            <p>This Act establishes a register of information about screening associated with certain types of cancer.</p>
            <p>The purposes of the register relate to:</p>

              <p>supporting cancer screening programs; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-b">
            <num>b</num>
            <content>
              <p>providing access to information about cancer screening and diagnoses; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-3__para-c">
            <num>c</num>
            <content>
              <p>cancer screening matters more broadly.</p>
            </content>
            <content>
              <p>There are protections for sensitive information.</p>
            </content>
          </paragraph>
        </section>
        <section eId="part-1__sec-4">
          <num>4</num>
          <heading>Definitions</heading>
          <content>
            <p>In this Act:</p>
            <p><term refersTo="#term-approved-form">approved form</term> means <def>a form approved under subsection 25(1).</def></p>
            <p><term refersTo="#term-child-protection-officer">child protection officer</term> means <def>an officer or employee of a State or Territory, or of a State or Territory authority, who has functions, powers or duties in relation to the care, protection or welfare of children.</def></p>
            <p><term refersTo="#term-civil-penalty-provision">civil penalty provision</term> has the same meaning as <def>in the Regulatory Powers Act.</def></p>
            <p><term refersTo="#term-claims-information">claims information</term> means <def>information about: 	(a)	claims for medicare benefit under <i>Health Insurance Act 1973</i>; or<ref href="#part-I">Part I</ref>I of the  treatment, other than information that relates to compensation or benefits, provided under any of the following Acts: 	(i)	the <i>Australian Participants in British Nuclear Tests </i><i>and British Commonwealth Occupation Force </i><i>(Treatment) Act 2006</i>; 	(ii)	the <i>Military Rehabilitation and Compensation Act 2004</i>; 	(iii)	the <i>Safety, Rehabilitation and Compensation Act 1988</i>; 	(iiia)	the <i>Treatment Benefits (Special Access) Act 2019</i>; 	(iv)	<i>Military Rehabilitation and Compensation Act 2004</i>.<ref href="#sec-1">section 1</ref> of the </def></p>

            <num>a</num>
            <content>
              <p>	(a)	claims for medicare benefit under <i>Health Insurance Act 1973</i>; or<ref href="#part-I">Part I</ref>I of the </p>

              <p><term refersTo="#term-commercial-in-confidence">commercial-in-confidence</term> has the meaning given by <def><ref href="#sec-5">section 5</ref>.</def></p>
              <p><term refersTo="#term-contracted-service-provider">contracted service provider</term> has the meaning given by <def>subsection 22A(10).</def></p>
              <p><term refersTo="#term-designated-cancer">designated cancer</term> means <def>one of the following types of cancer: bowel cancer; cervical cancer; lung cancer.</def></p>

            <num>a</num>
            <content>
              <p>bowel cancer;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>cervical cancer;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">
            <num>c</num>
            <content>
              <p>lung cancer.</p>
            </content>
            <content>
              <p><term refersTo="#term-enforcement-body">enforcement body</term> has the same meaning as <def>in <ref href="">the Privacy Act 1988</ref>.</def></p>
              <p><b><i>entity</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>a person; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>a partnership; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">
            <num>c</num>
            <content>
              <p>any other unincorporated association or body; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-d">
            <num>d</num>
            <content>
              <p>a trust; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-e">
            <num>e</num>
            <content>
              <p>a part of another entity (under a previous application of this definition).</p>
            </content>
            <content>
              <p><term refersTo="#term-healthcare">healthcare</term> means <def>health service <ref href="#sec-6__subsec-1">within the meaning of subsection 6(1)</ref> of <ref href="">the Privacy Act 1988</ref>.</def></p>
              <p><b><i>healthcare provider</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>an individual healthcare provider; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>a healthcare provider organisation.</p>
            </content>
            <content>
              <p><term refersTo="#term-healthcare-provider-organisation">healthcare provider organisation</term> means <def>an entity that has conducted, conducts, or will conduct, an enterprise that provides healthcare (including healthcare provided free of charge).</def></p>
              <p><term refersTo="#term-individual-healthcare-provider">individual healthcare provider</term> means <def>an individual who: has provided, provides, or is to provide, healthcare; or is registered by a registration authority as a member of a particular health profession.</def></p>

                <p>Note:	Because of paragraph (e) of the definition of <b><i>entity</i></b>, a healthcare provider organisation could be part of an entity.</p>

