        <heading>Short title</heading>
        <content>
          <p>		This Act may be cited as the <i>Crimes Legislation Amendment</i><i> </i><i>(Proceeds of Crime and Other Measures) </i><i>Act 201</i><i>6</i>.</p>

        <num>2</num>
        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

        <heading>Schedules</heading>
        <content>
          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

            <heading>Subsection 266A(2)</heading>
            <content>
              <p>Omit all the words after “in that item”, substitute:</p>
              <p>if:</p>
            </content>

                <p>the person believes on reasonable grounds that the disclosure will serve that purpose; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-b">

                <p>a court has not made an order prohibiting the disclosure of the information to <role refersTo="#authority">the authority</role> for that purpose.</p>

            <heading>Section 315A</heading>
            <content>
              <p>Before “A court”, insert “(1)”.</p>
            </content>
          </hcontainer>

            <num>3</num>
            <heading>At the end of section 315A</heading>
            <content>
              <p>Add:</p>
              <p>the court may only hear the application for the forfeiture order after the application for the exclusion order has been determined<i>.</i></p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-3__subclause-2">
              <num>2</num>
              <content>
                <p>However, if:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-3__para-a">
              <num>a</num>
              <content>
                <p>a *proceeds of crime authority applies for a *forfeiture order relating to particular property; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-b">
              <num>b</num>
              <content>
                <p>	(b)	a person applies for an order (the <b><i>exclusion order</i></b>) under section 29 or 29A to exclude a specified *interest in that property from a *restraining order; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3__para-c">
              <num>c</num>
              <content>
                <p>the application for the exclusion order has not been withdrawn;</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-4">
            <num>4</num>
            <heading>Section 319</heading>
            <content>
              <p>Repeal the section, substitute:</p>
            </content>
          </hcontainer>

            <num>319</num>
            <heading>Stay of proceedings</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-319__subclause-1">
              <num>1</num>
              <content>
                <p>	(1)	A court may stay proceedings (the <b><i>POCA proceedings</i></b>) under this Act that are not criminal proceedings if the court considers that it is in the interests of justice to do so.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-319__subclause-2">
              <num>2</num>
              <content>
                <p>The court must not stay the POCA proceedings on any or all of the following grounds:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-319__para-a">
              <num>a</num>
              <content>
                <p>on the ground that criminal proceedings have been, are proposed to be or may be instituted or commenced (whether or not under this Act) against the person subject to the POCA proceedings;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-319__para-b">
              <num>b</num>
              <content>
                <p>on the ground that criminal proceedings have been, are proposed to be or may be instituted or commenced (whether or not under this Act) against another person in respect of matters relating to the subject matter of the POCA proceedings;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-319__para-c">
              <num>c</num>
              <content>
                <p>on the ground that:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-319__para-i">
              <num>i</num>
              <content>
                <p>a person may consider it necessary to give evidence, or to call evidence from another person, in the POCA proceedings; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-319__para-ii">
              <num>ii</num>
              <content>
                <p>the evidence is or may be relevant (to whatever extent) to a matter that is, or may be, at issue in criminal proceedings that have been, are proposed to be or may be instituted or commenced (whether or not under this Act) against the person or any other person;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-319__para-d">
              <num>d</num>
              <content>
                <p>on the ground that POCA proceedings in relation to another person have been, are to be or may be stayed.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-319__subclause-3">
              <num>3</num>
              <content>
                <p>Paragraph (2)(a) applies even if the circumstances pertaining to the POCA proceedings are or may be the same as, or substantially similar to, the circumstances pertaining to the criminal proceedings.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-319__subclause-4">
              <num>4</num>
              <content>
                <p>Paragraph (2)(b) applies even if the subject matter of the POCA proceedings is the same as, or substantially similar to, the matter at issue in the criminal proceedings.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-319__subclause-5">
              <num>5</num>
              <content>
                <p>Paragraph (2)(d) applies even if the staying of the POCA proceedings would avoid a multiplicity of POCA proceedings.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-319__subclause-6">
              <num>6</num>
              <content>
                <p>In considering whether a stay of the POCA proceedings is in the interests of justice, the court must have regard to the following matters:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-319__para-a">
              <num>a</num>
              <content>
                <p>that the POCA proceedings, and any criminal proceedings of a kind referred to in paragraph (2)(a) or (b), should proceed as expeditiously as possible;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-319__para-b">
              <num>b</num>
              <content>
                <p>the cost and inconvenience to the Commonwealth of retaining property to which the POCA proceeding relates and being unable to expeditiously realise its proceeds;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-319__para-c">
              <num>c</num>
              <content>
                <p>the risk of a *proceeds of crime authority suffering any prejudice (whether general or specific) in relation to the conduct of the POCA proceedings if the proceedings were stayed;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-319__para-d">
              <num>d</num>
              <content>
                <p>whether any prejudice that a person (other than a proceeds of crime authority) would suffer if the POCA proceedings were not stayed may be addressed by the court by means other than a stay of the proceedings;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-319__para-e">
              <num>e</num>
              <content>
                <p>any orders (other than an order for the stay of the POCA proceedings) that the court could make to address any prejudice that a person (other than a proceeds of crime authority) would suffer if the proceedings were not stayed.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	Examples of orders the court could make to address any prejudice that a person (other than a proceeds of crime authority) would suffer if the POCA proceedings were not stayed include an order under <ref href="#sec-319A">section 319A</ref> (closed court) or an order prohibiting the disclosure of information.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-319A">
            <num>319A</num>
            <heading>Closed court</heading>
            <content>
              <p>A court may order that proceedings under this Act (other than criminal proceedings) be heard, in whole or in part, in closed court if the court considers that the order is necessary to prevent interference with the administration of criminal justice.</p>
            </content>

