
                <num>e</num>
                <content>
                  <p>therapeutic goods that are:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-i">
                <num>i</num>
                <content>
                  <p>exempt goods (within the meaning of that Act); or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-ii">
                <num>ii</num>
                <content>
                  <p>exempt under <ref href="#sec-18A">section 18A</ref> of that Act; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-iii">
                <num>iii</num>
                <content>
                  <p>the subject of an approval or authority under <ref href="#sec-19">section 19</ref> of that Act; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-iv">
                <num>iv</num>
                <content>
                  <p>the subject of an approval under <ref href="#sec-19A">section 19A</ref> of that Act; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-f">
                <num>f</num>
                <content>
                  <p>a substance or mixture of substances:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-i">
                <num>i</num>
                <content>
                  <p>	(i)	that is an agricultural chemical product (within the meaning of the Agricultural and Veterinary Chemicals Code set out in the Schedule to the <i>Agricultural and Veterinary Chemicals Code Act 1994</i>); or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-ii">
                <num>ii</num>
                <content>
                  <p>that would be such an agricultural chemical product, apart from regulations made for the purposes of paragraph 4(4)(b) of that Code; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-g">
                <num>g</num>
                <content>
                  <p>a substance or mixture of substances:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-i">
                <num>i</num>
                <content>
                  <p>that is a veterinary chemical product (within the meaning of that Code); or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-ii">
                <num>ii</num>
                <content>
                  <p>to which paragraph 5(4)(a) of that Code applies; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-iii">
                <num>iii</num>
                <content>
                  <p>that would be such a veterinary chemical product, apart from regulations made for the purposes of paragraph 5(4)(b) of that Code; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-h">
                <num>h</num>
                <content>
                  <p>a substance or mixture of substances that is an active constituent (within the meaning of that Code) for a proposed or existing chemical product (within the meaning of that Code), and that:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-i">
                <num>i</num>
                <content>
                  <p>is an approved active constituent (within the meaning of that Code); or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-ii">
                <num>ii</num>
                <content>
                  <p>	(ii)	is an exempt active constituent (<i>Agricultural and Veterinary Chemicals (Administration) Act 1992</i>); or<ref href="#sec-69B__subsec-1">within the meaning of subsection 69B(1)</ref> of the </p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-iii">
                <num>iii</num>
                <content>
                  <p>is imported into Australia with the written consent of the Australian Pesticides and Veterinary Medicines Authority under subsection 69B(1B) of that Act; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-i">
                <num>i</num>
                <content>
                  <p>	(i)	an industrial chemical within the meaning of the <i>Industrial Chemicals (Notification and Assessment) Act 1989</i>; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-ia">
                <num>ia</num>
                <content>
                  <p>a plant or fungus, or an extract from a plant or fungus; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-j">
                <num>j</num>
                <content>
                  <p>a controlled drug, controlled plant, controlled precursor, border controlled drug, border controlled plant or border controlled precursor; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-k">
                <num>k</num>
                <content>
                  <p>	(k)	a prohibited import within the meaning of the <i>Customs Act 1901</i>; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-l">
                <num>l</num>
                <content>
                  <p>prescribed by, or included in a class of substances prescribed by, the regulations.</p>
                </content>
              </paragraph>
              <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-320-2__subclause-3">
                <num>3</num>
                <content>
                  <p>Subsection (2) does not apply to a substance that contains any psychoactive substance that is not of a kind specified in any of paragraphs (2)(a) to (l).</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-320-2__subclause-4">
                <num>4</num>
                <content>
                  <p>In a prosecution for an offence under subsection (1), it is not necessary to prove that the defendant was reckless as to:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-a">
                <num>a</num>
                <content>
                  <p>the particular identity of the substance; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-2__para-b">
                <num>b</num>
                <content>
                  <p>whether the substance had a particular psychoactive effect.</p>
                </content>
              </paragraph>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-320-3">
              <num>320.3</num>
              <heading>Importing substances represented to be serious drug alternatives</heading>
              <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-320-3__subclause-1">
                <num>1</num>
                <content>
                  <p>A person commits an offence if:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-a">
                <num>a</num>
                <content>
                  <p>the person imports a substance; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-b">
                <num>b</num>
                <content>
                  <p>at the time of the importation, the presentation of the substance includes an express or implied representation that the substance is a serious drug alternative.</p>
                </content>
              </paragraph>
              <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-320-3__subclause-2">
                <num>2</num>
                <content>
                  <p>For the purposes of paragraph (1)(b), the presentation of a substance includes, but is not limited to, matters relating to:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-a">
                <num>a</num>
                <content>
                  <p>the name of the substance; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-b">
                <num>b</num>
                <content>
                  <p>the labelling and packaging of the substance and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-c">
                <num>c</num>
                <content>
                  <p>any advertising or other informational material associated with the substance.</p>
                </content>
              </paragraph>
              <hcontainer name="subclause" eId="schedule-1__clause-1__subclause-320-3__subclause-3">
                <num>3</num>
                <content>
                  <p>This section does not apply to a substance if it is:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-a">
                <num>a</num>
                <content>
                  <p>	(a)	food (within the meaning of the <i>Food Standards Australia New Zealand Act 1991</i>) for which:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-i">
                <num>i</num>
                <content>
                  <p>there is a standard (within the meaning of that Act); or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-ii">
                <num>ii</num>
                <content>
                  <p>in the form in which the substance is presented, there is a tradition in Australia and New Zealand of using the substance as food for humans; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-b">
                <num>b</num>
                <content>

