          <p>		This Act may be cited as the <i>Governance of Australian Government Superannuation Schemes </i><i>Legislation </i><i>Amendment Act 2015</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

              <p><b><i>Account</i></b> means the CSC Special Account established by section 29E.</p>

            <num>29B</num>
            <heading>Receiving payments or other amounts on behalf of the Commonwealth</heading>
            <content>
              <p>CSC may, on behalf of the Commonwealth, receive:</p>
            </content>
            <paragraph eId="schedule-1__clause-29B__para-a">
              <num>a</num>
              <content>
                <p>payments of amounts that are payable to the Commonwealth under each Act administered by CSC; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29B__para-b">
              <num>b</num>
              <content>
                <p>other amounts related to each Act administered by CSC.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-29C">
            <num>29C</num>
            <heading>Recovering debts owing to the Commonwealth</heading>
            <content>
              <p>		Rules made for the purposes of the <i>Public Governance, Performance and Accountability Act 2013</i> in relation to recovery of debts owing to the Commonwealth apply to CSC in the same way as those rules apply to a non-corporate Commonwealth entity (within the meaning of that Act).</p>

          <hcontainer name="clause" eId="schedule-1__clause-29D">
            <num>29D</num>
            <heading>Instruments in relation to payments, other amounts or debts</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-29D__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, provide in relation to the performance of CSC’s functions in relation to payments, other amounts or debts referred to in any of sections 29A to 29C.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-29D__subclause-2">
              <num>2</num>
              <content>
                <p>Before making an instrument, <role refersTo="#minister">the Minister</role> must consult the Board on the instrument.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-29D__subclause-3">
              <num>3</num>
              <content>
                <p>Subsection (1) does not apply to the extent that:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-29D__para-a">
              <num>a</num>
              <content>
                <p>	(a)	an instrument relates to CSC’s<i> </i>obligations as a trustee under a law of the Commonwealth, except to the extent permitted by such a law; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29D__para-b">
              <num>b</num>
              <content>
                <p>	(b)	an instrument is inconsistent with the Board’s performance of functions or exercise of powers under the <i>Public Governance, Performance and Accountability Act 2013</i> (including under rules made for the purposes of that Act in relation to recovery of debts owing to the Commonwealth).</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-29E">
            <num>29E</num>
            <heading>CSC Special Account</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-29E__subclause-1">
              <num>1</num>
              <content>
                <p>The CSC Special Account is established by this section.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-29E__subclause-2">
              <num>2</num>
              <content>
                <p>	(2)	The Account is a special account for the purposes of the <i>Public Governance, Performance and Accountability Act 2013</i>.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-29F">
            <num>29F</num>
            <heading>Credits to the Account</heading>
            <content>
              <p>There must be credited to the Account amounts equal to all money received from any person for the purposes of the Account.</p>
              <p>Note:	An Appropriation Act provides for amounts to be credited to a special account if any of the purposes of the special account is a purpose that is covered by an item in the Appropriation Act.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-29G">
            <num>29G</num>
            <heading>Purposes of the Account</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-29G__subclause-1">
              <num>1</num>
              <content>
                <p>This section sets out the purposes of the Account.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-29G__subclause-2">
              <num>2</num>
              <content>
                <p>Amounts standing to the credit of the Account may be debited for the following purposes:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-29G__para-a">
              <num>a</num>
              <content>
                <p>	(a)	to pay or discharge the costs, expenses or other obligations incurred by CSC in the performance of its functions under this Act or another law of the Commonwealth, to the extent that the Commonwealth agrees, or is required<i> </i>under an Act administered by CSC or instrument made under such an Act, to meet those costs, expenses or obligations;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29G__para-b">
              <num>b</num>
              <content>
                <p>to pay any remuneration and allowances payable to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29G__para-i">
              <num>i</num>
              <content>
                <p>a director in accordance with <ref href="#sec-34">section 34</ref>; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29G__para-ii">
              <num>ii</num>
              <content>
                <p>a member of a panel or committee (however described) established, under an Act administered by CSC or an instrument made under such an Act, to review a decision of CSC;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29G__para-c">
              <num>c</num>
              <content>
                <p>to meet the expenses of administering the Account;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29G__para-d">
              <num>d</num>
              <content>
                <p>to repay, as required by law, amounts that have been credited to the Account;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-29G__para-e">
              <num>e</num>
              <content>
                <p>to reduce the balance of the Account (and, therefore, the available appropriation for the Account) without making a real or notional payment.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	See <i> Public Governance, Performance and Accountability Act 2013</i> (which deals with special accounts).<ref href="#sec-80">section 80</ref> of the</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-3">
            <num>3</num>
            <heading>Section 32</heading>
            <content>
              <p>Repeal the section, substitute:</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-32">
            <num>32</num>
            <heading>Exemption from taxation—CSC</heading>
            <content>
              <p>CSC generally exempt from taxation</p>
              <p>CSC subject to taxation—income tax</p>
              <p>CSC subject to taxation—goods and services tax</p>
              <p>CSC subject to taxation—fringe benefits tax</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-32__subclause-1">
              <num>1</num>
              <content>
                <p>CSC is not subject to taxation under a law of the Commonwealth, except:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-32__para-a">
              <num>a</num>
              <content>
                <p>as provided by this section; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-32__para-b">
              <num>b</num>
              <content>
                <p>under a law prescribed by the regulations.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-32__subclause-2">
              <num>2</num>
              <content>
                <p>CSC is not subject to taxation under a law of a State or Territory, except under a law prescribed by the regulations.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-32__subclause-3">
              <num>3</num>
              <content>
                <p>	(3)	CSC is subject to taxation under the <i>Income Tax Assessment Act 1936</i> and the <i>Income Tax Assessment Act 1997</i>, except in relation to:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-32__para-a">
              <num>a</num>
              <content>
                <p>any payment to CSC in relation to which an amount is debited from the Account; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-32__para-b">
              <num>b</num>
              <content>
                <p>any payment to CSC of money appropriated by the Parliament for the purposes of CSC.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-32__subclause-4">
              <num>4</num>
              <content>
                <p>	(4)	CSC is subject to taxation under the <i>A New Tax System (Goods and Services Tax) Act 1999</i>.</p>
              </content>
            </hcontainer>