            <num>5</num>
            <heading>Application provisions</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-1">
              <num>1</num>
              <content>
                <p>(1)	Subsection 266A(2) of the <i>Proceeds of Crime Act 2002</i>, as amended by this Schedule, applies in relation to the disclosure of information after the commencement of this item, whether the information was obtained before or after that commencement.</p>
              </content>

            <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-2">
              <num>2</num>
              <content>
                <p>(2)	Subsection 315A(2) of the <i>Proceeds of Crime Act 2002</i>, as inserted by this Schedule, applies in relation to an application made after the commencement of this item:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5__para-a">
              <num>a</num>
              <content>
                <p>whether the application relates to an interest in property acquired before or after that commencement; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-b">
              <num>b</num>
              <content>
                <p>whether the application relates to conduct that occurred before or after that commencement.</p>
              </content>
            </paragraph>

              <num>3</num>
              <content>
                <p>(3)	Sections 319 and 319A of the <i>Proceeds of Crime Act 2002</i>, as inserted by this Schedule, apply in relation to proceedings instituted or commenced before or after the commencement of this item.</p>

              <heading>Intentional false dealing with accounting documents</heading>

                <num>1</num>
                <content>
                  <p>A person commits an offence if:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-a">
                <num>a</num>
                <content>
                  <p>the person:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-i">
                <num>i</num>
                <content>
                  <p>makes, alters, destroys or conceals an accounting document; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-ii">
                <num>ii</num>
                <content>
                  <p>fails to make or alter an accounting document that the person is under a duty, under a law of the Commonwealth, a State or Territory or at common law, to make or alter; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-b">
                <num>b</num>
                <content>
                  <p>the person intended the making, alteration, destruction or concealment of the document (or the failure to make or alter the document) to facilitate, conceal or disguise the occurrence of one or more of the following:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-i">
                <num>i</num>
                <content>
                  <p>the person receiving a benefit that is not legitimately due to the person;</p>
                </content>
              </paragraph>

                  <p>the person giving a benefit that is not legitimately due to the recipient, or intended recipient, of the benefit;</p>
                </content>
              </paragraph>