          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>has provided, provides, or is to provide, healthcare; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>is registered by a registration authority as a member of a particular health profession.</p>
            </content>
            <content>
              <p><term refersTo="#term-key-information-for-an-individual">key information for an individual</term> means <def>the following: the individual’s name, address, contact details, date of birth and gender; 	(b)	the individual’s healthcare identifier (within the meaning of the <i>Healthcare Identifiers Act 2010</i>) if any; 	(c)	the individual’s medicare number (within the meaning of <i>National Health Act 1953</i>) if any;<ref href="#part-VI">Part VI</ref>I of the  the number allocated to the individual by the Veterans’ Affairs Department if any; if applicable, the individual’s date of death;</def></p>

          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>the individual’s name, address, contact details, date of birth and gender;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>	(b)	the individual’s healthcare identifier (within the meaning of the <i>Healthcare Identifiers Act 2010</i>) if any;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">
            <num>c</num>
            <content>
              <p>	(c)	the individual’s medicare number (within the meaning of <i>National Health Act 1953</i>) if any;<ref href="#part-VI">Part VI</ref>I of the </p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-d">
            <num>d</num>
            <content>
              <p>the number allocated to the individual by the Veterans’ Affairs Department if any;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-e">
            <num>e</num>
            <content>
              <p>if applicable, the individual’s date of death;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-f">
            <num>f</num>
            <content>
              <p><term refersTo="#term-if-the-register">if the register</term> includes <def>information relating to the individual in connection with screening associated with cervical cancer: the individual’s sex; and the individual’s Human Papillomavirus vaccination status and number of doses of the vaccine administered to the individual; the individual’s Indigenous status; the individual’s country of origin or cultural identity; the individual’s preferred language and whether an interpreter is required to facilitate communication with the individual; the name and contact details of a personal representative of the individual if any; if applicable, information on assistance required by the individual for the purposes of this Act because of a medical condition or disability; any other information of a kind relevant to the purposes of the register and prescribed by the rules for the purposes of this definition. <b><i>nominated healthcare provider</i></b> of an individual, for screening associated with a designated cancer, means the healthcare provider the individual requested be recorded for screening associated with the designated cancer in a request in effect under section 14. <b><i>parent</i></b>: without limiting who is a parent of anyone for the purposes of this Act, a person is the <b><i>parent</i></b> of another person if the other person is a child of the person within the meaning of the <i>Family Law Act 1975</i>.</def></p>

            <num>i</num>
            <content>
              <p>the individual’s sex; and</p>
            </content>

              <p>if applicable, information on assistance required by the individual for the purposes of this Act because of a medical condition or disability;</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-l">

              <p>any other information of a kind relevant to the purposes of the register and prescribed by the rules for the purposes of this definition.</p>
            </content>
            <content>
              <p><b><i>nominated healthcare provider</i></b> of an individual, for screening associated with a designated cancer, means the healthcare provider the individual requested be recorded for screening associated with the designated cancer in a request in effect under section 14.</p>
              <p><b><i>parent</i></b>: without limiting who is a parent of anyone for the purposes of this Act, a person is the <b><i>parent</i></b> of another person if the other person is a child of the person within the meaning of the <i>Family Law Act 1975</i>.</p>
              <p><term refersTo="#term-participating-state-or-territory">participating State or Territory</term> means <def>a State or Territory that has agreed with the Commonwealth to participate in the register.</def></p>
              <p><term refersTo="#term-personal-information">personal information</term> has the same meaning as <def>in <ref href="">the Privacy Act 1988</ref>.</def></p>
              <p><b><i>personal representative</i></b>, of an individual, means:</p>

          </paragraph>

            <num>a</num>

              <p>a parent or guardian of the individual, if the individual is incapable of managing his or her health affairs; or</p>
            </content>
          </paragraph>

              <p>a trustee of an estate of the individual, if the individual is under a legal disability; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">
            <num>c</num>

              <p>a person who holds an enduring power of attorney granted by the individual; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-d">
            <num>d</num>
            <content>
              <p>a person nominated by the individual for the purpose of managing the individual’s affairs in relation to screening associated with a designated cancer.</p>
            </content>
            <content>
              <p><b><i>professional disciplinary authority</i></b> means:</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-a">
            <num>a</num>
            <content>
              <p>a registration authority; or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-b">
            <num>b</num>
            <content>
              <p>	(b)	the Health Care Complaints Commission established by the <i>Health Care Complaints Act 1993</i> (NSW); or</p>
            </content>
          </paragraph>
          <paragraph eId="part-1__sec-4__para-c">
            <num>c</num>
            <content>
              <p>	(c)	the Health Ombudsman appointed under the <i>Health Ombudsman Act 2013</i> (Qld); or</p>
            </content>
          </paragraph>