              <num>5</num>
              <content>
                <p>	(5)	CSC is subject to taxation under the <i>Fringe Benefits Tax Assessment Act 1986</i>.</p>

                <p>CSC must cause a report of the following information to be published, in such manner as the Board of CSC thinks fit:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-124D__para-a">
              <num>a</num>
              <content>
                <p>the number of payments that any employee of CSC was aware of that were made under subsection 124B(1) or 124C(1) during the reporting period (see subsection (2) of this section);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-124D__para-b">
              <num>b</num>
              <content>
                <p>the total amount of payments referred to in paragraph (a);</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-124D__para-c">
              <num>c</num>
              <content>
                <p>the number of payments made under subsection 124B(1) or 124C(1) that any employee of CSC became aware of during the reporting period that were made during an earlier reporting period;</p>
              </content>
            </paragraph>

            <heading>Operation of laws</heading>

                <p>If, before commencement, a thing was done by, or in relation to, ComSuper or <role refersTo="#ceo">the CEO</role> of ComSuper, then, for the purposes of the operation of any law of the Commonwealth after commencement, the thing is taken to have been done by, or in relation to, CSC.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-9__subclause-2">
              <num>2</num>
              <content>
                <p>For the purposes of subitem (1), a thing done before commencement under a provision that is amended by this Act has effect from that time as if it were done under that provision as amended. However, this is not taken to change the time at which the thing was actually done.</p>

