        <heading>Short title</heading>

          <p>		This Act is the <i>Civil Nuclear Transfers </i><i>to India </i><i>Act 201</i><i>6</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

            <p>Any information in column 3 of the table is not part of this Act. Information may be inserted in this column, or information in it may be edited, in any published version of this Act.</p>

      <section eId="sec-3">
        <num>3</num>
        <heading>Object of this Act</heading>
        <content>
          <p>The object of this Act is to codify, for the purposes of some Acts and legislative instruments, the content of Australia’s obligations, responsibilities and commitments, under the specified international agreements, in relation to the nuclear safeguards to be applied in India.</p>

        <num>4</num>
        <heading>Simplified outline of this Act</heading>
        <content>
          <p>Authorisations must be granted under particular legislation before nuclear material and nuclear-related items can be exported from Australia.</p>
          <p>Australia has obligations under international agreements in relation to safeguards to be applied in countries to which nuclear material and nuclear-related items are exported.</p>
          <p>This Act provides that, if particular conditions are met:</p>

        <paragraph eId="sec-4__para-a">
          <num>a</num>
          <content>
            <p>the exercise of powers or performance of functions under particular legislation is taken not to be inconsistent with Australia’s obligations; and</p>
          </content>
        </paragraph>
        <paragraph eId="sec-4__para-b">
          <num>b</num>
          <content>
            <p>the person exercising powers or performing functions under particular legislation is taken to have had due regard to Australia’s obligations, responsibilities and commitments;</p>
          </content>
          <content>
            <p>under specified international agreements, in relation to the safeguards to be applied in India.</p>
            <p>The conditions relate to specific agreements with India which deal with safeguards.</p>
          </content>
        </paragraph>
      </section>
      <section eId="sec-5">
        <num>5</num>
        <heading>Definitions</heading>
        <content>
          <p>In this Act:</p>
          <p><term refersTo="#term-australia-india-agreement">Australia-India agreement</term> means <def>the Agreement between the Government of Australia and the Government of India on Cooperation in the Peaceful Uses of Nuclear Energy done at New Delhi on 5 September 2014, as amended from time to time.</def></p>
          <p><term refersTo="#term-export-from-australia">export from Australia</term> includes <def>supply from a place in Australia to a place outside Australia.</def></p>
          <p><term refersTo="#term-india-iaea-agreement">India-IAEA agreement</term> means <def>the following, as amended from time to time:</def></p>

          <num>a</num>
          <content>
            <p>the Agreement between the Government of India and the International Atomic Energy Agency for the Application of Safeguards to Civilian Nuclear Facilities done at Vienna on <date date="2009-02-02">2 February 2009</date>;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-b">
          <num>b</num>
          <content>
            <p>the Protocol Additional to the Agreement between the Government of India and the International Atomic Energy Agency for the Application of Safeguards to Civilian Nuclear Facilities done at Vienna on <date date="2009-05-15">15 May 2009</date>.</p>

          <content>
            <p><term refersTo="#term-nuclear-material">nuclear material</term> has the same meaning as <def>in the Australia-India agreement.</def></p>
            <p><term refersTo="#term-nuclear-related-item">nuclear-related item</term> means <def>any of the following, within the meaning of the Australia-India agreement: a component; equipment; non-nuclear material; technology.</def></p>

          <num>a</num>
          <content>
            <p>a component;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-b">
          <num>b</num>
          <content>
            <p>equipment;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-c">
          <num>c</num>
          <content>
            <p>non-nuclear material;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-d">
          <num>d</num>
          <content>
            <p>technology.</p>
          </content>
          <content>
            <p><term refersTo="#term-rules">rules</term> means <def>rules made under <ref href="#sec-10">section 10</ref>.</def></p>
            <p><term refersTo="#term-specified-international-agreements">specified international agreements</term> means <def>the following: the Treaty on the Non-Proliferation of Nuclear Weapons done at London, Moscow and Washington on <date date="1968-07-01">1 July 1968</date>; the South Pacific Nuclear Free Zone Treaty done at Rarotonga on <date date="1985-08-06">6 August 1985</date>.</def></p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-a">
          <num>a</num>
          <content>
            <p>the Treaty on the Non-Proliferation of Nuclear Weapons done at London, Moscow and Washington on <date date="1968-07-01">1 July 1968</date>;</p>
          </content>
        </paragraph>
        <paragraph eId="sec-5__para-b">
          <num>b</num>
          <content>
            <p>the South Pacific Nuclear Free Zone Treaty done at Rarotonga on <date date="1985-08-06">6 August 1985</date>.</p>