                  <p>another person receiving a benefit that is not legitimately due to the other person;</p>
                </content>
              </paragraph>

                  <p>another person giving a benefit that is not legitimately due to the recipient, or intended recipient, of the benefit (who may be the first-mentioned person);</p>
                </content>
              </paragraph>

                <num>v</num>
                <content>
                  <p>loss to another person that is not legitimately incurred by the other person; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-c">
                <num>c</num>
                <content>
                  <p>one or more of the circumstances referred to in subsection (2) applies.</p>
                </content>
              </paragraph>

                <num>2</num>
                <content>
                  <p>For the purposes of paragraph (1)(c) of this section or paragraph 490.2(1)(c), the circumstances are:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-a">
                <num>a</num>
                <content>
                  <p>the person is:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-i">
                <num>i</num>
                <content>
                  <p>a constitutional corporation, or a corporation that is incorporated in a Territory; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-ii">
                <num>ii</num>
                <content>
                  <p>an officer or employee of a constitutional corporation acting in the performance of his or her duties or the carrying out of his or her functions; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-iii">
                <num>iii</num>
                <content>
                  <p>a person engaged to provide services to a constitutional corporation and acting in the course of providing those services; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-iv">
                <num>iv</num>
                <content>
                  <p>a Commonwealth public official acting in the performance of his or her duties or the carrying out of his or her functions; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-b">
                <num>b</num>
                <content>
                  <p>the person’s act or omission referred to in paragraph (1)(a):</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-i">
                <num>i</num>
                <content>
                  <p>occurs in a Territory; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-ii">
                <num>ii</num>
                <content>
                  <p>occurs outside Australia; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-iii">
                <num>iii</num>
                <content>
                  <p>concerns matters or things outside Australia; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-iv">
                <num>iv</num>
                <content>
                  <p>facilitates or conceals the commission of an offence against a law of the Commonwealth; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-c">
                <num>c</num>
                <content>
                  <p>the accounting document:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-i">
                <num>i</num>
                <content>
                  <p>is outside Australia; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-ii">
                <num>ii</num>
                <content>
                  <p>is in a Territory; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-iii">
                <num>iii</num>
                <content>
                  <p>is kept under or for the purposes of a law of the Commonwealth; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-iv">
                <num>iv</num>
                <content>
                  <p>is kept to record the receipt or use of Australian currency.</p>
                </content>
              </paragraph>
              <hcontainer name="subclause" eId="schedule-2__clause-1__subclause-490-1__subclause-3">
                <num>3</num>
                <content>
                  <p>Absolute liability applies to paragraph (1)(c).</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-2__clause-1__subclause-490-1__subclause-4">
                <num>4</num>
                <content>
                  <p>An offence against this section committed by an individual is punishable on conviction by imprisonment for not more than 10 years, a fine not more than <quantity refersTo="#penaltyUnit">10,000 penalty units</quantity>, or both.</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-2__clause-1__subclause-490-1__subclause-5">
                <num>5</num>
                <content>
                  <p>An offence against this section committed by a body corporate is punishable on conviction by a fine not more than the greatest of the following:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-a">
                <num>a</num>
                <content>
                  <p><quantity refersTo="#penaltyUnit">100,000 penalty units</quantity>;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-b">
                <num>b</num>
                <content>
                  <p>if the court can determine the value of the benefit that the body corporate, and any body corporate related to the body corporate, have obtained directly or indirectly and that is reasonably attributable to the conduct constituting the offence—3 times the value of that benefit;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-1__para-c">
                <num>c</num>
                <content>
                  <p>	(c)	if the court cannot determine the value of that benefit—10% of the annual turnover of the body corporate during the period (the <b><i>turnover period</i></b>) of 12 months ending at the end of the month in which the conduct constituting the offence occurred.</p>