              <p>any other authority that is responsible for investigating complaints about the professional conduct of individual healthcare providers.</p>

              <p><term refersTo="#term-protected-information">protected information</term> means <def>personal information or information that is commercial-in-confidence, to the extent that the information is: included in the register or otherwise obtained under, or in accordance with, this Act; or derived from a record of information that was included in the register or was otherwise obtained under, or in accordance with, this Act; or derived from a disclosure or use of information that was included in the register or was otherwise obtained under, or in accordance with, this Act.</def></p>

              <p>included in the register or otherwise obtained under, or in accordance with, this Act; or</p>

              <p><term refersTo="#term-register">register</term> means <def>the National Cancer Screening Register established under <ref href="#sec-9">section 9</ref>.</def></p>
              <p><term refersTo="#term-registration-authority">registration authority</term> means <def>an entity that is responsible under a law for registering members of a particular health profession.</def></p>
              <p><term refersTo="#term-regulatory-powers-act">Regulatory Powers Act</term> means <def>the Regulatory Powers (Standard Provisions) Act 2014.</def></p>
              <p><term refersTo="#term-rules">rules</term> means <def>the rules made under <ref href="#sec-28">section 28</ref>.</def></p>
              <p><term refersTo="#term-screening">screening</term> means <def>a process in which an individual undergoes testing or procedures in order to determine whether the individual has: a designated cancer or a precursor to a designated cancer; or any indicator, including genetic markers or cell abnormalities, that may lead to a designated cancer.</def></p>

          <heading>Meaning of commercial-in-confidence</heading>

An individual can also request that information notified by healthcare providers relating to the individual not be included in the register.</p>

                <p>The purposes of the register are to facilitate the following:</p>

                  <p>establishing and keeping an electronic database of records relating to screening and diagnoses associated with the designated cancers;</p>
                </content>

                  <p>collecting, analysing and publishing statistics and other information relating to screening and diagnoses associated with the designated cancers;</p>

                  <p>monitoring the effectiveness, quality and safety of screening and diagnoses associated with the designated cancers;</p>

                  <p>providing an individual with an invitation to undergo screening;</p>

                  <p>reporting to international organisations in relation to the designated cancers;</p>

                  <p>research relating to healthcare, screening or a designated cancer.</p>
                </content>
              </paragraph>
            </subsection>

                <p>For an individual who has a personal representative:</p>
              </content>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-2__para-a">
                <num>a</num>
                <content>
                  <p>paragraphs (1)(d) and (e) also apply to providing the representative with an invitation or test kit for the individual; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-2__sec-12__subsec-2__para-b">

                  <p>paragraph (1)(f) also applies to advising the representative; and</p>

                <p>The individual healthcare provider prescribed by the rules for a type of screening test or diagnosis prescribed by the rules must notify the Commonwealth Chief Medical Officer in the approved form, by the time prescribed by the rules, of the information prescribed by the rules for the type of screening test or diagnosis.</p>

                <p>An individual may, in the approved form, make any of the following requests:</p>

                  <p>that a particular healthcare provider be recorded as the individual’s nominated healthcare provider for screening associated with a designated cancer;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-14__subsec-1__para-b">
                <num>b</num>
                <content>
                  <p>that the individual not be given, at all or for a period of time, by (or on behalf of) the Commonwealth:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-14__subsec-1__para-i">
                <num>i</num>
                <content>
                  <p>any invitation of a kind referred to in paragraph 12(1)(d) or test kit referred to in paragraph 12(1)(e) in relation to screening associated with a designated cancer; or</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-14__subsec-1__para-ii">
                <num>ii</num>
                <content>
                  <p>any advice of a kind referred to in paragraph 12(1)(f) in relation to screening associated with a designated cancer;</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-14__subsec-1__para-c">
                <num>c</num>
                <content>
                  <p>that information relating to the individual that is:</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-14__subsec-1__para-i">

                  <p>about a designated cancer; and</p>
                </content>
              </paragraph>
              <paragraph eId="part-2__dvs-4__sec-14__subsec-1__para-ii">

                  <p>notified under <ref href="#sec-13">section 13</ref> after the date of the request;</p>
                </content>
                <content>
                  <p>not be included in the register;</p>
                </content>

