          <p>		This Act may be cited as the <i>Australian Crime Commission </i><i>Amendment (National Policing </i><i>Information</i><i>) </i><i>Act 201</i><i>6</i>.</p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

          <p>Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.</p>

            <heading>Subsection 4(1)</heading>

              <p>Insert:</p>
              <p><b><i>accredited body</i></b>: see subsection 46A(5).</p>
              <p><b><i>Charges</i></b><b><i> Act</i></b> means the <i>Australian Crime Commission (National Policing Information </i><i>Charges</i><i>) Act 201</i><i>6</i>.</p>
              <p><b><i>Finance Minister </i></b>means the Minister administering the <i>Public Governance, Performance and Accountability Act 2013</i>.</p>
              <p><b><i>national policing </i></b><b><i>information</i></b> means information that:</p>
              <p>but does not include the following:</p>
              <p><b><i>national policing </i></b><b><i>information</i></b><b><i> functions</i></b> means the ACC’s functions set out in paragraph 7A(fa).</p>

              <num>a</num>
              <content>
                <p>is collected by any of the following in the performance or exercise of its functions or powers:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-i">
              <num>i</num>
              <content>
                <p>the Australian Federal Police;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-ii">
              <num>ii</num>
              <content>
                <p>the police force of a State;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-iii">
              <num>iii</num>
              <content>
                <p>a body prescribed by the regulations; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-b">
              <num>b</num>
              <content>
                <p>is of a kind prescribed by the regulations;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-c">
              <num>c</num>
              <content>
                <p>any further information, opinion, interpretation or conclusion derived by the ACC from collected information;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-1__para-d">
              <num>d</num>
              <content>
                <p>any collected information included in an analysis, report or other presentation by the ACC of material referred to in paragraph (c).</p>
              </content>
            </paragraph>

            <paragraph eId="schedule-1__clause-5__para-gd">
              <num>gd</num>
              <content>
                <p>to determine, in writing, any conditions or restrictions in relation to providing nationally coordinated criminal history checks;</p>
              </content>
            </paragraph>

            <num>6</num>
            <heading>At the end of section 7C</heading>
            <content>
              <p>Add:</p>
              <p>Recommendations about charges for national policing information services</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-6__subclause-7">
              <num>7</num>
              <content>
                <p>Before the end of each financial year, the Board must recommend to <role refersTo="#minister">the Minister</role> in writing that <role refersTo="#minister">the Minister</role> either:</p>
              </content>

                <p>vary the legislative instrument under <ref href="#sec-7">section 7</ref> of the Charges Act in accordance with the recommendation; or</p>
              </content>

              <num>b</num>
              <content>
                <p>not vary the legislative instrument made under <ref href="#sec-7">section 7</ref> of the Charges Act.</p>
              </content>
            </paragraph>

              <content>
                <p>In making the recommendation, the Board:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-6__para-a">
              <num>a</num>
              <content>
                <p>must have regard to the principle that the charges and other fees imposed for national policing information services should cover the costs to the ACC of providing national policing information systems and services; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-b">
              <num>b</num>
              <content>
                <p>may have regard to any other matter the Board considers relevant.</p>
              </content>
            </paragraph>

                <p>If the Board recommends that <role refersTo="#minister">the Minister</role> vary the instrument, the recommendation must set out the matters considered by the Board.</p>

                <p>The Board may make recommendations to the Inter-Governmental Committee in relation to the composition and functioning of the Board.</p>

                <p>If the Board recommends that the composition of the Board be changed, the Board must also recommend what changes (if any) should be made to <ref href="#sec-7F">section 7F</ref> (quorum at Board meetings), <ref href="#sec-7G">section 7G</ref> (voting at Board meetings) and <ref href="#sec-7J">section 7J</ref> (resolutions outside of Board meetings).</p>

                <p>The ACC must not perform its national policing information functions other than:</p>
              </content>
            </hcontainer>

              <num>a</num>
              <content>
                <p>for purposes related to matters that are peculiarly adapted to the government of a nation and that cannot otherwise be carried on for the benefit of the nation; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-b">
              <num>b</num>
              <content>
                <p>for purposes involving, or for purposes related to, the collection and transmission of information by a communication using a postal, telegraphic, telephonic or other like service within the meaning of paragraph 51(v) of the Constitution; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-c">
              <num>c</num>
              <content>
                <p>in, or for purposes related to, a Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-d">