                  <p>	(iii)	is an exempt chemical product (<i>Agricultural and Veterinary Chemicals (Administration) Act 1992</i>); or<ref href="#sec-69B__subsec-2">within the meaning of subsection 69B(2)</ref> of the </p>

              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-iv">
                <num>iv</num>
                <content>
                  <p>is imported into Australia with the written consent of the Australian Pesticides and Veterinary Medicines Authority under subsection 69B(1B) of that Act; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-e">
                <num>e</num>
                <content>
                  <p>a substance or mixture of substances that is an active constituent (within the meaning of that Code) for a proposed or existing chemical product (within the meaning of that Code), and that:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-i">
                <num>i</num>
                <content>
                  <p>is an approved active constituent (within the meaning of that Code); or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-ii">
                <num>ii</num>
                <content>
                  <p>	(ii)	is an exempt active constituent (<i>Agricultural and Veterinary Chemicals (Administration) Act 1992</i>); or<ref href="#sec-69B__subsec-2">within the meaning of subsection 69B(2)</ref> of the </p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-iii">
                <num>iii</num>
                <content>
                  <p>is imported into Australia with the written consent of the Australian Pesticides and Veterinary Medicines Authority under subsection 69B(1B) of that Act; or</p>
                </content>
              </paragraph>

                  <p>prescribed by, or included in a class of substances prescribed by, the regulations.</p>
                </content>
              </paragraph>

                  <p>In a prosecution for an offence under subsection (1), it is not necessary to prove that:</p>
                </content>
              </hcontainer>

                  <p>the representation of the substance to be a serious drug alternative related to a particular serious drug; or</p>
                </content>
              </paragraph>

                  <p>the defendant intended to cause any person to believe that the substance:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-i">

                  <p>was a particular serious drug; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-ii">
                <num>ii</num>

                  <p>has a psychoactive effect that is the same as or similar to a particular serious drug; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-1__clause-1__subclause-320-3__para-iii">

                  <p>is a lawful alternative to a particular serious drug; or</p>
                </content>
              </paragraph>

              </paragraph>

                <p>goods are seized under a seizure warrant or under subsection 203B(2) or (2A), 203CA(3) or 203CB(2); and</p>

            <paragraph eId="schedule-1__clause-205EA__para-b">
              <num>b</num>

                <p>the goods are seized on belief or suspicion that they are a prohibited psychoactive substance; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-205EA__para-c">

                <p>a claim for the return of the goods may be made under <ref href="#sec-205B">section 205B</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-205EA__para-d">

                <p>not later than 30 days after the day the seizure notice was served, a claim is made under <ref href="#sec-205B">section 205B</ref> for return of the goods.</p>
              </content>
            </paragraph>

                <p>The authorised person who seized the goods must, subject to any law of the Commonwealth, a State or a Territory permitting their retention, destruction or disposal, return the goods unless:</p>

