            <p>		This Act may be cited as the <i>Australian Immunisation Register </i><i>Act 201</i><i>5</i>.</p>

              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <heading>Simplified outline of this Act</heading>
          <content>
            <p>This Act establishes a register of information about vaccinations.</p>
            <p>The purposes of the register relate to supporting Australian vaccination programs, and vaccination matters more broadly.</p>
            <p>Sensitive information in the register is protected.</p>

        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-ai-register">AI register</term> means <def>the Australian Immunisation Register.</def></p>
            <p><term refersTo="#term-approved-form">approved form</term> means <def>a form approved under subsection 29(1).</def></p>
            <p><term refersTo="#term-arrangement">arrangement</term> includes <def>a contract or deed.</def></p>
            <p><term refersTo="#term-chief-executive-medicare">Chief Executive Medicare</term> has the same meaning as <def>in the Human Services (Medicare) Act 1973.</def></p>
            <p><term refersTo="#term-civil-penalty-provision">civil penalty provision</term> has the same meaning as <def>in the Regulatory Powers Act.</def></p>
            <p><term refersTo="#term-commercial-in-confidence">commercial-in-confidence</term> has the meaning given by <def><ref href="#sec-5">section 5</ref>.</def></p>
            <p><term refersTo="#term-family-assistance">family assistance</term> has the same meaning as <def>in the A New Tax System (Family Assistance) Act 1999.</def></p>
            <p><term refersTo="#term-general-practitioner">general practitioner</term> has the same meaning as <def>in <ref href="">the Health Insurance Act 1973</ref>.</def></p>
            <p><term refersTo="#term-healthcare-identifier">healthcare identifier</term> has the same meaning as <def>in <ref href="">the Healthcare Identifiers Act 2010</ref>.</def></p>
            <p><term refersTo="#term-healthcare-identifier-information-for-a-person">healthcare identifier information for a person</term> has the meaning given by <def><ref href="#sec-5B">section 5B</ref>.</def></p>
            <p><b><i>legal personal representative</i></b>, of an individual, means:</p>
          </content>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>a parent or guardian of the individual, if the individual is under the age of 18 years; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>a trustee of an estate of the individual, if the individual is under a legal disability; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">
            <num>c</num>
            <content>
              <p>a person who holds an enduring power of attorney granted by the individual.</p>
            </content>
            <content>
              <p><b><i>parent</i></b>: without limiting who is a parent of anyone for the purposes of this Act, a person is the <b><i>parent</i></b> of another person if the other person is a child of the person within the meaning of the <i>Family Law Act 1975</i>.</p>
              <p><term refersTo="#term-personal-information">personal information</term> has the same meaning as <def>in <ref href="">the Privacy Act 1988</ref>.</def></p>
              <p><term refersTo="#term-prescribed-body">prescribed body</term> means <def>a person prescribed by the rules for the purposes of this definition.</def></p>
              <p><term refersTo="#term-protected-information">protected information</term> means <def>personal information, relevant identifying information or information that is commercial-in-confidence, to the extent that this information: is obtained under, or in accordance with, this Act; or is derived from a record of information that was made under, or in accordance with, this Act; or is derived from a disclosure or use of information that was made under, or in accordance with, this Act.</def></p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>is obtained under, or in accordance with, this Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>is derived from a record of information that was made under, or in accordance with, this Act; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">
            <num>c</num>
            <content>
              <p>is derived from a disclosure or use of information that was made under, or in accordance with, this Act.</p>
            </content>
            <content>
              <p><term refersTo="#term-provider-identification-information">provider identification information</term> has the meaning given by <def><ref href="#sec-5A">section 5A</ref>.</def></p>
              <p><term refersTo="#term-purposes-of-the-ai-register">purposes of the AI register</term> means <def>the purposes set out in <ref href="#sec-10">section 10</ref>.</def></p>
              <p><b><i>recognised vaccination provider</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>a general practitioner; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>an individual, or body, endorsed to administer vaccines in Australia, if the endorsement:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-i">
            <num>i</num>
            <content>
              <p>is for purposes that include the purposes of the AI register; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-ii">
            <num>ii</num>
            <content>
              <p>is by the Commonwealth, a State or a Territory.</p>
            </content>
            <content>
              <p><term refersTo="#term-regulatory-powers-act">Regulatory Powers Act</term> means <def>the Regulatory Powers (Standard Provisions) Act 2014.</def></p>
              <p><term refersTo="#term-relevant-identifying-information-for-an-individual">relevant identifying information for an individual</term> means <def>the following: the individual’s name, contact details, date of birth, gender and Indigenous status; 	(b)	the individual’s medicare number (within the meaning of <i>National Health Act 1953</i>) (if any);<ref href="#part-VI">Part VI</ref>I of the  the individual’s healthcare identifier (if any); the name and contact details of a legal personal representative of the individual if the individual is incapable of managing his or her health affairs; any other information of a kind prescribed by the rules for the purposes of this definition that identifies the individual.</def></p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>the individual’s name, contact details, date of birth, gender and Indigenous status;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>	(b)	the individual’s medicare number (within the meaning of <i>National Health Act 1953</i>) (if any);<ref href="#part-VI">Part VI</ref>I of the </p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">
            <num>c</num>
            <content>
              <p>the individual’s healthcare identifier (if any);</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-d">
            <num>d</num>
            <content>
              <p>the name and contact details of a legal personal representative of the individual if the individual is incapable of managing his or her health affairs;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-e">
            <num>e</num>
            <content>
              <p>any other information of a kind prescribed by the rules for the purposes of this definition that identifies the individual.</p>
            </content>
            <content>
              <p><term refersTo="#term-relevant-vaccination">relevant vaccination</term> means <def>a vaccination administered: in Australia; or outside Australia, if information about the vaccination is given to a recognised vaccination provider.</def></p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>in Australia; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>outside Australia, if information about the vaccination is given to a recognised vaccination provider.</p>
            </content>
            <content>
              <p><term refersTo="#term-rules">rules</term> means <def>the rules made under <ref href="#sec-31">section 31</ref>.</def></p>
              <p><term refersTo="#term-secretary">Secretary</term> means <def>the Secretary of the Department.</def></p>
              <p><term refersTo="#term-vaccine-preventable-disease">vaccine preventable disease</term> means <def>a disease listed as a vaccine preventable disease in the latest edition of the Australian Immunisation Handbook published by the Government Printer.</def></p>