                  <p>that a date by which the register indicates the individual is due to undergo a screening test associated with cervical cancer be changed;</p>

                  <p>that the register use a pseudonym for the individual.</p>

                <p>An individual may, in the approved form, withdraw any request made under subsection (1).</p>

                <p>The Commonwealth must give effect to a request or withdrawal under this section as soon as practicable.</p>

        <heading>Dealing with information in the register</heading>

          <heading>Simplified outline of this Part</heading>
          <content>
            <p>Information can be collected for inclusion in the register.</p>
            <p>Personal information included in the register, or derived from information included in the register, is “protected information”.</p>
            <p>Section 18 makes it an offence for a person to record, disclose or use protected information without authorisation.</p>
            <p>Recording, disclosure and use of protected information is authorised in specific circumstances, including for the purposes of the register and by healthcare providers and States and Territories.</p>
            <p>There are also a number of exceptions to the offence.</p>

        </section>
        <section eId="part-3__sec-17">
          <num>17</num>
          <heading>Authorised dealings with information</heading>
          <content>
            <p>Uploading personal information etc. to the register</p>
          </content>
          <subsection eId="part-3__sec-17__subsec-1">
            <num>1</num>
            <content>
              <p>A person may collect, make a record of, disclose or otherwise use:</p>
            </content>
            <paragraph eId="part-3__sec-17__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>personal information; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>key information for an individual; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>information that is commercial-in-confidence;</p>
              </content>
              <content>
                <p>if the person does so for the purposes of including information in the register.</p>
              </content>

              <p>Subsection (1) does not apply to information notified under <ref href="#sec-13">section 13</ref> to the extent that collection, recording, disclosure or use under the subsection would be contrary to a request in effect under <ref href="#sec-14">section 14</ref>.</p>

            <content>
              <p>Using or disclosing information in the register</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-17__subsec-3">
            <num>3</num>
            <content>
              <p>A person may collect, make a record of, disclose or otherwise use protected information, or key information included in the register, if:</p>
            </content>
            <paragraph eId="part-3__sec-17__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the person does so for the purposes of the register and is:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>an officer or employee of the Commonwealth or of an authority of the Commonwealth; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>engaged by the Commonwealth, or by an authority of the Commonwealth, to perform work relating to the purposes of the register; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-iii">
              <num>iii</num>
              <content>
                <p>an officer or employee of a person referred to in subparagraph (ii), or engaged by a person referred to in subparagraph (ii) to perform work relating to the purposes of the register; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>all of the following apply:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the person is a healthcare provider;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>the information is about screening or diagnosis associated with a designated cancer in relation to an individual;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-iii">
              <num>iii</num>
              <content>
                <p>the collection, recording, disclosure or use is for the purposes of providing healthcare to the individual in relation to the designated cancer; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>the collection, recording, disclosure or use is required or permitted by the law of a participating State or Territory, and the person is:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>a State or Territory authority of the participating State or Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>an officer or employee of the participating State or Territory, or of a State or Territory authority of the participating State or Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-iii">
              <num>iii</num>
              <content>
                <p>engaged by the participating State or Territory, or by a State or Territory authority of the participating State or Territory, to perform work relating to the information; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-iv">
              <num>iv</num>
              <content>
                <p>an officer or employee of a person referred to in subparagraph (iii), or engaged by a person referred to in subparagraph (iii) to perform work relating to the information; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-d">
              <num>d</num>
              <content>
                <p>the person does so for the purposes of performing the person’s functions, or exercising the person’s powers, under this Act; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-e">
              <num>e</num>
              <content>
                <p>the person is required or authorised to do so by or under a law of the Commonwealth or of a State or Territory; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-f">
              <num>f</num>
              <content>
                <p>the information is disclosed to the person under this section and the collection, recording, disclosure or use is for the purposes for which the information was disclosed to the person; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-g">
              <num>g</num>
              <content>
                <p>all of the following apply:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the person is <role refersTo="#secretary">the Secretary</role>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-ii">
              <num>ii</num>
              <content>
                <p>the collection, recording, disclosure or use is for the purposes of disclosing information to a professional disciplinary authority, a child protection officer or an enforcement body;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-iii">
              <num>iii</num>
              <content>
                <p>the person reasonably believes that the information will enable or assist <role refersTo="#authority">the authority</role>, officer or body to perform or exercise any of <role refersTo="#authority">the authority</role>’s, officer’s or body’s functions or powers; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-h">
              <num>h</num>
              <content>
                <p>the person does so for the purposes of court or tribunal proceedings, or in accordance with an order of a court or tribunal; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-17__subsec-3__para-i">
              <num>i</num>
              <content>
                <p>the person does so for the purposes of a coronial inquiry, or in accordance with an order of a coroner.</p>
              </content>

