          <p>		This Act may be cited as the <i>Aged Care Legislation Amendment (Increasing Consumer Choice)</i><i> Act 201</i><i>6</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

                <p>the applicant’s demonstrated understanding of its responsibilities as a provider of the type of care for which approval is sought; and</p>
              </content>
            </paragraph>

                <p>the systems that the applicant has, or proposes to have, in place to meet its responsibilities as a provider of the type of care for which approval is sought; and</p>
              </content>
            </paragraph>

                <p>the applicant’s record of financial management, and the methods that the applicant uses, or proposes to use, in order to ensure sound financial management; and</p>
              </content>
            </paragraph>

                <p>if the applicant has been a provider of aged care—its conduct as a provider, and its compliance with its responsibilities as a provider and obligations arising from the receipt of any payments from the Commonwealth for providing that aged care; and</p>

                <p>An approved provider must notify <role refersTo="#secretary">the Secretary</role> of the following information in relation to each home care service through which the approved provider proposes to provide home care:</p>
              </content>

              <content>
                <p>the name and address of the service;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-9-1A__para-b">

                <p>any other information of a kind specified in the Approved Provider Principles for the purposes of this section.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	Approved providers have a responsibility under <ref href="#part-4">Part 4</ref>.3 to comply with this obligation. Failure to comply with a responsibility can result in a sanction being imposed under <ref href="#part-4">Part 4</ref>.4.</p>
            </content>

                <p>The notification must be made before the approved provider first provides home care through the home care service.</p>
              </content>
            </hcontainer>

                <p>The notification must be in the form approved by <role refersTo="#secretary">the Secretary</role>.</p>

                <p>If <role refersTo="#secretary">the Secretary</role> approves a person as a recipient of home care, <role refersTo="#secretary">the Secretary</role> must determine the person’s priority for home care services.</p>

                <p><role refersTo="#secretary">The Secretary</role> may, at any time, vary a person’s priority for home care services determined under subsection (1), including any priority for home care services varied under this subsection.</p>

                <p>At the commencement time, the allocation of the place ceases to have effect.</p>

            <heading>Priority for home care services</heading>

                <p>(1)	Subsection 22-2A(1) of the new law applies to persons approved under <i>Aged Care Act 1997</i> as recipients of home care after the commencement time.<ref href="#part-2">Part 2</ref>.3 of the </p>

                <p>A determination of a person’s priority for home care services under subitem (2) must be consistent with the care needs of the person.</p>

                <p>A determination of a person’s priority for home care services under subitem (2) is taken, for the purposes of the new law, to be a determination of the person’s priority for home care services under subsection 22-2A(1) of the new law.</p>

                <p>(1)	This item applies if an approved provider is eligible under <i>Aged Care Act 1997</i> or section 46-1 of the <i>Aged Care (Transitional Provisions) Act 1997</i> for home care subsidy in respect of the day (the <b><i>relevant day</i></b>) immediately preceding the day this item commences, because:<ref href="#sec-46">section 46</ref>-1 of the </p>

            </hcontainer>
            <paragraph eId="schedule-1__clause-78__para-a">
              <num>a</num>
              <content>
                <p>	(a)	during the relevant day the approved provider holds an allocation of a place for home care subsidy that is in force under <i>Aged Care Act 1997</i>; and<ref href="#part-2">Part 2</ref>.2 of the </p>

            </paragraph>
            <paragraph eId="schedule-1__clause-78__para-b">
              <num>b</num>
              <content>
                <p>	(b)	during the relevant day there is in force a home care agreement under which a care recipient, approved under <i>Aged Care Act 1997</i> in respect of home care, is to be provided with home care in respect of the place by the approved provider.<ref href="#part-2">Part 2</ref>.3 of the </p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-78__subclause-2">
              <num>2</num>
              <content>
                <p>At the commencement time, <role refersTo="#secretary">the Secretary</role> is taken to have, by written notice given to the care recipient on the day this item commences, made a determination under section 23B-1 of the new law that the care recipient is a prioritised home care recipient in relation to the level of care being provided to the care recipient immediately before the commencement time.</p>

              <num>3</num>

                <p>This item does not prevent the variation or cessation, on or after the commencement time, of a determination referred to in subitem (2).</p>

            <heading>Unspent home care amount</heading>

                <p>(1)	Paragraph 46-1(1)(f) of the <i>Aged Care Act 1997</i> and the <i>Aged Care (Transitional Provisions) Act 1997</i>, as inserted by this Schedule, applies in relation to any unspent home care amount that relates to home care subsidy, and home care fees, that were or are payable in respect of 1 July 2015 or any later day.</p>

            <heading>Responsibilities of approved providers</heading>
            <content>
              <p>To avoid doubt, paragraph 63-1(1)(e) of the old law continues to apply in relation to a place allocated in respect of home care subsidy that is transferred before the commencement time.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-81">
            <num>81</num>
            <heading>Information about number of places included in home care services before commencement</heading>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, at any time after the commencement time, make publicly available the number of places included in a home care service immediately before the commencement time.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-82">
            <num>82</num>
            <heading>Delegation</heading>
            <content>
              <p>The amendments of subsection 96-2(1) of the <i>Aged Care Act 1997</i> and the <i>Aged Care (Transitional Provisions) Act 1997</i> made by this Schedule do not affect the continuity of any delegation that is in force under those subsections immediately before the commencement time.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-83">
            <num>83</num>
            <heading>Transitional rules</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-83__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters of a transitional nature (including prescribing any saving or application provisions) relating to the amendments or repeals made by this Act.</p>
              </content>
            </hcontainer>

                <p>To avoid doubt, the rules may not do the following:</p>