        </section>
        <section eId="part-1__sec-5">
          <num>5</num>
          <heading>Meaning of commercial-in-confidence</heading>
          <content>
            <p>		Information is <b><i>commercial</i></b><b><i>-</i></b><b><i>in</i></b><b><i>-</i></b><b><i>confidence</i></b> if a person demonstrates to the Minister that:</p>
          </content>
          <paragraph eId="part-1__sec-5__para-a">
            <num>a</num>
            <content>
              <p>release of the information would cause competitive detriment to the person; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-b">
            <num>b</num>
            <content>
              <p>the information is not in the public domain; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-c">
            <num>c</num>
            <content>
              <p>the information is not required to be disclosed under a law of the Commonwealth, or of a State or Territory; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5__para-d">
            <num>d</num>
            <content>
              <p>the information is not readily discoverable.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-5A">
          <num>5A</num>
          <heading>Meaning of provider identification information</heading>
          <content>
            <p>		If a recognised vaccination provider administers a vaccine, or is given information about a relevant vaccination, at a place where the provider practices the provider’s profession, then each of the following is <b><i>provider identification information</i></b> for the provider:</p>
          </content>
          <paragraph eId="part-1__sec-5A__para-a">
            <num>a</num>
            <content>
              <p>the provider’s name and contact details;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5A__para-b">
            <num>b</num>
            <content>
              <p>if a number known as a provider number has been allocated by the Chief Executive Medicare to the provider in respect of that place—that number;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-5A__para-c">
            <num>c</num>
            <content>
              <p>if a number known as the AIR provider number has been allocated to the provider for the purposes of this Act—that number.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-5B">
          <num>5B</num>
          <heading>Meaning of healthcare identifier information</heading>
          <subsection eId="part-1__sec-5B__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	Each of the following is <b><i>healthcare identifier information</i></b> for a person:</p>
            </content>
            <paragraph eId="part-1__sec-5B__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>if the person is a healthcare provider that has a healthcare identifier—the healthcare identifier;</p>
              </content>
            </paragraph>
            <paragraph eId="part-1__sec-5B__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>if the person is an individual healthcare provider linked to a healthcare provider organisation that has a healthcare identifier—the healthcare identifier for the healthcare provider organisation.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-1__sec-5B__subsec-2">
            <num>2</num>
            <content>

              <p>Recognised vaccination providers are required to report certain information in relation to certain relevant vaccinations that have been administered. This information will be included in the register.</p>
              <p>A recognised vaccination provider may be required to give information, or be given a formal warning, if the provider is not complying, or has not complied, with the requirement to report.</p>
              <p>Individuals can opt out from receiving certain information from the register. They can also request for their information in the register not to be disclosed for certain purposes.</p>
              <p>Payments relating to vaccinations may be made on behalf of the Commonwealth.</p>

                <p>information provided by a recognised vaccination provider about each relevant vaccination, including:</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-2__sec-9__para-i">
              <num>i</num>
              <content>
                <p>the day of the vaccination; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__dvs-2__sec-9__para-ii">
              <num>ii</num>
              <content>
                <p>information about the vaccine administered; and</p>
              </content>
            </paragraph>