              <heading>Reckless false dealing with accounting documents</heading>
              <hcontainer name="subclause" eId="schedule-2__clause-1__subclause-490-2__subclause-1">
                <num>1</num>
                <content>
                  <p>A person commits an offence if:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-2__clause-1__subclause-490-2__para-a">
                <num>a</num>
                <content>
                  <p>the person:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-2__para-i">
                <num>i</num>
                <content>
                  <p>makes, alters, destroys or conceals an accounting document; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-2__para-ii">
                <num>ii</num>
                <content>
                  <p>fails to make or alter an accounting document that the person is under a duty, under a law of the Commonwealth, a State or Territory or at common law, to make or alter; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-2__para-b">
                <num>b</num>
                <content>
                  <p>the person is reckless as to whether the making, alteration, destruction or concealment of the document (or the failure to make or alter the document) facilitates, conceals or disguises the occurrence of one or more of the following:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-2__para-i">
                <num>i</num>
                <content>
                  <p>the person receiving a benefit that is not legitimately due to the person;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-2__para-ii">
                <num>ii</num>
                <content>
                  <p>the person giving a benefit that is not legitimately due to the recipient, or intended recipient, of the benefit;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-2__para-iii">
                <num>iii</num>
                <content>
                  <p>another person receiving a benefit that is not legitimately due to the other person;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-2__para-iv">
                <num>iv</num>
                <content>
                  <p>another person giving a benefit that is not legitimately due to the recipient, or intended recipient, of the benefit (who may be the first-mentioned person);</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-2__para-v">
                <num>v</num>
                <content>
                  <p>loss to another person that is not legitimately incurred by the other person; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-2__para-c">
                <num>c</num>
                <content>
                  <p>one or more of the circumstances referred to in subsection 490.1(2) applies.</p>
                </content>
              </paragraph>
              <hcontainer name="subclause" eId="schedule-2__clause-1__subclause-490-2__subclause-2">
                <num>2</num>
                <content>
                  <p>Absolute liability applies to paragraph (1)(c).</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-2__clause-1__subclause-490-2__subclause-3">
                <num>3</num>
                <content>
                  <p>An offence against this section committed by an individual is punishable on conviction by imprisonment for not more than 5 years, a fine not more than <quantity refersTo="#penaltyUnit">5,000 penalty units</quantity>, or both.</p>
                </content>
              </hcontainer>
              <hcontainer name="subclause" eId="schedule-2__clause-1__subclause-490-2__subclause-4">
                <num>4</num>
                <content>
                  <p>An offence against this section committed by a body corporate is punishable on conviction by a fine not more than the greatest of the following:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-2__clause-1__subclause-490-2__para-a">
                <num>a</num>
                <content>
                  <p><quantity refersTo="#penaltyUnit">50,000 penalty units</quantity>;</p>
                </content>
              </paragraph>

                  <p>if the court can determine the value of the benefit that the body corporate, and any body corporate related to the body corporate, have obtained directly or indirectly and that is reasonably attributable to the conduct constituting the offence—1.5 times the value of that benefit;</p>

              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-2__para-c">
                <num>c</num>
                <content>
                  <p>	(c)	if the court cannot determine the value of that benefit—5% of the annual turnover of the body corporate during the period (the <b><i>turnover period</i></b>) of 12 months ending at the end of the month in which the conduct constituting the offence occurred.</p>

              <num>490.3</num>
              <heading>Meaning of annual turnover</heading>
              <hcontainer name="subclause" eId="schedule-2__clause-1__subclause-490-3__subclause-1">
                <num>1</num>
                <content>
                  <p>	(1)	For the purposes of this Division, the <b><i>annual turnover</i></b> of a body corporate, during the turnover period, is the sum of the values of all the supplies that the body corporate, and any body corporate related to the body corporate, have made, or are likely to make, during that period, other than the following supplies:</p>

              </hcontainer>
              <paragraph eId="schedule-2__clause-1__subclause-490-3__para-a">
                <num>a</num>
                <content>
                  <p>supplies made from any of those bodies corporate to any other of those bodies corporate;</p>
                </content>
              </paragraph>