      <section eId="sec-6">
        <num>6</num>
        <heading>Act extends to external Territories</heading>
        <content>
          <p>This Act extends to every external Territory.</p>
        </content>
      </section>
      <section eId="sec-7">
        <num>7</num>
        <heading>Act binds the Crown</heading>
        <content>
          <p>This Act binds the Crown in each of its capacities.</p>
        </content>
      </section>
      <section eId="sec-8">
        <num>8</num>
        <heading>Requirements applying to export of nuclear material and nuclear-related items</heading>
        <subsection eId="sec-8__subsec-1">
          <num>1</num>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="sec-8__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>a power is exercised, or a function is performed, for the purposes of:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-1__para-i">
            <num>i</num>
            <content>
              <p>	(i)	the <i>Nuclear Non</i><i>-</i><i>Proliferation (Safeguards) Act 1987</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-1__para-ii">
            <num>ii</num>
            <content>
              <p>an Act or legislative instrument prescribed by the rules for the purposes of this subparagraph; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>the conditions in subsection (3) are met at the time the power or function is exercised or performed;</p>
            </content>
            <content>
              <p>then, so far as the exercise or performance is in connection with the export from Australia of nuclear material or of a nuclear-related item, it is taken not to be inconsistent with Australia’s obligations, under the specified international agreements, in relation to the nuclear safeguards to be applied in India.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-8__subsec-2">
          <num>2</num>
          <content>
            <p>If:</p>
          </content>
          <paragraph eId="sec-8__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>a power is exercised, or a function is performed, by a person for the purposes of:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>	(i)	the <i>Defence Trade Controls Act 2012</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>	(ii)	the <i>Customs (Prohibited Exports) Regulations</i><i> </i><i>1958</i>; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-2__para-iii">
            <num>iii</num>
            <content>
              <p>an Act or legislative instrument prescribed by the rules for the purposes of this subparagraph; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>the conditions in subsection (3) are met at the time the power or function is exercised or performed;</p>
            </content>
            <content>
              <p>then, so far as the exercise or performance is in connection with the export from Australia of nuclear material or of a nuclear-related item, the person is taken to have had due regard to Australia’s obligations, responsibilities and commitments, under the specified international agreements, in relation to the nuclear safeguards to be applied in India.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-8__subsec-3">
          <num>3</num>
          <content>
            <p>The conditions are:</p>
          </content>
          <paragraph eId="sec-8__subsec-3__para-a">
            <num>a</num>
            <content>
              <p>the Australia-India agreement is in force; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-3__para-b">
            <num>b</num>
            <content>
              <p>the India-IAEA agreement is in force; and</p>
            </content>
          </paragraph>
          <paragraph eId="sec-8__subsec-3__para-c">
            <num>c</num>
            <content>
              <p>the person exercising the power or performing the function is satisfied that the nuclear material or nuclear-related item will be subject to safeguards under the India-IAEA agreement if supplied to a place in India.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-8__subsec-4">
          <num>4</num>
          <content>
            <p>This section applies to the exercise of a power or performance of a function before, on or after commencement of this Act.</p>
          </content>
        </subsection>
      </section>
      <section eId="sec-9">
        <num>9</num>
        <heading>Amendment of the India-IAEA agreement</heading>
        <content>
          <p>If the India-IAEA agreement is amended, <role refersTo="#minister">the Minister</role> must, by notifiable instrument, give notice of the amendment.</p>
        </content>
      </section>
      <section eId="sec-10">
        <num>10</num>
        <heading>Rules</heading>
        <subsection eId="sec-10__subsec-1">
          <num>1</num>
          <content>
            <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
          </content>
          <paragraph eId="sec-10__subsec-1__para-a">
            <num>a</num>
            <content>
              <p>required or permitted by this Act to be prescribed by the rules; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-1__para-b">
            <num>b</num>
            <content>
              <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
            </content>
          </paragraph>
        </subsection>
        <subsection eId="sec-10__subsec-2">
          <num>2</num>
          <content>
            <p>To avoid doubt, the rules may not do the following:</p>
          </content>
          <paragraph eId="sec-10__subsec-2__para-a">
            <num>a</num>
            <content>
              <p>create an offence or civil penalty;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-2__para-b">
            <num>b</num>
            <content>
              <p>provide powers of:</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-2__para-i">
            <num>i</num>
            <content>
              <p>arrest or detention; or</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-2__para-ii">
            <num>ii</num>
            <content>
              <p>entry, search or seizure;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-2__para-c">
            <num>c</num>
            <content>
              <p>impose a tax;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-2__para-d">
            <num>d</num>
            <content>
              <p>set an amount to be appropriated from the Consolidated Revenue Fund under an appropriation in this Act;</p>
            </content>
          </paragraph>
          <paragraph eId="sec-10__subsec-2__para-e">
            <num>e</num>
            <content>
              <p>directly amend the text of this Act.</p>