                <p>if the vaccine was administered in Australia—provider identification information and healthcare identifier information for the recognised vaccination provider who administered the vaccine; and</p>

                <p>the name and contact details of, and healthcare identifier information for, the general practitioner, paediatrician, public health physician, infectious diseases physician or clinical immunologist who conducted the assessment; and</p>

            <heading>Purposes of the register</heading>

                <p>The purposes of the AI register are to facilitate the following:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-1__para-a">
                <num>a</num>
                <content>
                  <p>establishing and keeping an electronic database of records relating to vaccinations of individuals;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>collecting, analysing and publishing statistics, and other information, about vaccination coverage across Australia and parts of Australia;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>monitoring vaccination coverage across Australia and parts of Australia;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-1__para-d">

                <content>
                  <p>monitoring the effectiveness of vaccines and vaccination programs in preventing vaccine preventable diseases;</p>
                </content>
              </paragraph>

                  <p>identifying any parts of Australia at risk during disease outbreaks because of the number of unvaccinated individuals in those parts;</p>

                  <p>checking an individual’s vaccination status by that individual or by a recognised vaccination provider;</p>
                </content>

                  <p>checking an individual’s vaccination status:</p>
                </content>
              </paragraph>

              </paragraph>

                  <p>to the extent that this is necessary for determining eligibility for family assistance;</p>
                </content>
              </paragraph>

                  <p>advising an individual when he or she is, or was, due to receive doses of a vaccine;</p>
                </content>
              </paragraph>

                  <p>certifying when a course of vaccination has been completed;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-1__para-j">

                <content>
                  <p>promoting individuals’ health and well-being by giving information on new developments associated with vaccinations to them and to recognised vaccination providers;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-1__para-k">
                <num>k</num>
                <content>
                  <p>payments relating to vaccinations;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-1__para-l">
                <num>l</num>

                  <p>research relating to vaccinations;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-1__para-m">

                  <p>anything incidental to any of the above paragraphs.</p>

              </paragraph>
            </subsection>

                <p>For an individual who is incapable of managing his or her health affairs:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-2__para-a">

                  <p>paragraph (1)(f) also applies to checking of the individual’s vaccination status by a legal personal representative of the individual; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-10__subsec-2__para-b">

                <content>
                  <p>paragraphs (1)(h), (i) and (j) also apply to advising, or giving a certificate or information to, a legal personal representative of the individual.</p>

              </paragraph>

                  <p>is of a kind prescribed by the rules; and</p>
                </content>
              </paragraph>

                  <p>is administered in the circumstances prescribed by the rules;</p>
                </content>
                <content>
                  <p>the provider must report, within the period prescribed by the rules and in the manner prescribed by the rules, the information prescribed by the rules for that vaccination for inclusion in the AI Register.</p>
                </content>
              </paragraph>
            </subsection>
            <subsection eId="part-2__dvs-2A__sec-10A__subsec-2">
              <num>2</num>
              <content>
                <p>Subsection (1) does not apply if the recognised vaccination provider reasonably believes that complying with that subsection is likely to pose a risk to the health or safety of an individual.</p>

              </paragraph>

                  <p>the provider must report, within the period prescribed by the rules and in the manner prescribed by the rules, the information prescribed by the rules for that vaccination for inclusion in the AI Register.</p>

            </subsection>

                <p>Subsection (3) does not apply if the recognised vaccination provider reasonably believes that complying with that subsection is likely to pose a risk to the health or safety of an individual.</p>

                  <p>the provider’s administrative costs incurred in reporting information for inclusion in the AI register; or</p>
                </content>
              </paragraph>

                  <p>the provider:</p>
                </content>
              </paragraph>

            <p>Section 23 makes it an offence if a person, while unauthorised to do so, discloses or uses protected information.</p>
            <p>The main authorisation relates to disclosure or use for the purposes of the register. There are also a number of exceptions to the offence.</p>

                <p>information that is commercial-in-confidence;</p>
              </content>

                <p>if the person does so for the purposes of including the information in the AI register.</p>
                <p>Using or disclosing protected information in the AI register</p>

              <p>A person may make a record of, disclose or otherwise use protected information if:</p>
            </content>
            <paragraph eId="part-4__sec-22__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>the person does so for the purposes of the AI register, and the person is:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-22__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>an officer or employee of the Commonwealth or of an authority of the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-22__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>engaged by the Commonwealth, or by an authority of the Commonwealth, to perform work relating to the purposes of the AI register; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-22__subsec-2__para-iii">
              <num>iii</num>
              <content>
                <p>an officer or employee of, or is engaged by, a person referred to in subparagraph (ii) to perform work relating to the purposes of the AI register; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-22__subsec-2__para-iv">
              <num>iv</num>
              <content>
                <p>a prescribed body; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-22__subsec-2__para-v">
              <num>v</num>
              <content>
                <p>a recognised vaccination provider; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-22__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>the person is authorised to do so under subsection (3); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-22__subsec-2__para-c">