                <p>	(d)	in or with respect to a Commonwealth place (within the meaning of the <i>Commonwealth Places (Application of Laws) Act 1970</i>); or</p>
              </content>
            </paragraph>

                <p>for purposes related to trade or commerce:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-i">

                <p>between Australia and places outside Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-ii">
              <num>ii</num>
              <content>
                <p>among the States; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-iii">
              <num>iii</num>
              <content>
                <p>within a Territory, between a State and a Territory, or between 2 Territories; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-f">
              <num>f</num>
              <content>
                <p>for purposes related to external affairs, including:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-i">
              <num>i</num>
              <content>
                <p>giving effect to an international agreement to which Australia is a party; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-ii">
              <num>ii</num>
              <content>
                <p>addressing matters of international concern; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-iii">
              <num>iii</num>
              <content>
                <p>by way of the performance of its functions in a place outside Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-g">
              <num>g</num>
              <content>
                <p>for purposes related to preventing the influx of criminals into Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-h">
              <num>h</num>
              <content>
                <p>for purposes related to the service and execution throughout the Commonwealth of the civil and criminal process and the judgments of the courts of the States; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-i">
              <num>i</num>
              <content>
                <p>by way of the provision of a service, for a purpose of the Commonwealth, to:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-i">
              <num>i</num>

                <p>the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-13__para-ii">

                <p>for purposes related to the executive power of the Commonwealth; or</p>

                <p>for purposes related to matters incidental to the execution of any of the legislative powers of the Parliament or the executive power of the Commonwealth.</p>
              </content>
            </paragraph>

                <p>In providing a nationally coordinated criminal history check, the ACC must comply with any condition or restriction determined by the Board.</p>
              </content>
            </hcontainer>

                <p>In this section:</p>
              </content>
            </hcontainer>
            <content>
              <p><b><i>Territory</i></b> means a Territory referred to in section 122 of the Constitution.</p>

                <p>The ACC may charge a fee for goods or services that are provided by the ACC in the course of performing its national policing information functions.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-15__subclause-2">
              <num>2</num>
              <content>
                <p>A fee charged under subsection (1) must not be such as to amount to taxation.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-15__subclause-3">
              <num>3</num>
              <content>
                <p>A fee charged under subsection (1):</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15__para-a">
              <num>a</num>
              <content>
                <p>is a debt due to the Commonwealth; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15__para-b">
              <num>b</num>
              <content>
                <p>is recoverable by the ACC, on behalf of the Commonwealth, in a court of competent jurisdiction.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-15A">
            <num>15A</num>
            <heading>National policing information charges</heading>
            <content>
              <p>Payment of charge</p>
              <p>Waiver etc. of charge</p>
              <p>Commonwealth liability for charge</p>
              <p><b><i>Commonwealth</i></b> includes a Commonwealth entity (within the meaning of the <i>Public Governance, Performance and Accountability Act 2013</i>) that cannot be made liable to taxation by a Commonwealth law.</p>

              <num>1</num>
              <content>
                <p>Charge imposed by the Charges Act on an application for, or the provision of, a kind of national policing information service is payable to the ACC, on behalf of the Commonwealth.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-15A__subclause-2">
              <num>2</num>
              <content>
                <p>If charge is imposed by the Charges Act on an application for, or the provision of, a kind of national policing information service, the amount of the charge:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15A__para-a">
              <num>a</num>
              <content>
                <p>is a debt due to the Commonwealth; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-15A__para-b">
              <num>b</num>
              <content>
                <p>is recoverable by the ACC, on behalf of the Commonwealth, in a court of competent jurisdiction.</p>
              </content>
            </paragraph>

              <content>
                <p>The ACC may, on behalf of the Commonwealth:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-15A__para-a">
              <num>a</num>
              <content>
                <p>waive or reduce, in a particular case or in particular cases, charge imposed by the Charges Act on an application for, or the provision of, a kind of national policing information service; or</p>
