          <p>		This Act may be cited as the <i>Safety, Rehabilitation and Compensation Legislation Amendment</i><i> </i><i>(</i><i>Exit Arrangements</i><i>)</i> <i>Act 201</i><i>6</i>.</p>

            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

                <p>if, after the cessation time, the employee is undertaking, or has completed, a rehabilitation program in relation to the injury—the successor is, for the purposes of <ref href="#sec-40">section 40</ref>, taken to be the relevant employer of the employee.</p>

                <p>the successor is neither a Commonwealth authority nor an Entity; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41C__para-e">

                <p>before the cessation time, an employee of the body corporate suffered an injury resulting in an incapacity for work or an impairment;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41C__para-f">
              <num>f</num>

                <p>	(f)	the definition of <b><i>rehabilitation authority</i></b> in subsection 4(1), and sections 36, 37, 38, 39, 41 and 41A, apply after the cessation time, in relation to the injury, as if:</p>

            <heading>Application of rehabilitation provisions to the Australian Capital Territory if it ceases to be a Commonwealth authority</heading>
            <content>
              <p>If:</p>
              <p>then:</p>
            </content>
            <paragraph eId="schedule-1__clause-41D__para-a">
              <num>a</num>
              <content>
                <p>	(a)	the Australian Capital Territory ceases to be a Commonwealth authority at a particular time (the <b><i>cessation time</i></b>); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41D__para-b">
              <num>b</num>
              <content>
                <p>before the cessation time, a person employed by the Australian Capital Territory suffered an injury resulting in an incapacity for work or an impairment;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-41D__para-c">
              <num>c</num>
              <content>
                <p>	(c)	the definition of <b><i>rehabilitation authority</i></b> in subsection 4(1), and sections 36, 37, 38, 39, 41 and 41A, apply after the cessation time, in relation to the injury, as if the Australian Capital Territory had not ceased to be a Commonwealth authority; and</p>
              </content>
            </paragraph>

                <p>to determine, under <ref href="#sec-97C">section 97C</ref>A, 97CB or 97CC, the amount of any exit contributions payable by bodies corporate, and by the Australian Capital Territory, and to collect such contributions;</p>

                <p>to apply exit contributions paid under <ref href="#sec-97C">section 97C</ref>A, 97CB or 97CC as a result of a body corporate or the Australian Capital Territory ceasing to be a Commonwealth authority, together with interest earned on those exit contributions, in the same way as paragraph (ec) would have required Comcare to apply:</p>

                <p>so much of the Consolidated Revenue Fund as represents the amount that would be worked out using the formula in subsection 90C(3) if it were assumed that an amount was payable to Comcare under subsection 90C(2).</p>

                <p>the application of a provision of this Division requires the calculation of so much of available scheme funds as is attributable to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-96A__para-i">
              <num>i</num>
              <content>
                <p>premiums paid by an Entity, a body corporate or the Australian Capital Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-96A__para-ii">
              <num>ii</num>
              <content>
                <p>special premiums paid by an Entity, a body corporate or the Australian Capital Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-96A__para-iii">
              <num>iii</num>
              <content>
                <p>interest earned on the premiums and special premiums referred to in subparagraphs (i) and (ii); and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-96A__para-b">
              <num>b</num>
              <content>
                <p>Comcare does not have sufficient information to make the calculation;</p>
              </content>
            </paragraph>
            <content>
              <p>then:</p>
            </content>
            <paragraph eId="schedule-1__clause-96A__para-c">
              <num>c</num>
              <content>
                <p>Comcare may make such assumptions and estimates as Comcare considers reasonable; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-96A__para-d">
              <num>d</num>
              <content>
                <p>the calculation may rely on those assumptions and estimates.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-96B">
            <num>96B</num>
            <heading>Comcare-retained funds</heading>
            <content>
              <p>		For the purposes of this Division, <b><i>Comcare</i></b><b><i>-</i></b><b><i>retained funds</i></b> has the same meaning as in section 90C.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-96C">
            <num>96C</num>
            <heading>Principal officer</heading>
            <content>
              <p>		For the purposes of this Division, the <b><i>principal officer</i></b> of a body corporate (other than a Commonwealth authority or a licensed corporation) is the principal executive officer of the body corporate.</p>
            </content>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-10">
            <num>10</num>
            <heading>After paragraph 97A(1)(a)</heading>
            <content>
              <p>Insert:</p>
              <p>should, so far as practicable, be sufficient to meet Comcare’s liability (if any) under this Act (including liability under actions for non-economic loss), in respect of injuries suffered:</p>
            </content>
            <paragraph eId="schedule-1__clause-10__para-aa">
              <num>aa</num>
              <content>
                <p>have regard to the principle that the amount that represents so much of available scheme funds as is attributable to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-i">
              <num>i</num>
              <content>
                <p>premiums paid by the Entity or authority; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-10__para-ii">
              <num>ii</num>
              <content>
                <p>special premiums paid by the Entity or authority; and</p>
              </content>

                <p>exit contributions, or instalments of exit contributions, paid to Comcare by the Australian Capital Territory after the cessation time; and</p>

                <p>interest earned on exit contributions and instalments referred to in subparagraph (iv);</p>

              <p>exceeds Comcare’s liability (if any) under this Act (including liability under actions for non-economic loss), in respect of injuries suffered before the cessation time by employees of the Australian Capital Territory;</p>
              <p>Comcare may make a determination that a specified amount is payable to the Australian Capital Territory by way of a refund of the whole or a part of the exit contributions, or instalments of exit contributions, paid to Comcare by the Australian Capital Territory.</p>

              <num>2</num>
              <content>
                <p>For the purposes of subsection (1), the specified amount must be equal to or less than the excess.</p>
              </content>

                <p>The specified amount is to be paid by Comcare <quantity refersTo="#deadline">within 28 days</quantity> after the determination is made.</p>

                <p>A determination under subsection (1) may only be made during the 7-year period beginning at the cessation time.</p>
