        <heading>Short title</heading>

          <p>		This Act may be cited as the <i>Defence Legislation Amendment </i><i>(</i><i>Military </i><i>Justice </i><i>Enhancements—</i><i>Inspector</i><i>-</i><i>General ADF) </i><i>Act 201</i><i>5</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

            </paragraph>

                <p>to do anything incidental or conducive to the performance of any of the above functions.</p>

            <heading>Subsection 110C(2)</heading>
            <content>
              <p>Repeal the subsection.</p>
            </content>

            <heading>At the end of section 110C (before the note)</heading>

              <p>Add:</p>

                <p>Regulations made for the purposes of paragraph (1)(g) must not prescribe a function unless the function relates to:</p>

                <p>the military justice system; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-b">

                <p>complaints made by members of the Defence Force, where the relevant complaint is about a decision, act or omission in relation to the member’s service in the Defence Force; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-c">
              <num>c</num>
              <content>
                <p>deaths of members of the Defence Force, where the relevant death appears to have arisen out of, or in the course of, the member’s service in the Defence Force.</p>
              </content>
            </paragraph>

                <p>To avoid doubt, a function prescribed by regulations made for the purposes of paragraph (1)(g) may be to inquire into or investigate a matter mentioned in paragraph (4)(b) or (c).</p>

                <p>This section applies to an inquiry or investigation by the Inspector-General ADF under:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-110DA__para-a">
              <num>a</num>
              <content>
                <p>paragraph 110C(1)(a); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-110DA__para-b">
              <num>b</num>
              <content>
                <p>regulations made for the purposes of paragraph 110C(1)(g).</p>
              </content>
            </paragraph>

              <num>2</num>
              <content>
                <p>The Inspector-General ADF may conduct an inquiry or investigation:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-110DA__para-a">
              <num>a</num>
              <content>
                <p>on his or her own initiative; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-110DA__para-b">
              <num>b</num>
              <content>
                <p>at the request of a service chief; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-110DA__para-c">
              <num>c</num>
              <content>
                <p>at the request of an individual.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-110DB">
            <num>110DB</num>
            <heading>Inspector-General ADF may end an inquiry or investigation</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-110DB__subclause-1">
              <num>1</num>
              <content>
                <p>The Inspector-General ADF may end an inquiry or investigation conducted by the Inspector-General ADF if the Inspector-General ADF is satisfied that the inquiry or investigation, or the continuation of the inquiry or investigation, is not warranted having regard to all the circumstances.</p>
              </content>

              <content>
                <p>Subsection (1) does not apply to an inquiry or investigation under paragraph 110C(1)(e).</p>

              <p>Note:	Paragraph 110C(1)(e) is about inquiries and investigations directed by <role refersTo="#minister">the Minister</role>.</p>

          </hcontainer>

            <heading>Section 110R</heading>
            <content>
              <p>Repeal the section, substitute:</p>

            <heading>Annual report by Inspector-General ADF</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-110R__subclause-1">
              <num>1</num>
              <content>
                <p>As soon as practicable after the end of each financial year, the Inspector-General ADF must prepare and give to <role refersTo="#minister">the Minister</role>, for presentation to the Parliament, a report on the operations of the Inspector-General ADF during the financial year.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	See also <i>Acts Interpretation Act 1901</i>, which contains extra rules about periodic reports.<ref href="#sec-34C">section 34C</ref> of the </p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-110R__subclause-2">
              <num>2</num>

                <p>For this purpose, the operations of the Inspector-General ADF include the operations of persons appointed under <ref href="#sec-110P">section 110P</ref>.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-9">
            <num>9</num>
            <heading>After subsection 124(2A)</heading>
            <content>
              <p>Insert:</p>
              <p>(2AA)	Subject to subsection (2B), the power to make regulations for the purposes of paragraph (1)(h) includes the power to make regulations requiring a person appearing as a witness before the Inspector-General ADF to answer a question even if the answer to the question may tend to incriminate the person.</p>
              <p>(2AB)	Subject to subsection (2B), the power to make regulations for the purposes of subsection 110P(3) includes the power to make regulations requiring a person appearing as a witness before a person appointed under <ref href="#sec-110P">section 110P</ref> to answer a question even if the answer to the question may tend to incriminate the first-mentioned person.</p>

            <heading>Subsection 124(2B)</heading>

              <p>other than in proceedings by way of a prosecution for giving false testimony at the hearing before the Inspector-General ADF or person appointed under <ref href="#sec-110P">section 110P</ref>.</p>

                <p>any civil or criminal proceedings in any federal court or court of a State or Territory; or</p>

            </paragraph>

              <p>Despite the repeal of <i>Defence Act 1903</i> by this Schedule, that section continues to apply, in relation to an inquiry or investigation that started before the commencement of this item, as if the repeal had not happened.<ref href="#sec-110D">section 110D</ref> of the </p>
