          <p>		This Act is the <i>Registration of Deaths Abroad Amendment Act 2016.</i></p>

        <heading>Commencement</heading>
        <subsection eId="sec-2__subsec-1">
          <num>1</num>
          <content>
            <p>Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.</p>

              <p><b><i>State or Territory registrar </i></b>means a person who holds an office or position that has the function of keeping a register of deaths under a law of a State or Territory.</p>

              <p>Insert:</p>

          </hcontainer>

            <num>3A</num>
            <heading>Relevant State or Territory seal</heading>
            <content>
              <p>For the purposes of this Act:</p>
            </content>
            <paragraph eId="schedule-1__clause-3A__para-a">
              <num>a</num>
              <content>
                <p>	(a)	if a person holds office as the Registrar, <b><i>relevant State or Territory seal</i></b>, in relation to the person, means a seal used by the person, under a law of a State or Territory relating to the registration of deaths, in the person’s capacity as a State or Territory registrar; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3A__para-b">
              <num>b</num>
              <content>
                <p>	(b)	if a person is acting as the Registrar, <b><i>relevant State or Territory seal</i></b>, in relation to the acting Registrar, means a seal used by the acting Registrar, under a law of a State or Territory relating to the registration of deaths, in the acting Registrar’s capacity as a State or Territory registrar; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-3A__para-c">
              <num>c</num>
              <content>
                <p>	(c)	if a delegate of the Registrar is a State or Territory registrar, <b><i>relevant State or Territory seal</i></b>, in relation to the delegate, means a seal used by the delegate, under a law of a State or Territory relating to the registration of deaths, in the delegate’s capacity as a State or Territory registrar; and</p>

              <num>d</num>
              <content>
                <p>	(d)	if a delegate of the Registrar is an employee in the same State or Territory office or body as the Registrar, <b><i>relevant State or Territory seal</i></b>, in relation to the delegate, means a seal used by the Registrar, under a law of a State or Territory relating to the registration of deaths, in the Registrar’s capacity as a State or Territory registrar.</p>

                <p>There is to be a Registrar of Deaths Abroad.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> is to be appointed by <role refersTo="#minister">the Minister</role> by written instrument.</p>
              </content>
            </hcontainer>
            <content>
              <p>Note:	For reappointment, see <i>Acts Interpretation Act 1901</i>.<ref href="#sec-33A">section 33A</ref>A of the </p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-3">
              <num>3</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must not appoint a person to be <role refersTo="#registrar">the Registrar</role> unless:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-5__para-a">
              <num>a</num>
              <content>
                <p>the person is a State or Territory registrar; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-5__para-b">
              <num>b</num>
              <content>
                <p>the State or Territory concerned, by written notice given to <role refersTo="#minister">the Minister</role>, agrees to the appointment.</p>
              </content>
            </paragraph>
            <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-4">
              <num>4</num>
              <content>
                <p>A notice under paragraph (3)(b) may be given on behalf of a State or Territory by a Minister of the State or Territory.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-5">
              <num>5</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may at any time terminate the appointment of a person as <role refersTo="#registrar">the Registrar</role>.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-6">
              <num>6</num>
              <content>
                <p>Without limiting subsection (5), <role refersTo="#minister">the Minister</role> must terminate the appointment of a person as <role refersTo="#registrar">the Registrar</role> if the person ceases to be a State or Territory registrar.</p>
              </content>
            </hcontainer>
            <hcontainer name="subclause" eId="schedule-1__clause-5__subclause-7">
              <num>7</num>
              <content>
                <p><role refersTo="#registrar">The Registrar</role> may resign his or her appointment by giving <role refersTo="#minister">the Minister</role> a written resignation.</p>
              </content>
            </hcontainer>

              <num>8</num>
              <content>
                <p>The resignation takes effect on the day it is received by <role refersTo="#minister">the Minister</role> or, if a later day is specified in the resignation, on that later day.</p>
              </content>
            </hcontainer>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-6">
            <num>6</num>
            <heading>Acting Registrar</heading>
            <hcontainer name="subclause" eId="schedule-1__clause-6__subclause-1">
              <num>1</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> may, by written instrument, appoint a person to act as <role refersTo="#registrar">the Registrar</role>:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-6__para-a">
              <num>a</num>
              <content>
                <p>during a vacancy in the office of Registrar (whether or not an appointment has previously been made to the office); or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-b">
              <num>b</num>
              <content>
                <p>during any period, or during all periods, when <role refersTo="#registrar">the Registrar</role>:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-i">
              <num>i</num>
              <content>
                <p>is absent from duty or from Australia; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-ii">
              <num>ii</num>
              <content>
                <p>is, for any reason, unable to perform the duties of the office.</p>
              </content>
            </paragraph>
            <content>
              <p>Note:	For rules that apply to acting appointments, see sections 33AB and 33A of the <i>Acts Interpretation Act 1901</i>.</p>
            </content>
            <hcontainer name="subclause" eId="schedule-1__clause-6__subclause-2">
              <num>2</num>
              <content>
                <p><role refersTo="#minister">The Minister</role> must not appoint a person to act as <role refersTo="#registrar">the Registrar</role> unless:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-6__para-a">
              <num>a</num>
              <content>
                <p>the person is a State or Territory registrar; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-6__para-b">
              <num>b</num>
              <content>
                <p>the State or Territory concerned, by written notice given to <role refersTo="#minister">the Minister</role>, agrees to the appointment.</p>
              </content>
            </paragraph>