            <heading>The CEO of ComSuper</heading>
            <content>
              <p>The person who is <role refersTo="#ceo">the CEO</role> of ComSuper immediately before commencement ceases, at commencement, to hold office as <role refersTo="#ceo">the CEO</role> of ComSuper by force of this item.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-11">
            <num>11</num>
            <heading>APS employees in ComSuper transferred to CSC as employees of CSC</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-11__subclause-1">
              <num>1</num>
              <content>
                <p>This item applies to a person who:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-11__para-a">
              <num>a</num>
              <content>
                <p>	(a)	is a member of the staff of ComSuper engaged under the <i>Public Service Act 1999</i> immediately before commencement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-b">
              <num>b</num>
              <content>
                <p>	(b)	is covered by a determination made under <i>Public Service Act 1999</i> that causes the person, at commencement:<ref href="#sec-72">section 72</ref> of the </p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-i">
              <num>i</num>
              <content>
                <p>	(i)	to cease to be engaged under the <i>Public Service Act 1999</i>; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	to become an employee of CSC under <i>Governance of Australian Government Superannuation Schemes Act 2011</i>.<ref href="#sec-26">section 26</ref> of the </p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-11__subclause-2">
              <num>2</num>
              <content>
                <p>(2)	The person is taken to have accrued an entitlement to benefits, in connection with becoming an employee of CSC, that is equivalent to the entitlement that the person had as a member of the staff of ComSuper engaged under the <i>Public Service Act 1999 </i>immediately before commencement.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-11__subclause-3">
              <num>3</num>
              <content>
                <p>(3)	The service of the person as an employee of CSC is taken, for all purposes, to have been continuous with his or her service as a member of the staff of ComSuper engaged under the <i>Public Service Act 1999</i>.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-11__subclause-3A">
              <num>3A</num>
              <content>
                <p>(3A)	Sections 26 and 27 of the<i> Public Service Act</i><i> 1999</i> apply in relation to the person as if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-11__para-a">
              <num>a</num>
              <content>
                <p>the person were an APS employee in an Agency (within the meanings of that Act); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-b">
              <num>b</num>
              <content>
                <p>CSC were the Agency referred to in paragraph (a); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-c">
              <num>c</num>
              <content>
                <p>the chief executive officer (however described) of CSC were the Agency Head of the Agency referred to in paragraph (a).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-11__subclause-3B">
              <num>3B</num>
              <content>
                <p>(3B)	For the purpose of filling a vacancy that exists in an Agency (within the meaning of the <i>Public Service Act</i><i> 1999</i>):</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-11__para-a">
              <num>a</num>
              <content>
                <p>the person is taken to be an APS employee in an Agency (within the meanings of that Act); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-b">
              <num>b</num>
              <content>
                <p>CSC is taken to be the Agency referred to in paragraph (a).</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-11__subclause-3C">
              <num>3C</num>
              <content>
                <p>Subitems (3A) and (3B) have effect in relation to the person:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-11__para-a">
              <num>a</num>
              <content>
                <p>for the relevant period; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-b">
              <num>b</num>
              <content>
                <p>while the person remains employed by CSC (whether or not the person has been identified by CSC as excess or potentially excess); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-c">
              <num>c</num>
              <content>
                <p>as if the person continued to have the classification and category of APS employment that the person had immediately before commencement.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-11__subclause-3D">
              <num>3D</num>
              <content>
                <p>(3D)	If a person moves to an Agency under <i>Public Service Act</i><i> 1999</i> (as those sections apply under subitem (3A)), the person is taken to be engaged under section 22 of that Act by the Agency Head of that Agency, on behalf of the Commonwealth, as an APS employee in that Agency (within the meanings of the <i>Public Service Act</i><i> 1999</i>).<ref href="#sec-26">section 26</ref> or 27 of the </p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-11__subclause-3E">
              <num>3E</num>
              <content>
                <p>In this item:</p>
              </content>
            </hcontainer>
            <content>
              <p><b><i>relevant period</i></b>, means:</p>
            </content>
            <paragraph eId="schedule-2__clause-11__para-a">
              <num>a</num>
              <content>
                <p>in relation to the application of subitem (3A)—the period of 3 years from commencement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-b">
              <num>b</num>
              <content>
                <p>in relation to the application of subitem (3B)—whichever of the following periods ends earlier:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-i">
              <num>i</num>
              <content>
                <p>the period of 3 years from commencement;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-11__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	the period beginning on commencement and ending on the day on which clause 2.9A of the <i>Australian Public Service</i><i> Commissioner’s Directions 2013</i> (as in force at commencement) is modified or revoked so as to remove the restriction on notification of vacancies as being open only to persons who are APS employees.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-11__subclause-4">