            <content>
              <p>Subsection (3) does not apply to protected information or key information to the extent that collection, recording, disclosure or use under the subsection would be contrary to a request in effect under <ref href="#sec-14">section 14</ref>.</p>

          </subsection>
          <subsection eId="part-3__sec-17__subsec-5">
            <num>5</num>
            <content>
              <p>	(5)	Collection, recording, disclosure or use of personal information for the purposes of research of a kind to which guidelines approved under <i>Privacy Act 1988</i> relate is authorised under paragraph (3)(a) or (f) only if the collection, recording, use or disclosure is in accordance with the guidelines.<ref href="#sec-95">section 95</ref> or 95A of the </p>
            </content>
          </subsection>
        </section>
        <section eId="part-3__sec-18">
          <num>18</num>
          <heading>Offence relating to protected information</heading>
          <content>
            <p>A person commits an offence if:</p>
          </content>
          <paragraph eId="part-3__sec-18__para-a">
            <num>a</num>
            <content>
              <p>the person makes a record of, discloses or otherwise uses information; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-18__para-b">
            <num>b</num>
            <content>
              <p>the information is protected information; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-18__para-c">
            <num>c</num>
            <content>
              <p>the making of the record, or the disclosure or use, is not authorised by <ref href="#sec-17">section 17</ref>.</p>
            </content>
            <hcontainer name="penalty">

                <p>Penalty:	<quantity refersTo="#custodialSentence">Imprisonment for 2 years</quantity> or <quantity refersTo="#penaltyUnit">120 penalty units</quantity>, or both.</p>

          <heading>Exception for use in good faith</heading>
          <content>
            <p>Section 18 does not apply to a person to the extent that the person makes a record of, discloses or otherwise uses protected information in good faith and in purported compliance with <ref href="#sec-17">section 17</ref>.</p>

            <p>Section 18 does not apply to a person if:</p>

              <p>the person makes a record of, discloses or otherwise uses information; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-20__para-b">
            <num>b</num>
            <content>
              <p>the information is commercial-in-confidence; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-20__para-c">
            <num>c</num>
            <content>
              <p>the person does not know that the information is commercial-in-confidence.</p>
            </content>

          <heading>Exceptions relating to the person to whom the protected information relates</heading>
          <subsection eId="part-3__sec-21__subsec-1">
            <num>1</num>
            <content>
              <p>Section 18 does not apply to a person if:</p>
            </content>
            <paragraph eId="part-3__sec-21__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>the person discloses protected information to the person to whom the information relates; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-21__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>the person is the person to whom the protected information relates; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-21__subsec-1__para-c">
              <num>c</num>
              <content>
                <p>the making of the record, or the disclosure or use, of the protected information is in accordance with the express or implied consent of the person to whom the information relates.</p>

              <p>Subsection (1) applies as if a reference in that subsection to the person to whom the protected information relates includes a reference to the person’s personal representative.</p>

          </subsection>
        </section>
        <section eId="part-3__sec-22">
          <num>22</num>
          <heading>Exception for disclosure to person who provided the information</heading>
          <content>
            <p>Section 18 does not apply to a person if:</p>
          </content>
          <paragraph eId="part-3__sec-22__para-a">
            <num>a</num>
            <content>
              <p>the person obtains protected information from another person; and</p>
            </content>
          </paragraph>
          <paragraph eId="part-3__sec-22__para-b">
            <num>b</num>
            <content>
              <p>the person discloses that information to the other person.</p>
            </content>

              <p>If <role refersTo="#secretary">the Secretary</role> becomes aware (otherwise than because of a notice under subsection (2)) that a person has, or may have, contravened section 18 in a manner involving an unauthorised recording, use or disclosure of personal information included in the register, <role refersTo="#secretary">the Secretary</role> must, as soon as practicable, notify <role refersTo="#information-commissioner">the Information Commissioner</role>.</p>

              <p>If a contracted service provider or a former contracted service provider becomes aware that a person has, or may have, contravened <ref href="#sec-18">section 18</ref> in a manner involving an unauthorised recording, use or disclosure of personal information included in the register, the contracted service provider or former contracted service provider must, as soon as practicable, notify:</p>

