            <p>		This Act may be cited as the <i>Export Charges (Imposition—Excise)</i><i> Act 201</i><i>5</i>.</p>

          <heading>Commencement</heading>
          <subsection eId="part-1__sec-2__subsec-1">
            <num>1</num>
            <content>
              <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <heading>Act binds the Crown</heading>
          <content>
            <p>This Act binds the Crown in each of its capacities.</p>
          </content>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Extension of this Act to external Territories and other areas</heading>
          <subsection eId="part-1__sec-4__subsec-1">
            <num>1</num>
            <content>
              <p>Subject to subsection (2), this Act does not extend to the external Territories.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	If rules made for the purposes of paragraph 8(2)(a) of the <i>Export Control Act 2020</i> extend that Act, or any provisions of that Act, to an external Territory, then this Act extends to that external Territory.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	If rules made for the purposes of paragraph 8(2)(b) of the <i>Export Control Act 2020</i> extend that Act, or any provisions of that Act, to an area adjacent to an external Territory, then this Act extends to that area.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-4__subsec-4">
            <num>4</num>
            <content>
              <p>	(4)	If rules made for the purposes of paragraph 8(2)(c) of the <i>Export Control Act 2020</i> extend that Act, or any provisions of that Act, to an area outside the Australian fishing zone in relation to which the <i>Fisheries Management Act 1991</i> applies, under regulations made for the purposes of section 8 of the <i>Fisheries Management Act 1991</i>, then this Act extends to that area.</p>

        </section>
        <section eId="part-1__sec-6">
          <num>6</num>
          <heading>Act does not impose tax on property of a State</heading>
          <subsection eId="part-1__sec-6__subsec-1">
            <num>1</num>
            <content>
              <p>This Act does not impose a tax on property of any kind belonging to a State.</p>
            </content>
          </subsection>
          <subsection eId="part-1__sec-6__subsec-2">
            <num>2</num>
            <content>
              <p>In this section:</p>
            </content>
            <content>
              <p><b><i>property of any kind belonging to a State</i></b> has the same meaning as in section 114 of the Constitution.</p>
            </content>
          </subsection>
        </section>
      </part>

        <heading>Charges in relation to the export of certain goods</heading>
        <section eId="part-2__sec-7">
          <num>7</num>
          <heading>Imposition of charges</heading>
          <subsection eId="part-2__sec-7__subsec-1">
            <num>1</num>
            <content>
              <p>	(1)	The regulations may prescribe a charge in relation to the export of a kind of goods covered by the <i>Export Control Act 2020</i>.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-2">
            <num>2</num>
            <content>
              <p>The charges prescribed for the purposes of subsection (1) are imposed as taxes.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-3">
            <num>3</num>
            <content>
              <p>Two or more charges may be prescribed in relation to the same kind of goods, and a single charge may be prescribed in relation to 2 or more kinds of goods.</p>
            </content>
          </subsection>
          <subsection eId="part-2__sec-7__subsec-4">
            <num>4</num>
            <content>
              <p>This section imposes a charge only so far as that charge is a duty of excise <ref href="#sec-55">within the meaning of section 55</ref> of the Constitution.</p>
            </content>
          </subsection>

          <num>8</num>
          <heading>Matters relating to amount of charges</heading>
          <subsection eId="part-2__sec-8__subsec-1">
            <num>1</num>
            <content>
              <p>The regulations may prescribe a charge for the purposes of subsection 7(1):</p>
            </content>
            <paragraph eId="part-2__sec-8__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>by specifying an amount as the charge; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-2__sec-8__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>by specifying a method for calculating the amount of the charge.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-2__sec-8__subsec-2">
            <num>2</num>
            <content>
              <p>Before the Governor-General makes regulations for the purposes of subsection 7(1) prescribing a charge in relation to the export of a kind of goods, <role refersTo="#minister">the Minister</role> must be satisfied that the amount of the charge is set at a level that is designed to recover no more than the Commonwealth’s likely costs in connection with the export of the goods.</p>

          <num>10</num>
          <heading>Exemptions from charges</heading>
          <content>
            <p>The regulations may provide for exemptions from a charge prescribed for the purposes of subsection 7(1).</p>

        <heading>Charges in relation to certain matters relating to the export of certain goods</heading>
        <section eId="part-3__sec-11">
          <num>11</num>
          <heading>Imposition of charges</heading>
          <subsection eId="part-3__sec-11__subsec-1">
            <num>1</num>
            <content>
              <p>The regulations may prescribe a charge in relation to a matter relating to the export of a kind of goods if:</p>
            </content>
            <paragraph eId="part-3__sec-11__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the export of goods of that kind is covered by the <i>Export Control Act 2020</i>; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-11__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>	(b)	provision in relation to the matter is made under the <i>Export Control Act 2020</i>.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-2">
            <num>2</num>
            <content>
              <p>The charges prescribed for the purposes of subsection (1) are imposed as taxes.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-11__subsec-3">
            <num>3</num>
            <content>
              <p>Two or more charges may be prescribed in relation to the same matter, and a single charge may be prescribed in relation to 2 or more matters.</p>

          <heading>Regulations</heading>

            <p>The Governor-General may make regulations prescribing matters:</p>
          </content>

              <p>required or permitted by this Act to be prescribed; or</p>
            </content>
          </paragraph>

                <b>Editorial changes</b>
              </p>
              <p>The <i>Legislation Act 2003</i> authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.</p>
              <p>If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.</p>

                <b>Misdescribed amendments</b>
              </p>
              <p>A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.</p>
              <p>If a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.</p>