                <p>the goods have been dealt with under <ref href="#sec-206">section 206</ref>; or</p>

            <paragraph eId="schedule-1__clause-205EA__para-i">
              <num>i</num>
              <content>
                <p>to recover the goods; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-205EA__para-ii">
              <num>ii</num>
              <content>
                <p>for a declaration that the goods are not forfeited.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-205EA__subclause-3">

                <p>A notice under paragraph (2)(b):</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-205EA__para-a">

                <p>must be served personally or by post; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-205EA__para-b">

                <p>may be served on a person who is outside Australia.</p>

                <p>The goods are condemned as forfeited to the Crown if:</p>
              </content>
            </hcontainer>

                <p>the claimant does not institute proceedings of a kind referred to in paragraph (2)(b) within the period of 30 days after receiving the notice under that paragraph (or within that period as extended, or further extended, under <ref href="#sec-205E">section 205E</ref>B); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-205EA__para-b">
              <num>b</num>
              <content>
                <p>the claimant institutes such proceedings within that period (or within that period as extended or further extended), and at the end of the proceedings there is not:</p>

                <p>an order for the Commonwealth to pay the claimant the market value of the goods at the time they were disposed of or destroyed, if they have been disposed of or destroyed before the end of the proceedings; or</p>

              <num>iii</num>
              <content>
                <p>a declaration that the goods are not forfeited.</p>
              </content>
            </paragraph>

                <p>For the purposes of subsection (4), if the proceedings go to judgment, they end:</p>
              </content>

                <p>at the end of the period for lodging an appeal against the judgment, if no appeal is lodged within that period; or</p>

                <p>when the appeal lapses or is finally determined, if an appeal is lodged against the judgment within that period.</p>

                <p>For the purposes of this section, the return of goods requires their return to the person reasonably believed to be the owner of the goods in a condition as near as practicable to the condition in which they were seized.</p>

            <heading>Extending the period for instituting proceedings for recovery of suspected prohibited psychoactive substances</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-205EB__subclause-1">
              <num>1</num>
              <content>
                <p>A person who has been given a notice under paragraph 205EA(2)(b) in relation to goods may, before the end of the applicable period under paragraph 205EA(4)(a), apply to a magistrate for an extension, or a further extension, of the period.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-205EB__subclause-2">
              <num>2</num>
              <content>
                <p>If the magistrate is satisfied that:</p>
              </content>
            </hcontainer>

                <p>it is necessary that the retention of the goods continue while information is assembled relating to whether the goods are a prohibited psychoactive substance; and</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>there has been no avoidable delay in assembling that information;</p>
              </content>
            </paragraph>
            <content>
              <p>the magistrate may order that the period be extended, or further extended, for a period specified in the order.</p>
            </content>

            <num>205EC</num>
            <heading>Proceedings for recovery of suspected prohibited psychoactive substances</heading>

                <p>Proceedings of a kind referred to in paragraph 205EA(2)(b) may be instituted or continued even if the goods to which the proceedings relate are disposed of or destroyed.</p>

              <num>2</num>
              <content>
                <p>In proceedings of a kind referred to in paragraph 205EA(2)(b):</p>
              </content>

                <p>the Commonwealth bears the onus of proving that the goods to which the proceedings relate were imported; and</p>

                <p>the person instituting the proceedings bears the onus of proving that the goods:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-205EC__para-i">

                <p>are not a psychoactive substance; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-205EC__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	are a substance to which, because of subsection 320.2(2) of the <i>Criminal Code</i>, section 320.2 of the <i>Criminal Code</i> does not apply.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-205EC__subclause-3">

                <p>If:</p>

                <p>the court hearing the proceedings decides that, apart from the disposal or destruction, it would have ordered that the goods be returned to a person;</p>

              <p>the court must order the Commonwealth to pay the person an amount equal to the market value of the goods at the time they were disposed of or destroyed.</p>
            </content>

                <p><b><i>import</i></b> a thing, means import the thing into Australia, and includes deal with the thing in connection with its importation.</p>
                <p><b><i>traffic</i></b> in a thing that is a firearm or a firearm part means:</p>
                <p>For the purposes of paragraph (d), preparing a thing for transfer includes packaging the thing or separating the thing into discrete units.</p>