              <num>a</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role>; and</p>
              </content>
            </paragraph>

                <p>if the notice is given under subsection (2)—the identity and contact details of the contracted service provider or former contracted service provider.</p>

              <content>
                <p>Handling possible contraventions</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-22A__subsec-4">
            <num>4</num>
            <content>
              <p>If <role refersTo="#secretary">the Secretary</role>, or a contracted service provider or former contracted service provider, becomes aware that a person may have contravened section 18 in a manner involving an unauthorised recording, use or disclosure of personal information included in the register, <role refersTo="#secretary">the Secretary</role>, or the contracted service provider or former contracted service provider, must do the following:</p>

            <paragraph eId="part-3__sec-22A__subsec-4__para-a">
              <num>a</num>
              <content>
                <p>so far as is reasonably practicable, contain the possible contravention;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22A__subsec-4__para-b">
              <num>b</num>
              <content>
                <p>evaluate any risks that, if the contravention has occurred, may be related to or arise out of the contravention;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22A__subsec-4__para-c">
              <num>c</num>
              <content>
                <p>if there is a reasonable likelihood that the contravention has occurred and the effects of the contravention might be serious for at least one individual whose details are included in the register:</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22A__subsec-4__para-i">
              <num>i</num>
              <content>
                <p>in the case of <role refersTo="#secretary">the Secretary</role>—consult <role refersTo="#information-commissioner">the Information Commissioner</role> about notifying individuals who may be affected; or</p>

              <p>If <role refersTo="#secretary">the Secretary</role>, or a contracted service provider or former contracted service provider, becomes aware that a person has contravened section 18 in a manner involving an unauthorised recording, use or disclosure of personal information included in the register, <role refersTo="#secretary">the Secretary</role>, or the contracted service provider or former contracted service provider, must do the following:</p>

              <num>a</num>
              <content>
                <p>so far as is reasonably practicable, contain the contravention and undertake a preliminary assessment of the causes;</p>
              </content>
            </paragraph>

                <p>evaluate any risks that may be related to or arise out of the contravention;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22A__subsec-5__para-c">

                <p>in the case of <role refersTo="#secretary">the Secretary</role>—consult <role refersTo="#information-commissioner">the Information Commissioner</role> about notifying individuals who may be affected;</p>

              <p>A person is not required to comply with subsection (1) or (2) in relation to a contravention that has occurred if the person has already given notice under that subsection that the contravention may have occurred.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-22A__subsec-8">
            <num>8</num>
            <content>
              <p>A person is not required to comply with paragraph (5)(c) or (d) in relation to a contravention if the person has already consulted, or asked <role refersTo="#secretary">the Secretary</role> to consult, <role refersTo="#information-commissioner">the Information Commissioner</role> under paragraph (4)(c) in relation to the contravention.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-22A__subsec-9">
            <num>9</num>
            <content>
              <p>A contracted service provider or former contracted service provider is not required to comply with subsection (2), subparagraph (4)(c)(ii) or paragraph (5)(d) in relation to a contravention that has, or may have, occurred if another person has already:</p>
            </content>
            <paragraph eId="part-3__sec-22A__subsec-9__para-a">
              <num>a</num>
              <content>
                <p>given notice in relation to the contravention under subsection (1) or (2); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22A__subsec-9__para-b">
              <num>b</num>
              <content>
                <p>consulted, or asked <role refersTo="#secretary">the Secretary</role> to consult, <role refersTo="#information-commissioner">the Information Commissioner</role> in relation to the contravention under paragraph (4)(c) or (5)(c) or (d).</p>
              </content>
              <content>
                <p>Contracted service providers</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-22A__subsec-10">
            <num>10</num>
            <content>
              <p>In this Act:</p>
            </content>
            <content>
              <p><b>contracted service provider</b> means a person who:</p>
            </content>
            <paragraph eId="part-3__sec-22A__subsec-10__para-a">
              <num>a</num>
              <content>
                <p>is engaged under an agreement referred to in <ref href="#sec-26">section 26</ref>; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22A__subsec-10__para-b">
              <num>b</num>
              <content>
                <p>obtains protected information in the course of performing services under the agreement.</p>
              </content>
            </paragraph>
          </subsection>
        </section>
        <section eId="part-3__sec-22B">
          <num>22B</num>
          <heading>Contravention is an interference with privacy</heading>
          <subsection eId="part-3__sec-22B__subsec-1">
            <num>1</num>
            <content>
              <p>An act or practice that contravenes <ref href="#sec-18">section 18</ref> or subsection 22A(1), (2), (4), (5) or (6) is taken to be:</p>
            </content>
            <paragraph eId="part-3__sec-22B__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>	(a)	for the purposes of the <i>Privacy Act 1988</i>, an interference with the privacy of an individual; and</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22B__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>covered by <ref href="#sec-13">section 13</ref> of that Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-22B__subsec-2">
            <num>2</num>
            <content>
              <p>	(2)	The respondent to a complaint under the <i>Privacy Act 1988</i> about an act or practice, other than an act or practice of an agency or organisation, is the person who engaged in the act or practice.</p>
            </content>
          </subsection>
          <subsection eId="part-3__sec-22B__subsec-3">
            <num>3</num>
            <content>
              <p>	(3)	In addition to the Information Commissioner’s functions under the <i>Privacy Act 1988</i>, the Information Commissioner has the following functions in relation to the register:</p>
            </content>
            <paragraph eId="part-3__sec-22B__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>to investigate an act or practice that may be an interference with the privacy of an individual under subsection (1) and, if <role refersTo="#information-commissioner">the Information Commissioner</role> considers it appropriate to do so, to attempt by conciliation to effect a settlement of the matters that gave rise to the investigation;</p>
              </content>
            </paragraph>
            <paragraph eId="part-3__sec-22B__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>to do anything incidental or conducive to the performance of those functions.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-3__sec-22B__subsec-4">
            <num>4</num>
            <content>
              <p><role refersTo="#information-commissioner">The Information Commissioner</role> has power to do all things that are necessary or convenient to be done for or in connection with the performance of his or her functions under subsection (3).</p>