                <p>the person does so for the purposes of performing the person’s functions, or exercising the person’s powers, under this Act; or</p>
              </content>
            </paragraph>

                <p>	(ca)	the person does so for the purposes of including information in the register kept under Part 2 of the <i>National Cancer Screening Register Act 2016</i>; or</p>

                <p>the person is required or authorised to do so by or under a law of the Commonwealth or of a State or Territory; or</p>

                <p>the person does so for the purposes of court or tribunal proceedings, or in accordance with an order of a court or tribunal; or</p>

                <p>the person does so for the purposes of a coronial inquiry, or in accordance with an order of a coroner.</p>

                <p>is derived from information that was in the register.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-22__subsec-3">
            <num>3</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, in writing, authorise a person to make a record of, disclose or otherwise use protected information for a specified purpose that <role refersTo="#minister">the Minister</role> is satisfied is in the public interest.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-22__subsec-4">
            <num>4</num>
            <content>
              <p>Paragraph (2)(a) does not apply to personal information to the extent that a disclosure under that paragraph would be contrary to a request in force under subsection 11(2).</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-23">
          <num>23</num>
          <heading>Offence relating to protected information</heading>
          <content>
            <p>A person commits an offence if:</p>
          </content>
          <paragraph eId="part-4__sec-23__para-a">
            <num>a</num>
            <content>
              <p>the person obtains information; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-23__para-b">
            <num>b</num>
            <content>
              <p>the information is protected information; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-23__para-c">
            <num>c</num>
            <content>
              <p>the person makes a record of, discloses or otherwise uses the information; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-4__sec-23__para-d">
            <num>d</num>
            <content>
              <p>the making of the record, or the disclosure or use, is not authorised by <ref href="#sec-22">section 22</ref>.</p>
            </content>

            <p>Section 23 does not apply to a person to the extent that the person makes a record of, discloses or otherwise uses protected information in good faith and in purported compliance with <ref href="#sec-22">section 22</ref>.</p>

              <p>the person makes a record of, discloses or otherwise uses protected information; and</p>

              <p>the information is commercial-in-confidence; and</p>

          </paragraph>
          <paragraph eId="part-4__sec-25__para-c">

              <p>the person does not know that the information is commercial-in-confidence.</p>

                <p>the person discloses protected information to the person to whom the information relates; or</p>

            <paragraph eId="part-4__sec-26__subsec-1__para-b">

                <p>the person is the person to whom the protected information relates; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-26__subsec-1__para-c">

                <p>the making of the record, or the disclosure or use, of the protected information is in accordance with the express or implied consent of the person to whom the information relates.</p>

          <heading>Exception for disclosure to person who provided the information</heading>

            <p>Section 23 does not apply to a person if:</p>

              <p>the person obtains protected information from another person; and</p>
            </content>
          </paragraph>

                <p>Relevant court</p>
              </content>

              <p>For the purposes of Part 4 of the Regulatory Powers Act, each of the following courts is a relevant court in relation to the civil penalty provisions of this Act:</p>

                <p>the Federal Court of Australia;</p>
              </content>
            </paragraph>

                <p>the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>);</p>

            </paragraph>

                <p>a court of a State or Territory that has jurisdiction in relation to the matter.</p>

              <p><role refersTo="#minister">The Minister</role> may, in writing, approve a form for the purposes of a provision of this Act.</p>

          </subsection>
          <subsection eId="part-5__sec-29__subsec-2">
            <num>2</num>
            <content>
              <p>A request required by a provision of this Act to be in the approved form must be given to the person specified in the form for that purpose.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-5__sec-30">
          <num>30</num>
          <heading>Delegation</heading>
          <content>
            <p>Delegation by <role refersTo="#minister">the Minister</role></p>
          </content>
          <subsection eId="part-5__sec-30__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, in writing, delegate his or her functions or powers under subsection 22(3) (about authorising disclosures etc.) to:</p>
            </content>
            <paragraph eId="part-5__sec-30__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>a person who holds or performs the duties of an SES Band 3 position, or an equivalent or higher position, in the Department; or</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>the Chief Executive Medicare.</p>
              </content>
            </paragraph>
          </subsection>

          <heading>Rules</heading>
          <subsection eId="part-5__sec-31__subsec-1">

              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>

            <paragraph eId="part-5__sec-31__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-5__sec-31__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-5__sec-31__subsec-2">

              <p>To avoid doubt, the rules may not do the following:</p>

                  <b>Misdescribed amendments</b>
                </p>
                <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under <i>Legislation Act 2003</i>.<ref href="#sec-15V">section 15V</ref> of the </p>
