          <p>		This Act may be cited as the <i>Crimes Legislation Amendment (Powers, Offences and Other Measures) </i><i>Act 201</i><i>5</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <heading>Recklessness as to nature of substance or plant sufficient for offence of attempt to commit an offence against this Part</heading>

                <p>Despite subsection 11.1(3), for the offence of attempting to commit an offence against this Part, recklessness is the fault element in relation to any of the following physical elements of the offence attempted:</p>

                  <p>that a substance is a controlled drug (a physical element of an offence against <ref href="#dvs-302">Division 302</ref> or 305 or <ref href="#sec-308">section 308</ref>.1, 309.2, 309.3, 309.4, 309.7 or 309.8);</p>

              </paragraph>
              <paragraph eId="schedule-1__clause-2__subclause-300-6__para-b">
                <num>b</num>
                <content>
                  <p>that a plant is a controlled plant (a physical element of an offence against <ref href="#dvs-303">Division 303</ref> or 304);</p>

                <p>a person is convicted of a federal offence, or of 2 or more federal offences at the same sitting; and</p>

                <p>the court imposes the sentence or sentences on the person; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-19AB__para-c">

                <p>either or both of the following subparagraphs apply:</p>

            </paragraph>
            <paragraph eId="schedule-5__clause-19AB__para-i">
              <num>i</num>
              <content>
                <p>any of the sentences is a federal life sentence;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-19AB__para-ii">
              <num>ii</num>
              <content>
                <p>the sentences, in the aggregate, exceed 3 years; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-19AB__para-d">
              <num>d</num>

                <p>when the court imposes the sentence or sentences, the person is not already serving or subject to a federal sentence.</p>
              </content>
            </paragraph>

                <p>Subject to subsection (3), a court must fix a single non-parole period in respect of all federal sentences a person is to serve or complete if:</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>
                <p>while the person is in prison and is serving or subject to a federal sentence, the court imposes a further federal sentence on the person; and</p>
              </content>
            </paragraph>

              <num>b</num>
              <content>
                <p>the result is that the person is to serve or to complete:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-19AB__para-i">
              <num>i</num>

                <p>a federal life sentence; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-19AB__para-ii">
              <num>ii</num>
              <content>
                <p>federal sentences the unserved portions of which, in the aggregate, exceed 3 years; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-19AB__para-c">
              <num>c</num>
              <content>
                <p>when the court imposes the further federal sentence, the person is not already subject to a non-parole period or recognizance release order in respect of a federal sentence.</p>
              </content>
            </paragraph>
            <content>
              <p>Non-parole period not appropriate</p>
            </content>
            <hcontainer name="subclause" eId="schedule-5__clause-19AB__subclause-3">
              <num>3</num>
              <content>
                <p>A court may decline to fix a non-parole period under this section if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-5__clause-19AB__para-a">

                <p>the court is satisfied that a non-parole period is not appropriate, having regard to:</p>
              </content>
            </paragraph>

                <p>the nature and circumstances of the offence or offences; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-19AB__para-ii">

                <p>the antecedents of the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-5__clause-19AB__para-b">

                <p>the person is expected to be serving a State or Territory sentence on the day after the end of the federal sentence, or the last to be served of the federal sentences, as reduced by any remissions or reductions under <ref href="#sec-19A">section 19A</ref>A.</p>

                <p>An authorised officer may disclose federal offender information to a relevant person if the officer reasonably believes that the disclosure is necessary to enable the relevant person to exercise the person’s powers, or to perform the person’s functions or duties.</p>