          <heading>Information Commissioner may disclose details of investigations to the Secretary</heading>
          <content>
            <p><role refersTo="#information-commissioner">The Information Commissioner</role> is authorised to disclose to <role refersTo="#secretary">the Secretary</role> any information or documents that relate to an investigation <role refersTo="#information-commissioner">the Information Commissioner</role> conducts because of the operation of section 22B, if <role refersTo="#information-commissioner">the Information Commissioner</role> is satisfied that to do so will enable the Commonwealth to monitor or improve the operation or security of the register.</p>
          </content>

              <p>For the purposes of Part 4 of the Regulatory Powers Act, each of the following persons is an authorised applicant in relation to the civil penalty provisions of this Act:</p>
            </content>
            <paragraph eId="part-4__sec-24__subsec-2__para-a">
              <num>a</num>
              <content>
                <p><role refersTo="#secretary">the Secretary</role>;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>an SES employee, or an acting SES employee, in the Department.</p>
              </content>
              <content>
                <p>Relevant court</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-24__subsec-3">
            <num>3</num>
            <content>
              <p>For the purposes of Part 4 of the Regulatory Powers Act, each of the following courts is a relevant court in relation to the civil penalty provisions of this Act:</p>
            </content>
            <paragraph eId="part-4__sec-24__subsec-3__para-a">
              <num>a</num>
              <content>
                <p>the Federal Court of Australia;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-3__para-b">
              <num>b</num>
              <content>
                <p>the Federal Circuit and Family Court of Australia (<ref href="#dvs-2">Division 2</ref>);</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-24__subsec-3__para-c">
              <num>c</num>
              <content>
                <p>a court of a State or Territory that has jurisdiction in relation to the matter.</p>
              </content>
              <content>
                <p>Extension to external Territories</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-24__subsec-4">
            <num>4</num>
            <content>
              <p>Part 4 of the Regulatory Powers Act, as that Part applies in relation to the civil penalty provisions of this Act, extends to every external Territory.</p>
            </content>
            <content>
              <p>Liability of Crown</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-24__subsec-5">
            <num>5</num>
            <content>
              <p>Part 4 of the Regulatory Powers Act, as that Part applies in relation to the civil penalty provisions of this Act, does not make the Crown liable to a pecuniary penalty.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-25">
          <num>25</num>
          <heading>Approved forms</heading>
          <subsection eId="part-4__sec-25__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, in writing, approve a form for the purposes of a provision of this Act.</p>
            </content>
          </subsection>
          <subsection eId="part-4__sec-25__subsec-2">
            <num>2</num>
            <content>
              <p>A request or withdrawal of a request required by a provision of this Act to be in the approved form must be given to the person specified in the form for that purpose.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-26">
          <num>26</num>
          <heading>Agreements</heading>
          <content>
            <p><role refersTo="#minister">The Minister</role> may, on behalf of the Commonwealth, engage a person under a written agreement to perform services for or on behalf of the Commonwealth in connection with functions of the Commonwealth, <role refersTo="#minister">the Minister</role> or the Commonwealth Chief Medical Officer under this Act.</p>
          </content>
        </section>
        <section eId="part-4__sec-27">
          <num>27</num>
          <heading>Delegation</heading>
          <subsection eId="part-4__sec-27__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, in writing, delegate his or her functions or powers under:</p>
            </content>
            <paragraph eId="part-4__sec-27__subsec-1__para-a">
              <num>a</num>
              <content>
                <p><ref href="#sec-5">section 5</ref> (about commercial-in-confidence information); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-27__subsec-1__para-b">
              <num>b</num>
              <content>
                <p><ref href="#sec-25">section 25</ref> (about approving forms); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-27__subsec-1__para-c">
              <num>c</num>
              <content>
                <p><ref href="#sec-26">section 26</ref> (about engaging persons under agreements);</p>
              </content>
              <content>
                <p>to an SES employee, or an acting SES employee, in the Department.</p>
              </content>
            </paragraph>
          </subsection>