                <num>b</num>
                <content>
                  <p>supplies that are input taxed;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-3__para-c">
                <num>c</num>
                <content>
                  <p>	(c)	supplies that are not for consideration (and are not taxable supplies under <i>A New Tax System (Goods and Services Tax) Act 1999</i>);<ref href="#sec-72">section 72</ref>-5 of the </p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-3__para-d">
                <num>d</num>
                <content>
                  <p>supplies that are not made in connection with an enterprise that the body corporate carries on.</p>
                </content>
              </paragraph>
              <hcontainer name="subclause" eId="schedule-2__clause-1__subclause-490-3__subclause-2">
                <num>2</num>
                <content>
                  <p>	(2)	Expressions used in this section that are also used in the <i>A New Tax System (Goods and Services Tax) Act 1999</i> have the same meaning in this section as they have in that Act.</p>

            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-1__subclause-490-4">
              <num>490.4</num>
              <heading>Related bodies corporate</heading>
              <content>
                <p>		The question whether 2 bodies corporate are related to each other is to be determined for the purposes of this Division in the same way as for the purposes of the <i>Corporations Act 2001</i>.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-1__subclause-490-5">
              <num>490.5</num>
              <heading>Proof of certain matters unnecessary</heading>
              <content>
                <p>In a prosecution for an offence against this Division, it is not necessary to prove:</p>
              </content>
              <paragraph eId="schedule-2__clause-1__subclause-490-5__para-a">
                <num>a</num>
                <content>
                  <p>the occurrence of any of the following:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-5__para-i">
                <num>i</num>
                <content>
                  <p>the defendant receiving or giving a benefit;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-5__para-ii">
                <num>ii</num>
                <content>
                  <p>another person receiving or giving a benefit;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-5__para-iii">
                <num>iii</num>
                <content>
                  <p>loss to another person; or</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-5__para-b">
                <num>b</num>
                <content>
                  <p>that the defendant intended that a particular person receive or give a benefit, or incur a loss.</p>
                </content>
              </paragraph>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-2__clause-1__subclause-490-6">
              <num>490.6</num>
              <heading>Consent to commencement of proceedings</heading>
              <hcontainer name="subclause" eId="schedule-2__clause-1__subclause-490-6__subclause-1">
                <num>1</num>
                <content>
                  <p>Proceedings for an offence against this Division must not be commenced without the Attorney-General’s written consent if:</p>
                </content>
              </hcontainer>
              <paragraph eId="schedule-2__clause-1__subclause-490-6__para-a">
                <num>a</num>
                <content>
                  <p>the conduct constituting the alleged offence occurs wholly in a foreign country; and</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-6__para-b">
                <num>b</num>
                <content>
                  <p>at the time of the alleged offence, the person alleged to have committed the offence is none of the following:</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-6__para-i">
                <num>i</num>
                <content>
                  <p>an Australian citizen;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-6__para-ii">
                <num>ii</num>
                <content>
                  <p>a resident of Australia;</p>
                </content>
              </paragraph>
              <paragraph eId="schedule-2__clause-1__subclause-490-6__para-iii">
                <num>iii</num>
                <content>
                  <p>a body corporate incorporated by or under a law of the Commonwealth or of a State or Territory.</p>
                </content>
              </paragraph>
              <hcontainer name="subclause" eId="schedule-2__clause-1__subclause-490-6__subclause-2">
                <num>2</num>
                <content>
                  <p>However, a person may be arrested for, charged with, or remanded in custody or released on bail in connection with an offence against this Division before the necessary consent has been given.</p>

              <num>490.7</num>
              <heading>Saving of other laws</heading>
              <content>
                <p>This Division is not intended to exclude or limit the operation of any other law of the Commonwealth or any law of a State or Territory.</p>

            <heading>Dictionary of the Criminal Code</heading>