              <num>4</num>
              <content>
                <p>To avoid doubt, a person referred to in subitem (1) who ceases to be a member of the staff of ComSuper is not entitled to receive any payment or other benefit merely because he or she ceased to be such a member.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-12">
            <num>12</num>
            <heading>Safety, Rehabilitation and Compensation Act 1988</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-12__subclause-1">
              <num>1</num>
              <content>
                <p>This item applies in relation to a person if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-12__para-a">
              <num>a</num>
              <content>
                <p>the person was a member of the staff of ComSuper before commencement (whether or not the person was still a member of the staff of ComSuper immediately before commencement); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-12__para-b">
              <num>b</num>
              <content>
                <p>	(b)	the person was an employee (within the meaning of the <i>Safety, Rehabilitation and Compensation Act 1988 </i>(the <b><i>SRC Act</i></b>)) of ComSuper; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-12__para-c">
              <num>c</num>
              <content>
                <p>the person suffered an injury (within the meaning of that Act) before commencement.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-12__subclause-2">
              <num>2</num>
              <content>
                <p>The SRC Act applies, after commencement, as if the person had been an employee of CSC during the period that the person was a member of the staff of ComSuper.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-12__subclause-3">
              <num>3</num>
              <content>
                <p>This item does not limit <ref href="#part-3">Part 3</ref> of this Schedule.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-13">
            <num>13</num>
            <heading>Long service leave for employees of CSC</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-13__subclause-1">
              <num>1</num>
              <content>
                <p>(1)	This item applies for the purposes of the <i>Long Service Leave (Commonwealth Employees) Act 1976 </i>(the <b><i>LSL Act</i></b>) in relation to a person if, immediately before commencement, the person is an employee of CSC.</p>
              </content>
            </hcontainer>
            <content>
              <p>Persons who have accrued long service leave entitlements before commencement</p>
              <p>Note:	A person’s long service leave credit under this subitem may be reduced if the person is granted long service leave (see <ref href="#sec-18">section 18</ref> of the LSL Act).</p>
              <p>Note:	The effect of this subitem is that from the day the person last accrued a long service leave credit, the person’s long service leave is worked out in accordance with the LSL Act instead of in accordance with the person’s previous employment conditions.</p>
              <p>Persons who have not accrued long service leave entitlements before commencement</p>
            </content>
            <hcontainer name="subclause" eId="schedule-2__clause-13__subclause-2">
              <num>2</num>
              <content>
                <p>Subitems (3) and (4) apply if the person had, before commencement, accrued an entitlement to long service leave (however described).</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-13__subclause-3">
              <num>3</num>
              <content>
                <p>At and after commencement, the person:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-13__para-a">
              <num>a</num>
              <content>
                <p>is taken to have a long service leave credit of the amount of the person’s long service leave credit immediately before commencement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-13__para-b">
              <num>b</num>
              <content>
                <p>is not entitled to any long service leave credit except under the LSL Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-13__subclause-4">
              <num>4</num>
              <content>
                <p>At and after commencement, the LSL Act applies to the person as if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-13__para-a">
              <num>a</num>
              <content>
                <p>the person’s service, before commencement, as an employee of CSC were employment in Government Service (within the meaning of the LSL Act); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-13__para-b">
              <num>b</num>
              <content>
                <p>the long service leave credit referred to in paragraph (3)(a) were accrued under the LSL Act in relation to that service.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-13__subclause-5">
              <num>5</num>
              <content>
                <p>If the person had, before commencement, not accrued an entitlement to long service leave (however described):</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-13__para-a">
              <num>a</num>
              <content>
                <p>the person’s service, before commencement, as an employee of CSC (beginning on the day the person most recently began as an employee of CSC) is to be treated, at and after commencement, as if it had been employment in Government Service (within the meaning of the LSL Act); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-13__para-b">
              <num>b</num>
              <content>
                <p>despite any provision of the LSL Act, any period of employment in a qualifying service (within the meaning of that Act) before the person began as an employee of CSC is taken not to be continuous with the person’s service as an employee of CSC.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-14">
            <num>14</num>
            <heading>Transfer of business</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-14__subclause-1">
              <num>1</num>
              <content>
                <p>(1)	The transfer of staff of ComSuper to CSC is a transfer of business for the purposes of the <i>Fair Work Act 2009</i>.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-14__subclause-2">
              <num>2</num>
              <content>
                <p>(2)	Despite <i>Fair Work Act 2009</i>, the only transferable instrument<b><i> </i></b>in relation to the transfer of business is the enterprise agreement that:<ref href="#sec-312">section 312</ref> of the </p>