            <num>2</num>
            <content>
              <p><role refersTo="#secretary">The Secretary</role> may, in writing, delegate his or her functions or powers under:</p>

              <content>
                <p>paragraph 17(3)(g) (about disclosing information); or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-27__subsec-2__para-b">

              <content>
                <p><ref href="#sec-22A">section 22A</ref> (about data breaches);</p>
              </content>
              <content>
                <p>to an SES employee, or an acting SES employee, in the Department.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-27__subsec-3">
            <num>3</num>
            <content>
              <p>In performing a function, or exercising a power, under a delegation, the delegate must comply with any directions of <role refersTo="#minister">the Minister</role> or <role refersTo="#secretary">the Secretary</role>.</p>
            </content>
          </subsection>
        </section>
        <section eId="part-4__sec-28">
          <num>28</num>
          <heading>Rules</heading>
          <subsection eId="part-4__sec-28__subsec-1">
            <num>1</num>
            <content>
              <p><role refersTo="#minister">The Minister</role> may, by legislative instrument, make rules prescribing matters:</p>
            </content>
            <paragraph eId="part-4__sec-28__subsec-1__para-a">
              <num>a</num>
              <content>
                <p>required or permitted by this Act to be prescribed by the rules; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-28__subsec-1__para-b">
              <num>b</num>
              <content>
                <p>necessary or convenient to be prescribed for carrying out or giving effect to this Act.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-28__subsec-1A">
            <num>1A</num>
            <content>
              <p>Before making rules for the purposes of:</p>
            </content>
            <paragraph eId="part-4__sec-28__subsec-1A__para-a">
              <num>a</num>
              <content>
                <p>	(a)	paragraph (l) of the definition of <b><i>key information</i></b> in section 4; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-28__subsec-1A__para-b">
              <num>b</num>
              <content>
                <p>paragraph 11(g);</p>
              </content>
              <content>
                <p>the Minister must consult the Information Commissioner in relation to matters that relate to the privacy functions (within the meaning of the <i>Australian Information Commissioner Act 2010</i>) and have regard to any submissions made by the Information Commissioner because of that consultation.</p>
              </content>
            </paragraph>
          </subsection>
          <subsection eId="part-4__sec-28__subsec-2">
            <num>2</num>
            <content>
              <p>To avoid doubt, the rules may not do the following:</p>
            </content>
            <paragraph eId="part-4__sec-28__subsec-2__para-a">
              <num>a</num>
              <content>
                <p>create an offence or civil penalty;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-28__subsec-2__para-b">
              <num>b</num>
              <content>
                <p>provide powers of:</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-28__subsec-2__para-i">
              <num>i</num>
              <content>
                <p>arrest or detention; or</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-28__subsec-2__para-ii">
              <num>ii</num>
              <content>
                <p>entry, search or seizure;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-28__subsec-2__para-c">
              <num>c</num>
              <content>
                <p>impose a tax;</p>
              </content>
            </paragraph>
            <paragraph eId="part-4__sec-28__subsec-2__para-d">
              <num>d</num>
              <content>
                <p>set an amount to be appropriated from the Consolidated Revenue Fund under an appropriation in this Act;</p>

            </paragraph>

              <content>
                <p>directly amend the text of this Act.</p>

                <p>A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made.