              <num>3</num>
              <content>
                <p>A notice under paragraph (2)(b) may be given on behalf of a State or Territory by a Minister of the State or Territory.</p>
              </content>
            </hcontainer>
          </hcontainer>

            <num>7</num>
            <heading>Subsection 7(1)</heading>
            <content>
              <p>Omit “at a place in the Australian Capital Territory approved by <role refersTo="#minister">the Minister</role>”.</p>

                <p><role refersTo="#registrar">the Registrar</role>’s signature; and</p>
              </content>
            </paragraph>

                <p>the relevant State or Territory seal;</p>
              </content>
            </paragraph>
            <content>
              <p>to appear on:</p>
              <p><role refersTo="#registrar">the Registrar</role> is taken to have:</p>
            </content>

              <num>c</num>
              <content>
                <p>a document (including a Certificate of Death Abroad and an entry in the Register) under this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-17__para-d">

                <p>a copy or extract made under this Act;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-17__para-e">
              <num>e</num>
              <content>
                <p>signed the document, copy or extract; and</p>

            </paragraph>
            <paragraph eId="schedule-1__clause-17__para-f">
              <num>f</num>
              <content>
                <p>sealed the document, copy or extract with the relevant State or Territory seal.</p>
              </content>
            </paragraph>

              <content>
                <p>All courts, judges and persons acting judicially must:</p>
              </content>
            </hcontainer>
            <paragraph eId="schedule-1__clause-17__para-a">
              <num>a</num>
              <content>
                <p>take judicial notice of the relevant State or Territory seal appearing on:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-17__para-i">
              <num>i</num>
              <content>
                <p>a document (including a Certificate of Death Abroad and an entry in the Register) under this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-17__para-ii">
              <num>ii</num>
              <content>
                <p>a copy or extract made under this Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-17__para-b">
              <num>b</num>
              <content>
                <p>in the absence of proof to the contrary, presume the document, copy or extract was duly sealed with the relevant State or Territory seal.</p>
              </content>
            </paragraph>
          </hcontainer>

                <p>This item applies to a thing purportedly done under the Principal Act before the commencement of this item, to the extent that the thing purportedly done would, apart from this item, be invalid because:</p>

              <num>a</num>
              <content>
                <p>a person was not appointed or validly appointed as <role refersTo="#registrar">the Registrar</role> under subsection 5(1) of the Principal Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-39__para-b">
              <num>b</num>
              <content>
                <p>a person was not appointed or validly appointed to act as <role refersTo="#registrar">the Registrar</role> under section 6 of the Principal Act; or</p>
              </content>
            </paragraph>

              <num>c</num>
              <content>
                <p>paragraph 8(2)(b) of the Principal Act was not complied with.</p>

                <p>subsection 5(2) of the Principal Act had not been enacted; or</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-39__para-b">
              <num>b</num>
              <content>
                <p>for paragraph (1)(b)—as if:</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-39__para-i">
              <num>i</num>
              <content>
                <p>the person had been validly appointed under <ref href="#sec-6">section 6</ref> of the Principal Act; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-39__para-ii">
              <num>ii</num>
              <content>
                <p>	(ii)	the words “who is engaged under the <i>Public Service Act 1999</i>” had not been included in section 6 of the Principal Act; or</p>
              </content>
            </paragraph>

              <num>c</num>
              <content>
                <p>for paragraph (1)(c)—as if paragraph 8(2)(b) of the Principal Act had not been enacted.</p>
              </content>
            </paragraph>

            <num>40</num>
            <heading>Pending applications for the registration of a death</heading>
            <content>
              <p>If:</p>
              <p>the <i>Registration of Deaths Abroad Act 1984 </i>(as amended by this Act) has effect as if:</p>
            </content>
            <paragraph eId="schedule-1__clause-40__para-a">
              <num>a</num>
              <content>
                <p>before the commencement of this item, an application was made under subsection 10(1) of the Principal Act for the registration of a death; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-40__para-b">
              <num>b</num>
              <content>
                <p>the death was not registered under <ref href="#sec-12">section 12</ref> of the Principal Act before the commencement of this item; and</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-40__para-c">
              <num>c</num>
              <content>
                <p>no decision to refuse to register the death under <ref href="#sec-12">section 12</ref> of the Principal Act was made before the commencement of this item;</p>
              </content>
            </paragraph>
            <paragraph eId="schedule-1__clause-40__para-d">
              <num>d</num>
              <content>
                <p>	(d)	the application had been made to the Registrar (within the meaning of the <i>Registration of Deaths Abroad Act 1984 </i>(as amended by this Act)) for the registration of the death; and</p>
              </content>
            </paragraph>

              <num>e</num>
              <content>
                <p>the application had been so made immediately after the commencement of this item.</p>
              </content>
            </paragraph>
          </hcontainer>
          <hcontainer name="clause" eId="schedule-1__clause-41">

            <heading>Notification that State or Territory registrar will not register death</heading>
            <content>
              <p>Paragraph 8(2)(b) of the <i>Registration of Deaths Abroad Act 1984</i> (as amended by this Act)<i> </i>applies in relation to a death, whether occurring before, at or after the commencement of this item.</p>

            <heading>Judicial notice of the mark of a stamp etc.</heading>