            <heading>Financial statements and other reporting requirements for ComSuper</heading>

              <p>Reporting requirements</p>
              <p>CSC must provide the report, as required, for so much of the period as occurs before commencement.</p>
              <p>CSC may meet the requirements in a single report for the period.</p>
              <p>Outstanding reporting requirements</p>
              <p>CSC must provide the report as required.</p>
            </content>

                <p>If:</p>

                <p>the period ends after commencement;</p>
              </content>

            <heading>Amending instruments may be retrospective</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-16__subclause-1">
              <num>1</num>
              <content>
                <p>If:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-16__para-a">
              <num>a</num>
              <content>
                <p>an instrument is made within the period of 12 months beginning at commencement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-16__para-b">
              <num>b</num>

                <p>a provision of the instrument amends a reference to ComSuper or <role refersTo="#ceo">the CEO</role> of ComSuper in any other instrument;</p>

              <p>the provision may be expressed to take effect from commencement, or a later time in the period referred to in paragraph (a), that occurs before the instrument is made.</p>

                <p>(2)	This item has effect despite subsection 12(2) of the <i>Legislative Instruments Act 2003</i>.</p>

                <p>(3)	If Schedule 1 to the <i>Acts and Instruments (Framework Reform) Act 2015</i> commences before the end of the period referred to in paragraph (1)(a) of this item, subsection 12(2) (retrospective application of legislative instruments) of the <i>Legislation Act 2003 </i>(as amended by that Schedule) does not apply in relation to an instrument referred to in subitem (1).</p>

            <heading>Constitutional safety net—acquisition of property</heading>

                <p>If the operation of this Schedule would result in an acquisition of property from a person otherwise than on just terms, the Commonwealth is liable to pay a reasonable amount of compensation to the person.</p>

            <heading>Transfer of custody of records</heading>

                <p>Subitem (2) applies to any records or documents that, immediately before commencement, were in the custody of <role refersTo="#ceo">the CEO</role> of ComSuper.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-19__subclause-2">
              <num>2</num>
              <content>
                <p>The records and documents are to be transferred into the custody of the CSC at or after commencement.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	The transferred records and documents are Commonwealth records for the purposes of the <i>Archives Act 1983 </i>(see the definition of <b><i>Commonwealth record </i></b>in section 3 of that Act).</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-20">
            <num>20</num>
            <heading>Certificates taken to be authentic</heading>
            <content>
              <p>A document that appears to be a certificate made or issued under a particular provision of this Schedule:</p>
              <p>unless the contrary is established.</p>
            </content>
            <paragraph eId="schedule-2__clause-20__para-a">
              <num>a</num>
              <content>
                <p>is taken to be such a certificate; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-20__para-b">
              <num>b</num>
              <content>
                <p>is taken to have been properly given;</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-21">
            <num>21</num>
            <heading>Special Accounts</heading>
            <content>
              <p>There is to be credited to the CSC Special Account, after commencement, an amount equal to the balance standing to the credit of the ComSuper Special Account immediately before commencement.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-2__clause-22">
            <num>22</num>
            <heading>Rules</heading>
            <hcontainer name="subclause" eId="schedule-2__clause-22__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-2__clause-22__para-a">
              <num>a</num>
              <content>
                <p>	(a)	required or permitted by this Act<i> </i>to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-22__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-2__clause-22__subclause-2">
              <num>2</num>
              <content>
                <p>Without limiting subitem (1), the rules may prescribe matters of a transitional nature (including prescribing any saving or application provisions) relating to:</p>

            </hcontainer>
            <paragraph eId="schedule-2__clause-22__para-a">
              <num>a</num>
              <content>
                <p>the amendments or repeals made by this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-22__para-b">

                <p>the enactment of this Act.</p>
              </content>
            </paragraph>

                <p>Without limiting subitem (2), rules made for the purposes of that subitem may provide that the following Acts have effect with any modifications prescribed by the rules:</p>

              <num>a</num>
              <content>
                <p>	(a)	the <i>Fair Work Act 2009</i>;</p>
              </content>
            </paragraph>

                <p>	(b)	the <i>Fair Work (Transitional Provisions and Consequential Amendments) Act 2009</i>;</p>

            </paragraph>

                <p>	(c)	the <i>Public Service Act 1999</i>;</p>
              </content>
            </paragraph>

                <p>	(d)	the <i>Governance of Australian Government Superannuation Schemes Act 2011</i>;</p>

            </paragraph>

                <p>	(e)	the <i>Long Service Leave (Commonwealth Employees) Act 1976</i>.</p>

                <p>To avoid doubt, the rules may not do the following:</p>
              </content>

                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-22__para-b">

                <p>provide powers of:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-2__clause-22__para-i">
              <num>i</num>
              <content>
                <p>arrest or detention; or</p>
              </content>
            </paragraph>

              <num>ii</num>

                <p>entry, search or seizure;</p>

              <num>c</num>

                <p>impose a tax;</p>

                <p>set an amount to be appropriated from the Consolidated Revenue Fund under an appropriation in this Act;</p>

                <p>amend this Act.</p>

            </paragraph>

                <p>The costs of the administration of this Act and the Trust Deed, including the costs of and incidental to:</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>
                <p>the management of the PSSAP Fund by CSC; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-3__clause-34__para-b">
              <num>b</num>
              <content>
                <p>the investment of money from the PSSAP Fund;</p>
              </content>
            </paragraph>
            <content>
              <p>are to be paid by CSC out of the PSSAP Fund in accordance with the Trust Deed.</p>
              <p>Constitutional safety net—acquisition of property</p>
              <p><b><i>acquisition of property</i></b> has the same meaning as in paragraph 51(xxxi) of the Constitution.</p>
              <p><b><i>just terms</i></b> has the same meaning as in paragraph 51(xxxi) of the Constitution.</p>
